Christopher Wiggins at The Advocate:
California Democratic U.S. Rep. Sara Jacobs is spearheading a congressional effort to pressure the Trump administration to rescind the Pentagon’s latest policy banning transgender Americans from serving in the military. In a Thursday letter, Jacobs and 41 other lawmakers urge Defense Secretary Pete Hegseth to withdraw the controversial directive and call on President Donald Trump to reverse his executive order enabling the policy. The letter, obtained by The Advocate, highlights the significant contributions of transgender service members, who serve at twice the rate of the general population, with an estimated 15,000 transgender people currently on active duty or the reserves. Studies have shown that transgender service members meet the same military standards as their cisgender peers, and the financial cost of providing medical care for transgender troops is minimal compared to overall military health care expenditures. The letter warns that the ban could have detrimental effects on military readiness and recruitment, especially as younger generations increasingly identify as LGBTQ+. “Any American who currently does – or can in the future – meet the standards required of military service should have the opportunity to serve. And in an all-volunteer force, transgender Americans serve at twice the rate of the general population and have proven that they are more than up to the challenge,” the lawmakers wrote. The letter was signed by several high-profile Democratic lawmakers, including U.S. Reps. Mark Pocan of Wisconsin, Pramila Jayapal of Washington, Jerrold Nadler of New York, and Debbie Wasserman Schultz of Florida. Notably, several LGBTQ+ members of Congress also signed, including Delaware Rep. Sarah McBride, the first out transgender member of Congress, Rep. Becca Balint of Vermont, and California Rep. Mark Takano, the ranking Democrat on the House Veterans’ Affairs Committee and chair of the Congressional Equality Caucus.
Happy to see some Dem lawmakers, such as Rep. Sara Jacobs, lead efforts to block Trump’s anti-trans attack on military readiness from taking effect.

Introducing Their Royal Highnesses, The Duke and Duchess of Landom
It's official, Alexandra, we have a new princess in The Family. Charleston Palace released a photo from Their Royal Highnesses The Duke and Duchess of Landom's private wedding at Olympia Palace.
Sources confirmed TRHs Prince Paul and Princess Alana served as the best man and maid-of-honor. Other Alexandran notables in attendance were Lord Malcolm Landgraab VI and HH Jacob Wasserman, The Viscount Goth.
Santa Marian native Manuela Santina designed The Duchess’ gown, which paired perfectly with a newly created tiara, the Princess Taiylor Meander Tiara. The wedding tiara is a gift from The Duke of Landom. When contacted by TRSi, a spokesman from Charleston shared the following:
Their Royal Highnesses, as is their right, chose to have a more intimate ceremony at Olympia Palace, where The Duke was born.
With interest growing in The Duchess' wedding tiara, we can confirm that although a new style, the tiara was created existing pieces HRH inherited from his mother and grandmother. It's important to His Majesty and The Duke of Landom that The Duchess feels part of the family and leaves her mark on the monarchy. This was the first step. But put plainly, HRH's tiara and wedding expenses were covered by the royal family's personal treasury.
For royal fanatics, we've listed TRHs full names/titles and styles:
His Royal Highness The Prince David Alexander Paul Ishmael of Alexandra, Duke of Landom, Earl of Willowshire, Viscount Albany, The Baron York, FKKG, HLCF.
Her Royal Highness The Princess Taiylor Leah Flemming-Ishmael of Landom, Duchess of Landom, Countess of Willowshire, Viscountess Albany, The Baroness York.
**The Duchess of Landom's legal name is actually:
Her Royal Highness The Princess David, Duchess of Landom

Filmmakers Launch New VR Company At Tribeca Film Festival
Among film festivals, the Tribeca Film Festival has one of the strongest relationships with virtual reality (VR), with several VR and 360-degree movies getting premieres at the event Now a new VR content company has been announced at the event.
Filmmakers Jacob Wasserman, Adam Donald and Ant Gentile have announced the creation of a new VR content company named Hidden Content, which was revealed at the premiere of the company’s first project, horror anthology The Caretaker.
The Caretaker is a narrative horror anthology in 360-degrees, which stars Adelaide Clemens, Tom Lipinski, Clara Wong and Diana Agostini. The pilot was a co-production with RealMotion Inc, with Max Born and Schuyler Weiss serving as producers, and Gentile and Kimberly Parker as exectutive producers.
Hidden Content will be working with film producer and financier Max Born again to produce a slate of VR films and develop a distribution platform for VR and augmented reality (AR) content. The aim is to have Hidden Content act as a full-service VR company. The three filmmakers behind the company have worked extensively in VR and 360-dgree cinema producing VR adverts and other branded content.
Hidden Content are working on three additional new VR genre series, though details on what these are have not yet been unveiled. The company is also working with other VR creators to add to the slate of projects for 2018.
The team previously produced Broken Night, a live-action interactive narrative which tells the story of a woman and her husband returning home from a night out to discover someone has broken into their home. The viewer can make decisions that influence the direction of the narrative as it progresses.
Additional information on Hidden Content’s projects can be found its website. Further news on Hidden Content and other VR experiences will be reported on here on VRFocus.

Hey! Do you have any Stranger Things readalikes and/or middle grade & YA horror recs?
I can, in fact, provide that thing!
I could give MG and YA horror recs all day, so I stayed sort of close to the Stranger Things readalikes part of it.
(All links are to Amazon via the WBS referral code, but buy local if you can, etc.)
Middle GradeThe Riverman by Aaron Starmer - This is a trilogy that takes place in the early 90s. Alistair is approached by a neighbor he hasn’t spoken to since they were younger, who asks him to write her biography. She explains that she is older than he thinks, as she passes time in another reality and has since learned that something from that reality is stealing the souls of children in their world. Creepy coming of age in a similar time period with a similar feel.
Doll Bones by Holly Black - Three friends have been playing the same epic game with their dolls and toys for years. When Zach’s dad tells him he’s too old for dolls and has to start playing boy games, the bone china doll who they cast as the queen of their world is unhappy. Same “kids on a epic quest against evil” vibes.
The Jumbies by Tracey Baptiste - Corinne has never believed in the tales of the jumbies, figuring they were something adults made up to scare kids at night. But after a close encounter in the forbidden part of the forest, a mysterious woman shows up and starts to affect their island. She has to convince her friends to help take down the evil and save their home. Creepy and with that classic “the kids see what the parents don’t” trope.
Miss Peregrine’s Home for Peculiar Children by Ransom Riggs - Jacob grows up hearing fantastic stories of people with strange powers from his grandfather. When his grandfather dies suddenly, he finds himself on a journey to the remote Welsh village where he grew up and stumbles upon a place without time, full of strange and wonderful things, and stalked by an evil only he can see. This one has gr8 pictures, so def do a print or ebook if you can, even though I’m usually a big audio proponent.
The Mysterious Benedict Society by Trenton Lee Stewart - After answering a strange and vague classified ad looking for gifted children, four kids find themselves in the house of the eccentric Mr. Benedict, who’s training them for a perilous undercover mission to bring down the Learning Institute for the Very Enlightened. Smart kids pitted against a sketchy government institution.
The Witch’s Boy by Kelly Barnhilll - After surviving a rafting accident that kills his more talented twin brother, Ned has been told his whole like that “the wrong boy lived.” Áine, daughter of the Bandit King, was warned by her mother that “the wrong boy” will save her life. When the two meet, they discover it’s up to them to stop a war brewing between two kingdoms and save Ned’s mother’s magic. Read this and then read all the rest of Kelly Barnhill’s books.
Young AdultFiendish by Brenna Yovanoff - Ten years ago, the people of New South Bend decided that the strange things happening in town were the fault of the families living in the Willows and burned their houses down. Clementine was kept alive by magic, walled in the cellar until a boy stumbles upon her and sets her free. Now, with the help of her cousin and her friends, Clementine is determined to figure out what really happened ten years ago and how it’s connected to the magical and terrifying place called The Hollow.
Shadowshaper by Daniel José Older - Sienna planned to spend her whole summer working on a mural in her neighborhood, but after being chased by a mysterious entity at a party, she discovers that she’s a part of something bigger. Her family are shadowshapers, people who can direct spirits into art to make it come alive. But someone wants to see the shadowshapers exterminated, and now Sienna and her friends have to uncover the mystery while fighting for their lives. READ. THIS. SERIES. I LOVE IT. HONESTLY. THE SECOND ONE CAME OUT THIS YEAR.
Wonders of the Invisible World by Christopher Barzak - Aidan’s life is ordinary and unremarkable until his former best friend, Jarrod, moves back to town. That’s when Aiden starts being haunted by visions of the past and visions of the present and things his mind has tried to hide from him. This is a weird, great (queer!) story.
The Walking Dark by Robin Wasserman - On a perfectly mundane day in a small down in Kansas, twelve people are abruptly murdered by friends and family members who then go on to kill themselves. Not long after, a strange tornado cuts the town off from the rest of the world, and as the adults descend into chaos, it’s up to a group of teens–including the sole survivor of the murder/suicides–to figure out exactly what is happening to their town.
Bone Gap by Laura Ruby - Roza was a beautiful outsider who was, against all odds, accepted by a small farming community when she stumbled into town, alone and frightened. The town, then, is devastated when she disappears, none more so than Sean, one of two brothers who had been boarding her. Younger brother Finn claims to have witnessed her abduction, but his lack of helpful evidence has ostracized him even more from the rest of the town, leaving him on his own to put together the clues of what’s happened and why and how to get Roza back. This book is weird and complex and sad and beautiful and magical.
The Forgetting by Sharon Cameron - Every twelve years, the city of Canaan descends into chaos, because every twelve years everyone’s memories are wiped completely clean. You remember nothing–your parents, your children, your spouse–unless it is written down. Except for Nadia. Nadia remembers. So it’s up to her to use her memories to solve the mysteries of the city as the next Forgetting approaches, before everything resets again and it’s too late.
AdultLet the Right One In by John Ajvide Lindqvist - Oskar has spent his life being bullied and mocked by his peers, but a new girl has moved in next door, a girl who seems ignorant of most things in the world, but is brilliant. Around the same time, a string of horrific murders start to rock their small town, and Oskar slowly starts to put the pieces together. This is a terrible description of a great book that has SO MUCH happening in it that it’s hard to describe well. I also recommend the original Swedish movie, which is awesome.
It by Stephen King - Yeah, okay, you probably guessed this one, but there are reasons everyone is making the comparison. Just read the first half, and skip the sex stuff.
The Boy Who Drew Monsters by Keith Donohue - After Jack nearly drowns, he begins to refuse to leave the house, staying inside and drawing terrible monsters. It’s three years later and Jack is ten and strange things are starting to happen, things that are connected to his drawings and what happened to him.
Something Wicked This Way Comes by Ray Bradbury - A strange carnival has come to town and it’s pulling in all of the townsfolk, regardless of age, with the ability to grant their true desires. But it’s not that simple, and there’s something dark at work that takes more than it gives. Two thirteen year old boys, Jim and Will, need to overcome their own fears and desires to defeat the evil within the carnival and save the town and themselves.
Meddling Kids by Edgar Cantero - I have to admit, I haven’t read this one yet, though I’ve been on the hold list for an age so hopefully I will soon. But it sounds like it fits–it’s billed as what happens to a group of teens like the Scooby gang twenty years later, when they’re all adults and have mostly left their mystery solving behind. Or mostly left it behind–something about that last mystery is still haunting them and brings them back to their hometown to try and put it to rest once and for all.

10 To Watch : Mayor’s Edition 72919
RICK HORROW’S TOP 10 SPORTS/BIZ/TECH/PHILANTHROPY ISSUES FOR THE WEEK OF JULY 29 : MAYOR’S EDITION
with Jacob Aere
Forbes named the most valuable franchises in sports, led by the Dallas Cowboys, who for the fourth consecutive year landed atop the list. The study values the Cowboys at $5 billion, with the Yankees second on the list at $4.6 billion, and Spain’s Real Madrid in third with a valuation of $4.24 billion. Rounding out the top ten are Barcelona ($4.02 billion), the Knicks ($4 billion), Manchester United ($3.81 billion), the Patriots ($3.8 billion), the Lakers ($3.7 billion), the Golden State Warriors ($3.5 billion), the New York Giants ($3.3 billion), and the Dodgers ($3.3 billion). The NFL dominates the overall list with 26 teams in the top 50. A major contributor was the league’s lucrative media rights deals with CBS, NBC, Fox, ESPN, and DirecTV, which saw each team receive more than $260 million last year. Way behind the NFL was the NBA, which had nine teams on the list. Eight European soccer clubs made the list, as did seven MLB franchises. Cowboys owner and Sport Business Handbook contributor Jerry Jones has been credited with driving up the franchise’s value since purchasing it for $150 million in 1989.
The cost of the Raiders' new Vegas stadium has risen to $1.9 billion. According to the Las Vegas Review-Journal (LVRJ), the Las Vegas Stadium Authority has reportedly approved $40 million worth of additions to the build, including 20 more suites and a field-level club area near the venue’s north end zone. The LVRJ report added that close to $1 billion has so far been spent on the construction of the 65,000-seat stadium. The new venue is expected to be ready for the 2020 season, when the Raiders are scheduled to relocate from Oakland to Las Vegas. The construction project, of which $750 million is being funded by taxpayers, has now passed the halfway stage, with the next major task being the installation of the cable steel roofing system that will support the stadium’s translucent roof. The latest update comes a month after the franchise appointed AEG Facilities to operate the new stadium. Right now, the Raiders are reluctantly in the spotlight as HBO’s “Hard Knocks” documents their every move during NFL preseason camp.
World Cup star Alex Morgan looking to launch female-focused media venture. Morgan, co-captain of the USWNT and World Cup champion, is planning to launch her own media venture focused on storytelling, specifically content for girls created by female athletes. The unnamed project is one of many off-field pursuits for the 30-year-old, recently named one of TIME's 100 most influential people. Morgan has written a series of children’s books about soccer called “The Kicks,” and last year acted in her first movie, a sports comedy called “Alex & Me.” Her sponsors include Nike Inc., Coca-Cola Co., AT&T, and Secret, a deodorant brand owned by Procter & Gamble. Morgan reportedly isn’t planning to launch it in partnership with any major media companies – rather, it’s part of a larger push by women on the team to advocate for gender equality in sports and beyond. “We’re authentic to who we are and what we stand for, and we’re becoming more brave and comfortable in our own skin,” Morgan said. This latest venture shows how the women of the USWNT can continue to use their championship platform to speak up about important issues.
The Oklahoma City Thunder partnered with the Oklahoma City National Memorial and Museum to unveil their new City Edition uniforms, a "charcoal and gold Nike uniform [that] pays respect to those affected" by the 1995 bombing there. The Oklahoman reported that it has "long been a Thunder tradition to bring each player to the memorial when he joins the team," but now the team will "put its own imprint on the museum." The team "plans to underwrite a permanent exhibit that will focus on the 'Oklahoma Standard.'" The "three values associated with that standard -- service, honor and kindness -- are also printed above the City jersey’s tag." In addition, a time stamp "appears under each: 9:01, the minute before the bombing, and 9:03, the minute after." The "survivor tree, a 90-year old elm that withstood the blast, appears on the waist band of the shorts." The Thunder also "pledged to fund free admission to the museum once a month" during 2020. The jerseys – a touching way for basketball fans to honor those lost in the tragedy almost 25 years ago – will be available to purchase at a later date.
Williamson signs landmark deal with Jordan Brands. Pelicans forward Zion Williamson's deal with Jordan Brand is for seven years and $75 million, according to a source cited by Forbes. In DC, The Washington Post notes for "comparison purposes," LeBron James signed a seven-year, $87 million deal with Nike in 2003. Williamson "arrives in the league as arguably the most-hyped prospect since James." Rockets guard Russell Westbrook and Thunder guard Chris Paul "have signature lines with Jordan Brand, but as an ascendant superstar, Williamson can quickly become the face of the brand." ESPN reported Williamson "ultimately turned down a higher offer from Puma" and as much as $15 million annually from Chinese brands Li-Ning and Anta "in order to wear Michael Jordan's brand." Williamson could see also his already impressive social media following expand after signing the Jordan Brand deal. Jordan has 33.1 million total followers, with 55% of those on Instagram. Williamson became a social media juggernaut due to his high school and college exploits, amassing almost four million Instagram followers and 390,000 on Twitter. Clearly, this sneaker lace up is a win-win for Williamson and the Jordan Brand.
Nasdaq makes a bet on sports gambling. The New York-based stock-exchange group announced a deal with UK betting platform Football Index to help build its trading platform using tools similar to those Nasdaq uses on traditional stock exchanges. The four-year-old, privately held Football Index launched a virtual “stock market” in 2014 in which participants buy shares in star players like Lionel Messi or Harry Kane. The site provides a mix of fantasy sports and regular sports betting with elements of stock market speculation. The Football Index deal will be the first in which the Nasdaq brand will be visible to gambling customers. Nasdaq has other sports-betting clients including the Hong Kong Jockey Club, which has a monopoly on the Chinese territoryʼs sports-betting market. It also has an agreement to provide betting technology for the horse racing unit of Australiaʼs Tabcorp, a lottery and gambling giant. In both those cases, Nasdaq has supplied back-end technology but its logo and branding did not appear on any consumer-facing products. Football Index says the ultimate goal is to create “recreational markets for retail traders in something they understand a lot better than” traditional financial instruments, such as currencies.
MLS WORKS showcases the soccer league’s philanthropy during 2019 All-Star Week. According to Orlando City FC, MLS’ philanthropic group is rolling out a slate of community-focused initiatives and events in the Orlando area for the MLS All-Star Game on July 31. MLS will offset a portion of the greenhouse gas emissions associated with All-Star Week festivities by purchasing 2,600 carbon offsets from a clean cookstove project in Africa. Supporting the Orlando City Foundation’s commitment to urban agriculture, MLS will invest in a community garden as part of the MLS WORKS + Target All-Star Community Day. And in partnership with Fleet Farming and their Edible Landscape service, a garden will be installed at Neptune Middle School. MLS will also provide funding for South Street Urban Farm’s education program in the Parramore area of downtown Orlando. The charity arm of MLS will also team up to combat hunger and support the Special Olympics as the MLS All-Stars take on La Liga’s Atletico Madrid.
Wasserman Media Group launches The Collective with $1 million for women in sports. According to Philanthropy Women, Wasserman unveiled its new program July 13 and the Collective will offer resources for female-focused initiatives, utilizing the full reach of Wasserman entities to support business and client campaigns. Among the Foundation’s grant recipients are Women in Sports and Events (WISE) and the City of Los Angeles’s Evolve Entertainment Fund. Currently, Wasserman represents 56% of the U.S. Women’s National Soccer Team, 26 WNBA players, and “a number of women Olympians who have won a total of 37 gold medals since 2010.” Representing some of the top women in sports such as Megan Rapinoe, Abby Wambach, Mia Hamm, and Katie Ledecky, Wasserman Media Group has furthered its commitment to increasing the prominence of top female athletes.
Kevin Durant helps to send kids from Prince George, Maryland to college. The newly-signed Brooklyn Net has opened the Durant Center, an educational facility in his hometown. According to BET, the Kevin Durant Charity Foundation has committed $10 million over the next decade in a partnership with Prince George’s County Public Schools and College Track to help minority low-income high school students earn a college degree. The Durant Center is the first College Track center on the East Coast, with the inaugural class of the Prince George’s county program totaling 69 students of color. Enrolled students attend the center after school for tutoring and advising where they are taught life skills, including time and stress management. Last year, Durant donated $3 million to University of Texas Austin, in addition to supporting organizations like the Tulsa Dream Center, Larkin Street Youth Services, and Black Girls Code in San Francisco, and was named ESPN’s 2018 Humanitarian of the Year. This only builds on his philanthropy track record.
The Tom Hatcher charity golf tournament raises nearly $100,000. Six years ago, Tom Hatcher had no idea what he was starting when he decided to organize a charity golf tournament. According to The Daily Times, Hatcher is the circuit court clerk for Blount County, Tennessee and was moved to action by his father, who was in the midst of a five-year battle with Alzheimer’s disease. At this year’s tournament, more than 300 golfers competed for two causes close to Hatcher’s heart. The sixth-annual event raised roughly $100,000, which will be split up and donated to Alzheimer’s Tennessee, Inc. and the Blount County Boys & Girls Club. The total donations have increased every year, with Hatcher’s inaugural tournament raising $23,000 in 2014. This one’s total bested last year’s by roughly $20,000. By mixing politics, sports, and charity, Hatcher continues to see growing success in raising funds and awareness for the Boys & Girls club as well as Alzheimer’s Tennessee.

* Regarding the nomination of Patrick Bumatay to the Ninth Circuit, “Why are Democrats fighting the judicial nomination of a qualified gay minority?” Good question! [The Federalist]
* Speaking of highly qualified minority nominees under attack, Carrie Severino argues that it’s the critics of D.C. Circuit nominee Neomi Rao, not Rao herself, who are being inflammatory. [National Review]
* And KC Johnson, reviewing the collegiate writings by Rao that have generated the attacks against her, argues that Rao’s views on campus sexual assault — from 25 years ago, so who knows whether or not she still holds them — are “align[ed] both with statute and today’s mainstream opinion.” [City Journal]
* Litigation over a watchdog commission for handling complaints of prosecutorial misconduct in New York State involves a lot of legal luminaries, including Jim Walden and Jacob Gardener of Walden Macht, Jim McGuire and Daniel Sullivan of Holwell Shuster & Goldberg, and Andrew Rossman, Kathleen Sullivan, and Alex Spiro of Quinn Emanuel. [New York Law Journal]
* Could Nick Sandmann and the Covington boys file libel lawsuits over some of the commentary on their controversy? It could be an uphill climb, according to Eugene Volokh (a First Amendment expert, and hardly anyone’s idea of a leftist). [Reason / Volokh Conspiracy]
* But if Covington cases do get filed, they could give rise to some interesting issues of civil procedure, as Howard Wasserman notes. [PrawfsBlawg]

'Piercing': How to Cultivate Tone and Style in Your Film
Tumblr media
Gather together your influences in order to create something all your own.
It’s no secret that filmmakers copy those other filmmakers in their lives who most inspire them. Whether that’s picking up on some sort of trademark dialogue, production design, pacing, music, performances, editing, or camerawork, many times it's easy to identify and trace a piece of style one director drew influence in from another.
With two wildly different, yet eerily similar films under his belt, Nicolas Pesce is mastering the art of adapting his favorite filmmaker’s techniques in a way that serves his own form of storytelling. He describes his first film  as his tribute to 50’s/60’s black and white horror, while he claims his newest project, the stylistically impressive thriller Piercing, is his take on the Giallo crime pictures which peaked in popularity in Italy during the 1970’s.
That’s not to say his films are a direct emulation of those pieces that he so dearly loves. As his actor Christopher Abbott puts it, filmmaking is all about “gathering influences to create something of your own.” Clearly, Pesce is a filmmaker who is not only interested in taking risks, but in creating and pushing style as well.
Tumblr media
"Piercing" Credit: Borderline Presents
Piercing is indeed one of those risky pictures. Abbott plays a man with, well, psychological problems. One night he kisses his wife and baby goodbye, seemingly on his way to a business conference. His real plan, however, is to check into a hotel, call an escort service, and kill an unsuspecting prostitute. That prostitute is played by Mia Wasikowska who ends up providing her captor with a little bit more trouble than he initially imagined.
I sat down with Pesce, Abbot, and their producer Jacob Wasserman back at Sundance to discuss, cultivating tone and style in your picture, maintaining your vision through intensely detailed pre-production and how to create screenplays that will attract both actors and producers to your project.

May/June Books
When I was younger, I used to love reading. Every summer, I would go to the library and take out 10 books at a time. I would read all of them, and then go back to the library to get more. I know this sounds corny, but I loved how reading could take me away from my real life and transport me into another world completely. When I read, I didn’t think about all of the problems in my life.
As I got older, I lost my love for reading. I’m not sure what happened. I guess lost my love for a lot of things. Up until recently, it was even difficult for me to finish one book a year.
Quarantine has allowed me to actually pick up reading again. This past month I have read a total of 6 books and I have thoroughly enjoyed each of them. If you need some inspiration for your next book, here are the ones I read:
“Defending Jacob” by William Landay
“Girls on Fire” by Robin Wasserman
“A Monster Calls” by Patrick Ness
“When We Believed in Mermaids” by Barbara O’Neal
“Where the Forest Meets the Stars” by Glendy Vanderah
“Everywhere You Don’t Belong” by Gabriel Bump

Tuesday round-up
On this second day of this unusual May session, the justices will hear – literally, only hear – oral argument in USAID v. Alliance for Open Society International, a First Amendment challenge to the enforcement against overseas groups of a requirement that recipients of federal funds to fight HIV/AIDS abroad have a policy opposing prostitution and sex trafficking. Amy Howe had this blog’s preview, which first appeared at Howe on the Court. Kayla Anderson and Prachee Sawant preview the case for Cornell Law School’s Legal Information Institute. At Constitution Daily, Marcia Coyle reports that this case and with one scheduled for argument tomorrow “are sequels to earlier cases that [the Supreme Court] decided[:] In the middle of a pandemic which is triggering new legal and constitutional questions, … the culture wars go on and on.”
Yesterday the justices heard argument remotely, with live audio, in U.S. Patent and Trademark Office v. Booking.com, which asks whether the addition of “.com” to a generic term creates a protectable trademark, for this blog. Mark Walsh has a “view” from the virtual courtroom for this blog. Jacob Baldinger discusses the issues in the case at Subscript Law, which also provides a graphic explainer. Nina Totenberg covers the argument for NPR. For The Washington Post (subscription required), Robert Barnes reports that “[t]he Supreme Court’s historic first teleconference oral argument went off relatively smoothly …, and its orderly round of questioning by the justices was enough to entice Justice Clarence Thomas, who usually asks no questions at hearings.” Tyler Olson and Bill Mears report at Fox News that it was “just [Thomas’] third time speaking during the sessions in over a decade.” At USA Today, Richard Wolf reports that the argument “was a good test run for the court, which will hear nine more cases by phone over the next nine days.” Additional coverage comes from Kevin Daley at The Washington Free Beacon and Jess Bravin for The Wall Street Journal (subscription required).
At Slate, Dahlia Lithwick and Mark Joseph Stern write that “[a]s oral arguments go, Booking.com was an object lesson in the fact that some of the court’s long-cherished preferences and rules are archaic and self-protective and probably silly.” Additional commentary comes from Howard Wasserman at PrawfsBlawg, who remarks that “[t]he big difference” from in-person arguments “is that the Justices were less the stars,” Josh Blackman at Reason’s Volokh Conspiracy blog (via How Appealing), Elie Mystal at The Nation, and the editorial board of The Wall Street Journal, which observes that the unprecedented teleconference format offered “a great chance for the public to witness the thoughtful Justice Thomas in action, so unlike the negative caricatures of him.”
The justices also added two cases yesterday to their merits docket for next term. In Edwards v. Vannoy, they will decide whether their recent ruling in Ramos v. Louisiana, holding that a unanimous jury is required in state criminal trials, applies retroactively to cases on federal collateral review. And in CIC Services v. IRS, they will consider whether the Anti-Injunction Act’s ban on lawsuits to stop assessment of taxes also bars challenges to IRS reporting and information-gathering mandates. Amy Howe covers the order list for this blog, in a post that first appeared at Howe on the Court. Greg Stohr reports at Bloomberg that in CIS Services, the court “agreed to review a ruling that critics say would give the Treasury Department and Internal Revenue Service a sweeping shield from challenges to their regulations.” At Crime & Consequences, Kent Scheidegger “do[es] not see any plausible argument for retroactivity” in Edwards “[u]nder existing precedent.”
Briefly:
For The Wall Street Journal, Jess Bravin and Sadie Gurman report that “[o]lder inmates in a Texas prison asked the Supreme Court on Monday to reinstate protective measures against the coronavirus that have been blocked at the state’s request by a federal appeals court in New Orleans.”
At this blog, in a post originally published at Howe on the Court, Amy Howe discusses the results of a SCOTUSblog project that “tracked the distribution of tickets to the public line for every in-person argument session this term”; she concludes that the data helps “to demonstrate the immense public interest in the court’s oral arguments – and how the system in place this term often fell short of meeting that interest.”
In an op-ed for the Chicago Daily Law Bulletin, Daniel Cotter runs down recent developments at the Supreme Court.
At Slate, David Gans argues that “[t]he sweeping arguments for a total religious exemption” in Little Sisters of the Poor Saints Peter and Paul Home v. Pennsylvania, a challenge to the government’s expansion of the “conscience exemption” to the Affordable Care Act’s birth-control mandate, “are profoundly inconsistent with the history of religious accommodation in this country and the backdrop against which the Framers crafted the First Amendment.”
At Vox, Ian Millhiser writes that the stakes in Our Lady of Guadalupe School v. Morrissey-Berru, in which the court will consider the scope of the “ministerial exception” to federal employment discrimination laws, “are profound[:] If an employee is classified as a ‘minister,’ they effectively lose their rights to be free from discrimination in the workplace.”
We rely on our readers to send us links for our round-up. If you have or know of a recent (published in the last two or three days) article, post, podcast or op-ed relating to the Supreme Court that you’d like us to consider for inclusion in the round-up, please send it to roundup [at] scotusblog.com. Thank you!

10 To Watch : Mayors Edition 5719
10 TO WATCH : RICK HORROW’S TOP SPORTS/BIZ/TECH/PHILANTHROPY ISSUES FOR THE WEEK OF MAY 6 : MAYORS EDITION
With Jacob Aere
We kick off our week at Drexel University. Drexel2020: The Evolving Sports Business Market will be held in Philadelphia the morning of May 6, and presents a rare opportunity to hear directly from movers and shakers in the sports world and gain access to their personal insights. Our signature new book, The Sport Business Handbook, recognizes the last 50 years as the formative period for the modern era of sports business. The Drexel University panel will explore its most influential moments. Most importantly, a vision for the future will emerge, with valuable perspective offered from the very individuals shaping that future. I look forward to moderating the panel, which features sports business leaders Jon Butler of Pop Warner, Tony Ponturo of Turnkey Sports and formerly Anheuser-Busch, and Nick Sakiewicz of the National Lacrosse League. The event is free and open to students, members of the sports business community, and others looking to learn more about the ins and outs of our high-profile industry.
Tiger Woods will receive his Presidential Medal of Freedom on Monday. According to the New York Times, the Presidential Medal of Freedom is the nation’s highest civilian honor. First awarded in 1963, it has honored achievements in fields including acting, architecture, art, economics, law, medicine, music, journalism, and politics. Among the two dozen sports figures who have been honored are Jesse Owens, Ted Williams, Muhammad Ali, and Michael Jordan. In golf, President George W. Bush honored Jack Nicklaus and Arnold Palmer, while President Obama recognized the pioneering player Charlie Sifford. In his time in office, President Trump has honored Babe Ruth posthumously, as well as quarterback Roger Staubach. Woods’ award comes at a time when many athletes have shown a reluctance to be honored by the Trump administration. The Golden State Warriors declined a White House visit after their championship, as did the NCAA Champion University of Virginia men’s basketball team. The champion Baylor women’s basketball team attended a White House ceremony last Monday.
The U.S. government has placed Saudi Arabia on its Priority Watch List amid ongoing pressure from several national sports bodies and international broadcasters to bring down the pirate broadcaster BeoutQ. The Office of the U.S. Trade Representative (USTR) has released two reports condemning the Saudi-based piracy operation and calling out the country for its failure to protect intellectual property. Saudi officials have confirmed the illegal nature of BeoutQ’s activities and claim to be addressing this issue by seizing BeoutQ set-top boxes. But such devices nevertheless continue to be widely available and are generally unregulated in Saudi Arabia. Saudi Arabia is included in the USTR’s "2019 Special 301 Report" that identifies governments that fail to protect and enforce intellectual property around the world. The U.S. government intervention arrives in conjunction with calls made by the U.K. government to investigate widespread piracy of live sports content in Saudi Arabia. The pirate broadcaster is also subject of a $1 billion international investment arbitration BeIN Sports brought against Saudi Arabia last October.
Fenway Park will host its own college football bowl game starting in 2020. Fenway Park will host a new bowl game starting in 2020 featuring teams from the ACC and AAC, according to sources. The ballpark will join venues in Los Angeles and Myrtle Beach as "sites for new bowl games" in 2020, which "marks the start of the NCAA's new bowl cycle." A record 43 bowls will be played that season. Fenway will become the third Major League Baseball venue to host a bowl game, "joining the Pinstripe Bowl at Yankee Stadium and the Cheez-It Bowl" at Chase Field. AT&T Park in San Francisco previously held bowl games under multiple naming rights partners, but the short-lived tradition was discontinued after low attendance year after year. Just as the NFL has stretched its brand marketing to become a 12-month sport, so too is college football looking to retain fan interest year round by extending its post season and timing intriguing announcements – like a bowl game underneath the Green Monster – to the post NFL Draft college football news cycle.
Women’s hockey players lay down their sticks in search of a better deal. Over 200 women’s hockey players, with names that include Team USA stars Hilary Knight and Kendall Coyne Schofield, announced that they refuse to play in a North American professional hockey league next season, noting in a statement that "We cannot make a sustainable living playing in the current state of the professional game. Having no health insurance and making as low as two thousand dollars a season means players can't adequately train and prepare to play at the highest level." Last Wednesday, the Canadian Women's Hockey League officially discontinued its operations, citing an economically unstable business model, leaving the National Women’s Hockey League the sole remaining professional league in North America. Some players noted that they hope the NHL will support a women's league via financial and infrastructural resources, according to ESPN. In contrast, on the men's side, the top ten players of the 2018-2019 season each brought home multi-million dollar paychecks from the NHL, with lucrative endorsement deals to boot.
CBD is building a perfectly legal presence in pro sports. Hemp supplement company cbdMD is sponsoring golfer Bubba Watson in a multiyear deal that kicks off with the PGA Championship at Bethpage Black later this month. Watson will feature the cbdMD logo on both sides of his headwear at all PGA Tour events. The deal includes a wide range of other integrated marketing opportunities to promote the brand. Meanwhile, another hemp company, diemCBD, has partnered with marketing company Swag'r to launch an augmented reality game for attendees of the NASCAR Coca-Cola 600 on May 26 at Charlotte Motor Speedway. Users can download the app, which is modeled on "Pokemon Go," to collect diemCBD tokens while exploring the Monster Energy NASCAR Cup Series event, leading them to coupons, free products, and more. From sports wagering to CBD usage and brand-building among athletes, we are certainly currently living in an era of relaxed rules considering where sports was merely months ago. As always, money talks.
Youth baseball gets a boost from Stadium and Adidas. Stadium inked an exclusive partnership with the 2019 Cal Ripken Major/70 World Series, a tournament of champions for players aged 12 and under. Stadium will air thirty-four live games over eight days, including the International Championship, U.S. Championship, and World Championship on August 10. Similarly, Little League Baseball and Softball inked a multi-year partnership with Adidas that will see the brand become the official uniform, footwear, and coaches apparel supplier for the Little League World Series and a Little League Official Sponsor. Beginning this season, Adidas will design and create all official on-field uniforms for all seven total Little League World Series events throughout the United States. Additionally, Adidas will outfit all teams with cleats, training apparel, and accessories, and all coaches will be supplied with athletic footwear and apparel. To kick off the partnership’s first season, Adidas will design brand and marketing activations at both the Little League Baseball World Series in Williamsport, Pennsylvania and the Little League Softball World Series in Portland, Oregon. Right before school resumes in August, our attention will be riveted on school-age bats and gloves at their annual peak.
NASCAR has a plan to boost attendance and ratings: betting on races. NASCAR has signed an exclusive data partnership with Genius Sports, a deal they believe will lead to an in-race betting product and help battle slumping attendance and TV ratings. According to Hashtag Sports, currently, bets on NASCAR races are few and far between at U.S. sports books, who often only have head-to-head options or odds on the race winner. Genius will use up-to-the-second data points like car speed and track position to build a betting product that the London-based company can sell to sports books. Exclusive access to the data will allow Genius to create a betting platform that provides traditional wagers—like who will win—and prop bets such as the number of lead changes or whether a Chevy will end up in victory lane. Sports leagues and teams typically see increased engagement when live betting is offered. Not only does it attract new fans, but live betting keeps them engaged for longer periods of time. NASCAR is hoping for the same response as support for the racing circuit both in-person and on TV declines.
LA 2028 has released its first budget for the 2028 Summer Olympic Games, a $6.88 billion spending plan that includes a $616 million contingency for overruns. The top line is 29% higher than a $5.33 billion budget released in 2017, which has been the most commonly cited price for the Games. However, that figure was calculated in 2016 dollars, and was designed for a 2024 Games. The new 2028 budget reflects the longer lead-time Los Angeles agreed to when it accepted the 2028 hosting duties and ceded the race for 2024 to Paris. More importantly, it is calculated in “real money” terms, adjusted for inflation based on when each dollar will actually be raised and spent. According to LA 2028 Chair Casey Wasserman, the much-discussed $2.5 billion domestic sponsorship revenue goal was already inflation-adjusted and does not change. The new number also includes $200 million in additional IOC funding promised as part of the deal L.A. accepted in exchange for being awarded the 2028 Games. Most of that $200 million will be spent on funding youth sports programs in L.A. and committee operations for an additional four years.
Disney has reached a handshake agreement to sell its share of its regional sports networks to the Sinclair Broadcast Group. After out bidding opponents, Sinclair Broadcast Group scooped up Disney’s remaining 21 networks, which are roughly worth $10 billion. If the sale goes through, this would solve Disney’s sports media monopolization puzzle after the U.S. Department of Justice informed the company it would have to divest RSNs that ESPN acquired last June. According to SportsPro, a majority stake in the YES Network – Fox’s premier sports network partially owned by the New York Yankees – has reportedly already been acquired by Amazon and Sinclair in a $3.5 billion deal. Among Sinclair’s closest rivals for the majority of the RSNs: Major League Baseball reportedly teamed up with Formula One owner Liberty Media earlier this month during the final round of bidding. With Disney having to divest some of its properties, Sinclair Broadcast Group has transformed into another sports broadcast behemoth that may have a tech advantage thanks to its partnership with Amazon.
