It's now legal to hack McFlurry machines and medical devices to fix them
Jason Koebler at 404 Media:
It is now legal to hack or otherwise bypass technical protection measures on McFlurry machines and other commercial food preparation machines in order to repair them thanks to a new rule issued by the Federal government.
Also, after a challenge, it remains “legal to circumvent manufacturer locks that prevent the repair of medical equipment.”
Bad copyright law combined with arbitrary software locks installed by manufacturers make it illegal for people to repair the devices they own, resulting in “both a huge number of McDonald’s ice cream machines and a large number of medical devices being broken at any given moment.” The beneficiaries of this bad law are the manufacturers of these devices, who have an unjustified monopoly on repairs.
This same monopoly, granted by Section 1201 of the the Digital Millennium Copyright Act, is enjoyed by manufacturers of “everything from video game consoles to tractors to ventilators to ice cream machines, kitchen appliances, and trains.”
The US Copyright Office issued exemptions to the law.
But Kylie Wiens, CEO of iFixit, said the new ruls don’t go far enough. Industrial equipment is excluded and the rules do not legalize sale of tools that would bypass software locks.
“This exemption is helpful, but what we really need is Congress to solve this problem and truly legalize repair,” he said.

California became just the third state in the nation to pass a "right to repair" consumer protection law on Tuesday, following Minnesota and New York, when Governor Gavin Newsom signed SB 244. The California Right to Repair bill had originally been introduced in 2019. It passed, nearly unanimously, through the state legislature in September.
“This is a victory for consumers and the planet, and it just makes sense,” Jenn Engstrom, state director of CALPIRG, told iFixit(which was also one of SB244's co-sponsors). “Right now, we mine the planet’s precious minerals, use them to make amazing phones and other electronics, ship these products across the world, and then toss them away after just a few years’ use ... We should make stuff that lasts and be able to fix our stuff when it breaks, and now thanks to years of advocacy, Californians will finally be able to, with the Right to Repair.”
Turns out Google isn't offering seven years of replacement parts and software updates to the Pixel 8 out of the goodness of its un-beating corporate heart. The new law directly stipulates that all electronics and appliances costing $50 or more, and sold within the state after July 1, 2021 (yup, two years ago), will be covered under the legislation once it goes into effect next year, on July 1, 2024. For gear and gadgets that cost between $50 and $99, device makers will have to stock replacement parts and tools, and maintain documentation for three years. Anything over $100 in value gets covered for the full seven-year term. Companies that fail to do so will be fined $1,000 per day on the first violation, $2,000 a day for the second and $5,000 per day per violation thereafter.
There are, of course, carve outs and exceptions to the rules. No, your PS5 is not covered. Not even that new skinny one. None of the game consoles are, neither are alarm systems or heavy industrial equipment that "vitally affects the general economy of the state, the public interest, and the public welfare."
“I’m thrilled that the Governor has signed the Right to Repair Act into law," State Senator Susan Talamantes Eggman, one of the bill's co-sponsors, said. "As I’ve said all along, I’m so grateful to the advocates fueling this movement with us for the past six years, and the manufacturers that have come along to support Californians’ Right to Repair. This is a common sense bill that will help small repair shops, give choice to consumers, and protect the environment.”
The bill even received support from Apple, of all companies. The tech giant famous for its "walled garden" product ecosystem had railed against the idea when it was previously proposed in Nebraska, claiming the state would become "a mecca for hackers." However, the company changed its tune when SB 244 was being debated, writing a letter of support reportedly stating, "We support 'SB 244' because it includes requirements that protect individual users' safety and security as well as product manufacturers' intellectual property."

Oh god, please don't do this.
Update your phone.
Maybe an argument can be made to wait a week or two just in case there are bugs in the new update, but updates are crucial to your phone's security. Updating apps is also part of that security. Unless it is an app that has no internet requirement, you need to keep them current. And if an app is no longer being supported or updated, you should probably move on to the next best thing. Even if that sucks sometimes.
And I hate to defend Apple all the time, but you cannot make current judgments based on the freakin' iPhone 4. Apple currently makes some of the longest lasting products on the market. Not only that, they support those products with software updates for pretty much their entire lifespan. Google and Samsung were being praised this year for promising 5 and 7 years of updates. Apple has been doing this for years now. They never put a number on it, but if a phone can run the software, they support it.
In fact, the big story about Apple slowing down phones is always presented as them wanting people to buy new phones, but in that case they were actually trying to extend the life of people's devices. If they hadn't throttled the CPU, the battery would have bricked a bunch of phones. Their error was not disclosing what they were doing. They got sued for that and rightly so. All people needed was a battery swap and they'd be back to full speed. It's ridiculous that Apple didn't just disclose that from the beginning.
Also, the days of phones getting too old to run new software are pretty much over. Moore's Law is slowing down and phones are incredibly powerful and anything within the last 5 years or so will probably last 7 to 10 years if you take care of it. Depending on your use, you might need a battery swap, but you should only need to replace your phone sooner if there are features you absolutely need in the new model.
Apple's big sin is not planned obsolescence but repairability. Their products are well made. They last a long time. And they tend to have fewer manufacturing defects than other brands. (In general. Your anecdotal experiences will vary.)
But... shit happens.
People drop things. They spill things. They abuse things. And when they break, you shouldn't have to get a whole new thing. Apple seems to have poorly trained diagnostic staff who commonly tell people their device cannot be repaired when the diagnosis is not apparent. Or they will misdiagnose something with a super expensive repair when it is actually a minor fix. (Which is why experienced repair shops exist and should be supported by Apple.) Apple has tried to micro-manage the repair process of their devices to such a degree that it has sparked an entire advocacy movement.
But don't let Google, Samsung, etc off the hook either. They suck too. If you are using Android thinking you have some moral high ground, they either do the same shit or they do slightly different shit that is just as bad.
Not to mention, Google is an advertising company. I don't understand people who are like, "Apple is evil, so I'm going to use this advertising platform instead." It's a lateral move, at best.
No good guys in capitalism, folks.
At minimum, repair shops should be able to use spare parts from broken devices to fix salvageable ones. And Apple is literally pairing screens and chips to one device so they can't be used to fix others. It's... diabolical.
So, update your phones.
Apple is bad at repairability but is good as far as planned obsolescence goes. Although when computers and phones eventually are able to last for 20 years, we'll see if that changes. For now, they make things that last until you fumble them into the toilet bowl and *that* is when they start to suck.
If you need a good villain to talk about planned obsolescence, I would go with Samsung appliances.

(Transcript under the cut)
London: Grim, welcome back! And for all of those just joining us at home: This is The Motive Trials and I am London Greer. Our competitors have just entered The Arena and are preparing for the first challenge: Hell's Kitchen. Each competitor will need to continue cooking Eggs and Toast until a fire breaks out. If they are able to keep a cool head and extinguish themselves, the round will continue and only stop once one competitor is going home with Grim here.
Grim: I'm definitely excited about this round, London. Cooking can often be an undervalued, but dangerous, survival skill. I think I answer more calls for kitchen fires than anything else. Besides, those appliance do not look safe.
London: Right you are, Grim! And if an appliance breaks, the sim using it will need to repair it before continuing the challenge. Let's head on over to The Arena.
And we're off! Here we see Chen Huan already grabbing those ingredients from their fridge.
Grim: Tianna looks pretty unhappy with this challenge so far.
London: That's not surprising, Grim. She does NOT like cooking.
We see a little smoke over at Aubree's station. She's attempting to scrape those eggs off the pan to prevent them from burning.
Oh no! That is the fire alarm we hear! It seems Kendall's cooking has jumped out of the pan!
Grim: You know, this is surprising, London. We're only 20 minutes into this challenge.
She seems to be attempting to pat the flames to put them out. This can be an effective method with very small fires.
London: I think we're past the point of patting, Grim. But, she's still got time is she can stop panicking and remember to grab her fire extinguisher!
This is a shame. I think we're gonna need a cleanup on aisle Kendall, Grim.
Grim: I think so too, London. I just got the notification on my tablet.
London: There's an app for that?!
Grim: It's a proprietary software, but yes.
London: Oh no, ladies and gentleman! It seems the purple curtain has come down for our friend, Kendall. I know the last thing she wanted was to see her urn on that plinth. Let's go ahead and sit down with her and see if we can figure out what went wrong.
Kendall, thank you so much for talking to us, we know this has got to be a tough time for you right now. You seemed like a really well prepared competitor, can you tell us what you think went wrong in there?
Kendall: You know, cooking has never really been my thing. I'm more of an open a can and grab a fork kinda girl.
London: So then, can you tell us why you seem so happy? You aura is even glowing green!
Kendall: I just found out that ghosts get to hang out in the arena and cause problems for the other competitors! Hell, that's more fun than the competition itself! I can't wait to be an agent of pure chaos.
London: Well, ladies and gentlemen, you heard it here first! Stay with us for more chaos and carnage. The next challenge will test our competitors' willpower when faced with the ultimate temptation: cake.
