One of the best-known resource-funded conflicts is the war in the eastern provinces of the Democratic Republic of the Congo (DRC). In the DRC, impunity and weak public institutions result in recurring violence, in which control over Congo’s rich min eral resources remains a central catalyst.
Even in less violent circumstances, mineral extraction risks causing corruption, social problems issues and environ mental destruction. The situation in Katanga, DR Congo’s southernmost province and home to large deposits of copper and cobalt, is a poignant example. Although the security situation in Katanga is much better than in its neighbouring Kivu provinces, mining takes place at a high human and environmental cost. Communities pay a brutal price when they lose their livelihoods to make way for mining projects. Workers risk their health and lives in Congo’s dangerous pits.
The cobalt taken from those mines is used in consumer products like mobile phones and laptops, car batteries, tools, lenses, jewellery and healthcare. Ethical sourcing of minerals has been central to the debate about the supply chain responsibility of electronics companies further down the line.
Some specific steps have been taken regard ing conflict minerals. In the USA, the 2010 Dodd-Frank Act requires listed companies to disclose the source of minerals in their products. The European Commission has proposed a conflict minerals regulation currently under discussion in the European Parliament.

Amnesty: Cobalt mined by DR Congo children could be used in smartphones
Cobalt mined dangerously by children in the Democratic Republic of Congo could end up in the lithium batteries of smartphones and electric cars made by Apple, Samsung or Sony, Amnesty International said Tuesday.
After questioning 16 multinationals, the human rights watchdog said world-class electronics brands are failing to ensure that no child miners were involved in lithium-ion batteries used in their products, according to a joint report released with Afrewatch.
The DR Congo accounts for more than half of global production of cobalt, mainly from the southeastern Katanga province.
Thousands of clandestine miners including numerous young children work in tunnels with rudimentary tools at risk to their health and their lives.
The firms contacted by the report were identified as clients of Asian battery manufacturers that acquire processed cobalt from Chinese mineral conglomerate Zhejiang Huayou Cobalt Ltd, which wholly owns a subsidiary in DR Congo, the report said.
The report describes how traders buy cobalt from areas where child labour is rife and sell it to a local subsidiary of Huayou Cobalt. Once processed, the cobalt is sold to battery component manufacturers in China and South Korea, which supply the multinationals.
The report, entitled 'This is what we die for: Human Rights Abuses in the Democratic Republic of Congo power the global trade in cobalt,' also includes testimony from adult and child miners who work long shifts with no protective equipment, in danger of fatal accidents and permanent lung damage.
One company interviewed acknowledged the link, but two multinationals denied sourcing cobalt from DR Congo and others took intermediate positions. Six said they were investigating the claim.
"Crucially, none provided enough details to independently verify where the cobalt in their products came from," the report said.
'People don't ask how products are made'
Leading automobile and electronics firms such as Daimler, Lenovo, Microsoft and Samsung were unable to declare the origin of the cobalt used in their lithium-ion batteries, Amnesty said.
Amnesty urged "multinational companies who use lithium-ion batteries in their products to conduct human rights due diligence, investigate whether the cobalt is extracted under hazardous conditions or with child labour, and be more transparent about their suppliers."
"Millions of people enjoy the benefits of new technologies but rarely ask how they are made," said Mark Dummett, business and human rights researcher for the non-governmental organisation.
"It is a major paradox of the digital era that some of the world's richest, most innovative companies are able to market incredibly sophisticated devices without being required to show where they source raw materials for their components," Afrewatch executive director Emmanuel Umpala said.
The vast DR Congo in central Africa has immense mineral resources but remains one of the least developed nations in the world.
Rather than easing poverty, mining has helped fund more than 20 years of conflict, particularly in the eastern North and South Kivu provinces, which furnish large amounts of gold, tin, coltan and tungsten.
To prevent companies from indirectly financing conflicts, a US law on so-called "blood minerals" took effect in 2014 obliging firms listed in the United States to inform its regulators if they use such raw materials, mined not only in DR Congo but its nine neighbouring countries.
In a report published jointly in April 2015 with Global Witness, another non-governmental organisation, Amnesty International accused major American firms of neglecting their duties under the legislation.

Blockchain to track Congo's cobalt from mine to mobile

LONDON (Reuters) - Blockchain is to be used for the first time to try to track cobalt's journey from artisanal mines in Democratic Republic of Congo through to products used in smartphones and electric cars.
Sources close to a pilot scheme expected to be launched this year say the aim is eventually to give manufacturers a way of ensuring the cobalt in lithium-ion batteries for products such as iPhones and Teslas has not been mined by children.
Tracking cobalt presents many challenges as scores of informal mine sites would have to be monitored, all players in the supply chain would need to buy into the scheme, and accurate, electronic data would need to be transmitted from remote areas - all in a vast country plagued by lawlessness.
But companies are under growing pressure from consumers and investors to show the cobalt they use has come through supply chains free of rights abuses, just as they have for minerals used in electronics such as tantalum, tin, tungsten and gold.
"We are prototyping, iterating, testing, scaling," said Warren, who is working with experts to see how blockchain can improve mineral supply chains. "The technology is not the hard part."
Amnesty International, which detailed the extent of child labour in cobalt mining in Congo in a 2016 report, said it was looking at blockchain, especially with a view to tracing payments to middlemen.
"You have to be wary of technological solutions to problems that are also political and economic, but blockchain may help. We're not against it," said Amnesty researcher Mark Dummett.
Congo holds half the world's cobalt reserves and demand for the main mineral component of lithium-ion batteries is set to surge as electric cars proliferate. In 2016, Congo mined 54 percent of the 123,000 tonnes of cobalt produced worldwide.
Carmakers such as Volkswagen are trying to secure long-term cobalt supplies to sustain electric car production, and they are asking suppliers to ensure no child labour was used in the supply chain.
The plan for the Congo pilot scheme is to give each sealed bag of cobalt produced by a vetted artisanal miner a digital tag which is entered on blockchain using a mobile phone, along with details of the weight, date, time and perhaps a photo.
At the next stage, a trader buying the bag would record the details on blockchain, and the process would be repeated until the ore gets to the smelter - leaving an immutable record of the cobalt's journey for downstream buyers or third parties to view.
The pilot will involve organisations throughout the supply chain, from on-the-ground monitors checking that sites are not using child labour, through the refining process to end users, according to people helping to develop the scheme.
One potential risk in the supply chain is that cobalt mined by children gets mixed with "clean" cobalt before processing.
The industry is experimenting with options such as indelible marks that survive the refining process, a mass balance approach as used for Fairtrade certification of products such as cocoa, or bolting blockchain onto computer technology already used by refiners to monitor material as it moves through their plants.
"We are very bullish about the potential impact of blockchain in minerals and metals supply chains," said Harrison Mitchell, director of RCS Global, which advises companies on responsible sourcing and audits supply chains.
"Blockchain-enabled supply chains will have the ability to deliver trust and transparency over the production of metals such as cobalt," he said. "Ensuring that information from these mine sites is inputted correctly and transparently is difficult, but it is possible."
Some institutional investors are also pushing mining companies and manufacturers to harness blockchain to help clean up mineral supply chains.
Christine Chow of Hermes Investment Management said tracking cobalt was far more complex than diamonds, typically involving 12 steps as opposed to five stages for gems.
"But the principle of recording key characteristics and then entering them into the blockchain, which is stored on the cloud, is the same," said Chow, part of the Hermes EOS team that advises institutional shareholders on responsible investing.
"To make it work, the key players in the chain must agree a set of input data to define its features," said Chow, whose team has $425 billion of assets under advice.
The International Council on Mining and Metals (ICMM) said its members, which include all major mining companies, were well-placed to draw on blockchain's potential to improve public trust in the industry.
"It does not solve the whole problem, but it solves a big part of the problem," ICMM CEO Tom Butler said.
"Quality at entry to where the blockchain starts remains a challenge, but in that respect we're in a privileged position as ICMM members are mining responsibly."
Glencore, the world's biggest producer of cobalt, declined to comment on the use of blockchain.
In its 2016 sustainability report, Glencore said when it sourced cobalt in Congo from outside its own production, it only dealt with third parties that did not use artisanal mines.

Is your phone tainted by the misery of the 35,000 children in Congo's mines?
"I documented the horrors at 31 artisanal mining sites in the south-eastern provinces, including several previously undocumented sites in remote mountains near the Zambian border. Based on the data I gathered, I estimate there are more than 255,000 creuseursmining cobalt in DRC, at least 35,000 of whom are children, some as young as six.
At the surface, I follow the men from Arthur’s tunnel with several sacks of cobalt to one of the dozens of Chinese buying houses nearby. The entire neighbourhood has in fact been walled off, in an effort to keep people from documenting the perilous conditions.
The cobalt under Kolwezi is purer than at Elodie’s site, so the traders at the nearby buying house pay a higher rate for each kilogramme. It works out to roughly $1.80 a day in income for Arthur, but he is unlikely to get to keep all of it. Numerous local creuseurs told me that children like Arthur are forced to pay bribes to the local government functionaries who are supposed to ensure there are no children working at sites like Kasulo.
In mine after mine, I witnessed heartrending suffering at the bottom of global cobalt supply chains.
The companies that source cobalt from DRC are surely aware of the appalling conditions under which the mineral is mined in some sites in the country. Aside from the Amnesty reports, labour abuses linked to cobalt mining in the region have been widely documented by human rights groups and by media organisations across the world.
Yet while major consumer electronic and automobile brands state they do not tolerate child labour in their supply chains, none have invested enough resources or time into ensuring that they can adequately address the human rights abuses that could be lurking in the products they sell to millions across the world. They have consistently shifted responsibility for human rights abuses in the Congo on to their Chinese suppliers.
In the absence of full accountability, suffering can run riot. No company should be able to jettison their responsibility for the vicious and unjust treatment of the people who mine cobalt and other minerals simply because they are separated from them by a few thousand miles, and a few layers in their supply chains.
From stone to phone, they must be accountable.
Any company sourcing cobalt from DRC must establish an independent, third-party system of verification that all mineral supply chains are cleansed of exploitation, cruelty, slavery, and child labour. They must invest whatever is needed to ensure the decent pay, safe and dignified working conditions, healthcare, education and general wellbeing of the people whose cheap labour they rely on.
There is little we can do as consumers at present, apart from refusing to buy their products until they take sufficient action.

I wanted to tell Elodie I would try to help. I wanted to tell her that despite all the evidence to the contrary, there were people in the world who cared about her and her son.
But I left in silence. I knew these words would be worthless. "

Apple and Google named in US lawsuit over Congolese child cobalt mining deaths

The lawsuit argues that Apple, Google, Dell, Microsoft and Tesla all aided and abetted the mining companies that profited from the labour of children who were forced to work in dangerous conditions – conditions that ultimately led to death and serious injury.
The families argue in the claim that their children were working illegally at mines owned by UK mining company Glencore. The court papers allege that cobalt from the Glencore-owned mines is sold to Umicore, a Brussels-based metal and mining trader, which then sells battery-grade cobalt to Apple, Google, Tesla, Microsoft and Dell.
Other plaintiffs in the court documents say they worked at mines owned by Zhejiang Huayou Cobalt, a major Chinese cobalt firm, which the lawsuit claims supplies Apple, Dell, and Microsoft and is likely to supply the other defendants.
In the court documents, the Congolese families describe how their children were driven by extreme poverty to seek work in large mining sites, where they claim they were paid as little as $2 (£1.50) a day for backbreaking and dangerous work digging for cobalt rocks with primitive tools in dark, underground tunnels.
The families claim that some of the children were killed in tunnel collapses while others were paralysed or suffered life-changing injuries from accidents."

That's the verdict of a US federal appeals court in a case involving five tech companies accused of benefitting from child labour in Congolese mines. On 5th March, 2024, the US Court of Appeals for the District of Columbia made a 3-0 decision in favour of (Google’s parent company) Alphabet, Microsoft, Dell, Tesla and Apple Inc. in a case filed by 16 former Congolese child miners and their guardians.
The plaintiffs accused the companies of "deliberately obscuring" their dependence on child labour, in effect abetting the exploitation of many children to ensure steady supplies of cobalt. Some of the complainants were the guardians of children who’d been killed in cobalt-mining operations.
The court ruled that buying cobalt in the global supply chain did not amount to "participation in a venture," and there was no proof that the tech giants had anything more than a buyer-seller relationship with suppliers or had the power to stop the use of child labour.
Cobalt is in high demand as competition for market leadership in Electric Vehicle sales kicks into high gear. Nearly two-thirds of the world's cobalt is mined in DR Congo. The country has 2-million artisanal miners working under horrible conditions, according to DelveDatabase, an online database. Four critical minerals - copper, nickel, cobalt and lithium - will generate $16 trillion in the next 25 years, according to the IMF.
DR Congo's vast wealth is the key reason for the country's long history of exploitation and conflict - from Belgian King Leopold II running the country as his private estate to Western tech firms churning out high-end goods using Congolese minerals.
