David Enrich’s “Murder the Truth”
Tumblr media
I'm on a 20+ city book tour for my new novel PICKS AND SHOVELS. Catch me in SAN DIEGO at MYSTERIOUS GALAXY on Mar 24, and in CHICAGO with PETER SAGAL on Apr 2. More tour dates here.
Tumblr media
David Enrich's Murder the Truth: Fear, the First Amendment, and a Secret Campaign to Protect the Powerful is a brave, furious book about the long-running plan by America's wealthy and corrupt to "open up the libel laws" so they can destroy their critics:
https://www.harpercollins.com/products/murder-the-truth-david-enrich
Enrich is a veteran business reporter at the New York Times; he's reported extensively on high finance and sleaze, and has a knack for piercing the Shield of Boredom that protects finance crimes from scrutiny. His 2017 book The Spider's Web manages the nearly impossible trick of making the LIBOR-rigging conspiracy – which involved trillions, but in ways that were so baroque that hardly anyone noticed – comprehensible:
https://memex.craphound.com/2017/09/24/the-spider-network-a-novelistic-account-of-the-mediocre-rich-men-who-robbed-the-world-with-libor/
In taking on the libel-industrial complex – a network of shadowy, thin-skinned, wealthy litigation funders; crank academics; buck-chasing lawyer lickspittle sociopaths; and the most corrupt Supreme Court justice on the bench today – Enrich is wading into dangerous territory. After all, he's reporting on people who've made it their life's mission to financially destroy anyone who has the temerity to report on their misdeeds.
As such, Enrich's writing is extremely cautious, sometimes comically so, but always intentionally, in a way that highlights the absurd chilling effect his subjects are attempting to induce in all of us.
The book primarily concerns itself with the effort to overturn Sullivan, a 1964 Supreme Court case that established protections for media outlets that report on public figures and commit minor factual errors, provided that the errors were neither negligent nor malicious.
Since Sullivan, media outlets have held the upper hand when reporting on public figures. While Sullivan isn't a license to simply make stuff up about celebrities, politicians and business leaders, it does mean that if a reporter makes a minor misstatement, it's on the subject of the reporting to prove that the error was negligent and/or malicious.
Before Sullivan, most defamation litigation happened in state courts, and southern courts allowed lawmakers and cops to sue newspapers that reported on racial terror campaigns during the civil rights fight. The judgments involved were so large that many media outlets simply gave up on reporting on the intimidation, violence and murder taking place in the Jim Crow south.
True to form, Clarence Thomas has led the charge to dismantle a law that was key to the struggle for rights for Black people and other disfavored minorities. In Enrich's telling, Thomas's animus for Sullivan started during his confirmation hearings, when Anita Hill described his relentless sexual harassment of the lawyers who worked for him, including Hill. Being the subject of a media firestorm that painted him as a disgusting, cruel sex-pest seems to have inspired Thomas in a decades-long campaign to find a case that would let him tear down Sullivan, so that wealthy people could once again intimidate reporters into silence. Of course, Thomas's hatred for Sullivan only grew when Propublica revealed that he had taken numerous "gifts" from wealthy "friends" who had business before the courts, revelations that will forever make Thomas's name a synonym for corruption.
Enrich's cast of characters includes a clutch of whiny, ultra-rich axe-grinders, who finance (often in secret) lawsuits that are designed to chip away at Sullivan. Some are international looters or corrupt ex-Soviet oligarchs, but others are ideologues, committed to the principle of impunity for the powerful.
He also introduces us to the lawyers who wage these battles. As you might imagine, the kind of lawyer who sits up at night figuring out how to help wealthy, powerful people destroy their critics is often a crank themselves, with "colorful" personal relations that Enrich reports on with meticulous prose, including the many denials and non-denials his subjects sent when he sought comment.
As with his LIBOR book, Enrich does yeoman duty here unpacking complex matters that would be dull in a lesser writer's hands. The litigation strategies devised by Sullivan's enemies are always convoluted and are sometimes clever, much like the litigation strategies used to kill campaign finance limits (Citizens United) and abortion rights (Dobbs). Indeed, many of the financiers, think-tanks and lawyers behind those plots are also would-be Sullivan slayers.
The best of these legal gambits are actually rather clever – locating innocent people who've been genuinely wronged by Sullivan (as the saying goes, "hard cases make bad law") and then using them to undermine Sullivan, without actually helping them in any way. It's positively fiendish.
We're in a moment when a lot of powerful people are getting far more powerful, and abusing that power to commit wildly corrupt acts. The only way we'll know about this is if the press can freely report on their misdeeds. Murder the Truth is a vital guide to the next Citizens United, the next Dobbs – a campaign to take away your right to know about the next assault on your rights that plutocrats will launch.

Hey! I decided to post this, even though I’m a bit bummed I didn’t get to redesign all the characters. I managed to finish Luna and Juno. I also tried coming up with a visual style for them, based loosely on the doll proportions. My favorite is Rhea, but she’s not here this time.
This is SpacePOP — a short-lived doll franchise that had some really rough web episodes (they were weak in writing, animation, and overall aesthetic… sorry). There were a few dolls, even a book, and then it all disappeared. I still remember their social media trying to post memes. It didn’t go well. I feel sorry for them. Was this in 2017?
I liked the idea behind it — alien girls connected to different music genres. I love music (especially electronic), and I think the concept could’ve had potential.
What I didn’t like was how much they tried to cram in. They were princesses, a rock band, planet saviors, with costumes straight out of late Winx Club from WOW. It was just too much. And the villain? Evil because… she's evil. That’s it. I always felt like the whole thing needed a serious rework.
So here’s my version:
In a distant corner of the universe lies a musical galaxy — a constellation of planets, each pulsing with its own unique sound. Every world is shaped by a different genre of music, influencing its rhythm, culture, and energy. But a new force begins to spread: Empress Geela, a being who feeds on silence, order, and control. Once a gifted conductor from the galaxy’s central planet, her sensitivity to sound became unbearable. What others saw as music, she experienced as chaos. In her search for peace, she chose silence — and now turns vibrant planets into lifeless, soundless shells.
To resist her, five girls from five musical worlds join forces as SpacePOP — guardians of harmony. Together, they use the power of music to restore balance, awaken silenced planets, and push back the quiet.
Each planet they save reveals a new music genre, a new world, and a new heroine — allowing the universe to grow over time. This creates space for new stories, new designs, and new characters — each with their own look, sound, and vibe. Perfect for an expanding collection of dolls, outfits, and music-inspired aesthetic.
I originally planned to develop the concept further — refine the worldbuilding, explore more ideas, and especially redesign the rest of the characters. But the motivation just never really came. So for now, I’m just posting what I have here.

The Birth of a Monster: Creature from the Black Lagoon (1954)
In the golden age of Hollywood horror, one monster swam into the spotlight and left a permanent mark on cinema. Creature from the Black Lagoon, released by Universal Pictures in 1954, introduced audiences to the Gill-man—a prehistoric, amphibious humanoid lurking deep in the Amazon. Directed by Jack Arnold, the film blended science fiction, primal fear, and Cold War anxieties into a haunting underwater ballet that captivated viewers then and continues to influence horror creators today.
Iconography in Scales: The Gill-man's Design
The Gill-man remains one of the most iconic monster designs in film history. Crafted by Milicent Patrick (though initially credited to Bud Westmore), the creature's look merged man and fish in a way that felt both alien and tragically familiar. Its bulbous eyes, glistening scales, and webbed claws were revolutionary for the era—and set a new bar for practical effects and costuming. Unlike earlier monsters like Dracula or Frankenstein’s creature, the Gill-man was not human-born or cursed—it was nature itself turned hostile.
Science Meets Terror: A Genre Evolution
Creature from the Black Lagoon emerged during a time when science fiction and horror began to merge. Instead of relying solely on gothic horror tropes, the film tapped into post-war fascination with evolution, radiation, and the unknown. The Gill-man, presented as a missing link, was a scientific anomaly—one that brought horror out of the castle and into the jungle. This shift influenced future films like Alien, The Thing, and The Shape of Water, where biology, not just mythology, births terror.
A Monster for the Atomic Age
Beneath the thrills and screams, Creature from the Black Lagoon reflected 1950s anxieties. The deep, unexplored waters of the Amazon symbolized the fear of the unknown during the Cold War era. The Gill-man, a being untouched by modern civilization, became a metaphor for the consequences of disrupting nature and the hubris of scientific exploration. In this sense, the film wasn't just a monster flick—it was a cautionary tale with gills.
Legacy in the Murky Depths
Universal’s classic monster lineup already featured heavyweights like Dracula, the Mummy, and the Wolfman—but the Gill-man was different. It was the last great Universal Monster of the era and arguably the first true creature-feature icon of modern horror. It inspired countless homages and reinterpretations—from the underwater terror of Jaws to Guillermo del Toro’s romantic reimagining in The Shape of Water (2017), which won the Academy Award for Best Picture.
Conclusion: Still Swimming Strong
Seventy years later, Creature from the Black Lagoon continues to ripple through pop culture. Its daring visuals, ecological themes, and tragic anti-hero have made it a touchstone in horror film history. Whether seen as a love story, a monster movie, or a science-fiction parable, the Gill-man remains a haunting reminder that sometimes the real terror is not what we find in the darkness—but what we disturb in it.

Bro got a really captivating vocab, how can I refuse? /pos Anyways, I am submitting Neko! Pronounced as Nico cause it took me over 3 years to realize that I was dyslexic and had been saying 'Neko' wrong the whole time. Created on SEPTEMBER 11th 2018 My oldest Kirby OC. Lil Man started off as a little cat with an absolutely horrendous design that was bleeding with the affection I had for the Kirby fandom and anime. Filled to the brim with cringe.
Tumblr media Tumblr media
[OLD ART FROM 2018] Skipping over a few years, he was redesigned with any sanity I had to salvage them. Thus came this new iteration of Neko. Which is whatever you call this.
Tumblr media Tumblr media Tumblr media Tumblr media
[OLD ART FROM 2022-2023] Which is still a cannon version of him but not the specific version of him that I'm submitting to this tournament. I got out of drawing puffballs and borbs in the fandom so if someone asks me to draw in the Kirby species format it may or may not look very good 👍 Coming to my last design of him that will be submitted into the ring to fight it out in brackets. His biker arc.
Tumblr media Tumblr media Tumblr media Tumblr media Tumblr media Tumblr media Tumblr media Tumblr media
[ART FROM LATE 2023 TO PRESENT] This variation of Neko was made for an RP with a friend group I've been a part of since 2017 on the good ol Kirby Amino I know traumatized a whole lot of you that was on it during the prime and golden age of Amino. Therapy isn't cheap but I hope those affected can find comfort knowing the place has fallen into ruins, dusted with spider webs and rotting as the app burns from the inside. Anyways, this version of him grew up in an underground fight ring which was his home after living on the streets for his whole life, before it was discovered and the whole place scattered him and his friends across the region where the story takes place. I didn't write the story for this RP that was heavily inspired by TOTK, but that's the gist of his backstory. He's very laid back now that he'd older but was much cockier when in the fight ring. He very much mellowed out after his whole home got taken away. Learning to not treat everything like it was easily disposable in life. Neko is and has always been caring to his friends and family, doing his best to take care of them without letting his strong persona mask slip off. His ethnicity is Filipino. His current design across the board is based on my childhood cat named Jingles and his personality is based on another one of my cats that passed away last year at the age of 18. While some may thing this isn't important to mention I have to say those people are wrong as he really did shape Neko into the character that they are. So overall I hope to whomever read this far you enjoyed learning about Neko! Thanks for reading and good luck to the other bracket competitors, may the best OC win this :] Ciao~! Bonus: I don't have pictures of Jingles but I do of Spookie <3

Horror Movie of the day: Creature from the Black Lagoon (1954)
Near the Amazon river, geologist Carl Maia(Antonio Moreno) finds a strange fossil from the Devonian period. It has webbed fingers, but a bone structure closer to a hominid, proving the connection between water and land animals. While he was reuniting with Ictiologist David Reed(Richard Carlson) to ask for his help in this expedition, two of his expedition collaborators are killed by what he suspects was a jaguar. But others aren't so sure about that. Indeed, there's a living fossil following them, in silence, watching from the waters of what the captain of the ship calls "The Black Lagoon".
Directed by Jack Arnold, this is one of the cornerstones of aquatic monsters in film. Inspired by both the producers hearing about local legends from the Amazon rainforest about aquatic monsters in the river and the discovery of the coelacanth not being extinct as an animal group, the movie has a little more to say about human's relationship with nature than its fame would lead you to believe. It's remembered as that one monster film where an underwater creature kidnaps a woman... but that's surprisingly not remotely close to the core of the conflict, as the so called Gillman is in fact given quite a lot of sympathy, being presented as a wild animal protecting his territory from invaders, even if he does indeed try to capture David's girlfriend Kay(Julia Adams) to keep her as a mate.
Speaking of which, the Gillman is easily the most copied monster in the Universal roster for a reason; being played by olympic swimmer Ricou Browning for underwater scenes really helped sell how DEADLY this creature is once you submerge, regardless of how beautifully those sequences under the river were shot. Yep, for those with thalassophobia, the movie is not for you.
Even if clearly of a lower prestige, it benefits from more than two decades of advancements in cinematography to deliver a simple but engaging, suspenseful ride.
Tumblr media
The Gillman in general is quite the achievement, to be honest. Not the most convincing costume for modern standards but it does sell the coencept of the aquatic monster quite well while also being quite mobile, allowing for fairly seamless swimming sequences. Two versions of the costume were required as well: for underwater sequences the costume was brighter so it would be captured by the camera in conditions with less light, while it was darker for scenes where the creature was on land.
Tumblr media Tumblr media
Sadly, Milicent Patrick, the unsung hero behind this marvel of a design wasn't properly credited during her lifetime, which is an absolute disgrace on Hollywood and Universal Studios. A creature movie lives or dies by the way the monster looks, so to deny the achievements of this woman is just infuriating.
Tumblr media
But of couse, with The Shape of Water (which Guillermo del Toro shamelessly admits is partly his fanfic where Kay and the Gilman end up together... thankfully without kidnappings) and the general CURSE on any project related to this particular creature(as multiple attempted reboots have been attempted but never seen the light of day, the most recent being in talks by James Wan of Saw and The Conjuring fame), who knows what's in store for this underwater menace.
Pictured below, The Shape of Water(2017) and designs for Gillman made by Rick Baker for a cancelled reboot by John Carpenter in 1992

CHARACTER NOTES: JUPITER/ERIS EVANS
[I've been meaning to do this for a while and I have it on the brain right now, so why not? With the information below, I'm hoping to open new doors for interaction while also clarifying some of Eris's motives and the core influences behind the character. She deserves a deep dive. 😊]
Tumblr media
Pokemon Platinum is my favorite main series game, I love my supporting characters, and I wanted to try a villain, which is why I initially picked up roleplaying JUPITER around 2017 in a closed Tumblr group. However, the experience left me feeling bitter--the Cyrus player at the time was very possessive, and Jupiter and I couldn't escape his shadow (or the community's view that Jupiter was a mere Galactic lackey, victim of the 10,000th spacesuit joke.)
ERIS EVANS was born from the ashes of that blog when I went indie in 2020, inspired by the questions: what would a post-Galactic Jupiter do, fully independent and freed from Cyrus's influence? What if she was 'worse'? and what would today's unethical sciences, corrupt politics, and greedy corporate behaviors look like within the Pokemon world?
Four main themes inform Eris's portrayal: (excess) hunger/greed, masks, poison, and resilience/survival.
More than anything, Eris Evans has an insatiable appetite for knowledge, willing to cross almost any unethical lines to satisfy her rampant curiosity. This hunger has been present all her life--from when she was gazing at the distant stars, entranced by Cyrus's fantastical vision for a new world, searching for her father, and even more so now. (Her hunger for knowledge is all-consuming and spills in every direction. If you have something cool, she'll want to figure out how it works. Take it apart. Tinker and probe.)
Importantly, Eris does not want to usurp any existing leaders or organizations...
The spotlight is stifling, and she is most at home working away in the background shadows. Above all, power, influence and control are things Eris craves because they allow her the time/resources to experiment as she pleases. While she's currently under Devon's employ right now, Eris will happily work with/under anybody who can provide her with freedom, resources, and a lofty goal to work towards.
With this being said, Eris's appetite is designed to lead her into trouble. She's woven an intricate web thus far (which I am pumped about), flitting back and forth between various conflicting organizations--a day will come when her multilayered façade all comes crashing down.
So, how does Eris manage to survive under the spotlight, juggling all her connections? She's an expert mask-wearer, ultimate deceiver, interchanging her personality to best fit the mood and get what she wants. She can't help herself. With her disarming looks and unmatched charisma, Eris excels in the world of big business, concealing her darker side underneath. A total wolf in sheep's clothing.
I made Eris a poison-developing expert because it fits in with her curiosity and the idea of soft power, an advisor whispering shadily into a leader's ear. Poison corrodes, corrupts, and is often used in deception, which makes it Eris's perfect symbol of choice. She uses poison in many forms--ranging from the sadistic physicality of her 'enforcer' Seviper, Anje to the gentle suggestion of her mind-warping Kirlia, Felisa. Eris and poison are all about damage over time, infecting and collapsing bigger foes from the inside...
All of this being said, Eris's endgame is unclear right now, even to her. Galactic gave her an ambition to sink her claws into, and Devon is currently satisfying her with full access to Pokemon bioenergy development, but she's always on the lookout for the next big step, always working, worrying about her legacy. Survival.
She helped leash Dialga and Palkia atop the Spear Pillar, spat at them. Soon after, Cyrus disappeared, just like her father had aboard the Sea Mauville all those years ago. That fateful encounter (and abandonment) helped her realize that time and influence are fleeting. In order to thrive in this new, post-Galactic life, she must fill the void with as much knowledge as possible, as many answers as possible. Rules are restraints. Above all, she must survive, no matter how terrifying/twisted she may become. Mortality hangs over her head like a hungry serpent, always demanding tribute.
Always demanding more.
TIDBITS
ERIS is the second (not first) largest dwarf planet in the solar system, maintaining Galactic's cute planetary roots. Eris is also the goddess of discontent and discord (not that Discord.) EVANS was chosen because I wanted an unassuming last name for her to blend in to society following her expulsion from Sinnoh. Also, alliteration always goes hard.
I chose DEVON as Eris's landing spot because they are very similar. Smiling exteriors, shady interiors. I view Devon as the consummate too big to fail company of the Pokemon world, doing whatever it can to maintain PR and get ahead of the competition. (Once again, Eris is looking out for herself and isn't beholden to Devon, though the corp does spoil her...)

Magilumiere Co. Ltd. Anime PV
youtube
Another day, another anime trailer. This one though... well, it's certainly not Dandadan, I'll say that. It might still be worth watching if you enjoy the manga or are curious about the series in general, but I certainly wouldn't hold my breath over it being all that great, and for more than a few reasons.
First of all, this is a coop project. Neither studio has been too hot in recent memory. The bigger name is J.C. Staff, and they don't exactly inspire much confidence in delivering a consistent performance. On the other side, and being touted as the "lead" studio is Moe. Never heard of them? Well, can't blame you, this is their first ever anime. They came to be in 2017, and since then have worked on a grand total of, checks notes, 30 series. Rather surprising and impressive.... until you realize that it's almost exclusively CGI and photography. The studio has effectively no real experience with 2D animation, the only credit being a single episode's worth of in-between animation on the Girl From The Other Side OVA.
So yeah, pretty rough hands the series in, and you could immediately feel that from the key visual for the series.
Tumblr media Tumblr media
I'll start with the character designs. They're not great, as expected from a first time character designer. They do a good job of copying the outline, but completely neglect the actual details and styles. Eyes are overall much larger, faces are sharper rather than the more round style of the manga, mouths are much larger, and so on and so forth. Even simple details like Hitomi's (the yellow haired girl) skirt. In the manga, the two tone design has different heights to add depth, but that doesn't exist in the anime.
And really, you see a similar story with the color design/composition. It's washed out and plain flat. It's incredibly bright compared to the manga, which does no favors to the art. I totally understand that you can't add near the same wrinkles and folds in the clothes, but Aoki's shading doesn't rely on lines to create texture and feel, and having that aspect of shading missing from the anime really adds to its struggles.
Anyways, continuing in this downward spiral, this is from a first time director. And no, they don't have a lick of experience with direction in any capacity. The most they've done is CG direction with Moe on the projects that they've supported. It just doesn't really bode well overall, and you can feel that a lot in how little of an impact the trailer leaves on you.
If there was one thing to say was good though, I would most likely say it was the environment art and animation. But even then that's only a 'sometimes' thing, as you get nice environment art like the top image, and then just straight up bad scenes like the bottom.
Tumblr media Tumblr media
If you're a fan of the series, or even just curious about it since it was recently licensed by Viz, there's really not much hope for a "good" adaptation here. It's probably passable, and might be enough to get more people interested in the series. As supplementary material and a new way to experience the manga though, it's pretty well looking like a waste of time. Incredibly surprising given how popular the manga is. After all, it did rank third overall in the Next Manga Award in 2022 for the web manga category.

Smart Trademark Watch Services to Remain Safe
Tumblr media
Today’s world runs on the internet, which alone makes a brand’s identity its most important treasure. Brands are declaring their presence through trademarks that include names, logos, slogans, and even sounds that are unique to them. Notwithstanding, it's challenging to assert and manage the rights in such marks and at the same time avoid the risks of unauthorized use of identical or very similar marks as the global online economy is expanding so fast.
The companies, however, use smart trademark watch services as a strategy to secure themselves and hardly ever fall victims to unauthorized use. In other words, they take control of brand protection and seek preventive measures. Nowadays, even the traditional word mark sounds are marked for protection. Furthermore, as the online market grows, trademarks are in danger of becoming counterfeit and thus, are the thefts. To counter these risks, brands have come up with smart trademark watch services which are a mechanism to ensure that the marks are observed, not used wrongly and lastly, if need be, appropriate measures are taken hierarchically beyond the national.
Purpose of Trademark Watch Services
A symbol is an instrument that inspires organization and consumer loyalty, and brands. It is a true fact that by the misuse of trademarks lots of people become victims of fraud. This content is available for those who want to read about the best ways to distinguish the best protected marks from fake ones. It provides graphic examples of how to detect logo poisoning.
WIPO has released its data suggesting that the intellectual property in the world is growing quite rapidly. New reports come in every year and the number of records always climbs up to new heights of which the data for 2016 reached its fever pitch at 3 million. From then on we have gradually increased the volume to 7.9 million records in 2017.
In addition to such marketing methods as flyers, brochures, catalog, and pamphlets, the companies are using direct marketing extensively. A very important part of these services is getting full reports including accurate rude language, swear words, adult content, and other issues, which can affect the brand anyway at all.
How Smart Trademark Watch Services Function
The smart trademark watch services as compared to the traditional methods involve the use of automation, artificial intelligence, and real-time data analysis tools. They are designed to simply monitor intellectual property (IP) assets that are scattered across digital and physical realms.
1. Automated Trademark Monitoring
A wide range of trademark databases such as the global registries like USPTO, EUIPO, WIPO, and local IP offices are being checked frequently. The alerts are fired off when there are identical or confusingly similar trademarks found.
Having this proactive surveillance, companies can easily start opposition procedures or contact the infringing parties even before the damage has been done.
2. AI-Powered Similarity Detection
Among the features of modern trademark watch tools are the matching algorithms which are AI-based that comprise but not limit to the word matches. In addition, machine learning is applied to analyze visual trademarks, phonetic similarities, and stylized logos.
The bywords of the set up are early warning, which implies that if possible risks emerge before they differ from the business malicious activities, the brand keeps safe.
3. Domain Name Monitoring
Domains are checked for which are getting registered close to the trademarks. The registration of the domains "brndname.com" and "yourbrand-shop.net" is the kind that can raise alert signals. This method has already allowed many cases of cyber squatters and fake web stores to be stopped.
4. Marketplace and Social Media Monitoring
Online marketplaces and social platforms are watched for unauthorized sellers or users who use the brand’s name or trademarks. The process of removing content can be automated through such systems.
Leading platforms like Amazon, Alibaba, eBay, Facebook, Instagram, and TikTok are professionally checked to detect and erase fake activity on a regular basis.
Benefits of Using Smart Trademark Watch Services
A trademark watch service revolves around the concept of vigilance in not only the technical sense but is also a shrewd investment in the brand's future and legal protection. The following are some of the main benefits of such services:
Early Detection of Trademark Infringement
In many legal systems, there is only a limited period for declaring one's opposition to similar trademarks. If a business misses this period, litigation is likely to be the only solution and it is always very expensive. Trademark watch services give an assurance that an infringement is recognized within a certain time interval and effective measures can be taken on time.
Protection Against Financial Losses
Marketplace infringements can lead to brand dilution and loss of sales, especially if copy products come into play. Using these services, businesses are able up to 70% faster fraud discovery and possible infringement cases from disreputable profiteers who deliberately mimic products and significantly devalue brands.
Reputation and Customer Trust Retention
Consumers who accidentally buy fake products may unintentionally be the reason for the wrong perception of the original brand and may spread it. This will cause damage to the brand reputation. The immediate termination of infringing activity will not only result in a loss of consumer confidence but it also helps mitigate by preventing the increase in the number of affected customers.
Global Coverage and Scalable Monitoring
Trademark watch solutions featuring AI and machine learning technologies are for the protection of the brand, no matter where the trademark is being used and in which language.
Who Are the Most Common Users of Trademark Watch Services?
Although every company with trademarks on the books can get advantages, there are some areas that are particularly exposed to the risks of trademark abuse:
Fashion and Luxury Goods – Counterfeits and fake listings are very common.
Pharmaceuticals – Unauthorized use can cause serious health risks to people.
Technology and Software – Apps, tools, and platforms are repeatedly being faked.
Consumer Electronics – Copycat accessories and devices are widespread in the world market.
FMCG and Beauty Brands - trademarks are being infringed on social media and packaging.
One trick is to persuade the startups and SMEs to subscribe to watch services to shield their emerging brand identities.
The Right Method of Identifying a Trademark Watch Partner
Many providers assure high-quality trademark protection services, yet the number that provides the same extent of monitoring, speed, and research is not the same. The following elements are important while picking a provider:
Access to a trademark database on the global market
AI-driven risk analysis and alerts
Marketplace and domain name monitoring
Custom reporting and analytics
Integration with legal IP teams
Companies like Cor search, MarkMonitor, Red Points, and Brand Shield are secure and in no doubt, they can efficiently handle large volumes of watch alerts.
Conclusion
In the current competitive status, passive defense is not sufficient. Brands need to take the first step to ensure their intellectual property and clients’ loyalty. Through smart trademark watch services, enterprises are becoming able to not only observe the threats but also to protect their rights, and even construct a more solid foundation for the entrepreneurship of future generations (Memory, Machauer, Garnevska, & Shim, 2020).
While digital risks are changing, the utilization of clever, large-scale and automated surveillance tools will be seen not only as a compliance requirement but also as an innovative strategy in the 21st century.

Week 9 Reflection – DES303
Theme: Accessibility, Feedback, and Iterative Redesign
What I Did This Week
Analysing user feedback and turning it into useful design enhancements for Pulse: Freedom in Motion was the focus of this week. Earlier, I held a targeted user feedback session where participants provided input on four main areas: content, navigation, accessibility, and visual design. I started redesigning the app's main features based on their feedback, giving accessibility and clarity top priority. My objective was to make the app more inclusive and user-friendly while improving the user experience based on practical insights.
Tumblr media
Feelings: From Uncertainty to Confidence
At first, I experienced a mixture of curiosity and anxiety. There was a subdued fear of how people would react to something I had spent so much time creating. But after I started reading their thoughts and recommendations, I felt inspired and reassured. Not only was the feedback critical, but it was also involved and constructive. The process felt collaborative because it was clear that people were interested in the app and wanted it to be successful. My perspective changed as a result of the experience from supporting design decisions to supporting iterative growth.
Tumblr media
Evaluation: What Feedback Revealed
The comments pointed out both areas that needed improvement and areas that were strong. The idea of integrating progress tracking, mental health, and movement was well received by users. The general idea and variety of dance content were well received. But there were three main areas of worry:
The homepage's visual clutter made it difficult to concentrate.
For mobile-first interaction, sidebar navigation felt strange.
The sense of ownership was lowered by the lack of personalisation options.
More importantly, several users brought up accessibility issues, confirming the importance of going beyond superficial inclusion. More careful design was required in the areas of button sizes, colour contrast, screen reader support, and visual hierarchy.
Tumblr media
Analysis: Insights from Redesigning with Empathy
Replacing the sidebar menu with a bottom navigation bar was one of the best ideas. This design decision is supported by research, as bottom navigation is more frequently utilised in mobile UX patterns and is simpler to reach with the thumbs (Babich, 2017). User interaction may significantly improve as a result of this minor change.
The desire for content personalisation was another significant realisation. Users desired the flexibility to change the tempo, tone, and level of difficulty. As a result, I started creating a special settings page that enables users to alter content based on their mood, energy level, and ability. Adaptive design theory, which supports a variety of users by providing flexible pathways instead of fixed tracks, is the direct inspiration for this (Clarkson et al., 2013).
The comments regarding colour schemes also caused me to reevaluate how inclusivity is impacted by visual tone. Despite its popularity, palette 4 was overly feminine and saturated. In order to achieve wider appeal while preserving visual character, I'm moving towards a neutral base with subdued accent colours going forward.
Examining the WCAG 2.1 accessibility guidelines was the most revolutionary element (World Wide Web Consortium, 2018). I started using best practices, such as clear text hierarchy, adequate contrast ratios, and larger tappable targets. I now view usability as a lens for moral, human-centered design rather than as a checklist after designing with universal access in mind.
Tumblr media
Conclusion: Designing with Empathy and Openness
I've learned this week that conversation, not just inspiration, is the source of good design. The app has become more inclusive, targeted, and based on actual needs as a result of hearing user feedback and acting upon it. Pulse is developing into a genuinely human-centered tool, not just an expressive idea. Accessibility is a way of thinking, not a feature. This redesign process reaffirmed how design that is considerate, flexible, and sympathetic can reach a larger audience and foster greater interaction.
Plan of Action: Next Steps
My next actions to build on this week's progress are:
Complete the redesign of the home/dashboard and the updated bottom navigation bar.
Create a working settings page to customise the content.
Use the updated colour scheme for all user interface components.
Use WCAG tools to perform initial accessibility audits.
To get feedback on the redesign and find any lingering issues, conduct a brief usability test.

about MEmes! here's a little bit about me and my journey in higher education. it goes oh so much deeper but I'll give you the gist of it.
In high school (and middle school) I was pretty depressed and ridden with anxiety. I struggled a lot academically and socially. At 16, I was diagnosed with major depression and anxiety disorder. I hated my life and I hated my hometown. I just wanted to leave. I managed to graduate high school in 2010 with a 2.75 gpa and decided to go to a university in a different state. I did well at first but at some point my mental health caught up with me, and so did an unhealthy relationship I was in - but that's a story for a different post... if I even make one.
Anyway, I decided to pursue a degree in Interactive Digital Design on the Web Design Track with a minor in Game design. Web design and video games were things I'd been interested in growing up, and still am, so it seemed like the right choice for me. It wasn't.
I tried to do well and even got the opportunity to take medications to help me, but the ones I tried didn't help and I found myself withdrawing in 2017 - after two failed relationships that drained me while I was attempting university, as well.
Some more life happened, another relationship happened, full time work happened, burnout happened, and I found myself with an Autism diagnosis at the age of 31.
After the death of my cat and some very honest conversations with my parents about the state of my mental health (it was bad), I got the opportunity to get excellent mental health care from the office of a friend of my father's.
After trying a few more medications (I'd tried many by that point with other doctors before) for my depression, anxiety, ADHD, and Autism the depression wouldn't go down so we decided to explore esketamine therapy, Spravato. It's like a cousin to ketamine but in controlled doses. I felt a new wave of inspiration and started creating digital abstract art on my ipad during Spravato sessions. (Let me know in the comments if you're interested in seeing my art).
A few months into it I was feeling really good and had created a lot of art so I decided I wanted to go back to school and pursue a degree in Art. I started posting my art online, along with blog posts on my old website, and even tried to sell some art on Etsy (that didn't work out.) Eventually, I stopped feeling the same about creating art.
For years I had been on a journey of personal development and working on my mental health. I realized that I had a lot of knowledge and passion for those subjects and decided I wanted to help people. I explored the idea of becoming a coach but I wanted to go deeper. I'd learned a lot about psychology and decided I wanted to pursue that as a career.
So far, I'm loving the psychology class I'm taking and am looking forward to taking more classes that truly interest me and inspire me to grow in this field.
I've always loved writing and since a young age wanted to be a blogger. So, I decided that I want to keep sharing what I know and learn along the way via these platforms (Instagram, TikTok, Substack, Tumblr, etc). If you're coming along for this journey, thank you for the support :)

What is Social Media Content Strategy?
Birk Creative’s Social Media Strategy Services Help Brands Get Back to Business
After a year of isolation, social media became an essential source of communication, not just for personal connection but professional services too. For many businesses though, built on interpersonal relationships and an old-school brick n mortar model, the wild wild west of social media can be a daunting feat. For Birk Creative CEO JinJa Birkenbeuel, she frames the hesitation as a missed opportunity for revenue and retention and is committed to help business owners strategize their social success. “Small business owners often have difficulty being the face of their brand. They’re so busy in the business that they don’t look up. But the most successful businesses are led by confident people who want to share what they know and can find the path to a personal conversation with their customers.” Your social media strategy is a blueprint for your business’s social channels, answering what, when, why and how your content lives. At Birk Creative, a social media strategy goes far deeper than hashtags and likes, it’s a detailed multi-channel plan that ensures every social-facing appearance of your business remains on brand and aligned with your brand DNA. It’s a blend of ideas, purpose and pathways to grow your business, expand your reach and achieve your goals. It can be a challenging road though,  but Birk Creative strives to guide small businesses through scaling their social media, offering:

Our passion for Small Business Social Strategy is so anchored in our values that Google tapped Birk Creative to be a collaborating architect of its Accelerate with Google Platform in 2015. Due to the positive impact of the program on small historically underserved businesses across the US, the program was acquired in 2017 by Grow With Google to become the Grow With Google Digital Coaches program. Through this expansive partnership, we helped build a national network of industry leaders to provide digital skills training and coaching to help Black and Latinx small businesses reach new customers, thrive online, and grow. As the internet’s go-to service destination and owner of YouTube and key performance analytics, the more Google savvy a business is, the stronger it’s social media reach will be. Through the GDC initiative, JinJa acts as the Chicago Coach offering digital skills workshops, hands-on coaching on various topics like social media strategy,  and more, creating space for like-minded entrepreneurs and local businesses to glean, gather and grow.
When Birk Creative was tapped by the CPASS Foundation tapped Birk Creative as its foundational branding partner, we helped the educational organization expand its digital footprint and visibility by developing a web interface, digital platform and extensive social media channels from scratch. CPASS provides underrepresented students access and advocacy to professional industry mentors, and other STEM-related resources to thrive. And as a youth-centric organization, social media is an essential tool for engaging its digitally-motivated audience and potential investors. To raise visibility for such an impactful youth-centric program, we needed to develop goals-driven content that was as inspiring as it was informative. Our strategy started with designing CPASS’s branding and visual identity, from which we designed social media assets for LinkedIn, Instagram, Facebook, Twitter and YouTube. Expanding CPASS’s mission across a multi-channel strategy, we developed an IG Live series of “STEM Stories” interviewing STEM influencers to inspire the STEM leaders of tomorrow, a Facebook channel and support group for STEM parents, and a robust Youtube Channel with industry leader messaging. The CPASS Foundation now has a vibrant platform and user-friendly resources for the marginalized STEM leaders of tomorrow. CPASS was acquired by Rush Mini Med School, and continues to generate significant engagement through social media, radio and the press.
Proving the power of social media, Birk Creative’s impact-driven strategy proved indispensable in our partnership with Advocate Healthcare. As the State of Illinois’s largest healthcare provider, Advocate hired Birk Creative to build social media visibility for their COVID public awareness campaign, targeting underserved communities to instill trust in the healthcare system and provide support in unprecedented times. Meeting the cultural complexities of our audience required a strong social media strategy, we had to create confidence through common ground. Expanding our  slogan: “We Got You,” or “Estamos Contigo,” in Spanish, with this snackable, shareable messaging we closed the communication gap with a universally translatable visual language for people across multiple social/digital channels. This campaign was a testament to our adaptive strategy capabilities, constantly pivoting in real time: from early COVID myths and contagion questions; to a Mask Up campaign; and a large-scale vaccination adoption campaign transforming to “Go get yours.” Beyond the project’s social media success, this rewarding partnership helped in saving lives as Illinois residents hit 70% full vaccination as of June 30.
From strategy and copywriting to planning and social collateral, we envision a client’s social media through a comprehensive and collaborative approach to best reflect the essence of the company’s values. clown ranch
clown rescue ranch was born from my knowledge of the Tumblr community known as 'clown husbandry(2020)'. fandom wiki describes this community as...
Clown Husbandry is a tag that originated on Tumblr, involving the idea of clowns not being human performers, but a species of strange animals kept as pets that entertain humans. These depictions of clowns can vary from animal like to human like, often behaving quite a bit more like animals in both case, and keeping a strong inspiration from their real counterpart.
i first herd of this community from watching this video below...
youtube
i thought the chance to explore this concept further would be amazing in animation. with Meany possibilities for horror and for humour, clowns as a subject perfectly straddle these two genres.
where this idea came into my own was that i wanted to take this concept further, perhaps instead of clowns as pets in a home, this animation could be about a zoo for clowns, or a rescue centre.
illinoisclownemporium (2020). Clown Husbandry. [online] Tumblr. Available at: https://www.tumblr.com/illinoisclownemporium [Accessed 28 Oct. 2024].
to, C. (2024). Beginner’s Guide. [online] Clown Husbandry Wiki. Available at: https://honkapedia.fandom.com/wiki/Beginner%27s_Guide [Accessed 28 Oct. 2024].
STRANGE ÆONS (2020). Clown Husbandry | Tumblr Deep Dive. [online] YouTube. Available at: https://www.youtube.com/watch?v=A9HWJd8s9_c [Accessed 28 Oct. 2024].
Tumblr media
i decided to create a idea sheet for my three made concepts, through doing this my idea developed further. what if i used this silly concept for an animation to tell an important message? having a more human face for an animal could build empathy and maybe lead the viewer to reflect on their treatment of animals. so maybe this short focuses on how to treat clowns i.e. animals with respect. what dose good habitats, diets and enrichments look like for clowns? clowns are of course also associated with the circus, circuses also have a history of animal abuse. perhaps clown poachers could look like ring masters, to further this connection. many animals have been demonised through media for example sharks form 'jaws(1975)'
Tumblr media
Jaws. (1975). universal pictures.
so two have clowns with films like IT(2017).
Tumblr media
sharks are not inherently evil and neither are clowns so this to has a link between clowns and carnivores animals like sharks, bears and lions ext.
these sketches below were an initial exploration as to what a clown might look like in this world. the large image was drawn first, my favourite parts of this design are that the large clown boots are not shoes at all, the claws on the hands and the gecko esc eyes. however body wise this design was very human. the second sketch was the clown in the corner of the ceiling, following this gecko like idea. this opened up the possibility of animal esc traits like wall climbing, web weaving or burrowing in the clowns.
Tumblr media
the final sketch below further increased the design process (as seen below). i wanted to add more animal traits like long arms ,shorter legs and a hunch. this hints at a more apelike history to these species.
