Alright y'all, I'm going do something I don't normally do and get political for a minute. I mean, I reblog things that are political sometimes, but I don't make my own posts about them.
So, I was on Kamala Harris' wikipedia page. Bc she's running for president. And I'm gonna vote for her bc she's not Trump. But I wanna see what she stands for or whatever. For what that's worth in American politics these days. (btw how fucked up is it that everyone refers to Biden and Trump by their last name, but Kamala by her first? like with Hillary there was the excuse of her last name being tied to a former president aka her husband. but with Kamala Harris there is no reason to justify it? it's just plain old sexism)

For those of you who don't know what Prop 21 is, here is a summary from the wikipedia page:

Major provisions of the proposition, as summarized by Attorney General of California are:

As someone who works with kids, let me just say that charging a literal teenager as an adult is absolutely horrendous. Because they are not adults. Studies have, in fact, shown that the adolescent brain is only about 80 percent developed.
I have worked with teenagers. They are not children, but they aren't adults. Like Britney Spears said "Not a girl, not yet a woman" Except you know, replace girl and woman with whatever your gender is.
And it's tough for these kids. I think a lot of adults forget how hard it is. Puberty. Hormones. The social hell that is high school. And there are so many of these kids walking around undiagnosed. Bc a lot of mental illnesses can trigger in your teenage years, most commonly depression and anxiety. Which is like, just a natural fear response to the American education system, tbh. Not only for mental illness, but also for disorders and disabilities. There are parents who refuse to get their kids help. I'm not talking about the 'I don't want to medicate my child' people, though they are annoying af too. Like, there are parents who will be told somehow by the school system that their child is showing delays, etc. And they just...refuse to process that. They can't accept it, so their kid goes their whole life until adulthood without getting the help they need. Some of them get help as adults. Some of them don't. And that's not even to mention the dozens of kids who fall through the cracks.
So I personally think it's a good thing that our possible future president was opposed to it. Like, she's got that going for her. And in today's political hellscape I take my wins where I can.

That whole article I've been "debunking" since it first popped up, usually once I point out the details behind it people drop it for a while then forget and then it shows up again.
Lather rinse repeat.
It's great outrage bait, wish people would look at the date by now is all but for the most part I don't blame them it's a headline that is designed to get you seeing red not reading the article.
It's not one that it's easy to make sound good honestly.
Also I was way off on the romeo and juliet thing, it was 10 years and the age of consent was 14 so theoretically a 24 year old and a 14 year old could do the deed and the 24 year old could avoid being on the list for life.
New law didn't change that part just made it so oral and anal sex were counted the same as vaginal, so they could stay off the list.

That being said, I cannot in my mind as a mother understand how sex between a 24-year-old and a 14-year-old could ever be consensual."
Oddly enough now the critics of the bill got what they wanted in the end, so I'll call that a win.
General rule of thumb, if you see some freaky sex law coming out of CA scott wiener will be involved somehow and people will likely blow the wrong part of it out of proportion.
And remember kids, when I say I'm not a conservative you should probably listen and stop trying to label me, you'll likely be wrong.

Okay so as most people most likely already know, I am not American or living in america so I am not familiar with american laws in-depth. I know about international law (as the ICC and UN etc) because international law covers all countries, otherwise I primarily know the law of my own country and EU bc my country is a part of EU.
However, I did quickly look into it and it seems the point of Megans Law is to publicize sex offenders in an effort to protect the community. So esentially you have to register so that anyone living close by or in your neighborhood etc is aware that there is a presence of a sex offender.
So him moving states and not registrering is a crime bc his punishment as a sex offender includes being registered as a sex offender (for however many years) so he would esentially have comitted a crime for not registrering when he moved.
So Megans Law is about transparency in the community when it comes to sex offenders in order to be able to protect everyone living there.
I am not sure what else the law entails, that's just what I got from it when I looked it up quickly 🥰

California SB-145 does not legalize sex with children. SB-145 expands the kind of sex acts that judges have discretion over to not have a defendant register as a sex offender. For example, prior to SB-145, in the case of a 19 year old boy having PIV sex with his 17 year old girlfriend, which constitutes statutory rape, a judge could elect to not have the 19 year old register as a sex offender. However, again prior to SB-145, in the case of a 19 year old boy having anal sex with his 17 year old boyfriend or a 19 year old girl having oral sex with her 17 year old girlfriend, a judge had no discretion and the 19 year olds would have to register as sex offenders. SB-145 simply gives a judge discretion to not have an individual register as a sex offender regardless of the sex act (i.e. PIV, anal, oral) as long as there is at most a 10 year age difference.
So in summary, it removes discrimination against the LGBTQ+ community, still requires an individual register as a sex offender if there is more than a 10 year age gap, and still allows a judged to require an individual register as a sex offender if they see fit regardless of the sex act or age gap.
Also the age of consent in California is 18 meaning there is no consensual sex with a minor in Californian because they have no Romeo and Juliet law. So all sex with minors is statutory rape. It’s just that under California law and with SB-145, judges can decide not to have individuals register as a sex offender if they see fit. The judge’s discretion essentially functions as a Romeo and Juliet law in terms of registration as a sex offender.

Here is another example from Indiana, which is very strict, and includes those who commit sex offenses over the ages of 14, which James was at 15.
James is not a muggle. Legally speaking in the wizarding world he may not have committed legal sexual assault, but to just to give you guys an idea, in the muggle world at the very least he would be potentially convicted of sexual misconduct, which is a misdemeanor and caries a minimum sentence of 4 years. This would likely be done in a juvenile hall. No James did not Rape Severus. I never claimed he did. What I am saying is sexual assault is a broad term that covers a range of sex offenses, and this includes pantsing in both California and Indiana.
Lastly, legality is often no measure of morality. The amount of pain and humiliation that Severus must have gone through being forcibly stripped naked is something which I have experience and let me tell you it sticks with you forever. Lastly, when it happens to me I was only in the presence of my three cousins, I can’t imagine being humiliated like that in front of my peers.
Here is a case where a boy committed suicide as a resault of being “pantsed”. It is not a lighthearted prank.

Opinion: Sex Offender Registration Doesn’t Help Victims, Hurts Young Offenders
Jason was 14 years old when he met his first girlfriend, a 13-year-old neighbor of the foster family with whom he lived. After a few months of dating, his girlfriend’s mother walked in on the teenagers engaging in consensual oral sex and called the police. Jason was arrested and charged with child molestation. He was adjudicated delinquent in juvenile court and placed on the California Sex Offender Registry. Before he was old enough to drive, Jason was branded a sex offender on a public, searchable website.
Now in his 30s, Jason suffers from depression and has experienced homelessness. Despite earning a college degree, he cannot find steady employment. An internet search shows he is a registered sex offender.
Jason is like many others who struggle to lead a healthy adult life because of a juvenile adjudication based on unsurprising adolescent behavior. States across the country place children as young as 8 years old on sex offender registries for conduct that is otherwise developmentally normal.
Required by federal law, this label imposes barriers on young people’s access to education, employment and safe housing. It can devastate them psychologically with little benefit to the community.
Youth sex offender registration costs the public over $3 billion a year. Rather than investing in preventive programming and victims’ services, resources are routinely allocated to a carceral and punitive response. Meanwhile, research-backed social programming and community needs remain largely underfunded.
For example, in 2017 California spent $140 million to register and monitor 3,500 youth registrants. Yet that same year, the budget for prevention programs and victims’ services was only $46,000.
In addition to the high cost of registration, sex offender registries do not advance the public safety goals for which they were created. Only 3% to 5% of youth who commit sexual offenses are likely to reoffend, showing that registration wastes resources on individuals who pose little to no risk of future harm.
State rules hard to understand
Youth are required to register as sex offenders for a wide range of offenses, including consensual sexual relationships, sexting and public urination. These laws have a disproportionate impact on marginalized communities. Laws that criminalize consensual same-sex relationships disproportionately target LGBTQ youth. Racial bias in charging and sentencing can also lead to greater numbers of Black and brown youth on the registry.
A recent report by Juvenile Law Center shows that 39 states place children on sex offender registries. The registration procedure and consequences vary widely from state to state. Youth can be required to register for their entire lifetime in some states, which dooms them to a life on the margins.
Indeed, once labeled a sex offender, the stigma remains regardless of how long the registration period lasts; web-based information and databases often remain online and accessible even if the period of registration has long since ended. These registration laws completely disregard the rehabilitative purpose of the juvenile justice system.
Today, approximately 200,000 individuals are on sex offender registries for offenses committed prior to age 18. Registered youth face harsh restrictions that regulate where they can live, work or attend school. Some states prohibit such youth from residing with other children in the home, which can preclude youth from living with siblings or their own children or partner’s children. Registration can also prohibit youth from living within a church or school zone, effectively prohibiting them from practicing their religion or receiving an education.
State registration laws are complex and difficult even for most adults to understand. Yet youth are expected to understand and comply with the numerous restrictions and reporting requirements, despite the many practical challenges of doing so. States require youth to update and verify their information regularly, including when any information has changed.
If a youth is traveling between states or even within counties in their own state, they may have to report or register. When they are unable to comply with the complex and untenable registration and reporting requirements, they can face fines, incarceration and extended registration.
Additionally, many states require information about registered sex offenders to be posted on a public website, made available at local police stations or disseminated to the youth’s communities. This community notification often results in humiliation and social ostracism—even vigilante violence in some cases—and imposes a negative self-image upon the youth.
Children on sex offender registries are four times more likely to report a recent suicide attempt compared to nonregistered children who have engaged in harmful or illegal sexual behavior. Stigmatization from sex offender labeling frequently deprives youth of vital sources of psychological support at the precise time they most need community acceptance. And, in many cases, that support is not publicly funded or accessible to those who need it.
The draconian practice of youth sex offender registration imposes an unending loop of barriers and obstacles on youth without improving public safety. It also needlessly shifts resources away from important services such as sexual violence prevention and victim assistance. That is why the time is now to abolish the harmful practice of placing youth on sex offender registries.

Trans woman has a history of sex crimes
In June, a group of women complained that a person who identified as female exposed their penis at the Wi Spa in Los Angeles. The incident led to months of sometimes violent protests, with media outlets declaring it an example of bias against the transgendered, or even that it didn’t happen. Slate said it was a “transphobic hoax.”
But on Monday, charges of indecent exposure were discreetly filed against a serial sex offender for the Wi Spa incident, following an investigation by the Los Angeles Police Department.
Sources with knowledge of the case but not authorized to speak publicly say four women and a minor girl came forward to allege that Darren Agee Merager was partially erect in the women’s section of Wi Spa. Besides being a suspect in this case, Merager is facing multiple felony charges of indecent exposure over a separate incident in Los Angeles.
Merager, who spoke exclusively to The Post, denies the allegations and says that she is actually the victim of transphobic harassment.
On June 23, several women confronted staff at the Wi Spa in Los Angeles’ Koreatown over accusations that a person exposed male genitalia in the women’s section. Video of the interaction was posted the following day on Instagram by a woman using the name “Cubana Angel.”
“It’s okay for a man to go into the women’s section, show his penis around the other women, young little girls — underage — in your spa?” she asked the staff. “He’s a man! He is a man!” The three-and-a-half-minute video was reposted across social media and promptly went viral.
“Cubana Angel” spoke at a press conference on July 7 in Pasadena next to her attorney. “As I was walking, I noticed something that was really disturbing, something that caused me to feel that I was transported into the men’s locker room,” the woman said.

She said some women and girls were uncomfortable and began putting their robes back on. She complained to staff, where the video was recorded, but they legally could not do anything because of California law. “We as women have rights to be safe in public spaces and they are being violated by men,” she said.
Both “Cubana Angel” and her attorney, Marc Little, declined to comment for the story.
The video was followed by weeks of sometimes violent face-offs between right-wing and Evangelical Christian protesters at the Wi Spa, and Antifa and far-left counter-protesters. On July 3, after police formed a line to separate the two groups, 40 people were arrested.

The LAPD so far have confirmed few details about the Wi Spa incident. Inquiries sent to the department were responded with statements saying the investigation is “ongoing.”
Then, this week, a warrant was issued in Los Angeles County for the arrest of 52-year-old Darren Merager, of Riverside, Calif., based on five felony counts of indecent exposure in connection with the Wi Spa incident. As of publication, Merager has not been arrested.
”Everything about the Wi Spa was a bunch of garbage and lies,” Merager said in an interview. She says she is legally female in California and was in a jacuzzi in the women’s section when she was accosted by “Cubana Angel.”
“She never saw me naked. I was underwater with water all the way up to my chest.” Merager denies ever being erect or around children at the spa. She says she is actually the victim of sexual harassment by transphobic women at the Wi Spa.
Law-enforcement sources revealed that Merager is a tier-one registered sex offender with two prior convictions of indecent exposure stemming from incidents in 2002 and 2003 in California. She declined to comment on the convictions. In 2008, she was convicted for failing to register as a sex offender.
A law passed by California Democrats that went into effect this year replaced the state’s lifetime registration requirement to a tiered system. The law allows lower-tiered sex offenders to petition to be removed from the list. However, Merager is not eligible due to ongoing criminal charges. She also has a long criminal history in California that includes nearly a dozen felony convictions for crimes ranging from sex offenses to burglary and escape.
In addition to Merager’s new felony charges of indecent exposure, she is also facing six felony counts of indecent exposure over a separate locker room incident in December 2018. Los Angeles County prosecutors accuse Merager of indecent exposure to women and children in a changing area at a swimming pool in West Hollywood Park.
“Merager claims to identify as female so he can access women’s locker rooms and showers,” reads an internal flyer by the Los Angeles County Sheriff’s Department that was sent to law enforcement departments in southern California in late 2018. Merager has pleaded not guilty to all six counts and her next court date for the incident is on Sept. 8. Merager told law enforcement she’s transient but bail was set at $150,000 in early 2019, which was paid.
Merager says her open cases involving accusations of indecent exposure show a “pattern of abuse” from a state and society that punishes transgender people. “You allow [trans women] to go in there [women’s spaces] and then people simply claim indecent exposure and you’re arrested,” she says.
Merager says she is speaking with progressive California lawmakers, like state senator Scott Wiener, in the hope that they change state law to better protect trans people.
“If you go into an area where you’re expected to be nude, there has to be an indecent exposure exemption,” she says. Merager says she may file complaints or lawsuits for the discrimination she says she has been made to suffer by law enforcement and women in the Wi Spa. She says she has been in contact with the Los Angeles County District Attorney’s Office since learning of the warrant and plans to turn herself in.
