Canadian Media Companies Target OpenAI in Copyright Lawsuit But Weak Claims Suggest Settlement the Real Goal
Canadian Media Companies Target OpenAI in Copyright Lawsuit But Weak Claims Suggest Settlement the Real Goal
Canada’s largest media companies, including the Globe and Mail, Toronto Star, Postmedia, CBC, and Canadian Press, came together last week to file a copyright infringement lawsuit against OpenAI, the owners of ChatGPT. The lawsuit is the first high profile Canadian claim lodged against the enormously popular AI service, though there have been similar suits filed elsewhere, notably including a New…

The differences between TFP and Earthspark Optimuses are sooooooo fucking funny. TFP OP is burdened with "I've never seen Prime laugh, cry, or lose his cool," he responds to "Hey Optimus you wanna see something funny?!" with the numbest dead-eyed Eeyore "No," he's just generally Haunted and Stoic every waking moment
Then we have Chuckles McGee with his looney toons ass face winking and making finger guns and giggling nervously and spamming the group chat with emojis and cracking jokes and making "graphic design is my passion" self-help pamphlets
#to be fair i'd also be a numb shell of a man if i had to deal with tfp megatron LMAO#and i could write a whole meta on how Earthspark Optimus's a-hyuck schtick is him masking and putting on a front but that's a whole post#tfp optimus prime#tfe optimus prime#optimus prime#transformers prime#transformers earthspark#transformers#maccadam

I want to double down on what's been said already based on what I know of copyright law:
In Canada, the protected areas for copying are said to fall under Fair Dealing. In the US it’s Fair Use, but the idea is the same - you can copy whatever you want depending on the purpose, whether the amount that you're copying is reasonable for that purpose*, and, critically, whether you are profiting off of someone else's work (which kind of purpose will determine whether you can profit from it. and will vary from country to country).
The list of what exactly is protected under law for copying will look slightly different from country to country, but the following is a pretty typical list of protected areas for copying:
The Canadian Copyright Act Sections 29, 29.1, and 29.2 explicitly state that copying a work is 100% legal for the purpose of
Research
Private study
Education
Parody
Satire
Criticism or review
News reporting
While it could well be argued that fanfic could qualify to be protected as parody, satire, and criticism or review depending on the fic, fanfiction is typically viewed to fall under the realm of education and private study** (which yes, is technically a subset of education, but by "education" they mean formal education like taking a course, going to school, etc).
And those two categories?
Unless the material is registered under a Creative Commons license that allows you to profit, you CANNOT profit off of other people's work in order for your fic to legally be considered fanfic.
So I cannot stress this enough: @just-tea-thanks is 1,010% right: you absolutely could be sued by the owner of the rights to the franchise if you sign up with that site. Why? Because you signed a document saying that you knew about your work being used for profit and aided and abetted the site in profiting off of work it had no rights to.
* You can legally copy insofar as the use and amount of copying are fair, but what that means depends on the situation (there’s a prevailing myth that you can only copy 30%, but no such stipulation exists neither in law nor in Supreme Court decisions). In the case of CCH Canadian Ltd. v. Law Society of Upper Canada in 2004, for example, it was determined that it’s fair for a lawyer to copy an entire court decision to use for preparing their defence.
** The Supreme Court’s decision on Alberta (Education) v. Canadian Copyright Licensing Agency (Access Copyright) very deliberately and explicitly states that private study need not be a single person viewing the material.
I got this comment on a story from my Other AO3 Account this morning.
(Info redacted because I prefer keeping these accounts separate but no one follows me on the side blog I have for that account.)
The story was posted almost a year ago and is relatively “popular” by my average statistics even though it has tropes and themes that are big turnoffs for a lot of people (hence separate accounts). This popularity is undoubtedly because it’s a Marvel Loki story and that fandom is massive.
So there is obviously an algorithm or a bot scrubbing ao3 statistics and leaving this comment on fics that meet a certain metric with the main character of the fic inserted into the comment.
I had a little time to kill this morning so I decided to investigate further. And y’all this is so predatory. Come on this journey with me. It made me mad. It may make you mad.
First, if you go to Webnovel’s website, you HAVE to choose between male lead or female lead stories before you can go any further. WTF?
And that’s weird, but this gets so much worse. This is basically a pay-to-read site that has different subscription models. Which… okay BUT! The authors don’t get paid! Look at that comment again. They’re promising a supportive and nurturing community, but zero monetary compensation. It’s basically, “post your stuff here so we can get paid and you can get… nice vibes?” I mean look at this Orwellian writing:
Using the phrase “pay-to-read model” in the same sentence as “qualitative changes in lifestyles for authors” deliberately makes you think that you can get paid and maybe even make a living on this website. But that’s not actually what it says and authors will not receive one red cent.
Oh but wait, the worst is still to come. In case this breaks containment (which I kind of hope it does) this is where I mention that I’m a lawyer in the US.
I don’t do intellectual property or copyright law but I do read and write contracts for a living. So I went to look at their terms of service. It was fun!
Highlights the first, in which Webnovel gets a license to do basically whatever they want with content you post on their site. This is how they get to be paid for people reading authors’ writing without paying them anything.
Highlights the second, in which Webnovel takes no responsibility for illegally profiting off of fan fic. This all says that the writer is 100% responsible for everything the writer posts (even though only Webnovel is making money from it).
Highlights the third which say that by posting, the author is representing that they have the legal right to use and to let Webnovel use the content according to these terms. So if a writer posts fan fiction and Webnovel makes money from people reading the fan fiction, and the House of the Mouse catches wise, these sections say that that’s ALL on the writer.
So that’s a little skeevy to start off with but the thing that is seriously shitty and made me make this post was that these assholes are coming to ao3. They are actively recruiting people in comments on their fan fiction. And they are saying they are big fans of the character you’re writing about and that they share your interests.
They are recruiting fan fiction writers and giving every impression that you can make money from posting fan fiction on their site and hiding the fact that you absolutely cannot but they can make money off of you while you try, deep in their terms of service which no one but a lawyer who writes fan fic and has some time to kill will read.
I see posts on here regularly from people who don’t understand how this stuff works, don’t understand that they (and others) can not legally make a financial profit from fan fiction. And there are tons of people who will not take the time to dig into the details.
Don’t deal with these bastards. Fuck Webnovel.

The boundaries of Steve and Robin's friendship quickly become all but nonexistent. They can talk to each other about anything, ask each other about anything
And Robin has questions
She's never seen a dick before, has no real intention of seeing one in the future, and finds the concept of them both mysterious and weird. But she can admit to a certain amount of academic curiosity about how they work. And then she remembers that her best friend, Steve, is A Guy™ and could surely answer at least some of her questions
Meanwhile, Steve, due to the aforementioned lack of boundaries, has all but forgotten that he never actually came out to Robin as trans. He's been merrily carrying on just assuming she already knows
These two facts collide one day at Family Video when they're both idly watching some mindless teen movie they've put on for the day while waiting for customers to show up. They reach what seems to be a very contrived skinny dipping scene, which makes Robin think, and she turns to ask Steve, "Hey, do dicks float in water?"
And Steve, without even looking away from the screen, shrugs and asks her, "How the fuck should I know?"
It takes half a minute of silence for him to realize that Robin is staring at him with no small amount of bewilderment and concern
(They later come to the agreement that they'll just have to wait and see if Steve ever gets a boyfriend, and then ask him all their dick-related queries)
#which means poor Eddie is going to have to deal with the both of them throwing weird dick hypotheticals at him#like they're spitballing ideas for a middle school science fair project#platonic stobin#robin buckley#steve harrington#trans steve harrington#ftm steve harrington#stranger things#solar wrote

DP x DC Camp
The Batfam force Damian to go to summer camp to socialize with kids his own age and have some normal childhood experiences
That’s all well and good, but normal does not describe his cabin’s councilor, one Daniel “for the love of Ancients call me Danny” Fenton
Between the son of the bat and a Fenton, camp is going to be weird
#danny phantom#dp x dc#dp x dc crossover#dp x dc prompt#danny fenton#dpxdc#writing prompt#writing#detective comics#camp counselor Danny#putting on the pep and trying to manage a group of 13 year olds#or ten#dealers choice DC timeline is a pain to deal with#Damian has gone from 10-14 I think? meanwhile Tim is still 17#and yes I know Danny went to space camp#but to be fair a more traditional camp experience would probably be more story convenient#and he’s been camping#with his family#that’s not even counting his mom going full marine in enemy territory survivalist mode#Danny is going to have some weirdly specific camping skills is what I’m saying

yall like to pretend that "don't split up" is the most obvious rule in any horror scenario, but what's the alternative? stick together and cooperate ? to find a solution? in a life-or-death situation??? babe surely you have been in enough group projects to guess how that shit ends
#honestly would prefer to try to strike a work-study deal with the Killer#rather than team up with your average group of horror movie characters#listen. the Killer has their shit together. they've planned this. they have clear goals. they have tools. they have a timeline.#whereas the So-Called Protagonists decided it would be 'fun' to get drunk in a cabin in the woods with no cell reception#honestly i'm siding with the Killer on this one. at some point that's fair game. ethically sourced murder victims

The Law Bytes Podcast, Episode 206: James Plotkin and David Fewer on Canada's Landmark Copyright Ruling on Fair Dealing and Digital Locks
The debate over copyright and digital locks – technically referred to as anti-circumvention legislation – dates back more than 25 years with creation of the World Intellectual Property Organization’s Internet Treaties and later in Canada with the enactment of the Copyright Modernization Act. The full scope and application of those digital lock rules has been the subject of considerable…

Part 1 | Part 2 | Part 3 | Part 4
Over the centuries, many poets, writers, painters, and sculptors were suspected of having Hanahaki. It seemed appropriate for an artist. A disease as poetic as it was tragic.
That's why, despite its rarity, Hanahaki was a famous disease.
Books, movies, plays, songs. It wasn't uncommon to find some portrayal of Hanahaki in the media. Everyone had some romantic and silly idea of what it was like to have Hanahaki.
Usually, this knowledge was limited to emotional triggers and the fact that the sufferer lived with a chest full of roots. Sometimes, people believed that Hanahaki could be cured through love.
Steve hated that idea.
Because he knew nothing would cure him. He could get a lung transplant, a heart transplant, a liver transplant, a kidney transplant, or any other organ that failed. The most likely outcome was his lungs. He would probably need a lung transplant one day, considering how much scar tissue he had accumulated in his chest. Pulmonary fibrosis was a bitch.
But he wouldn't be cured, he would just have more time.
His mother had managed to improve her quality of life by following Mr. Harrington around the world. They even seemed quite happy sometimes. Steve figured that staying away from him, having few feelings for him, helped too, after all, he was one less thing for Mrs. Harrington to worry about, since she put most of her feelings into her husband.
And if not even his mother, who understood him better than anyone else in the world, was capable of truly loving him, who would be?
Hanahaki could not be cured through love, and Steve preferred it that way, or he would have to face the reality that he was not loved as much as he wanted.
But Hanahaki could be controlled as long as he was on medication, treating the complications, monitoring the disease, and having a support network. People who would take care of him, who would not hurt him so easily. Being loved so intensely helped, because his body would understand love. It would not cure the disease, but it would ensure a slower progression, giving his body more time to recover.
The positive side of the Upside Down was this. Steve gained the children, Robin and Eddie. With Eddie, came Wayne. And even Joyce and Hopper cared immensely for him, even if they were more busy being the parents their children deserved. Nancy and Jonathan were a more complicated subject, and yet they were trustworthy.
Steve found himself surrounded by more love, loyalty and protection than he could have ever dreamed of.
The negative side, besides all the trauma, was that having so many people close to his heart meant that each of them had immense power over Steve, and, except for Robin, none of them knew it.
So when Eddie and Wayne left, he smiled and accepted it graciously. He tried to help them move, but his health had become increasingly declining and they rejected any help. Instead, he simply wandered around their new house, watching as the people he had grown to love, who shared so much of his pain, fears, and traumas, helped make it a home.
When he got tired, Steve decided to sit in the garden and eventually fell asleep there.
That was another thing Steve had learned to hate: it seemed like the disease had decided to finish him off. Even though he had been sick for most of his life, everything was manageable, easy to hide except for the flare-ups. When the flare-ups were over, he would bounce back and be his old self again. A tired, aching, constantly medicated young man. Not anymore.
He would have terrible days, get a little better, and then have a worse day. It was like taking 3 steps back, 2 steps forward, and then 2 steps back again.
It had become impossible to go a whole day without taking at least one nap.
When he woke up, restless and with his heart racing, it was still light out, so it couldn't have been that long. Robin was there, staring at him intently through her hair, her eyes a little teary.
"You scared me, Dingus." Steve blinked, still feeling a bit of the brain fog that was becoming more and more common. "Your parents still pay for your health insurance, don't they?"
For the next three weeks, Steve and Robin were absent from activities and meetings with everyone else a lot. Steve because he had to go for tests, Robin because she wanted to be with him through it all.
"It's good that you have such a great girlfriend, Steve." The doctor, who had known Steve for years, commented almost too happily. "It'll be good for your health." The look of pity she usually wore when she met Steve seemed softer.
He had some blocked bile ducts, and they put in biliary stents. His platelets were low, and he received a transfusion. Since there were too many remnants of roots in his chest and throat, Steve had to stay in the hospital for two nights, dissolving and aspirating everything, to make sure he would be okay to go home.
He was also given a vitamin supplement, his medication was adjusted, and he discovered that he would need beta blockers to slow his heart rate and reduce the chances of having an upper gastrointestinal hemorrhage.
They also discussed the possibility of another surgery. Steve refused.
On the way home, Robin tried to convince him to accept it, to remove all the roots, every single one of them. “I don’t want to. With each surgery, there are more scars.”
“Who cares about a few scars? Steve! You… You never did, why now? Nobody gives a shit about that, and if some girl complains about it, she doesn’t deserve you!”
“On my lungs, Robin. I don’t think it’s worth another surgery right now, because it’ll just give me more scar tissue. They’re too deep, so it’s probably better to wait for them to get worse rather than dig through my chest to rip them out. Eventually, I’ll need a transplant, I guess, and I figure it’s better to put off unnecessary risks until there’s no other option. I don’t know. Does that make sense? I don’t want to have another surgery, just to delay the inevitable. Maybe it’s stupid, but…”
He paused, trying to find ways to say what he wanted to say.
“Sometimes I think if I keep doing all this, I’ll be so patched up that there won’t be anything left in the end. It’s stupid, isn’t it?” Steve laughed self-deprecatingly.
After that, they sat in silence until they reached Steve's apartment, and before they went in, Robin grabbed his hand and looked into his eyes with such intensity that he wanted to squirm.
"I'll be your donor, Steve. I have two perfectly healthy lungs."
"Robin…" She swung her arms so aggressively that she almost hit the door, and Steve's hand, which was still between hers, froze in midair. Robin's eyes widened even more, and she pulled his hand again desperately, as if letting go would make him disappear into thin air.
“If I’m not a match, I’ll steal it, Dingus. I swear I’ll steal all the organs you need with my own hands.”
Steve laughed and hugged him, because what else was there to do?
They spent the whole night snuggled up on the couch, watching movies until they fell asleep. Steve, who spent the whole day taking naps and had insomnia at night, woke up after a few hours, as usual, and almost went to Eddie’s room, before he remembered that Eddie wasn’t there anymore.
Steve coughed, just a little, with longing.
He looked at Robin, illuminated by the soft glow of the television, then looked out onto the balcony and, despite his better judgment, woke her up, who was alarmed until she realized he was smiling.
"I’m in love with Eddie."
#I wanted to write more about the romantic side of things#But I think it's fair to focus more on dealing with the illness#even if that focus is superficial#I think chronic illnesses are often poorly portrayed and that's kind of annoying#Anyway#I'll try to focus on the steddie in the next part#But I'm bad with dialogue#so it should be more about describing what's being said than actually writing what they say#Yes#Eddie will be here in the next part
