Yeahhhhhh…look, as someone who may or may not be related to someone who bought this, Imma be real with you, I don’t think this will work.
Muskrat is an asshole, don’t get me wrong. And people have paid a LOT for self-driving that hasn’t been nearly close to what we’d want.
But there’s a couple things that are working against the owners.
First is that there are some VERY long legal documents you sign when you sign up for this crap, and I have absolutely no doubt in my mind that somewhere in there, there’s a “We don’t actually have this yet so you’re not allowed to sue us if we don’t deliver” clause. Elon might’ve been hyping everyone up with very skewed timelines, but when it comes to legalese, I suspect Tesla has covered it’s ass with fine print.
But more importantly, lawsuits like this generally need some kind of actual intent on Tesla’s part to defraud customers. And I think Tesla could make a reasonable case in court that they’ve been putting forward a genuine effort to make FSD a thing. They’ve been releasing regular updates to their FSD features, and they’ve been collecting a LOT of data to do so.
Now I’ll remind everyone that Tesla actually has gotten in hot water for what they’ve been doing with that data, since apparently some Tesla employees have been privately spreading images collected amongst themselves as jokes apparently some idiots were walking around nude in front of their teslas in their garage. But they’re definitely collecting data to make FSD a thing, and have even released Betas of the function (no I wouldn’t trust a beta with my life, thankyouverymuch) so I wouldn’t be surprised if Tesla had a case based around the fact that they were acting in good faith, and FSD is just really hard.
…that being said, I am curious where this is going. Just saying FSD is vaporware isn’t entirely accurate. But if older Tesla owners, who first invested years ago, made a case that they paid 10k$ for a self driving feature, but now that Tesla’s done more research, it’s clear their Teslas can’t actually have full FSD, there might be a case there.
IE People paid for FSD years ago, Tesla kitted out the cars best it could, but the current FSD packages require more hardware than on those cars. I think that has a much better case, as Tesla made tangible promises, and can’t currently fulfill them on those cars without giving those Tesla owners new cars, or complete overhauls.
