Barki Believes It’s Time for Equal Justice for All

He’s seen it. And he’s witnessed the crime get worse on the streets and in the neighborhoods of the Northern Panhandle, and that’s why Brooke County Prosecutor Joe Barki launched his campaign to become the next Circuit Court Judge in West Virginia’s First Judicial District nearly a year ago. Barki believes the punishment needs to fit the crime once again. The 51-year-old Brooke High graduate began his career as an assistant prosecuting attorney nearly 24 years ago in Ohio County, and he’s served as the elected Prosecutor in Brooke County for the past 12 years. The father of three once was a member of the West Virginia State Police because earning his law degree at the Delaware Law School at Widener University. “The short answer why I want to become a judge now is because I believe it’s time for a change for the people of the Northern Panhandle. I believe our community needs a judge who reflects more of the community values that we have nowadays,” Barki said. “It’s time for us to hold criminals accountable, so we need a judge who understands the problems that we've been dealing with for several years. Barki, seen here with his family, believes it is time to hold today's criminals accountable for the violations they commit. “I’ve been a prosecutor for 20-plus years so I’ve been dealing with the crimes, and with the changes in the criminal activity that’s taken place up and down the northern panhandle. I’ve seen firsthand how these crimes have affected the victims, their families, and the communities, too,” he said. “I feel I am at the point in my career now that I could really address the problems we have now from the bench, and I believe I’m the best person qualified to do that now and in the future.” Barki’s opponents in the non-partisan race include Wheeling attorney Dean Elliott Williams of Triadelphia, Ohio County, and the incumbent, the Honorable Ron Wilson of Weirton, who was first appointed to the bench 43 years ago at the age of 43. The primary election on May 14th also lists three other unopposed circuit judge candidates in the 1st Judicial Circuit, including incumbent David J. Sims in Division 2, incumbent Jason A. Cuomo in Division 3, and incumbent Michael J. Olejasz in Division 4. “The differences between me and the others in the Division 1 race are pretty stark,” Barki explained. “I want to make a positive impact on the community and not do the job the way it’s been down for more than 40 years. The crimes have changed and that means we, as a judicial system, have to evolve with it or the determent to commit crime isn’t there anymore. “I’m a person who grew up in this valley, and that means I’ve always been held accountable for my actions. And not only did my parents hold me accountable, but so did the adults in my neighborhood in Windsor Heights,” he said. “I believe the same should be true in our courts and that’s what I would bring to the position.” Barki, a father of two daughters and a son, was a state trooper in West Virginia before graduating law school in Delaware and before an attorney. The Wheels of Justice He grew up on First Street in Brooke County’s Windsor Heights, and Barki wanted to be a ball player growing up just like his idol and neighbor, Joe Pettini. The Brooke High graduate played his college ball at Mercer University where he started 196 consecutive games before he was signed in 1977 as an undrafted free agents by the former Montreal Expos. Pettini was traded to San Francisco in 1980, and the infielder mad ehis major-league debut later that year. “Every single kind in my neighborhood dreamed of being the next Joe Pettini, and that included me,” Barki said with a broad smile. “Pettini had something special, that’s for sure, but I wanted to be in the NFL, too, and I also thought about becoming a dentist. “But then I was introduced to the legal system and law enforcement, and that’s why I went to the academy and became a West Virginia State Trooper,” he explained. “Soon after that, I became interested in becoming a prosecutor, and I did what I had to do so I could and started 24 years ago in Ohio County and I’ve never looked back.” It's all about adventure when the Barki family travels together, including this trip to Yosemite. Since his first day, Barki has seen fist fights turn into shootings, a frightening increase in crimes against children, and drug trafficking turn into a constant crisis. Some cases, such as murders, large-scale narcotics arrests, and crimes involving animal brutality grab headlines, but another part of a circuit court judge’s job is to review possible plea deals. “As the prosecutor in Brooke County, it’s impossible for my office – even if we wanted – to try every single criminal case. And that’s true everywhere because that’s the reality of the world,” Barki said. “The vast majority the cases are resolved through plea agreements because that’s how the wheels of justice work, so that’s why a change in the position is so needed because what worked years ago is not working anymore. “If people aren’t held accountable for their actions, how can we expect the justice system to work? If it’s dysfunctional, how can we deter criminal activity in this panhandle? That’s why, right there, I’m running for the position. There has to be repercussions that fit the violation or someone who breaks the law will never change their behaviors. “Severe Sentences Levied At Border By Justice Raney,” Toronto Globe. October 29, 1930. Page 19. ----- ‘Gunmen and Gangsters’ Learn That Laws Must Not Be Flouted --- ARMED THUG IS MENACE --- (Special Despatch to The Globe.) Windsor, Oct. 28. - Seven men who were found guilty at the Sandwich sittings of the Supreme Court were sentenced to long terms in the Ontario Penitentiary at Portsmouth by Justice W. E. Raney this afternoon.

Charles Zenkauscas, 26 years old, convicted of stealing jewelry, bric-a-bric, and clothing from the Puce summer cottage of Dr. E. L. Giffen, Detroit, dentist, was sentenced to 14 years for this offense, seven years for possessing firearms with intent to commit bodily harm. Zenkauscas has a long prison record and is wanted in Waterbury, Conn., his home city, for bank robbery.

Albert Kurtinitis of Detroit, convicted of smuggling firearms into the Essex County jail to Zenkauscas, and Fred Robinet and Clarence Jacobs, both of Tecumseh, who were arrested in the house where Zenkauscas had the stolen property, were each sentence to serve seven years.

Twenty Years Thomas St. Clair [or Sinclair], 29 years old, and William McCrea, 30 years old, who held up the Government beer warehouse in Windsor, taking approximately $3,000 from the manager, were sentenced for the robbery, and also for retaining stolen money. St. Clair was sentenced to serve 20 years on the first charge and 10 years on the second. McCrea was sentenced to serve 15 years on the first charge and 10 years on the second. The sentences are to run concurrently.

Kenneth Threselton, 26 years old, of Windsor, was sentenced to serve 10 years for the theft of a radio, and for shooting at an officer while trying to escape.

Justice Raney characterized all these as ‘gunmen and gangsters’ and said the severe penalties were not given in a spirit of retaliation, but rather for the protection of society. He added that all of them were headed for the gallows had they not been restrained.

Manslaughter Sentence. Joseph Martin, 26 years old, of George Street, Amherstburg, charged with murder was convicted of manslaughter, and sentenced to 10 years. He was arrested for the slaying of Clarence Dolman, 19 years old, of Windsor, who died from a stab wound in the abdomen, caused by Martin. Dolman interfered on behalf of Martin’s sister when she was being beaten by her brother and another man, and in the scuffle, Martin inflicted the fatal injury.

[AL: Charles Zenkauskas (#1922) had been in penitentiary before in the States. He worked in the tailor shop at Kingston Penitentiary, and walked the ‘chalk line’ in the penitentiary. He was prominent in his shop, along with Cecil Irving, in being opposed to the growing resentment and organizing for a demonstration. Indeed, he refused to go along - “it was a foolish thing...a dangerous thing” made worse by the fact that the officers “did not handle things well.” Indeed, he though the Deputy Warden was like an “old women” who needed to be “a little more strict.” He felt that most of the officers complained about by the other convicts were not accurate - “you will find that the fellows who get the most marks and dockets are the fellows who are in trouble where ever they go.” He knew that getting through prison meant that “fellows who behave themselves get treated all right.” For all that, he was shot at during the last day of the riot, while hiding in a cell on the 4th tier - with two inmates who were considered ringleaders of the disturbance, men he claimed wanted to harm him. After the riot he was moved to the carpentry shop and continued to work and keep his head down. He was moved back to Tailor Shop #2 in 1935, and was interviewed by the Inspector of Penitentiaries in 1939 - he complained about the bad equipment and poor organization of the industries. He was released in late 1939. Albert Kurtinitis (#1923) was a first timer in penitentiary. He worked in the Paint Shop. He supported all the demands of the rioters in 1932. He was a reported a dozen times for various kinds of talking, gambling, idling his time, and so forth. He was released early and deported in June 1935 back to the United States. He and Zenkauskas were both Lithuanian immigrants to the States. Clarence Jacobs (#1977) appealed his sentence but that appeal was denied and he arrived at Kingston Penitentiary in late November 1930. He worked first in the barber shop then in the bakery. He was a first timer in penitentiary, though he had served in county jails. He went along with the riot in 1932 but had no specific complaints or demands. He was released in April 1936. Fred Robinet (#1936) did not appeal his sentence. He worked in the Tailor Shop at Kingston Penitentiary along with Zenkauskas, but was much interested in supporting the convict revolt in 1932-1933. He thought the shaving system was bad, the lack of exercise terrible, and the education system poorly organized - it had no up to date school books, and he failed his French and algebra courses because his school books did not arrive until after the test. He was transferred to Collin’s Bay Penitentiary in early 1933, but was returned in mid-1934 to Kingston for a disciplinary issue. He was released in May 1935.  Thomas Sinclair (#1920) had been in prison before, in Detroit and at Leavenworth Federal Penitentiary. He felt that problems in prisons originate from the same problems - the spy system and stool pigeons, churches that teach “nothing but bunk from the day you come in and come out” and a lack of trust and self-direction. He worked in the Carpentry shop at Kingston Penitentiary, and thought the conditions were poor there, with bad equipment. He was written up for disobedience a few times, including several times in church and once on a false report due to disagreeing with the Warden. He was implicated in an escape attempt in August 1931, with McCrea and several other inmates - Deputy Warden Walsh believed he cut his finger on purpose to avoid participating. After the riot, Sinclair felt that if the new administration kept its word on penal reform, “the boys would keep theirs.” In 1935 he was one of a group of inmates transferred to the North-West Cell Block, a minimum security section where he worked in the vocational shop there. Interestingly, he was implicated several times, in 1937. 37 and 1939 in organizing or supporting strikes and protests against the prison - in 1939 he was accused of asking other inmates during yard time “thumbs up or thumbs down” on the strike. He denied his role naturally. He was released in July 1943. William McCrea (#1921) had been in Kingston Penitentiary before, released in 1929 on a five year sentence. He felt that last bit “had taken the fight out of me” and was utterly hopeless starting his second sentence: “I don’t ever expect to get out of here....the only thing to do is beat the game or hang.” McCrea was put in the Blacksmith shop, with Murray Kirkland and Alfred Garceau, other prisoners soon to be influential in prison affairs. With Garceau and Kirkland, McCrea hatched an escape plan. The incompetent staff instructor ignored their fashioning of knives and hammers for breaking locks, and the five men came up with a rather ambitious or foolhardy plan to start a mutiny, knowing how hated the penitentiary was, and in the confusion, rush the front gate with their weapons. Even more fantastically, they were to time the demonstration with the visit of a fuel truck - they intended to ram it into the front gate to cause an explosion. They were ratted out by several inmates, including #1977 Jacobs, all of whom genuinely thought they’d get killed during the attempt. He was kept in solitary for several months, where he suffered a cold, was not tried, and claimed other men were beaten - he considered these punishments to be “degrading.” He became influenced by his time meeting the Communists in Kingston, and came down on the side of a demonstration to get change in the penitentiary. He played a crucial role during the riot of October 1932 - he operated the blowtorch to allow the men out of the shop, and used it free other prisoners. He also took a role in stopping some of the younger inmates “who throw out their chests and be big men” from blowing up or damaging the generators. Indeed, he was made a spokesman by other inmates and maintained some influence into 1933 as a member of the inmate committee. In the investigation after the riot, McCrea supported the demands for magazines, recreation, news “from the outside, not on the grapevine,” inmate pay, segregation of the young boy prisoners, and the removal of corporal punishment from the hands of the warden. McCrea was one of the inmates put on trial for his role in the riot, and along with Willard Milich #2077 he tried to canvas the other inmates for financial assistance - this was denied by the authorities, but eventually it was allowed and about 100 men put forward some of their savings to support those men on trial. He was given 18 months for riotous destruction of property. He continued to be somewhat influential and geared towards agitating until early 1934. McCrea was eventually transferred to the Carpentry shop, and then was transferred to Saskatchewan Penitentiary in 1938. Both Threselton (#1924) and Martin (#1925) were kept at Kingston Penitentiary until about mid-1932, and were then transferred to Collin’s Bay. Threselton was paroled in 1936 and Martin in 1934.]

Alright, fine. Here's the status report, in no particular order:

I'm back in Seattle. I wrote a blog post on the flight back from Windsor, which I have to make a few edits to (adding a few links, etc).

A good number of months ago, I went to the dentist. (I still don't brush my teeth more than once a week, which in typical fashion I was thinking would change after I went. My track record for changing my habits by consciously trying to change my habits is, literally since as far back as I can remember, entirely failures.)

The dentist seems like a competent doctor and perfectly nice person – more than that, really, as he did go out of his way to ask patients if they didn't like dentist visits and what he could do to help. However, his bedside manner really doesn't work for me in that he doesn't give the patient any information or give really any opportunity for questions. So while I'm sure he's right in his medical care and all, I don't have any level of emotional trust for him.

This is a problem because he referred me to an oral surgeon to get my wisdom teeth removed. So I'm supposed to do that, but it sure is easy to avoid a major medical procedure when you don't have any information about it or trust in the one saying you should do it.

Similarly, I went to my GP a while ago and got a referral to a... I don't actually remember exactly what, but it's for my anus. Probably should follow up on that, but I haven't had as much of the problem it's for, so again, it sure is easy to avoid.

Thirdly in the "medical stuff" category, I feel like I should probably be going to regular therapy/counseling of some kind. For, y'know, the "avoiding stuff" thing, among what I'm sure is a multitude of other repressed things. And maybe consider an antidepressant or somesuch (which would be through that avenue as well).

In the small category of potentially enjoyable things, I'm tempted to look for piano lessons. I do have a long and storied history of hating things I'm not yet good at, but if I stuck with it, I bet music could be a really enjoyable thing. Oh wait, I haven't stuck with anything of any kind in my entire life. Potential problem there.

As far as school goes, I was supposed to sign up for [something] at Seattle Central College... let's see, it opened on the 21st, so a week ago. I did 'enroll' before I left for Windsor, but never having actually used my online account, it's screwed up in some way, which I presumably have to contact the college to fix. However, I didn't see anything on the class list that actually sounds enjoyable or useful, I don't know if anything will be available (very likely yes, but not being sure it's an easy excuse), there are probably a lot of unpleasant steps like getting my old transcripts sent to the college that I was supposed to have done ages ago, none of the people at the college were at all nice when I did go so I don't want to talk to them again, and anything involving being a student makes me have really avoidant, and usually self-destructive, reactions. So that's a good time.

Thanks, high school experience. Also, fuck you, high school experience.

(Nota bene: I've never had suicidal or dangerous urges, and if I ever do I'll seek a lot more help than I do now. Avoidance is obviously bad, but at least it doesn't really get worse than "don't do the thing or any related things.")

I am pretty angry pretty much all of the time, though. I have a really excellent mostly-finished post about this from the beginning of the year when I was planning to post something every day (didn't work out, obviously). But I think that's separate from the previous paragraph. Mostly I'm angry that so many things are unfair to and hurt people I care about and innocent people who I don't know but nevertheless care about in some abstract way. And that I feel helpless to change that.

...Well, and that my previously addressed issues prevent me from helping to change things. I take it back, it's totally connected to the previous paragraph.

I have a lot of guilt. I don't really know how much, because it's one of those things that's debilitating to try and fully consider and I've been down that road before in high school. I will absolutely grant that addressing your faults and stuff is necessary and that you can't just live ignoring them forever (common theme in fictional media, it seems), but pushing it down the road is nice compared to last time when it broke me. This is why I probably need professional help, I imagine.

...eh, actually let's come back to that. It's actually pretty difficult to enumerate them into a list, not even in the emotional sense, just in the "hmm what were they again" sense. I can just flag 'em as I remember 'em.

Continuing: Rebecca's mental and financial situation. Financial first: the poor treatment of and lack of opportunities given to ~minimum wage, what gets called "unskilled" even though that's fucking bullshit, workers pisses me the fuck off. Like I said, I'm always angry – and on reflection, I think I tend to come across as uncaring about things that actually make me angry because given the choice between expressing a destructive emotion destructively and not expressing it and trying to stay levelheaded, I pick the second. The "be constructive" and "express that the emotion is there to show people you care without letting it control and overwhelm you" options that logically I know exist are... well, difficult and risky.

I remember when my mom was basically like, "oh, so you get upset a lot about this one person's situation?" And: sure, yes, of course I do, why wouldn't I? But I see that situation applied to literally billions of people in the world and I'm upset on all of their behalfs. She almost certainly wasn't implying that it *only* bothers me because I have a personal connection with someone in the situation I'm upset about, but it kind of sounded like it in the moment, and I'm damn offended if anyone actually thinks that about me. Oh well. Anyway, hi, I have far left political leanings because apparently "people who have hard lives should have easier ones, we as a society can make that happen on a large scale so we should" is an extremist position? What?

Aaaaaaannyway getting back to the status report. I feel guilt (1) about my lack of educational credentials and independence because they would allow me to help Rebecca's situation, and those of all of my friends, and those of people I don't know too. I literally have a note titled "what to do when you have your own money" which basically just says "help people." That's the only way I could feel good about myself.

But when the only way you can feel good about yourself is (okay, 'feels', not necessarily 'is') behind a door that makes you want to react self-destructively... it doesn't feel like there's any path that'll make you feel good about yourself. It just makes you feel hopeless, and angry, and like you don't want it to be this way, and that's close enough to feeling like you want it all to stop that it's easy to conflate the two.

Remember, if you feel this way too: They're *not* the same. It's a normal thing to mix those feelings up, but it's not true. Remember that.

Moving on. Rebecca's medical situation is... hm. I'll kind of write this out backwards because it's easier to recount that way. The post I wrote on the plane (I'll post it after this) is about, among other things, finance, and how I make financial decisions with the indefinite amount of resources available to me.

Rebecca doesn't have sufficient medical care for their mental health. Not by a small margin or in an unimportant way. Some of the reasons for this are financial, and of course some are not. The ones that are financial are, in my mind, things I have the ability to solve, and that it would be the financially responsible thing for that to happen. I have zero doubts about this.

I won't go into much more detail for the reasons of privacy. But as we're listing unresolved things that are on my mind, if one were to ask me in this context, "are things okay," my answer is no, and to "do you guys need help," my answer is yes.
