FRANKFORT – Potential mothers could claim child support during pregnancy under a new proposal before the Kentucky legislature.
House Bill 243, filed by Republican Reps. Amy Neighbors of Edmonton and Stephanie Dietz of Edgewood, would change Kentucky law to claim child support "at any time following conception."
The bill is designed to support pregnant mothers, Neighbors said.
"There are a lot of costs associated with a pregnancy and basically getting ready for baby," Neighbors said, pointing to car seats, other needed supplies and lost work time when a pregnant mother has to attend doctor appointments.
But abortion-rights advocates see the bill as part of an attempt to advance an anti-abortion agenda by laying the groundwork for fetal personhood under Kentucky law.
Bills based on the idea that a fetus is a person have been filed across the country after the Supreme Court's overturning of Roe v. Wade in 2022.
Neighbors said her decision to introduce the bill was not directly influenced by Kentucky's ban on most abortions but rather by a desire to support women during pregnancy.
The measure also would allow paternity testing prior to birth, as long as it's safe to do so, Neighbors said.
The bill was sent to the Committee on Committees on Jan. 11. Neighbors said she believes HB 243 will have widespread support from House Republicans.
Critics see bill as attempt at fetal personhood
Abortion-rights advocates told The Courier Journal the measure is an attempt to cement into law the belief that life begins at conception.
Rep. Lisa Willner, D-Louisville, said the measure would create a "slippery slope" for pregnant people.
"What the bill would do would be to grant full personhood to an embryo from the moment of conception," Willner said. "These so-called personhood laws could result in a pregnant woman facing child abuse charges and even incarceration if she seeks treatment for drug or alcohol abuse.”
“The legislature should instead focus on bolstering actual support for pregnancy, such as ensuring insurance access, covering doula and midwifery services, and expanding mental health supports," Willner said.
"This bill is an underhanded attempt to advance an anti-abortion agenda and lay the groundwork for fetal personhood in state law by allowing people to seek child support for a fetus," said Tamarra Wieder, Kentucky state director for the Planned Parenthood Alliance Advocates.
Wieder is also concerned the bill would open the door for surveillance of pregnant people because it would require the state to verify their eligibility for child support. She agreed with Willner that the legislature should focus on health care during pregnancy.
Planned Parenthood will ask its supporters to call legislators and express their opposition, Wieder said.
"We may actually be able to stop this because Kentuckians don't want more restrictions to abortion, and this is another abortion restriction that would be codified in law," Wieder said.
But when asked when asked about the comments from abortions-rights supporters, Neighbors said, "I can’t stress enough that my goal is to simply be supportive of mothers, children, and families."
National trend
The bill is the first Kentucky measure Willner has seen that creates a potential personhood definition for a fetus, she said.
But other states and Congress have considered, and in some cases adopted, similar bills around child support.
In 2021, Utah adopted a measure that requires fathers to pay 50% of the mother's pregnancy expenses. Indiana's legislature last year expanded the list of childbirth-related expenses fathers could be held responsible for paying, though the legislature stopped short of categorizing those payments as child support.
Georgia's abortion law applies the state's child support rules to any fetus "with a detectable heartbeat."
Washington Republicans have introduced bills similar to the current proposal in Kentucky. Sen. Marco Rubio, R-Fla., and Rep. Ashley Hinson, R-Iowa, in December introduced in their respective chambers the "Supporting Healthy Pregnancy Act," which would require biological fathers to pay child support for medical expenses during pregnancy.
"These bills are often introduced by folks who are pro-life or anti-abortion who believe that a fetus or unborn child is a rights-holding person," said Mary Ziegler, a law professor at the University of California-Davis. She is writing a book about the fetal personhood movement.
"The strategy behind them is to set a precedent that, you know, that life in the womb has rights essentially, which would obviously have extensions to abortion too," Ziegler said. "Essentially it would mean liberal abortion laws would be unconstitutional."
A separate Kentucky bill introduced by Sen. David Yates, D-Louisville, would add exceptions for rape, incest, maternal health, and lethal fetal anomalies to Kentucky's near-total ban on abortions. __________________

A compassionate, humorous young man with his whole life ahead of him.
That's how friends and family described Hamza Mohamed in victim impact statements read before the Court of King's Bench on Wednesday. The 22-year-old was shot to death nearly three years ago during a Jamaican community event at the Duggan Community Hall near 37th Avenue and 106th Street.
Six other men were injured in the shooting.
"Hamza was a charismatic, gentle, and a kind soul who was bursting with goals and aspirations," his cousin, Naima Hussein, said in a victim impact statement read before court.
"Unfortunately, none of those goals he had for the future came to fruition because his life was cut short." [...]

I've found a lot of enjoyment of translating skills and tropes into other media/medium/mechanics, whatever. This has led to me building out D&D character sheets for a good chunk of Edmonton and a few other players where the mood strikes me. It's less of a specific plot (I presume each team is an adventurer's guild running off and doing quests, monster of the week style) and more of a broad imagining of backstories and how everyone got together.
Here's just a list of the sheets I've built?
McDavid - Human Fighter (Banneret). Extremely generic build with notably low CHA. Plays a somewhat supportive role in his fighting.
Draisaitl - Tiefling Rogue (Arcane Trickster). First in his family to manifest their demonic heritage in generations, family didn't take it well. Left home and was a bounty hunter before becoming an adventurer. Most of his spells are to make up for his terrible CHA stat plus general utility.
Hyman - Human Paladin (Devotion). Came from a noble family and decided to use his strengths for good, much to their chagrin. The most traditional "hero" archetype you can imagine. He's just a good dude.
Nugent-Hopkins - Owlkin Druid (Shepard)/Monk (not enough for a subclass at the level I've built him at). Came from a circle of druids out in the wilds protecting the people from anything that may slip from the Feywild. He is admittedly the wildest character I built out of everyone. Ice and animal magic. The team hates his choice of creatures - they're bad at target selection.
McLeod - Aasimar Bard (Swords). Supposedly "destined for great things," then ran away to join the circus instead of dealing with that. Learned how to use his weapons and magic there. Joined the adventurer's guild a few years later. Magic is mostly disruption-focused with an offensive lean.
Bouchard - Elven Fighter (Arcane Archer). Another person from the wilds as a Ranger-style character but without the terrible class mechanics. Similar to Nugent-Hopkins, was charged with protecting the wilds from aberrations or preventing monsters from spilling out into more populated areas. Plays a sniper-esque role.
Skinner - Earth Genasi Wizard (Abjuration). Came from an area of the world with greater contact with the Outer Planes, or stranger dimensions. Learned a wide variety of magic before setting out and making a name for himself with his buddy. Defensive magic is his specialty, but he does have a gun if necessary.
Desharnais - Goliath Barbarian (Juggernaut). Met Skinner and decided to travel with him. Fighting style is essentially he plants his feet and doesn't move, but you can't move him, either.
Gagner - Human Cleric (Tempest). Older adventurer who prefers to manage the back end of the guild these days, but still absolutely capable of killing you. Outside the requisite healing magic, he focuses on destructive area of effect spells.
Yamamoto - Halfling Sorcerer (Wild Magic). Sorry buddy. Court aide to some powerful party in the local city. Hides under his cheerful goofy vibes to deal massive amounts of psychic damage.
Matthews - Air Genasi Barbarian (Desert Storm Herald). Comes from a different far off land (Arizona equivalent lmao) to gain working experience. He runs around and hits things.
Marner - Half-Elf Sorcerer (Lunar) / Warlock (Great Old One). Was expected to be a very powerful sorcerer from his family, but his magic never successfully manifested; took a deal with a... something to be at the level everyone expects him to be. Lies a lot - good thing he's good at that. His spell list is a mess: half of it's telepathy or psychic powers, the other half is his moon magic.

An Edmonton mother facing deportation to the Philippines has been granted permanent resident status, bringing an end to her eight-year battle to remain in Canada.
Evangeline Cayanan was initially scheduled to be deported last July, along with her seven-year-old Canadian-born daughter, McKenna's mother and daughter, with the support of advocates across the country, fought to remain in Canada.
On Thursday, Cayanan was informed by Immigration, Refugees and Citizenship Canada that her permanent residency application had been approved.
Cayanan, who first came to Canada in 2010 as a temporary foreign worker, spent a brief time in Ontario before moving to Edmonton in 2011.
She lost her status after she reported two employers for alleged abuse, including unsafe working conditions, harassment and discrimination.
According to federal court documents and her lawyer, she alleges one of the employers accused her of theft as retribution. Cayanan was charged with one count of theft over $5,000 in 2014, but prosecutors stayed the case in 2015, according to court records.
Her lawyer said she wasn't even in the country at the time of the alleged theft lost her work permit and wasn't able to apply for refugee status became undocumented in 2015, the same year her daughter McKenna was born. Cayanan then became an activist.
"I was so happy I was jumping on the bed," Cayanan told CBC News Friday can finally breathe … because I have been living in the shadows."
Cayanan said she was grateful for her supporters and for the certainty of her future in Canada and said she will pay back the community by continuing to advocate for migrants and helping others like the system.
The temporary foreign worker permits are tied to a specific employer meaning workers can only legally work for the employer named and that permit cannot be switched once in Canada.
"My situation is not unique," Cayanan said I am happy about the news, and I am hoping the government will still look into the other 500,000 undocumented.
"There is a growing number of undocumented migrants here. Those who have already established their lives here have their families here … and we are not a burden, they are not a burden because they are working under the table without legal status, we are being used, abused and exploited."
Cayanan filed applications to stay on compassionate and humanitarian grounds in 2016 and 2019, both of which were rejected and were set to face deportation in July 2022 but it has stayed before her removal from the country, she was granted a one-year postponement of her deportation.
While facing deportation, she also filed a pre-removal risk assessment, arguing it would be unsafe and that she and her daughter could face persecution in the Philippines.
Her daughter lives with ADHD and other developmental challenges, and Cayanan argued that a return to the Philippines would exacerbate her medical issues.
Cayanan also feared retribution for her activism and public criticism of the country's government if she were to return won an award from the John Humphrey Centre for Peace and Human Rights for her work fighting for healthcare access for the children of undocumented parents also a volunteer with Migrante Alberta, an organization supporting migrant workers.
Marco Luciano, a director with Migrante Alberta, said Cayanan's story illustrates the challenges migrant workers face in gaining a permanent foothold in the country.
Like Cayanan, many people come to Canada under the Temporary Foreign Worker program but lose status, all while new workers are brought into industries hungry for workers.
"Her case is very, very important," he said one victory, this is very important for the whole struggle to regularize the status of all undocumented migrants."
Canada is increasingly reliant on temporary foreign workers to Statistics Canada, the number of people in the program increased seven-fold from 111,000 in 2000 to 777,000 in 2021 and has also expanded its reliance on the workforce, loosening restrictions on the hiring of new temporary foreign workers last year.
But the path to permanent residency is often difficult, leaving thousands of people without status federal government is working on a program that will provide avenues to permanent residency for up to 500,000 immigrants who are working in Canada but do not have official standing.
Prime Minister Justin Trudeau committed to the mandate in December 2021 but the details of the program, and its timeline remain unclear.
The program needs to be broad and inclusive, and it needs to happen soon, Luciano said the Canadian government promised regularization," he said.
"Now is the time for the federal government to step up and value those promises."
