Hugo’s direct comparison between Bamatabois and Tholomyès is so painful. It’s one thing to know that, logically, Tholomyès didn’t care about Fantine and saw her as disposable; everything we saw of him (and of course, Fantine’s present state) indicates that. But the difference between how men like them treated Fantine when she was beautiful and held the more acceptable status of “grisette” and how she’s treated now that she’s ugly, poor, and a prostitute is stark. Before, she wasn’t worth making commitments to, but her presence was welcome as long as it was “fun.” Now that she’s in need, the true extent of their cruelty is on display because there’s nothing they can get from her. They feel no obligation to treat her with even the most basic level of courtesy because they never saw her as a person to begin with.

The title of this chapter - “M. Bamatabois’ Inactivity” - is somewhat strange. The chapter revolves around his actions: he harasses Fantine verbally, then shoves snow down her dress. Of course, Hugo discusses all that he doesn’t do as well. He doesn’t work and is not very helpful or harmful in his inaction. Since he has some wealth, his unemployment doesn’t condemn him (either financially or in the eyes of society), but it doesn’t help his image, either. It’s accepted that there are men like him who don’t work, but it’s not praised, either. Since he has some status and money and is aligned with the party in power (his hat indicates that he’s a royalist), he’s tolerated by everyone around him in spite of his “inactivity.” 

This “inactivity,” then, is largely defined through his relationship with society: he’s “inactive” in that he doesn’t work. That being said, it’s also a legal “inactivity.” At the end of the chapter, Bamatabois flees before Javert can question him, leaving Fantine to him. Bamatabois isn’t seen as a criminal worth pursuing, so in the eyes of the law, he was never there except as a victim of Fantine’s aggression. Even though he spends most of this chapter harassing Fantine, to Javert, he is the “inactive” victim, while Fantine’s single reaction makes her the perpetrator.

I think this was chosen as the chapter title to play on these two notions. The first alludes to the valorization of work by the bourgeoisie: would bourgeois readers really want to support this “idle” man over Fantine, who works as hard as she can to help her daughter, just because he appears “respectable”? It challenges their assumptions about class and one’s worth while also playing on their values. The second idea is more ironic and frustrating. We know that Bamatabois wasn’t “inactive” at all, but he’s not going to be punished for anything he did because of the difference in class and status that exists between him and Fantine.
