🔰 سیرۃ الرسول ﷺ کی آئینی و دستوری اہمیت

سیرت نبوی انفرادی، اجتماعی، قومی اور بین الاقوامی ہر دو مرکبات کا احاطہ کرتے ہوئے جامع اور ہمہ گیر رہنمائی عطا کرتی ہے۔ مکہ میں حضور نبی اکرم ﷺ کا سارا دور دعوت حق کے فروغ اور اسلام کے ابتدائی تعارف کو عام کرنے میں گزرا۔ تاہم مدینہ طیبہ تشریف لاتے ہی آپ نے دین کی تبلیغ کے مکّی انداز کے ساتھ ساتھ ایک اور امر کی جانب بھی توجہ مبذول فرمائی اور وہ تھا ایک منظم معاشرے کا قیام۔ کوئی بھی منظم معاشرہ ایک آئینی دستوری ریاست کے بغیر قائم نہیں کیا جاسکتا، ایک ایسی ریاست کہ جہاں قانون کی حکمرانی ہو۔ یہی وجہ تھی کہ مدنی دور میں ریاست کا قیام آپ ﷺ کی ترجیح اول رہا۔ مدینہ تشریف لاتے ہی قیام ریاست کے سلسلے میں آپ نے جن امور کو اپنی ترجیحات میں رکھا ان میں سرفہرست آئینی ریاست کی تشکیل اور اس کا دستور تیار کرنا تھا۔ آپ نے اس نو زائیدہ مملکت کو جو دستور عطا فرمایا وہ تاریخ انسانی کاپہلا تحریری دستور ہے، جس سے تاریخ انسانی ایک نئے علمی، سیاسی، فکری، دستوری، معاشی اور سماجی دور میں داخل ہوگئی اور دورِ جدید کا آغاز ہوا جس کی روشنی آج کی انسانیت تک پہنچی۔

اگر دستور مدینہ کا تجزیہ جدید دساتیری اسالیب کی روشنی میں کیا جائے تو یہ حقیقت سامنے آتی ہے کہ دستور مدینہ ان تمام خصوصیات کا حامل ہے جو کسی بھی مثالی دستور میں موجود ہوسکتی ہیں۔ اور اس سارے عمل کا معجزانہ پہلو یہ ہے کہ یہ سب کچھ آج سے صدیوں قبل ہوا جبکہ انسانیت اندھیروں میں ڈوبی ہوئی تھی۔ دور جدید کی دستوری و آئینی ترقی کا جائزہ اس حقیقت کو مزید وضاحت سے منکشف کرتا ہے۔ آج کے مثالی آئین یعنی دستور امریکہ کی بنیاد میگنا کارٹا (Magna Carta) ہے۔ 1215ء میں طے پانے والے میگنا کارٹا کے آرٹیکل 39 میں یہ بیان آئین امریکہ کی روح متصور ہوتا ہے:

No free man Shall be arrested, or imprisoned, nor shall we go against him or send against him, unless by legal judgement of his peers, or by the law of the land.

1957ء میں امریکی بار ایسو سی ایشن نے بھی انگلستان میں Runnymede کے مقام پر یادگار نصب کرکے اس حقیقت کا اعتراف کیا۔ میگنا کارٹا کی رُو کے تحت وجود پانے والے اس آئین نے بھی اپنی موجودہ شکل تک پہنچنے میں صدیوں کا سفر طے کیا ہے۔ ستمبر 1786ء میں Annapolis Convention منعقد ہوا جس میں صرف پانچ ریاستیں شریک تھیں۔ 1787ء میں Philadelphia Convention اِنعقاد پذیر ہوا۔ اور فلاڈلفیا میں ہی 17 ستمبر 1787ء کو دستور مکمل ہوا. تاہم اس میں مزید بہتری کے لئے ابھی کئی اقدامات کی ضرورت تھی۔ مثلاً 1920ء میں انیسویں ترمیم منظور کی گئی جس کے مطابق امریکن آئین میں پہلی مرتبہ رائے دہی کے استعمال میں جنسی امتیاز کو جرم قرار دیا گیا اور ریاستوں و حکومتوں کو اس سے منع کیا گیا۔

تاہم مساوات کے اس تصور کو عام کرنا ایک خواب ہی رہا۔ مساوی حقوق کی ترمیم (Equal Rights Amendment, ERA) جو 22 مارچ 1972ء کو کانگریس کے 92 ویں اجلاس میں پیش کی گئی تھی اس کے مطابق تجویز کیا گیا تھا کہ متحدہ امریکہ یا اس کی کسی بھی ریاست میں حقوق کی مساوات کی نفی نہ کی جائے۔ اس ترمیم کو مطلوبہ حمایت میسر نہ آنے کے سبب یہ ترمیم سات سال بعد 22 مارچ 1979ء میں بے اثر (Expire) ہوگئی۔ اور یہ ترمیم منظور ہو کر قانون کا حصہ نہ بن سکی۔ جب کہ ریاست کا آئین نہ صرف انسانی حقوق کا حامل ہے بلکہ آنے والے زمانے میں اس کی عملی شکل بھی سامنے آتی رہی۔ جس کا عکاس وہ مدنی معاشرہ ہے جہاں حضور نبی اکرم ﷺ اور اُن کے خلفائے راشدین کا دورِ حکمرانی رہا۔

شیخ الاسلام پروفیسر ڈاکٹر محمد طاہرالقادری کی یہ تصنیف سیرت مبارکہ کے اس پہلو کے مطالعہ پر محیط ہے۔ ایک ایسے زمانے میں جب کہ آئین، دستور اور قانون جیسے الفاظ و تصورات سے انسانیت ناآشنا تھی عرب جیسے نراجی معاشرہ میں آپ ﷺ نے ایک آئین کی کامیاب تشکیل کی اور اسے نافذ بھی کرکے دکھایا۔ اس عظیم تاریخی عمل کی تفصیلات کو اس تصنیف میں بیان کیا گیا ہے۔ امید ہے کہ اس کتاب کا مطالعہ جہاں اسلام کے کئی روشن پہلوؤں کو نمایاں کرنے کا باعث بنے گا وہاں اس سے دستور، آئین اور قانون کے ماہرین کے لئے تاریخ دساتیر کو ایک نئے زاویے سے دیکھنے کے امکانات بھی پیدا ہوں گے۔
