Spain lied about not selling weapons to Israel.
Even after October 7th, Spain has sold more than 1 million € of weapons to Israel. Norway and Finland make it possible.
In January, Spain made headlines word-wide when the government's Minister of Exteriors, José Manuel Albares (PSOE), claimed in Congress and later again in a radio interview that Spain had stopped selling weapons to Israel ever since October 7th. Israel's intensification of violence in Gaza following October 7th meant that, on top of decades of apartheid and ethnic cleansing, between October 7th and January 23rd Israel had already killed 28,000 people and forced 2 million out of their home. In this context, many people were demanding their governments stop arming and funding the genocide of the Palestinian people, and here on Tumblr and other social media sites like Twitter I think we all saw the many posts praising the Spanish government for this.
Well, it turns out it was a lie.
According to Albares, "Since October 7th there are no more weapons exportations [from Spain] to Israel". But in November alone, Spain exported weapons to Israel for 987,000€, as was published on the Spanish Government's official website dedicated to exterior commerce (Comex). A researcher from Centre Delàs (an independent centre for peace studies) found it and published it, and it has also been verified by newspapers such as elDiario.es.
This 987,000€ worth of weapons in November was not the only ammunition that Spain has sent to Israel in 2023. In 2023, Spain exported a total of 1.48 million € in war material to Israel.
All of the weapons sent in November come from the factory of Nammo Palencia (Castilla y León), a corporation that is 50% property of the Government of Norway and 50% owned by a public Finnish business. However, even if the owners are foreigners, the ammunition was sent from Spain and thus it had to be authorized by the an organism of the Spanish Government named Junta Interministerial de Defensa y Doble Uso, whose deliberations on whether a weapons exportation is accepted or denied are kept secret. The only cases where they have denied exporting weapons to Israel have been when they thought that Israel would re-sell these weapons to the Philippines.
Spain has had a close relation with Israel for years. As published by the Spanish Government, Spain has sold 20 million € of weapons to Israel between 2012 and 2022. Spain also buys weapons and military software from Israel (for example, the Spanish Intelligence Service has been using the Israeli software Pegasus to illegally spy on Catalan activists, journalists, politicians and civil society members and their relatives to attack the Catalan independence movement), and Spain has continued buying from Israel and allocating defense contracts to Israel even after the October 7th attacks. It is very difficult to track the concessions of public contracts such as buying weapons, but some contracts have been known. For example, on November 24th 2023, Spain bought 287.5 million € of missiles from Israel. This is not unusual: between 2011 and 2021, it is publicly known that Spain bought war material from Israel for at least 268 million €, but experts say that the real number could be two or three times as much.
Spain has also continued allocating concessions to Israel. For example, on December 15th 2023 Spain allocated a contract worth over 576 million € to Israel for a rocket launcher programme. On November 22nd, Spain allocated another another Israeli company to provide missiles for 237 million € at the same time as the Spanish army bought Israeli inhibitors for 1.4 million €. The very next day, November 23rd, Spain signed another military allocation to Israel for 82,600€. The following week, Spain signed yet another allocation with a different Israeli military corporation for 3.7 million €.
Spain also allows Israeli weapon manufacturing companies to produce weapons through their branches located in Spain. This way, Israeli weapons make their way to markets with which Israel doesn't have diplomatic ties but Spain does, like Saudi Arabia. And since Spain is a member of NATO, Israeli weapons produced in Spain are approved according to NATO standards and access it easily. In the same way, these Israeli weapons manufacturers also access European Union defense funds through their branches in Spain. (source).
As I said, I saw a lot of positive posts around when Albares said Spain was going to embargo, but I haven't seen any post about how they didn't do it. I also (personally) haven't seen anything on international media, and barely anything on Spanish media, which is already busy with the PSOE covid material corruption scandal. So I share this in the hope of helping put pressure on Spain to cut all ties with Israel immediately.
SHAME ON EVERYONE WHO GIVES ISRAEL THE MATERIAL AND MONEY THAT WILL BE USED TO MASSACRE THE PALESTINIAN PEOPLE. SHAME ON SPAIN, NORWAY, AND FINLAND.
#i've been meaning to post this for a few days but never manmaged to finish writing since i don't have internet at work and i barely have#time to do anything else than sleep eat and prepare work stuff when i'm home#so I'm late but this is still relevant#palestine#gaza#israel#free palestine#spain#norway#finland#españa#end genocide#bds#boycott divest sanction#free gaza#peace#anti military#💬

The time I gained my confidence...
When I was a kid, I am not the type of student who always raise her hand during recitations in school because I am too shy to be the center of attention. Although I am sure with the answer, it take some time for me to have the confidence to speak out.
Since I like studying especially back then, my parents are always proud to attend the recognition day at school, walking to the stage with me to receive my awards. I may not be actively participating to the activities related to public speaking but my fruit of labor is still being seen with the results of my grades.
I could say that I am not the super nerdy and intelligent type of person, but what I can be proud of is that if I set some goals in my mind, I usually allocate ample times to study or prepare for it. It was the consistency and effort that I usually do whenever I want to achieve the goals I set in mind. I believe that being consistent can help you in anything that you seek to achieve. I also believe that being intelligent is another story. I still remember how those intelligent classmates I had during primary and secondary schools can simply analyze and answer the questions fast and correct after just looking at it for a few minutes, and with that...that is how I define smart people.
Before, I usually categorized myself as an introvert one. I better do everything on my own than being helped by someone, or than be an extra baggage to my group, or be a center of attention and be tagged as fatuous. I used to plan almost everything on my own... I better figure it out myself than asking someone to help me, even if it might cost most of my time to fulfil it... that I am self-reliant.
It all changed when I moved to another country.
Working in IT is not a typical field for women. Unlike in the Philippines, I still had few women colleagues in the team. In Europe, it is not the case, when I got the chance to enter corporate world again, I am always the only woman in my team. It was really difficult. There were even times when I need to push myself to get up from bed and go to work. My team during that time were dominated by men, I feel insecure…I was timorous. I even sometimes cried while walking going to the office, asking why am I actually doing this to myself...ugh! tough times.
But then, after some months, I observed that if I stay this way, I will be left behind...that I should be a team player...I started to forge my mind to trust myself. I tried to be optimistic...I keep telling myself that I won't be here if the company didn't see my potential to be amalgamated to my team.
Slowly, I refined my confidence. I learn how to lower my guard and start to trust the process.
Now, I am already six years here, still working in IT. It is also my second company and only woman in my team, again. Looking back from where I started, I could say that I improved a lot. I am now participating in projects, voice out and ask questions if I want to know more. Collaborating with my team mates and try to socialize if I have a chance to do it. I am thankful that moving to another country made me discover that I can be more than I thought I was, that I can also do what others can...that confidence is actually already within me and I just need to snap it out...
just like in the saying..."It took some fast rhythms to make the dancers come alive."

BAYAN USA congratulates the workers of Jollibee in Journal Square, New Jersey for their recent campaign victories that have moved them closer and closer to a milestone win against corporate greed. After workers filed an unfair labor practice complaint to the National Labor Relations Board (NLRB), the NLRB responded by filing its own complaint against Jollibee after finding merit that the company had unlawfully terminated and retaliated against the workers. The NLRB’s action is a result of the tireless organizing and collective action of the Jollibee workers at Journal Square, as well as the broad network of support from both Filipino and non-Filipino communities.
BAYAN USA calls on the Filipino community and allies alike to support the Justice for Jollibee Workers Campaign’s month of action, leading up to October 11, the day Jollibee is set to appear in court for the case.
The class enemies behind Jollibee
Jollibee Foods Corporation (JFC) is a billion dollar business owned by Tony Tan Caktiong, the 5th richest person in the Philippines. Caktiong is unquestionably part of the class of big comprador bourgeoisie, one that makes its living from exploiting the resources of the Philippines — including labor — for the benefit of the imperialist market. In addition to its flagship fast food brand, JFC has also “diversified” its business ventures to other restaurants (such as Chowking, Red Ribbon, Smashburger, and The Coffee Bean & Tea Leaf), and even hotel chains. Their rapid business expansion comes from the exploitation of Filipino and non-Filipino workers alike.
In the Philippines, JFC was listed by the Department of Labor and Employment in 2018 as one of the companies with the most contractual employees, purposefully denying long-term contractual workers the right to job security and benefits. In the U.S., JFC-owned Smashburger was ordered to pay damages to 241 employees after being found to have violated New York City’s paid and sick leave laws.
A large factor in the aggressive growth of JFC is, in fact, the overseas expansion of Jollibee itself. Capitalizing off the forced migration of millions of Filipinos to every corner of the world, Caktiong has been able to profit off the nostalgia of OFWs and Filipinos in diaspora. In 2021, overseas markets contributed to around 40 percent of JFC’s overall revenue. And in 2022, almost one quarter of Jollibee’s revenues came from U.S. sales alone: $31 million out of $135 million. Even now, JFC has an aggressive plan to expand Jollibee by 500 stores in the next 5 to 7 years in North America.
These facts reveal how bold-faced of a lie the Jollibee Journal Square upper management team’s “reason” was for firing the workers: that the store was supposedly “losing money” and thus had to let workers go. In response to the NLRB’s complaint, Jollibee even admitted that it had actually made hundreds of thousands of dollars in revenue over the past 12 months, before and during the terminations that happened in February this year.
As JFC celebrates its 45th anniversary with the theme “#JoyfulTogether”, it is clear that only comprador capitalists like Caktiong remain joyful, while the workers live in misery. Despite painting a picture of family between management and workers, the class interests of the capitalists and the workers are irreconcilable.
No help from the Philippine government
BAYAN USA also calls to question the inaction of the Philippine government in such a high profile case. Both the Department of Foreign Affairs through its Philippine Consul General in New York, as well as the Department of Migrants Workers through its U.S.-based Migrant Workers Offices, are charged with providing service and assistance to Philippine nationals facing employment-related complaints.
Yet there has not been even a single word from the government since the campaign went public in July. If the representatives of the Philippine government in the Northeast were in tune with our community, they would know that many of the workers at the Journal Square store — and many other locations, for that matter — are still Philippine passport-holders, and thus entitled to assistance. At the end of the day, it is no wonder why the government remains silent. The interests of the big comprador capitalist class are intertwined with those in political power.
Justice for Jollibee Workers!
The victories of the Jollibee Journal Square workers are proof that when workers unite, get organized and take action together to demand for higher wages, better working conditions, and an end to exploitative systems, change can happen. BAYAN USA encourages Filipino workers across the country to learn from and be inspired by their fight. We pledge to be there in support of the hundreds of other workers’ struggles for higher wages and better working conditions just waiting to be launched.
To the broad public, join us in conducting public education, gathering signatures, holding rallies, and releasing solidarity statements in support of the Jollibee workers. Let us continue uplifting their demands for reinstatement, back pay and compensation, a public apology, and for JFC to notify and inform workers of their rights in all stores. Beyond this current fight, let us also drum up the demand for a living wage and the right to organize for Jollibee workers in Journal Square and everywhere.
Justice for Jollibee Workers! Get organized! Fight for higher wages and better working conditions! Defend the right to organize! Defend workers rights! The fight of Jollibee workers is the fight of the entire Filipino community!
-- "Organize and Fight! All-Out Support for the Justice 4 Jollibee Workers Campaign" from BAYAN USA, 1 Oct 2023

The commercial titled “A Message from the Future” was produced by Jollibee Studios and was released in May 15, 2021. The commercial is all about what happened during the COVID-19 pandemic and how did it affect people’s lives. The commercial depicts the situation during the COVID-19 outbreak by showing a story about a family gravely affected by the pandemic, having their father lose his job, and their mother become infected by COVID. As time went by, the family learned to lean on each other, recognizing the significance of togetherness as a family. The family was given hope after the mother recovered from COVID, transitioning from a monochrome film into a colorful one. The commercial ended with the grandfather telling his granddaughter, “You can never take anything for granted.” The target audiences of this commercial are families and people of all ages since Jollibee is a family-oriented fast food company that aims to promote good family values as well as Filipino values. The products advertised to the target audiences are necessarily good since food is a daily necessity and Jollibee is a fast-food chain. The product is also a necessity at the time of the publication of the commercial because people are restricted from leaving their homes, so they rely on food companies who offer to deliver services to the consumers. The product may also not be unnecessarily needed to find joy as joy can be found in many ways. There are no signs of any forms of Media Manipulation shown in the advertisement. The commercial managed to hook the attention of the audience because of the intended message of the ad, giving life lessons, values, and inspiration to the audience. What also makes this advertisement popular is it is relatable to anyone especially to those who struggle during the pandemic, which makes it understandable to the audiences.
youtube
The commercial is entitled “Hapag” by IKEA Philippines was posted on Youtube on December 12, 2022. The commercial promotes the rights and acceptance of the LGBTQ community by portraying a story of a son who was planning to confess to his father about the relationship he’s in, who is another man, which is something hard to accept for most parents. As the son tries to confess his secret to his father, the father is always occupied with urgent matters. As time went by, the son became discouraged from admitting to his father about his relationship. The father soon then discovered his son’s relationship. The next day, the son then gathered the courage to tell his father about his secret by introducing him to someone. The father then asked the son to invite that person to Christmas Eve as the father also wanted to introduce someone to them. Before the dinner, the father revealed to both of them that he was also gay. After that, all of them shared dinner together happily. The target audiences of this commercial are families who are celebrating Christmas with their loved ones. The target audiences of this commercial are families who are celebrating Christmas with their loved ones. The product featured in the commercial is an extendable table which is very good for feasts with the family because of the space it can provide. In my opinion, I think the product wasn’t necessarily needed for the target audiences since there are many other options for tables that are way cheaper and better than the featured product. There are no signs of Media Manipulation shown in the ad. The commercial managed to captivate the attention of the audience because of the message it promotes, which is to learn to accept your family for who they really are and to have more space to welcome your family.

Navigating the Landscape of Pharmacovigilance and Regulatory Services in the Philippines
Introduction
Pharmacovigilance (PV) and regulatory services are vital components of the pharmaceutical industry, ensuring the safety and efficacy of medicinal products. In the Philippines, a growing market for healthcare services, pharmacovigilance plays a crucial role in protecting public health and ensuring that the medicines used in the country are safe for consumption. This blog explores the current landscape of pharmacovigilance services in the Philippines, shedding light on key regulations, practices, and challenges within this evolving sector.
What is Pharmacovigilance?
Pharmacovigilance is the science and activities related to the detection, assessment, understanding, and prevention of adverse effects or any other drug-related problems. It focuses on ensuring that pharmaceutical products are safe, effective, and of high quality when used by patients.
In the context of the Philippines, pharmacovigilance plays a pivotal role in monitoring the safety of both locally manufactured and imported drugs, ensuring that the risks associated with their use are identified and minimized. This ensures that patients receive the highest level of care while taking medications.
The Role of the Food and Drug Administration (FDA) in the Philippines
The Philippine Food and Drug Administration (FDA) is the central authority responsible for regulating the safety, efficacy, and quality of pharmaceuticals in the country. The FDA’s mandate includes overseeing the registration, regulation, and monitoring of drugs, medical devices, and other health-related products. The agency works under the Department of Health (DOH) and is guided by various regulatory frameworks designed to ensure public health safety.
Key functions of the FDA in relation to pharmacovigilance include:
Regulation and Approval of Drugs: Before a drug can be marketed in the Philippines, it must undergo a thorough review process to ensure its safety, efficacy, and quality. The FDA conducts assessments based on clinical trials, scientific evidence, and expert reviews.
Post-Marketing Surveillance: Once a drug is approved, the FDA monitors its safety in the real-world setting. This involves collecting data on adverse drug reactions (ADRs) and other safety concerns reported by healthcare professionals, patients, and manufacturers.
Pharmacovigilance Reporting System: The FDA has a Pharmacovigilance Program that encourages healthcare professionals and patients to report any adverse effects associated with medicines. This system ensures that any potential risks are quickly identified and addressed.
Recall and Market Withdrawal: If a drug is found to have serious safety concerns, the FDA has the authority to issue recalls or withdrawal notices, ensuring that the public is protected from harm.
Key Regulatory Requirements for Pharmacovigilance in the Philippines
To ensure effective pharmacovigilance, there are several regulatory requirements that must be followed by pharmaceutical companies and other stakeholders in the Philippines. These include:
Good Pharmacovigilance Practices (GPvP): Pharmaceutical companies are required to implement Good Pharmacovigilance Practices (GPvP) as part of their regulatory obligations. These practices involve maintaining a robust system for the collection, monitoring, and reporting of adverse drug reactions (ADRs). Companies must have a designated pharmacovigilance team responsible for safety data management and reporting.
Adverse Drug Reaction Reporting: Healthcare professionals and consumers are encouraged to report ADRs through the FDA’s reporting system. Pharmaceutical companies must establish a system to capture these reports and evaluate any new safety information that may arise.
Risk Management Plans (RMPs): For certain high-risk medications, companies must develop and submit Risk Management Plans (RMPs) to the FDA. These plans outline how potential risks associated with the drug will be identified, assessed, and mitigated.
Periodic Safety Update Reports (PSURs): Pharmaceutical companies are required to submit regular safety reports to the FDA that summarize the safety profile of a drug. These reports provide updated information on the adverse events and any potential safety concerns associated with the medication.
Post-Market Surveillance: Continuous monitoring of drugs post-launch is essential to detect any unanticipated adverse events. Pharmaceutical companies must ensure that post-market surveillance data is systematically collected and analyzed.
Challenges in Pharmacovigilance and Regulatory Services in Philippines
Despite the robust regulatory framework in the Philippines, there are several challenges faced by stakeholders in pharmacovigilance and regulatory services:
Underreporting of Adverse Drug Reactions: One of the most significant challenges is the underreporting of ADRs by healthcare professionals and patients. Many healthcare providers may not be fully aware of the importance of ADR reporting, and patients may not always report their experiences with side effects.
Lack of Public Awareness: Public awareness regarding the importance of pharmacovigilance remains relatively low. This may contribute to the underreporting of ADRs and limit the effectiveness of pharmacovigilance systems.
Data Management and Integration: Collecting and managing pharmacovigilance services in Philippines from a variety of sources, including healthcare providers, patients, and pharmaceutical companies, can be a complex and time-consuming task. Efficient data integration systems are essential to improving the timeliness and accuracy of safety reporting.
Limited Resources: Regulatory agencies like the FDA may face resource constraints, making it challenging to manage the large volume of drug safety data generated each year. Adequate funding, staffing, and technology are critical for improving the efficiency and scope of pharmacovigilance activities.
Evolving Drug Landscape: With the increasing number of new and innovative drugs entering the market, regulatory agencies must continuously adapt their pharmacovigilance and regulatory practices to address emerging safety concerns. This requires staying updated on global pharmacovigilance standards and best practices.
The Future of Pharmacovigilance in the Philippines
As the pharmaceutical industry in the Philippines continues to grow, the importance of pharmacovigilance and regulatory services will only increase. There is a need for continued investment in training healthcare professionals, improving public awareness of ADR reporting, and strengthening the capacity of regulatory agencies like the FDA.
The adoption of advanced technologies, such as digital platforms for ADR reporting and artificial intelligence for data analysis, holds promise for improving pharmacovigilance efforts in the country. Additionally, greater collaboration between local authorities, international organizations, and pharmaceutical companies can help ensure that the Philippines maintains high standards of drug safety and regulatory oversight.
Conclusion
Pharmacovigilance and regulatory services play an indispensable role in safeguarding public health in the Philippines. By ensuring that only safe and effective medicines are available on the market, the FDA and other stakeholders work together to protect patients from the potential risks of adverse drug reactions. However, challenges such as underreporting and resource limitations must be addressed to enhance the efficiency of these systems. With the right resources and awareness, the Philippines can continue to build a strong pharmacovigilance framework that benefits patients and the broader healthcare community.

Brazil anticipates boost in meat exports to the Philippines
Philippine government is expected to soon approve Brazilian storage facilities for exports, according to the Ministry of Agriculture
The Philippines, one of the fastest-growing importers of Brazilian meat in 2024, is expected to soon formalize approval for Brazilian storage facilities to export poultry, pork, and beef, according to the Ministry of Agriculture.
“All commercial storage facilities inspected under the Federal Inspection System (SIF) will be allowed to store goods for shipment to the Philippines, provided the meat originates from processing plants already approved for that market,” said Luis Rua, secretary of Trade and International Relations at the Ministry of Agriculture. This authorization is anticipated to enhance the production and export processes of Brazilian companies.
Mr. Rua said meatpacking plants face storage limitations, and the approval of commercial storage facilities could increase production and export volumes to the Philippines. While the decision has been made by the Philippine government, it is still awaiting formal publication.
Commercial storage facilities, typically located near customs areas, ports, or strategic production and distribution hubs, require specific authorization to export stored products.

Hybrid Rice Seeds in the Philippines: Key Insights and Market Outlook for 2024-2029
The Hybrid Rice Seed Market in the Philippines is valued at approximately USD 84.68 million in 2024, with projections to reach USD 106.63 million by 2029, reflecting a growth rate of 4.72% during the forecast period (2024-2029).
Market Overview
The hybrid rice seed market in the Philippines is witnessing a positive growth trajectory, driven by an increasing demand for higher yields and improved rice production efficiency. Hybrid rice varieties are gaining popularity due to their potential to increase agricultural productivity and address food security challenges. With government initiatives supporting rice farming modernization and investments in research and development, the market is expected to expand steadily over the next several years.
Key Trends
Rising Adoption of Hybrid Rice Varieties As farmers seek to improve crop productivity and mitigate the impacts of climate change, hybrid rice varieties have become an attractive option. These varieties offer superior traits like higher yield, pest resistance, and drought tolerance, which are crucial for ensuring consistent rice supply in the country.
Government Support and Subsidies The Philippine government is actively promoting hybrid rice farming through subsidies and financial assistance programs. These policies aim to boost production and enhance food security by encouraging farmers to transition from traditional rice farming to more advanced hybrid seed technologies.
Increased Investment in Research and Development The Philippine hybrid rice seed market is benefiting from increased R&D investments. Seed producers are focused on developing hybrid varieties that are better adapted to local conditions, offering improved yields and disease resistance. The rise in partnerships between public and private sectors for agricultural innovation is also a notable trend.
Focus on Sustainability and Climate Resilience With climate change affecting agricultural patterns, there is a growing emphasis on developing hybrid rice varieties that can withstand extreme weather conditions such as floods and droughts. These varieties are tailored to ensure stable rice production amidst fluctuating climate conditions.
Growth of the Seed Production and Distribution Network The expansion of hybrid rice seed producers and distributors across rural areas is crucial in ensuring that high-quality seeds reach farmers efficiently. As more seed companies enter the market, competition is fostering innovation and improving seed accessibility for local farmers.
Challenges
High Initial Investment Costs While hybrid rice seeds offer significant benefits, their initial cost is higher than traditional rice seeds. This can be a barrier for small-scale farmers who may struggle with the upfront investment required to purchase hybrid seeds and implement new farming practices.
Limited Awareness and Education Among Farmers Despite the benefits, there remains a knowledge gap among farmers regarding the use and advantages of hybrid rice seeds. Adequate training and education programs are essential to ensure that farmers can maximize the potential of these seeds and achieve higher yields.
Dependency on Seed Imports The Philippines' reliance on imported hybrid rice seeds from countries like China and India poses a risk to the stability and sustainability of the market. Local seed production capabilities need to be further developed to reduce dependency and ensure self-sufficiency in hybrid rice seed supply.
Conclusion
The hybrid rice seed market in the Philippines is poised for steady growth, with strong support from government initiatives and increasing farmer adoption. While the market faces challenges related to cost and awareness, these hurdles are being addressed through policy measures, education, and advancements in research. As the demand for higher-yielding, climate-resilient rice varieties grows, hybrid rice seeds will play a key role in shaping the future of rice production in the Philippines.

The United States, plaintiff-appellee, vs. Carson Taylor, defendant-appellant. G.R. No. L-9726, December 8, 1914
FACTS:
Carson Taylor was the acting editor, proprietor, manager, printer, and publisher of the "Manila Daily Bulletin," a bilingual newspaper.
The "Manila Daily Bulletin" published an article on September 25, 1913, that was considered libelous against Ramon Sotelo, a member of the bar.
The article insinuated that Sotelo was implicated in a conspiracy to defraud an insurance company by burning a building and included a statement that criminal proceedings would be brought against him.
Sotelo was the attorney for the plaintiff in a case related to the fire mentioned in the article.
Taylor was charged with criminal libel.
The trial court found Taylor guilty and sentenced him to a fine of P200.
Taylor appealed the decision, arguing he was not responsible for the libel.
ISSUES:
Was Carson Taylor responsible for and guilty of the alleged libel?
Was Taylor the proprietor and publisher of the "Manila Daily Bulletin?"
Was the alleged article libelous per se?
Was the article libelous, while finding that there was no malice?
Did the alleged libelous article refer to attorney Ramon Sotelo?
Was Ramon Sotelo the attorney for the plaintiffs in case No. 10191, when the alleged libel was published?
RULING:
Answer: The Supreme Court reversed the lower court's decision, finding Carson Taylor not guilty of libel.
Legal Basis:
Philippine Law on Libel: In the Philippine Islands, there are no common law crimes; an act is only a crime if it is made so by law. Libel is a crime under Act No. 277 of the United States Philippine Commission.
Liability for Libel: Act No. 277 specifies that only the "author, editor, or proprietor" of a publication can be held liable for libelous content.
Burden of Proof: The burden of proof is on the prosecution to show that the defendant was the "author, editor, or proprietor" of the publication.
Application:
The complaint charged Taylor as the acting editor, proprietor, manager, printer, and publisher.
The court noted that Act No. 277 only specifies "author, editor, or proprietor" as those liable for libel.
The prosecution did not provide any proof that Taylor was the "author, editor, or proprietor" of the "Manila Daily Bulletin".
The evidence presented only showed that Taylor was the "manager" of the newspaper.
The court stated that the term “manager” does not imply ownership.
The Court reasoned that a manager's duties and powers are defined by contract and must be proven, they cannot be assumed.
The court held that even if Taylor was actually the "author, editor, or proprietor," he could not be held liable without proof of that connection to the publication.
Conclusion: The Supreme Court reversed the lower court's sentence, dismissed the complaint, and discharged Taylor from custody, concluding that the prosecution failed to prove that he was the "author, editor, or proprietor" of the newspaper.
DOCTRINE OF THE CASE:
Specific Liability for Libel: Only the "author, editor, or proprietor" of a publication can be held liable for libel under Act No. 277 of the United States Philippine Commission.
Burden of Proof: The prosecution bears the burden of proving that the defendant was the "author, editor, or proprietor" of the publication.
Role of Manager: The term “manager” does not necessarily imply ownership or responsibility for the content of a publication. A manager's responsibilities are based on their contract and must be proven with evidence.
RATIO OF THE CASE:
The Court emphasized that criminal liability cannot be based on assumptions or presumptions. The prosecution must present evidence that the defendant fits the specific criteria for liability under the law.
The ruling highlights the importance of strict adherence to the legal definition of who is liable for a crime. In this case, the law specifically names who is responsible for libel.
The decision clarifies that the title or position one holds is not enough to establish liability. Instead, the prosecution must provide evidence of the specific legal role that makes one liable under the law.
The ruling underscores that the burden of proof rests with the prosecution to demonstrate the accused’s legal responsibility beyond a reasonable doubt.
The court's analysis of the term "manager" indicates that a manager's role is distinct from that of an "author, editor, or proprietor" and requires concrete proof to determine their responsibilities.

Republic vs. Enriquez
G.R. No. 78391
Oct 21, 1988
Facts:
The case involves the Republic of the Philippines (petitioner) and Ramon G. Enriquez, Deputy Sheriff of Manila (respondent).
On January 28, 1985, the Commissioner of Internal Revenue served a Warrant of Distraint on the Maritime Company of the Philippines to collect P17,284,882.45 in deficiency taxes.
A Receipt for Goods and Things Seized was executed on April 16, 1985, acknowledging the seizure of several barges, vehicles, and spare parts.
A Notice of Seizure was issued on October 4, 1985, received by a Maritime Company representative, including six barges (MCP-1 to MCP-6).
On June 11, 1986, Deputy Sheriff Enriquez levied on Barge MCP-1 and Barge MCP-4 following a writ of execution from the Regional Trial Court in favor of Genstar Container Corporation.
A public auction for the barges was scheduled for June 23, 1986.
On June 18, 1986, the Commissioner of Internal Revenue informed the respondent that the barges were no longer owned by the Maritime Company due to prior distraint.
Despite this, the respondent sold the barges at auction on June 23, 1986, and issued a sheriff's certificate of sale.
The Republic of the Philippines filed a petition for prohibition with preliminary injunction on July 24, 1986, arguing the respondent acted beyond his authority.
The Court of Appeals dismissed the petition on April 30, 1987, leading to the current appeal.
Issue:
Whether or not the BIR Warrant of Distraint prevails over the writ of execution issued by an RTC.
Ruling:
The Supreme Court granted the petition, set aside the Court of Appeals' decision, annulled the notice of levy and execution sale of Barges MCP-1 and MCP-4, and enjoined the respondent from further sale proceedings.
In the case, the Distraint was made by the Commissioner long before the writ of execution was issued by the RTC. There is no question that at the time of the writ of execution, the 2 barges were no longer properties of Maritime. The power of the court in execution of judgments extends only to properties unquestionable belonging to the judgment debtor. Execution sale affect the rights of the judgment debtor only, and the purchaser in an auction sale acquires only such right as the judgment debtor had at the time of sale.
There is no further need for petitioner to establish his rights over the 2 barges as evidence clearly proves that the barges are under distraint and in fact seized by the Commissioner.

Market Dynamics
Medical tourism growth attracts international patients seeking affordable options.
Cosmetic Surgery Market is steadily developing due to various factors that shape the demand for foreign patients. The major reason is increasing awareness and desire for beauty and image-boosting as influenced by societal norms to look good, such as through social media influences. The rising availability of superior, intricate surgery and outpatient procedures makes cosmetic surgery attractive. The last thing to consider is the cost. Many patients go to other countries where the prices are lower than in their countries.
For instance, the American Society of Plastic Surgeons indicated that 1.8 million cosmetic surgeries were done in 2020, showcasing the strong market demand. Besides, access to accredited healthcare facilities is related to the development of medical tourism and affects patients from countries with high medical costs.
Potential risks and complications associated with surgical interventions.
Cosmetic Surgery Market is growing, although it is growing slowly due to several constraints. Firstly, the high cost of the treatments suggests it's an expensive service that can't help the general public by providing affordable operations. Elective procedures are not covered by insurance, and many people are unable to afford the procedure. They also pointed out regulatory issues and differences in market standards that slow down market development and negate patient safety and satisfaction. Furthermore, potential clients are hesitant to use the service due to the social stigma associated with surgery, particularly in societies with strict social norms. The operating prohibitive risk of developing complications after surgery and postoperative infections and discontentment with the results discourage people.
Greater attention to the psychological state of the patient leads to essential questions about the psychological attitudes towards such operations and to the revision of the criteria for admitting patients to operations. These factors create major difficulties for increasing the cosmetic surgery market’s development.
Integrating advanced technologies like AI for improved patient outcomes.
The application of advanced technologies such as artificial intelligence (AI) brings larger opportunities for the Cosmetic Surgery Market. AI benefits patients because it gives detailed recommendations to counteract anatomic differences and meet the patient’s expectations. Furthermore, patients have more confidence in the expected results of their therapies due to artificial intelligence's overnight use of imaging and simulations in patient care. Improvement of potential medical procedures is achieved using data on creatures of operations, and specific medical procedures following the surgery may lower the risk of surgical impossibilities and speed relief.
The application of AI helps to minimize classic paperwork, such as scheduling or billing, increasing the productivity of cosmetic practices. Consumers’ interest in aesthetic surgery increases, and using AI technologies increases clinics’ competitiveness and attracts the audience interested in the IT sector. The integration of AI into cosmetic surgery benefits clinical areas and helps to improve patient care in this fragmented industry.
Industry Experts Opinion
“Aesthetic Partners is one of the earliest players in the clinical aesthetics space and has demonstrated an exceptional track record of helping medical aesthetic, dermatology and plastic surgery practices across the country grow their businesses,"
Sonya Brown, General Partner, Co-Head of Growth Equity at Norwest Venture Partners.
“A unique feature of cosmetic procedures is that it captures an array of health practitioners including GPs, dermatologists, ear nose and throat specialists, anesthetists, cosmetic surgeons, allied health and nurses,"
Dr. Margaret Faux, Founder and Chief Executive Officer (CEO) of Synapse Medical Services.
Segment Analysis
Based on the procedure type, the Cosmetic Surgery Market is classified into Surgical Procedures and Non-Surgical Procedures. In the Cosmetic Surgery Market, non-surgical procedures grow due to their minimal level of invasiveness, shorter healing times, and lower costs. These procedures, like Botox, dermal fillers, and laser treatments, are more popular than surgical procedures because they are invasive and have fewer complications than surgical procedures. Non-surgical procedures now account for the major portion of the market because of the growing trend of "look" improvement without the need for surgery. Similarly, technological advancements have increased the safety and therapeutic efficacy of numerous interventions, leading to their use.

Activity 12.3
Prepare a one-paged policy brief enumerating: your stakeholders; the results of your policy analysis; and your recommendations.
Using Radio and TV to Combat Smoking through Public Advertising and Tobacco Bans
"Over 112,000 Filipinos die from tobacco-related diseases each year and about 23% of male deaths and 10% of female deaths are caused by tobacco" (Cordero, 2023). It contributes to a variety of health problems, including cancer, heart disease, and respiratory disorders. “To combat the youth tobacco epidemic, the Philippines implemented tobacco control legislation (Republic Act No. 9211) in 2003 that included prohibiting the sale of tobacco products to those aged <18 years, placing text warning labels on tobacco products, and prohibiting tobacco smoking in public places.” But allowing the public to buy “tingi” or a single stick of cigarette plus allowing smoking in public places has defeated the purpose of passing legislation to control the ill effects of smoking tobacco (Arrazola et al., 2020).
Given the severity of its impact on public health, it is crucial to implement policies that reduce smoking rates. One effective strategy involves using mass media—specifically radio and television—to advertise the dangers of smoking while enforcing a strict tobacco ban. “Research has shown that national mass media communication campaign is one of the most effective means of raising awareness of the real health harms of tobacco and second-hand smoke, deterring youth from initiating tobacco use, urging smokers to comply with smoke-free laws and encouraging smokers to stop smoking” (Vital Strategies, 2015). This policy aims to reduce smoking by educating the public, particularly the youth, and creating a healthier environment for everyone.
The main stakeholders in this policy include government agencies, healthcare providers, media companies, the general public, and the tobacco industry. Government agencies, such as health departments and lawmakers, are responsible for creating and enforcing laws related to tobacco advertising and smoking bans. Healthcare providers, including hospitals and clinics, play a vital role in treating smoking-related illnesses and providing smoking cessation support. Media companies, particularly radio and TV stations, are critical in broadcasting anti-smoking messages. The general public—especially smokers and young people—will be directly affected by these media campaigns and the tobacco ban. Finally, the tobacco industry, including manufacturers and retailers, will experience financial losses due to advertising restrictions and changes in consumer behavior.
The social costs and benefits of this policy need to be carefully considered. The costs include potential economic losses for the tobacco industry, which will be impacted by the ban on advertising and reduced sales. Some resistance from smokers and advertisers is also likely. However, the benefits of this policy far outweigh the costs. Reducing smoking leads to fewer smoking-related diseases, which results in lower healthcare costs. Mass media campaigns are effective in changing public attitudes and behaviors, particularly among youth, preventing them from starting to smoke. The tobacco ban will also improve public spaces by reducing secondhand smoke exposure, which benefits both smokers and non-smokers alike. Over time, this will lead to a healthier, more productive society, with fewer people suffering from tobacco-related illnesses.
The results of existing studies show that media campaigns and tobacco bans have been highly successful in reducing smoking rates. Countries like Australia and the UK have implemented strong anti-smoking campaigns and tobacco regulations, leading to significant declines in smoking. In Australia, “the 2012 report of the Surgeon General on preventing tobacco use among youth and young adults stated that the ‘evidence is sufficient to conclude that mass media campaigns[…] can prevent the initiation of tobacco use and reduce its prevalence among youth” (Melbourne et al., 2022). These policies have not only improved public health but also reduced the financial burden on healthcare systems. The evidence supports the idea that broadcasting anti-smoking messages on TV and radio can change behavior, especially when combined with a tobacco ban.
Based on these findings, the following recommendations are proposed:
Enforce a Comprehensive Tobacco Ban: The government should enforce the elimination of opportunities for tobacco companies to advertise, especially to vulnerable audiences like the youth. These measures reduce the social acceptability of smoking. When combined with smoking bans in public spaces, including parks, restaurants, and public transport, this creates a more supportive environment for individuals who want to quit and prevents exposure to secondhand smoke which will dramatize support for a tobacco-free culture.
Launch Nationwide Anti-Smoking Campaigns: Radio and TV stations should be mandated to air public service announcements (PSAs) that highlight the health risks of smoking. These campaigns should target a wide range of audiences, with specific messaging aimed at youth, pregnant women, both men, women, senior citizens, and communities with high smoking rates. These advertisements should put major emphasis on the dangers of smoking, the benefits of quitting, and available cessation resources like counselling and support services for those who want to stop.
Increase Public Awareness and Education: Alongside media campaigns, educational programs in schools and communities should be strengthened. A massive campaign should be launched in schools, particularly in junior and senior high school, to teach students about the dangers of smoking from an early age, while community organizations should offer free workshops and resources to help people quit. Alongside this, social media should also be tapped to augment the education campaign against smoking. With the rapid growth of smartphone ownership, complementing the mass media campaign with a digital campaign will help boost anti-smoking efforts.
Provide Support for Smoking Cessation: It is essential that cessation programs are made widely available to those who want to quit. These programs should include counseling services, access to nicotine replacement therapies, and online or mobile apps. Media platforms should be used to promote these services and provide information about how to access them.
Monitor and Evaluate Effectiveness: The government and health agencies should regularly monitor the effectiveness of the tobacco ban and media campaigns, using metrics such as smoking rates, public health data, and healthcare costs. Adjustments should be made to the policy as needed to ensure that it remains effective over time.
Review of Legislation: Congress should amend Republic Act No. 9211 and add the criminalization of smoking in public places and further increasing taxes on tobacco products. Selling of tobacco products in retail environments easily accessible by minors (sari-sari stores and convenience stores) should also be legislated. “Evidence on the impact of display bans suggests that they may help to contribute to a reduction in adolescent smoking rates. A study found that across six European countries which had implemented a display ban, this measure was associated with a 15% decrease in the odds of adolescent regular smoking” (Ford et al., 2019). Amendmending the existing anti-smoking law should be made to update it, taking into consideration other products like vapes that substitute for tobacco but still have similar harmful effects.
In conclusion, using radio and TV, supplemented by social media to advertise the dangers of smoking and implementing a tobacco ban is a powerful policy approach to reduce smoking rates and improve public health. While there may be initial economic challenges, the long-term benefits—such as reduced healthcare costs, healthier communities, and fewer smoking-related deaths—make it a policy worth pursuing. By leveraging the power of mass media to educate the public and enforcing stronger regulations, we can create a healthier, smoke-free future.
