By • Olalekan Fagbade ‘It’s illegal’ – former Senator faults President Tinubu’s recent appointments into NNPCL A former senator representing Imo north, Ifeanyi Araraume, has described recent appointment made by President Bola Tinubu in the Nigerian National Petroleum Company (NNPC) Limited as illegal. According to The Cable, President Tinubu last week made some managerial appointment in the NNPC in which he retained Mele Kyari as the chief executive officer of the agency and appointed Pius Akinyelure as the non-executive board chair. It will be recalled that former President Buhari had appointed Ararume as board chairman of the national oil firm in September 2021, but he was later sacked and replaced by Margaret Okadigbo in January 2022. The former senator later went to court and was able to void his removal as NNPC chair and even secure a N5 billion payment for damages. In a public notice on Saturday, through Ogwu Onoja, his attorney, Araraume said Tinubu’s appointments are illegal and contravene a subsisting court order. “We state that the purported appointment amounts to a flagrant disobedience of court order and brazen disregard of the judgment of a court of competent jurisdiction,” the former senator said. “We are appalled and shocked that the President could brazenly disobey the court judgment by purporting to appoint a new board and management team for NNPC Ltd instead of giving implementation to the said judgment of the Federal High Court delivered by Justice Inyang Ekwo on the 18th of April, 2023. “It is shocking that rather than obey the valid and extant judgment of the court, the President has taken the laws into his hands to overrule the courts and usurp the jurisdiction of the Court of Appeal before who, the President has filed an appeal which is pending, by taking steps to undermine the judgment by such illegal appointments. “This singular act of Mr. President unfortunately denotes a wanton disregard for rule of law and a direct affront on the Judiciary. “With the said judgment still valid and subsisting, it is clear as crystal even to the common man that the appointment of the new Board and Management of the NNPC Ltd by the President on the 27th November, 2023, is illegal, wrongful, null and void and of no legal consequence. “By this Notice, the general public is therefore warned to beware of those illegal appointments in their own interest. “The public is urged to avoid having any dealings whatsoever with the new board and management of the NNPC Ltd as anyone who goes ahead to do any business or transactions with them will be doing so at his or her own peril.” Araraume asked Tinubu to reverse his decision and allow the flow of the rule of law.

Court Of Appeal Rules On PDP’s Suit Against Tinubu, Shettima’s Candidacy, Awards N5million Against Appellant’s Lawyer In a unanimous decision on Friday, a three-member panel led by Justice James Abundaga held that the PDP had failed to establish locus standi to bring the case and hence, held that the appellant did not have the right to commence the action in law. The Court of Appeal in the Federal Capital Territory, Abuja, has dismissed an appeal suit filed by the Peoples Democratic Party (PDP) seeking the disqualification of Bola Tinubu, the presidential candidate of the All Progressives Congress (APC), and his deputy, Kashim Shettima, in the February 25 election. In a unanimous decision on Friday, a three-member panel led by Justice James Abundaga held that the PDP had failed to establish locus standi to bring the case and hence, held that the appellant did not have the right to commence the action in law. According to reports, the PDP asked the appellate court to overturn the January 13 judgment delivered by Justice Inyang Ekwo of a Federal High Court in Abuja, which dismissed its suit on the grounds that the PDP lacked locus standi to file the suit. While the PDP was the appellant, the respondents in the appeal were the Independent National Electoral Commission, INEC, the APC, and Tinubu and Shettima. The PDP had challenged the Tinubu/Shettima ticket for the 2023 presidential election in a lawsuit filed on July 28, 2022. It claimed that Shettima's nomination as running mate violated Sections 29(1), 33, 35, and 841(2) of the Electoral Act of 2022 (as amended), claiming that Shettima had double nominations. It claimed that at the time Shettima was nominated for vice president, he had not resigned or withdrawn his nomination as a candidate for the Borno Central Senatorial election. The party claimed that Shettima's nomination as a vice presidential candidate as well as a senatorial candidate for Borno Central violated the law. The PDP, which sought an order barring the APC, Tinubu, and Shettima from running in the presidential election scheduled for February 25, also asked the court to strike down their candidature. #pdp #nigeriaelections2023 #mci https://www.instagram.com/p/CqNmC06Iwku/?igshid=NGJjMDIxMWI=
