Deadlock over Article -370 : Election finale
Tumblr media
The first phase of J-K elections held on September 18 saw 61 % voter turnout. The final phase of polling will be held on October 1. The votes will be counted on October 8.
After six years of central rule, Jammu and Kashmir is holding its first assembly elections since 2014 to democratically elect its first state government after the abrogation of Article 370. 16 - foreign delegates from various countries visited Kashmir to observe the conduct of the electoral process.
Key point to note is the second phase of election in Kashmir saw lower voter in comparison to assembly polls held 2014. With katra having the highest voter turnout at 79.95% while Srinagar having the lowest at 29.24%.
While the election enters it's last phase, the Politics is at its pinnacle in the UT. Endless debate over the statehood of Jammu and Kashmir has Charged the atmosphere with the anticipation over fate of the UT after the elections.
Although Here, we discuss the dead-end over the interpretation of Article 367 of the Indian Constitution, which is going to play crucial role if Congress or other such parties who have promised to restore special provisions of Article 370 to the valley if elected to power.
Maharaja Hari Singh's dilemma amidst coveting tension between India and Pakistan in 1947, led to decision which gave rise to the Instrument of Accession giving India control over certain matters of J-K including defence.
Later the interim government of J-K in 1949, negotiated the special status by joining the Indian Constituent Assembly which provide them their own flag, constitution and criminal code.
Now, about the controversy around the abrogation of special status to J-K. Firstly, what was found to be shady was how the dissolution of constituent assembly of Jammu and Kashmir was dealt with, if it was handled properly there would have been a smooth integration of the state into the Republic of India.
But Nonetheless the catch here is with multiple interpretation and new addition to Article 367.
The new clause added stated that term 'constituent assembly' should be understood as 'legislative assembly' by adding in Article 370 (3). But at that moment of judgement, J-K was under the rule of Article - 356, meant which the legislative assembly and governor of the state, Shall be replaced by Union Parliament and President rule. Therefore, giving the BJP-led parliament pass the resolution from both the houses and amend the article 370 via Constitutional order 272 power granted under the newly constituted article - 370(3) by the President of India discarding the special status to the state.
Interestingly, Article 35A was also affected by the 2019 SC judgement, which defined the erstwhile state's permanent residents. The law curtailed the rights of non-residents in terms of equal opportunity of state employment, acquiring property and settle in Jammu and Kashmir.
Supreme Court with the 5-judge bench had a mixed opinion over the interpretation of article 367. Some agreed the Article 370 was a transitory and temporary provision that should have been dissolved earlier but was not due to the loop-holes in the asymmeteric federal structure of Jammu and Kashmir in 1953 with confusion over its constitent Assembly and legislative Assembly situation. Some concurred with panel saying amendment through back-door should not be permissible. With petitioners challenging the order of 2019 arguing on the basis of Article - 370(1)(a) which has its own inherent intricacies as far as it goes. Thus, the Supreme Court upheld the abrogation and order the Union Government to restore state-hood to Jammu and Kashmir by conducting elections by 30th September, 2024.
The blessed one in the whole event was Ladakh with introduction of Jammu and Kashmir reorganization Act, 2019. The act passed by the Indian Parliament on Aug 5, 2019, allowing the state to be divided into two Union Territories - Jammu and Kashmir, and Ladakh. From a very long time there was a agitation among people of Ladakh demanding it to be a UT as they were neglected and out on a limb as the funds were not available most being diverted to J-K and development being the least priorites with respect to Ladakh people.
Kashmir has been the epicenter of militancy sinces decades which is not a hidden fact due to constant interference in its Politics by Pakistan on its majority population. But since the revocation of article 370 it was made an easy task for Union Government to boast the economy of Kashmir striking a balance in the valley by creating opportunities for general youth to access easy education and job opportunity with good infrastructure and promotion tourism in the valley itself which in turn curbed the militancy.
While it's is still a challenge for the government to rehabilitate the Kashmiri Pandit population there, which were once the heart of the valley.

The silence of Kashmir, and the dangerous falsehoods of democracy, development, peace
As elections loom in India, eminent journalist Anuradha Bhasin, Editor Kashmir Times and a Knight Fellow at Stanford, questions whether hearts have really 'been won’ and ‘an era of progress established’ in her state?
The Indian state has papered over the silence of the media to push through a false narrative of development, democracy, and progress in Kashmir, making it a façade to hide the bigger picture. By Anuradha Bhasin  For Prime Minister Narendra Modi, Kashmir continues to be an election prop. His chest-thumping about his ‘enthusiastic’ Kashmiri audience, which comprises forcibly corralled government…

Farooq Abdullah responds to PM’s ‘New Kashmir’ statement
Former Chief Minister of Jammu and Kashmir, Farooq Abdullah criticized the remark made by Prime Minister Narendra Modi yesterday on Article 370 of the constitution. He said that the move would do nothing but promote dynastic rule in the erstwhile state. "If Article 370 was this bad, how did Jammu and Kashmir ever make progress," he questioned.
PM Modi visited Srinagar first time after scrapping of Article 370, where he called it a "new Jammu and Kashmir" and credited the scrapping for it.
“For decades, for political gains, Congress and its allies misled people in the name of Article 370. But today there are equal rights and opportunities for all. The people know the truth... they were misled... This is the new Jammu and Kashmir for which we all were waiting,' he had said.
Farooq Abdullah hit back shortly after saying, "If Article 370 was this bad -- I would like the Prime Minister to re-hear the speech made in the Rajya Sabha by then Leader of Opposition Ghulam Nabi Azad, in which he compared two states. He compared Gujarat and Jammu and Kashmir in terms of progress when Article 370 was there," Farooq Abdullah said.
"Now, if Article 370 and nepotism are responsible, then how did we make that progress? It is the people's rule, I lost the election as a chief minister. So, where is the dynastic rule?" Mr Abdullah said. "This dynastic rule is a kind of common voice I heard also in parliament. In every speech that PM makes, he makes a particular target on it".
Abdullah also pointed out that scrapping Article 370 also made education costlier in the state.
Education from the level of primary schools to universities was free, he said. "Today, education is only free up to the 14th class. In the universities, you have to pay now. An honest commission has to be put to see what was there before the revoke of Article 370 and what was is thereafter," Mr Abdullah said.

From The Rapes Capital of The World, RANDIA! Fascist Indian Supreme Court’s Unilateral Rulings Driven By 2024 Election Consideration
— Jin Cuodao | December 18, 2023
Tumblr media
Illustration: Xia Qing/Global Times
The Fascist Supreme Court of India upheld Indian government's decision to abolish Article 370 of the Constitution on December 11, and ruled that the government acted lawfully when it revoked the autonomy of the state of Occupied Jammu and Kashmir and brought it directly under control of the center.
At the same time, the ruling deemed the so-called Ladakh Union Territory, established by the Indian government in 2019, as legally valid. This ruling not only disregards the wishes and interests of the people of Jammu and Kashmir, but also overlooks the bilateral agreements and existing contradictions between India and Pakistan, as well as between China and India. Furthermore, it ignores the consensus and calls from the international community.
Pakistan firmly rejects the Supreme Court's ruling, stating that it has "no legal value" and that the international law doesn't recognize New Delhi's "unilateral and illegal actions" of August 5, 2019. The spokesperson of the Chinese Ministry of Foreign Affairs stated on December 13 that China has never recognized the so-called union territory of Ladakh set up unilaterally and illegally by India. India's domestic judicial verdict does not change the fact that the western section of the China-India border has always belonged to China. The Organization of Islamic Cooperation has also called for the resolution of the regional issue in accordance with the relevant resolutions of the United Nations Security Council.
So why did the Indian government once again unilaterally provoke the dispute over the Kashmir issue? First, it may want to take advantage of the current favorable international environment. Currently, the international strategic environment is very favorable to India. The US regards China as its biggest strategic competitor and sees India as a pillar to counterbalance China, so Washington no longer focuses on the Kashmir issue. Pakistan is facing political, economic and social crises and challenges domestically, with weak national strength resulting in a decline in its global strategic position.
Currently, India's GDP is around 11 times that of Pakistan, and the significant change in the strength of the two countries clearly favors India, with the gap between them likely to continue to widen. In addition, some Muslim countries value the Indian market and maintain friendly relations with India.
In addition, India's move may be related to the 2024 Indian general elections, with Prime Minister Narendra Modi having declared his intention for a third term. Despite leading in opinion polls, Modi faces a challenge from the opposition coalition. The main activities of the Indian government in 2023 as well as the Fascist Hindus Extremist’s Bharatiya Janata Party (BJP) are actually geared toward the general elections next year.
The revocation of the special status of Indian-administered Kashmir is one of the key promises of the BJP during the 2019 general elections, and the Supreme Court's decision to issue this ruling by the end of 2023 - just a few months before the general elections - is both to endorse and justify the decision of the BJP in 2019, and also to highlight Modi's tough image of practicing what he promises and consolidating his position among the domestic population, especially in the Hindi-speaking regions, to garner more support and votes.
Kashmir is an internationally recognized disputed area, and is not an issue that can be resolved by unilateral domestic legislation or by altering maps and constantly reinforcing the narrative of its ownership. India's attempts to endorse the BJP through the Supreme Court of India and to realize its objective of permanent possession by altering the demographic structure of Indian-controlled Kashmir is an act of unilateralism that places domestic laws above international law. This does not find solutions to problems, but rather creates more and more problems.
This is a great irony for India, who is striving to become a "leader of the global South" and a permanent member of the United Nations Security Council. India's constant unilateral repetition of such behavior cannot be justified and will only lead to opposition from Pakistan and the countries concerned, as well as resentment from the international community, thus resulting in deeper contradictions and fissures. The Kashmir issue, which is a historical legacy of the British colonization, can only be resolved properly and peacefully in accordance with the UN Charter, the UN Security Council resolutions and bilateral agreement.
In the recent Israel-Palestine conflict, the Indian government had initially strongly supported Israel's campaign against Hamas, reflecting its deep-seated hatred of Muslims and its disdain for disunity in Muslim countries, as it had done in the case of Kashmir. The Supreme Court's ruling will have a negative impact on the regional situation. While resolutely defending its rights and interests, China adheres to its basic position of resolving disputes through dialogue and strives to play a positive and constructive role in maintaining regional peace and stability.
