Key Decisions and Updates from the 53rd GST Council Meeting
Ease of Compliance Burden for Taxpayers
1. Changes in GSTR-1 Filing:
Introduction of GSTR-1A: Taxpayers can now add or amend particulars in GSTR-1 of the current tax period/IFF for the 1st and 2nd month of the quarter before filing GSTR-3B.
Reporting B2C Supplies: The threshold for reporting Business-to-Consumer (B2C) interstate supplies invoice-wise in Table 5 of GSTR-1 has been reduced from ₹2.5 lakh to ₹1 lakh.
2. GSTR-4 Due Date Revised:
The due date for filing GSTR-4 by composition taxable persons has been extended from April 30 to June 30, starting from the fiscal year 2024-25.
3. TCS Rate Reduction:
The Tax Collected at Source (TCS) rate for Electronic Commerce Operators (ECOs) has been reduced from 1% to 0.5% (0.25% each under CGST and SGST/UTGST or 0.5% under IGST).
4. Compulsory Filing of GSTR-7:
GSTR-7 must be filed mandatorily even if no Tax Deducted at Source (TDS) is deducted. No late fee will be charged for nil filing. GST Filing.
5. GSTR-9/9A Filing Exemption:
Taxpayers with an aggregate annual turnover up to ₹2 crore will be exempt from filing the annual return in GSTR-9/9A for the fiscal year 2023-24.
Modifications to Sections and Rules
1. Modification to Section 16(4):
The time limit to avail Input Tax Credit (ITC) for invoices or debit notes in any GSTR-3B filed up to November 30, 2021, is deemed to be November 30, 2021. This applies retrospectively from July 1, 2017. Section 16(4) shall be relaxed for returns filed within 30 days of the order of revocation.
2. Amendment to CGST Rule 88B:
No interest will be charged on the amount available in the electronic cash ledger on the due date of filing GSTR-3B, debited while filing the return in cases of delayed filing.
3. New Section 128A:
Waives interest and penalties for demand notices issued under Section 73 of CGST for fiscal years 2017-18, 2018-19, and 2019-20 in cases not involving fraud, suppression, and misstatement. This applies if the taxpayer pays the full amount in the notice by March 31, 2025.
4. Changes in Sections 73 and 74:
A common time limit will be set for issuing demand notices and orders. The time limit for taxpayers to claim the benefit of reduced penalty, by paying the tax demanded along with interest, is increased from 30 to 60 days.

Monetary Limits and Appeals
1. Monetary Limits for GST Appeals:
Recommended monetary limits for filing appeals: ₹20 lakh for GST Appellate Tribunal, ₹1 crore for High Court, and ₹2 crore for Supreme Court.
2. Amending Sections 107 and 112:
The maximum amount for pre-deposit for filing an appeal before appellate authorities is reduced from ₹25 crore to ₹20 crore under both CGST and SGST. For appeals before the GST Appellate Tribunal, the pre-deposit is reduced from 20% with a maximum amount of ₹50 crores to 10% with a maximum of ₹20 crores under both CGST and SGST.
Additional Key Decisions
1. Sunset Clause for Anti-Profiteering Cases:
A sunset clause will be added for pending anti-profiteering cases. The hearing panel will shift from CCI to the principal bench of GSTAT. The sunset date for receiving new applications regarding anti-profiteering is set for April 1, 2025.
2. Time Limit for GSTAT Appeals:
Modifying Section 112 to provide a 3-month time frame for filing appeals before the GST Appellate Tribunal. The timeline will commence from a date yet to be notified, likely by August 5, 2024.
3. New Section 11A:
Allows regularization of non-levy or short levy of GST due to common trade practices.
4. IGST Refunds and Adjustments:
Mechanism introduced for claiming refunds of additional IGST paid due to upward price revisions after exports. No IGST refund will be allowed where export duty is payable.
5. Biometric-based Aadhaar Authentication:
Implementation of biometric-based Aadhaar authentication for GST registration will be rolled out nationwide in a phased manner.
6. DRC-03 Circular:
A circular will prescribe a mechanism for adjusting any demand amount paid through DRC-03 against the amount payable as a pre-deposit for filing a GST appeal.
7. Amendment to Section 122(1B):
Clarification that the penal provision is applicable only for those e-commerce operators required to collect TCS under Section 52 and not for other e-commerce operators.

Social media influencers or those who claim to ‘educate’ and ‘influence’ masses using social media platforms including YouTube, Facebook, X (formerly Twitter), and Instagram are affecting India’s current political scenario. Ezivote, India’s first political fantasy application makes an attempt to know about such influencers and what goes behind political content creation.
Content creators and politics
Youtuber and vlogger Dhruv Rathee recently posted a video titled ‘Is India becoming a DICTATORSHIP?’. Around 30 minutes in duration, the content creator compared India’s current central government with Hitler’s ruling approach in his two-month-old video. The video has 24 million views to date. Rathee, who calls himself a ‘Youtube educator with expertise in breaking down complex words into simple words’, comes up with long videos that often encourage debates and divide the internet into two. One section stands strong with the Youtuber, labeling his content as an ‘eye-opener’ or ‘revolutionary’. The latter accused him of being anti-government or being politically biased.

To understand it better, let us go to the story of another YouTuber who recently joined the Bharatiya Janata Party (BJP), Manish Kashyap. On his channel, Kashyap posted videos of various social and political issues in his ‘aggressive’ style that caught viewers' attention. Praised by audiences for his heroic style of reporting in Bihar, the journey of creating political content to enter politics came amid many controversies for the YouTuber.
In March 2023, Manish Kashyap aka Tripurari Kumar Tiwari, was arrested by the Tamilnadu police for posting YouTube videos of Bihari migrant workers being harassed in Tamilnadu. The posted video was fake and his videos resulted in a mass exodus of Bihari migrants from Tamil Nadu as they left their workplace without any prior notice. Amid arrest, he spent nine months in jail. Before this, an FIR was lodged against him for inciting vandalism following damage to the statue of King Edward VII on Maharani Janki Kunwar Hospital in his home district. He was arrested for attacking Kashmiri shawl vendors in Patna after the Pulwama attack.
But do online political debates mark an offline impact? Amid the digital revolution in India, the answer is yes. The viewers who consume such content are free to express their opinions. But here, it is equally important to focus on the numbers. With millions of subscribers, there can be some significant impact on opinion formation. However, most creators continue to emphasize that they create content to educate the masses and have nothing to do with the political parties.
Impact on elections
The impact of social media platforms and influencers cannot be overlooked during election campaigning. A report by the Election Commission of India (ECI) states that the BJP spent 325 crore and the Congress spent 356 crore for digital advertising during the 2019 Lok Sabha elections. It is quite clear that this figure will be multiplied for the 2024  Lok Sabha elections. SURAT: Congress leader Rahul Gandhi on Monday told a sessions court in Surat his conviction by a magistrate's court in a 2019 defamation case over his "Modi surname" remark was erroneous, patently perverse, and he was sentenced in a manner so as to attract disqualification as a Member of Parliament.
Gandhi, in his appeal filed in the sessions court against the conviction and two-year jail term handed last month, submitted he was treated harshly by the trial court which was "overwhelmingly influenced" by his status as an MP, and maintained there is no such thing as a definite Modi samaj or community on record.
In his application seeking the suspension of conviction, which will come up for hearing on April 13, the former Congress president said, "It appears reasonable to argue that the applicant was really sentenced in a manner so as to attract the order of disqualification (as an MP)."
Earlier in the day, Additional Sessions Judge RP Mogera's court granted him bail till the disposal of his appeal on a bond of Rs 15,000.
Gandhi (52), elected to the Lok Sabha from Wayanad in Kerala in 2019, was convicted in the criminal defamation case on March 23 by the court of Chief Judicial Magistrate H H Varma and sentenced to two years in jail.
The magistrate's court had granted him bail for 30 days to appeal the verdict.
A day later, he was disqualified as a Lok Sabha member under provisions of the Representation of the People Act, 1951.
"The judgment of conviction and order of sentence passed by the CJM (Chief Judicial Magistrate) is erroneous, patently perverse, in flagrant violation of principles of appreciation of evidence in criminal trial, illegal and unwarranted on the facts and circumstances of the case and on the evidence to substantiate the charge levelled against the appellant/accused," said Gandhi in his petition in the sessions court.
The judgment of conviction and order of sentence was passed without any evidence, he claimed in the plea filed through his lawyer.
The magistrate's court judgement was passed on the basis of assumptions, presumptions, conjectures, surmises and suppositions which are not permissible in the criminal law at all, according to the petition.
The order of conviction and sentence was bad in law and against the weight of evidence, and the trial judge was "overwhelmingly influenced" by his status as an MP, he said.
In such a case, he (trial judge) certainly presumed that the award of maximum sentence of two years would entail his disqualification as a Member of Parliament, said the plea.
The Representation of the People Act holds that an MP/MLA convicted of any offence and sentenced to imprisonment for not less than two years shall be disqualified from the date of conviction.
"Parliamentarian, in Opposition, is expected or rather required to be 'vigilant and critical', and the view of the trial court that a Member of Parliament deserves to be awarded the highest punishment because of his status "is wholly unwarranted and manifestly unjust," said the four-time MP in his plea.
By the very nature of his task, a politician in Opposition cannot always weigh his words in golden scales, he said, adding, "Hence, it is incumbent upon courts to focus on the essence and spirit of the speech (related to Modi surname) made rather than on the tone and tenor.
He said "a strong and uncompromising opposition" is the essential requirement of a "true and healthy democracy."
"While performing his duties as a critic of the government, a Member of the Legislature, is very likely to cause annoyance and/or embarrassment to those in power," Gandhi stated.
While granting bail to Gandhi, the sessions court issued a notice to the complainant in the case, Gujarat BJP MLA Purnesh Modi, over the plea for the suspension of conviction and sought his response by April 10.
When the magistrate's court took the view that he deserved to be awarded the highest punishment because of being a Member of Parliament, it is expected that the judge would also be aware of the mandatory disqualification that it entails, Gandhi said.
"Such disqualification entails the rejection of the mandate of the electorate on one hand and huge burden on the exchequer on the other (for holding bypoll)," said the Congress leader.
Gandhi maintained the trial court erred in believing the accused didn't stop after allegations against Prime Minister Narendra Modi, and industrialists Nirav Modi, Lalit Modi, Mehul Choksi and Vijay Mallya, and therefore he intended to defame all persons with the Modi surname.
The said sentence, "Why all thieves have surname Modi," was spoken in connection with PM Modi, Nirav Modi and Lalit Modi, and not people with the "Modi" surname," said the plea.
Barring this sentence, all the alleged defamatory comments are against PM Modi personally, the Congress leader said in the plea, adding there is no such thing as Modi samaj or community on record.
He said the complainant (MLA Purnesh Modi) terms the Modh Vanik Samaj or Modh Gachi Samaj or Teli Gachi Samaj as Modi samaj, even when there is no documentary evidence on record that they are all part of the Modi samaj.
Even otherwise, a Modi Samaj is "not an identifiable, determinate, definite group," Gandhi said.
"There are Modis in every community. There is no organization of persons having the surname Modi. There is no particular group of Modis which is referred to in the impugned defamatory statement as distinguished from the rest of the Modis," he said.
"Modis are 13 crores (in number), and all these people will not have a right to file the complaint because it is not an identifiable, definite, determinate group or collection of persons," said the 52-year-old Congress leader.
While awarding him the maximum permissible sentence (two years), the trial court treated it as "a case of extreme depravity" without giving attention to the fact that the petitioner (Gandhi) was a first-time offender, said the plea.
The appellant has been treated harshly both on the merits of the controversy (due to the remark) as well as at the stage of determination of sentence taking into account his position as a Member of Parliament, he said.
Gandhi said the proceedings of trial did not satisfy the requirements of a fair trial, and there were elements of unfairness vitiating the trial at various stages.
He said the defamation complaint was filed in "hot haste" at Surat by a sitting MLA of Bharatiya Janata Party (Purnesh Modi) two days after he made the comment at an election rally at Kolar in Karnataka.
There was no prima facie material to accept the allegations made by MLA Modi, the Congress leader said, adding the complaint was "motivated by political considerations".
The lower court observation, that the accused insulted and defamed the PM's surname and called him a thief for political gains, had no basis, Gandhi said.

Jharkhand election results: Unfortunate for BJP in continuing the 2nd turn of chief minister in Jharkhand assembly elections, but one learns from their own shortcomings. The results declared in the 2019 Jharkhand Assembly election on Monday again made it clear that the state Chief Minister`s post is still “unfortunate” with none of its holders managing to get a second consecutive term even as current Raghubar Das was trailing in his own stronghold because of which BJP was swept out of the power.
However, Das should be applauded for earning the distinction of becoming the first Chief Minister of the tribal-state, engraved out of Bihar in 2000, to complete a full term in power, but in 2019, anti-incumbency, rural distress, resentment over lack of jobs and even a divide within over the choice of poll candidates had to bear the loss.

Projections for 2024 Lok Sabha elections
The last elections for 2023 are over. Now it's time to prepare for the 2024 General Elections. BJP showed that it can beat anti-incumbency factors and return with a bigger share of seats. INC is at a loss as to where it went wrong. Were they wrong from the beginning or did that happen after the nominations were filed? Success in Karnataka elections barely 6 months back put them in an overconfident mode and thought the same formula works for all seasons. Whoever thought so made the only terrible mistake of their life in the Hindi belt or the cow belt as most political commentators would like to call those states - Rajasthan, Madhya Pradesh, Chhattisgarh.
I did some simple calculations and arrived at my seat projections for 2024. No surprises. NDA is returning to power, and BJP is improving its 2019 tally. States where they were expected to lag behind are now moving towards BJP. Congress party & I.N.D.I alliance are in for a big shock when the results are announced in mid-May 2024. BJP may improve its tally and will walk away with 308-360 seats and NDA allies will contribute another 20-25 seats. If NDA comes with the slogan "abki baar Modi sarkar aur 400 paar", don't be surprised; it will definitely happen. In the south, Karnataka BJP is likely to lose a couple of seats. They can still come back with a decent number of seats - between 20 to 24. Telangana 4 to 6, Tamil Nadu and Kerala there is a fair chance of them opening their account with one or two seats. Andhra I don't see anything happening now, but as election dates come near, things can change. Bihar & Maharashtra BJP will improve its tally, but the allies will underperform.
BJP will win between 310-360 seats and allies will add another 20 seats taking the NDA tally to 330 to 380 seats. Another projection will be given in mid-January 2024.

Elections 2019: In Assam, Prafulla Mahanta finds himself at the crossroads

The Asom Gana Parishad (AGP) is split but not fully out because Prafulla Kumar Mahanta, its founder and leader (until recently), stands isolated as the party is back with the Bharatiya Janata Party in Assam after a brief ‘estrangement’ to Mahanta’s surprise and disapproval. He turned to small regional outfits on the political periphery to support him but interestingly, even the All Assam Students’ Union (AASU), of which he was once the spearhead, was indifferent to his appeal.
The trigger for Mahanta’s dissent was the AGP’s decision last week to return to the National Democratic Alliance and contest the Lok Sabha polls together after “walking out” of the coalition last January to protest the BJP’s doggedness to pass the contentious Citizenship (Amendment) Bill, 2019, in Parliament. Eventually, the Centre put it aside, after the entire north-east rose up in arms because the proposed law would have legalised the citizenship rights of foreigners of every religious denomination living in these states, barring Muslims. To the AGP--whose progenitor, the AASU, led one of independent India’s long-drawn agitation against ‘illegal infiltrators’ from Bangladesh who were domiciled and given voting rights in Assam--the amendment was an abomination because the AASU never recognised ‘infiltrators’ as Hindus and Muslims.
Three AGP ministers in the BJP-led government, Atul Bora, Keshab Mahanta and Phani Bhushan Choudhary, put in their papers in “protest”. However, reliable BJP sources said the “understanding” was the BJP would pound away the bill for a while to disseminate a “larger” political message the country over and put it aside expediently.
