I have to disclose that I am not a financial advisor or an accountant <3
Trusts: You want to consider purchasing the properties under a trust. Tax implications can vary under trusts. Revocable living trust will allow you to be treated as the owner, but in an irrevocable trust, it is a separate entity. In some structures, you would only pain capital gains, which can also be transferred to a separate trust, and you do not end up paying capital gains on the property. You do this with a charitable remainder trust. Generally, if a property is held in a trust, rental income generated from that property is typically subject to income tax. The trust itself may be responsible for paying those taxes, or the tax liability might pass through to the beneficiaries, depending on the type of trust and its specific provisions. This will change the amount you would pay in taxes. If the property was purchased as a primary home, there could also be capital gain exceptions depending on the trust. Your income affects the rates you pay on specific trusts. Before I continue, I want to suggest speaking to an actual attorney, not an accountant. Most are not knowledgable or equipped to properly guide you here. Same as with traditional, in a trust you can deduct property related expenses like mortgage interest, property taxes, maintenance costs, and depreciation, from the rental income. This can help reduce the taxable income generated by the property.
IRA's: You can use a self directed IRA or other retirement accounts to invest in real estate. The gain from these investments grow tax deferred within your account. This is something you should also consider doing.
Depreciating assets: Real estate can depreciate overtime. This doesn't include land. But when it depreciates, you can deduct the properties cost. This would offset the income you would pat taxes on.
1031 Exchange: Filing a 1031 will allow you to defer paying capital gains on an investment property when it's sold, as long as another "like kind" property is purchased with the profit gained from the sale.
Mortgage Interest Deduction: Interest paid on mortgages for investment properties can be deducted.
Carry Forward: If your expenses exceed your rental income, you could have a net loss. Some of these losses can be used to offset other taxable income, while others might be carried forward to future years.
Living in the property: If you live in the property for 2 years. you can exclude a portion of the capital gains from your taxable income when you sell.
Opportunity Zones: Opportunity zones offer tax incentives, including deferring and potentially reducing capital gains taxes.
Expenses: All repair expenses can be deducted.
Installments: You can structure your sale to receive payments over time. This spreads out the capital gains and reduces tax impact.
Tax Credits: There are a ton of tax credits for investors. Would research in your state.
More deductions: Interest on a mortgage for an investment property is typically tax deductible, as are property taxes and many other expenses related to the property like Insurance premiums.
Cost segregations: You can hire someone to reclassify certain areas of your property to accelerate depreciation. This will give you a significant upfront tax deduction.
Pass throughs: Certain pass through entities (like LLCs, S Corporations, and partnerships) may be eligible for a deduction of up to 20% of their business income from rental properties.

Chapter 355: Moving Day
âYou can take those up to the master bedroom â up the stairs, second door to the right,â Jackson told a mover carrying a large box of belongings.
Surprisingly, the actual move into Dellingham Cottage hadnât taken more than a couple of hours. Given that he had lived his entire life so far in his parentsâ home, Jackâs few personal possessions had easily fit into a small rental truck. Since the house was fully furnished, the boxes were mostly books, electronics and clothes, but he still hired a team of movers to assist.
He stepped back and looked at the cottage. Despite its name, the house was large and sprawling. Though certainly not a mansion, it was more space than he really needed. He planned on living alone for the time being. Even a cleaning lady was out of the question until he was sure his career as an author had taken off â and even then, would likely not be a live-in. Those days were over, he supposed.
âExcuse me,â a voice said from behind him.
Jack turned to find an older gentleman in a suit approaching.
âMy name is Meade,â the man said. âDaniel Meade. And I assume you are the owner of this property?â
Jack stuck out a hand.
âYes, Iâm the owner,â he said. âJackson Flynn.â
âA pleasure, Mr. Flynn,â Meade said. âI know this may seem odd, given that youâre moving in, but I represent an investor who is quite interested in acquiring this property.â
âExcuse me?â Jack asked, surprised. âSomeone wants to buy Dellingham Cottage?â
âIndeed,â Meade replied, nodding. âIn fact, theyâre willing to make a quite generous offer for âŚ.â
Jack held up a hand and interrupted, gently.
âIâm afraid itâs not for sale, Mr. Meade,â he said. âThis property has been in my motherâs family for nearly 300 years, so it has great sentimental value to her â and to me.â
âWell, Iâm sure we could reach some kind of agreement,â Meade replied. âA lease, perhaps? So you could retain ownership while my client could âŚ.â
âIâm afraid not,â Jack said. âAs you noted, I am only just now moving in myself. This is my home now, and I donât plan on leaving Dellingham anytime soon. Iâm sorry, but your client will have to find another property. There is no sum of money that could persuade me to part with this house. Itâs part of my family heritage.â
âI understand,â Meade replied. âAt least I can report that I made an effort.â
âCertainly,â Jack said, turning to go inside. âNow, if youâll excuse me, Iâd like to get settled in. Good day, Mr. Meade.â
âGood day, Mr. Flynn,â Meade said.
Jack walked into the house, still puzzling over the manâs interest in his home. Certainly, heâd always appreciated the quaint comfort of Dellingham Cottage â but there were far more impressive homes within only a few miles.
âI think this is the last of it, sir,â one of the movers said, approaching. âAnything else you need from us?â
âNo, thank you,â Jack replied. âI believe thatâs all.â
As the men left, Jack walked into the parlor and collapsed onto the sofa, stretching. Despite the ease of the move, it had already been a stressful day.
âWelcome home,â he said aloud to himself, looking about.

What's better than rent control?
Landlords competing for tenantsânot the other way around! How do you get competition between landlords? Not by making it less attractive to supply accommodation, but by making it less attractive notâ toâby taxing vacant lots and unoccupied dwellings. A âvacancy taxâ applies not only to what real-estate agents call vacancies (properties advertised for rent), but also to unoccupied properties that are not on the rental market. To avoid the tax, the owners need to find occupants. In the case of undeveloped subdivisions, finding occupants requires prompt developmentânot âdrip-feedingâ the market. In the case of vacant lots, finding occupants requires building (and the zoning system, if there is one, can determine the minimum density needed to avoid the tax).
What would property owners think of this? Consider:
If you're a property investor, you're betting on growth in the economy's capacity to pay rent and service mortgages. So you need your fellow investors to be generating economic activity on their landânot just hoarding it. And you can't have one rule for your fellow investors and another one for you!
A vacancy tax on residential property is good for commercial property owners because it keeps nearby residential properties populated with prospective customers and workers. And it's good for homeowners with variable-rate mortgages because it's anti-inflationary, making the central bank less likely to raise interest rates and more likely to lower them. (And of course the tax doesn't apply to your home, which by definition is not vacant.)
A vacancy tax on commercial property is good for residential property owners because it keeps nearby commercial properties populated with employers and service-providers. It's good even if you're a commercial property owner because it keeps nearby commercial properties populated with complementary businesses that will attract foot traffic to your property!
A vacancy tax is not meant to be paid. It's meant to be avoided!
A vacancy tax is good for general taxpayers because the avoidance of it requires economic activity, which expands the bases of other taxes, allowing their rates to be lower. (And of course a vacancy tax is good for real-estate agents because it generates more rental-management fees orâif owners decide to sell rather than letâsales commissions.)
For all these reasons, the benefit of a vacancy tax for tenants need not come at the expense of owners. It can come out of economic growth, which is also good for owners.
