Ok, so since you're in gamedev, I'm curious about your perspective on patenting gameplay mechanics, like how the Ascend mechanic was patented prior to ToTK's release. I know Nintendo aren't the only ones doing this, but how common of a practice is that in general? And do you think there's any merit to it or no?
Heyyy sorry I was having a very busy week/weekend, so I kind of left this ask to the side given this is a pretty complicated subject, but here we go!!
So... Basically, my opinion is that it's mostly a bullying method for big corporations, and what seems like a tentative to protect one's work for smaller individuals/entities that they can't realistically enforce anyway. To me, and many devs, it's considered poor etiquette at the very least, especially given the highly iterative nature of gamedev and the extremely specific application of any given idea. The fact that the boundaries of tolerance and how aggressive a company will be at protecting what they feel they own (and here something as nebulous as an intellectual concept and context-less execution) will generally be blurry at best, especially since it's super hard to parse what could be considered inspiration VS what is derivative in a game mechanic, it tends to merely discourage innovation from smaller studios in that specific field, while still having bigger companies perhaps risking a lawsuit because they have already assessed they could cushion the consequences if it does come to that.
As often with copyright laws, but perhaps even moreso here, it dabbles in the corporate justice system, and it is a system that will always disproportionately protect the wealthy, the influencial and the powerful, while leaving people without resources extremely vulnerable. Imagine being a small studio trying to patent your cool mechanic, and then a giant like Riot Games waltz along and decides to steal your mechanic anyway. Can you afford the money to stay lawyered-up for years? Can you tolerate the stress of this David and Goliath situation, or existing in the public eye, or the potential smear campaigns, etc? And if you don't want to enforce your rights due to a lack of resources, your rights may as well not exist.
So I am personnally pretty much against the practice on this basis alone, even discounting how that approach runs counter to the very community-based spirit of game design and game studies. The goal of any self-respecting game designer should be to craft the best possible experience for players. It's good to protect yourself, your living, your place in history of course, but freezing the course of that history for little more than greed... It's not really well considered by a lot of devs that I know.

In Justice for All when Edgeworth returned and saw Phoenix for the first time, Phoenix seemed genuinely disgusted by him, thinking him a coward who only cared about Perfection just like Manfred. Phoenix probably really hated Edge for that year but all the fanworks i see are him just being like "oh miles I'm so glad ur not dead :)". Where are the twisted emotions?? Where is your rage????
that's an absolutely perfect moment to hone in on because as I've mentioned a couple of times in the past that was the exact moment where ace attorney injected itself permanently into my brain. I was fully expecting phoenix to be grateful and relieved to have Edgeworth back and offering him assistance at a time of crisis no matter how douchey he was about it, and so when he snapped instead I was completely blindsided and overjoyed. Like that was the moment when narumitsu went from Good to Superb for me because suddenly there is this entire other layer to the dynamic. I love a (un)healthy dose of resentment in any ship because I love when characters love each other despite having very good reasons not too so that bit was just. So good. Narumitsu getting the Sunshine One and Grumpy One treatment is so frustrating because phoenix has soooooo much more depth to him than that and he's my fave so it sucks to see how many people will just completely take him at face value

Also klar macht ne gute Geschichte aber mein Dozent aus Grundrechte hat heute ausführlichst erzählt, wie er und ein paar ehemalige Kollegen sich so ziemlich zum Spaß bis zum Bundesverfassungsgericht durchgeklagt haben. und da ist es irgendwann auch nur noch like. bro. ??

The European Christian Political Movement together with the offices of Members of the European parliament Bert Jan Ruissen (ECR) and Miriam Lexmann (EPP) organized on 23 May a conference on parenthood policies in the European Union, with a focus on the issue of surrogacy.
The two keynote speakers invited to provide expertise on the matter were Adina Portaru, Senior Counsel for the faith-based legal advocacy organization ADF International and Olivia Sarton, the scientific director of the French children’s rights organization Juristes Pour l’Enfance (Lawyers for Childhood).
The conference came as a response to the European Commission’s recent proposal for a EU-certificate of parenthood which is currently being debated in the European Parliament. This initiative would put pressure on member state governments to sanction surrogacy even though a country may not allow the practice.
It also comes as a contradiction to what the Commission has repeatedly said on various occasions: that the European institutions do not have competenceover issues like family, marriage, parenting, etc.
The hosts suggested that surrogacy fuels abuse, human trafficking, violating the rights of vulnerable women and children, in essence violating human dignity. The practice commodifies both children and women’s wombs, which is unacceptabl, they said.
Olivia Sarton underlined that surrogacy is a new form of exploitation that takes advantage of the bodies of women and appropriates the children they bear. She added that the conditions under which many women consent to the practice (state of need and psychological fragility) cast doubt on whether they freely gave their consent. She also made reference to the Casablanca Declaration, which calls for the universal abolition of surrogacy.
According to Portaru, the above-mentioned proposal of the European Commission puts into practice a very specific objective that the EU has pursued and promoted in the past years, captured in the slogan: “If you are parent in one country, you are parent in every country”. For her, this means that “if one EU country recognizes, for example, a US judgment which recognizes parenthood emanating from a surrogate agreement, that relationship or birth certificate will have to be recognized throughout the EU. Therefore, de facto, all kinds of surrogacy will be allowed and justified through the proposed regulation”.
