Court Issues Stern Warning to Employers on Preventing Underpayments

The Federal Court of Australia (FCA) has imposed record penalties of $10.34 million against two related entities for multiple violations of the Fair Work Act 2009 (FW Act), resulting in significant underpayments.

The Better Off Overall Test (BOOT)

The enterprise agreements required CBA and CommSec to conduct BOOT assessments to ensure employees were better off overall. This involved:

– Comparing entitlements under the enterprise agreement with those under the relevant modern award at the end of each “relevant period” and making top-up payments if necessary.

– Comparing individual agreements against the terms of the enterprise agreement.

CBA and CommSec failed to perform these assessments, leading to approximately $16 million in underpayments. Despite being aware since December 2015 that they were not complying with these obligations, both entities failed to implement the necessary compliance practices and processes.

This constituted “serious contraventions” under section 557A of the FW Act, characterized by knowing violations that formed part of a systematic pattern of conduct over ten years, affecting a large number of employees.

Individual Flexibility Arrangement (IFAs) Violations

CBA and CommSec also breached section 50 of the FW Act by entering into invalid individual agreements with certain employees, resulting in underpayments of approximately $5.2 million. These underpayments included various allowances, leave entitlements, redundancy pay, and overtime.

False or Misleading Representations

CBA violated section 345 of the FW Act by falsely assuring employees that they would be better off under individual agreements compared to the enterprise agreement, which was untrue.

The FCA noted that the contraventions were significant, prolonged, and preventable by these large, wealthy institutions. The court emphasized that the focus should be on the systems, processes, and checks that allowed such a situation to persist.

The FCA declared that the penalties must be substantial enough to deter not only CBA and CommSec but also other potential violators. It stressed the need for general deterrence to ensure compliance, highlighting the importance of adequate systems to prevent and correct errors.

The court ordered penalties of $7.3 million for CBA and $3.03 million for CommSec, totaling $10.34 million, to be paid within 60 days. A small reduction was applied for self-reporting, cooperation with the FWO, and admission of liability.

The significant penalties in this case are meant to discourage other organizations from maintaining non-compliant systems under the FW Act or relevant modern awards or enterprise agreements. What works for film directors isn’t necessarily going to work for other leaders, says three-time Academy Award winner Oliver Stone.

“Purity works for film but is not necessary for making toothpaste,” he told the World Business Forum in Sydney in May.

But at least one thing remains key whether your business is in the arts, manufacturing or services.

“The leadership has to be authentic,” Stone says.

“You are trying get different groups working together — bringing it all together without fighting each other,” he commented in an interview with Chartered Accountants ANZ Chief Executive Lee White FCA.

Making a movie is like leading a business with multiple divisions and multiple goals. The challenge is to galvanise all the stakeholders into a cohesive operation working towards a shared vision.

“It’s very difficult. Actors have egos. Sometimes he won’t do what you think he should. Production designers often go off on their own – you see the set and you say ‘this is not what we talked about’.”

So how do you get everyone rowing in the same direction? Stone’s advice is simple.

“You start with a script.”

Think plan on a page. Think strategy summary. Think mission statement. It doesn’t matter what it is called. But it matters greatly that everyone in the business buys into it.

“There has to be something greater than yourself. People respect that. If they don’t respect you as a director the script still stands as a shining light. That works for people.”

Stone’s first major film success was as a scriptwriter. His screenplay for Midnight Express (1978) was turned into a hit film, earning Stone his first Academy Award. He also wrote crime hit Scarface (1983) and the less critically successful Conan the Barbarian (1982).

His directorial breakthrough came with Platoon in 1986. The realistic depiction of the life of a GI in Vietnam was controversial for showing violence by American troops against civilians. Stone, who served in the Vietnam War, says it is important for a country to understand the truth of its history.

But his script was not initially popular and sat on the shelf for a decade.

“The directors and actors who made the first Vietnam War movies had no realistic assessment of what war was like on the ground. When I saw Rambo and all those films I gave up.

“I got the chance to make it [Platoon] ten years after I wrote it. I never thought I would end up directing it.”

Stone says Vietnam was a tremendously ugly war.

“We went into the villages, like My Khe [a hamlet associated with the infamous My Lai killings], and messed with them constantly.

“I tried to tell what I thought was the truth. I got myself in a lot of hot water for doing it.”

But while some criticised the depiction of violence by American troops, others found in Platoon an opportunity to celebrate Vietnam veterans — although Stone says the film was never meant as a celebration.

“Generally, popular films are a result of a misunderstanding between the public and the director,” he chuckles wryly.

“I was fired by my first accountant because I didn’t make any money,” says Stone.

“It takes a certain kind of mind to wrap itself around bonds and dividends. I just couldn’t do it.”

Nevertheless, money, and the pursuit of it, has been a recurring theme in his movie career. Not least in the hit movie Wall Street (1987).

The film, in part inspired by Stone’s stockbroker father Lou, was a critique of the culture of excess in the financial markets of the 1980s. It struck a chord with audiences grossing US$4.1m on its opening weekend.

Stone’s father worked for Sanford Weill, who later formed Citigroup. Stone notes that after a highly successful career in the financial sector Weill now says it was “a bad thing” to deregulate Wall Street. Weill has also advocated reform of the banking industry.

“We know now, in the Reagan era many got rich, but many got poorer. But the 1980s have influenced America. We got more conservative in our politics.”

You can’t make movies without money and Stone has extensive experience dealing with sources of funding.

Producers in particular have an important role in the financial side of the movie business and are crucial, he says, for gaining funding. Stone has 28 production credits — including films such as JFK (1991) and The People vs Larry Flint (1996) — alongside his 29 credits as a director. And he is fairly cynical about where his funding comes from.

“Corporate boards have always been a problem in my life [in terms of getting funding for projects]. Boards take money out of companies to line their own pockets, not grow the company.”

Funding issues gave him advance warning of the GFC when money for a project was pulled as the crisis unfolded.

“Merrill Lynch was one of the funders and shooting was cancelled at the last minute. We knew something was happening on Wall Street but who knew it was one of the worst crises?”

His response to the GFC was Wall Street: Money Never Sleeps (2010), the follow-up to his 1980s smash hit.

“The crisis motivated me to do it. It was clear to me that Gekko had become the bank. I grew up when banks were banks but that’s no longer the case. There’s no way to save money, there are no interest rates, there’s nothing.”

Banks have distorted themselves, he says, and that’s difficult for people to understand.

“At the time I made Wall Street, talking about figures like 100 million dollars was a shock. Today it’s a billion or more, the scale of money is staggering.”

Talent Success in filmmaking, as in other business spheres, often comes down to how you manage your staff, he says.

And the big risk in movies is with the actors.

“Sometimes an actor is wrong. To say no is the key. If you get the wrong actor you are screwed.

“Sometimes you cover it up, as a lot of good directors have done. Otherwise you let the person go. Hopefully in the first two weeks before it is too late.”

There is a talent shortage in Hollywood just as there is often said to be in finance.

“You don’t have too much choice. You have availability issues, budget issues.

“Sometimes they give you a list and you can get the movie made with this list.”

Having got the talent in, the next challenge is how to get the best out of them.

“Sometimes you push an actor, sometimes you badger him. You might say ‘you do what you want’. Then one day he says ‘tell me what to do’. It’s a delicate balance.

“Some of them don’t even know what they are saying, but they are saying it well. They argue about it — I just think ‘that’s okay, if that is what they think it is about. You don’t even know what you are saying but you are giving a great performance’.”

Stone has made three biopics on US presidents — JFK (1991, two Academy Awards), Nixon (1995, four Academy Award nominations) and W. (2008). They weren’t equally successful.

“Kennedy [JFK] was a surprising hit worldwide. Part of that is because it is Kennedy, but it has good tension and thrust,” Stone says.

“A lot of people don’t like Nixon and his face on the poster didn’t do us any good.”

George W Bush was even less popular and this influenced the impact of W. at the box office.

“This fellow was one of the most hated presidents of his time. Nixon was three dimensional but Bush was two dimensional. Unlike Nixon, he was so confident he got up in the morning and looked in the mirror and liked what he saw. So he goes out and sells himself.

“He was the worst president the US has had.

“The movie came out at exactly the wrong time. When his popularity was about 30 per cent.”

While he does not try to hide his disdain for the former presidents, Stone is adamant that neither Nixon nor W. were political hatchet jobs.

“I’m a dramatist. Shakespeare didn’t like Richard the Third but he certainly did a good job. Both presidents I did not like but I made the movies not to show my political viewpoint, but to show theirs.”

It’s part of his desire to educate Americans about their history, something he has pursued through movies, documentaries and the television series Untold History of the United States.

He is evidently proud to relate that W. was considered bang on by some Bush supporters.

“Nancy Reagan, who knew him from his youth, said the movie was great. People say I’m a political filmmaker, but I’m a storyteller first and foremost.”

And as a dramatist he rates integrity and authenticity as keys to success. These are vital to motivate people, to convince people and to tell a good story.

LIVEME MILLIONAIRE CLUB MADNESS CONTEST - OFFICIAL RULES

1. How To Enter: The LiveMe Millionaire Club Madness Contest (the “Contest”) begins November 24, 2018 at 12:00 AM (PST) and ends December 5, 2018 at 11:59 PM (PST) (the “Contest Period”). At the start of the Contest Period, all active LiveMe users will be automatically entered into the Contest.

2.  How to Play: There is gameplay for Broadcasters and Gifters:

A.  Broadcaster Gameplay: To play, Broadcasters must compete to accumulate Diamonds while broadcasting. At the conclusion of the Contest Period, In addition, the top 5 Broadcasters from each Group with the most Diamonds accumulated will win the following Prize package:

Additionally, all Broadcasters who hit specific Diamond goals during the Contest Period will win a free Rebate Percentage (awarded as a rebate for Diamonds OR the cash value of the Diamonds at the time of award), as follows:

NOTE: Only Diamonds received during broadcasts (i.e. not via direct message) within the Contest Period will count.

B.    Gifter Gameplay:  Gifters will be ranked based on the cumulative amount of Coins Value gifted during the Contest and the top Gifter (who also recharges over $10,000) at the end of the Contest will win a 2019 Dodge Challenger SXT automobile valued at MSRP $27,595 (“Grand Prize Vehicle”).

Users determined in our sole discretion to be conducting any fraudulent recharge transaction will have their accounts frozen and may be punished to the fullest extent of the law.

3.   Winner Notification: All Winners will be notified by LiveMe direct message or email within seven (7) days after close of the Contest Period.  If the Prize Winner fails to respond to LiveMe’s notification or does not accept the prize awarded within twenty-four (24) hours following such notification, the Prize will be deemed forfeited and an alternate winner will be selected by LiveMe staff from the remaining eligible Users.  If any alternate similarly fails to respond or declines the awarded Prize, LiveMe staff will use a reasonable number of attempts, in its discretion, to award the Prize to additional alternate winners, but if it is unable to do so, the Prize will ultimately be deemed forfeited and LiveMe shall have no further liability in connection with this Contest.

4.  Eligibility:  Prize Winners must be active users in good standing at the close of the Contest Period to win.  Contest is only open to LiveMe users who are legal residents of the United States (and/or other countries in LiveMe's US region, including Canada) during the Contest Period. Grand Prize Vehicle is not available to users residing in New York, Rhode Island or Florida (the “Restricted States”) or any country besides the United States, and only available to users 21 years of age and older. If under the age of 21, or residing in one of the Restricted States or Countries, Grand Prize winner will receive a Diamond Bonus equivalent to the MSRP of the Grand Prize vehicle at the close of the Contest Period, which will be automatically delivered to the Winner’s LiveMe account.   In order to be eligible to receive the Grand Prize Vehicle, Winner must provide LiveMe with a signed Liability Waiver & Release (to be provided by LiveMe at time Winner is notified), which certifies that said Prize Winner agrees to assume full responsibility for any injuries or damages they may sustain as a result of their participation in the Prize awarded, including travel to or from the selected dealership destination to retrieve the Prize. In addition, the Prize Winner must agree to assume liability for and agree to indemnify and to hold LiveMe, its employees, agents, affiliates and subsidiaries harmless for all claims or damages caused, in whole or in part, by the Prize and any negligent, intentional, or other act or omission on the Prize winner’s part. Employees of LiveMe, its parents, affiliates and subsidiaries, participating advertising and promotion agencies, independent judging organizations, and prize suppliers (and members of their immediate family and/or those living in the same of household of each such employee) are not eligible.  Contest otherwise void where prohibited by law. Odds of winning a Prize will depend upon the total number of users during the Contest Period.

5.              Prize Issuance and Restrictions. After close of the Contest Period, Virtual Prizes will be awarded seven (7) days after close of the Contest Period. Cash Prizes (via rebate) will be awarded via PayPal or Payoneer.  Note, that LiveMe is not responsible for non-delivery to Winners who provide incorrect Paypal or Payoneer account information. Grand Prize vehicle winner will be contacted by LiveMe staff within 1-3 months for further information, provided that, Prize Winner is responsible for vehicle registration, license, tax, title and insurance fees and for all costs associated with any available upgrade/option not provided with the prize vehicle and any other expenses related to the acceptance and use of the prize not specified. Actual delivery date will be determined by LiveMe staff; Winner must take delivery of vehicle within 30 days of notice of availability from a US-based dealer selected by LiveMe in its sole discretion, or the Grand Prize may be forfeited. Winner must have a valid driver’s license and proof of insurance to take delivery. Vehicle awarded may differ from any vehicle shown in promotional materials. Vehicle color, options and equipment will be determined by LiveMe in its sole discretion. In lieu of accepting the Grand Prize vehicle, the winner may irrevocably elect to receive in-app virtual Diamonds, valued at the MSRP of the Grand Prize Vehicle at the close of the Contest Period. 1st Annual FCA Year-End Awards-THE WINNERS

The 1st Annual FCA Year-End Awards voting is officially over. Thank you to all who voted. Some categories were close in voting and overs were a runaway. I was a little surprise how some categories went. Now for the part you have all been waiting for. Who won?! Well let’s not wait any further:

FCA Lucha Underground Wrestler of 2018 -- Taya Valkyrie (31.8%): This was somewhat a surprise since she was only a small centerpiece of a storyline on Season 4 of Lucha Underground, but she left a good enough impression on you guys to earn the award this year. With the future of Lucha Underground in question, she might be the one and only winnner of the Lucha Underground Wrestler of the Year Award. Marty Martinez & Pentagon Dark tied for 2nd place with 18.2% of the votes and Taya’s husband, Johnny Mundo finished 3rd with 13.6% of the votes

FCA’s Mr. ROH 2018 -- Jay Lethal (23.8%): Jay Lethal made a resurgence back to the top of the ROH throne and carried the ROH flag throughout the entire year so it only made sense that the champ would win this honor. Marty Scrull & Dalton Castle tied for 2nd place with 19% of the votes and Hangman Page finished 3rd with 14.3% of the votes

FCA Cruiserweight/Jr. Heavyweight Wrestler of 2018 -- Mustafa Ali (35.7%): Although he never quite captured the WWE Cruiserweight title, he made up for it with stellar performances throughout the year to convince the fans that he was must see. He’s officially a member of the SmackDown roster and already has shown that he can hang with the best. Will Ospreay finished 2nd with 21.4% of the votes and Buddy Murphy finished 3rd with 14.3% of the votes.

FCA Viral Wrestler of 2018 -- Becky Lynch (77.8%): Becky Lynch lived up to her moniker of The Man. Her bloody face was all over social media and she was a savage on Twitter and can’t seem to stop. We don’t want her to stop. She ran away with this category. Tama Tonga & PAC tied for 2nd with 7.4% of the votes while Sami Callahan & The Young Bucks tied for 3rd with 3.7% of the votes

FCA Best Tag Team of 2018 -- The Undisputed Era (36.7%): Probably the most over tag team in the business, the Undisputed Era had a great 2018 in NXT’s tag team division winning the Dusty Rhodes Classic and becoming 2-time NXT Tag Team Champions. It makes total sense that they win this award and that, boys & girls, is UNDISPUTED. The Young Bucks finished 2nd with 16.7% of the votes and surprisingly The Revival finished 3rd with 13.3% of the votes.

FCA Best UK-Based Male Wrestler of 2018 -- Pete Dunne (68.2%): The current reigning & defending WWE United Kingdom Champion is currently the longest reigning titleholder on WWE’s roster right now and has taken on all who have challenged his throne. He’s earned the honor of being considered the UK’s best. Tyler Bate, WALTER & Zack Gibson tied for 2nd with 9.1% of the votes and Joe Coffey finished 3rd with 4.5% of the votes.

FCA Best NXT Match of 2018 -- TWO WAY TIE (20%): So I knew this category was gonna be tight, but a 2-way tie? I was coming up with this category, I struggled to pick one. That’s how good NXT was in 2018.  Johnny Gargano VS. Andrade Almas from TakeOver: Philadelphia & Johnny Gargano VS. Tommaso Ciampa in a Last Man Standing Match at TakeOver: Brooklyn 4 got the majority of the votes at 20% and both were definitely MOTY candidates. The Chicago Street Fight from TakeOver: Chicago 2 between Gargano and Ciampa finished 2nd with 16% of the votes. Tied for 3rd at 12% was Ricochet VS. Velveteen Dream from TakeOver: Chicago 2 & Aleister Black VS. Johnny Gargano from TakeOver: WarGames 2.

FCA Best NJPW Match of 2018 --  Kenny Omega VS. Chris Jericho //No DQ Match (WK12) (26.3%): When this was made official in 2017, Omega VS. Jericho was seen as a dream match and this match delivered on his hype and added on to the legend of both men. Omega’s battle with fellow Golden Lover, Kota Ibushi in the G1 Climax came in 2nd with 21.1% of the votes and coming in 3rd was the instant classic between Okada & Omega from the Dominion PPV.

FCA Best WWE Match of 2018 -- Becky Lynch VS. Charlotte Flair // Last Woman Standing (WWE Evolution) (65.5%): The Man & The Queen made history at the 1st ever all-women’s PPV in the 1st ever Last Woman Standing Match and it was an instant classic. Definitely worthy of being the best WWE Match of 2018. The Triple Threat TLC match from TLC 2018 between Asuka, Becky & Charlotte finished 2nd with 20.7% of the votes while the Triple Threat match at Wrestlemania 34 between Seth Rollins, Finn Balor & The Miz finished 3rd with 6.9% of the votes.

FCA Best UK-Based Female Wrestler of 2018 --  Rhea Ripley(45.5%): This was somewhat of a surprised to me, but in a short amount of time, Rhea Ripley made a lasting impression on fans with a great performance in the Mae Young Classic and winning a 8-woman tournament to become the 1st ever NXT UK Women’s Champion. Toni Storm finished 2nd with 40.9% of the vote and Isla Dawn, Jinny & Millie McKenzie tied for 3rd place 4.5& of the votes a piece.

FCA Best NXT Female Wrestler of 2018 -- Kairi Sane(30%): The former NXT Womens Champ had a great 2018 capturing the title for the 1st time at TakeOver: Brooklyn 4. She had an amazing rivalry with Shanya Baszler in 2018 and 2019 is looking bright for the Pirate Princess. Shayna Baszler came in 2nd with 20% of the votes and in 3rd was Nikki Cross with 16.7% of the votes.

FCA Best SD Live Female Wrestler of 2018 --  Becky Lynch(76.2%): Just like in the category for Viral Wrestler of 2018, Becky Lynch ran away with the majority of the votes which tells you the kind of 2018 Becky Lynch had. Coming 2nd with 9.2% of the votes each was Asuka & Charlotte Flair while Naomi came in 3rd with 4.8% of the votes.

FCA Best RAW Female Wrestler of 2018 -- Natayla (32.1%): This was a surprise winner here. While she didn’t have the most successful 2018 as far as achievements, she was a consistent performer in the ring and put on great matches. Ruby Riott came in 2nd with 21.4% of the votes and Sasha Banks finished in 3rd with 14.3% of the votes.

FCA Best WWE Female Wrestler of 2018 --  Becky Lynch(86.7%): Becky Lynch completes the clean sweep by winning this award capping off an amazing 2018 for The Man. Not one member of RAW was in the running for this award which shows how good SmackDown was. Charlotte & Asuka got the rest of the votes garnering 6.7% of the votes a piece.

FCA Best Impact Wrestling Female Wrestler of 2018 --  Taya Valkyrie(44.4%): Despite not competing on Impact Wrestling for a good portion of the year, you guys felt that she was the best of the Knockouts roster. Impact Knockouts Champ Tessa Blanchard came in 2nd with 33.3% of the votes and former champ Su Yung came in 3rd with 16.7% of the votes.

FCA Best NJPW Wrestler of 2018 -- Kenny Omega (16.7%): The reigning IWGP Heavyweight Champion had a great 2018 highlighted by finally defeating Kazuchika Okada for the heavyweight crown at Dominion. He also had a classic encounter with Chris Jericho at Wrestle Kingdom 12. His tag partner, Kota Ibushi came in 2nd with 13.9% of the votes and coming in 3rd place was Jay White with 11.1% of the votes.

FCA Best Impact Wrestling Wrestler of 2018 --  Pentagon Jr.(32%): CERO MIEDO! Pentagon Jr. made an impact (no pun intended) everywhere he went in 2018, but made a huge splash when he became the Impact World Heavyweight Champion back in April defeating Austin Aries and brother Fenix in an amazing triple threat match. Sami Callahan came in 2nd with 28% of the vote while Fenix & Johnny Impact finished 3rd receiving 12% of the votes each.

FCA Best RAW Male Wrestler of 2018 -- Seth Rollins(27.3%): As he stated himself, Seth Rollins carried RAW on his back throughout 2018 capturing the Intercontinental Championship and putting on the best performances just about every night. Finn Balor finished 2nd with 21.2% of the votes and Dean Ambrose finished 3rd with 15.2% of the votes.

FCA Best SD Live Male Wrestler of 2018 --  AJ Styles(31.4%): SmackDown Live was definitely the “House That AJ Styles Built” in 2018 dominating the year as WWE Champion putting on stellar performances. Daniel Bryan got 20% of the votes finishing 2nd and Andrade “Cien” Almas finished 3rd with 14.3% of the votes.

FCA Best NXT Male Wrestler of 2018 --  Tommaso Ciampa(25.6%): The self-proclaimed “Greatest Sports Entertainer of All Time” had probably the best (if not one of the best) 2018 of any wrestler in the business. He made his return from injury at NXT TakeOver: Philadelphia by attacking Johnny Gargano with a crutch which led to the best feud of 2018. Not only did he had an epic series of matches with his former DIY partner, but manage to capture the NXT Championship along the way. Former NXT Champ, Aleister Black finished 2nd with 23.1% of the votes while rising star Velveteen Dream finish 3rd with 15.4% of the votes.

FCA Best WWE Male Wrestler of 2018 -- Seth Rollins (43.9%): Not only did the majority of you feel like The Kingslayer was the best of RAW, but the best wrestler in WWE and it’s hard to argue. AJ Styles & The Miz tied for 2nd with 14.6% of the votes and coming in at 3rd with 9.8% of the votes was Dean Ambrose.

Ram Branding Pays Off

Fiat Chrysler America’s focus on building the Ram brand has paid off in a big way. Ram moved past the Chevrolet Silverado in total sales to end 2018. The progression moved Ram to the second spot behind the industry leading Ford F-150 in the U.S. pickup truck market. 

As second quarter sales figures will soon be announced Ram is hoping to hold onto the second spot. Ram held a 22,000 vehicle lead in sales over the Silverado at the end of May.
