Nigeria Admits Culpability in $60 Million Dispute Involving Chinese Investors, Amosun’s Actions Tied to Tinubu Government.   In a significant legal admission, Nigeria's attorneys have acknowledged the country's involvement in a contentious $60 million dispute, which originated from the harassment and deportation of Chinese investors in Ogun State. The lawyers' admission contradicts recent public statements made by both the Tinubu administration and former Ogun State Governor Ibikunle Amosun, who had denied any wrongdoing in the matter.   The dispute centers around the Ogun-Guangdong Free Trade Zone, a multibillion-naira project in Igbesa, Ogun State, managed by Chinese firm Zhongshan. Court documents reveal that the Nigerian police and immigration officials, acting under federal directives, harassed and expelled Chinese expatriates attempting to reclaim control of the zone.   President Tinubu To Depart For France On Monday With New Presidential Jet Released By Chinese Firm, Zhongshan   These actions were carried out at the behest of Amosun, who, during his tenure as governor, arbitrarily ousted the investors from the facility.   The revelations emerged as Nigeria battles to prevent asset seizures in the United States, following a ruling by the U.S. Court of Appeals for the District of Columbia. The court upheld a previous judgment that found Nigeria and Ogun State liable for breach of contract and abuses against the Chinese investors, awarding them $60 million in compensation.   The legal battle has plunged Nigeria into a diplomatic quagmire, with the Chinese investors reportedly detaining Nigerian aircraft in France as part of their enforcement strategy. Despite denials from Amosun and the federal government, evidence presented in court—including text messages—suggests that Nigerian officials threatened Zhongshan’s executives, further complicating the case.   Nigeria’s legal team, led by Squire Patton Boggs LLP, argued that the involvement of Ogun State in the contract disputes should not strip the country of its sovereign immunity under the Foreign Sovereign Immunities Act. However, the U.S. appellate court ruled that the New York Convention, governing international trade and arbitration, applied to the case, thus allowing the Chinese investors to continue their legal pursuit of Nigeria’s assets.   The case has sparked confusion and concern within Nigeria, with reports indicating that the Tinubu administration may consider further legal action, potentially appealing to the U.S. Supreme Court. Meanwhile, the dispute continues to cast a shadow over Nigeria’s international relations, particularly with China, a key economic partner.   Amosun, who admitted to transferring the free trade zone to a subsidiary of Zhongshan in 2012, has maintained his innocence and urged the Tinubu government to resist the Chinese investors' demands. Both Amosun and presidential representatives have so far declined to comment on the recent legal developments and the implications for Nigeria's sovereignty and international standing.

The 'Foolish Man' and his mega refinery complex

Chief Bayo Onanuga writes; Some years ago, Aliko Dangote, Africa's richest man invited media leaders to a luncheon at the Protea Hotel in Ikeja to mark his 55th birthday. Some of his guests sat around him at the centre table. They chatted freely. Discussions about our country, and the state of the economy soon veered into discussing the absurdity of our country, being a major crude exporter, and also a major importer of refined petroleum products. Our colleague from a major business paper said the local conditions were unfavourable to any investor who wanted to build a refinery. He then made a remark that I believe he would live to regret: "Only a foolish man will build a refinery in Nigeria". Aliko who had listened to all our business and political pontifications, interjected: "I am that foolish man". A pin-drop silence enveloped the table as he dropped the unexpected news: "My company has just decided to build a refinery in the country. But we are doing it big". Those were his exact words, as the multi-dollar billionaire told us he was willing to spend close to $9 billion on the project. The media big man became speechless. The rest of us caught the contagion of being flummoxed as well, as Aliko expatiated on the project. He said it will be a petrochemical complex. As the project was still on the drawing board, he did not tell us it will be the biggest refinery in the world, capable of processing 650,000 barrels of crude daily. All the hint he gave was that it will be 'big'. Our takeaway was that it will be big like Aliko's involvement in cement, sugar, pasta, and other businesses. He didn't say it will include a fertilizer plant and a power plant that can supply enough electricity to Nigeria's South West, excluding Lagos. Initially billed for Ogun State, the Dangote Petroleum Refinery surprisingly shifted location to Lagos, just opposite the creek separating the two states. Governor Dapo Abiodun may want to probe his predecessor, Ibikunle Amosun, why he allowed the complex to move to neighbouring Lagos. The gigantic project, which cost $15 billion, is now sitting in all majesty in the Lekki Free Trade Zone in Ibeju-Lekki, covering a land area of approximately 2,635 hectares, seven times the size of Victoria Island. The complex is the world’s Largest Single-Train 650,000 barrels per day Petroleum Refinery with 900 KTPA Polypropylene Plant. It comes with a 435 MW Power Plant, which will be able to meet the total power requirement of Ibadan DisCo of 860,316 MWh covering five States including Oyo, Ogun, Osun, Kwara, and Ekiti. The refinery, according to its fact sheet, can meet 100% of the Nigerian requirement for all refined products, including Gasoline, Diesel, Kerosene, and Aviation Jets. It will also be able to produce a surplus of each of these products for export. Designed for 100% Nigerian Crude, the refinery has the flexibility to process other crudes. No wonder it is located near the seashore. Today President Muhammadu Buhari commissioned the gigantic petrochemical complex. Just as we rejoice with Aliko Dangote and the Dangote Group family, we need to give kudos to the Buhari administration for ensuring that the complex comes to fruition, by ensuring that it was not starved of needed foreign exchange and taking a stake in it. For Aliko, all is well that ends well. The complex will bring to an end our country's many decades of shame, for being unable to refine its crude and having to depend on importation, wasting scarce forex. The 'foolish man' of 11 years ago has demonstrated once again that he is a man of wisdom, a peerless shrewd investor who sees clearly the 'bigger picture' when his compatriots are bogged down by parochialism and immediate monetary gains. Former Governor of Ogun State, Gbenga Daniel, has finally broken his silence over the controversy on Nigeria's presidential jets seized recently.   Ejes Gist News gathered that the jets were grounded in Europe a few days ago, following a court injunction by a Chinese firm, Zhongfu International Investment FXE, over a contract dispute with the Ogun State Government.   Presidential Jets Seizure: Amosun Also Cancelled My Ogun Contract, Just Like He Did to a Chinese Firm – Pat Utomi   Daniel was the serving governor from 2003 to 2011 when the contract was signed in 2007.   Buttressing the statement, he cited the need to enhance diplomatic measures involving Nigeria's collective interests and assets.   A statement from the office of Daniel explained that he is not in any way connected to the current legal deliberations, but will definitely help the federal government in arriving at a political solution. Presidential Jets Seizure: I Mistakenly Signed Away Ogun's Multibillion-Naira Trade Zone to Chinese Investors, Ibikunle Amosun Confesses   The Senate President charged the press to cooperate with the government in ensuring a constructive resolution, rather than politicking about the nation's assets and integrity.   "Since the report of the Arbitration and legal matters between a Chinese Firm and the Federal Government of Nigeria/ Ogun State Government on the termination of Management contract at the Ogun/ Guangdong Free Trade Zone, the Media Office of His Excellency, The Senator Otunba Engr Gbenga Daniel, FNSE, FAEng has been inundated with calls requesting for Otunba Daniel's reaction on the matter.".   "We need to establish clearly that Otunba Gbenga Daniel, or his administration, is not in discussion on the matter before the courts and arbitration; neither were the terms or proprietary of the Agreement for the establishment of FTZ, but rather, the termination of a Management Contract. The judgements in all the courts are very clear on this.".   This is a very sensitive matter involving our collective national assets and commonwealth, which every patriotic Nigerian should be concerned about. And as an elder statesman who had been privileged to serve as governor of Ogun State, during which time he was able to carry out a number of developmental projects, like the establishment of the Ogun/Guangdong Free Trade Zone and others, and through which he impacted on the lives of many citizens, and presently a serving Senator of the Federal Republic of Nigeria, it is in this patriotic path that he chooses to thread.   "Rather than the media comments, the most reasonable course of action Senator Otunba Gbenga Daniel would rather engage in at this critical time is to help Nigeria through President and Commander-in-Chief, Asiwaju Bola Ahmed Tinubu, toward finding a diplomatic solution on the issue at hand with available records that could assist the Federal Government in pursuing its course before the arbitration and before the courts.". He cannot do this on the pages of newspapers and in other media, which may also compromise the strength of arguments by Nigeria in the courts.   "We need to also appreciate that this matter is before various courts in several countries and it is subjudice for anyone to speak on them.".   "But let us emphasize again that the Ogun/Guangdong Free Trade Zone project still exists, several Nigerians working there as we write this, just as there are several companies still doing their legitimate businesses. It is from this development perspective that the efforts of Otunba Gbenga Daniel should be well appreciated.".   "At the time of his handover in 2011, about 56 companies were at different stages of operations, construction, and showing interest in the Free Trade Zone, through which various life-impacting developments, such as the construction of roads, schools for the local community, a scholarship, and sponsorship of many Nigerians for academic pursuits, etc. have taken place at Igbesa area, which was otherwise a rural community before the establishment of the Free Trade Zone.".
  "So many misleading reports and misrepresentation of facts on Timelines of activities relating to the establishment and Operations of the Free Trade Zone are in circulation, especially on the social media, and we beg that the media should partner with the Nigerian government in finding a very productive solution to this matter in Nigeria's interest. It is not time to play politics with the assets and integrity of our dear country.".   "We sincerely appreciate all efforts at reaching out for Otunba Daniel's side of the story as we also seek the understanding of all those who called to appreciate his sturdy silence to be able to assist the President on the way out of this testy time and situation."

‘Like He Did Chinese Firm, Amosun Also Cancelled My Ogun Contract’ – Pat Utomi   Renowned political economist, Pat Utomi, on Sunday, revealed how he suffered to pay back millions of naira in loans after former governor of Ogun State, Ibikunle Amosun, allegedly cancelled a contract he had with the state government. Utomi disclosed this while reacting to Amosun’s admission that a contract he cancelled while he was Ogun governor has now led Nigeria to an embarrassing situation in which the country’s presidential jets are being seized in Europe. Presidential Jets Seizure: I Mistakenly Signed Away Ogun's Multibillion-Naira Trade Zone to Chinese Investors, Ibikunle Amosun Confesses   Amosun in a statement published by Naija News said he cancelled the contract with the Chinese firm in 2016 after the Ogun government discovered that the firm’s claims were false.   The Chinese firm Zhongfu International Investment FXE recently secured a French court order to seize three Nigerian presidential jets over its business dispute with the Ogun government.   Utomi in his reaction in a post on X wrote, “The Chinese were not the only victims. One prominent Ogun indigene allegedly committed suicide with similar Amosun action. Amosun stopped all such on being sworn in.”   Utomi said he met with Amosun over the issue and the governor promised to resolve it but it was never resolved. He said he also sought the intervention of Bola Tinubu, who was not Nigeria’s president then, but to no avail.   “I lost my weary SA partners who owned a successful regional chain across Southern Africa and Asia. I licked my wounds and Slaved to pay off the loans. The Chinese had better leverage,” he wrote.   The full statement reads, “So it was Gov Amosun’s violation of contract terms signed by his predecessor that brought the shame of seizure of jets from the Presidential fleet. I hope he is happy at his achievement’.   “The whole matter is Khama at work. The Chinese were not the only victims. I went to Abeokuta and he called in Yewandw Amusan who said mine was a straight forward deal they did not include it.   “He asked that all be included but mine be quickly sorted. That began a rigmarole that went on for years. I made another trip to Abeokuta. He drove me back to Lagos at the wheels with my driver trailing along with the escorts and sirens.   “He had earlier asked that I make a request for refund of what I paid even though my South African partners and I had invested 200m in addition to the lease amount at the time.   “With just two of us in the car he advised I make a claim for 100m and write for additional payments the day after I cash the cheque. It was surreal but if I got nothing more it would be better than being in court until we both retire.   “I took the case to APC leader BAT and Baba Akande. No result. Took it to Dapo Abiodun when he took over. Nothing came of it. If this happened to Frieda I wondered what enemies were going through.   “I lost my weary SA partners who owned a successful regional chain across Southern Africa and Asia. I licked my wounds and Slaved to pay off the loans. The Chinese had better leverage.   “They took it and all are shamed. The Senate on Tuesday passed for second perusing, a bill trying to set up a rainy day account for treatment of gunfire casualties just as other dangerous crises.

The proposed enactment, trying to revise the Compulsory Treatment and Care for Victims of Gunshots Act 2017, was supported by Senator Oluremi Tinubu (APC, Lagos).
Tinubu, in a lead banter, said the Act was to authorize the treatment of survivors of discharge wounds who were being declined treatment by medical clinics because of a distortion of Section 4 of the Robbery and Firearms (Special Provision) Act 1990.

“In a nation where crisis reaction is practically non-existent, and getting casualties to the clinic is now troublesome, it is dismal that where the casualties come to a medical clinic alive, they’re actually denied therapy and passed on to bite the dust,” she said.
Representative Emmanuel Bwacha (PDP, Taraba) said giving treatment to survivors of discharge wounds would help security organizations in getting data from such people expected to control culpability in the country.

Congressperson Ibikunle Amosun (APC, Ogun) said the holiness of life should be ensured at all expense, taking note of that “Regardless of whether those individuals have carried out those violations, it is the point at which they are alive that they can acknowledge the cold hard truth, and others will gain from it.”
