The Israeli governmentâs declared objectives in Gaza were to eliminate Hamas and recover the hostages. But very few senior Hamas figures have been confirmed killed or captured in Gaza and just one hostage, not a civilian, has been rescued by Israeli troops as a result of a military operation. Tens of thousands have been killed, but the two most prominent Hamas leaders in Gaza, Sinwar and Deif, are not among them. The most significant Hamas leader to have been killed since the start of the war is Saleh al-Arouri, assassinated in Lebanon on 2 January. Israeli troops are still clearing northern Gaza, but the al-Qassam Brigades continue to operate in Gaza City and Khan Younis. The IDF has killed thousands of Palestinian fighters, but itâs very likely that the war has led to new fighters being recruited. Israelâs military operations havenât achieved any of their public objectives; the real purpose appears to be collective punishment and full-scale destruction. Israelâs leaders seem to back this assessment. For the minister of heritage, Amihai Eliyahu, the destruction of northern Gaza was âa pleasure for the eyesâ. Benjamin Netanyahu has repeatedly spoken of inducing the Palestinians to leave. The finance minister, Bezalel Smotrich, imagines a future with â100,000 or 200,000 Arabs in Gaza and not two millionâ. Israelâs defence minister, Yoav Gallant, said that Israel is âfighting human animals and we are acting accordinglyâ. Some of these statements are collected in South Africaâs submission to the International Court of Justice, issued on 29 December, which charges that Israelâs actions are passing from massacre to genocide. On the opening day of the hearings Tembeka Ngcukaitobi argued that âthe evidence of genocidal intent is not only chilling, it is also overwhelming and incontrovertible.â On 26 January the ICJ issued a provisional order that Israel must âtake all measuresâ to prevent genocidal acts in Gaza. It said it had âtaken noteâ of the statements made by Gallant and others.

Murder and rhetoric: How SA built its genocide case against Israel
The genocide case against Israel opened this month at the International Court of Justice at The Hague where South Africa is looking to prove that Israel is committing genocide in the Palestinian enclave.
Fighting âhuman animals.â Making Gaza a âslaughterhouseâ. And âerasing Gaza from the face of the earth.â
Such inflammatory rhetoric by Israel has become a key component of the genocide case against Israel at the UN world court, where South Africa is accusing Tel Aviv of crimes against humanity by targetting innocent Palestinians in the occupied territories.
South Africa says the language â in comments by Israeli leaders, soldiers and entertainers about Palestinians in Gaza since Hamasâ October 7 cross-border attacks â is proof of Israelâs intent to commit genocide.
Israeli leaders have downplayed the comments and doubled down on the military offensive in Gaza that has led to the massacre of nearly 24,000 people, most of them women and children.
Rights groups and activists say the jingoistic rhetoric is an inevitable byproduct of Israel's decades-old, open-ended rule over the Palestinians and that they've intensified during the brutal war on Gaza. They say such language has been left unchecked, inciting violence and dehumanising Palestinians.
âWords lead to deeds,â said Michael Sfard, a prominent Israeli lawyer. âWords that normalise or legitimise serious crimes against civilians create the social, political and moral basis for other people to do things like that.â
The genocide case against Israel opened last week at the International Court of Justice at The Hague. South Africa is looking to prove that Israel is committing genocide in Gaza and that Israel has specific intent to commit genocide. It is using the litany of harsh statements as part of the evidence in its case.
With the ground offensive getting underway in late October, Prime Minister Benjamin Netanyahu cited the Bible in a televised address: âYou must remember what Amalek has done to you.â Amalekites were persecutors of the biblical Israelites, and a biblical commandment says they must be destroyed.
South Africa argued that the remarks showed Israel's intent to commit genocide against Palestinians. Netanyahu denied that this week and said he was referring to Amalek as a way to describe Hamas and its attack.
Two days after the Hamas attack, Defence Minister Yoav Gallant said Israel was âfighting human animals,â in announcing a complete siege on Gaza.
Deputy Knesset speaker Nissim Vaturi from the ruling Likud party wrote on X, formerly known as Twitter, that Israelis had one common goal, âerasing the Gaza Strip from the face of the earth.â Israeli Heritage Minister Amichay Eliyahu, from the far-right Jewish Power party, suggested that Israel drop a nuclear bomb on Gaza and said there were âno uninvolved civiliansâ in the territory.
Israeli soldiers were caught on video making similar remarks as they sang and danced in the early days of Israelâs ground offensive.
On Oct. 7, a journalist wrote on X that Gaza should become âa slaughterhouseâ if the roughly 250 people taken hostage by Hamas were not returned.
Military officials and two Israeli pop singers are also cited by South Africa for making inflammatory comments.
âThe language of systemic dehumanisation is evident here,â lawyer Tembeka Ngcukaitobi said for South Africa in remarks before the court. âGenocidal utterances are therefore not out in the fringes. They are embodied in state policy.â
South Africa is asking for a series of legally binding rulings declaring that Israel is breaching âits obligations under the Genocide Conventionâ â a decision that could take years â and for a binding interim order that Israel cease hostilities, a ruling on which is expected in the coming weeks.
Defending Israel in court, lawyer Malcolm Shaw said the remarks were made mostly by officials with little role in determining Israeli policy, calling them ârandom quotesâ that were misleading and had been, in some cases, repudiated by Netanyahu.
But Roy Schondorf, a former Israeli deputy attorney general, said in an interview that the statements still carried risk, even out of context: âIt would have been better if some of these remarks had not been said.â
Israel argued that its justice system would take action against unacceptable speech. But critics say statements against Palestinians have gone unpunished or undenounced. Lawyer Sfard appealed to the countryâs attorney general earlier this month on behalf of a group of prominent Israeli figures, demanding to know why the rhetoric hasn't been reined in.
In a statement two days before the case launched at the world court, Attorney General Gali Baharav Miara said calling for intentional harm to civilians could amount to a criminal offense and that Israeli authorities were examining several such cases, without elaborating. The comments appeared to be aimed at heading off the South African accusations.
Mainstreaming the rhetoric
The war is being fought under Israelâs most hardline government ever, dominated by far-right Cabinet ministers with a long record of controversial remarks well before Oct. 7.
Finance Minister Bezalel Smotrich once called for âerasingâ a Palestinian West Bank town. National Security Minister Itamar Ben Gvir -- a rabble-rousing ultra-nationalist -- talked of the supremacy of freedom of movement âŻfor illegal Jewish settlers in the occupied West Bank over that same right for Palestinians.
While little appears to have been done to confront violent rhetoric directed at Palestinians, Palestinian citizens of Israel who have shown empathy for people in Gaza are facing a crackdown, according to Adalah, a legal rights group. Police say the speech amounts to "incitement, promotes violence or shows support for terror groups".
Adalah says at least 270 Palestinian citizens of Israel have had some sort of interaction with law enforcement â arrests, investigations or warnings, with at least 86 charged for speech offenses. Some Jewish Israelis who expressed sympathy for Palestinians have also faced arrest or sanction by their employers.
Aeyal Gross, a professor of international law at Tel Aviv University, said that how Israel responds to the inflammatory rhetoric matters in the case with South Africa, because Israel, as a signatory to the Genocide Convention, is prohibited not only from committing genocide but also from inciting to genocide.
Gross said that it was probably too late for Israel to take steps that show it doesnât condone such speech. Punishing such remarks could have sent a message to the court as well as to Israeli society that the state doesnât tolerate incendiary rhetoric.
âItâs important because it would have said, âItâs not our intent,â" he said. "But itâs also important because it would have meant we are sending the soldiers on the ground a message not to act in this way.â

Watching South Africa's case.
First speaker Adila Hassim SC talking about "genocidal acts that have lead to this urgent request for provisional measures."
Her argument:
Showing map, demonstrating Israel closing off only two crossing points. Addressing direct killings and consequences of siege rendering necessities for life unobtainable.
Only some acts must fall under genocide convention provisions. Not all genocidal acts are listed by Hassim.
First genocidal act presented is mass killing. Number of killing by Israeli forces as of 1/9 is 23,210. At least 70% believed to be women or children. 7,000 missing, presumed dead.
Killed even while fleeing along Israeli-declared "safe routes."
In first three weeks, Israel deployed 6,000 bombs per week, at least 200 times deployed 2,000 lbs bombs in southern areas of Palestine designated safe, and in northern refugee camps. 2,000 lbs are some of the biggest and most destructive.
More than 1,800 families have lost multiple family members, hundreds of multigenerational families have been wiped out.
UN chiefs have described it as a "graveyard for children."
Second genocidal act: Inflicting of serious bodily or mental harm.
Close to 60,000 wounded or maimed, mostly women and children, while healthcare collapsed.
Large numbers of Palestinians including children are arrested, blindfolded, made to strip, and taken to unknown destinations.
Third genocidal act: Deliberately imposed conditions that cannot sustain life.
Achieved in at least four ways.
1: Forced displacement of about 85% of Gazans. Those who refuse to leave are killed or at risk of killings. Families displaced multiple times. First evacuation order demanded over 1 million to move, included children, elderly, wounded, entire hospitals, even newborns within 24 hours. No humanitarian assistance was permitted. Damaged or destroyed estimated 355,00 Gazan homes leaving at least half a million with no home.
No indication that Israel will rebuild, soldiers joyfully film themselves detonating entire blocks and erecting Israeli flags over rubble.
2: Israel's conduct calculated to cause hunger, starvation, and dehydrated. 93% of population facing crisis levels of hunger. More than 80% of people in world suffering catastrophic hunger are in Gaza. Predicted that more Gazans may die from starvation and disease than airstrikes. Israel refuses to allow aid and obstructs distribution.
5 missions to relieve hospitals denied. Aid allowed is not enough.
3: Gazans deliberately denied clothes, shelter, sanitation. Clean water all but gone, essential nonfood items denied. Sourcing rates of infectious disease outbreaks. Diarrhea in kids under five have increased 2000%
4: Military assault on Gazan healthcare system. Wounded deprived of lifesaving medical care.
Fourth genocidal act: Israel blocking delivery of aid for delivering babies. Estimated 180 Gazans give birth each day. 15% likely to experience complications and require additional care which is not available.
Four acts demonstrate calculated pattern of genocidal conduct.
Getting aid into Gaza unreasonably difficult. Convoys attacked, aid works displaced and killed, ruined roads, entry points not for trucks, not enough aid, more.

State Enterprises Minister Pravin Gordhan's Equality Court challenge against EFF leader Julius Malema and his deputy Floyd Shivambu has been moved to the South Gauteng High Court in Johannesburg.
"It was moved to the High Court due to the fact that we raised constitutional dispute in our answering affidavit.

Last week the matter was postponed ,

In November last year, Gordhan lodged complaints against Malema and Shivambu.
This was after Malema referred to Gordhan as a "dog of white monopoly capital" while addressing a crowd outside the commission of inquiry into state capture .in November 2018

He also took aim at Gordhan's daughter, Anisha Gordhan, saying she had allegedly been awarded contracts by National Treasury and other government departments, seemingly as a result of her father's position in government.
Gordhan's attorney Tebogo Malatji said although the matter was now moved to the High Court, they saw it as "a simple case".

President initiates remedial action on Mogajane appointment

The Presidency has informed the Office of the Public Protector that President Cyril Ramaphosa has initiated remedial action in line with the report of the Public Protector on the appointment of National Treasury Director General Dondo Mogajane.

Mogajane was employed as the Director General of National Treasury, with effect from 8 June 2017, on a fixed-term contract of five years.
The Public Protector found that Mr Mogajane had failed to disclose a criminal record on the Z83 application form he completed for the position of Director-General at the National Treasury and that this failure constituted impropriety or dishonesty, and amounted to improper conduct.
The Public Protector recommended that, within 30 days of the report, the president should take appropriate action against Mogajane in terms of the Public Service Act for "blatantly and dishonestly" making false representation of material facts in his Z83 form.
The act directs that the president is responsible for disciplinary steps and the implementation of relevant sanctions against a head of department.
The act further enables the president to delegate to any minister any power conferred on the president, including the power to initiate disciplinary action against a Director-General as well as to effect the outcome thereof
