Supposedly this won't affect Pell Grants, food stamps, and similar things. But I also wouldn't be surprised if it did. But given Trump's track record and the cutting of SNAP benefits (because fuck people trying to eat I guess), the current issues with Medicaid portal access, and *gestures to everything else*.

However, the funding freeze could affect trillions of dollars, at least temporarily, and cause widespread disruption in health care research, education programs and other initiatives. More to the point, the rate is way lower than you’d expect given the massive fiscal stimulus policymakers have been pumping into the economy. We were told that the GOP’s corporate tax cuts alone would permanently turbocharge growth to at least 3 percent.

Instead, Trump spent $2 trillion in deficit-financed tax cuts for the rich to get us basically the same growth rate we had before he took office.

The mechanism by which Trump’s signature legislative achievement was supposed to turbocharge growth, according to the tax cut’s advocates, was by stimulating business investment. Instead, business investment fell last quarter, in the second consecutive quarter of contraction.

We have answers to the question "How do we pay for Medicare 4 All?" Some of them quite detailed. No one has managed to come up with an answer to "How do we afford not having it?" We as a nation literally cannot pay for healthcare. This is a huge ongoing crisis. The closest we can come to answering it is to pretend that, well, the fallout of individuals not being able to afford healthcare is limited to those individuals. This is a lie. It costs everyone. It drags the precious economy down. The person who goes bankrupt because of medical expenses and loses their house... that's a blow to the neighborhood they lived in. A bank has replaced a profitable asset (a mortgage) with a depreciating asset (an empty house). The family struggling to pay for healthcare is paying money into a system that doesn't actually produce anything except profit for the top. Take away that struggle, they are doing business with their neighbors. Ordering products. Buying services. Creating jobs! Defaulted medical bills (including from those much-exaggerated can't-refuse-anybody free ER visits that the right likes to pretend is the same as free healthcare) get passed onto everybody else, meaning we're already "socializing" costs, but inefficiently. ERs don't do routine preventative and diagnostic services or non-emergency treatment of chronic conditions, which means by the time someone winds up in an ER, the care they need is 1) more expensive and 2) less effective. 

All of this is a huge drain on the stuff that the people gibbering about the terrible specter of socialism actually do care about: productivity! Consumer confidence! The freedom of the marketplace! Socialize the medical system and we will be paying less money for better outcomes. We're already spending more money on healthcare, collectively, than it would take to treat everyone for real. And for all that money, we get the worst healthcare in the so-called developed world. If we could be getting more while paying less, THE INVISIBLE HAND OF THE FREE MARKET demands that's what we do. Market economics dictates that we adopt socialized medicine. Anybody who disagrees doesn't actually care about what they're telling you they care about. "But people will have to wait for treatment!" They do already, sometimes until they die. "But there will be rationing." There already is rationing and it's killing people. "But the government will decide what treatment you get." Less so than for-profit insurance companies do now. Universal healthcare, free at point of service, paid for by public money, is the best deal we could take. We would pay less and get more. And it would make the "free market" freer by removing artificial constraints on things like job mobility. "Private industry is more efficient than the government." Efficient at what? For insurance companies, it's making money. This efficiency comes in the form of them taking more profit by charging more and providing less.

It's efficient *against us*.

Of course, replacing most of the concept of health insurance with a public institution will displace some jobs, and we should take care of the people affected by that but "socialism" is a better solution than propping up an industry that is robbing and killing us. Our concept of business ethics right now is that the main fiduciary duty of a company is to generate ever-growing profits for its stakeholders. This means a for-profit insurance company is doing wrong when it takes care of us. Its "job" is to take our money and keep it. Any money that an insurance company spends on paying for actual health care is regarded in the business world as a failure, with some failure being inevitable, but regrettable nonetheless. They will take more and give less, if they can get away with it. Now, the ideal of the free market is that if they jerk us around we can take our business elsewhere, but healthcare is so expensive and byzantine that most of us can't afford it, except when subsidized by an employer who has the benefit of negotiating in bulk on our behalf. But this leaves us in a pinch where if our employer isn't great we can't "vote our wallets" by leaving because we need the healthcare and if our healthcare (which we didn't get to pick directly) isn't great we can't "vote our wallets" because we need the paycheck.

In theory an employer offering bad healthcare benefits is a bad employer who should be "corrected" in the market by leaving their employ, but jobs aren't fungible, we can't just leave and go across the street to another employer with the same circumstances but better insurance. This makes the "free market" as it applies to health insurance NOT REALLY VERY FREE AT ALL.

Our nominal power to negotiate and force companies to compete for our business is severely constrained and diluted by circumstances. If a restaurant, movie studio, or video game company wants our business, it has to contend with the fact that we could stay home and feed or entertain ourselves in lots of other ways, on top of there being other restaurants and media companies. But the alternative to healthcare is stay home and administer home remedies and hope you don't die of an infected tooth or hangnail that spreads, or untreated cancer, or whatever. We aren't really "customers" with the same choice. So the fact that the consequences of voting our wallet and staying home means we might die and the fact that our negotiation ability is at a remove through our jobs (which, again, without which we might lose our ability to secure food and shelter and healthcare, and maybe die)... ...means that the vaunted competition that is supposed to make the free market efficient and fair just doesn't happen. It doesn't apply.

We are at the mercy of corporations who, again, are instructed by society that their highest good is separating us from our money. And it doesn't have to be this way! We could eliminate the whole predatory, unnecessary layer that is the for-profit health insurance complex and replace it with a public agency whose highest good is getting the most treatment for the least money. And at that point, multiple massive distortions of the "free market" disappear.

We gain more power to change jobs if another employer is offering us a better deal. Free market competition! Great, right? We've got more money that we can spend on things we want. We don't have people losing cars and houses and apartments and education plans and jobs because they had a medical emergency they couldn't pay for. We eliminate a lot of bankruptcies. Financial planning becomes more predictable. Consumer confidence goes up. Spending goes up.

Every business that is providing something people want benefits from the increased stability! Demand for basically everything rises! Jobs are created! Workers are less stressed and fearful and exhausted and so are working better! Where's the downside for "capitalism"? I'm a fan of the free market. I think customers benefit when companies compete for their money. I think companies benefit when workers compete for their money. But our for-profit healthcare system distorts this whole thing so badly that this is basically not happening now. If you like "capitalism" in the sense of a market-based economy where entities compete to trade what they have for what they want... a little "socialism" around the edges is a good thing, a necessary thing. If we could decouple our thinking in the business world from the current fiduciary duty we choose to imagine businesses owe, then "profit" becomes the reward for doing a good job at whatever the business does, and that's FINE. It's good, it's great, it's the ideal. 

But we can't there as long as we're treating everything as though it's just another fungible option among many where people could freely vote their wallets. We can stay home from the movies if the options stink, go watch a play or a TV show. Can't do that with cancer treatment. Democratic socialism, social democracy... related and overlapping concepts, I'm not actually that interested in wanking over the distinctions. The point is, you can have social features on a market economy. And you can't have a market economy for long without them. In the competition that makes a market economy work, the reward for winning is also the means by which the game is played, which means each round is *less* competitive than the one that came before. Competition is a finite resource, which means it's unsustainable. The more that this competition extends into areas in which negotiation and competition are stifled, the faster the process by which the competition breaks down becomes until the "free market" becomes a fiefdom of company towns. And so the distortion caused by our for-profit healthcare industry is speeding up the demise of the free market. A public option would slow that down. Eliminating health insurance as it exists now and replacing it with some form of single payer system would go much further. 

To make a long story short (TOO LATE!) - we can't afford to keep the health insurance industry around. Can't afford it. How do we pay for it? Nobody has an answer for that. We can figure out how to pay for Medicare 4 All, but not how to pay for health insurance. And while we're figuring out how to pay for healthcare under the private insurance model, we should ask... wait, what are we paying for? Mostly to prop up an industry whose goal is that we should continue paying them to exist. Literally no purpose. They produce nothing.

Democrats criticized the legislation, originally known as the Tax Cuts and Jobs Act of 2017, but officially called An Act to Provide for Reconciliation Pursuant to Titles II and V of the Concurrent Resolution on the Budget for Fiscal Year 2018, but Republicans defended the law as a necessary overhaul to previous tax laws and a means to provide economic relief for the middle class.

The dueling partisan narratives left many taxpayers with a murky understanding of the law’s impact.

To gain a better grasp on the intricacies of the 2017 Act, professors David Kamin, Lily Batchelder, and Daniel Shaviro—tax law experts from the New York University School of Law—cowrote a paper analyzing the sweeping legislation which appears in the Minnesota Law Review.

According to the authors, “Many of the new changes fundamentally undermine the integrity of the tax code and allow well-advised taxpayers to game the new rules through strategic planning.”

Here, the authors describe how some may take advantage of the new system, and how changes to the tax laws may affect the US economy.

‘CRACKING AND PACKING’

David Kamin: One of the largest tax cuts in the legislation goes to “pass-through” businesses—where income is taxed at the level of the owner rather than the business. But, to be eligible for this tax cut, owners need to meet certain very complex criteria.

For those with higher incomes, this includes being in the “right” line of business. That means being an architect (eligible) and not a lawyer (not eligible). Selling skincare products (eligible) but not being a dermatologist (not eligible). The formalistic and largely arbitrary lines then allow for much gaming, including what we—borrowing from the election law context—call “cracking and packing,” pulling apart and combining businesses.

For instance, a dermatologist office might “crack” apart a skincare products business run out of the same office, share overhead expenses, and then try to assign as much of those overhead expenses as possible to the dermatology practice to maximize profits eligible for the deduction. Possibly abusive? Yes, but very hard for the IRS to catch.

Lily Batchelder: The bill creates large incentives for the wealthy to convert their labor income into business income. This was already an issue in the tax code because of the carried interest loophole and loopholes in the payroll tax. But the bill makes a bad situation much, much worse.

If a wealthy individual hires an elite tax advisor to make their labor income look like pass-through business income, they can cut their marginal tax rate by more than 7 percentage points. And if they don’t need to spend the income anytime soon and treat it as corporate income, they can cut their tax rate by 20 percentage points.

Theoretically, middle class families could engage in the same games but they are much less likely to do so for at least three reasons. First, middle class families would receive much smaller tax benefits from such gaming and in many cases, none. Second, they often have little leverage over their employers to restructure their compensation and, even if they did, probably would have to give up all of their employee benefits in exchange. This includes their health insurance, 401(k), and disability insurance. Last, they are less likely to be able to afford a tax advisor with the expertise to structure this kind of arrangement in the first place!

GAMING THE SYSTEM

Daniel Shaviro: One of the many disappointing aspects of the 2017 act was its failure to address the opportunities for sheltering labor income from tax at full individual rates, through use of the corporate tax. Pre-2017, the top corporate rate was far closer to the top individual rate than it is post-2017. The main rationale for the corporate rate reduction pertained to global tax competition for scarce capital. This has no bearing on the case where the owner-employee of a corporation pays herself far less than the market value of her work.

For example, suppose I create a wildly successful new start-up and pay myself zero salary, despite my becoming, in net worth terms, a billionaire via the stock appreciation. The income that my efforts yield will show up in the corporate tax base, and be taxed at only 21 percent. True, I would face a second level of tax on paying myself dividends or selling my stock, but even this would be at a reduced rate. And what’s more, I may not need to make such payments if I am sufficiently financially liquid, e.g., by reason of borrowing against the value of the stock.

Opinions in the “biz” differ on how frequently taxpayers will find it worthwhile to do this, given the difficulty of extracting funds from one’s company tax-free. What is plain, however, is that Congress in 2017 deliberately did nothing to prevent this from happening. Indeed, the final version of the 2017 Act reduced the efficacy of a provision in the House bill that would have slightly addressed the problem by setting the tax rate for “personal service corporations” (PSCs) at 25 percent rather than just 21 percent. In the final act that rate is just 21 percent, like the general corporate rate, causing the PSC rules to be close to meaningless as a defense against using corporations as a tax shelter for labor income.

Shaviro: In the international realm, the 2017 Act may actually have improved the law marginally. At a minimum, it created a new regime that could be tweaked by future Congresses to yield a better system than the previous one. However, the main new international rules that it added to the code unnecessarily created multiple opportunities for game-playing. Just to give some quick examples without getting too deep into the weeds:

The foreign-derived intangible income (FDII) rules, which provide a special deduction for exports by companies, such as Apple and Facebook, that have valuable intellectual property, create incentives for “round-tripping” goods—e.g., selling them to a foreign taxpayer, then buying them back with just enough bells and whistles to prevent the entire transaction from being disregarded.

Both FDII and the global intangible low-taxed income (GILTI) rules can create incentives to locate business assets abroad rather than at home.

The base erosion anti-avoidance tax (BEAT) can be gamed through such means as restructuring supply chains so one is purchasing sale items for customers from one’s foreign affiliates. The BEAT can also be gamed by adding lots of extra deductions (offset by lots of extra income so the sum total is a wash), so that so-called “base erosion tax benefits” will fall below an arbitrary “floor” (as a percentage of total deductions) that the BEAT imposes for no discernible reason.

VIOLATING THE WTO TREATY?

Shaviro: The FDII rules almost certainly violate the World Tax Organization treaty, of which the US is a signatory. They are expressly an export subsidy, and the WTO makes export subsidies illegal. If other treaty signatories challenge the FDII rules, there is a very high probability that they’ll be held illegal, with the consequence that peer countries will be authorized to respond with targeted provisions of their own.

In the last 30 or so years, the US has enacted illegal export subsidy rules on three separate occasions. Each time the rule was held violative and the US backed down. Why do this again? I think the main answer was cynicism, but ironically the prospect of an overturn makes the US companies that wanted favorable tax treatment more leery than they would otherwise have been of setting up complex structures to take maximum advantage of the FDII rules.

‘AN ARRAY OF MISTAKES’

Kamin: The legislation was written at an extremely rapid clip, leaving an array of mistakes—some minor and some large. An early one to emerge was the “grain glitch.” In attempting to apply the pass-through deduction to businesses organized as cooperatives, especially prevalent in agriculture, legislators wrote in an even larger loophole by accident. Effectively, farmers selling to these cooperatives (think Ocean Spray cranberries) could potentially entirely wipe out their tax liability because of the glitch.

This one was large enough—and was causing sufficient chaos in the agricultural sector—that it was fixed. But most haven’t been. So, take another: one of the largest revenue raisers in the legislation was limiting the deductibility of state and local taxes for individuals to $10,000. However, the letter of the law seems to fail to apply that to another form of cooperative, a housing cooperative.

So, owners of pricey cooperatives in NYC may be able to deduct their property taxes without limit; by contrast, owners of traditional condominiums and houses will not. And the list could go on.

MAJOR TAKEAWAYS

Batchelder: The bill is heavily tilted towards the wealthy. According to the official Congressional budget scorekeepers, this year the average millionaire will get a tax cut of more than $27,000 on their personal tax return, compared to a tax cut of $431 for an average middle-class family earning $40,000 to $50,000. Even as a share of their after-tax income, the tax cut for the average millionaire is three times as large.

It is also a very costly bill. The Congressional Budget Office estimates that it will increase our national debt by $1.9 trillion by 2028, even after including its effects on the economy. These large tax cuts will eventually have to be paid for. If Congress pays for them by raising revenues in proportion to income, the vast majority of middle class and low-income families will end up worse off. These families will be hit even harder if the bill is paid for by cuts to programs like Social Security, Medicare, and Medicaid.

Shaviro: It’s often said that tax legislation should be judged by four main criteria: fairness, efficiency, complexity, and revenue adequacy. The 2017 Act, despite having good particular rules here and there, egregiously failed on all four counts.

It was an act of class warfare benefiting those at the top relative to everyone else, for the most part it reduced economic efficiency by creating perverse incentives and arbitrary distinctions between different activities, it made tax planning more complicated for those who can afford sophisticated tax advice, and it will probably lose on the order of $2 trillion of net revenue over 10 years, even if all supposedly expiring provisions are actually allowed to expire.

It was also the sloppiest, most poorly drafted tax legislation that I have ever seen, despite all the talent and effort deployed by hard-pressed staffers, because the process was so secretive and rushed.

WILL MEDICAID PAY FOR YOUR HOME CARE?

The state budget of New York was passed in mid-2020, and there have been specific changes that every resident in the state should be aware of. As of October 1, 2020, the Medicaid program now has a 2 ½ year lookback period.

The lookback period affects older beneficiaries of the program as it does affect eligibility.Those who have qualified will receive Medicaid payments for long-term care at home. These payments are under Community Medicaid. The lookback period was designed to save the state money as it is still under a state of fiscal emergency. To clarify, the Medicare program is for people 65 years old and above and people on disability, as covered by the Social Security System. Medicaid is different. The Medicaid program is delivered jointly by the federal program and the state, so Medicaid benefits and eligibility requirements vary across states.

Despite the budget cuts, Medicaid in NYS remains a reasonably robust and comprehensive benefits package. Medicaid still covers long-term care, prescription drug coverage, dental care, outpatient service, in-patient services, and health providers, too.

Should an individual meet an exception or exclusion, he/she must look for a healthcare provider that accepts Medicaid, as he/she will require medical services via fee-for-services.

Households and individuals must meet eligibility criteria for the Medicaid program, including financial measures, immigration/citizenship criteria, and residency.New Yorkers who are low-income may still qualify under the MAGI eligibility rule. Non-MAGI beneficiaries may still receive benefits like waiver service, community-based long-term care, and institution-based services.

NYS has one of the most generous Medicaid programs in the country, which eventually led to conditions where they had to make budget cuts to the program. Essentially, the Medicaid program costs the NYS too much, so they had to add the lookback period.Consult with an estate planning law firm if you think you may be affected by these changes.

Long post about how to get on disability (SSI or SSDI) in the United States

It just hit me that this information might help a lot of users who might see this post. If you or someone you know is disabled and seeking to apply please feel free to use this information in any way to help them because it is a long complicated process involving multiple steps and details that almost lends itself to being difficult for the person who would most benefit from being approved for financial assistance.

This is not a complete guide. I will try to use basic English vocabulary for this because language barriers make the process even harder.

Differences between SSI and SSDI (both programs are administered by the Social Security Administration in the US):

SSDI stands for Social Security Disability Insurance. You pay payroll taxes in each paycheck, if you are working, to the SSA as part of a retirement fund. The SSDI program is in basic terms early access to the money you have accrued for retirement due to a long-term disability. (It is more complicated than that re: how much you receive on SSDI when compared to what you would receive depending on the age you would have retired, but that’s a detail you can look into). The program has no asset limit. This is important later on. Your eligibility for this program depends on whether you have worked enough in the past decade or throughout your life to earn enough work credits, and the credits are earned at a certain rate per years you have been working. There are other eligibility requirements, such as income, citizenship, and many, many others. Generally, you are eligible for SSDI if you are a citizen, a legal permanent resident who has been an LPR for over 5 years or became an LPR before August 22, 1996, but please check in case this changes by the time you read this.

SSI stands for Supplemental Security Income. It does not require you to have earned work credits or paid through SSA payroll tax. It is based on financial need and it has an asset limit. You may not be eligible for SSI if you became a legal permanent resident after August 22, 1996 but please do your own research and check, because my memory of this detail is not perfect. Disabled children may qualify for assistance through SSI depending on their parents’ income and assets. If you are under 18, your parents apply for you, but they must make a bank account in your name to receive the payments. Once you turn 18 your parents’ income and assets do not count against your receiving benefits even if you live at home. [Link] SSI may often require you, especially if the application is for a child, to attend an appointment [LINK]  in person after completing the application online (which I’ve linked below).

If you are an adult, both of these programs really only care if your condition makes it impossible for you to work full time for a very long time. (However, activities of daily living, like how the disability affects your ability to take care of yourself and family and do chores at home and socialize with the community, are still looked at, and for a child, whether they are on an IEP or a 504 plan at school or whether they have problems behaviorally or physically at school or at home are looked at) I have spoken to people with a lot of very valid medical conditions who need to work full time to feed their kids and being that their working full time would count against their disability--that they need to lose the job first and possibly bring themselves to a dangerous level of poverty to be considered worthy of these benefits--so they cope with the conditions even to a really unhealthy point just because they have to. The long, long process of waiting to hear back doesn’t lend itself to allowing yourself to support yourself while waiting for your payment arrive doesn’t help either. It’s one of the many catch-22s of these types of programs.

Requirements common to both programs:

-Asset limits and income limits change based on how many children a family or married couple has. Remember, SSDI has no asset limit, but SSI does. If you are living with a partner but not married their assets and income are not pooled with yours, which disturbingly enough, works in your favor even if they cover bills or help with stuff or you each own a car. Assets do not include your first home or first car, or the land you live on, however any additional properties you own, or cars you have, or bank accounts in your name or your spouse’s name are measured in value. They will let you count your least valuable car as your second car. If you are applying for SSI and have 2 cars, consider that it may cause a denial if it is over your family’s asset limit. (Asset limit right now is $2000 for an individual and $3000 for a married couple and up to $5000 depending on number of children and please look this up to find current in because they change these. Income limit, which both programs scrutinize, is complex as well and there is more information here but $1180 monthly if you are not blind and $1970 if you are blind. Please double check these figures prior to applying because they change I just wanted to give you some numbers to work with.) Depending on how much you make your benefits can be reduced. And if you think a second car’s a stupid reason to deny someone who has a disability we aren’t even started on the stupid reasons to deny someone unfortunately

(boxes checked to increase your probability of denial for these programs: because you are under 55, because you have graduated high school or have some further education, because while your disability may prevent you from doing the job you were doing before but not others they’ve found for you even if you are unable to commute to those jobs or cannot find those jobs  or won’t be hired for them as long as they exist in some capacity in the United States they will treat you as someone who can still do that job, because your disability is deemed not severe enough yet because it needs to either be expected to end in your death or last over a year to be considered long term enough, because you are able to work part time and your benefits are reduced due to you already making a bit of money, because you use one cane instead of a walker, because your condition is not affecting you every hour of every day, because you are able to walk up and down stairs without a stairlift even if it takes you a long time or is painful, because you only saw the PCP and no specialists for your condition even though how are you supposed to go to a lot of appointments if the point is your disability makes it difficult for you to go places, because the doctor you saw didn’t see something or inconclusively mentioned the condition in your medical record and there wasn’t additional testing ordered...there are more, this paragraph is just becoming too much of a wall of text even for me)

(on the flipside, terminal illnesses, including HIV and cancer, depending on the stage, often qualify for the “compassionate allowance”, which rushes your application through an approval and gets you receiving benefits early. I’m just going to include a link HERE on that because my brain would melt explaining it)

Please note that every situation is different and don’t be discouraged if the monstrous paragraph above contains situations that apply to you. It does not mean you will be denied, I cannot know that. Your entire situation might change the way the application is seen, and any form of evidence of that situation may help you out, so the best thing to do is find out who can help you with going to the doctor, what your current health plan will help with in regards to getting the right referrals to get your particular condition looked at by a specialist before you apply.

The last thing i want this post to do is make you give up applying before you tried, because if you are approved, you will receive financial help that could really help you, as well as enrollment in Medicaid with no waiting period (if approved for SSI) and Medicare (if approved for SSDI) two years later.

If you are denied:

It is very common to get a denial. Some states allow you to apply for a reconsideration of the application with additional information within 60 days of the denial; other states skip this step and have you appeal your case before an administrative law judge. These are very complex and involve long wait times but beyond these levels, if you keep getting denied, you can take your case to civil and even Federal courts to have it looked at by different people. This is the stage when people often seek out disability attorneys. I don’t know about you, but I feel when an entire legal industry arises from the fact that it is extremely difficult to navigate the disability system, something is probably wrong with society. Weigh your options because an attorney who knows the ins and outs of this hellscape may provide valuable, but they are also notorious for stretching out the timeline of your case due to the fact that the back pay you are owed will increase, which will increase their percentage of it when you finally are approved. (That’s what they’re banking on, anyway, and what’s in it for them.)

I really hope this post will be helpful. There is still the possibility that somewhere in it I’ve made a serious error, however. I’m going to leave some reading material for you to go over that will offer insight into details I couldn’t include.

1. Why do people feel so overwhelmed about Medicare when they’re approaching age 65?

I think it’s because your whole working life, you’ve had someone choose your health insurance for you, you work for a company, that company has an HR department, HR department reviews, a bunch of group health insurance plans, and they come and say here, you know, you can sign up for this plan. Here’s what it’s going to cost you out of your paycheck. And that’s what happens. Maybe you work for a company that gives you a choice between a PPO and an HMO they have two plants to choose from, but you never have to do any of the heavy lifting and learn what deductibles and coinsurance are, you know, you just sign up and go with whatever insurance that’s given to you. Well, when you turn 65, and you’re retiring and you’re leaving that group health insurance whenever if it’s at 65 or later. Either way, you’ve got to learn this National Health Insurance Program, which is a beast with four parts, 10 supplements, and literally thousands of Medicare Advantage or Part D drug plan options. 

2. Why haven’t they made it easier to comprehend or done some type of Medicare course to help people get introduced and acclimated with Medicare?

Yeah, you’re speaking my language. We have a private Facebook group where we allow people to join and ask their Medicare questions. I have heard that same question. Probably hundreds of times, like people will say, Why didn’t anyone prepare us and I often like to say, there should be a class when you’re 50 that you have to take could be online, and they could do it in an hour, but preparing you for things that people generally don’t know about Medicare, namely, that it’s not free, that you’re going to pay for it, and also that it doesn’t cover 100% of the cost of your healthcare so that you have time Get ready for that. Because we have met over the years, many, many people turning 65 getting ready to retire who were just blown away to find out that there’s a cost to this healthcare that they’re going to pay their whole life, that it’s going to be deducted from the cost, their social security check, and they’re not ready. So we’ve seen a lot of people decide to work a few more years because they were so caught off guard. So the government really does need to do a much better job. They send out a handbook. It used to be mailed to you now not even everyone gets the book in the mail. There’s some legislation too, that’s in Congress right now to take place to try to do a better job of preparing people for when they should enroll. So they don’t end up with penalties that they incurred just because they didn’t know when and where and how they should have signed up for Medicare.

3. Is it because they’re so confused or just so not in the know about what it actually involves and what it’s gonna entail? Usually when there’s things that people don’t really know anything about, and they’re a little nervous about, they tend to avoid it. 

Yes, people will procrastinate until the very last minute, or they just don’t make any decision at all. They sometimes end up in trouble for that. One example that we’re dealing with a lot now is that people who don’t have employer insurance who’ve been insured the last few years through the private health care exchange, they have had a subsidy which, which helps to make that insurance, very inexpensive for them. So they might be paying 50 or $100 a month for a health insurance plan because the government picks up part of the cost of the premium under the Affordable Care Act and so they’re like, well, I love the insurance coverage I have I just not going to sign up for Medicare. Well, what they find out later, is that it was never intended that the ACA Plans replace Medicare, they’re supposed to leave them and enroll in Medicare at 65. So not only will they pay a late enrollment penalty for signing up for Medicare because of that, but furthermore, once the government catches up with them, they’ll make them pay back all the subsidy dollars that they’ve been given since age 65. And you can just imagine there are literally thousands of people in that bucket who don’t know any better. So it’s so important that people start doing their research early. The early 60s is a good time, but certainly no later than age 64. You need to dive in and learn the parts of Medicare and learn the enrollment periods and familiarize yourself with all that so that you don’t accidentally make a huge blunder that is going to affect your coverage and what you pay for it for the rest of your life.

4. Can you fill in our listeners on exactly what that entails when you start being eligible for Medicare as far as price?

So part of the reason people think Medicare is free is that during your working years, you pay FICA taxes, and you see on your paycheck stub, the amount that’s pulled out of your paycheck to go toward Medicare and to go towards social security. So people think that they’re prepaying and that Medicare will cost them nothing when they get there. And on one part, that’s true, Part A, which is your inpatient hospital coverage under Medicare that is funded by the FICA taxes that you pay throughout your working life or if you were married to someone, you have to work at least 10 years here in the US or be married to someone who did to get Part A for free, and most people do work so about 99% of all Medicare beneficiaries, enrolling in part A will pay nothing for it. You can purchase If you a lot of times immigrants who are recent to America, maybe don’t have that work history, you can purchase it, but for most people, Part A costs nothing.

5. What exactly is Part A?

Part A is your inpatient hospital coverage. If you’re admitted into a hospital, Part A is the fund that pays for inpatient hospitals, skilled nursing, hospice, blood transfusions, things like that, that would occur in a hospital setting.

6. So that doesn’t cover all the other stuff? It only covers if you get sick, and you have to go into a hospital or you have to get skilled nursing?

Sometimes, people who can’t afford or didn’t know they have to pay, won’t sign up for the Part B which is the outpatient coverage, and that’s a big mistake if Medicare is going to be your primary coverage if you don’t have other coverage, such as through the VA or through retiree coverage through an employer, because although Part B does pay for outpatient things like you and I would think of as outpatient like doctor visits and lab work, it also covers things which may happen in the hospital because physicians perform services at a hospital and physicians fall under Part B. So if you were to have outpatient surgery or chemotherapy or radiation in a hospital, Part B is actually the part that covers those services. Part B is not free currently in 2020. The base premium, the standard base premium for Part B that most people pay is $144.60 per month. That typically goes up a little bit every year. People in higher income brackets about 5% of Medicare beneficiaries pay substantially more than that because they’re in a higher income bracket. 

7. What about the senior or the aging person who doesn’t want to pay $144 for part B, and has either a pension which includes health benefits or is still working and has health benefits, do they need to get Part B?

They don’t. If you work for an employer, past age 65, and that employer has more than 20 employees, then you can keep your employer coverage and it’s going to pay primary and Medicare will pay secondary. 

8. What is Part C?

Part C is the Medicare Advantage program. To understand how that works, I’ll first state that when you have your Medicare benefits in place. They work similarly to other insurance that you’ve had in the past when you have employer group health insurance. When you go to the doctor, you have a copay. If you go to the hospital, you pay a deductible. Well, Medicare has those same things. You have a deductible when you go to the hospital, there’s an outpatient deductible, and then Medicare covers only about 80% of your outpatient expenses. So you need some sort of supplemental coverage that’s going to cover that other 20% and also pay those deductibles for you. So you could choose to enroll in a traditional Medicare supplement that goes alongside the original Medicare that picks up those things for you or you could opt for the Medicare Advantage Program instead. And that is just a way where you can get your original Medicare Part A and B benefits through a private insurance company that operates a local network in your area.

9. What’s the difference if someone wants to do Part C and Part D, they can either get that through Medicare, or they could get it through private companies such as Boomer Benefits?

The Medicare Advantage program is not something Boomer Benefits offers, you would enroll in a doctor, a private insurance company, and all the same companies that you’re used to that operate in the under 65 world. They offer Medicare supplements and Medicare Advantage plans. So in your local area, you might be signing up with United Healthcare or Blue Cross or Aetna or Cigna Anthem. There are dozens of carriers that offer these plans. The main differences are with original Medicare and a Medicare supplement. Medicare is the primary payer and if you have a Medicare-approved claim which Medicare approves most medically necessary care. Medicare pays its share and then sends the rest of your supplement company and the supplement company picks up their share, leaving you little out of pocket. And the advantage of sticking with original Medicare and going that route is Medicare doesn’t have a network There are over 1 million providers that participate in Medicare across the United States. So you can see any doctor you want anytime you don’t have to pick a primary care doctor, you never have to get a referral.

10. If I was over 65 I could use any doctor, even in another state under my part C?

Original Medicare with a Medicare supplement is the one that you could see any doctor Part C is the one that has a local network.

Winning the Green New Deal Means Challenging Capitalism

Hope without action on climate change is as meaningless as “thoughts and prayers” after a mass shooting. The Intergovernmental Panel on Climate Change (IPCC) issued a Special Report in October 2018 warning that by 2050, without major course correction, over 350 million more people globally will be exposed to deadly levels of heat stress; in the U.S., wildfires in the West will burn at least twice as much forest area than in the years preceding 2019; and there could be as much as $1 trillion in damage to public infrastructure and coastal real estate. As of 2014, the U.S. was responsible for 20 percent of all global greenhouse gas emissions.

For decades, it was considered radical to even accept that climate change is real. Now, there is widespread acceptance of the reality of climate change, but in the face of the political establishment’s infuriating inaction, what’s considered radical is actually proposing to address the large-scale problem with an appropriately sized solution.

This gap between the scale of the problems we face and the solutions being put forward by establishment politicians can be seen on issue after issue – whether it be obscene economic inequality, systemic racism and sexism, or the imminent climate crisis. This is a central driving force behind the politicization and radicalization among ordinary people currently taking place across the world.

What’s in the Green New Deal

It is in this context that the Green New Deal being proposed by Alexandria Ocasio-Cortez, self-described democratic socialist Congressperson from New York City, is gaining mass support across the country and setting the terms of the debate around what kind of action is needed to combat climate change.

As proposed by Ocasio-Cortez the Green New Deal is a resolution, not a bill, which means it’s not binding. If passed, it sets priorities that Congress is supposed to take up by subsequently passing actual laws and policies.

The Green New Deal calls for meeting 100% of the power demand in the U.S. through clean, renewable, and zero-emission energy sources. Although most media outlets have reported that the Green New Deal calls for 100% renewable energy by 2030, the resolution itself actually doesn’t specify a year. It calls for overhauling transportation in the U.S. to become climate-friendly. It also calls for upgrading “all existing buildings in the United States and building new buildings” to achieve maximum energy efficiency, and for the international exchange of technology, expertise, products, and funding to help other countries achieve a Green New Deal as well.

The resolution is presented as a far-reaching anti-poverty program with strong language against economic and social inequality. It calls for the creation of millions of “high-quality union jobs that pay prevailing wages, hir[ing] local workers, offer[ing] training and advancement opportunities, and guarantee[ing] wage and benefit parity for workers affected by the transition.” It also calls for a democratic and participatory process that includes workers and oppressed communities in planning, implementing, and administering the Green New Deal at the local level although it is not spelled out how this would be done in practice.

Going beyond just the environment, the Green New Deal calls for all people in the United States to be guaranteed a job with a family-sustaining wage, adequate family and medical leave, paid vacations, and retirement security. It also calls for stopping the United States’ “historic oppression” of women, people of color, and immigrants. The resolution concludes by calling on the federal government to guarantee all people high-quality health care, affordable housing, and overall economic security.

Despite being the richest country in the history of the world, not a single one of these basic needs are guarantees for an ordinary person living in the U.S. We are told it would cost too much to meet everybody’s fundamental needs and transition to 100% renewable energy. Meanwhile the three richest men in America are hoarding as much wealth as is held by the bottom half of the population. 100 corporations globally are responsible for over 70% of the world’s greenhouse gas emissions since 1988. The truth is that our civilization and the planet are being sacrificed so that a handful of people can continue making massive amounts of money. The Green New Deal seeks to turn this around.

What Will it Take to Win?

The 2018 IPCC Report estimates it would cost $900 billion per year to implement the program it says is needed. The Green New Deal is modeled on their proposals. Ocasio-Cortez proposes this should be paid for in part with a 70% marginal tax rate on all income over $10 million. This would be a good start but not enough to fund the entire program.

Additional funding could come from taxes on the major fossil fuel corporations, big banks, and financial institutions. However, these corporations are not leaping at the opportunity to be taxed billions of dollars to address climate change. They are prepared to mount enormous opposition to the Green New Deal, and this opposition will become increasingly visible as the movement in support of it grows.

So far opposition has mainly come in the form of claims that the Green New Deal is an unrealistic fantasy. It’s “just a bunch of ideas that even as theory don’t work, let alone in the real world,” as CEO Lourenco Goncalves said ($60 million-net worth from mining). This type of casual dismissal is often the ruling elite and politicians’ first line of argument when confronted with bold progressive ideas that threaten their interests. In the 2016 Democratic primary, Hillary Clinton repeatedly referred to many of Bernie Sanders’ proposals, particularly Medicare for All, as “pie in the sky.”

Now, three years after Sanders popularized Medicare for All, a majority of Americans support it, including a majority of Republicans. Longtime establishment and corporate-friendly Democrats such as Corey Booker or Kamala Harris now feel forced to give verbal support of such policies in order to even be considered by most Democratic voters. This could become the case with the Green New Deal as well.

We must be careful though. There is a massive difference between offering verbal support for the Green New Deal during a political campaign, and supporting the concrete measures required to achieve it, not to mention building the movement that will be necessary to win it. Public statements are one thing, but behind the scenes lobbyists and powerful corporate interests exert pressure and even give directives on what the politicians they fund can and cannot do.

Uniting all who want to stop the looming catastrophe requires a clear, bold set of demands. It also requires a clear understanding of how major progressive change is won. The only force capable of counteracting entrenched corporate opposition is a mass movement centered on the social and economic power of the working class.

Recently, the leadership of the AFL-CIO Energy Committee sent a public letter to the sponsors of the Green New Deal. It agreed on the need to address climate change and invest in renewable energy technologies, and noted the Green New Deal’s call for the inclusion of workers and unions in the process. They argued, however, that the resolution itself “is far too short on specific solutions that speak to the jobs of our members and the critical sectors of our economy… and makes promises that are not achievable or realistic.” It goes on to say, “We will not stand by and allow threats to our members’ jobs and their families’ standard of living go unanswered.”

There is an element of fear-mongering here that must be challenged. The real threat to union members’ and all workers is not the Green New Deal. It’s the manufacturing, construction, and energy sector bosses as well as the corporate establishment of both political parties, who are allowing the status quo of low wages, worsening benefits, and rising cost of living to continue, not to mention the coming disastrous effects of climate change itself.

In fact, the resolution itself calls for “high-quality union jobs…, training and advancement opportunities, and guarantees wage and benefit parity for workers affected by the transition.” This could benefit from more specificity but to label this an attack on jobs and working families’ standard of living is simply untrue. Mistakenly, environmental movement has frequently taken an approach dismissive of the legitimate concerns of workers about their jobs and living standards. Ocasio should take up their offer for further dialogue and publicly challenge these labor leaders to come to the table to discuss a united proposal that all workers and environmentalists could get behind.

There are unions nationally which are in favor of strong action on climate change such as Amalgamated Transit Union, Communication Workers of America, and National Nurses United, as well as locals of many other unions, including in the building trades. These unions should actively mobilize support for a workers’ Green New Deal and show an alternative to the conservative leadership which currently dominates most unions. It is the fossil fuel bosses who must be left in the dust, not the workers who have a key strategic role in fighting for this industrial transition.

Winning a workers’ Green New Deal will require the movement, including labor, not mistaking the corporate leaderships of the Democrats or Republicans as their allies, and instead mobilizing its full power with mass protests, industrial actions, and strikes.

Workers’ Green New Deal Requires Public Ownership

The reason we are in this position in the first place is that we live in a society where political and economic decisions are dictated by the profit of privately-owned companies. Since serious action would require directly attacking the interests of large sections of corporate America, the political establishment opposes any comprehensive proposal to move rapidly to 100% renewable energy.

Even under capitalism, if a sufficiently strong mass movement is built, some aspects of the Green New Deal could be won. But to achieve a full transition to an economy based on renewable energy by 2030 will require taking unprecedented steps against the private ownership of key sectors of the economy. Unfortunately, neither Ocasio-Cortez nor Sanders accept that we would have to move beyond the framework of capitalism to achieve these goals, which is a fundamental weakness of their approach.

As long as the main energy companies are privately owned and run on the basis of profit and competition, they will fight against the Green New Deal and the scale of the funding, planning, and cooperation needed for the full plan simply cannot be achieved. We will need to take the main fossil fuel companies into public ownership, under the democratic control of working people, to actually carry out such a far-reaching plan, especially in such a short amount of time.

The transition will have to include a complete infrastructure overhaul, requiring taking key sections of the manufacturing and construction industries into public ownership as well. On the basis of a democratically agreed upon plan, public transportation could be massively expanded. New high-speed railways and trains could be built, and the auto industry could finally divorce itself from big oil and rapidly transition to producing electric vehicles only. Road and highway infrastructure would need to be updated to coincide with this change.

As mentioned above, a plan of this scale would cost approximately $900 billion annually, a huge number. But the resources already exist for an initiative on this scale. Collectively, just the top fifteen banks in the U.S. own $13.5 trillion. They will never give up this money for the common good voluntarily, so taking the big banks and major financial institutions into public ownership is also a necessary part of this transition.

Given that the billionaire class will fiercely oppose removing these key industries from private ownership, it will only happen as the result of a united mass working-class movement fighting consciously to do so. A vital tool for this struggle is building a new working class party with a clear socialist program.

We completely agree with the broader goals of the Green New Deal to end poverty and oppression but these too cannot be achieved within the framework of this system and will require revolutionary change. Taking the main pillars of the economy into public ownership to establish a democratically planned economy based around human need would lay the basis for the development of an egalitarian socialist society, under which exploitation and all forms of oppression could be rooted out. With the escalation of the international climate crisis, the need for humanity to move beyond capitalism to socialism has never been posed more sharply. 3 experts explain our new tax code

As the tax filing deadline nears, Americans continue to navigate tax season with curiosity and caution as they find how the Trump administration’s 2017 tax legislation personally affects them.

Democrats criticized the legislation, originally known as the Tax Cuts and Jobs Act of 2017, but officially called An Act to Provide for Reconciliation Pursuant to Titles II and V of the Concurrent Resolution on the Budget for Fiscal Year 2018, but Republicans defended the law as a necessary overhaul to previous tax laws and a means to provide economic relief for the middle class.

The dueling partisan narratives left many taxpayers with a murky understanding of the law’s impact.

To gain a better grasp on the intricacies of the 2017 Act, professors David Kamin, Lily Batchelder, and Daniel Shaviro—tax law experts from the New York University School of Law—cowrote a paper analyzing the sweeping legislation which appears in the Minnesota Law Review.

According to the authors, “Many of the new changes fundamentally undermine the integrity of the tax code and allow well-advised taxpayers to game the new rules through strategic planning.”

Here, the authors describe how some may take advantage of the new system, and how changes to the tax laws may affect the US economy.

‘Cracking and packing’

David Kamin: One of the largest tax cuts in the legislation goes to “pass-through” businesses—where income is taxed at the level of the owner rather than the business. But, to be eligible for this tax cut, owners need to meet certain very complex criteria.

For those with higher incomes, this includes being in the “right” line of business. That means being an architect (eligible) and not a lawyer (not eligible). Selling skincare products (eligible) but not being a dermatologist (not eligible). The formalistic and largely arbitrary lines then allow for much gaming, including what we—borrowing from the election law context—call “cracking and packing,” pulling apart and combining businesses.

For instance, a dermatologist office might “crack” apart a skincare products business run out of the same office, share overhead expenses, and then try to assign as much of those overhead expenses as possible to the dermatology practice to maximize profits eligible for the deduction. Possibly abusive? Yes, but very hard for the IRS to catch.

Lily Batchelder: The bill creates large incentives for the wealthy to convert their labor income into business income. This was already an issue in the tax code because of the carried interest loophole and loopholes in the payroll tax. But the bill makes a bad situation much, much worse.

If a wealthy individual hires an elite tax advisor to make their labor income look like pass-through business income, they can cut their marginal tax rate by more than 7 percentage points. And if they don’t need to spend the income anytime soon and treat it as corporate income, they can cut their tax rate by 20 percentage points.

Theoretically, middle class families could engage in the same games but they are much less likely to do so for at least three reasons. First, middle class families would receive much smaller tax benefits from such gaming and in many cases, none. Second, they often have little leverage over their employers to restructure their compensation and, even if they did, probably would have to give up all of their employee benefits in exchange. This includes their health insurance, 401(k), and disability insurance. Last, they are less likely to be able to afford a tax advisor with the expertise to structure this kind of arrangement in the first place!

Gaming the system

Daniel Shaviro: One of the many disappointing aspects of the 2017 act was its failure to address the opportunities for sheltering labor income from tax at full individual rates, through use of the corporate tax. Pre-2017, the top corporate rate was far closer to the top individual rate than it is post-2017. The main rationale for the corporate rate reduction pertained to global tax competition for scarce capital. This has no bearing on the case where the owner-employee of a corporation pays herself far less than the market value of her work.

For example, suppose I create a wildly successful new start-up and pay myself zero salary, despite my becoming, in net worth terms, a billionaire via the stock appreciation. The income that my efforts yield will show up in the corporate tax base, and be taxed at only 21 percent. True, I would face a second level of tax on paying myself dividends or selling my stock, but even this would be at a reduced rate. And what’s more, I may not need to make such payments if I am sufficiently financially liquid, e.g., by reason of borrowing against the value of the stock.

Opinions in the “biz” differ on how frequently taxpayers will find it worthwhile to do this, given the difficulty of extracting funds from one’s company tax-free. What is plain, however, is that Congress in 2017 deliberately did nothing to prevent this from happening. Indeed, the final version of the 2017 Act reduced the efficacy of a provision in the House bill that would have slightly addressed the problem by setting the tax rate for “personal service corporations” (PSCs) at 25 percent rather than just 21 percent. In the final act that rate is just 21 percent, like the general corporate rate, causing the PSC rules to be close to meaningless as a defense against using corporations as a tax shelter for labor income.

Shaviro: In the international realm, the 2017 Act may actually have improved the law marginally. At a minimum, it created a new regime that could be tweaked by future Congresses to yield a better system than the previous one. However, the main new international rules that it added to the code unnecessarily created multiple opportunities for game-playing. Just to give some quick examples without getting too deep into the weeds:

The foreign-derived intangible income (FDII) rules, which provide a special deduction for exports by companies, such as Apple and Facebook, that have valuable intellectual property, create incentives for “round-tripping” goods—e.g., selling them to a foreign taxpayer, then buying them back with just enough bells and whistles to prevent the entire transaction from being disregarded.

Both FDII and the global intangible low-taxed income (GILTI) rules can create incentives to locate business assets abroad rather than at home.

The base erosion anti-avoidance tax (BEAT) can be gamed through such means as restructuring supply chains so one is purchasing sale items for customers from one’s foreign affiliates. The BEAT can also be gamed by adding lots of extra deductions (offset by lots of extra income so the sum total is a wash), so that so-called “base erosion tax benefits” will fall below an arbitrary “floor” (as a percentage of total deductions) that the BEAT imposes for no discernible reason.

Violating the WTO treaty?

Shaviro: The FDII rules almost certainly violate the World Tax Organization treaty, of which the US is a signatory. They are expressly an export subsidy, and the WTO makes export subsidies illegal. If other treaty signatories challenge the FDII rules, there is a very high probability that they’ll be held illegal, with the consequence that peer countries will be authorized to respond with targeted provisions of their own.

In the last 30 or so years, the US has enacted illegal export subsidy rules on three separate occasions. Each time the rule was held violative and the US backed down. Why do this again? I think the main answer was cynicism, but ironically the prospect of an overturn makes the US companies that wanted favorable tax treatment more leery than they would otherwise have been of setting up complex structures to take maximum advantage of the FDII rules.

‘An array of mistakes’

Kamin: The legislation was written at an extremely rapid clip, leaving an array of mistakes—some minor and some large. An early one to emerge was the “grain glitch.” In attempting to apply the pass-through deduction to businesses organized as cooperatives, especially prevalent in agriculture, legislators wrote in an even larger loophole by accident. Effectively, farmers selling to these cooperatives (think Ocean Spray cranberries) could potentially entirely wipe out their tax liability because of the glitch.

This one was large enough—and was causing sufficient chaos in the agricultural sector—that it was fixed. But most haven’t been. So, take another: one of the largest revenue raisers in the legislation was limiting the deductibility of state and local taxes for individuals to $10,000. However, the letter of the law seems to fail to apply that to another form of cooperative, a housing cooperative.

So, owners of pricey cooperatives in NYC may be able to deduct their property taxes without limit; by contrast, owners of traditional condominiums and houses will not. And the list could go on.

Major takeaways

Batchelder: The bill is heavily tilted towards the wealthy. According to the official Congressional budget scorekeepers, this year the average millionaire will get a tax cut of more than $27,000 on their personal tax return, compared to a tax cut of $431 for an average middle-class family earning $40,000 to $50,000. Even as a share of their after-tax income, the tax cut for the average millionaire is three times as large.

It is also a very costly bill. The Congressional Budget Office estimates that it will increase our national debt by $1.9 trillion by 2028, even after including its effects on the economy. These large tax cuts will eventually have to be paid for. If Congress pays for them by raising revenues in proportion to income, the vast majority of middle class and low-income families will end up worse off. These families will be hit even harder if the bill is paid for by cuts to programs like Social Security, Medicare, and Medicaid.

Shaviro: It’s often says that tax legislation should be judged by four main criteria: fairness, efficiency, complexity, and revenue adequacy. The 2017 Act, despite having good particular rules here and there, egregiously failed on all four counts.

It was an act of class warfare benefiting those at the top relative to everyone else, for the most part it reduced economic efficiency by creating perverse incentives and arbitrary distinctions between different activities, it made tax planning more complicated for those who can afford sophisticated tax advice, and it will probably lose on the order of $2 trillion of net revenue over 10 years, even if all supposedly expiring provisions are actually allowed to expire.

It was also the sloppiest, most poorly drafted tax legislation that I have ever seen, despite all the talent and effort deployed by hard-pressed staffers, because the process was so secretive and rushed.

I was charged with impaired driving when i was 21. I fought it in court and it did nothing but make me spend lots of money and drag things out even more. Now i am 24 and get my full license back at the end of this month. I have had my license for the last year but with the interlock ignition condition on it. Not being able to afford the ignition interlock i decided to not drive. I am seeking advice from a insurance broker or somebody who has been charged with impaired and has gone through this. ON average what do you think i will be paying for insurance? Do you have any suggestions to make? I have a feeling i wont be able to afford it and will still take public transportation but i am curious. Please only answer if you have dealt with this situation

3 experts explain our new tax code

As the tax filing deadline nears, Americans continue to navigate tax season with curiosity and caution as they find how the Trump administration’s 2017 tax legislation personally affects them.

Democrats criticized the legislation, originally known as the Tax Cuts and Jobs Act of 2017, but officially called An Act to Provide for Reconciliation Pursuant to Titles II and V of the Concurrent Resolution on the Budget for Fiscal Year 2018, but Republicans defended the law as a necessary overhaul to previous tax laws and a means to provide economic relief for the middle class.

The dueling partisan narratives left many taxpayers with a murky understanding of the law’s impact.

To gain a better grasp on the intricacies of the 2017 Act, professors David Kamin, Lily Batchelder, and Daniel Shaviro—tax law experts from the New York University School of Law—cowrote a paper analyzing the sweeping legislation which appears in the Minnesota Law Review.

According to the authors, “Many of the new changes fundamentally undermine the integrity of the tax code and allow well-advised taxpayers to game the new rules through strategic planning.”

Here, the authors describe how some may take advantage of the new system, and how changes to the tax laws may affect the US economy.

‘Cracking and packing’

David Kamin: One of the largest tax cuts in the legislation goes to “pass-through” businesses—where income is taxed at the level of the owner rather than the business. But, to be eligible for this tax cut, owners need to meet certain very complex criteria.

For those with higher incomes, this includes being in the “right” line of business. That means being an architect (eligible) and not a lawyer (not eligible). Selling skincare products (eligible) but not being a dermatologist (not eligible). The formalistic and largely arbitrary lines then allow for much gaming, including what we—borrowing from the election law context—call “cracking and packing,” pulling apart and combining businesses.

For instance, a dermatologist office might “crack” apart a skincare products business run out of the same office, share overhead expenses, and then try to assign as much of those overhead expenses as possible to the dermatology practice to maximize profits eligible for the deduction. Possibly abusive? Yes, but very hard for the IRS to catch.

Lily Batchelder: The bill creates large incentives for the wealthy to convert their labor income into business income. This was already an issue in the tax code because of the carried interest loophole and loopholes in the payroll tax. But the bill makes a bad situation much, much worse.

If a wealthy individual hires an elite tax advisor to make their labor income look like pass-through business income, they can cut their marginal tax rate by more than 7 percentage points. And if they don’t need to spend the income anytime soon and treat it as corporate income, they can cut their tax rate by 20 percentage points.

Theoretically, middle class families could engage in the same games but they are much less likely to do so for at least three reasons. First, middle class families would receive much smaller tax benefits from such gaming and in many cases, none. Second, they often have little leverage over their employers to restructure their compensation and, even if they did, probably would have to give up all of their employee benefits in exchange. This includes their health insurance, 401(k), and disability insurance. Last, they are less likely to be able to afford a tax advisor with the expertise to structure this kind of arrangement in the first place!

Gaming the system

Daniel Shaviro: One of the many disappointing aspects of the 2017 act was its failure to address the opportunities for sheltering labor income from tax at full individual rates, through use of the corporate tax. Pre-2017, the top corporate rate was far closer to the top individual rate than it is post-2017. The main rationale for the corporate rate reduction pertained to global tax competition for scarce capital. This has no bearing on the case where the owner-employee of a corporation pays herself far less than the market value of her work.

For example, suppose I create a wildly successful new start-up and pay myself zero salary, despite my becoming, in net worth terms, a billionaire via the stock appreciation. The income that my efforts yield will show up in the corporate tax base, and be taxed at only 21 percent. True, I would face a second level of tax on paying myself dividends or selling my stock, but even this would be at a reduced rate. And what’s more, I may not need to make such payments if I am sufficiently financially liquid, e.g., by reason of borrowing against the value of the stock.

Opinions in the “biz” differ on how frequently taxpayers will find it worthwhile to do this, given the difficulty of extracting funds from one’s company tax-free. What is plain, however, is that Congress in 2017 deliberately did nothing to prevent this from happening. Indeed, the final version of the 2017 Act reduced the efficacy of a provision in the House bill that would have slightly addressed the problem by setting the tax rate for “personal service corporations” (PSCs) at 25 percent rather than just 21 percent. In the final act that rate is just 21 percent, like the general corporate rate, causing the PSC rules to be close to meaningless as a defense against using corporations as a tax shelter for labor income.

Shaviro: In the international realm, the 2017 Act may actually have improved the law marginally. At a minimum, it created a new regime that could be tweaked by future Congresses to yield a better system than the previous one. However, the main new international rules that it added to the code unnecessarily created multiple opportunities for game-playing. Just to give some quick examples without getting too deep into the weeds:

The foreign-derived intangible income (FDII) rules, which provide a special deduction for exports by companies, such as Apple and Facebook, that have valuable intellectual property, create incentives for “round-tripping” goods—e.g., selling them to a foreign taxpayer, then buying them back with just enough bells and whistles to prevent the entire transaction from being disregarded.

Both FDII and the global intangible low-taxed income (GILTI) rules can create incentives to locate business assets abroad rather than at home.

The base erosion anti-avoidance tax (BEAT) can be gamed through such means as restructuring supply chains so one is purchasing sale items for customers from one’s foreign affiliates. The BEAT can also be gamed by adding lots of extra deductions (offset by lots of extra income so the sum total is a wash), so that so-called “base erosion tax benefits” will fall below an arbitrary “floor” (as a percentage of total deductions) that the BEAT imposes for no discernible reason.

Violating the WTO treaty?

Shaviro: The FDII rules almost certainly violate the World Tax Organization treaty, of which the US is a signatory. They are expressly an export subsidy, and the WTO makes export subsidies illegal. If other treaty signatories challenge the FDII rules, there is a very high probability that they’ll be held illegal, with the consequence that peer countries will be authorized to respond with targeted provisions of their own.

In the last 30 or so years, the US has enacted illegal export subsidy rules on three separate occasions. Each time the rule was held violative and the US backed down. Why do this again? I think the main answer was cynicism, but ironically the prospect of an overturn makes the US companies that wanted favorable tax treatment more leery than they would otherwise have been of setting up complex structures to take maximum advantage of the FDII rules.

‘An array of mistakes’

Kamin: The legislation was written at an extremely rapid clip, leaving an array of mistakes—some minor and some large. An early one to emerge was the “grain glitch.” In attempting to apply the pass-through deduction to businesses organized as cooperatives, especially prevalent in agriculture, legislators wrote in an even larger loophole by accident. Effectively, farmers selling to these cooperatives (think Ocean Spray cranberries) could potentially entirely wipe out their tax liability because of the glitch.

This one was large enough—and was causing sufficient chaos in the agricultural sector—that it was fixed. But most haven’t been. So, take another: one of the largest revenue raisers in the legislation was limiting the deductibility of state and local taxes for individuals to $10,000. However, the letter of the law seems to fail to apply that to another form of cooperative, a housing cooperative.

So, owners of pricey cooperatives in NYC may be able to deduct their property taxes without limit; by contrast, owners of traditional condominiums and houses will not. And the list could go on.

Major takeaways

Batchelder: The bill is heavily tilted towards the wealthy. According to the official Congressional budget scorekeepers, this year the average millionaire will get a tax cut of more than $27,000 on their personal tax return, compared to a tax cut of $431 for an average middle-class family earning $40,000 to $50,000. Even as a share of their after-tax income, the tax cut for the average millionaire is three times as large.

It is also a very costly bill. The Congressional Budget Office estimates that it will increase our national debt by $1.9 trillion by 2028, even after including its effects on the economy. These large tax cuts will eventually have to be paid for. If Congress pays for them by raising revenues in proportion to income, the vast majority of middle class and low-income families will end up worse off. These families will be hit even harder if the bill is paid for by cuts to programs like Social Security, Medicare, and Medicaid.

Shaviro: It’s often says that tax legislation should be judged by four main criteria: fairness, efficiency, complexity, and revenue adequacy. The 2017 Act, despite having good particular rules here and there, egregiously failed on all four counts.

It was an act of class warfare benefiting those at the top relative to everyone else, for the most part it reduced economic efficiency by creating perverse incentives and arbitrary distinctions between different activities, it made tax planning more complicated for those who can afford sophisticated tax advice, and it will probably lose on the order of $2 trillion of net revenue over 10 years, even if all supposedly expiring provisions are actually allowed to expire.

It was also the sloppiest, most poorly drafted tax legislation that I have ever seen, despite all the talent and effort deployed by hard-pressed staffers, because the process was so secretive and rushed.
