"COURT DECLARES WILL OF MAN WAS FORGERY," Montreal Star. July 10, 1934. Page 5. ---- Sister Found to Have Written Document ---- When Joseph Rondeau, a bachelor of St. Jean de Matha died in September, 1932, he left an estate of $20,000. No will could be found at the time but shortly after Delia Rondeau, a sister, produced what she declared to be a holograph will signed by Joseph which read: "1st. September, 1932. I give all to my sister, Delia, what I possess, my goods as well as money I give them all to Delia." She produced this at the prothonotary's office at Joliette for but Mrs. probate, Pacific Geoffroy, another sister, claimed it was a forgery and fraud and took action in the courts to secure her share of the estate on the ground that Joseph had died intestate.
The case was heard by Mr. Justice Forest in the Superior Court, Joliette, and in a judgment given yesterday the court held that the will was a forgery, that perjury had been committed by the defendant, and that the action would be maintained with costs. His Lordship pointed out that Delia Rondeau was liable to prosecution for the falsehoods she had told in court in an effort to take the estate away from the other heirs, that there was conclusive evidence that the writing on the document was in Delia's hand-writing, and did not resemble that of her brother as shown on other documents.
The defendant's attitude throughout the trial had been hostile, hesitant and in bad faith, and Mr. Justice Forest commented that one witness, Theona Rondeau who had supported the petition for probate had admitted that she was illiterate and could not recognize any signature and that "she was weary of the role which Delia made her play in the affair and had consulted her confessor for the peace of her conscience."
