Blue house blue house blue house
This simple structure is tentatively called Casa Macaraig, home of the wealthy Macaraig family who married into the owners of the hoteliers, the McCarrics. Whether the house was already blue before Doña Macaraig and Laird McCarric got hitched or if it was ordered repainted by his bride to make him feel at home is left up in the air.
I just needed a blue house to break up the warm monotony of the city center.

Million Dollar Baby
Ed Mapplethorpe had just turned 19, the right time for him to try out alcoholic drinks legally. Being the son of a millionaire film producer, he invites his friends over to his house after he orders various alcoholic drinks for himself and them.
The first to arrive is his childhood friend since elementary, Lisa Thornhill, who gives him something for his birthday party.
‘Ed, I got a telescope for you.’
‘Thanks, Lisa!’
‘You’re welcome.’
Then he puts the telescope in his room, just in case if he wants to look at the night sky. He goes back to the living room and gives her a glass of vodka, but she rejects it.
‘Sorry Ed, I’m not into alcohol.’
‘That’s terrible, I’m 19 now and I really want to share drinks with you.’
‘If alcohol is your thing, then power to you if you want to drink.’
Ed ends up drinking vodka himself, given Lisa doesn’t like getting drunk.
She would’ve much preferred a glass of soy milk herself, but as soon as Ed got drunk he started feeling sick.
He closes his eyes, whilst feeling a little dizzy. He still feels like the world is spinning around him, like he’s this ill star that a planet revolves around with.
He eventually vomits, which Lisa cleaned up immediately. The second friend to arrive is his girlfriend, Alice Potter, she immediately consoles and comforts a very drunk Ed.
‘Ed, what’s wrong with you?’
‘Alice, I just got drunk because I turned 19 today.’
‘I can’t drink alcohol now because I’m going to turn 19 in two months.’
‘Well, that’s bad.’
‘Do you have any fruit juices for me to drink?’
‘Well, I have apples and oranges in my fridge.’
Since there aren’t any cartons of fruit juice there, Alice proceeded to making fruit juice herself which she shares with Lisa.
‘Toast!’
‘Yes!’
While Lisa plays the piano as Alice reads a book about the Moon, the third friend to arrive is Alex Macaraig, he brought along some presents for him to unwrap. The only problem is Ed remains drunk and sick, he has yet to recover in due time.
‘Ed, I bought you books about Saturn and Uranus, those are your favourite planets, right?’
‘Alex, I feel sick.’
Then Alice sees him.
‘Alex, Ed just got drunk on his birthday.’
‘Oh I see.’
Alex walks around the house, looking for something for him to keep himself preoccupied, he goes through every room and area. He’s also not into drinking alcohol, so he just drinks water instead.
Then Ed’s father arrives, carrying a binocular.
‘Mr Mapplethorpe, you just arrived!’
‘What did Ed do today, Alex?’
‘He got drunk. That’s what Alice said to me.’
‘When did he get the idea that he can get drunk, just because he’s 19 now?’
‘I don’t know, why don’t you ask him instead?’
Then his father confronts him.
‘Ed, why did you get drunk?’
‘But Dad, I turned 19, I’m not a kid anymore.’
‘No more alcohol for you!’
‘F---.’
For the rest of the evening, his father made him throw away the bottles. He didn’t like it, but had to do it anyways.

Article 1315. Contracts are perfected by mere consent, and from that moment the parties are bound not only to the fulfillment of what has been expressly stipulated but also to all the consequences which, according to their nature, may be in keeping with good faith, usage and law. (1258)
CASE DIGEST: SM Investments Corporation vs. Posadas I G.R. No. 200901 | December 7, 2015 | PEREZ, J.
FACTS:
SM Investments Corporation (SMIC) and respondents Estela Marfori Posadas, Maria Elena Posadas, and Aida Macaraig Posadas own 27.6 hectares of land in Makati City. On August 8, 1995, SMIC, through its President Henry Sy, Jr., proposed a joint venture to develop the property into a commercial/residential subdivision. The offer included a goodwill payment of PHP 70 million and a 60/40 profit-sharing scheme favoring the respondents. On August 18, 1995, the respondents countered, requesting an increase in the goodwill money to PHP 80 million, which SMIC accepted on August 24, 1995. SMIC sent development drawings on December 2, 1995. On December 6, 1995, the respondents informed SMIC of receiving better offers and demanded an improved offer from SMIC. On February 27, 1996, SMIC reiterated its offer with revised terms, including a goodwill payment of PHP 140 million. When the respondents did not honor the joint venture agreement, SMIC filed a case for Specific Performance and Damages on April 21, 1997. The Regional Trial Court of Makati City ruled in favor of SMIC on December 18, 2007, declaring the joint venture agreement valid and enforceable. The respondents appealed, and the Court of Appeals reversed the decision on September 13, 2011. SMIC filed a Petition for Review with the Supreme Court.
ISSUE:
Whether or not there is a perfected contract for a joint venture
RULING:
Yes, there was a perfected contract for a joint venture between SMIC and the respondents. The Supreme Court found that a contract is perfected by mere consent of the parties, as per Article 1315 of the Civil Code. The essential elements of a contract—consent, object certain, and cause—were present in this case. The letter of August 8, 1995, from SMIC contained a complete offer, and the respondents' letter of August 18, 1995, was a counter-offer that SMIC accepted on August 24, 1995. This exchange of correspondences indicated a meeting of the minds, thus perfect.

The alleged disintegration of Smuggled Onions to be investigated by the Bureau of Customs
(Prepared by Niko Baua / news reporter of ABS-CBN News)
CALAMBA, LAGUNA -- The National Bureau of Investigation (NBI) is currently looking into the alleged disintegration of its confiscated smuggled onions inside a container van at the Bureau of Customs (BOC), which were supposed to be properly disposed around late-May 2022 at 10:11am (Laguna local time).
Due to the ongoing Coronavirus Disease-19 (CoViD-19) pandemic nationwide, including the Luzon area, onion smuggling was intercepted in 2019, and is thought to have reached a skyrocketed record of disposal. Per container van #GCSU6019637, only the nets were completely melted when opened for the first time. They were exposed and turned into dust empty-handed, according to the BOC staff.
In an exclusive radio report from DZMM-TV's Teleradyo: Manila of ABS-CBN News as the Bureau of Plant Industry (BPI) said, vegetables became watery and almost dissolve when stored for a longer time.
But the so-called company named Pyrotech Solution (whose a parent company of Macaraig in Parañaque City) that was accredited to dispose products without traces of onion in such a container van that has no foul smell at all.
While BOC gave their company credit for disposing of the items, they claimed to have found no evidence of onion inside the container van. Within 13 years of service, they are said to have first experienced on this in the present. Onion smuggling had yet to schedule for a destruction, but it was reportedly postponed due to the aforementioned pandemic. They make sure the container van is not opened once more following an inspection after being halted off.
The NBI is investigating the allegation that the confiscated smuggled onions are being recycled or sold in the market. It is very illegal to sell or give away because it will affect the local supplier from the source. Condemnation facilities accredited by the BOC are also summoned to find out if they are following the customs process in destroying their smuggled goods.

Skilled Landing on Moving PH Navy Anti-Sub Frigate
The Philippine Navy's (PN) missile frigate BRP Antonio Luna (FF-151) achieved another milestone as an AgustaWestland (now Leonardo) AW-159 "Wildcat" anti-submarine helicopter successfully landed on its flight deck while the ship was underway off Corregidor Island. "On the morning of 27 April 2023, the Philippine Navy achieved another significant milestone in its development of anti-submarine warfare capability as the PN AW-159 Mk220 'Wildcat' helicopter, with tail number NH-441, successfully conducted its first deck landing aboard BRP Antonio Luna (FF-151), an ASW (anti-submarine warfare) guided missile frigate, while underway at vicinity 30 nautical miles southwest of Corregidor Island," a post on the BRP Antonio Luna's Facebook page said Thursday night.
Simbad-RC on BRP Antonio Luna. Photo by Rhk111. Wikimedia. This achievement demonstrates the growing capability and readiness of the Navy's crews and platforms as a team for ASW operations. "Both the JRCFs (Jose Rizal Class Frigates) and the PN Wildcats were products of the 1st Horizon Projects under the Revised AFP (Armed Forces of the Philippines) Modernization Program, which were delivered and commissioned into the service in 2020/2021 and 2019, respectively. The JRCFs were built by Hyundai Heavy Industries of South Korea while the PN ‘Wildcats’ was built by Leonardo Helicopter Limited UK (LHUK)," the post further said. The PN's "Wildcat" aircrew are still undergoing the contracted in-country training with Leonardo Helicopter Limited UK while the JRCFs are being used in the various operational areas of the country. The AW-159s, which the Philippine Navy has two, were acquired to increase the ASW capabilities of the JRCFs. "The PN through the Naval Air Wing and Offshore Combat Force are taking steps to complete the integration of these game-changer assets in order to be deployed together in securing our maritime domain," the BRP Antonio Luna said. It added that these initiatives are a great contribution to fulfilling the Navy’s vision of becoming a modern, multi-capable naval force responsive to our maritime nation's defense and development. The BRP Jose Rizal (FF-150) and its sister ship BRP Antonio Luna are modern warships capable of surface, sub-surface, air and electronic warfare using state-of-the-art electronic sensors, long-range missiles, acoustic guided torpedoes and embarked anti-submarine helicopters. The BRP Jose Rizal was delivered to the Philippines in May 2020 and commissioned in July that year while the BRP Antonio Luna was commissioned on March 19, 2021. The contract for the two ships was placed at PHP16 billion with another PHP2 billion for weapon systems and munitions.

FAMILY CODE
Paternity and Filiation(Art. 166)
ANDAL VS. MACARAIG
Facts:
🔸Petitioner Mariano Andal filed for recovery of ownership and possession of a parcel of Land in Camarines Sur.
🔸He said that he is the surviving son of Emiliano Andal and Maria Duenas, he also stated that the land was acquired by his father from his mother.
🔸However, respondent Macaraig questioned the legitimacy of Andal because he said that Emiliano was sick of TB from Jan. 1941 until he became disabled in 1942. Macaraig also alleged that Duenas the mother of Andal are having adulterous relationship with Felix, brother of Emiliano. 🔸And on June 1943 Duenas gave birth to Andal, the petioner of this case.
ISSUE:
Won Mariano is a legitimate child.
RULING:
Yes, Mariano Andal is presumed to be the legitimate son because, he was born within the 300 days following the dissolution of marriage[Art. 108.Civil Code]. That the presumption can only be rebutted by proof that it was physically impossible for the husband to have had access to his wife during the first of 120 days of the 300 days. Even if the fact that the wife committed adultery cannot overcome this presumption. Although the husband was already suffering from TB, that is not enough evidence that he is suffering from impotency, nor does it prevent carnal intercourse.
🔸NOTE: this 300/120 computation might be obsolete because of the scientific method of DNA now.

Presumption of marriage; merely rebuttable
There is a presumption of marriage between persons deport themselves to be married. The presumption is merely rebuttable (Rule 131, Rules of Court). This presumption may be contradicted by a party and overcome by other evidence.
LUIS UY v. SPS MENDOZA
G.R.NO. 206220
AUGUST 19, 2015
Luis Uy subsituted by Lydia Uy Velasquez and Shirley Uy Macaraig, Petioner
Vs
Spouses Jose Lacsamana and Rosaura Mendoza, substituted by Corazon Bueno, Respondents
Facts:
The petitioner, Luis filed with RTC Batangas a complaint for the Declaration of Nullity of Documentss with damages against respondents Petra Rosca and Sps Lacsamana. He alleged that he was the lawful husband of Rosca, that they lived together as husband and wife from 1944 to 1973 wherein they where separated and lived apart. He alleged that he and his wife acquired a land which was issued in the name of Petra Rosca, married to Luis Uy. He stated that Rosca, executed in gross and evident bad faith and signed in a false simulated deed of sale. He contested the sale and that the property was conjugal in nature and sold without his consent.
Rosca denied all the allegations and claimed that she lawfully acquired the subject land using her paraphernal funds and that she was never married to Uy. Rosca stated that
Sps Lacsamana also counterclaimed that they were buyers in good faith.
After the death of Luis he was substituted by his daughters, Lydia and Shirley. Lydia testified that the Uy family lived in the house built on the land questioned by Uy and Rosca. She also alleged that the funds used to construct the family dwelling came from Uy’s business.
On other hand, Rosca testified that sometime on or before WWII, they both cohabited and settled in Batangas. The couple attempted to formalize their marital union with a marriage ceremony. However, it was not consummated because of the bombing which occurred on the day of the ceremony. Likewise, they were unable to secure a marriage contract. She also stated that she purchase alone and as sole vendee, with the money coming from her own personal and and paraphernal funds the subject parcel of land and even the construction of their family dwelling.
From the records, in the petition for Uys naturalization, it stated that, “I am married (not legally), in his sworn statements no less than the Governor of Batangas for his petition also the same. In his immigrant certificate of residence and Alien Certificate of Residence shows that he regarded himself as single. That, Vicente Caedo, a prominent citizen of Batangas, stated that Uy and Rosca were not legally married.
From the part of Uy, it was written in the SSS claim death for employees compensation, Rosca admitted she is the widow of Uy.
ISSUE:
Wether or Not the marriage of Uy and Rosca is valid
Ruling:
No, Uy failed to discharge the burden that he was legally married to Rosca. There is a presumption established in our Rules "that a man and woman deporting themselves as husband and wife have entered into a lawful contract of marriage."Semper praesumitur pro matrimonio — Always presume marriage. However, this presumption may be contradicted by a party and overcome by other evidence.Uy was not able to present any copy of the marriage certificate which he could have sourced from his own personal records, the solemnizing officer, or the municipal office where the marriage allegedly took place. Even the findings of the RTC revealed that Uy did not show a single relevant evidence that he was actually married to Rosca. On the contrary, the documents Uy submitted showed they were not legally married to each other. Since Uy failed to discharge the burden that he was legally married to Rosca, their property relations would be governed by Article 147 of the Family Code which applies when a couple living together were not incapacitated from getting married.Wherefore, the court find that the Deed of , executed by Rosca on her paraphernal property in favor of Spouses Lacsamana, is valid.
