File 1119-1122 Review

While I am unfortunately disappointed by how the previous Heizuha-confession- build-up cases (File 1113-1118) wasn't continued by another Ōoka/Heizuha build-up case, I thought this Kid-heist-turned-into-murder case was overall a very entertaining standalone case, and surprisingly also the first 4-file case in awhile. It was a very nice way to somewhat incorporate Kudo Shinichi into a case without wasting the spare antidote, by having Kid disguise as him (like he did with Sherry during Mystery train case) with Conan's guidance in order to solve the case. This is the first manga case that we see Kid disguise as Shinichi since the manga confirmation (in File 1018) that events within Movie 3 (like Kid figuring out Conan's true identity) is canon.

It was nice to finally have Hakuba Saguru return after years since his last appearance in the Detective Koshien case (back in Kir arc), and to see him have an indirect meeting with Kudo Shinichi. It was especially exciting to see him come close to not only figuring out that Shinichi is being impersonated by Kid, but also Conan's true connection to Shinichi.

There was great potential for Hakuba's role in the story if he had learned of Conan's true identity and it could have created an interesting rival-dynamic between them, that would be less friendly than Conan's relationship with Heiji (which ironically would be the anime staff's original intention for Heiji when they requested that Gosho introduces a detective rival). Unfortunately, it amounted to only being a mislead and Hakuba only deducing that Conan relayed Shinichi's words through phone to Kid.

While one could still hold out hope that Gosho is playing us further and hiding a future twist that Hakuba only pretended to have not figured it out and decided to protect Conan's secret, it's more likely that Gosho simply decided to properly establish the lines that Hakuba can't cross in DC as a secondary Magic Kaito character and that his involvement in DC will only serve as crossover fanservice rather than anything substantial in the DC story. This is of course disappointing, as he has already made iconic imprints in the DC franchise, and would have gained from getting more spotlight in the DC universe as well (not just MK).

The best part about this case is Shinichi's new affirmations of his feelings for Ran, when they had a cute romantic moment that reasaured Ran that she is still in Shinichi's mind despite avoiding to meet her.

It did its job in resolving some of my yearning for new ShinRan development since them becoming an official couple.

It was interesting to learn how Gosho is further confirming that some movie-only Kid stunts are also canon, seeing as he had Ran point out that Kid has repeatedly disguised as Shinichi, after she figured out his disguise, despite it being the first time in the manga.

This is an interesting implication, because in the already canonized events of Movie 3, Ran never learned that the Shinichi that appeared at the end (to help cover for Conan's identity) was Kid in disguise.

This would mean that Gosho is implying that the Shinichi-disguise stunts in M8, M14, M19 &/or M23 are also semi-canon.

It was only fair of course for Gosho to not tarnish the romantic ShinRan scene in this case by having Hakuba confirm to Ran that it was not meaningless words from Kid, but rather Shinichi's true words.

As for what we can expect from the next case, the official magazine preview for File 1123 was leaked recently that teased that we are getting a Sato-Takagi case combined with the Kanagawa police, which are Chihaya & Juugo (the pair from the recently introduced romance subplot).

It looks like it will basically be a new Juugo-Chihaya romance case with Sato-Takagi developments on the side, and more potential for Hagiwara and Matsuda to come up in flashbacks. It might be a more action-heavy case as well, seeing as it starts off with a car chase in an abduction case, so it's looking to be an exciting case overall. We can only hope that it leads to some main development, like if Gosho incorporates Furuya Rei into the case (in the spirit of the Wild Police gang), and by extension further build on his last requested mission by Falcon Elder to investigate Conan (File 1115)... or even better, continued developments with Rum.

Bucky stood on the side of the room, leaning against the window sill. He's pretending to ignore the argument Steve and Tony find themselves engaged in. It's been a week since Sam decided to play matchmaker and submit multiple endorsements for Alice as the team's analyst.

"I don't get how out of all the analysts in that department this is the one that keeps popping up." Tony complains, looking over the Omega's file again.

"She's qualified and she's worked with us before." Steve reminds him.

"I don't care. This job requires field work. We're not dragging an Omega to a Hydra base with us."

"Why not? She can take it." Sam pipes up from his front row seat on the couch. He looks like he's watching the Superbowl rather than the top Alphas of the pack arguing. Meanwhile, the other Avengers are staying silent and simply observing the chaos.

"Sam." Natasha warns. Tony shakes his head and grumbles under his breath about liabilities. "The point is that her designation literally isn't allowed to be freely put in danger."

"S.H.I.E.L.D is trying to change that." He argues back. "Besides, it's not like we're asking her to fight. We're just asking her to gather intel while we're fighting off the bad guys. We can pair her up with Bucky and -."

"No." Bucky interrupts, finally speaking for the first time since this discussion started. "I won't be responsible for an Omega. On or off the field."

"You're the most qualified."

"I said no. What part of that did you not understand?"

"He has a point..." Steve mutters, staring at the photo of Alice.

"No, he doesn't." Bucky retorts and cuts a glare at Sam. "I'm refusing whatever stupid idea he has cooked up this time. We don't even know if she'll fit the pack dynamic or not."

"What do you want us to do? Bring in another Alpha and hope we don't overload the pack?"

"No, I'm just saying there's options."

"Who?" Tony asks.

"I don't know. One of the Betas." Bucky answers, waving his hand dismissively. He's already had enough of the arguing and Sam in general. This answer only sparked more of an argument around him, not that he paid any attention to it.

In truth Bucky was terrified of meeting Alice. The moment he saw her picture he felt something he hadn't felt in a long time - desire. That feeling only got stronger when he read further into the description included in her personnel file: 5'2", 120 lbs, green eyes and black hair. Fucking perfect. For the first time in seventy years Bucky felt a physical reaction to a woman, even if it was just her picture. The Alpha in him awakening, silently begging him to track the Omega down and attempt to lay a claim. He pushed the thought away, very far away, reminding himself that he's a broken Alpha. She would have no interest in someone like him.

"At least meet with her first." Sam says, pulling Bucky out of the depraved thoughts starting to spiral around his brain.

"I can't believe you're serious about this." Wanda huffs. "She's a liability."

"There's ground work we need to do before we can even go on this mission."

"I think what Sam is trying to say is that we work with her before the mission." Steve interjects, trying to keep control of the discussion before it erupts into another argument. "We let her move up here and do office work. It'll give everybody time to get used to each other. We can use the time to train her a little so she's not as much of a liability and-."

"Who's training her?" Bucky asks suddenly, annoyed by the possibility of someone like Sam or Clint training Alice.

"Funny you should ask. I was thinking you, actually." Tony smirks. "Or do you not want to be responsible for an Omega in a training room either?"

A few of the others laugh which makes Bucky bristle. "If you're all set on this I just want to give her the chance to not die." Steve and Sam share a knowing look, both trying to hide smirks. Tony and Bucky both see through the façade, everyone now curious what the pair is secretly planning. "If she gets hurt or can't keep up, she's done."

"That's fair, but if she can you're watching her back on the mission."

Bucky huffs and gives a curt nod before turning back to the window. Great job, Barnes. That's the best way to make your life easier.

"I'll let Fury know we made our decision. Tony we should make sure one of the den rooms is cleaned up and ready for her."

Tony nods. "Yep, I'll get her set up and get her added to the system."

"We should probably get her an office space or something too." Nat says.

"I can get one of the spare spaces close to medical for her." Bruce offers quietly.

"That's sweet honey, but I'm afraid she'd be overwhelmed with that. She's not used to the chaos and scents like you." Natasha smiles at her Beta mate. "But I'm sure we can find an empty space around here somewhere... Maybe across the hall from the gym?"

"Why there?"

"So we can keep an eye on her when we're busy."

"That tracks." Bruce smiles and stands up, ready to get to work.

"Alright, guys, I think we all have an idea of what we're doing. I'll go talk to Fury." Steve stands as well and motions for Sam to follow him before walking away.

"What's up, man?" Sam asks just before Steve pushes him into an empty room and slams him against the wall.

"What the fuck are you doing?"

"Just making sure the team is well equipped for the mission." He says, flashing a cheeky grin.

"I swear to God I'm not saving your ass when he figures out what you're doing and decides to beat your ass over it. I told you to stay out of it."

"I can't watch him spiral like this anymore, Steve."

Steve sighs and release his hold. "I don't like seeing it either but Buck... Bucky just isn't there yet."

"Neither is Alice." Sam mutters. "She isn't loud or bubbly. Honestly, if I didn't know any better I'd say she's depressed sometimes. This isn't just for him. It's for her too."

Steve shakes his head and sighs. "I can't really be considering this..."

"Two weeks. Give it two weeks and I promise you if nothing happens I'll drop it."

Steve starts at him for a moment with a raised eyebrow. "Two weeks." He repeats and pokes Sam in the chest. "But if either of them get hurt I'll personally let Bucky know who scratched his bike last month and sell tickets to the show. Do I make myself clear?"

"Crystal. Thank you, st- hold on. Bucky's bike? That wasn't me."

"No, I know it wasn't. But he doesn't know that."

Hmm, the plot development in this volume is very interesting, but I don't really know where the cliffhanger at the end is going in the next volume. I'm not quite sure if it's one of my favourite volumes. It's still very enjoyable to read. There are cute moments between Yaiba and Sayaka and I think we've got some character development of Yaiba.

Sonoko, as president of ShinRan's fan club, and our representative, tells Ran that she should go on a date with Shinichi, since they are dating.

At the end of the file, Kid appears as Shinichi (for the first time in canon). All just before the anniversary case. I don't want to have high expectations but...don't you think it's like Gosho is doing a pre-scenario for a ShinRan case for the anniversary in January?

The condition shall be deemed fulfilled when the obligor voluntarily prevents its fulfillment. (1119)

Constructive fulfillment – refers to an obligation prevented by the obligor from happening.

for the condition to be considered fulfilled these two requisites shall be present.

Intent of the obligor to prevent fulfillment of the condition

Actual prevention of compliance

Intent to Prevent Compliance – The law does not require that the obligor acts with malice or fraud as long as his purpose is to prevent the fulfillment of the condition. He should not be allowed to profit from his own fault or bad faith.

e.g. A agreed to give B 5% of the commission if B could sell A’s property at a certain price. B found a buyer that agrees upon A’s terms. To evade the payment of commission agreed upon, A sold his property to the buyer at lower price without B’s aid.

In case the obligor acts voluntarily but not for cause of prevention of fulfillment of the obligation. It is no longer considered part of this article.

e.g. A binds a contract to B to construct him a house, But before the construction is finished, A filed a case against B causing B to be imprisoned and non-fulfillment of the condition.

There is no constructive case fulfillment of the condition in this case.

In Exercise of Right – If the obligation prevented is a violation to a right, the condition is not considered fulfilled.

e.g. A asked B to construct him a house but due to violation of city ordinances, B wasn’t able to finish constructing the house.

Actual Prevention of Compliance – If the result is not specified to the condition set by the obligor. There is no constructive fulfillment.

e.g. A asked B to paint him, but before B could delivered the painting to A, A destroys it.

Provoking Resolutory Condition – when the obligation is subject to resolutory condition and the obligee unjustifiably provokes the agreement. It will not be considered fulfilled and there will be no extinguishment  of rights. The obligee cannot be excused from non-compliance of the obligation.

Case Illustration

Taylor vs. Uy Tieng 43 Phil. 873

Facts:

Uy Tieng, defendant, employed taylor, plaintiff, for two years as the oil mill superintendent. Written in the contract that the machinery to be installed in the factory fail and to not arrive in manila within 6 months, this contract can be cancelled by the defendant. The machinery failed to arrived in manila within 6 months. Because the defendant saw that the oil business no longer promised large returns. After 6 months the defendant decided to revoke the contract and notified the plaintiff of his discharge. Plaintiff sued the defendant for the commission he would have received under the contract. The plaintiff also stated that the defendants voluntarily prevented the arrival of the said agreement, and under article 1186 of the Civil Code, the condition should be considered fulfilled.

Issue: 

Whether or not the defendant is liable for the salary the plaintiff lost under the contract.

Held:

No. Because according to the terms agreed upon the defendant has the right to cancel the contract. Article 1186 is not applicable because it only supposes a case where the obligor is the one who prevented the fulfillment of the obligation, not the obligee.
