..."Early disclosure could also provide prosecutors with a strategic advantage. If Trump opts for the advice of counsel defense, he would waive his attorney-client privilege, requiring him to share all “communications or evidence” related to his defense team, including potentially privileged information that could weaken his position.
“Knowing this will enable the prosecutors to prepare to counter that defense through witnesses and arguments showing the weakness of that defense, and indeed, that such defense is completely untenable given Trump’s statements and actions that show he himself made all the critical decisions relating to subverting the 2020 election results,” Bennett Gershman, a former New York prosecutor and law professor at Pace University, told Salon.
The prosecutors have proof that Trump’s lawyers, especially White House counsel Pat Cipollone, gave him advice which he disregarded, he explained.
“By raising such a defense, Trump will automatically forfeit any reliance on the attorney-client privilege, thereby freeing lawyers and other persons to testify about conversations with Trump,” Gershman said.
But it’s “questionable” whether Trump could even assert the advice of counsel defense unless he testified, Stephen Gillers, a professor of legal ethics at New York University School of Law, told Salon.
“The defense depends on the claim that lawyers assured Trump that his contract was lawful, so that even if the lawyers were wrong, Trump lacked criminal intent because he relied on the advice,” Gillers said. “But I don’t see how Trump can create that defense, unless he testifies to his reliance on the advice of counsel, and we doubt very much that Trump will ever testify in any of his criminal cases.”
Lawyers have played a central role in the election interference case since prosecutors initiated grand jury subpoenas in spring of 2022, The Times reported. These subpoenas primarily targeted lawyers like John Eastman and Kenneth Chesebro, who joined Trump's inner circle during the election and played a pivotal role in guiding him on the "fake elector" scheme, that declared him the winner in key swing states that had actually been won by his opponent, Joe Biden.
The subpoenas also sought information about other lawyers, including Jenna Ellis and Rudy Giuliani, who were involved in advising Trump on the false elector plan and also promoting baseless claims of widespread election fraud.
“Conceivably, the judge may allow lawyers who allegedly gave Trump advice that his conduct was lawful would be sufficient to create the defense, if believed, even without Trump’s testimony,” Gillers said. “But I doubt it. Trump will have to say that he relied on the advice of counsel in order to create the defense and to get a jury instruction on it.”

LUCY AND THE GOLD RUSH
S1;E13 ~ December 30, 1968
Directed by Jack Donohue ~ Written by Howard Harris and Ben Gershman
Synopsis
When Kim and Craig dig up rock specimens for a school Geology project, one of them turns out to be gold. This inspires Lucy and Harry to go prospecting to make their fortune.
Regular Cast
Lucille Ball (Lucy Carter), Gale Gordon (Harrison Otis Carter), Lucie Arnaz (Kim Carter), Desi Arnaz Jr. (Craig Carter)
Guest Cast
Rhodes Reason (Jeff Simpson) appeared on “Lucy and Carol Burnett: Part One” (TLS S6;E14) and here marks the second of his five episodes of “Here's Lucy” having just been seen in the previous episode, “Lucy, the Matchmaker” (S1;E12). He also appeared with Lucille Ball in the 1974 TV movie Happy Anniversary and Goodbye.
Philip Bruns (J. Calvin Coolidge Tompkins) is probably best remembered as Mary Hartman's dad George on “Mary Hartman, Mary Hartman” (1976-77). This is his only appearance opposite Lucille Ball.
This is the final episode of the 1968 calendar year; a year that saw the end of “The Lucy Show,” the birth of “Here's Lucy,” and the first full year of Paramount owning the former Desilu Studios.
There was no new episode on Monday, December 23rd although CBS did air new episodes of “Gunsmoke,” “Family Affair,” and “Mayberry R.F.D.” that evening. Instead, they reran the first episode of the season / series “Mod, Mod Lucy” (S1;E1).
This is the only collaboration between writers Howard Harris and Ben Gershman and also their only time writing for Lucille Ball.
For the first time on “Here's Lucy,” we hear Gale Gordon's unusual pronunciation of “Los Angeles” using a hard 'g'.
Harry wants to dictate a letter to Consolidated Machinery (before a rock falls on his foot and Lucy runs out of steno pads).
Harry says the gold in their rock could be worth as much as $14 a ton! Unfortunately, they later find out it will cost $35 a ton to mine it!
Jeff Simpson says he is staying at the Explorer's Club. This may be a nod to Los Angeles's famous Adventurers' Club, a private male-only organization formed in 1922.
Under pressure from Uncle Harry, Lucie finally remembers where they found the gold rock: they took the freeway to the Calabasas turnoff, took the Old Tapanga Canyon Road, and walked 3 miles.
Lucy references the Grand Canyon while digging for gold. Although the Ricardos and the Mertzes all wanted to see the Grand Canyon on their road trip to California, no episode was devoted to it.
J.C.C. Tompkins is named for President Calvin Coolidge who was inaugurated in 1925, the same year the silent movie The Gold Rush premiered starring Charlie Chaplin.
Calvin Coolidge spent the summer of 1927 in the Black Hills, South Dakota and was photographed panning for gold with his wife.
After selling his land to Harry for $1,000, J.C.C. Tompkins goes off singing “I'm in the money!” The song “We're in the Money” (aka "The Gold Diggers' Song") is from the 1933 film Gold Diggers of 1933 and was written by Al Dubin and Harry Warren. It is now part of the stage musical 42nd Street.
This episode allows Gale Gordon to do much of the physical humor normally done by Lucille Ball. He barricades himself in his office with a Rube Goldberg-like method and then tries to break open the gold rock, unsuccessfully but humorously. At the end of the episode, he falls down a mine shaft.
This episode was loosely remade in season 6 as “Harry Catches Gold Fever” (S6;E12). In that episode, Kim and Craig are not present and Harry pans for gold rather than mines for it.
Lucy Ricardo and the gang went prospecting for the 1950's version of gold – uranium - in “Lucy Hunts Uranium,” a 1958 episode of “The Lucy-Desi Comedy Hour” that also starred Fred MacMurray. While that episode was shot on location in the California desert (standing in for Nevada), this one is shot entirely on the soundstage at Paramount.
A Matter of Class! Kim and Craig are in the same Geology class, despite Kim being two years ahead of Craig in school.
Menu Mistakes! When Harry pays a surprise visit with a 14-pound roast turkey (at 29 cents a pound), Lucy says she was having leftovers for dinner, but instantly produces a fancy tray of hors d'oeuvres from the kitchen. She also coincidentally has cranberry sauce already on the table.
Where the Floor Ends! The wide shot reveals where the wall-to-wall carpeting meets the concrete stage floor, a frequent error on all “Lucy” sitcoms.
Hot Set! In that same scene, Gale Gordon is sweating profusely. Despite having a handkerchief in his pocket, the actor resists the temptation to mop his dripping brow. He is also sweating in the gold mining scene. Gordon may have been ill or reacting to the heat in the studio - or both!
“Lucy and the Gold Rush” rates 3 Paper Hearts out of 5
This is a pretty standard Hollywood ‘Gold Rush’ plot (complete with a grizzled old prospector from 1849), but Lucy still manages to find the humor in it.

Yes, the band O.A.R. knows about the Russian Olympics team and they think it's hilarious
Dozens of stars have emerged from the 2018 Winter Olympics, but perhaps the most impressive isn't even an athlete, it's a band.
More than 20 years after coming together to create music, O.A.R. — you know, those guys you spent your middle school/teenage summers listening to — have become unexpectedly and overwhelmingly relevant again.
It all started when a doping scandal got Russia banned from competing as a team in the 2018 games. To participate, 169 Russian athletes decided to compete under the Olympic flag using the team name "Olympic Athletes From Russia,” which, yep you guessed it, is abbreviated "OAR."
Suddenly the three letters once almost exclusively associated with chill AF music were all over uniforms and television screens worldwide. But while everyone was busy trying to find out what the heck OAR meant, Mashable grew concerned with the wellbeing of the real O.A.R. (The band.) Being the kind people that we are, we checked in with lead vocalist and guitarist Marc Roberge to see how he and the boys are handling the new OAR in town.
SEE ALSO: What is Team OAR and why are they in the Olympics?
"When the games started the phone calls started coming in, the emails, the texts — now to the point where every single morning I have a funny run-in with somebody about it," Roberge said. "It’s grown into this thing, but it’s hilarious, it’s awesome and I love it."
Though the band heard rumblings that their name might be jacked for a few weeks they had no idea it would become so widely noticed. Roberge explained his mornings now consist of watching the women's hockey team destroy OAR and getting calls from his friends who poke fun at the team name.
O.A.R <3's the Olympics
One of the reasons band O.A.R. is so cool with Team OAR is because they're huge fans of the Olympics.
"As a group we’re huge sports fans, we've always toured the country and visited a lot of different sports teams," Roberge, who's a huge hockey fan, said. "The Olympics is a huge event. I have memories my whole life watching with my family and now I do it in the mornings with my own kids."
In fact, the band loves the games so much they even performed at the 2015 Special Olympics Opening Ceremony.
vimeo
Sure it sucks to be dealing with this strange identity crisis, but Roberge is doing his best to be a good sport (ha ha) and admitted he loves hearing the color commentator say O.A.R. 30 times a day.
"I’m trying to enjoy it, and we’re athletic by proxy now at this point," he added, joking that the band should update its bios to include Team OAR's Olympic achievements and stats.
The O.G. O.A.R
The Russian athletes have been dominating OAR coverage lately, but Roberge reminded us that the O.G. O.A.R. stands for "Of A Revolution" and only has five members: himself, Benj Gershman, Chris Culos, Richard On, and Jerry Depizzo.
"When we came up with the name we were in the basement of our drummer's house like most bands in high school are," he said, sharing the name came from a story he was writing at the time called "The Wanderer."
O.A.R. the band, not the Olympics team.
Image: Jason Kempin/Getty Images for Stella Artois
"We thought that we were making a new kind of music and we thought it was different," he said. "And people will always wonder what the first word before 'of' is and we’ll always keep that a secret among the band."
The band was originally called "Exposed Youth" in their middle school years, but they wouldn't have made Olympics coverage with that one so good call on the switch.
What to do if you stumbled upon this band for the first time while Googling the Olympics
Maybe you've been living under a rock for the past few decades and had never heard of the band O.A.R. until Googling the Olympics. That's a little embarrassing, but Roberge has got you covered. He thinks potential fans who happen upon O.A.R. in their quest for Olympics knowledge should do the following:
Listen to the band's first recording: "That Was A Crazy Game of Poker"
Listen to their newest single, "Just Like Paradise"
Listen to an old hit like "Shattered," "Peace," or "Heaven"
After this diverse range of songs you will probably know if you're a fan of band O.A.R. or not. But if you're still not sure I personally recommend watching the iconic training scene from the 2006 film, She's The Man. Channing Tatum teaches Amanda Bynes to play soccer as O.A.R.'s "Love and Memories" plays in the background and it's beautiful.
Perfect timing
While the Olympics buzz was unexpected, it really couldn't have come at a better time for the band. "It’s the most coverage we’ve had ever," Roberge quipped, which is ideal considering O.A.R. dropped their new single, "Just Like Paradise," on Monday.
"The song is intended to be an early taste of summer and we really everybody we know needs a little more brightness in their lives," he said. "A lot of crazy stuff’s going on and we just wanted something that would make people happy."
The band also has an upcoming tour planned this summer, so if you're a fan now you can go check that out. Until then, you can catch the other OAR on the Olympics.

Cultural Event Report

Cultural Event Report
April 26, 2017
The event that I chose to attend was Gay BINGO on Saturday, April 22 at the Gershman Y in center city Philadelphia. This event was hosted by AIDS Fund Philly with the goal of raising money for individuals who are HIV positive as well as local organizations that provide services. The money raised helps these individuals in emergency financial situations. Gay BINGO is held once a month in the auditorium at the Gershman Y. The structure of this event is very laid back and is hosted by drag queens who open the event with an entertaining performance. The participants were very diverse as well, including straight and gay couples and single individuals all coming together for this great cause. The fun twist on this event involved activities such as couples charades that consisted of a straight couple, gay couple, lesbian couple, and a “Will and Grace” couple. This activity was very entertaining and engaged all members of the audience. This event on the AIDS Fund’s website describes Gay BINGO as irreverent, fabulous, campy, and wildly popular.
In Jack Babuscio’s article, “Camp and the Gay Sensibility,” ‘camp’ is a term that describes elements in a person, situation, or activity which express, or are created by, a gay sensibility. Gay sensibility is defined as a creative energy that reflects a consciousness that is different from the mainstream; a heightened awareness of certain human complications of feeling that spring from the fact of social oppression (Babuscio, 2004). The four features of camp discussed in this article include irony, aestheticism, theatricality, and humor. Some of these features of camp were definitely portrayed at Gay BINGO. The drag queens opened the event with a theatrical performance in congruence with their theme of the night. During the games they walked around the audience selling special games in different outfit or costume changes every couple of games played. Another feature of camp that was definitely portrayed throughout the event was humor. Each game was sponsored by different agencies that support Gay BINGO and supported the cause and hosted a game for advertisement. One of the sponsors was Philly AIDS Thrift store in South Philadelphia, whose all proceeds actually all go to the AIDS Fund as well. It was interesting and inspiring to see these different agencies getting involved in the community for a great cause. When these agencies were on stage the host and the agency representative usually made conversation, jokes, and comic relief between announcing the bingo numbers. The host and the agency representatives were also very engaged with the audience and made jokes with them as well. Many of the jokes were immature and inappropriate, but this audience and area were as if they were a safe space for any kind of open humor.
Moe Meyer’s article, “Reclaiming the Disclosure of Camp,” discusses the ‘queer’ label and how it has evolved over the years. Meyer describes queer as “a concept of self performative, improvisational, discontinuous, and processually constituted by repetitive and stylized acts” (Meyers, 2004). This description of queer also describes some of the tone and activity that was portrayed throughout the event. This was the host’s tone and style to keep an upbeat, fun, and engaging experience.
As this event was very laid back, funny, lighthearted, and inappropriately silly, it was also very serious at times. The host and other performers were very passionate about the cause of this event and had the audience take a pledge to continue to participate in Gay BINGO until there is a cure for HIV/AIDS and to put an end to this awful epidemic in our world today. The host and other performers were very grateful for the large turn out in the audience and that really showed throughout the event how the performers and host treated the guests. Their passion was inspiring and contagious because many of the guests in the audience participated in many of the regular cues during the Gay BINGO game, such as certain actions, reactions, and dances when certain numbers were called throughout the games. This showed that many of these guests were regular goers to Gay BINGO. Many of these regulars dressed in costume for the theme and went all out supporting that month’s theme. It was a very welcoming community of all individuals no matter one’s sexuality, gender, race, etc. The host and performers made everyone in the audience feel as though that was where they belonged and that every individual was a meaningful and valuable participant. Overall, I think that this community’s passion to raise money and awareness and education for the AIDS Fund and help those who are in need who are HIV positive is an incredible thing. This is most definitely a positive and engaging way to put communities like this in the media and in events that are benefitting those individuals in need in the most fun and entertaining way.
