November 26, 2024 is the retrial date for the Menendez brothers. How will the transits affect their retrial? Let’s take a look—>
Lyles’ transit Sun conj. Venus—This is favorable in terms of reclaiming his image and voice after so long. Both planets sit in the 8h which denotes a transformation after hardship, a complete unveiling of the truth. Think of it like an eclipse. It unfolds right before your eyes: reclaiming what was the truth all along. The masses will be rooting for them especially since Venus conj. Sun is here. News will travel fast of this case, and many eyes will be on the trial.
With this as well, Venus is all about fairness and restoring justice, so Venus conj. sun adds a well needed touch to their case. This unveiled evidence is helping the brothers greatly.
His transit venus is conj. natal sun in the 9h—Amazing for teaching the system how it failed them. Regarding the new evidence popping up, a district attorney recently spoke up about the retrial and said considerably, “the brothers did not get a fair trial. It was a misjustice.” This case will highlight how the systems’ approach needs to change regarding males being sexually abused, and will serve as a strong reminder on how to treat survivors moving forward.
Both are sitting in Capricorn which is absolutely important, Capricorn is all about structure and foundations. It has ties to the government as well and how our system performs. Capricorn rules political structures, and authorities. This time around Lyle and Erik will be receiving a lot more compassionate eyes from the judges, and much better treatment in terms of their community. Venus comes to correct the system as well, since it falls in Capricorn, bringing about much needed change regarding their legal system.
Venus here in this case will cause their trial to reach many hearts no matter the distance. It is emotional.
Their case will be viewed fairly, and be calculated with a sharper eye since 1996, the ruling system was practically shit. It’s even possible Lyle might go on to give long speeches of his past and his prison life, after the trial to reach the masses. He may mostly focus on what he did to help him cope, and become a motivational speaker of some kind. People will look up to them as agents of change.

With the ruler landing in Leo transit of the 4h, even more will come to light regarding the Menendez brothers home life. This time it will be met with a lot of passion, support and respect from the masses. Expect to be a lot of uproar if the case is mishandled or criticized—people will be on it. Potential for a lot of bias, misandry especially from women who projected their personal feelings onto the case. I mostly see the women could have a bias take on the brothers, women who are reporters or journalists covering the situation.
The documentary in conjunction with the trial will bring about even more spotlight onto the brothers. Both in a redeeming light, and yet somehow still considered an outcast for their murders.
Natal saturn conj. NN retrograde—Revisiting what went wrong. Rectifying. Feels like life is starting over the way it should’ve 32 years ago when they got imprisoned. Lyle will also be nearing the end of his saturn return which amplifies this even further. Strong vibes of discussing the authority system and evaluating who should be the one to decide what is considered guilty vs innocent. Especially with NN being in Aries & saturn. Reevaluating authors figures.
Pisces rising—I’d like to think of this as the brothers being seen with fresh eyes. Being seen in a more rejuvenating light. With transit saturn in the 1h, Lyle will be approaching the trial more structured, disciplined, and definitely wise beyond the years. Both the brothers are nearing the end of a painful cycle here because Pisces denotes that. Pisces is all about the ending of a cycle before starting anew (Aries)
Transit Pluto conj, natal mercury—Pluto is giving Lyle and Erik a platform, a voice to share their trauma and pain once again. This trial will definitely allow Lyle and Erik to open up and be heard. It’s emotional for them and they will be revisiting feelings of abuse and trauma. At the same time it feels like liberation and release for them.
Transit Mercury retrograde in the 8h—Unveiling the traumatic doings of their childhood is difficult for both the brothers, and yet it serves as an astounding foundation for change regarding the justice system. Massive revelations, and information that was hidden will be revealed regarding the legal case. Any legal experts, attorneys that dragged the boys will be prosecuted in the media heavily.
With transit Saturn squaring natal Venus—The divide is still present. I could view this as women in higher positions looking down upon the brothers still, such as reporters and journalists. I can also see this as this trial being very difficult regarding Erik and Lyle, it’s tense. Especially since both are aware of what is happening in the media industry with them being villainized and sexualized.
With Saturn in Pisces in the 11h I feel that if the brothers emerge from prison, it’s almost a shock to them to see the supporters by their side. Tammi, Eriks wife has a TikTok where Erik spoke briefly on there. He didn’t seem to quite understand or grasp the magnitude of support. But I have a feeling when they do come out it’ll feel like a dream for them, because this is all they ever wanted.
Lastly, with Sun trine Saturn the brothers will definitely be experiencing long term fame, since Saturn falls in the 11h. But this fame has a double edged sword as the community is still divided on what to believe regarding the misrepresented brothers. Especially since most of them refuse to understand their story.

Judge Rules in Favor of Store Employee Fired for Trying to Stop Thief

A longtime Safeway employee from San Mateo, California, has won a court victory after she was terminated for trying to stop a suspected shoplifter, FOX-KTVU out of Oakland has reported.
Antoinette Baez was fired Feb. 2, 2023 after she attempted to stop an alleged shoplifter. Safeway policy prohibits employees from chasing, touching, or pursuing a suspected thief, according to attorney Neil Eisenberg who represented Baez.
Baez had noticed a woman attempting to leave the store without paying and subsequently contacted her supervisor, David Arevelos, who then confronted the woman.
In a video released by Baez's attorney, she recounted the events that unfolded.
"I said, 'Your transaction is still on the screen. You haven't paid for anything,'" Baez recalled telling the woman, who denied the allegation and tried to leave with the merchandise.
In the video, Baez is shown trying to grab the grocery bags the woman was holding. Baez says she was aware of the store policy regarding theft and tried to remain calm during the incident.
"That kept playing in my head, like don't go outside, don't go after her, and don't touch her," Baez explained.
It was then that the altercation became physical, as Arevelos attempted to prevent Baez from being punched by the alleged shoplifted.
The woman left the store without any of the groceries and Baez then called the store's director.
"He was very understanding, compassionate; he's like: 'I'm sorry that happened; I'm glad everyone's OK,'" Baez recalled, adding, "No disciplinary actions were taken against me."
Less than a month later, both Arevelos and Baez were eventually dismissed.
Following a lengthy legal back and forth, Baez and her attorney won the claim they filed with the state Employee Development Department. The new ruling awarded Baez unemployment back dated to her point of termination, almost a full year.
However, Eisenberg confirmed his client has not received an apology from Safeway, nor an offer to have her employment reinstated.
"This is probably the dumbest, cruelest incident I've seen in my entire practice," he said, adding that he feels Safeway has created an open-door policy for theft.
"You are better off stealing from Safeway than paying for your goods or your groceries, because when you pay for your goods or your groceries, you are absorbing the cost of shoplifting," the attorney said.
"If you're shoplifting, you get to go free, no consequences."

A Long Island nurse has been charged after she was caught on video allegedly picking up a two-day old baby and slamming him face-down into his bassinet. 
Amanda Burke, 29, was arrested Wednesday morning and charged with endangering the welfare of a child, a Class A misdemeanor, in connection with the Feb. 6 incident, the Suffolk County District Attorney’s Office announced. 
Burke worked as a registered nurse in the neonatal intensive care unit at Good Samaritan Hospital in West Islip on Long Island, and at the time of the incident was in charge of the newborn's care.
“Burke approached the newborn while he was lying in a bassinet, lifted him up, quickly flipped him over, and violently slammed him face down in the bassinet,” prosecutors said in a news release. 
The infant’s father recorded the incident on his cellphone through the nursery window, the baby’s mother confronted Burke, and the parents notified hospital nursing staff, prosecutors said.
As a result, Burke was terminated “within hours of the incident,” the release said.
“The allegations against this defendant, who is someone entrusted with the care of our most vulnerable citizens, are truly disturbing," District Attorney Raymond A. Tierney said.
Robert C. Gottlieb, an attorney for Burke, told NBC News: "This case should have never resulted in criminal charges.”
“Amanda is an outstanding, exemplary, compassionate nurse who did not and would never do anything to endanger any infant or patient under her care,” he said. “The baby involved was not injured or ever placed in any danger of injury. The District Attorney’s statements are off base and not justified by all the facts that will come out in court.”
The infant’s father, Fidel Sinclair, told NBC New York in February it was divine intervention that he witnessed what happened to his son, Nikko.
“I’m happy I was there. God sent me,” Sinclair said. “If it wasn’t for God, who sent me to go over there and check on him, we would have never seen none of that happen. And that would have kept happening through the night, not only to him, but to the other babies, too.”
Nikko’s mother, Consuelo Saravia, told the station, the video of how her baby was handled left her shaken.
“It was heartbreaking,” she said. “I couldn’t stop crying. I couldn’t even sleep.”
Saravia said she confronted the nurse: “I told her, ‘I don’t want you to touch my child! You just slammed him,’” she told the station. “She said, ‘Oh no, if you think I mishandled him or anything, I’m sorry.’”
Burke's arraignment has been set for May 2. 
The district attorney’s office said it notified the New York State Department of Education’s Office of Professional Discipline of the investigation findings, but to date Burke’s registered nurse license has not been suspended.

HAPPY 2023! Back to the old grind. But first -- I would like to manage a quick year-end post for 2022 if it’s still relevant. First, a little gush about finding this place, and then a quick hit list of shows that moved me. 
I only joined Tumblr in July 2022, after watching Old Fashion Cupcake (on the recommendation posts of @isaksbestpillow​, who I’ve followed for years in my passionate pursuit of everything Kinou Nani Tabeta-related). I was so moved by OFC that I literally felt like I needed an OUTLET to gush out my feelings about what I had just watched. And so, my first post went up. 
I legit had no idea what I was getting into with Tumblr, but at least I felt like I had a space where I could really nerd out about shows I loved in incredibly minute detail, which my real-life human mutuals (partners, sibs) wouldn’t be able to appreciate. 
After that first OFC post, I felt like a pressure valve had been released, and I really had no idea how much I NEEDED TO TALK about these dramas I’ve loved watching so much over the years. So I just want to say that I’m so appreciative of all the feedback and engagement I’ve gotten on my posts in these short six-ish months -- it really makes me emotional and full that I get to do some real writing that I truly love doing, talking about subjects that I LOVE talking about (dramas, food, etc.)
Also -- this outlet here on Tumblr. I’m a crazy, overworked mom, trying to fit everything in -- kids, partner, work, school, childcare, making meals, working out, the whole freaking bit. I can’t tell you all what a RELIEF it is to be able to prioritize time to sit here and write about things I love. It is truly a mentally welcome release. 
Okay, quick thoughts on my dramas of 2022. I’m not going to do any kind of numbered list, just a fast and emotional meditation on what moved me. 
I think the dramas that I wrote the most about this year were:
Extraordinary Attorney Woo Cherry Magic (so. many. Cherry. Magic. posts.) Kabe Koji
And I hold these very close to my heart, especially Cherry Magic, but I’m just reviewing my pinned post drama list, and thinking of what twists me when I even see the title. 
I think Eternal Yesterday earns a spot. Certainly the Cherry Magic movie -- now that I’ve seen Akaso Eiji and Machida Keita in so many other works, I truly think that us CM fans were ridiculously spoiled by their acting in the CM franchise. And I think Extraordinary Attorney Woo, while not a BL, was likely the best Korean drama that I’ve watched in years (but I’m gonna hold up on that, because I’m watching Semantic Error right now, ha).
In any case, if Old Fashion Cupcake was so good to move me to literally join another social media network, then -- that says something.
Every time I think about this drama -- every time I think about the music that plays whenever Nozue is alone and thinking about Togawa -- I feel a gut punch.
What the HELL was with this drama that made it so great? The pacing, definitely. Togawa’s insistence, for sure. His grind, his determination. That one shot scene in episode 4.
But like I wrote in my very first post -- I think what GOT me about OFC was Nozue, and his responsible, thoughtful engagement with lives other than his own, until the end of the series, when he turned his compassionate light on himself. He opened himself up to the gentleness that he gave unto others. And he shared that gentleness in Togawa with love in the end.
As compared to the many OGs on Tumblr who have been watching and posting about BLs for years, I’m just far behind on understanding BL canon -- I’m diligently catching up on a lot. And Kinou Nani Tabeta in 2019/2020 was definitely my gateway to the genre, but I was also busy having kids and nursing, so -- that kinda interrupted the work for a while.
That all being said, having watched BL and cishet dramas for years, there is a kind of crushing emotionality, a connection to what one is REALLY feeling, in Old Fashion Cupcake that is depicted in such an honestly authentic way, that -- like Eternal Yesterday -- makes me crumble inside. It’s just pure, honest engagement and chemistry. I haven’t seen THAT LEVEL in much else over my years of watching Asian shows.
While I have enough content to go through Akaso Eiji and Machida Keita rabbitholes for months, I just don’t have enough for Kimura Tatsunari and Takeda Kouhei, and I so wish I did, because these guys probably had the best chemistry for me in dramas this year -- maybe save for First and Khao in The Eclipse. I’m looking forward to watching a lot more in 2023, but the standard set by Old Fashion Cupcake this year in regards to how to get my insides to twist with angst -- that standard is pretty high, and I hope a drama/dorama can come close in this near year.

What to know for 4/20
Saturday marks one of the most well-known cultural holidays in the country: 420.
Celebrated every April 20, the holiday is a day for people to advocate for the legalization of marijuana in the United States and other countries.
The drug has been legalized in 24 states and decriminalized in seven more.
Fourteen states have legalized the medical use of cannabis.
Texas is not one of them.
The Lone Star State’s policy remains that weed is illegal.
The only exception for medical marijuana use is when doctors prescribe low-THC cannabis under the state’s Compassionate Use Program.
Is it legal to carry marijuana in Texas?
Sec. 481.121. of the Texas Health and Safety Code covers marijuana possession.
The punishment for the crime depends on the amount of marijuana a person has when arrested.
There are six varying offenses depending on the amount, starting with a Class B misdemeanor and ending with a first-degree felony.
A Class B misdemeanor is for people in possession of 2 ounces or less.
A Class A misdemeanor is when people possess 4 ounces or less but more than 2.
A state jail felony is for less than 4 pounds but more than 4 ounces.
Third-degree felony offense is for 50 pounds or less but more than 5 pounds.
A second-degree felony is 2,000 pounds or less but more than 50.
The highest offense would be a first-degree felony for possession of more than 2,000 pounds.
The punishment for that crime is up to life in prison and/or a fine up to $50,000.
Is marijuana legal in San Antonio?
While it is illegal in the state to possess marijuana, Bexar County created an initiative in partnership with the San Antonio Police Department to issue citations for specific low-level offenses rather than making an on-site arrest.
The Cite & Release initiative is “an important tool that allows non-violent, low-level offenders to complete an appropriate sanction while maintaining a job and housing.” San Antonio police can issue citations for nonviolent misdemeanor offenses like possession of marijuana, misdemeanor theft, driving with an invalid licensee and criminal mischief.
Those cited will avoid being arrested and must complete an associated diversion program.
Once the program is completed, the citation will not appear on their criminal record.
According to the Bexar County District Attorney’s Office, the Cite & Release initiative can reduce the burden on the local court system and jail.
It also allows officers to return to duty in “significantly less” time than it takes for an officer to make an arrest.
Has Texas decriminalized marijuana?
Texas has not decriminalized marijuana, but some cities have decriminalized it.
Those cities include Austin, Denton, Elgin, Killeen and San Marcos.
Earlier this year, Texas Attorney General Ken Paxton sued those five cities for violating the state law.
The Texas House of Representatives passed a bill to decriminalize marijuana last year, but the bill died in the Senate.
Are CBD gummies legal in Texas?
CBD products are legal in the state of Texas if they comply with state and national laws.
CBD stands for cannabidiol, which is a chemical found in cannabis plants that don’t produce a high.
Hemp products like CBD are legal in the state.
However, they can’t be smoked.
That is illegal.
Is delta-8 or delta-9 legal in Texas?
Delta-8 and delta-9 products, which are derived from cannabis plants, are legal in Texas.
Products are allowed to have only up to a 0.3% concentration of delta-9 THC.
There is no limit on delta-8 THC.
Since there is only a very small amount of delta-8 THC found in a marijuana plant, most of the product is created in labs by extracting cannabidiols and chemically changing them to delta-8 THC.
However, some are looking to ban the two substances, including Lt. Gov. Dan Patrick.
Last week, he asked state senators to look into potentially banning the products ahead of next year’s legislative session.
What does 420 mean?
The origin of 420 as a marijuana-coded term is a group of California friends, who in 1971 would meet after school to smoke at 4:20 p.m. every day and then go searching for a friend’s brother’s weed patch, according to PBS.
What exactly 420 means depends on the context the saying is being used. It can refer to the unofficial holiday of April 20, smoking at 4:20 p.m. like those California friends, smoking in general or even just marijuana.

Going through security at any airport can be an anxious chore, especially if you have weed in your carry-on.
The possession, growing, selling, distribution and use of recreational marijuana is illegal in Texas.
Medicinal marijuana is legal in Texas, but limited as to who qualifies to get it.
CBD products — a derivative of hemp, a close cousin to the outlawed weed — are plentiful in shelves in Texas gas stations or smoke shops packaged in colorful boxes with flavors like fruity pebbles, magic mango and grape ape gusher.
Like marijuana, these cannabis-based products deliver a high.
But unlike marijuana, these products are legal in Texas, thanks to laws that allowed the cultivation of hemp.
Bringing weed from a state where marijuana is legal back home to Texas may seem like a way to circumvent strict laws.
But weed is not legal in Texas.
So, will airport Transportation Security Administration agents actually search for drugs in luggage?
Here’s what we know:
Will TSA agents in airports search for marijuana in your bag?
The Transportation Security Administration are not looking for drugs when they screen fliers, but if they find marijuana or other drugs, they will refer the matter to law enforcement.
TSA’s screening procedures are focused on security to detect potential threats to aircraft and passengers.
While TSA officers are screening for weapons or other harmful items and happen across an illegal substance, it will be reported to local law enforcement, according to the TSA.
Why is it illegal to fly with marijuana?
While several states have legalized recreational marijuana use, the federal government has not.
The TSA is in charge of security at airports, while the Federal Aviation Administration governs the airspace.
Since the federal government has jurisdiction over the airspace and federal law states that recreational marijuana use is illegal, any kind of flying with weed possession is unlawful, according to the Washington Post.
Even if you were traveling between two states where recreational marijuana use is legal, it’s still illegal to fly with weed.
This applies to medicinal marijuana as well.
The only exception to flying with medicinal marijuana, is if it contains less than 0.3% of THC on a dry weight basis, according to the Washington Post.
Can Texans drive home with legal weed bought in California? How about flying it in?
Several states allow for recreational marijuana use, but Texas is not one of them.
The Lone Star State does allow for medicinal marijuana use, but only in certain instances.
People diagnosed with cancer, multiple sclerosis, post-traumatic stress disorder and more, all qualify.
In total, 24 states across the U.S. have legalized recreational marijuana and 38 states have allowed medicinal use.
But with several states only a few hours drive from Dallas-Fort Worth, what happens if someone crosses state lines with marijuana in their possession?
Here’s what to know about Texas’ marijuana laws:
WHAT DOES THE LAW SAY ABOUT MARIJUANA IN TEXAS?
The possession, growing, selling, distribution and use of recreational marijuana is illegal in Texas.
State law is tough on marijuana offenses.
Fines can run in the thousands, plus years in jail.
Here’s how the penalties shake out for marijuana possession:
2 ounces or less — Class B misdemeanor with a maximum fine of $2,000 and up to 180 days incarcerated.
2-4 ounces — Class A misdemeanor with a maximum fine of $4,000 and up to one year incarcerated.
4 ounces to 5 pounds — State jail felony with a maximum fine of $10,000 and 180 days to 2 years incarcerated.
5 to 50 pounds — 3rd degree felony with a maximum fine of $10,000 and two to 10 years incarcerated.
50 to 2,000 pounds — 2nd degree felony with a maximum fine of $10,000 and two to 20 years incarcerated.
2,000 pounds or more — 1st degree felony with a maximum fine of $50,000 five to 99 years incarcerated.
The penalties for selling marijuana are:
7 grams or less for no remuneration — Class B misdemeanor with a maximum fine of $2,000 and up to 180 days incarcerated.
7 grams or less — Class A misdemeanor with a maximum fine of $4,000 and up to a year incarcerated.
7 grams to 5 pounds — State jail felony with a maximum fine of $10,000 and 180 days to two years incarcerated.
5 to 50 pounds — 2nd degree felony with a maximum fine of $10,000 and two to 20 years incarcerated.
50 to 2,000 pounds — 1st degree felony with a maximum fine of $10,000 and five to 99 years incarcerated.
2,000 pounds or more — Enhanced 1st degree felony with a maximum fine of $100,000 and 10 to 99 years incarcerated.
The Texas Department of Public Safety operates an online registry of physicians who prescribe low-grade cannabis to people with epilepsy, cancer, autism and other conditions.
Finding a physician to prescribe low-THC can be found by searching the DPS website.
WHAT HAPPENS IF YOU CROSS TEXAS STATE LINES WITH POT?
Texas law is pretty clear:
It is illegal to possess recreational marijuana regardless of where it was purchased.
If you purchased marijuana while in Colorado and then traveled to Texas with the substance, you have broken the law.
It doesn’t matter if the marijuana was purchased legally, as soon as it crosses Texas state lines its considered contraband.
It’s not only a marijuana possession charge you’ll have to worry about, you could be charged with drug trafficking which is a federal crime, according to Westfall Sellers law firm.
WHAT HAPPENS IF YOU’RE CAUGHT WITH WEED IN A TEXAS AIRPORT?

Yes, but only if you’re not driving and don’t have any marijuana in your possession.
Under Texas Penal Code chapter 49, driving while intoxicated is not only limited to alcohol but drugs as well.
A DWI charge is a class B misdemeanor in Texas and could carry a fine up to $2,000, up to 180 days in jail and loss of a driver license for up to a year.

Sound Judgment Releases New Episode On Interviewing

In September, I published an article -- The Ten Best Interviewers In Podcasting. In that assessment, I rated the host of the Sound Judgment podcast --  Elaine Appleton Grant -- as the third-best interviewer.
Here's what I wrote: "The Host of Sound Judgment --Grant is in a tough spot hosting this podcast. Sound Judgment is about being a better podcast host, so you need an excellent podcast host to legitimatize that point. Thankfully, Grant is superb. She possesses excellent cadence, a smidgen of earnestness, a touch of empathy, a dash of clarity, and a heaping of good humor."
 In the latest episode of Sound Judgment, out on December 14, Grant turns it up several notches. The episode title -- The Art Of True Curiosity -- is indeed a masterclass on how to interview and be a podcast host.
 Grant's guest is Kelly Corrigan, who has written four remarkable memoirs, each of which was a New York Times bestseller. Between her podcast, Kelly Corrigan Wonders, and her PBS show, Tell Me More, she’s interviewed authors, actors, philanthropists, and leaders of all kinds — everyone from Katie Couric and Transportation Secretary Pete Buttigieg to Melinda Gates, Anne Lamott, Michael Lewis, Margaret Atwood, and famed human rights attorney Bryan Stevenson.

Then, Corrigan introduces the concept of intellectual humility, replacing conviction with curiosity because we don't know what we don't know. 
"Personal information in an interview lands for listeners," Corrigan. "It lands in the context of their life."
Corrigan recommends listening to a potential guest to get a sense of their cadence and rhythm before you interview them.

(AP) - In a scathing ruling last month, a judge said the FBI had used a "villain" of an informant to manipulate a group of Muslim men into going along with a fictitious plot to destroy military planes and synagogues in New York City's suburbs. She ordered three released from prison, saying "the real lead conspirator was the United States."
Now, a man convicted in another sting carried out by the same FBI operative says he hopes the ruling will prompt U.S. prosecutors to review the fairness of similar counterterrorism operations carried out in the wake of the 9/11 terror attacks.
"Hopefully this will be the first step for the Justice Department to review all those cases of conspiracy and entrapment," said Yassin Aref, a former imam who spent 14 years in federal custody in a case involving a business loan made to an Albany pizza shop owner and a made-up story about a Stinger missile.
Aref and the shop owner were arrested in 2004 in one of several FBI stings carried out by a paid civilian operative named Shahed Hussain, whose work has been criticized for years by civil liberties groups.
Hussain entered the U.S with his wife and two sons in the 1990s afer he was accused of murder - falsely, he once testified - in his native Pakistan. He settled in the Albany area and was working as a translator when he got caught helping someone get their driver's license illegally. In exchange for leniency, he started working for the FBI.
American law enforcement at the time was on a massive hunt for terrorist "sleeper cells" planning attacks on U.S. soil. Hussain worked with the FBI to approach people suspected of being sympathetic to Islamic militant groups and see if they could be talked into an illegal act.
One target was a group of four men from Newburgh, New York, who were arrested in 2009, convicted of plotting deadly antisemitic attacks and sentenced to 25 years in prison.
Courts has upheld their convictions, finding they knowingly became eager participants in a plot to plant explosives at a Bronx synagogue. But when three of the four applied for compassionate release, U.S. District Judge Colleen McMahon granted the request, saying the FBI had sent a master manipulator "to troll among the poorest and weakest of men for 'terrorists' who might prove susceptible to an offer of much-needed cash in exchange for committing a faux crime."
In a ruling July 28, McMahon called them "hapless, easily manipulated and penurious petty criminals" who had no connection to any terrorist group and had "never remotely contemplated" violent extremist before they met Hussain.
The ruling resonated with defendants and attorneys in a case Hussain helped build in 2004 against two men involved with an Albany mosque, Aref and former pizza shop owner Mohammed Hossain.
Posing as a successful businessman, Hussain befriended Hossain, eventually offering to lend him $50,000 for his struggling business. But he also told the pizza parlor owner the money would come from the sale of a shoulder-fired missile, imported from China, to a group that wanted to kill a Pakistani diplomat in New York City.
Hossain later said he thought the talk about an attack was a joke and that the missile he was shown was a plumbing supply. For religious reasons, he asked his imam, Aref, to witness the business transaction, much like a notary.
Aref and Hossain, now free after serving long prison terms for money laundering concealing material support for an attack with a weapon of mass destruction and giving material support to a terrorist organization, say they were innocent.
"I was a businessman taking care of my children," Hossain told the Associated Press.
Defense lawyers said they were manipulated to take part in a deal they didn't understand.
"The government wanted to make me something big, to make me look like danger," said Aref, speaking to the AP from his native Iraq, where he now lives. When the FBI was not able to find real terrorists, he said, "then they created one."
The FBI declined to comment. Emails seeking comment were sent to the Department of Justice and the regional U.S. attorney's office.
At the time of the arrests, then-deputy attorney general James Comey said "we are working very, very hard to infiltrate the enemy." After their convictions, then-U.S. Attorney Glenn Suddaby said the pair were "prone to support terrorism."
But the Albany case became a prime example used by critics who believed the government overreacted in its response to 9/11. In their view, Hussain was not informing on potential terrorists, but pushing people toward illegal behavior.
Judge McMahon described Hussain as "most unsavory," saying he encouraged his naive targets with rhetoric and a large cash reward.
McMahon's government-led conspiracy criticism is "exactly the argument we were making," said Terence Kindlon, the attorney who represented Aref. Kindlon called a "contrived case" tried amid rage over 9/11.
Hussain is believed to have returned to Pakistan, but he maintained a limo company in upstate New York that was operated by a son. In 2018, one of the company's vehicles wrecked while carrying a group on a birthday outing, killing 20. Hussain's son was convicted of manslaughter and sentenced to at least five years in prison after prosecutors presented evidence that the company had evaded safety regulations.
The FBI said in a prepared statement that it did not take any action that allowed the limousine company to operate, "nor did we take any action to interfere with the prosecution of the case."
Contact information for Hussain in Pakistan could not be found.
Aref, 53, was deported after his prison sentence but says he bears no ill will. His appeals attorney, Kathy Manley, said legal appeals are exhausted.
Hossain, 68, was released in 2020 and lives in Albany. He no longer has the pizza place, but maintains a handful of rental properties. He said the experience has left him with lingering fears.
"If I look back and I'm thinking about what has happened," he said, "it just makes me numb."
