Power of Attorney vs Living Will: What’s the Difference?

In estate planning, do you include all of your stuff?  I mean, EVERYTHING?  Well, yes.  There are a number of legal approaches to estate planning.  The simplest and most important is a General Durable Power of Attorney to appoint an agent if you become incapacitated.  Then a Will, so when you pass away YOU direct your property.  Medical Directives are important to make your own choices about treatment.  Trusts are important to protect assets, do Medicaid planning, and control property after death.

It is a lot to think about.  The thing is, estate planning is not that expensive and it provides you with the tools you need to make informed decisions and protect your loved ones.

Today I have a meeting with my Ty Hafan Family Support Worker. It’s to discuss my advance directive and updating my funeral plans. Don’t worry, I’m not planning on needing them anytime soon! But the reality of living with a degenerative, life threatening condition is that any day could be my last, and in true obsessive compulsive style, I like to be prepared. These documents are my safety net; always there when I need them. I did my first one of these when I was about 14. My parents have never been involved; it’s always been me. This is for a fairly simple reason; my mum admits that my parents would say yes to anything to keep me alive... the whole point of an advance directive is having my decisions known, and being able to tell my team what treatments I don’t want, and when I want them to stop. I can’t explain how I’m feeling right now. Already my stomach is full of That Yucky Feeling, as The Davies Clan call it. But I also know it’s really important for me, and for my loved ones, that I do this. The irony is not lost on me that this appointment falls on Dying Matters week... I gotta put my money where my mouth is, right?! Can’t be telling y’all to talk about death whilst avoiding the subject myself! I will be going swimming this morning, which I know will help my anxiety. But for after, please send me something happy? It can be a photo, or telling me something good about your day? Is a tattoo on a guy's chest stating "DO NOT RESUSCITATE" a valid advance medical directive?

This actually occurred!  A medical directive - also known as a living will - is a person's own statement (directive) to medical professionals and family that they do or don't want to be revived under certain circumstances and states whether or not the person wants life sustaining treatment such as a ventilator. So...this guy had tattooed on his chest "Do Not Resuscitate" and a signature! He was in a comatose state and medical professionals were stumped.  They elected to provide medical care and support but did not connect a ventilator or feeding tube.  The guy's real AMD was located - which coincided with his tattoo - and he died the following day.  My observation is that this would not work under Virginia law since it does not meet the requirements of a legal AMD.  That said - the tattoo was a LOT more expensive than a legal medical directive document!

I may only be 26 but as an icu nurse I've seen people my age or younger in situations that made their families make tough decisions. It gives me peace of mind knowing my family will be able to make decisions that I would want in the event I can't.
