Brewfest Week 2: Warriors Dirty Fighter Conversion Kit
Our first post for week 2 is advice for staying alive- no matter what it takes. Using the Tavern brawler feat and improvised weapons, a variety of unconventional tactics become available.
This one actually went up early on the foundry a little early, and you can read this article with the original formatting there.
Kit Overview
Investment Type: 'Half' Feat (In place of an Ability Score Increase [ASI])
Minimum Investment: One of your precious ASI slots- this stings less if you're a Fighter or Rogue.
Overall Impact: You are able to utilize unconventional forms of attack without penalty, making combat more expressive, and opening up new strategies.
Investment
This is one of the easiest conversion kits to access, in theory. By simply taking the Tavern Brawler feat, you have access not to a single new fighting style, but to a variety of new techniques ranging from unconventional weapons and unarmed strikes to truly off-the-cuff improvisation that may fit with any number of fighting styles.
Evaluating the investment here is a little bit odd though, because while any conversion kit does you no good unless you use it, you're likely to think you'll use this more than you actually will. You'll imagine yourself throwing stones, plucking a lit torch from a sconce and swinging it like a flaming club, or any manner of truly off the cuff attacks- but realistically, you need a plan.
And I hear you- "how can I plan to use an improvised weapon"?
But here's the thing, improvised does not strictly mean you've made the decision to use an object as a weapon in the moment. The weapon can be improvised in the sense that it is not meant to be used as a weapon- or, if you ask certain designers, a weapon being used in a way it is not meant to be used is considered improvised.
And there's the rub: the real investment is yours, not your character's. To get a plan in place, you need to understand what an 'Improvised Weapon' is in terms of DnD5e. If you're the type to use this feat, your wheels might already be turning.
So what is an improvised weapon?
It is a distinct type of weapon- it is not a simple or martial weapon.
It deals 1d4 damage, and it is a thrown weapon with a 20/60 range.
It does not have any other properties- it is not a finesse weapon, a heavy weapon, a light weapon, or two-handed weapon (By default).
It is still a weapon, for any feature which may require one.
So simply put, you can't (effectively) two weapon fight, sneak attack, great weapon fight, or similar with an improvised weapon. We'll discuss what you can do in the mechanical impact section, but I wanted to set aside any misconceptions out of the gate.
Before we move on to the narrative impact, I'm going to lay out the feat's benefits, because they're rather broad:
You add your proficiency bonus to attacks with improvised weapons.
You roll a damage die with your unarmed attacks, rather than dealing a single point of damage.
When you hit a creature with an unarmed strike or improvised weapon on your turn, you can use a bonus action to attempt to grapple the target.

Narrative Impact
The narrative suggested here is obvious- you're a brawler. You fight with your bare hands, grab the nearest combatant by their shirt collar, and maybe smash an empty ale bottle over their head. But your narrative options? Those are near limitless.
Are you a fighter that catches foes off guard with shield bashes, pommel strikes, and kicks?  A paladin or cleric so committed to hunting undead and fiends that they utilize holy water and wooden stakes as a matter of course? An alchemist or wizard that deploys alchemical concoctions by splashing or tossing them at nearby foes? A monk whose flowing movements and measured blows are supplemented by a pragmatic willingness to apply brute force where necessary? An assassin who deploys inhaled poisons by simply lobbing their containers?
If you have an unconventional combat tactic in mind, this feat will make it possible. The trouble is going to be getting something out of it mechanically. If you don't mind losing a little mechanical edge for a little bit of expression, there are some very cool things you can do. However, let's look at ways you can get a mechanical boost out of it.
Mechanical Impact
Okay so we've talked about how there's some interesting imagery we can get out of this feat, and maybe some mechancial benefit, but how do we get there? I think there are three broad categories of mechanical impact you can get out of this feat. In no particular order Brawling, Unconventional Weapons, and Payload Delivery.
That's a whole bunch of seemingly meaningless jargon: let me explain.
Brawling
This is the impact the feat was named for. This is best used by strength-based frontliners: the usual suspects are Barbarians, Fighters, Monks, and Paladins.
However, we're aiming for unconventional here aren't we? Blade Pact Warlocks, Rangers, Clerics, and Wild-Shaped Druids can certainly get in on the action if they have the strength to back it up- or a Rogue with expertise in Athletics.
The trick to brawling is simple: You want to leverage the feat's 3rd benefit and grapple as a bonus action. You probably want to dole out some damage on that grappled target or take advantage of the grapple to keep them disabled.
So you need two things here: a trigger for the grapple and a follow-through. Fighting unarmed or with a one-handed weapon is ideal here. Good thing this feat sets you up for that in several ways.
To trigger your bonus action grapple, you need to make a successful unarmed strike or with an improvised weapon. Depending on how many free hands you normally have, that might be quite easy, or it might be a little complicated.
Monks have it easy here, every attack they're likely to make opens up this bonus action. Afterwards you can follow through with Flurry of Blows, perhaps even knock them prone if you're following the Way of the Open Hand. You could even use both hands to grapple and do this to two separate targets while continuing to fight with your feet- though your DM might start to balk at this point. Wild-Shaped Druids have it just as easy- even if your DM doesn't consider natural attacks unarmed strikes (a fair interpretation, to my mind), nothing's stopping you from making an unarmed attack anyway- just don't use the teeth and claws until you have your target grappled.
Now if you're a Fighter wielding a one handed weapon and nothing else, well, problem solved. If you're a Fighter or maybe Barbarian wielding a two handed weapon, you can simply take one hand off of the weapon to strike and grab. You might be able to follow through by using your weapon to make improvised attacks against the target. If your DM rules that the two-handed property can't be overridden by making improvised attacks, you might be able to use knees, feet, or elbows to strike the grappled target.
If you're a sword-and-board Paladin or Fighter, well, now things are more complicated. You can drop your weapon to make an unarmed strike followed by a grapple, but your DM is unlikely to let you pick that weapon back up immediately if it doesn't work. But you can make an improvised attack with the shield, and drop the sword to execute the grapple if it works. If you're a two-weapon Ranger or similar you can execute a similar maneuver by striking with the pommel or handle of your weapon and dropping one of them to execute the grapple. The follow-through here consists of further improvised attacks with the shield, or attacks with the remaining one handed waeapon.
Unconventional Weapons 
Many pieces of 'adventuring equipment' in the PHB are treated as improvised weapons when you attack with them. This feat, oddly, is the only way to gain proficiency in the use of these weapons.
Alchemist's Fires, Acid Vials, Holy Water, and Oil Flasks are the only 'official' options I'm aware of, but even these are useful as sources of on-demand elemental damage for characters that don't normally have access to it.
I struggle to think that a DM who wasn't utterly adversarial refusing to allow you to make other simple weapons- a molotov cocktail, for example. I also think it would be perfectly reasonable to deliver inhaled or contact poisons by lobbing a vial. That's pretty much the definition of an improvised weapon attack- plus there's precedent in in most of the 'official' improvised weapons for lobbing vials.
This makes for an extremely unpredictable character if you're a non-caster. Battle Master Fighters, Rogues (especially Thieves), and certain Monks can deploy a simply staggering number of tactical options- from the right damage for the situation, to devastating conditions, to denying an area to their foes.
If you are a caster, there are some neat tricks you can do with spells. Fire spells can be enhanced by oil, and using a catapult spell to launch an improvised item doesn't require you to be proficient, but at low levels it's nice to be able to use the item if you're out of spells. The primary draw of using this method with spellcasters, in my mind, is that casters tend to be proficient in the sorts of tools that create unconventional weapons, so you can keep yourself supplied.
This fits quite well with Artificers and Wizards for most tools. Clerics, Paladins, and perhaps Celestial patron Warlocks could create Holy Water. It seems less likely that Sorcerers or other types of Warlocks would use this method, but nothing is stopping them.
Frankly, if you're the type to use spells that don't deal direct damage, you're more likely to find use for unconventional weapons. If not, your damage spells will always far outstrip the usefulness of these items. If you're playing a Thief or Battle Master, you 're already looking for opportunities to apply a unique skill set- this just expands your toolbox.
Payload Delivery
There's little tactical benefit to this technique, in most scenarios. This method disregards the damage and other properties of improvised weapons, and simply uses the fact that improvised weapons are weapons to deliver the damage of another feature in a flavorful or unexpected manner.
This primarily serves the purpose of expression without sacrificing effectiveness, but you might also gurantee that you can use your class features even if your weapons are not accessible- this may or may not be important to you depending on your campaign and character.
Paladins and Warlocks can deliver their (Eldritch) Smites through improvised weapons so long as the attack is a melee attack, and Battle Masters can deliver their maneuvers at range or in melee through improvised weapons. Green Flame Blade and Booming Blade, favored by Bladesingers and Eldritch Knights, don't discriminate against improvised weapons. In certain circumstances, this might let you continue to fight effectively even if you're doing another important job with your hands, such as bearing the party's light source.
Delivering conditional damage, such as sneak attack or great weapon fighting, can be more challenging since improvised weapons don't have properties, but you might convince a DM that a rail spike should be a finesse weapon or that a table should be heavy. Talk to your DM about these sorts of strategies before you take this feat.
Kit Support
Talk to your DM. Improvised Weapons fall almost entirely under the purview of the collaboration between players and DM. Odds are good that if you aren't trying to break the game (and none of these strategies should), your DM will look for ways to reward you for adopting an unconventional strategy. Especially if they know where you're going with it ahead of time.
That said, most of the ways to enhance the use of this feat that are actually found within the system are the few items on the adventuring gear table that are called out as improvised weapons- which we have discussed at length.
Perhaps there are others floating around in various published adventures or setting books- if you have access to those books, perhaps give them a once over.
Pitfalls
I don't need to tell you that your DM can handily ruin this one for you.
What I do need to tell you is that if your plan isn't thought through, if you haven't explained your plan to your DM beforehand and they balk, or if you're expecting this feat to form your entire battle strategy rather than being a single tool for your kit, you're going to be sorely disappointed.
Otherwise, making sure your character can use at least two of the feat's three applications reduces the odds your strategy will simply never be relevant in actual play.

The Simpsons Season 32 Episode 4 Review: Treehouse of Horror XXXI

The Simpsons Season 32 Episode 4
Halloween is the special time for many series, giving them the chance to throw logic and canon out the window to plumb the fantastic for fearful flights. But The Simpsons season 32, episode 4, “Treehouse of Horror XXXI” opens with the scariest of all fantasias: Reality.
The episode begins a short while after Halloween on what looks to be the most frightening day in recent memory, the upcoming election between Trump/Putin and Someone/Anyone. The sequence includes a list of reasons to vote against Trump (Made it okay to shoot hibernating bears, put children in cages, called Mexicans rapists, imitated disabled reporter, looks lousy in a tennis outfit, can’t get wife to hold hands, called third world countries **** holes, called Tim Cook ‘Tim Apple’ …). Each more surrealistically real than the last. The list is long, so long you can’t make them all out during the crawl. They are detailed, amazing, includes one that is made up, and thorough. Homer’s commentary is priceless. But so are the rest of the political barbs in the pre-segment, such as when a heavily medicated octogenarian tells a potential voter he needs two forms of ID. “Twelve if you’re a Democrat.”
The opening segment isn’t all blatant politicking. Some of it is strictly silly. Homer understands and knows where he stands on all the judges and propositions, but when it comes to the presidency, he can’t pick. It’s not like he has to choose between beer, pretzels and donuts. Of course, the dire predictions of doom are slightly exaggerated in the animated, and Halloween-infused, world of “Treehouse of Horrors,” but it’s probably scarier than the entire season of The Walking Dead: World Beyond. The rest of the episode plays it for laughs.
Toy Gory
The first segment is a parody of the children’s classic Toy Story. Marge is a loving mom, giving Bart his last moments with his toys before he gives them away to charity. But we learn from the cleverly worded and Disney-sonic opening song this is not a kid who plays well with others, breathing or plastic. “You put a dent in me, you broke my head in three,” a sorrowful and scornful Randy Newman knockoff sings in a throaty nasal. Bart is apparently the rotten kid next door in this tale. Is it any wonder, though? His new Radioactive Man action figure comes with real radioactivity. The Simpsons likes to play with the after effects of atomic energy. The box warns about keeping the toy away from users’ scrotums, Abe thinks he left his in his other pants and Homer’s had a long history with the atomic effect.
Speaking of effects, the imagination captures the 1995-era computer-animated look and feel of Toy Story with subversive intent. Krusty the Clown, Bart’s most beloved toy one imagines, is the Woody in this. He is also the one who fosters dissent and leads the revolution. Ultimately, Bart becomes the perfect toy owner, but it’s not exactly a happy ending. Dr. Hibbert’s X-ray of Bart comes straight out of the Operation game. Hibbert explains Bart’s bones are Tinker toys. He has a Build-A-Bear heart and his brain is pop rocks and silly putty. He also has tennis elbow, hoof in mouth, frog in throat and is limited to only one semicolon. Not only that, he now stoically appreciates bad puns like “Don’t ask, don’t Mattel.” The Simpson family lost Bart at “I love you” and the message of the segment is don’t buy toys. It is perfectly chilling.
Into the Homer-Verse
The Simpsons go full on Homer-Barbera for this tough-loving tribute to the classic cartoon studio. A search for Halloween candy leads Homer on a hunt through the nuclear plant in search of giveaways sweeter than Advil. The bit where Homer is actually going through all the N&Ns and Rhesus snacks on his desk is a highlight, reminiscent of when Elaine ate a centuries-old, and terribly expensive, wedding cake on Seinfeld. Burns, who has Hansel and Gretel caged in a secret lab, prefers his snacks stringy and tough, so there wouldn’t be any sweets there. While he doesn’t find candy, Homer does cause a quantum flash of celestial energy which bursts a hole into an unstable universe, one where no one knows what a Murgatroyd is. The other realm is filled with cartoon Homers, from his Snaggle Puss counterpart through his noir version to a gaming animation pixilation. Disney Princess Homer brings new tonal beauty to the word “d’oh.” It sounds confusing, until Lisa sings it.
The best exchange of the Homer-Verse is when Homer walks past security in a restricted area. The guard says no one is allowed back there. When Homer asks what the guard is doing back there, logic and tasers go flying. It is a surrealistic solution to an abstract problem. The Krustyburger solution of having to find “other sources of meat” to contend with the six new, and hungry hungry Homers is equally surreal, but far crueler, which makes it just as funny. Until Gil gets there and you realize someone might lose their lunch.
“Eat the bacon, victory is mine,” we hear as Japanese Anime Homer sits down with the rest of the misplaced beings to a hearty breakfast. It is a very short segment but exquisitely executed. The Homers overwhelm Marge’s kitchen and threaten the delicate balance of interdimensional relationships. The portal they opened also affects labor relationships as the Burnsiverse knows where to get cheap, undocumented labor and the Smithersverse takes copious notes. Each of the Homers will die over and over again, which isn’t a horrible problem, except they will also die again. Lisa, of course, solves the problem using Harlon Ellison’s law of circular storytelling, as the episode exits, stage left, to run a circular saw over the same premise from a different angle.
Be Nine, Rewind
The Groundhog Day sendup begins with Harry Nilsson’s “Gotta Get Up,” the song, which was also featured in Russian Doll, grows more frantic as days and things get pounded like so many bubbling waves. It’s Lisa’s 9th birthday and she’s not sure if she’s ready to be halfway to adulthood. She doesn’t even want to put “Night Night Moon” in the hand-me-down box. The box is for Bart, who is actually ahead of Lisa in school, making it an eye-roller of a bit. Everything is fine until Homer steals frosting from the birthday cake with his finger. The many deaths of Lisa which follow are a tour de farce. Almost every line and sight gag builds on the ones before it, although the most specifically funny death involves a vanity mirror and is both the most and least expected of the lot. It is a millisecond of comic transcendence.
That can’t be said for Krusty’s balloon animals: a cigar, a snake, a worm and a 2×4. He gives out the same unimaginative throwaways at every party, and most Krustyburger grand openings. It’s a running gag that his jokes are all stolen, so feel free to read into the clown’s less than stellar performance. The closing scenario is the most hopeful. Probably just because we lose Gil, again, during it. He generously gives Patty a great set up. He kills a kid on the road test for his driver’s license. He’d better make it up on the written portion. It’s funny because, in many states, it’s relatable enough to be true.
The Simpsons season 32 has been offering consistently satisfying episodes of straight and subversive humor. “Treehouse of Horror XXXI” is the best of the season so far, but the Treehouses are always season highlights, and more reliably than Christmas episodes. No character is safe on Halloween. You can kill Gil as many times as you like. The Simpsons always packs a devilishly delicious trick or treat bag, with nothing so frightening as razor-blade-concealing apples, or anything else remotely nutritious. The opening segment is a political thriller, but the segments themselves are classic comedy.

12 Guidelines for a Web Designer (CSS/HTML)
You know to understand and explaining the guidelines especially when it comes to usability of your business’s website is an assured way to increase your client foundation.
The websites that are not user-friendly are not suitable. Simply put, if your website is not friendly for the people who go to your page, visitors will go elsewhere. Building trust and make them sure your website is easy and quite comfortable to access, efficient to work upon, and subsumes accessible content are some of the important guidelines for web designers needs to follow.
You should also think to have your own website experimented especially for usability. And, when you test your website, you'll be capable to figure out what is going right, what is going wrong, and what might need to be changed, right?

3. Use the Right DocType
While designing a website, the doctype declaration matters a whole lot on whether or not your markup and CSS will approve. In fact, the complete appearance and feel of your site can alter greatly depending on the DOCTYPE that you declare.

4. Providing Style Sheet Information
Another important character of creating a catchy website is to incorporate author, tags, title, description, accurate URL information, and other aspects within your stylesheet. So here, whenever the user or developer who would need a reference or other features at any point in time, they will quickly attain the contact person as well as all other information that they are looking for.    
The aspect of designing the elements of a Stylesheet from top to bottom might not be as easy as it might seem to be. Sometimes, if the designer has the least idea of CSS, they might start organizing the elements by arranging these in the order they would like them to be. However, when it comes to writing CSS code, this might not be a good practice, as it might become difficult for others or yourself to locate the CSS code elements within the stylesheet.
5. HTML Line- Wrapping

6. ID and Class Naming

Names that usually are specific and that element should be preferred as such and considered as most understandable & the least likely to change. The names that are generic are simply a fallback for the elements that usually have no particular or no meaning different from their siblings. In short, they're typically needed as "helpers".
You know what, using functional or generic names lessens the probability of unnecessary files or template changes.  
Here is how we need to do it.
7.Semantics
In semantics, every designer necessitates using HTML according to its purpose. Using the major elements (sometimes incorrectly called “tags”) for what they have been created for.
For example, use heading elements for the headings, elements for paragraphs, an element for anchors, etc. Or using HTML according to its purpose is important for accessibility, reuse, and code efficiency reasons.
8. Optional Tags
Omit optional tags (optional). For file size optimization and scannability purposes, consider omitting optional tags. The HTML5 specification defines what tags can be omitted. (This approach may require a grace period to be established as a wider guideline as it’s significantly different from what web developers are typically taught. For consistency and simplicity reasons it’s best served to omit all optional tags, not just a selection.)  
9. Protocol
Hypertext Transfer Protocol Secure (HTTPS) is a variant of the standard web transfer protocol (HTTP) that adds a layer of security on the data in transit through a secure socket layer (SSL) or transport layer security (TLS) protocol connection.
HTTPS enables encrypted communication and a secure connection between a remote user and the primary web server.
HTTPS is configured and supported by default in most web browsers and initiates a secure connection automatically if the accessed web servers request a secure connection. HTTPS works in collaboration with certificate authorities that evaluates the security certificate of the accessed website. Use HTTPS for embedded resources where possible.
Always use HTTPS (https:) for images and other media files, style sheets, and scripts, unless the respective files are not available over HTTPS.

10. Separation of Concerns
Do separate structure from a presentation from behavior.
Strictly keep structure (markup), presentation (styling), and behavior (scripting) apart, and try to keep the interaction between the three to an absolute minimum.
That is, make sure documents and templates contain only HTML and HTML that is solely serving structural purposes. Move everything presentational into style sheets, and everything behavioral into scripts.
Besides, keep the contact area as small as possible by linking as few style sheets and scripts as possible from documents and templates.
Separating structure from a presentation from behavior is important for maintenance reasons. It is always more expensive to change HTML documents and templates than it is to update style sheets and scripts.
11. Understand the Difference Between Block vs. Inline Elements
Block elements are elements that simply clear each line after they're declared, spanning the whole width of the available space. Inline elements take only as much space as they need, and don't force a new line after they're used.

I breathe a sigh of relief as we arrive at the gates of the city. The walls of Owariella loom over us as we approach. These walls are enough to make a Giant feel small, so I can only imagine how a Sprite must feel seeing them.
We’re forced to dismount the hummingbird at security as usual. The guards do a full scan of every vehicle, including its riders, before entering the city. It’s a pain, but it prevents anyone with the virus from getting in. This allows Giants to enter the city without needing to wear protective masks. Luckily, our technology has come a long way in a short amount of time, so it’s only a few minutes before the little indicator on the security guard’s scanning wand pings me as clean. I graciously take this moment to remove my ventilator mask.

I guess that’s it. I watch her disappear into the crowd, feeling a strange sense of doubt. I can feel my heart rate elevating suddenly, and I fumble for the inhaler in my pocket. I close my eyes and take deep drag. I picture Belladonna’s face, and then the sight of her walking out of my life. I try to shake the image from my mind and take another quick drag. 
When I open my eyes again, I remember that I am still pretty exposed standing just outside the main thoroughfare. No one seems to pay me any mind, but I still shuffle along to avoid any unwanted attention.
It only takes me a few minutes of unloading the hummingbird to sink back into my normal routine, and the image of Belladonna fades further and further from my consciousness.
“Teddy! What do you have for us?” asks Shiryn with a cheery smile. She is the owner of a successful food preparation business. Shiryn definitely notices my sour face. “Hey, hey! Don’t give me that look. I know you were probably counting on getting fed. I didn’t forget about you. You know the general market, right?”

“A buddy of mine runs the little kitchen in the back. She’s got some real good stuff. I should know, she learned everything from me!” Shiryn does a belly laugh. She then passes me a small, paper ticket.
“Give this to the cook and she’ll hook you up. I promise.”
I pocket the ticket and give Shiryn an earnest nod.
Shiryn chuckles again. “I was wondering how you’d take this. I wanted to hang it over your head a little longer, but you just looked so pathetic, I couldn’t handle it any longer.”
As Shiryn continues to laugh at her own jokes, I ball up my fist and throw a punch, pulling it just a foot before making contact. She throws her hands up in defense, laughing even harder. 
She grips my shoulder and pushes me away playfully. “Anyway, your service is much appreciated as always.”
“Yeah, yeah.” I throw the pouch of money into my satchel bag and make for the exit.
“Hey!” Shiryn calls out to me, and I whip my head around. “Take care of yourself, really.” The look of sincerity in her face is a little uncharacteristic, and I wonder if she’s trying to pull another prank.

What Google's GDPR Compliance Efforts Mean for Your Data: Two Urgent Actions

It should be quite obvious for anyone that knows me that I’m not a lawyer, and therefore that what follows is not legal advice. For anyone who doesn’t know me: I’m not a lawyer, I’m certainly not your lawyer, and what follows is definitely not legal advice.
With that out of the way, I wanted to give you some bits of information that might feed into your GDPR planning, as they come up more from the marketing side than the pure legal interpretation of your obligations and responsibilities under this new legislation. While most legal departments will be considering the direct impacts of the GDPR on their own operations, many might miss the impacts that other companies’ (namely, in this case, Google’s) compliance actions have on your data.
But I might be getting a bit ahead of myself: it’s quite possible that not all of you know what the GDPR is, and why or whether you should care. If you do know what it is, and you just want to get to my opinions, go ahead and skip down the page.
What is the GDPR?
The tweet-length version is that the GDPR (General Data Protection Regulation) is new EU legislation covering data protection and privacy for EU citizens, and it applies to all companies offering goods or services to people in the EU.
Even if you aren’t based in the EU, it applies to your company if you have customers who are, and it has teeth (fines of up to the greater of 4% of global revenue or EUR20m). It comes into force on May 25. You have probably heard about it through the myriad organizations who put you on their email list without asking and are now emailing you to “opt back in.”
In most companies, it will not fall to the marketing team to research everything that has to change and achieve compliance, though it is worth getting up to speed with at least the high-level outline and in particular its requirements around informed consent, which is:
"...any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her."
As always, when laws are made about new technology, there are many questions to be resolved, and indeed, jokes to be made:

But my post today isn’t about what you should do to get compliant — that’s specific to your circumstances — and a ton has been written about this already:

My intention is not to write a general guide, but rather to warn you about two specific things you should be doing with analytics (Google Analytics in particular) as a result of changes Google is making because of GDPR.
Unexpected consequences of GDPR
When you deal directly with a person in the EU, and they give you personally identifiable information (PII) about themselves, you are typically in what is called the "data controller" role. The GDPR also identifies another role, which it calls "data processor," which is any other company your company uses as a supplier and which handles that PII. When you use a product like Google Analytics on your website, Google is taking the role of data processor. While most of the restrictions of the GDPR apply to you as the controller, the processor must also comply, and it’s here that we see some potentially unintended (but possibly predictable) consequences of the legislation.
Google is unsurprisingly seeking to minimize their risk (I say it’s unsurprising because those GDPR fines could be as large as $4.4 billion based on last year’s revenue if they get it wrong). They are doing this firstly by pushing as much of the obligation onto you (the data controller) as possible, and secondly, by going further by default than the GDPR requires and being more aggressive than the regulation requires in shutting down accounts that infringe their terms (regardless of whether the infringement also infringes the GDPR).
This is entirely rational — with GA being in most cases a product offered for free, and the value coming to Google entirely in the aggregate, it makes perfect sense to limit their risks in ways that don’t degrade their value, and to just kick risky setups off the platform rather than taking on extreme financial risk for individual free accounts.
It’s not only Google, by the way. There are other suppliers doing similar things which will no doubt require similar actions, but I am focusing on Google here simply because GA is pervasive throughout the web marketing world. Some companies are even going as far as shutting down entirely for EU citizens (like unroll.me). See this Twitter thread of others.
Consequence 1: Default data retention settings for GA will delete your data
Starting on May 25, Google will be changing the default for data retention, meaning that if you don’t take action, certain data older than the cutoff will be automatically deleted.
You can read more about the details of the change on Krista Seiden’s personal blog (Krista works at Google, but this post is written in her personal capacity).
The reason I say that this isn’t strictly a GDPR thing is that it is related to changes Google is making on their end to ensure that they comply with their obligations as a data processor. It gives you tools you might need but isn’t strictly related to your GDPR compliance. There is no particular “right” answer to the question of how long you need to/should be/are allowed to keep this data stored in GA under the GDPR, but by my reading, given that it shouldn’t be PII anyway (see below) it isn’t really a GDPR question for most organizations. In particular, there is no particular reason to think that Google’s default is the correct/mandated/only setting you can choose under the GDPR.
Action: Review the promises being made by your legal team and your new privacy policy to understand the correct timeline setting for your org. In the absence of explicit promises to your users, my understanding is that you can retain any of this data you were allowed to capture in the first place unless you receive a deletion request against it. So while most orgs will have at least some changes to make to privacy policies at a minimum, most GA users can change back to retain this data indefinitely.
Consequence 2: Google is deleting GA accounts for capturing PII
It has long been against the Terms of Service to store any personally identifiable information (PII) in Google Analytics. Recently, though, it appears that Google has become far more diligent in checking for the presence of PII and robust in their handling of accounts found to contain any. Put more simply, Google will delete your account if they find PII.
It’s impossible to know for sure that this is GDPR-related, but being able if necessary to demonstrate to regulators that they are taking strict actions against anyone violating their PII-related terms is an obvious move for Google to reduce the risk they face as a Data Processor. It makes particular sense in an area where the vast majority of accounts are free accounts. Much like the previous point, and the reason I say that this is related to Google’s response to the GDPR coming into force, is that it would be perfectly possible to get your users’ permission to record their data in third-party services like GA, and fully comply with the regulations. Regardless of the permissions your users give you, Google’s GDPR-related crackdown (and heavier enforcement of the related terms that have been present for some time) means that it’s a new and greater risk than it was before.
Action: Audit your GA profile and implementation for PII risks:
There are various ways you can search within GA itself to find data that could be personally identifying in places like page titles, URLs, custom data, etc. (see these two excellent guides)
You can also audit your implementation by reviewing rules in tag manager and/or reviewing the code present on key pages. The most likely suspects are the places where people log in, take key actions on your site, give you additional personal information, or check out
Don’t take your EU law advice from big US tech companies
The internal effort and coordination required at Google to do their bit to comply even “just” as data processor is significant. Unfortunately, there are strong arguments that this kind of ostensibly user-friendly regulation which incurs outsize compliance burdens on smaller companies will cement the duopoly and dominance of Google and Facebook and enables them to pass the costs and burdens of compliance onto sectors that are already struggling.
Regardless of the intended or unintended consequences of the regulation, it seems clear to me that we shouldn’t be basing our own businesses’ (and our clients’) compliance on self-interested advice and actions from the tech giants. No matter how impressive their own compliance, I’ve been hugely underwhelmed by guidance content they’ve put out. See, for example, Google’s GDPR “checklist” — not exactly what I’d hope for:
So, while I’m not a lawyer, definitely not your lawyer, and this is not legal advice, if you haven’t already received any advice, I can say that you probably can’t just follow Google’s checklist to get compliant. But you should, as outlined above, take the specific actions you need to take to protect yourself and your business from their compliance activities.

With that out of the way, I wanted to give you some bits of information that might feed into your GDPR planning, as they come up more from the marketing side than the pure legal interpretation of your obligations and responsibilities under this new legislation. While most legal departments will be considering the direct impacts of the GDPR on their own operations, many might miss the impacts that other companies’ (namely, in this case, Google’s) compliance actions have on your data.
But I might be getting a bit ahead of myself: it’s quite possible that not all of you know what the GDPR is, and why or whether you should care. If you do know what it is, and you just want to get to my opinions, go ahead and skip down the page.
What is the GDPR?
The tweet-length version is that the GDPR (General Data Protection Regulation) is new EU legislation covering data protection and privacy for EU citizens, and it applies to all companies offering goods or services to people in the EU.
Even if you aren’t based in the EU, it applies to your company if you have customers who are, and it has teeth (fines of up to the greater of 4% of global revenue or EUR20m). It comes into force on May 25. You have probably heard about it through the myriad organizations who put you on their email list without asking and are now emailing you to “opt back in.”
In most companies, it will not fall to the marketing team to research everything that has to change and achieve compliance, though it is worth getting up to speed with at least the high-level outline and in particular its requirements around informed consent, which is:
"...any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her."
As always, when laws are made about new technology, there are many questions to be resolved, and indeed, jokes to be made:

My intention is not to write a general guide, but rather to warn you about two specific things you should be doing with analytics (Google Analytics in particular) as a result of changes Google is making because of GDPR.
Unexpected consequences of GDPR
When you deal directly with a person in the EU, and they give you personally identifiable information (PII) about themselves, you are typically in what is called the "data controller" role. The GDPR also identifies another role, which it calls "data processor," which is any other company your company uses as a supplier and which handles that PII. When you use a product like Google Analytics on your website, Google is taking the role of data processor. While most of the restrictions of the GDPR apply to you as the controller, the processor must also comply, and it’s here that we see some potentially unintended (but possibly predictable) consequences of the legislation.
Google is unsurprisingly seeking to minimize their risk (I say it’s unsurprising because those GDPR fines could be as large as $4.4 billion based on last year’s revenue if they get it wrong). They are doing this firstly by pushing as much of the obligation onto you (the data controller) as possible, and secondly, by going further by default than the GDPR requires and being more aggressive than the regulation requires in shutting down accounts that infringe their terms (regardless of whether the infringement also infringes the GDPR).
This is entirely rational — with GA being in most cases a product offered for free, and the value coming to Google entirely in the aggregate, it makes perfect sense to limit their risks in ways that don’t degrade their value, and to just kick risky setups off the platform rather than taking on extreme financial risk for individual free accounts.
It’s not only Google, by the way. There are other suppliers doing similar things which will no doubt require similar actions, but I am focusing on Google here simply because GA is pervasive throughout the web marketing world. Some companies are even going as far as shutting down entirely for EU citizens (like unroll.me). See this Twitter thread of others.
Consequence 1: Default data retention settings for GA will delete your data
Starting on May 25, Google will be changing the default for data retention, meaning that if you don’t take action, certain data older than the cutoff will be automatically deleted.

The reason I say that this isn’t strictly a GDPR thing is that it is related to changes Google is making on their end to ensure that they comply with their obligations as a data processor. It gives you tools you might need but isn’t strictly related to your GDPR compliance. There is no particular “right” answer to the question of how long you need to/should be/are allowed to keep this data stored in GA under the GDPR, but by my reading, given that it shouldn’t be PII anyway (see below) it isn’t really a GDPR question for most organizations. In particular, there is no particular reason to think that Google’s default is the correct/mandated/only setting you can choose under the GDPR.
Action: Review the promises being made by your legal team and your new privacy policy to understand the correct timeline setting for your org. In the absence of explicit promises to your users, my understanding is that you can retain any of this data you were allowed to capture in the first place unless you receive a deletion request against it. So while most orgs will have at least some changes to make to privacy policies at a minimum, most GA users can change back to retain this data indefinitely.

It has long been against the Terms of Service to store any personally identifiable information (PII) in Google Analytics. Recently, though, it appears that Google has become far more diligent in checking for the presence of PII and robust in their handling of accounts found to contain any. Put more simply, Google will delete your account if they find PII.
It’s impossible to know for sure that this is GDPR-related, but being able if necessary to demonstrate to regulators that they are taking strict actions against anyone violating their PII-related terms is an obvious move for Google to reduce the risk they face as a Data Processor. It makes particular sense in an area where the vast majority of accounts are free accounts. Much like the previous point, and the reason I say that this is related to Google’s response to the GDPR coming into force, is that it would be perfectly possible to get your users’ permission to record their data in third-party services like GA, and fully comply with the regulations. Regardless of the permissions your users give you, Google’s GDPR-related crackdown (and heavier enforcement of the related terms that have been present for some time) means that it’s a new and greater risk than it was before.
Action: Audit your GA profile and implementation for PII risks:
There are various ways you can search within GA itself to find data that could be personally identifying in places like page titles, URLs, custom data, etc. (see these two excellent guides)
You can also audit your implementation by reviewing rules in tag manager and/or reviewing the code present on key pages. The most likely suspects are the places where people log in, take key actions on your site, give you additional personal information, or check out
Don’t take your EU law advice from big US tech companies
The internal effort and coordination required at Google to do their bit to comply even “just” as data processor is significant. Unfortunately, there are strong arguments that this kind of ostensibly user-friendly regulation which incurs outsize compliance burdens on smaller companies will cement the duopoly and dominance of Google and Facebook and enables them to pass the costs and burdens of compliance onto sectors that are already struggling.
Regardless of the intended or unintended consequences of the regulation, it seems clear to me that we shouldn’t be basing our own businesses’ (and our clients’) compliance on self-interested advice and actions from the tech giants. No matter how impressive their own compliance, I’ve been hugely underwhelmed by guidance content they’ve put out. See, for example, Google’s GDPR “checklist” — not exactly what I’d hope for:

Consequence 1: Default data retention settings for GA will delete your data
Starting on May 25, Google will be changing the default for data retention, meaning that if you don’t take action, certain data older than the cutoff will be automatically deleted.
You can read more about the details of the change on Krista Seiden’s personal blog (Krista works at Google, but this post is written in her personal capacity).
The reason I say that this isn’t strictly a GDPR thing is that it is related to changes Google is making on their end to ensure that they comply with their obligations as a data processor. It gives you tools you might need but isn’t strictly related to your GDPR compliance. There is no particular “right” answer to the question of how long you need to/should be/are allowed to keep this data stored in GA under the GDPR, but by my reading, given that it shouldn’t be PII anyway (see below) it isn’t really a GDPR question for most organizations. In particular, there is no particular reason to think that Google’s default is the correct/mandated/only setting you can choose under the GDPR.
Action: Review the promises being made by your legal team and your new privacy policy to understand the correct timeline setting for your org. In the absence of explicit promises to your users, my understanding is that you can retain any of this data you were allowed to capture in the first place unless you receive a deletion request against it. So while most orgs will have at least some changes to make to privacy policies at a minimum, most GA users can change back to retain this data indefinitely.
Consequence 2: Google is deleting GA accounts for capturing PII
It has long been against the Terms of Service to store any personally identifiable information (PII) in Google Analytics. Recently, though, it appears that Google has become far more diligent in checking for the presence of PII and robust in their handling of accounts found to contain any. Put more simply, Google will delete your account if they find PII.
It’s impossible to know for sure that this is GDPR-related, but being able if necessary to demonstrate to regulators that they are taking strict actions against anyone violating their PII-related terms is an obvious move for Google to reduce the risk they face as a Data Processor. It makes particular sense in an area where the vast majority of accounts are free accounts. Much like the previous point, and the reason I say that this is related to Google’s response to the GDPR coming into force, is that it would be perfectly possible to get your users’ permission to record their data in third-party services like GA, and fully comply with the regulations. Regardless of the permissions your users give you, Google’s GDPR-related crackdown (and heavier enforcement of the related terms that have been present for some time) means that it’s a new and greater risk than it was before.
Action: Audit your GA profile and implementation for PII risks:
There are various ways you can search within GA itself to find data that could be personally identifying in places like page titles, URLs, custom data, etc. (see these two excellent guides)
You can also audit your implementation by reviewing rules in tag manager and/or reviewing the code present on key pages. The most likely suspects are the places where people log in, take key actions on your site, give you additional personal information, or check out
Don’t take your EU law advice from big US tech companies
The internal effort and coordination required at Google to do their bit to comply even “just” as data processor is significant. Unfortunately, there are strong arguments that this kind of ostensibly user-friendly regulation which incurs outsize compliance burdens on smaller companies will cement the duopoly and dominance of Google and Facebook and enables them to pass the costs and burdens of compliance onto sectors that are already struggling.
Regardless of the intended or unintended consequences of the regulation, it seems clear to me that we shouldn’t be basing our own businesses’ (and our clients’) compliance on self-interested advice and actions from the tech giants. No matter how impressive their own compliance, I’ve been hugely underwhelmed by guidance content they’ve put out. See, for example, Google’s GDPR “checklist” — not exactly what I’d hope for:

What Google's GDPR Compliance Efforts Mean for Your Data: Two Urgent Actions

It should be quite obvious for anyone that knows me that I’m not a lawyer, and therefore that what follows is not legal advice. For anyone who doesn’t know me: I’m not a lawyer, I’m certainly not your lawyer, and what follows is definitely not legal advice.
With that out of the way, I wanted to give you some bits of information that might feed into your GDPR planning, as they come up more from the marketing side than the pure legal interpretation of your obligations and responsibilities under this new legislation. While most legal departments will be considering the direct impacts of the GDPR on their own operations, many might miss the impacts that other companies’ (namely, in this case, Google’s) compliance actions have on your data.
But I might be getting a bit ahead of myself: it’s quite possible that not all of you know what the GDPR is, and why or whether you should care. If you do know what it is, and you just want to get to my opinions, go ahead and skip down the page.
What is the GDPR?
The tweet-length version is that the GDPR (General Data Protection Regulation) is new EU legislation covering data protection and privacy for EU citizens, and it applies to all companies offering goods or services to people in the EU.
Even if you aren’t based in the EU, it applies to your company if you have customers who are, and it has teeth (fines of up to the greater of 4% of global revenue or EUR20m). It comes into force on May 25. You have probably heard about it through the myriad organizations who put you on their email list without asking and are now emailing you to “opt back in.”
In most companies, it will not fall to the marketing team to research everything that has to change and achieve compliance, though it is worth getting up to speed with at least the high-level outline and in particular its requirements around informed consent, which is:
"...any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her."
As always, when laws are made about new technology, there are many questions to be resolved, and indeed, jokes to be made:

My intention is not to write a general guide, but rather to warn you about two specific things you should be doing with analytics (Google Analytics in particular) as a result of changes Google is making because of GDPR.
Unexpected consequences of GDPR
When you deal directly with a person in the EU, and they give you personally identifiable information (PII) about themselves, you are typically in what is called the "data controller" role. The GDPR also identifies another role, which it calls "data processor," which is any other company your company uses as a supplier and which handles that PII. When you use a product like Google Analytics on your website, Google is taking the role of data processor. While most of the restrictions of the GDPR apply to you as the controller, the processor must also comply, and it’s here that we see some potentially unintended (but possibly predictable) consequences of the legislation.
Google is unsurprisingly seeking to minimize their risk (I say it’s unsurprising because those GDPR fines could be as large as $4.4 billion based on last year’s revenue if they get it wrong). They are doing this firstly by pushing as much of the obligation onto you (the data controller) as possible, and secondly, by going further by default than the GDPR requires and being more aggressive than the regulation requires in shutting down accounts that infringe their terms (regardless of whether the infringement also infringes the GDPR).
This is entirely rational — with GA being in most cases a product offered for free, and the value coming to Google entirely in the aggregate, it makes perfect sense to limit their risks in ways that don’t degrade their value, and to just kick risky setups off the platform rather than taking on extreme financial risk for individual free accounts.
It’s not only Google, by the way.
