[ad_1] New Delhi: Strategist-turned-politician Prashant Kishor has thrown his support behind the ongoing protests by Bihar Public Service Commission (BPSC) aspirants. While addressing allegations surrounding his involvement in the protests, Kishor clarified that he left the protest site 45 minutes before police resorted to lathicharge on the candidates.  Kishor has also vowed to take legal action against the police, stating, “We will file an FIR against the police and also approach the court regarding this matter.”  Prashant Kishor has Laid Out Five Dey Demands:  1. A re-examination for the BPSC 70th prelims.  2. Financial assistance of Rs 10 lakh for Sonu’s (Student preparing for BPSC who died by suicide) family3. Complete withdrawal of cases filed against candidates involved in the protests.  4. Immediate steps to address grievances of aspirants.  5. Assurance of fair and transparent processes in future BPSC exams.  Kishor warned that if the demands are not met, he will lead an indefinite dharna starting January 2.  “The government must act responsibly and address these issues. If they fail to do so, we will escalate our protest,” he said.  Case Against Prashant KishorThe Bihar Police has also filed a case against Prashant Kishor and others for allegedly instigating the students' protest in Patna's Gandhi Maidan.According to the police, Kishor and other members of his party provoked the candidates, prompting them to take to the streets and create disturbances in different parts of the city.Prashant Kishor's 3-day Ultimatum to Nitish Kumar Govt Prashant Kishor on Thursday had given a three-day time to the Nitish Kumar government in Bihar to resolve issues related to the alleged question paper leak of a recent PSC exam. The state has been witnessing a widespread demonstration by civil service aspirants over the issue and the police faced criticism for using force on protesters.Kishor, whose Jan Suraaj party had last week written to Chief Secretary Amrit Lal Meena for cancellation of the examination held by the Bihar Public Service Commission (BPSC) on December 13, warned the police of protests if job seekers are baton-charged in future. The Jan Suraaj party chief on Thursday reached Gardani Bagh, the designated place for organising protests or dharna, where civil service aspirants have been holding a sit-in for the last several days and demanding cancellation of the December 13 exam."The government must meet protesting students or their representatives and consider their demand for re-examination. I am giving an ultimatum to the state government. The administration must resolve this issue within three days," Kishor said.He extended support to the protesters and said he would join a march on Monday."I am always here to support the students. I will also join protest march of the students tomorrow. I will be at the forefront. If the police resort to baton-charge, I will be the first to face that. The police action against students on Wednesday is highly condemnable," he said while addressing the protesting aspirants.Chaos erupted outside the BPSC office on Wednesday when police baton-charged the protesters who were seeking cancellation of the 70th Integrated Combined Competitive Examination (CCE) 2024.The demonstrators alleged irregularities in the exam, including paper leaks, and sought re-examination.A group of protesters marched towards the BPSC office to press their demands, and a confrontation between police personnel and the job seekers ensued after they were stopped.RJD supremo Lalu Prasad also condemned the police action against protesting job aspirants."Police action against protesting students was wrong. Police should not have done this", Lalu told reporters in Patna on Thursday.Kishor also claimed, "A covil service aspirant died by suicide in Patna on Tuesday, it is unfortunate. The government should announce a compensation of Rs 10 lakh for the family of the deceased." It may be recalled that 25-year-old Sonu, a resident
of Patna's Paliganj area, was preparing for competitive exams and he died allegedly by suicide in the Kankarbagh area of Patna on Tuesday.Locals and his relatives informed police that Sonu, who was preparing for multiple competitive exams, including Bihar Public Service Commission (BPSC) , was living under tremendous stress for the last few months "due to different exams and anxieties about his career", police officials had said.Patna-based popular vlogger Motiur Rahman Khan, known as Guru Rahman, also joined the protests at Gardani Bagh on Thursday. However, Guru Rahman expressed strong displeasure over Kishor's alleged attempt to derive political mileage out of the protest and declared that the Jan Suraj party chief would not be allowed to join the stir on Friday."I am with students and will fight for the cause for which they have been protesting here for the last nine days. We will not allow any opposition leaders to come here and derive political mileage out of the protest. Students demanded the cancellation of the entire exam held on December 13 from the government. Only, if somebody from the ruling party comes here, then we will allow them," said Rahman.Rahman also asked, "Where was Kishor for the last nine days ? He (Kishor) will not be allowed to join the protest of job aspirants tomorrow".When asked about police preparing to register a case against him for instigating students, he said, "I don't care about all these. I will keep fighting for the cause of students".The opposition Congress and Purnea MP Pappu Yadav condemned police action against protestors.Yadav said he would call a Bihar bandh on January 1 if the December 13 examination was not cancelled.Meanwhile, a Delhi-based tutor was held on Thursday on the charge of instigating aspirants who tried to "storm into" the BPSC office in Patna.Patna's District Magistrate (DM) Chandrasekhar Singh told PTI that preliminary investigations into Wednesday's protests found that one Rohit, a tutor, mobilised and instigated the aspirants.Senior Superintendent of Police (SSP) Rajeev Mishra said, "Initial investigations have revealed that Rohit had come from Delhi and brought along a number of persons, including girls, posing as disgruntled job aspirants. He is being examined by the investigators." The source of their funding is also being investigated as they seem to be part of a larger conspiracy, he said."We are probing the larger conspiracy behind yesterday's incident. What is the source of funding for those who came from outside the state to instigate civil service aspirants is also the focus of our probe. Rohit seems to be the mastermind of yesterday's protest. Patna Police will send a preliminary report to the Economic Offences Unit (EOU) to investigate their source of funding," he told PTI.Alleging irregularities in the 70th Integrated CCE, aspirants demonstrated outside the BPSC office and sought re-examination.The police baton-charged the aspirants to bring the situation under control. Bihar police arrested eight suspects and are seeking 18 others for running the scam. Essentially, job applicants were required to provide 99 rupees to register for the job opportunity. But that was definitely worth it given that they'd get paid half a million rupees for the sex and then a bonus of 800,000 rupees if the woman conceived a baby. The contract even appeared to bear the official signature of, um, Oprah Winfrey! See below.
But shortly after signing up, one victim interviewed by the BBC News said he "was asked to fork out more than 16,000 rupees – 2,550 rupees to obtain some court documents, 4,500 as safety deposit and 7,998 rupees as Goods and Services Tax (GST) on the money he was going to get."
Demands for additional funds followed including the threat that if he didn't deliver, tax authorities would go after him.
"The scammers lured them with promise of free money and free sex which is a deadly combination," cyber law expert Pavan Duggal said. "In situations like these, prudence often takes a backseat."

Gujarat HC : No Contempt Action Against Police Officer Arresting Without Warrant, If Proper Explanation Given To Magistrate
Tumblr media
Case Analysis: No Contempt Action Against Police Officer Arresting Without Warrant, If Proper Explanation Given To Magistrate: Gujarat HC Introduction The case of No Contempt Action Against Police Officer Arresting Without Warrant, If Proper Explanation Given To Magistrate: Gujarat HC deals with the question of whether a police officer can be held in contempt of court for arresting an accused without a warrant, without prior notice under Section 41A of the Criminal Procedure Code (CrPC), if the officer provides a valid explanation before the magistrate. The Hon’ble High Court provides a detailed analysis of the relevant provisions of law and important judgments to arrive at its conclusion. Background of the case The case arose from an application filed under Section 12 of the Contempt of Court’s Act, 1971, by the applicants who were arrested by the respondent police officer for offences punishable under Sections 406, 420, 504 and 506 IPC. The applicants alleged that the respondent violated the guidelines laid down by the Supreme Court in the case of Arnesh Kumar Vs. State of Bihar & Anr., as reported in (2014) 8 SCC 273, which required the police to issue a notice under Section 41A CrPC before arresting an accused for offences punishable with imprisonment up to seven years. The applicants sought a court order directing the respondent to rectify the contempt of court and to initiate proceedings against him under the Contempt of Courts Act. Contentions of the parties in Gujarat HC The applicants contended that the respondent did not issue any notice under Section 41A CrPC before arresting them and did not record any reasons for doing so. They argued that this amounted to contempt of court as per the Supreme Court judgment in Arnesh Kumar case, which mandated that the police should follow a checklist and furnish reasons and material to justify the arrest. They also relied on various judgments from other High Courts to support their case. The respondent contended that he had complied with the guidelines of Arnesh Kumar case and had given a valid explanation for arresting the applicants without notice under Section 41A CrPC. He stated that he had mentioned in the checklist that he arrested the applicants to prevent them from committing any further offence of similar nature, as they were running an education/job consultancy firm and had cheated many people by promising them jobs abroad. He also submitted that he had given a copy of the checklist to the magistrate at the time of production of the applicants and that the magistrate had authorized their detention. Decision of the High Court Gujarat HC The High Court held that contempt of court proceedings cannot be initiated against a police officer for arresting an accused without a warrant, without prior notice under Section 41A CrPC, if the officer provides a valid explanation before the magistrate. The High Court observed that Section 41A CrPC does not bar arrest in all cases, but only requires that the police should give notice to appear before them and record reasons for arrest if they fail to comply. The High Court also noted that Section 41(1)(b)(ii) CrPC allows arrest without warrant if it is necessary to prevent such person from committing any further offence. The High Court relied on the Supreme Court judgment in Arnesh Kumar case, which clarified that arrest can be made in cases where there is a possibility of accused absconding or not appearing at trial or tampering with evidence or intimidating witnesses or repeating offences. The High Court found that the respondent had given a clear and specific reason for arresting the applicants in the checklist, which was to prevent them from committing any further offence. The High Court also found that the respondent had furnished a copy of the checklist to the magistrate and that the magistrate had authorized their detention after recording reasons. The High Court concluded that the respondent had fully and substantially complied with the condition mentioned as per the statutory provision of CrPC as well as adhered with the directions and guidelines issued by the Supreme Court in Arnesh Kumar case. Therefore, the High Court held that there was no contempt of court on part of the respondent and dismissed the application filed by the applicants. Conclusion In conclusion, the High Court held that no contempt action can be taken against a police officer for arresting an accused without a warrant, without prior notice under Section 41A CrPC, if he provides a proper explanation before the magistrate. The High Court also held that arrest can be made in cases where it is necessary to prevent such person from committing any further offence. The High Court followed and applied the guidelines laid down by the Supreme Court in Arnesh Kumar case for arrest. References - Case Name: No Contempt Action Against Police Officer Arresting Without Warrant, If Proper Explanation - Given To Magistrate: Gujarat HC - Case Citation: (2023) livelaw.in 238585 HC - Arnesh Kumar Vs. State of Bihar & Anr. The checklist under Section 41(1)(b)(ii) CrPC can be incorporated as follows: - The police officer should record the reasons for arresting the accused without a warrant in writing and mention them in the checklist. - The police officer should specify which of the following grounds are applicable for the arrest: - To prevent the accused from committing any further offence of similar nature; - To ensure proper investigation of the offence; - To prevent the accused from causing the evidence of the offence to disappear or tampering with such evidence in any manner; - To prevent the accused from making any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the police officer; - To ensure the presence of the accused in the Court whenever required. - The police officer should also state whether he has received credible information that the accused has committed a cognizable offence punishable with imprisonment for more than seven years or with death sentence and whether he has reason to believe on the basis of that information that the accused has committed the said offence. - The police officer should give a copy of the checklist to the magistrate at the time of production of the accused and explain why he did not issue a notice under Section 41A CrPC before arresting him.
