The Ladakh Protest: The 21-day Hunger Strike led by Sonam Wangchuk
Ladakh, famously known as “Mars on Earth”, is the perfect destination where the mind slows down and the soul finds its path.
It is the northeastern Union territory of India, known for its highest mountain ranges, mesmerizing landscapes, beautiful deep valleys, crystal clear blue lakes, diverse wildlife, highest motorable mountain roads, Buddhist heritage, and the overall picturesque beauty of the place.
Ladakh: A union territory without legislature
Ladakh, which was a part of Jammu and Kashmir since 1847, was separated from Indian-administered Kashmir in 2019 and was reconstituted as a Union territory on October 31, 2019.
People of Ladakh have constantly demanded separate territory since the 1930s due to the unfair treatment of Kashmir and the prevailing cultural differences between people of Kashmir and Ladakh.
The formation of Ladakh as a separate Union territory was widely celebrated. Still, people were disappointed because it was made a UT without a legislative assembly and would have a lieutenant governor, while Jammu and Kashmir had a legislature.
What does it mean to have no legislature in Ladakh?
Unlike J&K, Ladakh cannot elect its own representative.
Ladakh will be ruled directly by the central government through a lieutenant governor as an administrator.
The President of India has the power to form rules and regulations for Ladakh, according to Article 240.
Sonam Wangchuk following his Father’s footsteps
Sonam Wangyal was born in 1925 in a small village in the Leh district of Ladakh. He worked his entire life for the rights of the people of Ladakh. He had strong secular beliefs.
He was appointed as the MLC of Jammu and Kashmir from 1957–1967 and as the MLA from 1967–1972, due to his selfless service toward the people of Ladakh.
Wangyal was also an active member in the campaign for ST status for Ladakhis, which was carried out between 1982 and 1984.
In 1984, on his five-day hunger strike, the former Prime Minister, Indira Gandhi, visited Leh and requested Wangyal to withdraw from the strike with the promise of granting the status of ST to the people of Ladakh.
Following his father’s strong morals and values and showcasing his devotion to the land and people of Ladakh, Sonam Wangchuk, a nature activist, engineer, innovator, and educationalist, began a “climate fast for 21 days” on March 6, 2024.
Why are they protesting?
The primary goal behind the protest is to raise awareness about the fragile ecosystem of Ladakh endangered by the growing industrial and developmental projects approved in New Delhi without consent, a threat posed as a result of having no legislative assembly in the Union territory of Ladakh.
The residents of Ladakh have two key demands:
Full-fledged statehood for Ladakh: the residents have demanded to elevate Ladakh’s status as a Union territory to a full-fledged state. This would enable Ladakh to have its own government and the right to form its own rules and regulations in favor of the land and people of the territory.
Integration of Ladakh in the 6th Schedule of the Constitution: The 6th Schedule aims to protect areas with tribal and indigenous populations. By including Ladakh in the 6th schedule, it would allow the state to establish autonomous districts and regional councils.
These elected bodies will have the power to administer and protect the tribal regions of the area. It would give the Ladakhis more control over water management, land use, and cultural preservation.
What is the government’s response to the ongoing protest?
Unlike the response and action taken upon the hunger strike carried out by Wangchuk’s father, the present-day government is MIA.
The current government seems unbothered by the demands and protests in Ladakh, just the way it is, and the deteriorating situation in Manipur.
The pioneers of the movement and every other active citizen in and out of Ladakh are furious about the inaction of the government and the PM, who knowingly promised in his 2019 manifesto of Lok Sabha, that Ladakh will be incorporated into the 6th schedule of the constitution. But apparently, they failed to honor their promises.
Lack of media coverage:
The lack of media coverage is infuriating for the people of Ladakh and the active citizens of India.
Although the independent media and journalists who are physically present in the ongoing protests do cover the news for the country, But it is disappointing to witness the lack of coverage by mainstream media and the big houses.
The scarcity of coverage of this major issue conceals the truth from the nation. The nation wants to know more about the concerns and affairs of the territory. Unless there is some news from the local media houses, the lack of coverage by the recognized media houses keeps the common man from knowing what is really happening there.
The current news on the Ladakh protest:
According to the current news,
Wangchuk survived solely on water and salt during the 21-day hunger strike (inspired by Gandhiji), which lasted from March 6th to March 26th.
In his speech, he talked about the “21-day fast"—that 21 days was the longest fast that Gandhiji kept during the independence movement.
Wangchuk states that the 21-day fast is over, but the protest will still continue. They will only rest when the government agrees to fulfill their demands.
Wangchuk said, “After me, women will begin a 10-day fast tomorrow. This will be followed by youth and Buddhist monks. Then it could be women, or I could come back. This cycle will go on.”
After ending his 21-day fast, Wangchuk stated “We will continue our struggle (in support of our demands). The gathering of 10,000 people at the venue and the participation of over 60,000 others over the past 20 days is a testimony of the people's aspirations.”
Conclusion:
All things considered, Ladakh, the "Land of High Passes," stands at a crossroads. While the echoes of their protests might fade from national headlines, the Ladakhi people's yearning for a brighter future persists. Whether they find resolution in the sixth schedule status or the full-throated roar of statehood, one thing is certain: Ladakh's story is far from over.

In his speech, he said, “India chooses to reply and respond to the comments made by Pakistan that have yet again made an attempt to direct this august body from its agenda. We want to state that the union territory of Jammu and Kashmir was, is and will remain the integral part of India.” He added, “The people of Jammu and Kashmir have recently exercised their democratic and electoral rights and elected a new government. Pakistan must resist such rhetoric and falsehood because it will not alter the facts. Jammu and Kashmir's Assembly elections face uncertainty as opposition fears LG-nominated MLAs may sway results in favor of the BJP.
The stakes have never been higher as Jammu and Kashmir prepares for its first Assembly elections in over a decade. This throws open concerns over the role of five nominated members – a provision enabled by the Jammu and Kashmir Reorganisation Act, 2019 – who are nominated by the Lieutenant Governor for various segments of society, including two women, two Kashmiri Pandits and one displaced individual from Pakistan-Occupied Kashmir. But that decision has sparked fears in opposition parties, which believe that this could turn out to be some form of “BJP plus” nominations.

Critics such as National Conference and Congress leaders argue that the power to nominate members should lie with an elected government. They regard it as a form of ‘pre-election rigging’, afraid that the nominees would cast their vote in unison with the BJP and thus sway the outcome of the election to the side of the ruling party. The BJP, on the other hand, is confident that the nominations are well within the legal framework established under the J-K Reorganisation Act.

To that end, the legislative landscape has dramatically changed, with the strength of the Assembly doubling and now totaling 95 seats, reflecting a highly significant shift in representation. Not only are most of the more than 40% of candidates running as independents–indeed many considered to be BJP allies–but their leaders argue this is simply a vote-dividing ploy. Only then would the real implications of these developments be in the balance, holding in the balance the political future of Jammu and Kashmir-the country or countrymen of a million ballot boxes-minus the promised play-by-the-book ending.

Deadlock over Article -370 : Election finale

The first phase of J-K elections held on September 18 saw 61 % voter turnout. The final phase of polling will be held on October 1. The votes will be counted on October 8.
After six years of central rule, Jammu and Kashmir is holding its first assembly elections since 2014 to democratically elect its first state government after the abrogation of Article 370. 16 - foreign delegates from various countries visited Kashmir to observe the conduct of the electoral process.
Key point to note is the second phase of election in Kashmir saw lower voter in comparison to assembly polls held 2014. With katra having the highest voter turnout at 79.95% while Srinagar having the lowest at 29.24%.
While the election enters it's last phase, the Politics is at its pinnacle in the UT. Endless debate over the statehood of Jammu and Kashmir has Charged the atmosphere with the anticipation over fate of the UT after the elections.
Although Here, we discuss the dead-end over the interpretation of Article 367 of the Indian Constitution, which is going to play crucial role if Congress or other such parties who have promised to restore special provisions of Article 370 to the valley if elected to power.
Maharaja Hari Singh's dilemma amidst coveting tension between India and Pakistan in 1947, led to decision which gave rise to the Instrument of Accession giving India control over certain matters of J-K including defence.
Later the interim government of J-K in 1949, negotiated the special status by joining the Indian Constituent Assembly which provide them their own flag, constitution and criminal code.
Now, about the controversy around the abrogation of special status to J-K. Firstly, what was found to be shady was how the dissolution of constituent assembly of Jammu and Kashmir was dealt with, if it was handled properly there would have been a smooth integration of the state into the Republic of India.
But Nonetheless the catch here is with multiple interpretation and new addition to Article 367.
The new clause added stated that term 'constituent assembly' should be understood as 'legislative assembly' by adding in Article 370 (3). But at that moment of judgement, J-K was under the rule of Article - 356, meant which the legislative assembly and governor of the state, Shall be replaced by Union Parliament and President rule. Therefore, giving the BJP-led parliament pass the resolution from both the houses and amend the article 370 via Constitutional order 272 power granted under the newly constituted article - 370(3) by the President of India discarding the special status to the state.
Interestingly, Article 35A was also affected by the 2019 SC judgement, which defined the erstwhile state's permanent residents. The law curtailed the rights of non-residents in terms of equal opportunity of state employment, acquiring property and settle in Jammu and Kashmir.
Supreme Court with the 5-judge bench had a mixed opinion over the interpretation of article 367. Some agreed the Article 370 was a transitory and temporary provision that should have been dissolved earlier but was not due to the loop-holes in the asymmeteric federal structure of Jammu and Kashmir in 1953 with confusion over its constitent Assembly and legislative Assembly situation. Some concurred with panel saying amendment through back-door should not be permissible. With petitioners challenging the order of 2019 arguing on the basis of Article - 370(1)(a) which has its own inherent intricacies as far as it goes. Thus, the Supreme Court upheld the abrogation and order the Union Government to restore state-hood to Jammu and Kashmir by conducting elections by 30th September, 2024.
The blessed one in the whole event was Ladakh with introduction of Jammu and Kashmir reorganization Act, 2019. The act passed by the Indian Parliament on Aug 5, 2019, allowing the state to be divided into two Union Territories - Jammu and Kashmir, and Ladakh. From a very long time there was a agitation among people of Ladakh demanding it to be a UT as they were neglected and out on a limb as the funds were not available most being diverted to J-K and development being the least priorites with respect to Ladakh people.
Kashmir has been the epicenter of militancy sinces decades which is not a hidden fact due to constant interference in its Politics by Pakistan on its majority population. But since the revocation of article 370 it was made an easy task for Union Government to boast the economy of Kashmir striking a balance in the valley by creating opportunities for general youth to access easy education and job opportunity with good infrastructure and promotion tourism in the valley itself which in turn curbed the militancy.
While it's is still a challenge for the government to rehabilitate the Kashmiri Pandit population there, which were once the heart of the valley.

Addressing a media conclave, Singh said the BJP registered its best ever performance in J&K and credited Prime Minister Narendra Modi for having introduced in the last 10 years a new work culture wherein the benefits of development and public welfare schemes reached to every section of society regardless of caste, creed or religion. He said the BJP is a party that has ensured fair deal to every citizen, following the mantra for "justice to all, appeasement to none". Singh said there were times when a returning officer would reject all the nomination papers and accept only that of the ruling party candidate and declare him a winner uncontested even before the day of polling. "From there we have traversed into a long spell of militancy where, for over three decades, elections were held under fear of gun with boycott call by Pakistan and separatist groups resulting in just eight per cent to 10 per cent polling managed by a handful of individuals and families to perpetuate their rule from generation to generation," Singh said. The senior BJP leader said this was for the first time that mainstreaming of democracy took place in J&K and the elections witnessed the same festivity and enthusiasm as anywhere in the country.
