I've been thinking about the Aaron trial a LOT and kinda fell into a rabbit hole about it and thing is. Aaron is guilty. Like 100% guilty. The prosecution can't prove first degree murder but they don't need to because they can charge him with 2nd degree, aka "murder of passion". It was a charged moment and Aaron responded by killing the dude. Yes he deserved it and yes it's still murder, with considerable jail time.

There are 3 ways for Aaron to get off here (not including Moriyama interference). One, jury nullification. The jury basically decides that yes he did it BUT he shouldn't go to jail for it so we're gonna vote as if we're not convinced he did it. Incredibly rare but legal. Two, Aaron's lawyer successfully argues that Aaron was acting in self defense on Andrew's behalf. They could potentially try to have Drake charged with SA and CSA posthumously, and use the details of that trial as evidence in Aaron's. Three, and this ties into 2, JAG (military legal branch) tells the SC courts they don't want a public trial. From here it becomes internal politics, and might result in a plea deal in exchange for the whole thing getting shoved under the rug.

it seems to me like jury nullification is one of those old laws that don't really hold up in a modern setting, like if you suggested it now, i don't know if they'd actually go forward with it?

the best i've come up with is that he's aquitted for accidental death or self defence and the jury are swayed by andrew, neil and higgins' testimonies, or he's found either guilty or not guilty of involuntary manslaughter. just throwing some random thoughts out into the world. (let's disregard first degree murder.)

voluntary manslaughter in SC can't be given without "heat of passion and sufficient legal provocation" present. "The heat of passion refers to the defendant experiencing some type of uncontrollable emotion, such as rage or terror. The heat of passion does not excuse a homicide, but it does remove malice. Legal provocation refers to circumstances that would cause a reasonable person to lose self-control."

IM NOT A LAWYER but i think it might be hard to prove this - it happened SO quickly that there's not enough evidence beyond reasonable doubt to prove that it was an intentional act of passion with reasonable provocation.

involuntary manslaughter can't be given without "criminal negligence" or essentially a reckless or hazardous disregard for safety etcetc. in SC code of laws it says "criminal negligence is defined as the reckless disregard of the safety of others. A person charged with the crime of involuntary manslaughter may be convicted only upon a showing of criminal negligence as defined in this section."

AGAIN IM NOT A LAWYER but i think there's probably ways to argue that there was no criminal negligence on aarons behalf because it wasn't technically reckless. i think aarons lawyers would argue that it wasn't a homicide at all but was an accident because aarons behaviour wasn't technically reckless (in some ways). regardless even if he was found guilty of involuntary manslaughter there's no minimum sentence for it in SC so it's possible he'd avoid going to jail at all because of his character/how unlikely it is he'll reoffend/his prospects in life/his clean record and all that. he'd have parole terms and probably some community service and a fine or something but i think he'd easily avoid jail time even if he was found guilty.

he could still possibly be aquitted on the question of whether ANY category of murder happened beyond a reasonable doubt. the prosecution would have to prove that aaron intentionally swung the racquet with or without intent to kill. i think there's an argument there for an accidental death - which would definitely make this ask even longer so i won't get into my NOT LAWYER thoughts on how/why.

i'm not saying andrew and neil WOULD commit perjury. but they WERE the only people in the room when it happened, and if they can't say that for certain aaron swung the racquet at drake then there's a doubt there about whether it was homicide or not. nobody is denying the murder occured - but the prosecution HAVE to prove that aaron was WILLFULLY negligent and that led to drake's death. just a thought.

happy aromantic awareness week!

I've been slowly exploring and poking at my aromanticism throughout the last year or so. while I've been happy to id as such for about 10 years (however long it was after I learnt the term) I definitely felt a certain reticence about thinking too much about it, and mostly deep-dived into other facets of my self -- aromanticism makes even other queer and lgbt+ people uncomfortable, and since I was living my life as I wanted to anyway, I was able to be open about it without insisting on understanding (call that a mix of internalised aro-phobia, fear, and probably just not being ready)

I think as I get older the aro part of me feels like it's coming to the fore as the constructs of society affect me more and more. it's not easy being a part of the world without conforming to normative ideas about relationships and family

this has made me both more radical in my aro-based politics, while also asking more questions on a personal level: what do I want out of my time around other people? what matters to me about connection?

it's been leading me to exploring the term "loveless" -- a pretty heady word I think, a lot of people have a kneejerk reaction about it, but it feels good to me. this could be something in flux (similar to how i inhabited what I call a void space in terms of gender before feeling comfortable exploring masculinity-as-drag, and with asexuality before I started poking at kink), but honestly I've never understood the term or its apparent accompanying feelings. I enjoy the company of other people, I like sharing things with them, and I have connections that for one reason or another have shared more than others due to the ways we've met and our history together, but I'm also not deeply emotionally affected by people on the whole, nor do I feel like I'm "missing" a certain kind of connection that I need to pursue to feel whole

I mostly spend time with others through the lens of specific community spaces, in which we have the same goal (be that political, artistic, fandom-based, sharing rent, etcetc.) and that's really what I want -- shared goals, having a fun time, building spaces, communally caring for one another

so that's where my aro-based poking has lead me so far. it's still a tad reticent, because... well I do worry. I worry that people in my life will take this to mean I'm uncaring about what we've done together or the plans we've made, or that I'm in need of some kind of fixing, and I'm worried as I have been since I was a kid that in the next 10, 20, 30+ years I could really be struggling to survive, because I'm not able to create the kind of social safety nets that are "acceptable" in the eyes of government structures

I do have a safety net currently, and it's a good one I think, with people I really like, and who care about me, but its legal ins and outs, as well as my internal being that will always have this particular lens through which I experience the world, make it less stable than if I'd been in a romantic relationship or even if I experienced "love" in some other way (and tbh ending up in this scenario was pure happenstance and I'd never have been looking for it otherwise)

so to think about the future: what forms of connections do we value, materially? what kind of people do we allow to thrive and under what structures? how do we build (queer) community spaces in which we provide care for one another that aren't predicated on finding the exact special person/s that potentially leave others behind? how can this kind of ethos on a massive, societal scale, potentially make us more able to care for people with no social safety nets, especially homeless, disabled, elderly, and underage people, who get stuck in systems that can't -- and often won't -- adequately support them?

and what sort of connections do you like forming that aren't strictly romantic or fall under "the special person" categories? personally I just joined the local theatre group and am going to their social events and it's been a massive boost to my self-confidence

hmm that’s a good question! 

i’m by no means a fandom historian, or like, anything close. this is from my personal experience and a little extrapolation. 

short answer, misogyny manifesting in a “i’m not like other girls” complex.

fanfiction in and of itself is something a lot of people find shameful. it’s not a legitimate form of media, it’s not worth people’s time, it’s in a legal grey area, etcetc. there are a lot of reasons we see fanfiction as some sort of silly hobby for teenage girls (to which i say, fuck you, but that’s not the point) that they give up as time goes on. the majority of fanfiction writers are “younger” women, who write media based on real people or existing media, and who write about things “real” media finds...shameful. 

for example, how many professional porn videos have the women come? multiple times? from clit stimulation? from not just vaginal penetration? how many of these porns have storylines that aren’t terribly acted out? how many of them involve actual, good dirty talk? how much of this porn is made for heterosexual men? how many of it is a guy and a girl? how much of it is lesbian porn made for lesbians?

compare that to what we see in fanfiction. 

another example: how many tv shows/movies can you name that involve wlw pairings? how many of them are explicitly bisexual? how many always have sad endings? how many of them have a sex scene, in comparison to m/f pairings? 

again, compare that to what we see in fanfiction

fanfiction is, to say the least, the rubberband ball of everything “mainstream” media hates. it hates women, it hates doing things for women, it hates giving pleasure to women, it hates it when women love women, it hates hiring women. not to mention how many of these women are women of color, and i don’t think i need to tell you how much the media dislikes them. 

THEREFORE:

it starts a cycle wherein the people who write “good” fanfiction (not x reader) justify their “good” fanfiction” by creating an “other” (x reader fiction) to hate on. “oh, i’m not one of those fanfiction writers,” they tell themselves. it happens in a lot of ostracised/oppressed communities. like, everyone’s cool now with you going to therapy, but god forbid you go to sex therapy. everyone’s cool with you saying you’re doing a face mask as “self care,” but god forbid you need a day off from work to rebalance your mental health. you can be gay, but god forbid you’re trans and gay. you can be trans, but god forbid you look trans. etcetc. 

just, i think the x reader hate comes from infighting, and it representative of a much larger issue.

so this is slightly a mess. while i can understand where this may originate (as in why anti-pot people are inclined to use it) this is def not the way to go about it. so quick history lesson re: marijuana vs cannabis

back in the day what americans referred to as "cannabis" was pretty widely used, primarily for medical purposes - as were many other drugs but that's besides the point.

then in early 1900s with (legal) immigration from Mexico came the MyStErioUs drug called Marijuana (alt: marihuana). which is literally the same damn thing by a different name because of a different language (though any plant can be grown differently and there are many many different kinds of weed that have different effects etc but tangent aside...).

HOWEVER the ignorance of the common American was taken advantage of by politicians and generally racist communities who wanted reason to stop immigration and/or imprison immigrants, without explicitly doing so, as well as find someone to blame the great depression on. So there was an erroneous distinction made between cannabis and marijuana.

it snowballed for decades into the anti-drug as well as furthering anti-immigrant/black/poor etcetc bs we've seen since. (mind you again this is super shallow & quick review and doesn't elaborate on details throughout that time) This seems to have come to a head during the big "drug war" in the 90s that helped populate prisons with people for stupid offenses such as mere possession, which ultimately ruined lives for no good reason.

however, modern day? this distinction between the terms has been exposed as a fraud to the general population and the term "marijuana" is most predominantly used today in the medical community (ie: medical marijuana, for areas that have yet to allow recreational use) likely more so as a safeguard for patients. As pretentious as it may be or seem, professional communities are not going to adopt the term weed or pot not only because it's technically slang (which was likely adopted during prohibition to avoid detection since during the "war" terms such as pot and dope were used as identifiers by the anti-drug community) but also i figure because it is a vague term that could refer to a variety of plants termed as weeds (dandelions for example have been used, especially during the great depression, for ingestion as teas or otherwise) and scientists like specificity. there is no other marijuana than marijuana. some do use cannabis though, and i reckon the reason marijuana may be a more commonly used term now may be because of how popular its prohibition made it as a known term, and cannabis just faded into the background during that time since it wasn't as much of a demonized term due to its origins.

However besides all that this is primarily absurd to me because being a stoner is not an intrinsic identity, it is a chosen one. unlike, say, being a medical patient with a diagnosis that marijuana can alleviate the symptoms of.

it's not the words they choose it's how they use them. if you want to hold onto the community don't give up the real estate.

last but not least a big take away from this is that it is in line with bigoted agenda to deem a term that is primarily used within a certain language as a slur, especially since the ones who demonized it originally were, you guessed it, bigots.

we really need to address this issue.

the m-slur, (marij*ana), really needs to be treated as a slur. the m-slur is often used by anti-marij*ana activists to spread their harmful views on the matter of what we refer to as weed. we see the m-slur on signs, in media, at school, TELLING US THAT WEED IS NOT OKAY. THIS IS NOT OKAY. the m-slur is most prominently used to refer to weed by anti-marij*ana activists. if you are pro-weed, USE THE TERM WEED, NOT THE M-SLUR. THE M-SLUR IS VERY HARMFUL TO STONERS AND MAKES US FEEL AWFUL ABOUT OURSELVES. honestly, the m-slur is a HUGE trigger for me as it makes me think of everyone against weed… we NEED TO ADDRESS THE ISSUE OF THE M-SLUR. WE NEED TO STOP IGNORING THIS PROBLEM.
