छाछ के Packet में मिला Chuha, अर्जी दायर कर 20 लाख रुपये मुआवजे की करी गई मांग

आज कल Packet बंद चीज़ों का ज़माना है। हर जगह लोग Packet बंद चीज़ें खरीदते हैं। ज़रा सोचकर देखिए जब Packet बंद किसी चीज़ में आपको Chuha मिले तो आपको कैसा लगेगा। ये कोई मज़ाक नहीं बल्कि हक़ीक़त है। Delhi High Court ने 9 सितंबर को उस याचिका पर सुनवाई से इनकार कर दिया, जिसमें एक डेयरी कंपनी के छाछ के टेट्रा पैक में चूहे या चिकन का टुकड़ा मिलने का आरोप लगाते हुए कार्रवाई की मांग की गई थी।

High Court ने याचिका खारिज करते कहा कि मामले को उचित फोरम यानी Consumer Court में उठाया जाए। हालांकि, जस्टिस रेखा पल्ली ने food safety department को निर्देश दिया कि वह याचिका पर सीमित समय में जवाब दे।

High Court ने कहा, ‘मुआवजे के लिए Consumer Court जाइए। इसके लिए अलग से अदालत है। आप प्रथम दृष्टया मुझे कुछ भी साक्ष्य नहीं दिखा सके। मैं कुछ भी विवादित तय नहीं कर सकती। मेरी नजर में प्रथम दृष्टया ऐसा कुछ भी नहीं जिससे प्रोडक्ट में कमी साबित हो। यह पहलू एक रिट याचिका के जरिए तय नहीं हो सकता, जिसे खारिज किया जाता है।’ Court ने यह भी कहा कि याचिका खारिज किए जाने का मतलब यह नहीं कि आप Consumer Court नहीं जा सकते।

वहीं, याचिकाकर्ता के वकील शादाब खान ने इसे अपने मुवक्किल के मौलिक अधिकार, खासतौर पर संविधान के अनुच्छेद 21 के तहत मिले अधिकारों का उल्लंघन बताया। वकील ने दावा किया कि ��नकी मुवक्किल शाकाहारी है और बीते साल छाछ पीने के बाद से उन्हें कई शारीरिक और मानसिक बीमारियों का सामना करना पड़ रहा है। बता दें कि याचिका में कहा गया है, ‘याचिकाकर्ता को शारीरिक (पेट संबंधी बीमारियां/ एसिडिटी) और मानसिक असर (डिप्रेशन) झेलना पड़ रहा है।’ याचिका में Food Safety and Standards Authority of India यानी FSSAI और डेयरी कंपनी से 20 लाख रुपये के मुआवजे की भी मांग की गई थी।

So glad that I got to deliver food packets to around 55 houses in remote water logged areas of Sai Nagar, Dindayal Nagar and Krishna Township. Such an exhaustingly difficult task only made possible with assistance of Bhai Saifuddin, Murtaza, Mohammed, Mustafa and the team. My scooter gave up a lot of times due to water filled carborator but nevertheless helped reaching impossibly distant places. When I collected the crate full of food packets from the FMB community kitchen of Syedna Mufaddal Saifuddin, I knew the delivery wouldn't be an easy task. But I had this belief that it will work out and it definitely did. Countless people came to assist us on the road. Some by pushing the scooter in thigh deep water, Others by navigating and giving shortcuts, Some informing us about people in need, Rest by offering us drinking water and boosting our morale. It was certainly a sight worth seeing.
