Tennessee Gov. Bill Lee’s administration accused the National Rifle Association of wanting to use involuntary commitment laws “to round up mentally ill people and deprive them of other liberties,” according to documents drafted by the Republican’s staffers as part of their initial attempt to pass a gun control proposal earlier this year.
The memos, provided by Lee’s office as part of a public records request, reveal a rare criticism of the powerful gun lobby made by the Republican Governor. Lee has previously praised the NRA’s efforts to protect the Second Amendment but has since faced opposition from the group as he works to pass gun control legislation in response to a deadly Nashville school shooting that took place in late March.
So far, Lee has proposed keeping firearms away from people who could harm themselves or others. He’s currently facing pushback from both the GOP-dominant General Assembly and firearms rights advocacy groups, including the NRA, that are wary of loosening gun laws in ruby red Tennessee. The NRA’s opposition is particularly notable because the group was a crucial player in Lee’s successful push in 2021 to pass a law that allows people 21 and older to carry handguns without a permit in Tennessee.
That means Lee has been forced to go on the defensive, arguing that what he has proposed is not, in fact, a so-called red flag law like those adopted by other states in the wake of tragedies. Instead, the talking points show he is attempting to sell his proposal as “the most conservative in the nation” and the best plan for “Second Amendment advocates.” He also is taking aim at advocates who want to focus on Tennessee laws that allow committing people without their permission if they pose “a substantial likelihood of serious harm” due to a “mental illness or serious emotional disturbance.”
“Not only is the NRA’s proposal impractical — it would drastically expand the scope of government,” one of the memos reads.
In announcing his plan publicly in April, Lee acknowledged the proponents of involuntary commitment, but did not name the NRA.
“Some advocates of the Second Amendment say something called ‘involuntary commitment’ is the answer, but that would restrict all kinds of constitutional rights, including the Second Amendment,” Lee said at the time. “It’s not the best way.”
Speaking with reporters on Wednesday, House Speaker Cameron Sexton further lowered expectations that Lee’s proposal has a chance to pass, saying he doesn’t think he and fellow Republican lawmakers support red-flag-esque laws. He said some other areas of policy could be considered: involuntary commitment, more mental health in-patient beds, better database updating for background checks, a new state-level offense beyond the federal law prohibiting felons from having a certain amount of ammunition, and broadening state law so more types of violent threats could be considered a crime.
“When you look at what the NRA is saying, is you currently have laws on the books — emergency, involuntary commitment,” Sexton told The Associated Press on Wednesday. “And so, use what you have.”
The Governor initially unveiled his legislation just weeks after six people — including three young children — were killed in a Nashville school shooting. Lee’s wife, Maria, was friends with the head of the school and a substitute teacher who were among those killed.
Despite Lee’s urging for lawmakers to pass his proposal, GOP leaders have resisted. The Legislature adjourned without taking up the issue in April, but Lee has since called them to come back to address the matter in late August.
The documents reviewed by AP show that Lee’s administration drafted the talking points in April. They tout the Governor’s proposal as “more targeted and more limited” than what the NRA currently supports. It’s unclear where the memos were circulated or how many people outside Lee’s office received them.
In the memo, Lee’s office wrote that the NRA’s plan “does not get at the heart of the problem, as it fails to address unstable individuals who suffer from mental health issues but do not qualify for involuntary commitment to a facility.”
“Gov. Lee believes the best path forward is practical, thoughtful solutions to keep communities safe and protect constitutional rights,” his spokesperson, Jade Byers, said in an emailed statement. “He looks forward to speaking with key stakeholders, including the NRA, and working with legislators on proposals in the months ahead.”
In an April memo, the NRA’s lobbying arm urged its supporters to oppose Lee’s plan. The group noted that “Tennessee already has broad civil commitment laws” and added that the state could improve access to emergency mental health services.
Asked about the Governor’s office talking points about their group, NRA spokesperson Amy Hunter didn’t address the claims, saying in a statement that the group is focused on “preserving and advancing the rights of law-abiding gun owners in Tennessee.”

Rep. Jones (D-TN-House-52) is back in the Tennessee House again after Tennessee Republicans under racist Speaker Cameron Sexton voted to expel him.
Nashville's Metro Council has unanimously voted to reinstate freshman Democrat Justin Jones to his seat in the Tennessee House. The GOP-led legislature expelled Jones last week for gun reform protests he led on the chamber floor after the Covenant School shooting.
The vote puts Jones into the seat on an interim basis until a special election can be held for the seat.
"Justin Jones has been elected to the vacancy of Tennessee House 52 pursuant to the state law and the rules governing the Metropolitan Council," Vice Mayor Jim Shulman announced at Monday's specially called meeting, as cheers erupted in the gallery.

Rep. Jones still has to run in a special election. But because GOP gerrymandering placed Jones in an overwhelmingly Democratic district, there’s little doubt about the outcome.
On Wednesday, all eyes in Tennessee will be on Memphis where a local council is expected to appoint Justin Pearson to his old seat.
EDIT: There are now allegations that far right Speaker Cameron Sexton of the Tennessee House does not live in the district he’s representing. That puts him in violation of Article II, Section 5a of the Tennessee Constitution.

A video captures an incident of Tennessee House Speaker Cameron Sexton, a member of the Republican party from Crossville, appearing to engage in a physical altercation with State Representative Justin Pearson, a Democrat from Memphis. The incident occurred on Tuesday, shortly after the conclusion of a special legislative session.
State Rep. Justin Pearson and his esteemed colleague Rep. Justin Jones can be seen at the bottom of the House Speaker’s dais with signs advocating for their constituents against gun violence.
In the video you can clearly see Speaker Sexton shoving his right shoulder into Rep. Person’s chest.
The incident escalated when Sexton turned toward Pearson, pointing at Pearson and his security detail surrounding the speaker.
Before the incident unfolded Representative Justin Jones (D-Nashville) rallied for a vote of no confidence, targeting the speaker’s position.
However, as the speaker promptly adjourned proceedings, precluding the intended vote, tumult unfurled both on the assembly floor and in the gallery, punctuated by discernible voices clamoring to “vote him out”, which can be heard in the video.

In the video, the House Speaker can visibly be seen aggressively shoving his right shoulder into Rep. Pearson, with plenty of room to walk past the Black Representative.
“White supremacist speaker Cameron Sexton violently shoved me today while I held my ‘Protect Kids, Not Guns!’ I’m infuriated by his actions but more infuriated by the inaction of the Tennessee House GOP to pass a single bill to prevent gun violence,” the State Rep. said. He then adds, “This is how democracy dies. We must rise.”

The Shelby County Board of Commissioners in western Tennessee voted unanimously to send Justin Pearson back to the Tennessee House of Representatives.
The far right Republican supermajority in the Tennessee House voted to expel Justin Pearson and another black Democrat Justin Jones late last week. Rep. Jones was reinstated earlier this week.
County officials in Memphis voted unanimously on Wednesday to reappoint Justin Pearson to the Tennessee House of Representatives, less than a week after the legislature voted to expel him and another Black Democratic lawmaker for participating in a protest against gun violence.
The Shelby County Board of Commissioners, which was tasked with appointing someone to fill the seat, convened to discuss reappointing Pearson and voted to send him back to Nashville. Pearson addressed the commissioners and dozens of supporters who assembled at the meeting.
"Nashville thought that they could silence democracy, but they didn't know the Shelby County Commission," Pearson said to cheers following the vote. "So the message for all the people in Nashville who decided to expel us: You can't expel hope. You can't expel love. You can't expel our voice. And you sure can't expel our fight. We look forward to continuing to fight, continuing to advocate, until justice rolls down like water, and righteousness like an ever-flowing stream. Let's get back to work."
Before the vote, Commission Chairman Mickell Lowery told CBS Memphis affiliate WREG that many commissioners wanted Pearson to be reappointed. All seven of the assembled members voted to reinstate him.
The GOP supplicants of the NRA thought they could shut down talk of gun reform after the massacre at the Covenant School by silencing protests against Tennessee’s extreme permissiveness when it comes to carrying guns and owning military-style assault weapons. Instead, GOP arrogance created a major embarrassment for the state with the legislature acting like Putin’s State Duma in Moscow.
Pearson still has to run in a special election to make his return to office permanent. But because Republican gerrymandering packed his district overwhelmingly with Democrats, his re-election is largely a formality.

San Diego supercross was great btw Tomac won which kind of-of course at this point I mean I was never a Tomac fan but watching the guy stamp himself definitely as one of the greatest the sport has ever seen at age 30 when the guys who’s records he is breaking had been retired for years by the time they were his age. I dunno, my point is the guy is just damned impressive and so is Jett Lawrence I mean we all want to see other people win but this is so much like when Carmichael was winning everything in 250 and Stewart was winning everything in the 125 in the early 2000’s which I think is pretty cool. Just two dominating talents in the sport. I’m glad to get to witness it and I really hope Eli races outdoors or another year of supercross or maybe in the SMX to race Jett when he moves up to 450 I really think that would be epic. I mean Jett already beat Sexton on a 450 at MXoN last year so like, Jett might just be the guy soon as he gets on a 450, so watching him try to take down Eli would just be epic imo. Sexton and Malcolm both just can’t keep their fucking bikes off the ground, Anderson, idk, under preforming. Webb needs to put up a stiffer fight. Roczen and Barcia solid rides. If McAdoo or Hampshire can start in front of Jett at any point this year we’ll see if they can put up a fight with him, but so far Jett has led every lap of both 250 mains this year, he really could sweep the season at this point.
