YON, France (AP) — A French court ruled on Monday that the American man accused of sexually assaulting a Pennsylvania college student in 2013 and later sending her a Facebook message that said, “So I raped you,” can be extradited to the United States.
Ian Cleary, 31, of Saratoga, California, was detained in April in the city of Metz in northeastern France after a three-year search. He has been held in custody pending extradition proceedings since his arrest.
The Court of Appeal in Metz said that Cleary can be extradited. When asked if he wished to be extradited or not, in line with French law, Cleary refused, prosecutors said in a statement Monday. His refusal may delay the extradition process, but it won't stop it.
The ruling is final. Cleary's case is now the responsibility of the French Justice Ministry, which must prepare and submit the extradition order for the French prime minister. While he awaits the prime minister's signature, Cleary remains detained in France.
Justice Ministry officials didn't immediately respond to a request for comment.
Cleary had been the subject of an international search since authorities in Pennsylvania issued a 2021 felony warrant in the case weeks after an Associated Press story detailed the reluctance of local prosecutors to pursue campus sex crimes.
The arrest warrant accuses Cleary of stalking an 18-year-old Gettysburg College student at a party, sneaking into her dorm and sexually assaulting her while she texted friends for help. He was a 20-year-old Gettysburg student at the time, but didn't return to campus.
The Gettysburg accuser, Shannon Keeler, had a rape exam done the same day she was assaulted in 2013. She gathered witnesses and evidence and spent years urging officials to file charges. She went to authorities again in 2021 after discovering the Facebook messages that seemed to come from Cleary’s account.
“So I raped you,” the sender had written in a string of messages.
“I’ll never do it to anyone ever again.”
“I need to hear your voice.”
“I’ll pray for you.”
The AP doesn't typically identify sexual assault victims without their permission, which Keeler has granted. The accuser’s lawyer in Pennsylvania, reached on Monday, declined to comment on the development.
According to the June 2021 warrant, police verified that the Facebook account used to send the messages belonged to Ian Cleary. Adams County District Attorney Brian Sinnett, who filed it, declined to comment on developments when reached Monday.
After leaving Gettysburg, Cleary earned undergraduate and graduate degrees from Santa Clara University, near his family home in California, worked for Tesla, and then moved to France for several years, according to his website, which describes his self-published medieval fiction.
Keeler, originally from Moorestown, New Jersey, stayed on to graduate from Gettysburg and help lead the women’s lacrosse team to a national title.
By 2023, two years after the warrant was filed, Keeler and her lawyers wondered how he was avoiding capture in the age of digital tracking. The U.S. Marshals Service thought he was likely overseas and on the move, even as he was the subject of an Interpol alert called a red notice.
Across the U.S., very few campus rapes are prosecuted, both because victims fear going to police and prosecutors hesitate to bring cases that can be hard to win, the AP investigation found.
Keeler, when the warrant was issued, said she was grateful, but knew it only happened “because I went public with my story, which no survivor should have to do in order to obtain justice.”

Housing advocates tired of the Bay Area’s foot-dragging efforts to plan for more homes amid an intensifying housing crisis are taking matters to the courts.
On Tuesday, three pro-housing groups announced they had sued 11 cities and Santa Clara County for failing to meet a Jan. 31 deadline to submit their future homebuilding proposals to state regulators.
Advocates contend the jurisdictions have long resisted growth and are now ignoring their responsibility to prepare for significantly more housing over the next decade. The cities include Palo Alto, Cupertino, Burlingame, Daly City, Martinez, Pinole, Pleasant Hill, Richmond, Fairfax, Novato and Belvedere.
The goal of the dozen lawsuits? To force local governments to adopt housing plans — dubbed “housing elements” — that actually meet the state’s strict planning requirements. And to ensure jurisdictions are subject to penalties — including losing control over local laws governing development — until they do.
“We want a judge to order the cities to adopt a compliant housing element, and have the cities acknowledge there are consequences,” said Greg Magofña, director of development and outreach with the Oakland-based California Housing Defense Fund, one of the groups filing the lawsuits.
As of Tuesday afternoon, just 29 of the region’s 109 cities and counties had adopted the every-eight-year plans, according to the California Department of Housing and Community Development. And just four of those plans — from San Francisco, Emeryville, San Leandro and the city of Alameda — had been deemed in compliance by the state.
Advocates say the 12 lawsuits are just the beginning. They aim to sue even more out-of-compliance cities and counties in the coming weeks. Magofña said the three pro-housing groups will continue targeting local governments with a history of denying new homes — particularly apartments and affordable housing — and that tend to be “whiter, richer and more exclusionary.”
In addition to the California Housing Defense Fund, San Francisco-based YIMBY Law and Californians for Homeownership — a nonprofit launched by the California Association of Realtors — are behind the lawsuits.
Geoff Gillette, a spokesperson for Pleasant Hill in suburban Contra Costa County, said the city had yet to be served with the civil lawsuit. He refuted the notion that Pleasant Hill isn’t making enough progress on its housing element. The city submitted an initial draft of its plan late last year.
“We’ve taken this very seriously,” Gillette said. “For us, it’s important that we do the process right and we make sure that our community is aware that it’s a transparent process.”
Gillette pointed to regulators’ increased planning expectations this eight-year cycle as a primary reason why the city’s plan is late. The state is now requiring cities and counties to spell out in detail how they plan to phase in mandated reforms, such as easing restrictions on new multifamily housing, and prove that areas identified for future homes have a realistic chance of development.
“These are things we weren’t going to shortcut on or rush through to meet the deadline,” Gillette said.
Another challenge for local governments: they have to prepare for significantly more housing.
By 2031, the nine-county Bay Area is on the hook for approving more than 441,000 single-family homes, apartments, townhomes and condos for people of all income levels. That’s double the goal for the past eight years, representing a roughly 15% increase in the region’s total housing stock, in large part to make up for decades of failing to hit state homebuilding targets.
Some local officials and neighborhood groups say the dramatically increased goals ignore the effect new development would have on traffic, the environment and wildfire risk, among other impacts.
In a statement, Livable California, a group that aims to “foster equitable, livable communities and truly affordable housing” said it “does not believe cities should be forced into planning more than local voters deem appropriate.”
“We are in favor of local control and community planning efforts. We believe local government officials know what’s best for their constituents.”
If those officials continue dragging their feet on their housing plans, advocates want them to feel the repercussions. Enter the “builder’s remedy.”
The provision in state housing law could enable developers to push through projects of virtually any size almost anywhere they please, as long as a portion of the building includes affordable units. The penalty hasn’t been legally tested, so advocates are suing in part to compel a judge to clarify when jurisdictions are subject to the law.
JR Fruen, an attorney and housing advocate newly elected to the Cupertino City Council, said he believes his city is already at risk of the builder’s remedy since it only recently submitted a housing element draft.
But he said with a new council majority, the city — home to Apple’s headquarters and some of the most expensive home prices and rents in the country — is moving forward in earnest with its housing plan after years of “bad-faith” planning by prior councils.
Fruen hopes the lawsuit could spur even more action.
“It could be a useful reminder to some of my colleagues who might be reluctant to follow the law, or pursue an ambitious element that actually meets our housing needs, to do so,” he said.

SAN JOSE, Calif. (KGO) -- A 20-year employee of the San Jose Police Officers Association charged in a scheme to distribute drugs, including fentanyl.
"I was just absolutely taken aback, shocked, became saddened," Sean Pritchard, President of the San Jose Police Officers Association said, "And as the days have gone by, I'm at a place where I'm now I'm angry."

Sean Pritchard, president of the San Jose Police Officer's association says he first got a call from federal authorities last Friday that Joanne Segovia, the union's executive director, was charged with attempting to import illegal synthetic opioid drugs from overseas, specifically valeryl fentanyl.
Federal prosecutors says it was part of a scheme to distribute them in the U.S.
Pritchard says Segovia had been with the union for nearly 20 years.

"This person has been really known as the grandma of the POA, and it's not the woman that we have known for well over a decade and so that's why it's been so difficult," Pritchard said, "A woman who has helped fallen officer's families, helped organize fundraisers when officer's children are sick. That's the person we know."
Investigators say Segovia, 65, used her personal and office computers to order the drugs and agreed to distribute them elsewhere in the U.S.
The SJPOA says they had no knowledge of it and are conducting an internal investigation.

The union says Segovia handled front desk operations but did not make decisions for the organization.
They still don't know what her exact intentions were with the drugs.
According to the criminal complaint, Homeland Security agents were led to Segovia through an investigation that looked into a network they say ships controlled substances made in India.
A network operative's phone was searched and they found messages that were found to be linked to Segovia and her San Jose address.
Investigators found that between October of 2015 and January 2023, Segovia allegedly had approximately 61 shipments mailed to her home coming from countries all over the world, from locations that included Hong Kong, Hungary, India, and Singapore.

The shipments had labels that included "Wedding Party Favors," "Gift Makeup," and "Chocolate and Sweets," federal officials said.
Federal investigators intercepted those shipments and say they found thousands of narcotic pills.
According to the complaint, Segovia continued to order controlled substances even after being interviewed by federal investigators in February. On March 13, federal agents seized a parcel addressed to Segovia in Kentucky, containing valeryl fentanyl, a fentanyl analog. The package reportedly originated from China on March 10 and declared its contents as a clock.
Santa Clara County supervisor Cindy Chavez heads the county's fentanyl working group that works to combat the opioid crisis locally.

"What's really concerning me is that it's just a reminder of how accessible this is," she said, of the news, "And that we, from a law enforcement and a community perspective, need to be much more aggressive and much more assertive about how we deal with interrupting that chain that that we just have been unable to break."
ABC7 reached out to Segovia and have not heard back.
The complaint states that she denied any illegal activity in initial interviews with investigators and then later tried to blame her housekeeper.
Segovia is due in court Friday at 1 p.m.
If convicted, she faces a maximum sentence of 20 years.

One of two men who carried out a Satanist-inspired “thrill kill” murder in San Jose was freed from prison and released back into Santa Clara County. Former inmate Jae Williams, 29, was granted early release on November 20, court records show.
Williams was a 15-year-old high school student when he and his 16-year-old friend, Randy Thompson, decided they wanted to kill someone. The boys befriended 15-year-old Michael Russell with the sole intention of murdering him in 2009.
The victim’s family’s attorney, Scotty J. Storey, told KRON4, “Jae and Randy set out with a goal of killing someone just to find out what it felt like. They cultivated a ‘friendship’ with Mikey, lulling him into a sense of security with them, to achieve their goal.”
When San Jose Police Department homicide detectives were investigating the teen’s grisly death, Williams told police that his religion, Satanism, gave him permission to kill.
The three boys went to Russell’s house on Nov. 10, 2009. When the trio was alone in the backyard, Williams and Thompson attacked the victim with a knife. They reportedly took turns stabbing the Santa Teresa High School student.
Storey said the terror Russell must have felt realizing his “friends” were going to kill him is unimaginable.
With Williams freed from prison, the victim’s surviving family members are also terrified, Storey said.
“They are very disappointed in the legislative system that created the statute, which lead his release. They are also terrified for themselves and for society. There is no indication that Jae Williams ever showed any contrition or remorse for taking Mikey’s life or the brutal way that he and Randy murdered him,” Storey told KRON4.
For their trials, Thompson and Williams were charged and convicted as adults, and sentenced to serve 26 years to life in prison. Senate Bill 1391, passed in 2018, prohibits anyone under the age of 16 from being charged as an adult. After California’s law passed, Williams’ case was transferred into juvenile court.
Thompson — who was just one year older than Williams at the time of the “Thrill Kill” — remains locked up in San Quentin State Prison, a California Department of Corrections and Rehabilitation spokesperson confirmed to KRON4. “He was sentenced to life with the possibility of parole for first-degree murder. He is in CDCR custody,” the spokesperson wrote.
Thompson’s next parole hearing is scheduled for March of 2024. He will be eligible for parole in May of 2028, according to state inmate records.
Williams was set free hours after a discharge hearing was held in Santa Clara County juvenile court on November 20. His mother, Christina Trujillo, and defense attorney, Lewis Octavio Romero, appeared in the courtroom with him, court records state.
The court set the following probation conditions on the convicted murderer’s release:
Williams cannot change his place of residence without prior approval from his probation officer.
Williams is forbidden from associating with Thompson. He is also barred from having any “intentional contact” with the victim’s family members.
He must participate in re-entry services.
He may not leave his family’s home between 11 p.m.-6 a.m.
He must attend school, vocational training, or maintain full-time employment.
Williams may not use, possess, or be under the influence of alcohol or drugs.
He is subject to search and seizure at any time by law enforcement.
Williams is not allowed to own firearms until he turns 30 years old on June 8, 2024.
If Williams violates his probation conditions, he could be ordered back to jail for no longer than six months.

Stanford Started as a Coeducational School with an Agricultural Focus
At the bequest of the Stanford's the university was originally designed as a coeducational school with an agricultural focus. The Main Quadrangle, which is the heart of the Stanford campus, was completed in 1887. Stanford enrolled its first students, 555 of which 130 were women, in 1891. The school was originally called "the Farm" because of its location in Santa Clara County and also because the Stanford students were heavily involved in the development of California's agriculture industry.

Stanford First University Breaking New Ground.
The university was originally conceived as a way to prepare students for careers in the railroads and other industries that were booming at the time. In 1905, Stanford became the first university in the United States to offer degrees in aeronautics. However, when the great depression hit in 1929, Stanford was hit hard. Tuition revenue dried up, and many students were forced to drop out. The university was forced to make severe budget cuts, and several faculty members were let go. Stanford survived the great depression due to its endowment, which was created by the sale of timberland and farmland owned by the university. The endowment allowed Stanford to maintain its operations during the economic downturn. Even with the endowment Stanford's president at the time, David Starr Jordan, was forced to take a pay cut. Despite these difficulties, Stanford managed to survive the great depression and went on to become one of the world's leading universities.

How Did the World Wars Effect Stanford?
During the World Wars, Stanford served as an training ground for soldiers in the US military. In addition, the university also hosted War Research Laboratories that conducted research on behalf of the government. Stanford's proximity to San Francisco also made it a major hub for war production, with many companies setting up plants and facilities in the area. The wars had a major impact on Stanford, both during and after the conflict.

The Early History of Stanford University.
Stanford Sr. served as the university's first president until his death in 1893. During his second year at Stanford he hired David Starr Jordan, the former president of Indiana University (1884 to 1891). Under Jordan's leadership from 1891 to 1913, Stanford achieved prominence as one of the leading research universities in the United States. A versatile naturalist, Jordan helped Stanford earn a reputation for excellence in such fields as botany, biology, zoology, geology, anthropology, archaeology, and paleontology. During this period Stanford also built its first hospital (1898) and business school (1900), established a law school (1901), and founded what is now the School of Earth Sciences (1902). Not all of Jordan's ideas about Stanford were successful; he once proposed that only men be allowed to attend the university. The first African American student at Stanford was Ernest Houston Johnson, 1894. He was popular and graduted with a B.A. Economics in 1895.

7. The University has Produced Many Exceptional Graduates.
Stanford's alumni include 17 astronauts, 18 Turing Award winners, and 225 Rhodes Scholars. The university has also produced Fulbright Scholars and Marshall Scholars. Stanford has the second-largest endowment per student in the United States. Stanford also has a strong commitment to social responsibility and philanthropy. The university has an endowment of $37.8 billion, which it uses to support its research and educational programs.

Most people believe that in order to be creative, you have to be intelligent. This is a myth. In fact, research has shown that once you get beyond an I.Q. of about 120, intelligence and creativity are not related at all. That means anyone can be creative if they are willing to work at it. Wealthy California pioneers and founders of the Central Pacific Railroad founded Stanford University in 1885 as a memorial to their only son, Leland Jr. The Stanfords generously donated their land grant to the university, stipulating its sole use for educational purposes. The university began as a coeducational school with an agricultural focus which expanded into offering degrees in aeronautics in 1905. The university also contributes significantly to Silicon Valley's economy.
