Every day is January 6.
January 6, 2024
ROBERT B. HUBBELL
Every day is January 6. American democracy prevailed on January 6 because good people made extraordinary sacrifices to protect the Constitution and the rule of law. Good people did their jobs. Good people honored their oaths. Good people put themselves in harm’s way. Good people spoke the truth. Good people stared down a violent mob.
The mob was repelled on January 6—but has regrouped during the last three years. It assaults democracy anew each day with lies and threats of violence. It sees the Constitution as an obstacle to power. It sees honest politicians who honor their oaths as the enemy.
But take heart! There are more good people willing to defend the Constitution than members of the mob trying to bend it to their will. The good people who rallied to its defense on January 6 have prevailed in most political battles since January 6—and have every reason to believe they will do so in the future.
We must continue our resistance with the spirit of January 6 in our hearts and minds. Democracy is at stake—it always is. The only thing that has changed is that opponents of democracy have emerged from the shadows, setting their shame aside because their leader is shameless. But those who seek to protect and preserve democracy have the good fortune of being led by a good and decent man.
On the third anniversary of January 6, that good man—Joe Biden—spoke to the American people about the challenges we will face together as we defend democracy against the mob. He asked for our support. We should give it to him without reservation or doubt. Because in supporting him, we are supporting the Constitution—and ourselves.
Joe Biden’s speech at Valley Forge on the anniversary of January 6.
President Joe Biden spoke at a college near Valley Forge on the eve of the third anniversary of January 6. He spoke in plain and strong words to describe the threat to democracy posed by Donald Trump. Biden did not shy away from describing Trump's past crimes, his narcissism, lies, and dereliction of duty.
A video of the 30-minute speech is here, NBC News, Biden speaks at Valley Forge ahead of Jan. 6 anniversary, and key passages are here: Key quotes from US President Biden's Jan. 6 democracy speech.
Biden said, in part,
Today we're here to answer the most important of questions. Is democracy still America's sacred cause? This is not rhetorical, academic, or hypothetical. Whether democracy is still America's sacred cause is the most urgent question of our time. That's what the 2024 election is all about. These MAGA voices who know the truth about Trump on January 6 have abandoned the truth and abandoned democracy. They made their choice. Now the rest of us, Democrats, independents, mainstream Republicans, need to make our choice. Donald Trump's campaign is about him. Not America, not you. Donald Trump's campaign is obsessed with the past. Not the future. He's willing to sacrifice our democracy to put himself in power.

"Fayez Ataya (6-months old) died on 30 May. Abdulqader Al-Serhi (13 years-old) died on 1 June. Both children died from starvation. Mahmoud Fattouh (1-mos. old) died on 24 February. Yazan Al Kafarneh (10-yrs. old) died 4 March... starved by Israel”
There is therefore no doubt that famine has spread across all of Gaza.

Citizen arrest warrant for Mr. Biden & Ms. Harris
Will you take action? I invite you to use the following letter:
The Constitution of the United States of America contains provisions and laws for a secure border around the sovereign land of the United States of America. It further outlines laws required for all legal entry, immigration, into said Nation.
The executive office, the executive officers of the United States of America, the President of the United States and the Vice President of the United States, are duty and oath bound to execute said laws in adherence to provide for a common defense and protection for all sovereign land and citizens, ("The People") of the United States of America as stated in the United States Constitution, Article II.
The President takes the following oath when sworn into office:
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
The Vice President takes the following oath:
"I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God."
Mr. Joseph Biden swore to the President's oath when sworn into office.
Ms. Kamala Harris swore to the Vice President's oath when sworn into office. (Dates recorded on public record)
I, as a citizen of The United States of America, am bound to be faithful and loyal to the Constitution, not to a political party or person, by the following oath:
"...I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely, without any mental reservation or purpose of evasion; so help me God."
I further do and have pledged allegiance to the United States of America by the following pledge:
"I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all."
Both Mr. Biden and Ms. Harris are delinquent, derelict, and in violation of their oath's of office by not enforcing US border and immigration law as outlined by law in the said Constitution. Both parties are in violation of continuously breaking and neglecting their sworn oath and duty. Both are committing seditious acts, causing 26 States, a majority of the Republic's States to rebuff them for said dereliction and violation.
I, therefore, as a citizen, to be faithful and loyal to Almighty God on which this Republic stands, the Constitution of the United States of America, and to all its citizens, "The People," acting under my duty and authority provided me under and in the United States Constitution, to sustain, uphold, and defend the laws of said land, do hereby execute a citizen's arrest on Mr. Biden and Ms. Harris, and charge them with said delinquency, dereliction, violation, sedition, and treason against the United States of America, "The People," and its sovereign land, and hold them to be tried for said charges.I further call for the swearing into office persons who will follow, abide by, and faithfully and diligently carry out their oaths of offices by and in the authority of the United States Constitution and its citizens, "The People," to provide for their defense and protection. Specifically, I called for the swearing in of the Speaker of House of Representatives to said oath, protection, and defense of The United States of America.

Asleep At The Wheel
What happens when a driver falls asleep at the wheel of the car he is driving?  Typically it results in an accident, possibly the loss of at least one life, maybe more.  Kevin McCarthy, hired to represent the 330 million people living in the United States, has fallen asleep at the proverbial wheel and is driving this train right toward a cliff – fiscal and otherwise. Intentionally. On…

Dare We Say "Murderer"?
I have long contended that, taking into consideration his knowledge of the pandemic, along with his reckless disregard for the consequences of his inaction, Donald John Trump is guilty of second degree murder. It’s clear he was more interested in his re-election and “legacy” than the safety or security of the American people. One of the primary duties of the President is to protect the national…

The case in California vs Biden & Blinken
Taking a page from Trump & January 6th:
Dereliction of duty is recognized as a crime in some state laws, such as an Ohio statute governing law enforcement personnel, but no general federal law makes it a crime. There is, however, a robust body of dereliction of duty law in the armed forces. Since the president is commander in chief, there is some justice in invoking the concept, even though Trump was never subject to military law, either before or during his time in office. The Manual for Courts-Martial sets forth the elements of the offense of “dereliction in the performance of duties.” The first three apply across the board: (a) that the accused had certain duties; (b) that the accused knew or reasonably should have known of the duties; and (c) that the accused, willfully or through neglect or culpable inefficiency, failed to perform those duties. A fourth element applies where the dereliction of duty resulted in death or grievous bodily harm: (d) that such dereliction of duty resulted in death or grievous bodily harm to a person other than the accused. The manual elaborates: A person is derelict in the performance of duties when that person willfully or negligently fails to perform that person’s duties or when that person performs them in a culpably inefficient manner. “Willfully” means intentionally. It refers to the doing of an act knowingly and purposely, specifically intending the natural and probable consequences of the act. “Negligently” means an act or omission of a person who is under a duty to use due care which exhibits a lack of that degree of care which a reasonably prudent person would have exercised under the same or similar circumstances. Culpable inefficiency is inefficiency for which there is no reasonable or just excuse. The manual also provides that “where the dereliction of duty resulted in death or grievous bodily harm, the intent to cause death or grievous bodily harm is not required.” Dereliction can be a serious offense in the armed forces. The maximum punishment turns on whether the conduct was willful, negligent, or the result of culpable inefficiency. Importantly, for willful dereliction that results in death or grievous bodily harm, confinement for up to two years is authorized. Had Trump been subject to the Uniform Code of Military Justice, there would be no question that his actions and failures to act on Jan. 6th rose to the level of willful dereliction. And there were fatalities and grievous bodily injuries at the Capitol that day. Setting aside technical definitions of dereliction of duty, even its broader, colloquial sense—someone’s failure to perform an action it was his responsibility to perform—is now no longer the main point. It could have formed the basis for an impeachment, but Trump is no longer subject to impeachment. Indeed, he escaped his last impeachment, coming as it did so close to the end of his term, in part because some thought his misconduct could be adjudicated in criminal and civil proceedings. (“President Trump is still liable for everything he did while he was in office,” Mitch McConnell said. “We have a criminal justice system in this country. We have civil litigation.”) Even so, reference to dereliction of duty in connection with Jan. 6th is quite understandable. It contributes to our understanding of just how grave a betrayal Donald Trump’s behavior represented. It may go to his intent, and it would certainly be taken into account on sentencing in the event he is criminally charged in connection with the assault on the Capitol. Particularly as the Jan. 6th Committee trains its sights this week on his conduct during that assault, it is worth keeping in mind, if only for contextual reasons as the Department of Justice, state prosecutors in Georgia and perhaps elsewhere, and Americans generally, make the critical decision whether he should face criminal charges.
