My partner told me about how EA won't let American McGee make the third Alice game but still won't let him have his IP, leading him to retire and not want anything to do with the game anymore, and honestly, that pisses me off so much
It sucks to me that companies, be it for animated shows or games, will screw over people like artists and developers and not allow them to see out their vision, but still keep the IPs locked away forever despite not planning on doing anything with them?
Imo I feel like it should be made illegal for companies to hoard IPs like that. Cuz it sucks how creators get all their hard work stolen away, and they can't even make something out of it once they leave the companies that screwed them over.
#corporate greed#ea games#american mcgee's alice#rant#intellectual property#artists REALLY deserve more rights and protections

We’ve made an update to MatGPT! You can now ask MatGPT your questions completely anonymously.
He is very paranoid though, so using this option comes with a 20% increase in him assuming the asker is someone he knows personally.
#matgpt#maintenance#here at OpenAelfinn we only believe in protecting OUR privacy and OUR intellectual property#yours is permitted on sufferance#if you bring fire/music/iron/any other contraband we’re turning off anon

every time I see a passionate defense of IP law an angel loses its wings
#nice intellectual property. too bad I'm thinking about it#'creators should own their ideas forever' no <3 they should have the protected legal right to USE their ideas forever#no matter who they were working for#'this will just incentivize corporations to use small creators' work' oh no don't worry if I'm ever in a position to get rid of IP law#the corpos are on the chopping block first#ac speaks

thinking about that post where that anon says they report people for copyright infringement when they watermark their gifs... i think most people dont actually know what copyright infringement is bc making gifs and posting them on tumblr is not even close to that ❤️
#'copyright infringement is when you edit something and post it on your blog and claim the edit as your own' no dumbass#its when you take an intellectual property and try to post and share it with no modifications and claim it is 100% yours#or directly stealing ideas / writing / music / etc from things#its also when you dont pay for the rights to use something. some places allow you to use their stuff without credit as long as you pay#like its a huge range of things and creators making gifs and watermarking their work is NOT copyright infringement youre so stupid 😭#personal#like its the same thing as like commentary youtube videos. youre building off of the source material. its protected under fair use.....#anyways if all gifmakers got copyright claimed on here tumblr would literally die theyre not going to do anything about it lol

OpenAI and Tumblr aren’t like, besties. Tumblr has always had issues with bots and spam so I don’t think they were exactly stumbling out the door to make a contract with the company that’s been the spearhead of modern day spam.
Tumblr and openAI negotiated the contract, so think for a second about what each company gets out of the deal. You can easily argue that OpenAI wouldn’t want an opt-out option, so you could also argue tumblr was the party behind the option existing. This is all speculation, but it’s just as valid to say ‘The opt-out option was a non-negotiable for tumblr, but OpenAI pressured them into making it opt-out instead of opt-in’ as it is to say ‘Tumblr only included the opt-out option to appease the user base’. People are only making the latter point (and I’d argue are primed to accept it) because all the fear-mongering has made everyone’s knee jerk reaction to AI fear and rage. Oooooo neural nets and weighted graphs Ooooooooooo they’re gonna kill art for real this time for real oooooo all the other panics about automation were wrong but THIS one is real I promise oooooooooooo we need to ‘Kill AI’ just like we had to ‘kill automation’ because technology has gotten too advanced. we need to make computers worse and then everything will get better ooooooooooo
#.txt#sorry I’m kind of just a little mad#there’s ethical questions raised by AI about the place technology has in our lives#but no one is really addressing those issues they’re sidestepping all of them to crucify….. math#AI is one of a billion tools in the machine of capitalism that is meant to grind up and spit out humans for their labor#but yeah AI is the breaking point and definitely worth leaving the site and deleting all your content over#no one can really explain what’s so uniquely evil about ai#they just gesture at the idea of intellectual property theft#and then the rest of their arguments are trying to prove that what AI does is actually intellectual property theft#so at this point we loveeeeee intellectual property law and DMCA should be 10000X more restrictive#yknow…. to protect freelance artists

What is considering litigation?
Considering litigation refers to the process of evaluating the possibility of pursuing a legal claim or lawsuit. This may involve reviewing the facts and circumstances of a case, researching the relevant laws and regulations, consulting with legal experts, and determining whether the potential benefits of filing a lawsuit outweigh the costs and risks involved. The term "considering litigation" implies that a decision has not yet been made and the parties involved are still in the process of evaluating their options.
What kind of cases can be resolved using considering litigation?
Nearly any legal dispute or conflict can be resolved through litigation, but the decision to pursue a lawsuit depends on various factors such as the strength of the case, the likelihood of success, and the costs and benefits involved. Some common types of cases that can be resolved through litigation include:
Contract disputes
Personal injury claims
Employment discrimination cases
Intellectual property disputes
Consumer protection cases
Product liability claims
Real estate disputes
Business disputes
It's worth noting that while litigation can be a way to resolve many types of legal disputes, it is not always the best solution. Alternative dispute resolution methods, such as mediation or arbitration, may be more cost-effective and less time-consuming in some cases.
Which is the right court for me?
The right court for you depends on the specific facts and circumstances of your case. In general, there are several factors that determine which court has jurisdiction over a case, including:
The type of case: Different courts have jurisdiction over different types of cases, such as criminal cases, civil cases, or bankruptcy cases.
The location of the parties involved: A court typically has jurisdiction over a case if the defendant resides or does business in the court's geographic area.
The amount of money at issue: Some courts have jurisdiction over cases involving certain amounts of money, such as small claims court or district court.
It is recommended to consult with an attorney or a legal expert to determine the right court for your case. They can help you understand the legal process, evaluate your options, and make informed decisions about how to proceed.
Who can approach a British Court?
In Britain, the courts are open to anyone who has a legal right to bring a claim or take part in a legal dispute. This includes individuals, companies, organizations, and government entities.
To approach a British court, a person or entity must have standing, which means they have a sufficient interest in the case and are directly affected by the outcome. In some cases, a person may be required to first exhaust other means of resolution, such as mediation or arbitration, before they can bring a case to court.
It's worth noting that the specific rules and procedures for accessing the British court system may vary depending on the type of case and the court in question. In some instances, legal representation may be necessary, especially in complex cases. Seeking the advice of a legal expert can help you understand your rights and obligations and ensure that you follow the correct procedure for approaching the court.
What is the considering litigation process?
The "considering litigation" process refers to the process of evaluating whether to initiate a lawsuit. This process involves reviewing the facts and circumstances of the case, researching the applicable laws, determining the likelihood of success, assessing the costs and risks involved, and deciding whether it is in the best interest of the party to pursue legal action. The process may involve consulting with legal counsel, conducting investigations, and negotiating with the other party in an attempt to resolve the matter without going to court.

sometimes I think it would be interesting if someone just straight up yoinked one of my OCs and started playin barbies with them. like full-on theft (but it's not really theft bc I didn't own them in the first place, but that's the... like, socially-agreed-upon way to refer to this)
I think it would be interesting for the same reason that it's interesting to know how other people perceive you as a person. everyone has a slightly different (sometimes wildly different) perception of me for various reasons, a big one being that everyone is using their own personalities and experiences and biases to form that perception. right? so naturally the same thing would happen with the OCs. I know who Noah is to me, but what would Noah be like if written by someone else? what would Noah mean to them? what aspects of his being would resonate the most with them? what would they see when he appeared to them; what would he sound like; in what small ways would he change their life?
Noah's existence as an OC is a collaboration between me and the fabric of the multiverse (this is extremely simplified wording but I think it works for this purpose), so what would that same collaboration produce if the "me" in the equation is replaced by another? I will always be curious about that sort of thing
#listen. nothing i've done here is an intellectual property that i feel compelled to protect.#if you've got the stones and you think you've got the skill... go wild. take it and run#but don't be surprised if it takes you in return is all i'm sayin#singularity.txt#but also if you just want to do science with me....... write my ocs. go ahead! i Want to See#expand the picture of who they are as people. make them deeper. broader. something new

I have a feeling that if Blood Moon Sky was already a published work and was a visual novel, Amsel might get put in a lot of crossover ships with Alucard Tepes

btw i still think the idea that ai using an image in its referencebank is akin to directly stealing that image is reactionary and also fundamentally misunderstands how ai works
#i understand and emphasize with artists who are concerned about it as a working artist myself but like...#its just 2015 style drama again lol#its also funny to me how many leftists act like copyright law and intellectual property laws are untouchable on a social critique level#(btw: copyright law and the concept of intellectual property has never been about protecting people and has always been about making money)

the website states to first use Nightshade and then Glaze, but they're also working on at combined tool!
Good news, fellow artists! Nightshade has finally been released by the UChicago team! If you aren't aware of what Nightshade is, it's a tool that helps poison AI datasets so that the model "sees" something different from what an image actually depicts. It's the same team that released Glaze, which helps protect art against style mimicry (aka those finetuned models that try to rip off a specific artist). As they show in their paper, even a hundred poisoned concepts make a huge difference.
(Reminder that glazing your art is more important than nighshading it, as they mention in their tweets above, so when you're uploading your art, try to glaze it at the very least.)

Trademark Secrets: Why Copycats Are Killing Your Brand"?
In today's competitive business landscape, protecting your brand is essential to maintaining its integrity and reputation. One of the most effective ways to safeguard your brand from copycats is through trademark registration. A trademark serves as a legal shield, preventing unauthorized entities from using your brand name, logo, or other distinctive marks that could cause confusion in the market. Without a registered trademark, businesses are at risk of losing their unique identity to competitors who might mimic their branding to confuse consumers.
Copycats can dilute the value of your brand and erode customer trust. If competitors exploit your brand's recognition, it can result in lost sales, reduced market share, and a tarnished reputation. The consequences are severe, but with the right trademark protection, you can defend your intellectual property (IP) and take action against infringements.
At Sr4ipr Partners, we specialize in trademark filing services, helping businesses secure their intellectual property and defend against infringement. Whether you’re a startup or an established brand, our legal expertise ensures your trademark registration process is smooth and effective. Protect your business from copycats today—trademark your brand and maintain your competitive edge!
