PHILADELPHIA (WPVI) -- Starbucks is changing course when it comes to its open-door policy.
The company will no longer let people hang out or use its restrooms without making a purchase. It's a business move that some say could come with unintended consequences of racial bias reminiscent of an incident that thrust one Philadelphia Starbucks into the national spotlight.
The new policy was outlined in a memo sent to Starbucks stores. It details what the chain calls a new code of conduct that "makes it clear that our spaces, including our cafes, patios and restrooms, are for use by paying customers and our partners."
"It is a very, very risky move," said Temple University's Subodha Kumar, who is the Paul R. Anderson Distinguished Chair and Professor of Statistics, Operations and Data Science at the Fox School of Business.
"Clearly some customers will feel safer," he said of the new Starbucks policy, "but there's a second type that some people will just not come because they feel it will not be a welcoming environment."
One of the concerns is that the policy could encourage bias. It's a situation Starbucks already faced in April of 2018 when two Black men were arrested after sitting inside a Starbucks at 18th and Spruce streets in Rittenhouse Square without buying anything.
The incident sparked widespread protest and policy change. After the incident, Starbucks solidified its open-door policy, saying people didn't have to buy anything to use the space.
This new policy is an about-face.
"It may create some inherent discrimination culture," said Kumar. "If the employees are not trained and they just implement this policy, this can be detrimental because different employees can treat customers very differently."
According to the memo, each store will get up to three hours of training on the new policies, which are also aimed at encouraging paying customers to stay longer by offering free refills on hot or iced coffee. It's a move to drive up profits for the coffee company, which has seen a dip in sales.
With some stores citing safety issues, Starbucks says the new policies are part of a mission to "get back to Starbucks and create the warm and welcoming coffeehouse our customers expect."
Experts like Kumar just hope Starbucks pays close attention to the impact on the coffee chain and its customers.
"My only worry is have they thought through the unintended consequences," said Kumar. "I think it can lead to a lot of new problems that we're not even thinking of right now."
Action News spoke to Dante Robinson, one of the two men arrested at the Center City Starbucks on 18th and Spruce in 2018.
We asked for his thoughts on the new policy. He declined to speak on the new policy, saying he'd moved on from the situation. He and the other man who was arrested, Rashon Nelson, reached a settlement with Starbucks and the city of Philadelphia.
As for Starbucks' new policy that customers have to buy something to use the restroom or hang in the dining area, stores could soon post signs detailing the new code of conduct for customers.

Brendan Carr, newly installed as chairman of the FCC under the new Trump administration, is reviving a trio of complaints aimed at NBC, ABC and CBS content, ones that his predecessor dismissed for being “at odds with the First Amendment.” The revived complaints come from the conservative Center for American Rights and generally align with Trump’s gripes about media coverage during the 2024 presidential campaign. The complaints include one against ABC’s Philadelphia affiliate, WPVI-TV, alleging bias in ABC’s hosting of the September presidential debate; one against WCBS-TV in New York that accuses CBS of “news distortion” in the way that 60 Minutes edited an interview with Kamala Harris; and another against WNBC-TV in New York for alleged violations of the equal time rule when Saturday Night Live featured Harris in a cameo the weekend before the presidential election. Just last week, before she resigned, FCC chairwoman Jessica Rosenworcel, appointed by President Joe Biden, dismissed the three complaints, as well as another one filed by the Media and Democracy Project, which challenged the license of Fox-owned WTXF-TV in Philadelphia. That complaint alleged that the revelations from the Dominion Voting System defamation case against Fox News showed that Rupert and Lachlan Murdoch lacked the “character” to hold a broadcast license. Carr’s order, however, does not revive the Fox complaint. In restoring the complaints today, the FCC said that the dismissals were “issued prematurely” and “based on an insufficient investigatory record for the station-specific conduct at issue.” The agency said that the complaints require “further consideration.” In her statement last week dismissing the complaints, Rosenworcel said, “The facts and legal circumstances in each of these cases are different. But what they share is that they seek to weaponize the licensing authority of the FCC in a way that is fundamentally at odds with the First Amendment. To do so would set a dangerous precedent.” She also warned that the agency “should not be the president’s speech police.” When he took office on Monday, Trump signed an executive order on “restoring freedom of speech and ending federal censorship.” Among other things, it says that “no taxpayer resources are used to engage in or facilitate any conduct that would unconstitutionally abridge the free speech of any American citizen.” The order, though, calls out the Biden administration for “exerting substantial coercive pressure” on social media companies over their content moderation practices.
Brendan Carr, the new FCC Chair, revives the three bogus politically-motivated complaints about the alleged “bias” from CBS, ABC, and NBC from right-wing Center for American Rights.

A teen girl and her mother are speaking out after the 16-year-old escaped a man who allegedly stalked and harassed her, an incident that was caught on camera.
In surveillance video obtained by Philadelphia ABC station WPVI, Ariana MacMillan can be seen walking home along a busy road outside of Philadelphia when a man begins walking closer to her and, according to Ariana, making inappropriate comments.

According to Ariana, she felt scared, thinking the man might "kill her," and made a quick decision to run to a nearby shop. The shop owner called the police on her behalf shortly after.
The man has now been charged with stalking and harassment, according to Ridley Township Police in Folsom, Pennsylvania.

A New Jersey mayor accused of drunk driving allegedly drove her toddler home from day care on St. Patrick’s Day, nearly crashing on the road only days after resigning from her job with another town.
Lumberton Township leader Gina LaPlaca was arrested for her alleged booze-induced stunt on March 17 after she picked up her 2-year-old son from day care.
The 45-year-old Democrat was allegedly captured on video by another driver swerving all over the road, nearly crashing into a utility pole before the footage was shared with police, WPVI reported, citing charging documents.
Police traced the car back to LaPlaca’s house, where they met the mayor around 6 p.m. Monday.
The toddler was found strapped in a car seat in the rear passenger seat.
Officers also discovered an open container of alcohol, the outlet reported.
LaPlaca allegedly admitted to drinking while driving and was put through a field sobriety test.
She was arrested and charged with driving under the influence, according to the outlet.
Police also charged LaPlaca with reckless driving and endangering the welfare of a child, according to court records viewed by The Post.
She was released with a summons to appear in court on April 28.
LaPlaca’s husband defended his wife, saying she had been struggling with addiction and is getting the needed help, calling on critics to not attack their children’s mother.
“Please ignore the exaggerated political hyperbole and keep in mind her passion for helping others. This should not erase all the things she has accomplished for our community,” Jason Carty wrote on Facebook.
LaPlaca shares a toddler son with Carty and has a teenage stepson from her husband’s previous relationship.
She was first elected to the Lumberton Township Committee in 2020.
The five-member panel first chose LaPlaca to serve a one-year term as mayor in 2021. She was re-elected the past three years.
She worked for the Jersey Shore-area Neptune Township since November 2021, serving as the assistant business administrator before being elevated to business administrator in January 2022.
LaPlaca resigned from the position before a township committee meeting on March 10, the Asbury Park Press reported.
She claimed the “changing political environment” was her reason to leave the job in the township, which is located 50 miles northeast across the Garden State from Lumberton.
The Fordham Law School graduate held several counsel roles including a nearly three-year stint in the New Jersey General Assembly Majority Office.
She then worked in the private sector for 11 years, first as the director of state affairs with Verizon, before taking on the regional director role at American brewery giant Anheuser-Busch for seven months, according to her LinkedIn profile.
Along with her role as mayor and township committee member, LaPlaca serves as chairwoman of the Lumberton Democrats.
