Austria's supreme court paves way for same-sex marriage from 2019
Same-sex couples will be allowed to marry in Austria from 2019, the country's supreme court ruled on Tuesday and said a law to the contrary violated the principle of non-discrimination.
The move brings Austria into line with many other European nations including Germany, France, Britain, and Spain.
It also comes at a time when stories of sexual harassment under the #MeToo hashtag have flooded social media, sparking a rethink of attitudes towards sexual discrimination.
"Today is a truly historic day," said lawyer Helmut Graupner, who represented the two female plaintiffs in court.
"Austria is the first European country to recognize marriage equality for same-gender couples as a fundamental human right. All the other European states with marriage equality introduced it (just) the political way," he said in a Facebook post.
Austria's constitutional court examined a 2009 law that allows registered partnerships for same-sex couples but prevents them from getting married. It acted at the request of two women who were rejected by two lower authorities.
The distinction between marriage and registered partnership can no longer be upheld without discriminating against same-sex couples, the court said in a statement.
"The resulting discriminatory effect is seen in the fact that ... people living in same-sex partnerships have to disclose their sexual orientation even in situations, in which it is not and must not be relevant, and ... are highly likely to be discriminated against," the court said in its ruling.
The conservative People's Party (OVP), whose leader Sebastian Kurz is expected to be sworn in as chancellor next month, said it will accept the ruling.
The far-right Freedom Party (FPO), Kurz's chosen government coalition partner criticised the ruling.
"Now there is equal treatment for something that's not equal," said Herbert Kickl, FPO General Secretary, in a statement. A marriage between women and men needs protection as only these partnerships can create children, he said.
The OVP and the FPO voted against same-sex marriage in parliament a few months ago.
The court decision comes days after French President Emmanuel Macron unveiled a plan to curb violence against women and weeks after Scotland apologized to gay men for historical convictions.
The Homosexual Initiative Vienna (HOSI) welcomed the court's decision. "We are very happy," said HOSI chairman Christian Hoegl. "We want to use the opportunity for a renewed call for a fundamental reform of marriage."
Same-sex marriage is legal in 25 countries. Australia aims to pass a law to this effect early next month after 62 per cent of voters favoured marriage equality in a national survey.
In Germany, women and men are allowed to wed to a same-sex partner since October. The first country to legalise same-sex marriage was the Netherlands in 2001.

The equality of homosexuals has not yet reached the center of society. Especially in the country, gays and lesbians suffer from homophobia and exclusion. It was an unfortunate coincidence that the father of Florian R., in the village, learned that his son was gay. The then 17-year-old South Styrian had been sighted in a café with a confessional homosexual. The news went flying quickly. The father became drunk and tore his son out of sleep at night. "He hit me and shouted that I was no longer his son," remembers the 23-year-old Florian R. to his involuntary outing. On the next day his father apologized to him, howling. Especially in rural areas, gays and lesbians are still reluctant to leave their homes, as opposed to their families, friends or workplace. It is true that Austria, according to a conservative estimate of at least a quarter million gays and lesbians live, officially as an open-minded EU country. The researches on this story, however, draw a different picture. In a comparison with Austria, Austria was anything but a Muensterland for equality: Only in 1971 were same-sex relationships between adults legalized. In the year 2003 was ?? after years of debate? the protection age for male homosexuals reduced from 18 to 14 years, 2009 the registered partnership allows. While social acceptance for a homophobically orientated life in the mainstream seems to have emerged in the large-scale area and the corresponding sociocultural milieus, the rural area still proves to be a treadmill field for homosexuals. The pink angle, the equivalent of the yellow Jewish star as a sign of homosexuals during the Nazi period, is obviously still an everyday reality. The fear of rejection or the feelings of guilt, the family? , many homosexuals are fleeing into urban environments, where the anonymity of the crowd offers some security. But also for those gays and lesbians who flee to the city, the double life often does not end. The 23-year-old Styrian student Manuel F. * has been living in Graz for some years, but still hides his sexual orientation before his conservative father: "I am studying and are afraid that he will refuse me financial support. He believes that I live in a residential community. In fact, I've long since contracted with my friend. F.'s colleagues know little about his private life. This type of ?? risk override ?? according to investigations, takes its toll: the permanent plug-in play and the invention of plausible life lies at least 20 percent of the working energy and can lead to mental disorders. The psychologist and suicide expert Martin Plöderl is convinced that homophobia is anchored deeply in our society, despite the more liberal legislation: "Even before children have a clear concept of homosexuality, they know that it is devalued in our society. A study conducted by the Vienna Anti-Discrimination Agency in Austrian schools showed how strongly homophobic stereotypes characterize the language and attitude of children and adolescents. 47 percent of the students interviewed know homophobic abuse. 46 per cent had to look at how a gay student was threatened and humiliated; in lesbian schoolgirls it was ?? only ?? 26 percent. The investigation also showed that three percent of the homophobic violence originates from teachers. Therefore, in the future of teacher training, obligatory anti-discrimination training will take place. The Austrian Homosexual Initiative (HOSI) offers schools talks with young homosexuals to dismantle prejudices. This form of subtle discrimination is used in the specialist jargon-internalized homophobia ?? and has similarly devastating consequences for the victims as direct violence. Pushing and hiding reduces self-esteem; the fear of being exposed is a constant companion. Depression, panic attacks, and anxiety disorders are the pathological consequences of this vital foundation. Based on data from international studies, Plöderl estimates that 30 to 50 percent of people who choose suicide in Austria are gays, lesbians or transsexuals. That would be 350 to 600 suicide annually. By way of comparison: Last year, a total of 522 people died in traffic accidents. More about these numbers and subtle discrimination when you follow the link. https://queerimpuls.blogspot.de/
