[CLUBE CINEMA] Cineclubismo e Direitos Autorais

Um tema polêmico e que gera muitas dúvidas aos interessados em criar um cineclube: são questões relacionadas aos direitos autorais e de exibição dos filmes. 

Todo filme tem uma finalidade comercial, e por isso, existem instituições que protegem os realizadores para que seu trabalho não seja explorado.

No caso dos filmes, duas instituições protegem os realizadores cinematográficos:  a primeira delas, é a Motion Picture Licensing Corporation (MLPC), uma empresa que realiza o serviço de legalização das exibições públicas de obras audiovisuais. A MPLC Brasil atua no mercado desde 2006 e para os cineclubes emite uma Licença Guarda-chuva que custa ao redor de uns mil e duzentos reais com duração de um ano. A Licença Guarda-chuva da MPLC se  emite para um lugar específico de exibição. Se houver mudança do lugar das exibições , é preciso pagar nova de exibição. Devem ser usadas cópias originais de DVDs ou VHS (não é permitido cópias piratas ou gravações).  Somente cobrem filmes, séries ou videoclipes de distribuidoras associadas e que podem serem confirmadas no site www.mplcbrasil.com.br. 

Cineclubes goianos

As sessões devem ser gratuitas, se houver cobrança, a Licença muda e o valor cobrado também. Além dos direitos de distribuidores, existe a cobrança dos direitos autorais das músicas exibidas nos filmes. O Escritório Central de Arrecadação e Distribuição (ECAD) é um escritório privado brasileiro responsável pela arrecadação e distribuição dos direitos autorais das músicas a seus autores, tendo sua localização no Rio de Janeiro. Quem está isento de pagar a taxa do ECAD: eventos particulares em propriedades privadas, cultos religiosos e eventos com proposito educacionais. Excluindo esses eventos, todos os outros eventos que tenham música e público, devem pagar a taxa do ECAD. Existe um valor de referência, chamado Unidade de Direito Autoral (UDA), que custa R$ 74,02, mas cada evento é taxado de acordo com suas especificações, tais como área total, capacidade do público, valor do ingresso, região socioeconômico, duração do evento, entre outras.

Na nota sobre direitos autorais que se encontra site: www.intervozes.org.br/direitoacomunicação, o Conselho Nacional de Cineclubes juntos a Associação de Cineclubes do Rio de Janeiro, Associação de Cineclubes de Vila Velha e a Federação de Cineclubes do Estado de São Paulo declaram que “A livre circulação, resguardando os direitos comerciais, é condição essencial para a reprodução do conhecimento, o desenvolvimento da cultura. A criação é um processo contínuo, baseado no cotejo permanente com o patrimônio artístico da humanidade, que não pode ser apropriado por alguns em detrimento da maioria, tal como estabelecem os artigos 19, 27 e 39 da Declaração Universal dos Direitos humanos. Tal é origem do conceito de direito autoral, criado para defender autores dos abusos das empresas que controlam a distribuição de suas obras. E não o contrário, limitando o conhecimento e a fruição do saber e da arte em nome da apropriação de lucros presentes e sempiternos. Que, por sua vez, certamente não foram prejudicados pela exibição de um filme numa sala de aula. Os Cineclubes brasileiros apelam a todas as forças da sociedade para se posicionarem contra esse grave precedente, ainda em primeira instância, que atenta contra o direito que tem todo ser humano “de participar livremente da vida cultural da comunidade, de fruir as artes e de participar do progresso cientifico e de fruir de seus benefícios”. Essa realidade inviabiliza um projeto cultural de formação de público, que beneficia a própria indústria cinematográfica, pois aproxima o público e o faz deixar a segurança de seu lar para ir até aos shoppings, enfrentar uma fila e pagar caro, em média 25 reais por um ingresso e adicionar mais 25 da pipoca e o refrigerante.

Qual é a posição dos Cineclubes Goianos.

Os cineclubes sempre foram espaços democráticos e gratuitos, que dependem da doação do tempo dos participantes, e voluntários, com a tendência de agregar as pessoas, com preocupações intelectuais e culturais, aproximando o fazer cinema e tratando de fazer compreensível e popularizar a 7ª Arte. Se os Cineclubes forem estritamente legalizados, deveriam começar com recursos suficientes para comprar ou alugar os filmes, comprar ou alugar os equipamentos de exibição, autorizações  do ECAD e MPLC, e futuramente novas instituições para cobrança dos direitos dos atores, roteiristas e técnicos cinematográficos.

For the first time in more than 15 years, Montana bison will roam new grazing grounds on public land. After 4 years of review, the Bureau of Land Management (BLM) on 28 July granted a request by the nonprofit American Prairie to release its bison herd onto more than 24,000 hectares in central Montana. This is the largest land approval BLM has given American Prairie. Many ecologists are celebrating the expansion, part of American Prairie’s effort to restore Montana’s prairie ecosystems and return the U.S. national mammal to its former glory.

“We get a lot of bad news about declines of biodiversity,” says ecologist Liesbeth Bakker of the Netherlands Institute of Ecology, who has worked with bison in Nebraska. “But then to see these things really gives you hope; it makes you think it is possible to restore these ecosystems and give these majestic animals the room they deserve.” She notes that the benefits go beyond bison to a host of prairie plants and other native animals. Ranching groups and state officials are less enthusiastic, fearing the bison will compete with cattle.

American Prairie aims to create the largest nature preserve in the lower 48 states using purchased and leased land in central Montana. Bison are instrumental to its goal of restoring the prairies. The organization already manages about 180,000 hectares of public and private land, much of it former ranchland, on which they now graze about 800 bison. It hopes to expand that number to 1000 now that it has the extra space.

Grasslands, especially tallgrass prairies, are some of the most endangered and least protected ecosystems in the world, and they have received relatively little restoration. Some former prairie is difficult or impossible to restore, such as that converted to cropland or urban development. But there’s hope for land used for cattle grazing, notes American Prairie spokesperson Beth Saboe. “The biodiversity that can exist there is astonishing.”

Just a few bison can aid the rebirth. Although all grazing animals can improve grassland diversity if carefully managed in small numbers, no species does it quite like bison, says University of Minnesota, Twin Cities, ecologist Joseph Bump. Bison are less reliant on water sources than are cattle, which means they can travel farther from rivers to graze. As a result, they are less likely to trample riparian plants, allowing fish and amphibian diversity to recover.

Studies have also shown that compared with cattle, bison graze in a way that makes them more effective at trimming dominant grasses, allowing sunlight to reach the smaller flowering plants known as forbs. This stimulates their growth, attracting more native insects and birds. Bison also famously create wallows, depressions that fill with rainwater and draw microcommunities of diverse organisms. BLM cited this research, arguing that the reintroduction of bison to the proposed sites in Montana grasslands will not only increase plant and animal diversity, but improve water quality and overall habitat conditions.

“I don’t see any ecological downside to this development,” Bump says. “And I don’t really see a long-term downside in any way.”

Several organizations disagree. The United Property Owners of Montana, the Montana Stockgrowers Association, and Montana Public Lands Council (MPLC) have fought the nonprofit’s efforts in recent years. They are concerned the BLM decision signifies a shift in range management that will favor restoration and harm ranching communities and cattle production, which is the primary industry in central Montana.

“The final decision issued by the BLM is a failure to our public lands system,” MPLC Chair Vicki Olson said in a statement issued on 29 July. “The rangeland will be the ultimate victim.” 

Montana legislators have already vowed to get the decision reversed. “As we review BLM’s bison grazing decision, we share Montanans’ frustration with the agency’s woeful and repeated failures to properly engage Montanans and act within the bounds of its authority on this issue,” Montana Governor Greg Gianforte tweeted.

BLM addressed many of the concerns in a letter issued on 29 July. The bureau’s 2021 environmental analysis of American Prairie’s request concluded the change would not harm the land or the local ranching economy. Bump agrees. “The tension lies in thinking that it’s an either or,” he says. “It’s a false dichotomy that we can’t have ranching and bison, we can certainly have both. Even in these areas that are human dominated, there can still be room for these large animals as well.”

Abstract:  INTRODUCTION: Cinnamic acids are a class of compounds based on phenyl propanoid backbone (C6-C3) isolated from plants and microorganisms, exhibiting interesting biological activities.OBJECTIVE: To characterise cinnamic acids through the phytochemical study of welsh onion, Allium fistulosum, and to evaluate their antibacterial and cytotoxic properties.MATERIAL AND METHODS: The phytochemical study of A. fistulosum was performed through chromatographic techniques, including reversed phase medium-pressure liquid chromatography (MPLC) and high-pressure liquid chromatography (HPLC). Preliminary analysis of crude chromatographic fractions from the organic extracts was carried out by proton nuclear magnetic resonance (H-NMR) in order to prioritise the study of those having phenyl propanoid skeleton. The structural identification of the isolated compounds was performed through analysis of spectroscopic data, mainly one-dimensional (1D) and two-dimensional (2D) NMR. The antibacterial activity was assessed against gram negative (Escherichia coli) and gram positive (Staphylococcus aureus) bacteria while the cytotoxic property was evaluated on breast cancer cell line (MCF-7).RESULTS: TheH-NMR study of crude fractions and application of a straightforward method to purify the phenyl propanoid compounds by reversed phase MPLC and HPLC, allowed the effortless isolation of several cinnamic acids, including two new rare phenolic imidates (1 and 2). The use of an entirely NMR approach for structural elucidation of the isolated metabolites allowed the isolated material to be kept for further pharmacological tests.CONCLUSION: These results corroborate the importance of the use of 1D and 2D NMR to the identification of new phenyl propanoids, potential lead compounds against bacteria and cancer cells.
