Paris-Die Anerkennung der Souveränität Marokkos über dessen Sahara ist ein „beschwichtigendes“ Element, das Fortschritte über den Status quo hinaus zustande bringt, der der Lösung eines destabilisierenden Konflikts für die euromittelmeerische Region in die Quere kommt, bekräftigt Emmanuel Dupuy, Präsident des Instituts für Perspektive und Sicherheit in Europa (IPSE), einer auf geopolitische und geostrategische Fragen spezialisierten Denkfabrik mit Sitz in Paris.

„Die Anerkennung der Souveränität Marokkos über dessen Sahara ist im engsten Sinne des Wortes ein beschwichtigendes Element. Dies bewerkstelligt  es, über den Status Quo und über die Position hinauszugehen, die die internationale Gemeinschaft, Frankreich inbegriffen, mit dem Waffenstillstandsabkommen vom Jahr 1991 und der seitens Marokkos in 2007 unterbreiteten Autonomielösung anerkennt “, argumentiert der Geopolitologe in einem Interview MAP gegenüber am Vorabend einer virtuellen Konferenz zum Thema „die Bedrohung seitens der Front Polisario für den Euro-Mittelmeerraum: eine unwiderlegbare  Verantwortung Algeriens“, die von IPSE und dem Institut Mandela mit veranstaltet wurde.

Derzeit gibt es "eine neue mächtige Dynamik", die sich um die Frage der Sahara dreht, bekräftigt der Präsident von IPSE, auch Nationalsekretär Les Centristes, die Ansicht vertretend, dass Frankreich und die Europäische Union ebenfalls Teil dieser Dynamik sein müssen, was dies auch bisher mehr als zwanzig beteiligte Staaten getan haben.

„Nicht weniger als 25 diplomatische Vertretungen (Konsulate bzw. Büros von wirtschaftlichem Interesse) haben sich in der Sahara positioniert, aus Staaten, die offensichtlich nachvollziehen, dass die Nord-Süd-Dynamik und die Süd-Süd-Dynamik und die euro-afrikanische Transversalität diesen Korridor zu durchqueren haben, entlang der Schiene, worauf die transafrikanische Pipeline aufgebaut werden soll, die von Lagos nach Tanger führen sollte und de facto Öl sicherer, regelmäßiger und reibungslos befördern kann“, stellte er die Erklärung auf.

Dem Geopolitiker zufolge ist eine Befriedung der Region "offenkundig im Interesse aller", was bestätigt, dass die Entwicklung der westafrikanischen Subregion und deren Einheit mit der Schaffung einer gemeinsamen Währung ebenso "Säulen" sind, die aufeinandergestapelt sind, um einen echten Raum für Austausch zu schaffen, der durch die effektive Errichtung der afrikanischen kontinentalen Freihandelszone seit Jahresbeginn beschleunigt werden wird.“

Hinzu kommt das große Interesse an dieser Zone auf wirtschaftlicher Ebene, wenn man in Erfahrung bringt, dass „in der Zone Westafrikas, der 16. Wirtschaftsmacht, die stabilste und beständigste Wirtschaftszone liegt, die ihr eine Macht aufstempelt, die ihr bewerkstelligt, Einfluss auf die internationalen Beziehungen ausüben zu dürfen“, fuhr er fort.

Um pragmatischer zu sein, ist der Geopolitologe der Ansicht, dass „der erste Schritt für Frankreich und Europa darin liegt, in die Fußstapfen der diplomatischen Dynamik zu treten, die in den südlichen Provinzen, ob in Dakhla bzw. in Laâyoune, zustande kommt, und ihr gegenüber beizustehen, wie es die Amerikaner sehr gut verstanden und getan haben, und dies mit dem Aufbau von Wirtschaftsstrukturen“.

In diesem Kontext erinnerte er an die Unterzeichnung von zwei Wirtschaftsabkommen zwischen Marokko und den USA: „Abkommen, die durch die Errichtung der Struktur der United States International Development and Financial Corporation mit der Zielsetzung untermauert wurden, Marokko zur ersten Stufe einer Rakete zu machen, eines Projekts, das von den Amerikanern, im Besonderen von Prosper Africa, eine weite Verbreitung genießt und das wirklich das Tor zu den wirtschaftlichen Interessen in Westafrika ausmacht.“

Dem Geopolitologen zufolge „gehen die Stagnation des Konflikts (der Sahara) und die internationale Mattigkeit mit der Notwendigkeit einher, voranzukommen und innovative Lösungen zu erzielen“, nachschiebend, dass „Marokko von dieser Sicht aus dort besonders gut mit der nationalen Strategie für die menschliche Entwicklung (INDH) ausgerüstet ist, die das Humankapital als integrativen Faktor für alle marokkanischen Bevölkerungsgruppen und den in der Verfassung vom Juli 2011 zugelassenen fortgeschrittenen Prozess der Regionalisierung festlegt.“

Diese Politik wird eine stärkere Beteiligung an den Entscheidungsprozessen hiesiger Akteure und damit eine Anerkennung der Befugnisse der territorialen Autonomie bewerkstelligen, in diesem Fall mit der marokkanischen Initiative eines Autonomiestatuts für die Sahara-Region auf Verhandlungswege, welche „eine gute Grundlage für die Arbeit darstellt“.

Herr Dupuy erbrach auch den Beweis der Zuversichtlichkeit, dass "wir eine Lösung für den Sahara-Konflikt erzielen würden, die viel diplomatische Energie und viele finanzielle Mittel in Anspruch nimmt".

„Während wir überall über Dezentralisierungsprozesse der stärkeren Integration von Randgebieten nachdenken, bin ich der felsenfesten Überzeugung, dass es das Beste wäre, wenn wir Regionen entwickeln, die noch nicht ausreichend entwickelt sind und dies als Reaktion auf Faktoren wie Unruhe und Instabilität“, stellte der Geopolitologe die Behauptung auf.

Emmanuel Dupuy verweist auf die Position Algeriens im Hinblick auf den Konflikt in der Sahara und auf dessen jüngsten Provokationen gegenüber Marokko und ist der Ansicht, dass das algerische Regime „in einer Logik der Spannungsstrategie stehen muss, um interne Probleme nicht bewältigen zu müssen, während der Hirak, nämlich die politische und soziale Protestbewegung, energischer wieder aufgenommen wird.“

Derzeit analysiert der Geopolitologe: „Es gibt eine etwas besondere algerische Zeitlichkeit: Die algerische Macht ist geschwankt und schwankt immer noch mit dem Sturz vom Präsidenten Bouteflika, mit der Gründung des Hirak, der im vergangenen Februar in dessen zweite Jahr eingetreten ist, und den Einforderungen der Algerier, die immer gleich lauten, nämlich dem Kampf gegen Korruption und gegen Vetternwirtschaft“. Darüber hinaus hat die aktuelle Situation die Andeutungen einer politisch-militärischen Agenda aufgeworfen.

Hinzu kommt "eine Verfassungsreform, wo den algerischen Streitkräften die Möglichkeit anheimfällt, Operationen außerhalb des Staatsgebiets durchzuführen", zusätzlich zu "der konsequenten Verstärkung der algerischen Streitkräfte an der Grenze zu Marokko und im Besonderen in der gesamten Region", wo sich die Flüchtlingslager befinden, mit anderen Worten in der Nähe der Pufferzone. All diese Elemente „gelangen nicht in Richtung der Stabilisierung der Situation“, warnt der Präsident von IPSE davor.

In diesem Sinne betonte er, dass „die Infragestellung einer Art Modus-Vivendi durch Algerien Teil desselben Wunsches ist, eine neue Agenda auf die Beine zu stellen, die etwa darauf abzielt, der internationalen Gemeinschaft vorzuführen, dass die Sahara-Region ebenso instabiler als die Sahelzone ist“.

"Darüber hinaus wird diese Position in Washington vom mächtigen algerischen Lobbyisten-Netzwerk, im Besonderen innerhalb des Kongresses, verkauft", bekräftigt der Geopolitologe, zusichernd, dass "es derzeit in Washington wie auch anderswohin in Brüssel einen echten Versuch bestände, auf Aktionen vermittels der Einflussnahme Einfluss auszuüben”.

Ayodhya matter not to be referred to larger bench; matter not barred by res judicata in Ismail Faruqui case either: SC

Supreme Court: The Bench comprising of CJ Dipak Misra and Ashok Bhushan and S. Abdul Nazeer, JJ., by a majority of 2:1, held that the appeals concerning the Ayodhya (Ram Janmabhoomi-Babri Masjid) matter need not be referred to a larger Bench for consideration. Ashok Bhushan, J. delivered the majority judgment for CJ Dipak Misra and himself. While S. Abdul Nazeer, J. in his separate opinion was of the view that the matter should be referred to a larger Bench.

The present appeals were fixed for commencement of final arguments on 05-12-2017, when Dr Rajeev Dhavan, learned senior counsel appearing for the appellants submitted that the Constitution Bench Judgment of the Court in Ismail Faruqui v. Union of India, (1994) 6 SCC 360 needs reconsideration, hence the reference be made to a larger Bench. In Ismail Faruqui, while the Constitution Bench (per majority) upheld the validity of the Acquisition of Certain Area at Ayodhya Act, 1993 except that of Section 4(3) of the Act which was struck down; it also made observations that a mosque s not an essential part of the practice of the religion of Islam and namaz (prayer) by Muslims can be offered anywhere, even in open. According to Dr Dhavan, the law laid down in Ismail Faruqui in relation to praying in a mosque not being an essential practice is contrary to both, i.e. the law relating to essential practice and the process by which essential practice is to be considered. Whether essential practice can be decided on a mere ipse dixit of the Court or whether the Court is obliged to examine belief, tenets and practices, is a pure question of law. He submitted that Ismail Faruqui judgment being devoid of any examination on the above issues, the matter need to go to a larger Bench.

The Court had to find out the context of observations made in the judgment which according to the appellant were questionable and to decide whether the said observations furnish any ground for reconsideration of the Constitution Bench judgment. After referring to a plethora of judgments, Ashok Bhushan, J. observed that the question as to whether particular religious practice is essential or integral part of the religion is a question, which has to be considered by considering the doctrine, tenets and beliefs of the religion. What Dr Dhavan contended was that the Constitution Bench in Ismail Faruqui, without there being any consideration of essentiality of a religion, made the questionable observations. It was observed from that the context for making the said observation was a claim of immunity of a mosque from acquisition. Whether every mosque is the essential part of the practice of religion of Islam, acquisition of which ipso facto may violate the rights under Articles 25 and 26, was the question which had cropped up for consideration before the Constitution Bench. The observation has been made to emphasise there is no immunity of the mosque from the acquisition. What the Court in Ismail Faruqui meant was that unless the place of offering of prayer has a particular significance so that any hindrance to worship may violate right under Articles 25 and 26, any hindrance to offering of prayer at any place shall not affect right under Articles 25 and 26. the observation need not be read broadly to hold that a mosque can never be an essential part of the practice of the religion of Islam.

As to the question of res judicata –the present proceedings being barred in light of the decision in Ismail Faruqui, the Court held that the issues which were involved in that case were validity of the Act of 1993. The issues which have been framed in the suits giving rise to the present appeals were different issues which could not be said to be directly and substantially in issue in Ismail Faruqui. On this count alone, the plea of res judicata as raised by the respondent was liable to be rejected.

While concluding, the Court held that the questionable observations made in Ismail Faruqui, as noted above, were made in context of land acquisition. Those observations were neither relevant for deciding the suits nor relevant deciding the present appeals. Therefore, the Court was of the considered opinion that no case was made out to refer the Constitution Bench judgment Ismail Faruqui for reconsideration. Hence, no case has been made out seeking reference of these appeals to a Constitution Bench of this Court.

S. Abdul Nazeer, J., in his separate opinion stated that he was unable to accept the view of the Justice Bhushan that no case had been made out seeking reference of the present appeals to a Constitution Bench of this Court. However, he was in respectful agreement with the opinion on the question of res judicata. Therefore, while concluding, considering the Constitutional importance and significance of the issues involved, he was of the opinion that following questions need to be referred to a larger Bench:

(a) Whether in the light of Commissioner, Hindu Religious Endowments, Madras v. Sri Lakshmindra Thirtha Swamiar of Sri Shirur Mutt, AIR 1954 SC 282 and other cases, an essential practice can be decided without a detailed examination of the beliefs, tenets and practice of the faith in question?

(b) Whether the test for determining the essential practice is both essentiality and integrality?

(c) Does Article 25, only protect belief and practices of particular significance of a faith or all practices regarded by the faith as essential?

(d) Do Articles 15, 25 and 26 (read with Article 14) allow the comparative significance of faiths to be undertaken?

As per the majority, it was held that the present appeal does not require to be referred to a larger Bench nor does the Ismail Faruqui case needs reconsideration. TRIPTICO DO JARDIM DAS DELICIAS, BOSH

Na primeira Fase da Parte 2 do projeto “Aos Peixes: Uma Viagem Imaginada”, é solicitado aos alunos que criem um MAPA ou CARTA de navegação com as rotas possíveis e imaginárias da viagem.

Desta forma, através de um suporte digital com recurso à animação, evidenciamos os aspetos essenciais da informação contida no mapa estático, expondo assim cinco pontos marcantes da expedição.

Assim, para a conceção deste projeto, tiramos partido do quadro Jardim das Delicias de Hieronymus Bosh para formulamos o mapa da nossa expedição marítima.

Mas a questão coloca-se: “porque decidimos tirar partido deste artefacto?”.

Quando olhamos para esta peça artística, tomamos consciência que (apesar de não ser tomada como tal) a mesma apresenta as características de um mapa, que, ironicamente, coincidem com os conceitos da viagem a desempenhar pelo HMS Beagle Éden.

No exterior do painel (isto é, quando o tríptico está fechado) temos a reprodução da criação do mundo.

A esse momento damos o nome de “Criação”, momento que pertence à narrativa da criação da Genesis (criação do mito Judaico e Cristão, no qual temos a conceção de duas histórias que são vistas nos dois primeiros capítulos do Livro de Genesis.

Na primeira (Genesis 1:1 – 2:3) Elohim, palavra hebraica para a designação plural de “Deus”, cria o Céu e a Terra em seis dias, começando com a luz no primeiro dia e terminando com a humanidade no último. Na segunda história (Genesis 2:4 – 2:24) Deus, agora tratado pelo nome de Yahweh, cria Adão, o primeiro homem, e coloca-o no Jardim de Éden, dando-lhe o domínio dos animais. Eva, pelo contrario, é criada através da costela de Adão e é tomada como sua companheira.

Finalmente, ao vislumbrarmos o quadro com maior cuidado, notamos que no canto superior esquerdo, é possível evidenciar a representação de Deus, sentado com a bíblia ao seu colo, enquanto cria a Terra.

Por fim, por cima do Divino, temos descrita uma frase do Salmo 33 “Ipse dixit, et facta sunt: ipse mandãvit, et creãta sunt” – Pois ele falou e foi feito; Ele comandou, e tornou-se rápido.

É de salientar que na pintura a Terra aparece enclausurada numa esfera transparente, que se refere à descrição tradicional da criação da Terra, como sendo uma esfera de cristal que se suspende entre os cosmos, na qual se destaca perante uma enorme escuridão.

Finalmente, apesar da presença de vegetação na tela, a Terra ainda não contem qualquer tipo de vida humana ou animal. Indicando assim, que esta cena representa o evento Bíblico do terceiro dia da criação da Terra.

Assim, o grupo de trabalho, tirou partido destes factos e tomou o exterior do tríptico, como o mapa da nossa viagem, tornando esta gravura como sendo o globo giratório para o cumprimento desta missão, em substituição aos globos usuais.

Pelo contrario, no interior do tríptico, tomamos as suas pinturas como referência para os diferentes pontos essenciais da nossa viagem.

No interior deste artefacto, temos a representação de três cenas, que devem (mesmo não sendo obrigatório) exercer uma leitura cronológica da esquerda para a direita.

No painel da esquerda temos a representação de Deus a apresentar a Eva a Adão, no painel central é nos mostrado um panorama de figuras nuas, místicas, animais imaginários, híbridos, entre outros, que representam o paraíso. No ultimo painel, temos a representação do inferno, das tormentas, do castigo divino, um momento depois da vida para aqueles que, em vida, passaram os seus dias a pecar.

Assim, o primeiro painel representa o objetivo da nossa viagem (o porquê de irmos embarcar neste caminho incerto), no segundo temos a recompensa da viagem que estamos a desempenhar (o encontro com o divino, com a beleza, com a realidade), na última pintura do tríptico, temos o apercebimento de que para a tão ansiada descoberta das sementes da Maçã de Adão, o ser humano tem que primeiro morrer (inferno) para só depois poder ascender aos céus.
