Troubling mistakes in death investigations prompt calls for change for Missouri coroners
KANSAS CITY, Mo. — In most of Missouri when there’s an unexpected death, a coroner is notified. The coroner determines the cause of death.
It’s a lot of power for an elected official who needs almost no qualifications to hold the job.
However, FOX4 Problem Solvers found that some serious mistakes are prompting calls for change.
If a coroner botches a death investigation, those who often pay the biggest price are the family members of the deceased. In fact, it’s their outrage that’s leading the call for change.
Dustin Chance was 36 years old when he died. Jayke Minor was 27. Both families will never know why they died, because the coroner never ordered an autopsy.
“He was one of those people always on the go. We went to bed and he just didn’t wake up,” Joy Chance, Dustin’s wife, said.
“Jayke was a good kid. He didn’t deserve this. No family deserves to go through what we have,” dad Jay Minor said.
Saline County Coroner Willie Harlow is an executive board member of the Missouri Coroners and Medical Examiners Association.
He was so alarmed by what happened in these two cases, the sudden and inexplicable deaths of two seemingly healthy young men, that he wants Missouri law changed to hold coroners more accountable.
“A coroner is elected for four years. That’s a long time to keep someone in office who is not doing their job. Anybody can be the coroner,” Harlow said.
That’s a disturbing, but little-known fact.
“There was a guy who was running who was a taxicab driver. What qualifications would a taxicab driver have to be coroner? Well, he has the same qualifications as anyone else: Over the age of 21 and lived in that county for six months. So that’s a little scary,” Harlow said.
Although large metropolitan areas like Kansas City use medical examiners, who are also doctors, the majority of rural Missouri relies on coroners.
“My son passed away eight-and-a-half years ago, unexpectedly, no known medical conditions,” Jay Minor said.
Even the head of Missouri’s coroner’s association says an autopsy should have been performed, but the Howard County corner never requested one.
It took Jay Minor three years and the help of a different county’s coroner to even get the report detailing how his son died.
“I have your report, but it’s full of mistakes,” he said.
Where his son’s name should have been written is another person’s name, scratched out with his son’s written above.
The report says the body was found in the living room, but the police report says he’s in the bedroom. The body is described as warm, but the police report states the body was cold. And police arrived an hour before the coroner.
But what has the dad most upset: His son’s death is listed as “drug overdose.” This is something the coroner couldn’t possibly have known because there was no toxicology report.
“I found that hard to believe, so we kept pressing and that’s when this all started to snowball,” he said.
Officials at the Missouri Coroners and Medical Examiners Association were so outraged they went to the attorney general to see if the coroner could be disciplined, but there was nothing the attorney general could do.
Howard County Coroner Frank Flaspohler insisted that the error-ridden coroner’s report that Jay received three years after his son died wasn’t finished and shouldn’t have been released.
“I started typing that in because I just type over an old one. And I ended up printing that report before it was finished and giving it to a fellow coroner. When I handed it to him, I said, ‘This isn`t right. Don’t give it to the family, it’s got the name misspelled,’” Flaspohler said. “So I had no clue that he would give it to the family, and he did.”
But the coroner he gave it to, the Pettis County coroner, said he was never told that.
Flaspohler, who has been coroner for 30 years, acknowledges he made mistakes. He said since Jayke’s death he’s changed his policies and tripled the number of autopsies.
Unfortunately, what happened in Howard County isn’t unusual.
“I asked him for an autopsy, and he told me no. His exact words: They were a poor county and he couldn’t justify it,” Joy Chance said.
She lives in Odessa and had been camping with her husband Dustin near Lake of the Ozarks. She said he seemed fine when they went to sleep, but he never woke up. The Miller County coroner, who is also an EMT, handled the death.
“He started saying, ‘I believe your husband had undiagnosed sleep apnea.’ I argued with him about it. And then he said that my husband may have had a stroke or a heart attack. And I just got really upset. I said he was 36 years old. There was nothing wrong with him,” Chance recounted.
She kept demanding an autopsy, but he refused.
“The statute says it’s the coroner’s job to determine the manner and cause of death,” Harlow said, who added that guessing isn’t good enough.
“He wasn’t somebody that you just hear about. He was an actual person, he was a father, he was a husband, he was a brother, he was a friend. And I feel like he didn’t get any respect at all,” Joy Chance said.
A bill before the Missouri legislature will mandate better training for all coroners. If they don’t comply, they can be fined and lose some of their powers.
Jay Minor has been fighting to get it passed for three years, it will be called “Jayke’s Law.”
After multiple complaints, both coroners eventually corrected their report, but both families are still upset with the final version.

Settlement reached in MO wrongful death lawsuit
KANSAS CITY, Mo. (AP) — A settlement has been reached in a wrongful death lawsuit filed after a developmentally disabled Missouri man's body was found encased in concrete after he went missing from a supported living home.
Rudy Veit, an attorney for the mother and sister-in-law of Carl DeBrodie, said Thursday that details of the settlement are confidential. He said the settlement provides enough money to care for DeBrodie's mother, Carolyn Summers, and for donations to organizations that helped DeBrodie during his lifetime.
DeBrodie's body was found in April 2017, about a week after he was reported missing from Second Chance Homes in Fulton. Investigators believe his disappearance was not reported for months.
Veit said the agreement includes ways to improve oversight of care for people in supported living homes and to hold public administrators more accountable.

After alleged neglect at care facility, injured veteran’s family says he deserves better
RAYMORE, Mo. — Bradick Barrett served two tours of duty in Iraq, but it was only after he was back home in Missouri that his sisters started fearing for his safety.
“He’s completely reliant for his every need,” his sister Aylica Beach said, referring to the traumatic brain injury he suffered after being hit by a car in Kansas City.
Because he needed round-the-clock care, his family moved him to Redwood of Raymore, a long-term care facility.
Beach said his care there has declined after the nursing home was bought by a new company. She said her 34-year-old brother’s needs are often ignored.
Twice when she visited his bed had been urine soaked for so long that his sheets had rings of dried urine surrounding the wet part.
“You could smell the stench before you made it to his room,” Beach said.
She said when she visits him he’s never dressed (naked except for a diaper) even though he has a closet full of clothes.
His younger sister Alexis was so alarmed she called FOX4 Problem Solvers.
“Every time we would complain to higher ups, nobody would do anything,” Alexis said.
The disturbing conditions are part of a pattern FOX4 Problem Solvers had found at nursing homes all owned by the same company — OPCO CA Skilled Management.
Two years ago the Los Angeles-based company bought six nursing homes in the Kansas City area: Redwood of Blue River, Redwood of Cameron, Redwood of Carmel Hills, Redwood of Independence, Redwood of Kansas City South and Redwood of Raymore.
According to Nursing Home Compare, three of the homes only rated a single start out of five possible.
“I can’t sleep at night because I’m wondering how he has to live,” she said. “This is a man who fought for our country, and these are the conditions that he’s stuck with.”
Last year a wrongful death lawsuit was filed against the same Raymore nursing home after a frail 70-year-old woman fell twice. Her frustrated family transferred her to another nursing home where she died a month later. The family blames both homes for her death, according to the lawsuit.
The most recent state inspection on file shows the Raymore home has 23 violations. That’s about three times the national average.

Among the findings: Not enough staff, some patients were only bathed about once a month, FBI background checks weren’t done on employees, pain medication wasn’t being administered and some patients were left to linger in bed for hours.
The Redwood nursing homes in Carmel Hills and Kansas City saw violations double after the new company came on board. Last year, FOX4 reported that problems at the Independence home were so numerous that the feds threatened to withhold Medicaid funding if they weren’t fixed.
“What we have is an epidemic problem,” said Kansas City attorney Scott Shachtman who has sued multiple nursing homes and is representing the family of the woman who died shortly after leaving Redwood of Raymore.
Although Shachtman wouldn’t talk about that case, he did speak about problems in general with nursing home care.
“The problem is that these nursing homes often times are run with limited budgets, limited people, limited staffing, limited equipment and what that equates to is people getting hurt,” Shachtman said.
He said a broken hip or a bed sore may not sound serious, but for an elderly person it can be a death sentence.
“Within a month their body has declined to the point of not being able to survive,” Shachtman said.
Jim Kooken, an administrator at Redwood of Raymore, told FOX4 he’s made significant changes since taking over eight months ago.

He said he had investigated claim the sisters had made regarding their brother’s care and could not substantiate them. He also said the nursing home had problems long before the company he works for bought it.
“They inherited a lot of problems,” Kooken said. “Slowly but surely we are making things better.”
Kooken said he’s fired unqualified staff, instituted training programs for others and increased started pay from $12 to 13 an hour.
He said a recent state inspection found only 11 violations — closer to the national average. Kooken also insisted that the company is one of the better for-profit chains he’s ever worked for.
But a study reported in Medicare Advocacy found that the worst nursing homes in the nation are for-profit nursing homes. They have lower staffing levels, a higher number of violations and more patient injuries that nonprofit homes.
Beach is trying to move her brother to a nonprofit home, one operated in Warrensburg by the state of Missouri for veterans — but there’s a waiting list. She said she won’t give up trying to get him moved, no matter how long it takes.
“When I was talking to him the last time I was there about his conditions and promising him I would get him out of there, he stated crying,” she said.
FOX4 contacted the veteran’s home on behalf of Beach’s brother, but no one would comment on his position on the waiting list because of privacy concerns.

$100M lawsuit filed for duck boat victims
KANSAS CITY, Mo. — An attorney has filed a lawsuit against Ripley Entertainment, Inc. on behalf of some members of the Indianapolis, Indiana family killed in a duck boat incident in Branson, Missouri.
The Ride the Ducks Branson vehicle capsized and sank on July, 19, amid strong storm winds and taking on too much water. Seventeen people died, including the driver of the boat and nine members of a family of 11 on vacation from Indianapolis. The victims’ ages ranged from just 1 year old, to 70 years old.
The lawsuit alleges wrongful death, outrageous conduct and negligence in the incident, and seeks at least $100 million in damages.
It also states inspectors had warned the company the bilge pumps on the duck boats could fail in bad weather.
Attorney Gregory W. Alshire is representing John D. Coleman, Ervin Coleman, Lisa D. Berry, Marlo Rose Wells and Maxwell Ly in the case, according to court documents.
Additional defendants include Ride the Ducks International, LLC, Ride the Ducks Branson, LLC, Herschend Family Entertainment Corporation, and Amphibious Vehicle Manufacturing, LLC.
