Dear Sephiroth: (a letter to a fictional character, because why not) #2
I saw some disheartening news today:
I was truly hoping that no one would have to be taken from us this time. Of course, I understand that sometimes our hopes don't pan out, and that, ultimately, that sort of thing has to be okay; we can't get our way all the time - it's not how living works. Still… I'm sure you're aware that Cloud and his friends are a very good group of people who, like you, are caught up in the machinations between an evil corporation and a cosmic horror. It's terrible when innocents get caught up in the crossfire between things that have nothing to do with them. Sadly, our worlds aren't all that different in that regard: these sorts of things happen all the time, anywhere you go....
I don't imagine, though, that it's going to be Aerith who gets sacrificed this time. I'm terrified to think that somehow, some way, instead, it will be you. I feel somewhat sick to my stomach at the thought of how terribly possible this feels, and I'm not really sure what to do with all this anxiety that's welling up in the pit of my stomach.
You saved my life. Your existence offered me someone whose circumstances looked similar to mine when I was growing up. My world is filled with a lot of people who are very much like you - people who grew up in abusive environments, groomed as tools to be used instead of treated like people to be loved, cared for, and understood. People who are valued not for who they are, but for what they look like or what they can do. People who, tired of how much pressure they're under, tired of how few seem to care, and tired of being exploited, lash out, only to be called "monsters" and "bad people" for it.
Stories like yours influence what society thinks is the appropriate way to treat people like us. As it is now, all too often, people like us get pushed out towards the margins of society as unwelcomed things to be excluded or even eliminated. People look at the bad things that others do as evidence that their blood should be spilled, rather than looking at and correcting all the factors that caused them to get to the point of doing bad things in the first place, and this is very sad.
I was very sad that at the end of the original storyline, instead of trying to help you to return to the light, they decided to beat you, bleed you, and break you. And people called that "justice". They didn't try to do anything about the suffering that drove your choices. They didn't offer you even a shred of empathy or concern. And this sort of "justice" happens to all kinds of people in my world, all the time, especially to those of us who are, for whatever reason, considered "non-standard".
I am very frightened of this terrible version of "justice" that most people, both in your world and in mine, seem to subscribe to. There is no mercy to it. It does not heal. All it does is call for those who fall down to suffer. I'm terrified that this version of "justice" is imminently about to happen to you, and it breaks my heart to think of all the people who will be cheering as it happens.
I just wish that nobody had to get hurt.
At the same time, though, I'm very aware that you've survived things worse than death. You were raised by the staff at Shinra, after all. Tortured as a boy by Hojo. Groomed into the role of child soldier, told that you had to function at maximum capacity all the time, at all costs, and deprived of the basic human comforts that should come with everyday living. Even after being thrown into the reactor core at Nibelheim, and even after Cloud and his wonderful friends stopped you at the Northern Crater, you still tenaciously kept your head held high and bravely moved forward, towards a world in which no one else should have to be made to suffer in the same ways that you, Angeal, and Genesis were forced to endure. I know you'll get through this somehow, but I wish you didn't have to try to. I'll leave you with this nice picture that a person named Kate made:

AI Seems Scary, but it Will Likely do More Good Than Bad
Just venting my personal opinions all over this post, which few if any people will see anyway. Call it organizing my thoughts I guess? AI is here to stay, and that's not a bad thing, or at least it doesn't have to be. Back in the day there were doomsayers, many of them well known and respected personalities, all over the place touting the dangers of the Internet and you know what? They weren't entirely wrong. They were also more wrong than right. So-called experts have an unfortunate tendency to make wrong predictions about the future, especially in regards to emerging and novel technologies. A couple of centuries ago, there were publications on expert opinions about how it wouldn't be possible to travel at high speed (like 50kph+) because it would lead to asphyxia.
The internet is a modern mainstay, nearly as important as electricity. Without it, much of what we count on day to day will grind to a halt. Putting aside personal devices like desktops, tablets, etc. that are usually internet-connected, there are a lot of other things that rely on it. Credit card machines are internet connected and without it our increasingly cash-less society will grind to a near halt. Many companies, especially larger ones, need to 'check in' with some central sever somewhere to function effectively. That'd be gone too. A lot of information will be lost outright, or at least isolated where it isn't terribly useful. The impact of internet on both personal and business productivity is in the trillions per year. It saves time, sometimes a lot of it, and 'time is money', as they say. This is to say nothing of how much power it puts in the hands of the average person with internet access. It can empower people to find better opportunities, and advocate for themselves. It is a jumping point for learning new skills, often for free.
I see AI as much the same. If you consider its growth and accessibility, it is a lot like the internet. At first it was used mainly by governments, corporations, and in research. Institutions, in other words. The internet back in the day was mostly used by the same groups. So at first it was mainly the people that work at these places that experienced it. Then enthusiast tech-heads started getting their hands on it for personal use, experimenting with what it can do. Then there was limited public access in the form of AI assistants like Siri, Google Assistant, Alexa, Bixby, etc. Those could be sort of useful, sometimes. Now we're at the point where it's getting better, and at an increasing pace. It has 'blown up' with the introduction of Chat-GPT and the like. Sure, it's still awkward, and it can be abused, but the same is true of the internet. There will always be those that abuse useful tools to exploit others and cause harm and mayhem for either personal gain, to further their extreme goals, or just to watch the world burn. Protections will evolve to try and keep pace, though they won't be perfect, and the average person will have to learn to take some pains to protect themselves as well.
And yes, AI is going to take jobs away and that will cause a lot of people problems, and while that is unfortunate it is also perfectly normal for new technologies. With that change comes new opportunities. The tools will be there for you to use to your advantage, just like the internet.
Or maybe you'll just amuse yourself by trying to get your AI to do something lewd. Probably that.
The main problem I see in future isn't the singularity. No, I'm worried that countries will fail to make appropriate policy changes to reflect the increasing automation that AI and robotics technology together, eliminating most menial labour whether it's manual or data-processing related. We could end up with a large percentage of the population that can't find work, let alone work that pays all their bills. With the increasing productive capacity of countries it should make it very much possible to sustain the population as a whole even if a large percentage aren't producing any work. It would simply not be sane to let society proceed down a path of dystopia, as the burden of a large and dissatisfied homeless and overworked population would result in civil unrest and possible violence, and more to the point such a society would be costly. It is literally cheaper to provide a basic level of housing and resources to someone who would otherwise be homeless, than it would be to deal with a homeless population.
Similarly, I can't see a world where a large fraction of the population having no purchasing power would be good for international trade. If much of the population of every country, including the wealthy ones, have no purchasing power, trade of finished consumer goods like electronics, processed foods, media, clothing, etc. would stagnate. It seems it would be more healthy to have some surplus wealth circulating through the population to keep both the country, and international trade of goods, healthy.
I don't know, it just seems like the future will become a policy choice between 'dystopia' and 'increased free time', all because of the near elimination of unskilled and low-skilled work. Low wage and low skilled workers are already prone to being treated like garbage that doesn't deserve to make enough to live on, and unless policy changes to match the times, this will only get worse.
tl;dr - There will definitely be some growing pains with AI, but it doesn't have to end in an 'AI Destroys Humanity' scenario, and likely won't. Policy changes not being made to reflect a rapidly diminishing need for menial labour is a far more pressing concern, in my mind.

empire - exploitation & erasure
exploitation & erasure are constant themes throughout both s11 & s12 in the leadup to the reveal in the timeless children.
going episode by episode, we start with the stenza in the woman who fell to earth.  they’ve been coming to earth, for lord only knows how long, hunting humans & bringing them home as trophies to prove their prowess.  this is a way of proving their superiority - in this case, a ritual demonstration of their ‘right to rule’ - & it’s a fox hunt.  the details are different, but it’s a fox hunt.  bc the stenza are an empire, & in doctor who, every empire is the british empire.
then we have the ghost monument, which properly delves into the stenza as a civilization.  angstrom, played by an irish actress, talks about how her people are suffering, how the stenza invaded & occupied their world & are now committing genocide, how the only way to save her family is to win the race so they can afford to emigrate.  this was blatant.  the other obvious theme of exploitation is the scientists of desolation, held captive & forced to give up their secrets in the name of scientific progress - this is, remember, the same episode in which the idea of the timeless child is introduced.
rosa is, at heart, a conversation about the civil rights movement & neo-nazis.  krasko is literally trying to erase rosa parks - &, by extension, the civil right movement - from history.  rosa parks is not the entire civil rights movement, but krasko’s an idiot, so let’s roll with that idea.  neo-nazis today are constantly trying to rewrite history; this episode is a call to refuse to allow it, & a reminder that the work of the civil rights movement is yet unfinished.  in britain, as well, as ryan & yaz’s alley conversation clearly shows.
next we have arachnids in the u.k. which is very blatantly a condemnation of corporate pollution.  it’s not explicitly about exploitation, except that jack robertson is exactly the sort of man who exploits anything & everything he can, & who gets ordinary people killed for his greed, just more dramatically & directly than most corporations that dump industrial waste wherever they damn please.  we also suspect that robertson will cover it all up & get away with everything, as his sort generally do.
the next episode that deals with empire is demons of the punjab, which really doesn’t fuck around.  the partition of india is a particularly shameful & very poorly handled chapter of the history of the british empire, following a century of exploitation & abuse, which resulted in a lot of bloodshed & death, & ongoing tensions even now.  it’s also generally ignored aspect of british history.  also ignored are the indian soldiers - indeed, the soldiers from across the commonwealth - who fought in the world wars.  this episode also deals with the forgotten, unacknowledged dead.
kerblam! is definitely about exploitation.  it indirectly deals with the exploitation of workers - on a meta level, i find it almost funny that they don’t dare call amazon out more directly - with things like the tracking anklets, the invasive monitoring of employees, the rebukes for even interacting with coworkers while on the clock.  & the system is explicitly being exploited by charlie, being used to harm people & intended to be the scapegoat for his actions.
the next episode has a strong theme of exploitation is the battle of ranskoor av kolos.  the ux are very blatantly being exploited - the younger, a black man, is physically trapped & used to create things for the benefit of t’zim-sha, while the elder, a white woman, is psychologically trapped by having her faith used against her.  interestingly, she also is made complicit in keeping the younger enslaved.  the ultimate goal of their labour?  reducing entire planets to objects that can sit on t’zim-sha’s metaphorical mantlepiece.
the exploitation in spyfall is about calling out tech corporations which treat people as products, harvesting data & selling it on.  or, in this case, use it to erase dna - destroy that which makes a person what they are.  that theme of erasure carries through to the doctor removing noor & ada’s memories; memories are a significant part of what makes a person who they are, & removing them is erasing a part of that person.
orphan 55 is a grim projection of the end result of exploiting the earth - explicitly attributing the bulk of the blame to the wealthiest & most privileged - even as kane refuses to stop trying to get something out of an already dead planet.  there’s also the appropriation of land which is already inhabited by the dregs, & yes, i’m still sulking about how the doctor had nothing to say about how kane was by some standards an invader & a colonizer - worse, the descendent of someone who abandoned the land, now trying to reclaim it from those who had no choice to remain behind.
next we have nikola tesla’s night of terror, which is a condemnation of both capitalism & empire!  edison exploits his employees & denies them credit for their work, taking all the acclaim for himself instead; tesla, despite his brilliance, is largely forgotten by history.  it’s interesting that the doctor makes a point of saying that the erasure of his contributions doesn’t make them or him any less valuable in long run - it is what you do, not what is remembered, that truly matters.  the skithra, meanwhile, are another empire, very strongly paralleled with edison, who try to exploit tesla’s brilliance - the tesla, i remind you, who is explicitly compared with the doctor - try to use him to further their own power.
praxeus is a more subtle & insidious sort of exploitation, using earth as a petri dish in order to solve another planet’s problems.  they also use adam lang as a test subject, keeping him in a lab & injecting something foreign into his body; rather the opposite of what happened to the timeless child.  suki’s actions, interestingly, are said to be born of fear & desperation - she says that her species are all but wiped out.  the shobogans, in the timeless child, are said to be very few in number; perhaps a future storyline for tecteun will feature similar motivations.
the next episode is also about exploitation.  the villains of can you hear me play at destroying entire worlds for their own amusement, they literally harvest nightmares, & they use the doctor to free rakaya - by convincing her that rakaya is something other than what she is, that’s she a prisoner & a victim.  the doctor always does take the side of the victims.
& finally we get the cybermen.  this isn’t an origin story for the cybermen, which is the most common type we get on the show; this is the cyber empire, which is set on eradicating the human race, sometimes hunting them down just to kill them, sometimes using their bodies for parts, literally erasing their emotions - their humanity - & turning them into obedient machines.  however unusual ashad may be, these concepts are impossible to divorce from any cyberman story.  which makes them the perfect lead-in to the timeless child reveal - the exploitation of a child’s body, with no care for them as a person, being the foundation of an empire.  which probably also makes the master’s cyberlord scheme a particularly satisfying just desserts, in his mind.
& of course, throughout both seasons, we have the doctor’s past as a constant theme - in the first episode she has no memory of who she is, but is nevertheless completely herself; she subsequently continues to erase her past, in a way, by refusing to discuss or even acknowledge it in s11; she never tells her companions the full story in s12; fugitive of the judoon, of course, has her running into a former version of herself she has no memory or knowledge of; all culminating in the discovery that she has aeons worth of lives that have been erased, not just from herself, but from the matrix as well.
also, i know i can’t shut up about ireland, but i reiterate that every empire in doctor who is some shade of the british empire, so i find it really very interesting that the hidden truth of the doctor’s life, disguised as the brendan metaphor, was set in ireland.  & he was working for the police.  Very Interesting Indeed.

Is it a silly prank, a Pagan ritual, or a genius discovery about the next era of mass transit? In a picture posted to Flickr by artist James Bridle—known for coining the term, "New Aesthetic"—a car is sitting in the middle of a parking lot has been surrounded by a magic salt circle. In the language of road markings, the dotted white lines on the outside say, "Come On In," but the solid white line on the inside says, "Do Not Cross." To the car's built-in cameras, these are indomitable laws of magic: Petrificus Totalus for autonomous automobiles.
Captioned simply, "Autonomous Trap 001," the scene evokes a world of narratives involving the much-hyped technology of self-driving cars. It could be mischievous hackers disrupting a friend's self-driving ride home; the police seizing a dissident's getaway vehicle; highway robbers trapping their prey; witches exorcizing a demon from their hatchback.
Self-driving cars aren't there yet, but the artist-philosopher-programmer's thought-provoking photo is a reminder that we'll have to start thinking about these things soon. If a self-driving car is designed to read the road, what happens when the language of the road is abused by those with nefarious intent?
Bridle has carved out a space for himself among those thinking 10–100 years in the future. His website Booktwo.org is lousy with philosophical treatises, thought experiments, creative code, and art projects. His "collaboration with technology" Five Eyes was part of the V&A Museum's privacy-oriented show All of This Belongs to You, which also included the remains of whistleblower Edward Snowden's smashed hard drive full of leaked documents. Bridle has spent the last decade making drones more relatable, uncovering the mysteries of weather prediction, and otherwise trying to elucidate the invisible technologies—usually military in origin—that rule our world.
Recently Bridle has become fascinated by autonomous vehicles. Self-driving cars will be available to the public soon. Singapore is considering the purchase of a fleet of 300,000 driverless taxis to replace the 780,000 manned ones currently clogging their streets. Google's self-driving car initiative, now called Waymo, has been investing in the technology since 2009. Elon Musk's Tesla is already implementing limited automated features in the United States, and even slow-moving large scale car manufacturers like Ford are getting into the game. If driverless cars become anywhere as ubiquitous as the horseless carriage, innocuous vandalism like the Autonomous Trap is just the beginning the problems engineers will have to solve.
Now Bridle is trying to build his own self-driving car, and made the sardonic artwork Autonomous Trap 001 in the process. He's released all the code developed in pursuit of the DIY self-driving car here. We spoke to Bridle to learn more about the circumstances behind this vague photo series and better understand his apprehension and curiosity about the robot chauffeurs of the future.
Creators: What are we looking at here? Can you give me a brief explanation of Autonomous Trap 001?
James Bridle: What you're looking at is a salt circle, a traditional form of protection—from within or without—in magical practice. In this case it's being used to arrest an autonomous vehicle—a self-driving car, which relies on machine vision and processing to guide it. By quickly deploying the expected form of road markings—in this case, a No Entry glyph—we can confuse the car's vision system into believing it's surrounded by no entry points, and entrap it.
Is this actually an autonomous car, or is it conceptual?
I don't actually have a self-driving car, unfortunately—I don't think any have made it to Greece yet, plus the cost issue—but I do have a pretty good understanding of how the things work, having been researching them for a while. And the one in the picture is a research vehicle for building my own. As usual, I've got totally carried away in the research, and ended up writing a bunch of my own software, rigging up cameras and building neural networks to reproduce some of the more interesting currents in the field. Like the trap, I wouldn't entirely trust what I've built, but the principles are sound.
Where did you take these pictures?
I made this Trap while training the car on the roads around Mount Parnassus in Central Greece. Parnassus feels like an appropriate location because, as well as being quite spectacular scenery and wonderful to drive and hike around, it's the home of the Muses in mythology, as well as the site of the Delphic Oracle. The ascent of Mount Parnassus is, in esoteric terms, the journey towards knowledge, and art.
What is your role in the project and is there anyone else involved?
It's just me. I did a project last year called Cloud Index Index which used satellite imagery and machine learning to explore politics and computational thinking, and I had a lot of help on that, particularly from Gene Kogan, another artist who works with machine learning. This time I wanted to do it all myself—mostly to show that I could, and therefore, in theory and accepting an immense amount of privilege and good fortune, anyone can. These technologies are for everyone: you can read the papers, repeat the findings, study the code, build your own tools. This radically reshapes the way you understand and interact with the world, and is something I think is quite crucial to propagate in the current age.
Why did you create Autonomous Trap 001, besides poking fun at an incredibly hyped technology?
It's part of a body of work / research / writing / fooling about to explore and understand the contemporary technologies of automation, in order to better use them, and in some cases to disrupt and oppose them.
Self-driving cars bring together a bunch of really interesting technologies—such as machine vision and intelligence—with crucial social issues such as the atomization and changing nature of labor, the shift of power to corporate elites and Silicon Valley, and the quasi-religious faith in computation as the only framework for the production of truth—and hence, ethics and social justice.
The Trap falls into the category of resistance, while the attempt to build my own car is a process of understanding how the dominant narratives of these technologies are produced, and could be changed. I don't see why cab drivers of the future shouldn't be chalking white lines on side streets to derail self-driving Ubers which are putting them out of work, and I also think we need more eyes and hands on the tools which are shaping all of our futures.
Were there any unexpected challenges in creating the piece?
I ran out of salt, and had to drive back to the nearest village to buy a few more kilos. Luckily, salt, unlike bandwidth and computational power, is a pretty cheap resource. Also, I should have pulled my trousers up for the video.
This is Autonomous Car Trap 001. Do you have more planned?
I have a habit of numbering things, but yes, there will definitely be more. Like the Drone Shadows, which proliferate to this day, consciously starting a series seems to have generative effects.
Where does this fit in your larger body of work?
It's all part of the same attempt to understand the world and act in it, if that doesn't sound too pompous. This work follows directly from projects on machine vision, artificial intelligence, militarized technology, big data etc.—as well as more, shall we say, poetic interventions into emerging technologies. It's one big rolling project, with occasional bouts of specific obsession.
What's next for you? What other projects are you working on?
This body of work is in part in preparation for a solo exhibition which opens next month in Berlin, at Nome Gallery, called Failing to Distinguish Between a Tractor Trailer and the Bright White Sky. I'll be showing a bunch of different outcomes of the research, including interpretations of the machine vision systems I've been building, and the results of the self-driving car training—and hopefully connecting them to some of my more mythological interests.
I've also got a new commission opening in London next week, as part of Convergence—a series of billboards in East London continuing my search for the Render Ghosts. Beyond that, I'm mostly working on writing projects about the new dark age and the relationship between technology, knowledge, understanding, and agency.

In the waning days of the American Empire a sort of collective madness has seemed to take hold of its ruling class. It is perhaps most clear in the unhinged and incessant decrees of the bloated emperor via tweet. But it is also in the idiotic ramblings of his minions redefining fossil fuels as “freedom gas” or rapidly melting Arctic seas as an economic “opportunity.”  It can also be seen in the reactionary and warmongering responses of the so-called resistance in the corrupt Democratic Party establishment and corporate media regarding Russiagate. Or Bolton and Pompeo inventing evidence to justify more imperial wars just years after the disastrous assault on Iraq and during the longest ongoing US war in Afghanistan. It extends to the incredulous claims of Michele Bachmann that Trump is “godly and biblical” and televangelist Kenneth Copeland, who described his aversion to flying commercial airlines as getting in “a long tube with demons,” calling for a national day of prayer for the orange-tinted tyrant. It is truly staggering to behold.
Amidst all this madness, crimes and atrocities are being committed in broad daylight by that same ruling class both domestically and abroad. In the Middle-East the ruling class, via their corporations General Dynamics, Raytheon, Lockheed Martin and Boeing, is aiding and benefiting from outright genocide in Yemen by the most brutal and criminal of America’s colonies: Saudi Arabia. Similar profits are garnished from backing the apartheid regime in Israel and the military junta in Egypt. In Brazil the ruling class has only just begun to see the dollars roll in from Bolsonaro’s further opening up of the Amazon, the planet’s proverbial lungs. In Modi’s India, they are salivating at the chance to despoil more of the sub-continents riches. And around the world corporations and the fossil fuel industry continues its mad and blind dash toward species extinction.
Back in the US police violence against people of color remains steady and the prison industry is still booming. Along the southern border, migrants from Central America are seeking legal asylum, scores of them young children. Their only “crime” is fleeing their homelands which have been ruthlessly torn up by US foreign policy for at least a century. But they are being rounded up by militias and sent to concentration camps. LGBT and mentally ill migrants are being tortured in solitary confinement. Families are being separated, children caged, violated, dying from preventable diseases.
In the era of social media all of this information is readily available for those interested. Even those uninterested are exposed to what is happening via the ubiquitous social media newsfeed. Indeed, a subdued disquiet among the bourgeoisie has become undeniable. But endless imperialistic wars, rampant corruption, human rights abuses, waning economic advancement, and mass species extinction hasn’t yet prodded most of them from their homes to shut down the machinery of this cult of death, even though it threatens the very futures of their own children. When the bourgeoisie in the US do get out to protest the events are generally scripted, scheduled, sanctioned and televised by the establishment itself. The appropriate permits are obtained. No traffic is stopped. No building is occupied. The status quo remains intact and the necessary steam of middle-class angst is let off until the next event. In the meantime, the war, prison and surveillance industry expand, police militarization continues apace, the environment continues to be raped and pillaged, and fundamental freedoms like speech and reproductive rights are systematically dismantled. By comparison, any actual dissent is met with swift authoritarian violence by the corporate state; Standing Rock Sioux and BLM as stark examples.
Perpetually harried and fearful of losing the tenuous privilege afforded to them by the ruling class, the white middle class in the US has little time to focus on anything outside their prescribed bubble of experience. They inhabit a world constructed by the capricious and cynical designers of the free market. A place devoid of the words “ruling class,” where the mantra of “pull yourself up by your bootstraps” reigns supreme in an era of neoliberal barbarism. Where even if one is working fulltime they may still not have access to basic healthcare coverage. Where they are saddled with enormous debt that can never really be paid off in anyone’s lifetime. Peering at the world through the lens of glowing, hand sized screens, connecting algorithmically to the pulse of a commercially constructed world, most essentially exist in a pixelated prison of suspended and unconnected moments, reinforced by procedural programs which have been meticulously written in the posh and sterile board rooms of Madison Avenue and in the Silicon Valley. History is extinguished here, as are agency and imagination. It is a consumerist world that conforms to the dictatorship of money.
Americans have been socially conditioned for decades to accept these contradictions of their economic, social and political arrangement. Meanwhile suicide is rampant, punctuated by mass shootings. Opioid abuse is taking many more lives. Indeed, the pharmaceutical industry has thrived off this angst, convincing millions that their psychic and social maladies are all due to a personal or chemical defect, not the system itself. That working people barely stave off homelessness and middle class families are increasingly separated from their loved ones and communities by having to travel long hours to a job (or jobs) which hardly covers daily expenses, is a struggle not considered telegenic enough, unless it is cast in the heroic light of “personal responsibility.”
Indeed, Hollywood and corporate media reinforce the mythology of American greatness while its populace becomes ever more weighted down by the late stage capitalist nightmare. Whether it be CNN or MSNBC, distraction from issues related to class or economic disenfranchisement rule the day. Russiagate, the “scary” (and non-existent) migrant caravan, or Trump’s latest outlandish or absurd tweet dominate the news cycles. Catastrophic climate change, the staggering loss of biodiversity, burgeoning suicides among youth, the elderly or veterans, the never-ending and expanding war machine of the Pentagon, growing police violence and a bursting prison industrial complex, corporate and banking corruption, increased economic disparity and hardship? Not so much.
Movies and programs about dystopia have been ubiquitous for many years now, but the factors that contribute to these apocalyptic futures have nothing to do with the actual existential threats we are now facing. Zombies and terrorists dominate the themes presented, and this reflects back on the enormous influence of the Pentagon, Department of Defense, CIA, et al. on mass media. Even video games mirror the warped and expansionist aspirations of the American establishment and its bellicose foreign policy. For decades, these agencies have sought to steer the narrative of American angst toward conformity with the capitalist status quo. And they have been largely successful thanks to many attributes of American life itself. Suburbia and automobile culture after WW 2 erased the commons to create a sort of facsimile of community, often devoid of central spaces, character or originality, and connected by ribbons of featureless highway. Vast dead spaces that are simultaneously everywhere and nowhere at the same time.
But even relatively innocuous programs and movies are divorced from lived reality. I was watching one recently at a friend’s house about a group of friends taking a trip to the wine country. With some mild and typically safe humor to garnish a few chuckles, it was rife with convention and contrivance. The most glaring thing of all, though, was the lack of any class reflected in the character’s diverse lives. All were of the American middle-class in one form or another. Some single mothers, others working highly paid jobs. But none of them facing what the majority of Americans actually face. None of them living pay check to pay check, lacking basic healthcare coverage, paying exorbitant rents or mortgages, or saddled with perpetual debt. But as long as their character’s clothing and surroundings were furnished by Zara, Williams-Sonoma and Pier One, the circumstances of reality were easily eclipsed. Forgotten.
Indeed, the Age of Trump, which is the product of decades of capitalist rot, has demonstrated that the American bourgeoisie have been largely inured to their continually degraded status. They cannot see class oppression because those words are not in the lexicon. Corporate capitalism has created an insular world of sterile detachment from the real world in which it inhabits. “Human resource” departments, situated in nearly every workplace, effectively erase class and context by enforcing optimism and encouraging a kind of self-policed dialogue. Outside this world, mass media manages “threats” by externalizing and otherizing. So little has really changed in the narrative. Once upon a time it was the communists, Jews, Khrushchev, the Vietcong, the sexually “deviant,” people of color, Russia. Now it is migrants, Muslims, Julian Assange, the Iranian Revolutionary Guard, LGBTQ, people of color, Russia. All scapegoats for the country’s failures and abysmal state. All psychic projections of animus and angst for a bourgeoisie in America that never understood the machinations of its ruling class or shook itself free of the “exceptionalism” of its Calvinist puritanical roots.
But the angst of the American bourgeoisie is demonstrated more by what it doesn’t speak about than what it does. It is a disquiet which is at once terrified of the collapse that looms ahead and horrified at the idea of losing the status quo arrangement, even though that status quo is benefiting fewer and fewer people. It stands simultaneously aghast and paralyzed before the obvious madness of its rulers, and yet continually grasps at failed “lesser evilism” as a solution. And it largely still buys into the noxious mythology of it being the “greatest country on earth.” The corporate elite, having stripped down civic education over decades, robbed them of their political agency and resistance and replaced it with a sanitized history and demoralizing optimism, or “positive thinking,” which places all blame for their collective state and its inadequacies on the individual. That it has been so lauded by Wall Street should cause anyone to wonder why it has been so internalized by the disenfranchised masses.
To be sure, this arrangement is rapidly meeting its end. Banking and corporate corruption, never really having been dealt with in the last “Great Recession” or its notorious state funded “bailout,” has only become more blind and reckless. The membrane of the bubble created after that fiasco, born in avarice, is thinning in plain sight. It is about to burst again, and this time it will be far more catastrophic. The endless imperialistic wars that the US has engaged in for the last decades are also creating a financial strain. Coupled with climate breakdown those expensive bases of aggression around the world will begin to cost more than they bring in profit. In the US itself biblical floods are wiping clean the soil graded for agriculture throughout the Midwest and causing tremendous economic hardship for scores of rural and commercial farmers. Droughts offer a grim alternative to this increasingly chaotic climate pattern. Food prices will undoubtedly rise in the future thanks to a capitalist system which creates artificial shortages and surpluses.
Indeed, around the world the climate is shifting dramatically between drought and deluge affecting huge swaths of habitat. Already countless species have succumbed to this ramification of a warming world. But also to industrial pollution, defilement of the oceans, misuse of land and extraction of minerals and fossil fuels: the excesses of capitalism. According to a recent study, a million more species are being marched down the halls of extinction today. Trash is filling the world’s oceans, with birds, turtles and whales washing up by the thousands with bloated bellies full of plastic detritus. It’s literally raining plastic particles now in many places. And all the while the beneficiaries of this pernicious and omnicidal system are dwindling to a select few who are incapable of grasping the quietus of all life on the planet, let alone their own. But without a doubt, this small segment of society will fight ferociously for their continued privilege no matter how untenable, absurd or suicidal it is.
The concurrent madness of the ruling class and the angst of the bourgeoisie in our age isn’t anything surprising. Like the phenomenon of Trump, it has been an unholy union in the making for a long time. The product of empire itself. Social media and the death throes of capitalism have only made it more visible to the general public as of late. But it should be understood that while the ruling class are moneyed and powerful, they are not omnipotent, nor are they more intelligent than the rest of us. On the contrary, even as it sees the demise of the biosphere on which it depends, this “elite” class can do nothing else but marshal the language in an attempt to save its failing economic trajectory. Thus, it is militarizing our collective existential moment: not to save the planet, but to save capitalism itself. And it will do this by deflection, brutally punishing or even eradicating those who have the least impact: the poor, the working class, and the global south.
Under a darkening, climate changed sky, created by the avarice of a few and their ceaseless wars and atrocities, an imperiled and disappearing biosphere lies before us all. Therefore, remaining silent and accepting the status quo in the face of ruling class folly, cruelty and madness, should only be interpreted as complicity to the crime.

As Facebook confronts outrage among its employees and the public for mishandling multiple decisions about its role in shaping public discourse, it is becoming clear that it cannot solve its conundrums without a major change in its business model. And a new model is readily available: for-benefit status.
For decades, a misguided ideology has warped companies, economies and societies: that the sole purpose of corporations is to maximize short-term returns to one set of stakeholders — those who have bought shares. Neither law nor history requires this to be true.
But shareholder value-maximization ideology has become cemented in far too much corporate practice at the expense of societal well-being. This is manifested in many ways: a slavish adherence to the judgment of the “market,” even when other social signals are more powerful; executives enriched by stock options; companies fearful of “activist investors” who attack whenever stock prices fail to meet quarterly “expectations” and often-frivolous shareholder lawsuits pushing for stock gains at all costs.
The pandemic, however, has accelerated an already-spreading recognition that shareholder value maximization is often a harmful choice — not by any means a moral imperative or even a fiduciary responsibility.
Major institutions of capitalism are converging on a new vision for it. The 2019 Business Roundtable CEO statement said that corporate strategy should benefit all stakeholders – including shareholders, yes, but equally customers, employees, suppliers, and the communities in which companies operate. BlackRock CEO Larry Fink’s recent annual letters assert new views of how that investment company, the world’s largest, should invest the trillions it oversees.
Fink’s 2019 letter spelled out a new vision for corporate purpose; the subsequent 2020 and 2021 letters focused on business’ responsibility around climate change, particularly in light of the pandemic. The B Corporation and conscious capitalism movements are growing. The World Economic Forum is championing a “Fourth Sector,” combining purpose with profit. Business schools, facing student rebellions against a purely profit-maximizing curriculum, are rapidly changing what they teach.
And with society under siege, many more businesses, including social media, are scrambling to seem like good corporate citizens. They have no choice.
Facebook, for example, has doubled down on philanthropy and new efforts to combat misinformation, even as usage and share price soar. Platforms like WhatsApp (owned by Facebook) have become essential services to connect people whose physical ties have been abruptly severed during the global pandemic. Shelter-in-place has become, in many ways, shelter-in-Facebook-properties.
But Facebook and its brethren remain fragile. Since the 2016 presidential election in the U.S., Facebook has faced governmental hearings and regulation, public uproar (#deleteFacebook), and huge fines for invading privacy and undermining democracy. These calls were amplified in the weeks following the January 6 Capitol riot. Separately, it faces allegations of bias, largely (though not entirely) from the political right. These have led to calls for the revocation or reform of Section 230 of the Communications Decency Act, which grants it immunity from the actions of its users.
A giant company that is simultaneously essential and pilloried is vulnerable. Just ask the ghosts of John D. Rockefeller and his fellow robber barons, whose huge monopolies industrialized America more than 100 years ago. Journalistic muckrakers and public outrage targeted them for their abusive practices until the government finally broke up their companies via antitrust legislation.
Because Mark Zuckerberg maintains complete majority control of Facebook, he could unilaterally quell public opprobrium and fend off heavy-handed regulation singlehandedly by transforming Facebook into a new kind of business: a for-benefit corporation.
Under the Public Benefit Corporation legal model, firms bind themselves to a public benefit mission statement and carry out required ongoing reporting on both the standard financials and on how the company is living up to its mission. That status protects the company against profit-demanding shareholder lawsuits, and also attracts employees and investors who want to combine profit with purpose.
Data.world is one of the thousands of certified B Corporations that have seen good returns on financial metrics. Allbirds, for example, launched in a few sustainable materials using a pro-sustainability process to manufacture comfortable shoes, quickly reaching revenues of $100 million and valuation of $1.7 billion in an industry fraught with sustainability and human rights concerns. Other household names that are B Corps include The Body Shop, Coursera, Danone, the Jamie Oliver Group, King Arthur Flour, Numi Tea and Patagonia.
Many companies that have not undergone formal B Certification from B Labs have nonetheless done well while transforming their business practices, such as the carpet and flooring company Interface. Some firms incorporate ESG principles into their management systems – the $24 billion (market cap) Dutch life sciences company DSM has for years had meaningful sustainability targets for its senior management that account for fully 50 percent of their annual bonuses. Both Interface and DSM attribute much of their commercial success to their attention to non-financial considerations.
A for-benefit Facebook could similarly relate to the world differently, avoiding many of the reputational shocks and regulatory responses that have led to huge stock dips and enormous fines. Its operations would align with Zuckerberg’s proclaimed purpose to enable the potential abundance that results from connecting everyone in the world.
Imagine a Facebook town hall as a true public square, not just another way to gather and sell people’s data without their explicit consent. Imagine a Facebook that put its users first and its advertisers second; that revealed where ads came from; that earned your attention in a way that you controlled rather than through machine-driven algorithms maximizing your attention for good or ill. Such a for-benefit Facebook could create true buy-in and transparency with its massive community around the world.
Of course, such steps as Facebook’s new Oversight Board, which may provide some meaningful review, don’t require a legal change. But if shareholders and employees continue to be rewarded primarily by the success of the problematic ad revenue model, a continuing conflict between private gain and public benefit makes it impossible to have confidence about what is happening behind the scenes. A shift to for-benefit incorporation and appropriate certification brings with it different performance metrics and accountability systems with public scores.
In changing Facebook into a for-benefit corporation, Zuckerberg could insulate himself against presidential rage while rehabilitating his reputation — and his company’s. It would likely create vast ripples both in Silicon Valley and beyond — and it might help transform capitalism itself.

Ask the author: The evasive virtues and Supreme Court confirmation hearings
The following is a series of questions posed by Ronald Collins to Ilya Shapiro concerning his forthcoming book, Supreme Disorder: Judicial Nominations and the Politics of America’s Highest Court (Regnery Gateway, 2020).
Ilya Shapiro is the director of the Robert A. Levy Center for Constitutional Studies at the Cato Institute and publisher of the Cato Supreme Court Review. He is the co‐author of Religious Liberties for Corporations? Hobby Lobby, the Affordable Care Act, and the Constitution (2014). Shapiro has testified many times before Congress and state legislatures and has filed more than 300 amicus briefs in the Supreme Court. He clerked for Judge E. Grady Jolly on the U.S. Court of Appeals for the 5th Circuit.

Question: What prompted you to write this book, and why now?
Shapiro: I’ve been a “professional” court-watcher for over a decade, and even before that was riveted by Supreme Court confirmation hearings whenever they came up. I recall once walking into a law firm partner’s office for a job interview and he had Samuel Alito’s hearings on TV; we watched for half an hour before getting on with the interview (I got the offer). I even own a complete bound set of volumes from the Robert Bork hearings — picked them up from a library that was discarding these treasures. But anyway, the battle over Brett Kavanaugh showed that the court is now part of the same toxic cloud that envelops all of the nation’s public discourse. I wanted to dive into why that is and whether it can be fixed. And after the central role the vacancy in Justice Antonin Scalia’s seat played in the 2016 election, I knew I had to get this out before the 2020 election.
  Question: How would you summarize the thesis of your book?
Shapiro: Politics has always been part of judicial nominations, but we feel something is now different. The confirmation process hasn’t somehow changed beyond the Framers’ recognition, and political rhetoric was as nasty in 1820 as it is in 2020. Even blocking or not taking up nominees, as happened to Merrick Garland, is hardly novel. But all these things are symptoms of a larger phenomenon: As government has grown, so have the laws that courts interpret, and their reach over more of our lives. Senatorial brinksmanship is symptomatic of a problem that began long before Kavanaugh, Garland, Clarence Thomas or Bork: the courts’ aiding and abetting the expansion of federal power, and then shifting that power away from the people’s representatives and toward the executive branch.
As courts play a greater role, of course nominations are going to be more fraught — especially when divergent interpretive theories map onto partisan preferences at a time when our parties are more ideologically sorted than since at least the Civil War. But in the end, all the “reform” discussion boils down to re-arranging deck chairs on the Titanic, which isn’t the appointment process, but the ship of state. The basic problem we face is the politicization not of the process but of the product. The only way confirmations will be detoxified is for the court to rebalance our constitutional order by returning improperly amassed power to the states, while forcing Congress to legislate on truly national issues.
  Question: What was one of the most important discoveries you made while researching this book?
Shapiro: American history is long enough that there’s little new under the sun. We think we’re at a period of heightened opposition to potential justices, but of 163 nominations formally sent to the Senate, only 126 have been confirmed, a success rate of just 77%. Much of this can be explained by party control of the Senate and White House. Historically, the Senate has confirmed fewer than 60% of Supreme Court nominees under divided government, as compared to about 90% under unified government. And nearly half the presidents have had at least one unsuccessful nomination, starting with George Washington and running all the way through George W. Bush and Barack Obama. Even qualitatively, I would put the Louis Brandeis nomination in 1916 ahead of modern battles in terms of controversy — and it took the longest time — even if he was ultimately confirmed by a more comfortable margin.
  Question: There is a notable element of legal realism in your book, especially in the chapter titled “What Have We Learned?” All seven lessons you set forth there suggest there is no way out of the politicization of the judicial confirmation process. Is that your view? Might the real problem be not so much the confirmation process but the modern use of federal judicial review?
Shapiro: That’s exactly right. We have severe — and sincere — disagreements over the substance of constitutional law and methods for interpreting statutes, ones that can’t simply be waved away by invoking “norms” or “courtesy.” What courts decide really matters, so who decides also matters. I don’t think the problem is with “judicial review” as such — the Supreme Court really doesn’t invalidate many laws, and the Roberts court overturns precedents at a significantly lower rate than its predecessors — but it’s absolutely appropriate for senators (and voters) to debate the theories that potential nominees would apply. Given a finite number of seats, political clashes are unavoidable.
  Question: The inside flap of your book states that the judicial-appointments process has been adversely affected by “decades of constitutional corruption.” Tell us about the nature of that corruption and when it began.
Shapiro: I would trace the corruption to what legal scholars call the “constitutional revolution of 1937,” but that goes beyond that year’s key cases of West Coast Hotel v. Parrish, Helvering v. Davis, Steward Machine Co. v. Davis, and NLRB v. Jones & Laughlin, as well as the previous year’s Butler v. United States, the next year’s United States v. Carolene Products, and the infamous Wickard v. Filburn (1942).
In 1935, President Franklin Roosevelt wrote to the chairman of the House Ways and Means Committee: “I hope your committee will not permit doubts as to constitutionality, however reasonable, to block the suggested legislation.” Eventually, the court rendered constitutional limits on federal power unenforceable and made certain rights more equal than others. After the “switch in time that saved nine,” when the court began approving grandiose legislation it had previously rejected, no federal laws would be set aside as going beyond congressional power until 1995. But even the 1930s and ’40s don’t tell the whole origin story: If the Slaughterhouse Cases (1873) hadn’t eviscerated the 14th Amendment’s privileges or immunities clause, for example, we wouldn’t have the warped conception of unenumerated rights — “penumbras and emanations” and the like — that’s also central to confirmation battles.
  Question: You argue that the court “has let both the legislative and executive branches swell beyond their constitutionally authorized powers.” Can you give us an example of this under the Roberts court?
Shapiro: The most obvious example is National Federation of Independent Businesses v. Sebelius (2012), in which Chief Justice John Roberts transmogrified Obamacare’s individual mandate penalty into a tax. It’s certainly gratifying to those of us in that fight that a majority of justices rejected the government’s assertion of power to compel commerce in order to regulate it. But justifying a mandate with an accompanying penalty for noncompliance under the taxing power doesn’t rehabilitate the statute’s abuses. It merely created a “unicorn tax,” a creature of no known constitutional provenance that will never be seen again. And by letting the law survive in such a dubious way, Roberts undermined the trust people have that courts are impartial arbiters, not political actors.
  Question: You talk a lot about the administrative state (or, as you sometimes refer to it, a “faceless bureaucracy” or “alphabet agencies”). How does this relate to the confirmation process as you understand it?
Shapiro: The collection of ever-expanding powers in the administrative state has transferred decision-making authority to the courts. But when she sat in the hot seat herself, she realized why they did so: There’s no incentive to be more forthright and thus open yourself to attack, and every incentive just to demonstrate deep knowledge and an easygoing manner.
So no, I don’t see a change possible, particularly when senators themselves have an incentive to collect clips of gotcha questioning for reelection or presidential campaigns, as we saw with Sens. Cory Booker (D-N.J.) and Kamala Harris (D-Calif.) at the Kavanaugh hearings. I mean, Sen. Josh Hawley (R-Mo.) can declare that he won’t vote for anyone who doesn’t explicitly come out against Roe v. Wade, but that seems like shooting yourself in the foot barring a huge Republican majority that can afford to lose moderate votes.

Shapiro: As I discuss in my book, this is all about raw politics. The last time the Senate confirmed a nominee from a president of the opposing party to a high-court vacancy arising during a presidential election year was 1888 — that’s the Garland situation — but now the Senate and president are politically aligned.
Moreover, vacancies have arisen 29 times in presidential election years, during the administrations of 22 of the 44 presidents preceding the current one, and those presidents made nominations all 29 times. Nine times presidents made nominations after the election, in the Senate’s lame-duck session, and all but one of those was confirmed, including several after the nominating president lost the election. (Chief Justice John Marshall was one.)
So again, this is purely about politics, not law or precedent, and what McConnell will have to consider are such things as whether confirming someone would hurt the court’s legitimacy and ultimately whether the Democrats would pack the court in response. Of course, some on the left claim that all of the Republican-appointed justices are illegitimate for one reason or another, and McConnell can’t control the Democrats, who may add justices regardless. Shapiro: “Amenable” is the right word. They’re probably not worth the effort to get a constitutional amendment, which I’m convinced would be required despite clever academic theories to the contrary. If the most common proposal, 18-year terms with a vacancy every two years, had been around the last few decades, the court’s makeup would hardly be different; there would now be three Bush II appointees, four Obama appointees, and two Trump appointees – in other words, still five Republican-appointed justices to four Democratic-appointed ones.
In the last 50 years, there have been 30 years of Republican presidents and 20 years of Democratic ones; if anything, liberal voices have been overrepresented. But even if term limits wouldn’t change the court’s decision-making, they might be worth trying anyway because at least there would be less randomness. As Orin Kerr put it: “If the Supreme Court is going to have an ideological direction — which, for better or worse, history suggests it will — it is better to have that direction hinge on a more democratically accountable basis than the health of one or two octogenarians.”

Google pushes Europe to limit ‘gatekeeper’ platform rules
Google has made its pitch to shape the next decades of digital regulation across the European Union, submitting a 135-page response yesterday to the consultation on the forthcoming Digital Services Act (DSA) — which will update the bloc’s long-standing rules around ecommerce.
The package also looks set to introduce specific rules for so-called “gatekeeper platforms” which wield outsized market power thanks to digital network effects. Hence Mountain View’s dialled-up attention to detail.
The lion’s share of Google’s submission focuses on lobbying against the prospect of ex ante regulation for such platform giants — something the European Commission has nonetheless signalled is front of mind as it looks at how to rein in platform power.
This type of regulation intervention aims to identify competitive problems and shape responses ‘before the event’ via the application of obligations on players who hold significant market power vs after the fact competition enforcement when market harm has been established.
“A blanket approach to ex ante competition regulation could have unintended consequences on user experience as well as multiplying costs for European businesses,” it writes, urging lawmakers to take a long, hard look at existing regulation to see if it’s not able to do the job of ensuring markets are “working properly”.
“Where the evidence shows meaningful gaps, the next step ought to be to consider how one can modernise those existing rules and procedures to address the underlying concerns before turning to consideration of new and distinct regulatory frameworks,” it adds.
If EU lawmakers must go ahead with ex ante regulation of platforms giants, Google — an adtech giant — is especially keen that they do not single out any specific business models. So it definitely wouldn’t be a fan of ex ante regs applied only to surveillance-fuelled ad-targeting platforms. Funny that.

Regulators should not favor or discriminate against any business, business model, or technology from the outset,” it goes on.
“In certain sectors, the platform may have market power; in others, it may be a new entrant or marginal player. The digital ecosystem is extremely diverse and evolving rapidly and it would be misguided for gatekeeper designations to be evaluated by reference to the position of an entire company or corporate group.”
Nor should lawmakers opt for what Google dubs “an overly simplistic” assessment of what constitutes a gatekeeper — giving the example of number of users as an inadequate way to determine whether a platform giant has significant market power in a given moment. (Relevant: Google market share of search in Europe exceeds 90%.)
“Recent competition enforcement demonstrates the range of platforms that have been found to have market power (e.g., Microsoft, Google, Facebook, Amazon, and Apple) and other platforms may be found to have market power in the future (borne out, for example, by the UK CMA’s investigation into online auction platform services),” it writes. “The gatekeeper assessment should therefore recognize that a range of platforms — operating a range of different business models (e.g., ad-funded, subscription-based, commission-based, hardware sales) — may hold ‘market power’ in different circumstances and vis-à-vis different platform participants.”
The tech giant can also be seen pushing a familiar talking point when its business is accused of profiting, parasitically, off of others’ content — by suggesting that when regulators are assessing whether a platform is a gatekeeper or not by considering the economic dependence of traditional businesses on a limited number of online platforms they should look favorably on those platforms “through which a materially significant proportion of business (e.g. in the form of highly valuable traffic) is channeled”.
But of course it would say that clicks are just as good as all the ad dollars it’s making.
Google is also pushing for regular review of any gatekeeper designations to ensure any obligations keep pace with fast-moving markets and competition shifts (it points to the recent rise of TikTok by way of example).
It also doesn’t want gatekeeper designations to apply universally across all markets — arguing instead they should only apply in the specific market where a platform is “found to have ‘gatekeeper’ power”.
“Large digital platforms tend to operate across multiple markets and sectors, with varying degrees of competitive strength in each,” Google argues, adding that: “Applying ex ante rules outside these markets would create a risk of deterring pro-competitive market entry through excessive regulation, thereby depriving SMEs and consumers of attractive new products.”
That would stand in contrast to the EU’s modus operandi around competition law enforcement — where a business that’s been judged to be dominant in one market (like Google is in search) has what competition chief Margrethe Vestager likes to refer to as a “special responsibility” not to abuse its market power to leverage that advantage in any other market, not only the one it’s been found to hold most of the market power.
At the same time as Google is lobbying for limits on any gatekeeper designations, the tech giant wants to see certain types of rules applied universally to all players. Here it gives the examples of privacy, transparency (such as for fees) and ranking decisions.
Data portability is another area it’s urging rules to be applied industry-wide.
It also wants to see any online ad rules applied universally, not just to gatekeeper platforms. But it’s also very keen for hard limits on any such rules.
“It will be important that any interventions seeking to achieve more transparency and accountability are carefully designed to avoid inadvertently hampering the ability of online advertising tools to deliver the value that publishers and advertisers have come to expect,” the adtech giant writes, lobbying to reduce the amount of transparency and accountability set down in law by invoking claims of privacy risks to user data; threats to commercial IP; and ‘bad actors’ gaming the system if it’s not allowed to continue being (an ad-fraud-tastic) blackbox.
“Consideration of these measures will therefore require the balancing of factors including protection of users’ personal data and partners’ commercially sensitive information, and potential harm to users and competition through disclosure of data signals that allow ‘bad actors’ to game the system, or rivals to copy innovations. We stand ready to engage with the Commission on these issues,” Google intones.
On updating ecommerce rules and liability — which is a stated aim of the DSA plan — Google is cautiously supportive of regulatory changes to reflect what it describes as “the digital transformation of the last two decades”. While pushing to retain core elements of the current e-Commerce Directive regime, including the country-of-origin principle and freedom to provide cross-border digital services. 
For example it wants to see more expansive definitions of digital services, to allow for more specific rules for certain types of businesses — pushing for a move away from the ‘active’ and ‘passive’ hosts distinction for platforms, to enable them to respond more proactively in a content moderation context without inviting liability by doing so, but suggesting hosting services may be better served by retaining the current regime (Article 14 of the e-Commerce Directive).
On liability for illegal content it is lobbying for see clear lines between illegal material and what’s “lawful-but-harmful”.
“Where Member States believe a category of content is sufficiently harmful, their governments may make that content illegal directly, through democratic processes, in a clear and proportionate manner, rather than through back-door regulation of amorphously-defined harms,” it writes.
It also wants the updated law to retain the general prohibition on content monitoring obligations — and downplays the potential of AI to offer any ‘third way’ there.
“While breakthroughs in machine learning and other technology are impressive, the technology is far from perfect, and less accurate on more nuanced or context-dependent content. Their mandated use would be inappropriate, and could lead to restrictions on lawful content and on citizens’ fundamental rights,” Google warns. “The DSA can help prevent risks to fundamental rights by ensuring that companies are not forced to prioritise speed of removal over careful decision-making,” it adds, saying it encounters “many grey-area cases that require appropriate time to evaluate the law and context”.
“We remain concerned about recent laws that enable imposition of large penalties if short, fixed turn-around times are not met,” it goes on, pointing to a recent ruling by the French Constitutional Council which struck down an online hate speech law on freedom of expression grounds.
“Any new standard should safeguard fundamental rights by ensuring an appropriate balance between speed and accuracy of removal,” Google adds.

AI year in review: Opportunities grow, but ethics loom large

Automated AI for the enterprise
The enterprise cloud market heated up with increased implementation of automated machine learning (AutoML) that allows customers to apply AI to use cases such as marketing, customer service, and risk management. The biggest players in cloud computing — Google, Microsoft, and Amazon — spotlighted AI tools and automation in their annual tech showcases. Microsoft summed it up at Ignite 2019 with its tagline for Azure Cognitive Search: “Use AI to solve business problems.”
At the Google Cloud Next conference in April, Google announced new AutoML classes, premade Retail and Contact Center AI services, and the collaborative model-making tool AI Platform. In December, Amazon launched a blizzard of AI-powered enterprise tools at its re:Invent 2019 conference.

At the other end of the network — the edge — software advances like federated and multimodal learning are enabling artificial intelligence on smartphones and other devices, with the promise of greater control and better privacy protections compared to AI processed in the cloud. And even closer to home, Sense released a line of AI devices to monitor and reduce household energy use, while Evolve Energy’s AI helps solar and wind power customers find the best prices and save energy.
Shipping and shopping
Besides consumer energy monitors like the above, 2019 saw huge advances in areas like autonomous cars and the internet of things (IoT). AI also made inroads into such everyday tasks as grocery shopping.
Self-driving cars from the likes of Uber, Lyft, Alphabet’s Waymo, Tesla, and Argo are the pretty face of autonomous vehicles, and consumer sentiment reports suggest the public is warming to the idea. But commercial trucking was where the money was in 2019. Carmaker Volvo is so confident in the viability of its smart trucks that it’s going to break out its driverless financials starting in 2020, although it faces competition from the likes of TuSimple, which is testing delivery for the U.S. Postal Service; Daimler, which is testing autonomous trucks in Virginia; and Starsky Robotics, which relies on remote teleoperators to run its test fleet.
Competition in the AI assistant market is still greatest between Amazon and Google, rivalry that has spurred the performance and capabilities of voice recognition and personal assistants. Amazon and Microsoft launched the Voice Interoperability Initiative in September, along with a slew of partners — absent Apple, Samsung, and Google — that seek to allow devices to run more than one assistant. There’s good reason for Microsoft to join, since it’s become clear its Cortana is not beating Amazon’s Alexa or Google Assistant anytime soon. But Samsung’s Bixby also stepped back in acknowledgment of its market position. As for which voice assistant is best, Google Assistant keeps coming out on top in accuracy tests, although in a May 2019 test by Tom’s Hardware, Alexa and Siri were not far behind.
AI went mainstream for grocery shopping in 2019. Walmart is using AI to improve online grocery ordering, employing machine intelligence to figure out what consumers are likely to need, and it’s begun using driverless vans to ferry goods between stores in Arkansas. Meanwhile, Microsoft helped grocery chain Kroger create cashierless stores using smart shelves and other intelligent technology, while the Giant Eagle chain turned to Grabango for its own AI trial.
Governmental give-and-take
Politicians and corporations clashed throughout 2019 over the appropriate use and oversight of AI. Famously, one of Democratic senator and presidential candidate Elizabeth Warren’s campaign promises is to break up big tech businesses like Google and Amazon. “With fewer competitors entering the market, the big tech companies do not have to compete as aggressively in key areas like protecting our privacy,” Warren’s campaign blog states. While China has been using facial recognition to regulate cell phone accounts and allegedly round up the Uighur minority population, most governments in the U.S. that examine the technology do so to limit or ban its use. Especially in California, San Francisco and other cities are enacting bans on use of facial recognition by public entities, particularly police departments.
Detroit has no such ban, and indeed its police chief, James Craig, is enthusiastic about facial recognition’s potential to fight crime. This led to an August 2019 Twitter beef for the ages between Chief Craig and Detroit’s U.S. Congressional Representative, Rashida Tlaib (D-MI), that ended in an awkward demonstration of the technology that frustrated both sides.
The tide could turn if President Trump wins re-election in 2020, as his administration takes a more collaborative approach to AI. If the eventual Democratic nominee is Senator Bernie Sanders (D-VT), and he wins, Chief Craig might be out of luck. But legislation to regulate facial recognition has been surprisingly nonpartisan so far.
Smart cities
Despite privacy concerns over government use of AI, the technology can improve everyday life, especially if proper care is taken to consider the ethics.
The amount of data being created by smart cars, roadside cameras, public transit, and other sensors is overwhelming, but by feeding it into AI systems, companies like Waycare are helping cities predict and improve traffic flow. StreetLight Data takes a different approach: By tapping into cellphone location data, it can track and predict traffic for vehicles, bicycles, and pedestrians. London is using Waze to tackle traffic congestion in the city center and reduce air pollution. Elsewhere, Alphabet division Sidewalk Labs is helping Toronto push the envelope of smart city technology, fed by weather and usage patterns, to create a high-tech innovation district.
Norway has emerged as a hotbed for startups leveraging AI to build better cities. Oslo-based Spacemaker‘s software allows city planners to estimate the effect of each planning decision and optimize for a range of goals, courtesy of machine learning. And in August, the city of Trondheim unveiled Powerhouse, a smart office building designed to generate more energy than it consumes and apply the excess to powering other smart city tech, such as road monitoring.
As 2019’s projects come to fruition in 2020 and beyond, it will be interesting to watch how AI develops in the real world. Ethical oversight will be needed to make sure the technology continues to serve humanity, rather than the other way around.

Rather than suggest a specific site for product reviews, I’ll do a short list of “tells” I use to rate a site as biased, corrupt, feeder, independent, sold out, expert etc. Based on the final “score” of a site, I’ve found it pretty effective at saving hours going through semi-convincing blarney and - more important - saving me losing money on purchasing substandard products.
If there’s a link to Amazon (or equivalent) to buy the product being reviewed, the site is getting a kickback and the review will be biased. This has infiltrated many of the established review sites as they try to stay profitable, compromising integrity.
Is the site is specialist? Does it focus solely on certain types of product (e.g. high-end audio equipment)? Is the site independent (i.e. not owned by some megacorp)? Then it will be worth looking into further.
How much history does the site have? When was it founded? Was it once (or is it still) print media? How many mouths does it have to feed? Truth is, a site that began print media and contracted online only but maintains a staff, should be treated as suspect. They’ve every reason to sell bias and corrupt reviews.
Does the site have no product purchase links of the type of product you’re looking into? Sometimes sites only link to specific affiliates (i.e. sponsors). Does it have no Amazon ‘deals’? If not, then this is promising.
Is the site well established but not linked into the top pages of Google and not thrown up as a top search result by dint of sponsorship? This is promising.
If the site is selling the product directly, in-house reviews will be biased and “verified purchaser” reviews will likely be corrupted.
Sites like Analyze and identify fake reviews and ReviewMeta.com - Amazon Review Checker can be useful for extreme cases but these days they’re easily fooled too. Still, another layer of safeguarding.
If the site is sufficiently general - like if it does more than just review products of a certain type - it may be on Trustpilot Reviews: Experience the power of customer reviews and this is worth checking. If the site is listed bad on Trustpilot then it’s got problems.
What I do is pick a few products I know personally - ideally one’s with specific flaws that are obvious to any purchaser but won’t be in the press releases - and see if the reviews hit on those issues. If they do, and there’s similar integrity and fidelity on comparable products (i.e. the site isn’t just a feeder for a certain brand, rubbishing everything else) you may have hit gold!
Is the site up to date? Is the site suspiciously recommended on 3rd party platforms like Quora, often using a cut and paste answer to semi-related questions (a keyword sniper bot).
Does the site frontline articles that try to look like reviews but are trying to cover products not yet released to the public? Unless the site has a pre-release physical product this is a surefire blag and the reviews will be compromised.
Does the site cover only big brand names? This is a bad sign. No product type is populated solely by big household name brands.
Does the site cover a reasonable spectrum of price options for products of the same type? If not, there’s reason to be concerned. Example: a site reviewing action cameras will invariably have the GoPro but there’s options for 1/10th the price - not as good but still, similar basic functions.
No review site can be authentic without dealing with both highest and lowest price and, most important, giving you satisfactory explanation WHY there is such a difference between top and bottom.
Is the review site classifying based on price rather than rating? This should be looked into because many sites use the budget v best divide to avoid having to directly compare essentially similar products. It’s a tactic you’d expect from a site trying to sell expensive and budget versions without putting off the buyer by telling the rich guy he’s paying more for nothing, or the poor guy he can’t actually afford a decent version of the product.
Does the review site include the name of the individual reviewer of the product? Is there contact details for that reviewer? Does the reviewer include an abridged resume? If not, it’s cause for concern.
Online versions of newspapers sometimes do ‘best in class’ reviews for mainstream products under headlines like “Which is the best blah blah?”. This will likely be biased, compromised and an evolved money spinner for the newspaper.
You’ll be able to tell a fake review if the review/list has very little about the shortcomings and frontline issues with whatever technology (industry standards) instead focusing on positives.
A genuine enthusiast (or expert) will review with sincere interest in the product type as a whole. This review will put the product in context, make comparisons with other options, pinpoint pros and cons some of which will be industrywide and therefore on ALL reviews of the same type.

Does the site or the product have customer submitted reviews? If the site or product has customer submitted reviews the only useful info can be gleaned is from the "eloquent midrange" i.e. 2 and 3 star, and longer considered 4 star reviews. Cut off the 5s and the 1s. The former tend to be biased. The latter tend to be edgecases like a product delivery being screwed up (which tells you nothing about the product itself). Cut off reviews that are shorter than 2 sentences. Cut off reviews that don't mention at least three specific features of the product with an opinion, i.e. the battery life was excellent is OK but the phone came with a replacement battery is not!
Biased or covert-sponsored reviews share some techniques. Most abused is “infectious enthusiasm” where the reviewer moons over tech - scripted by press releases - glossing over shortcomings e.g. “the battery life is a decent 25 seconds” or “sleek, chic, Milan-inspired design contours more than make up for the loss of headphone jack; and of course most have switched to USB-C already.” Real reviews are less bright and bubbly, more demanding and pedantic.
Many sites try to appropriate an expertise they may (through the individual contributors involved) be able to call on, but experts need money same as everyone else and selling endorsements - even on the level of an obscure tech geek - can be a nice little income; and is popular with corporate brands as it boosts edgy and niche credibility (on which mainstream success MUST be built, if it wants to last).

Bias, corruption, covert-sponsorship: there will be an overload at the top/highest end and either an absence of 2-3 stars + plenty of 1* or a lack of 1* and some 2* and 3*. These latter will often be the non-brand name versions.
True review articles will weight more towards criticism than congratulations, i.e. the review will be into the type of product or the genre of service so will be very aware - and keen to share - insight into the shortcomings of the industry as well as the failures of the actual product. Corrupted or dodgy sites won’t have this sort of scope. It doesn’t help the cause of easy profiteering to have normal industry standards exposed as sub-standard nor does a product sell as well if a trusted review spotlights its pros and cons without 4 to 1 favouring the pros.
These are just some rough notes on the product fake-news reviews and sites that claim to be a one-stop place to find information and comparison tests between ‘rival’ products.
