- 'I Am 100 Percent Sure They Fabricated the Abuse Excuse' - “I’m not 90 percent sure; I’m 100 percent sure...
“I am 100 percent sure that they fabricated their defense,” Bozanich says on Saturday’s episode of Murder Made Me Famous on the Reelz Channel. “I’m not 90 percent sure; I’m 100 percent sure.”
Bozanich says that she did some sleuthing to determine the veracity of the brothers’ claims. “I contacted the jail and I said, ‘I want to know how many hours a day the Menendez brothers are spending with their lawyers,’ ” she recalls. “I was told it was like four to five hours a day. Anybody could get ready to put on a show with that much help in two years, four hours a day. Even a bad actor would be able to do that – especially to save your life.”
But it was the brothers’ demeanor that pushed her over the top. “I was told during the trial by the bailiffs that the brothers would high five each other, particularly after a good day in court when they were testifying,” says Bozanich. “They would high five each other because they pulled it off.”
Dominick Dunne: “I never ever believed for a second that he sexually abused them,” he told the camera... Actually, Dunne did believe the two son’s accusations against Jose Menendez, and he believed it for more than a second. He believed it for the better part of a day.
Dunne found he strongly identified with one of the young killers and confessed, years later, of being “fascinated” by Erik Menendez. X

What Lyle Left Out and Why
One of the most famous moments in the first Menendez trial was Lyle’s tearful testimony, in which he described being sexually abused. Lyle wept throughout a lot of his testimony and was much more emotional on the stand than Erik. (interesting how Erik is the one who gets accused of acting though...)
However, Erik was also a lot more in depth when it came to describing the details of his abuse. Lyle talked a lot about how he felt during it and the events surrounding it, but was vague when describing the abuse. He used terms like “he’d rape me” and “I’d perform oral sex on him”, where as Erik did not use these proper type of terms, and would describe how each act of abuse played out.
Lyle clearly displayed a lot of shame and embarrassment that he’d been victimized. As well as the guilt he felt that as a child he’d re-enacted some of his abuse on Erik. Pamela Bozanich criticized Lyle for apologizing to Erik on the stand, and Lyle replied that he was also apologizing to his father. Lyle had never wanted anyone to know his parents were sick people. He loved them, and his family loved them.
Dr. Conte, one of the psychologists who evaluated Lyle, stated that there was clearly a lot of aspects and incidents of abuse Lyle was simply not willing to talk about. He said that this is because victims fear certain secrets are so shameful or disturbing they will push people away. He also said the abuse at the hands of his father probably went on longer than Lyle was willing to admit.
All of their cousins knew the fact that Jose showered with Lyle and Erik when they were kids. But the fact is, Lyle kept showering with his dad up until 21. Erik testified that Jose sexually abused him during showers, and Lyle told Donovan Goodreau that he and Erik had both been molested by Jose in the bathtub.
Lyle was very vague when talking about being molested by his mother. This was clearly something that was very difficult for him to talk about. He used very non-descriptive terms like “touching”, and “everywhere”. Jill Lansing even had to clarify by asking if he meant his genitals and he barely audibly, and very quickly answers “yes.” Lyle said his dad would be in bed with them when this was going on. It is possible Jose did something to him at this time too.
Lyle also admitted to Norma Norvelli there were things he was not willing to tell the psychologists. “I can only go so far for them. Some things I can talk about, some things I won’t.”

Alicia Hercz whose Lyle’s Spanish teacher and former neighbor testified that Jose had a controlling and saw behaviour signs of the boys indicating they were being abused:

While many witnesses including families, friends, neighbors and former employees testified about witnessing or hearing about the abuse. Jurors went with Pamela Bozanich’s theory that they did it get the money. One of this being with the tapes that were sent to the police by Dr. Oziel’s mistresses. However Dr. Burgess believe the menendez lied on those tapes because they couldn’t trust Dr. Oziel about the abuse.

This has a quote from Deputy District Attorney Pamela Bozanich: "While admitting that the Menendez family was "not an Ozzie and Harriet family where everyone was happy," she said the parents gave them the privileges of wealth. "The parents were willing to support them while they were spoiled, vicious brats," she said. She accused defense attorneys of using a tactic called NHI, a homicide detectives' sarcastic shorthand for worthless victims meaning "No human involved." "It is a sick kind of joke and that's what the defense is in this case. What the defense is saying is that Jose and Mary Louise Menendez were such horrible people, it's OK. Who cares if they are dead? The world is probably a better place without them."

Many of the other 10 Law Review articles have very good links to other sources of the term – not only as a racist "code word", but also in reference to any people not regarded as worthy of "personhood" – prostitute rape victims, extremely violent criminals in prisons, etc.; clearly some uses of the term may seem less forgivable or understandable than others.

Oxford English Dictionary (Advanced Search - full text) for "no human involved" gets us back to 1973 under the very long entry for N, which includes many acronyms beginning with N:

Pamela Bozanich, famously worked as the prosecutor of Lyle Menendez in both trials of he and his brother, Erik Menendez.
Erik and Lyle had confessed to killing their parents, Jose and Kitty Menendez. Their stated reason was fear, after a lifetime of physical, psychological and sexual abuse. When Erik told his older brother he was still being sexually abused, Lyle confronted their father, who threatened to kill them to keep them from going public.
Pamela’s team argued three different theories over the course of the trial. Greed, hatred of their parents or the re-creation of a movie plot.
Mrs. Bozanich was also a prosecutor in the infamous McMartin pre-school case. The most expensive trial in American history. The interviews of the children in this case were later found to be extremely improper. The children made accusations that they had been “flushed down toilets into secret rooms”, “saw witches fly” and “traveled in hot air balloons.” The children also named actor Chuck Norris as one of the abusers. The case was eventually dismissed.

The Menendez Brothers meanwhile, presented credible evidence of their abuse in court. Such as naked photographs their father had taken of them, medical reports from childhood consistent with sexual abuse and witness testimony from their cousins that Lyle and Erik had told them they were being sexually abused as children. Psychologists also testified the brothers’ story was too authentic to have been faked.
Prosecutors repeatedly questioned Erik Menendez on his sexual orientation, and argued he had enjoyed the abuse. They also attempted to present the theory he was in an incestuous relationship with his brother, Lyle.
Jury member Hazel Thornton stated the majority of discussion by the jurors was on the topic of Erik being gay.
“They want this jury to believe... That it’s okay to rape homosexual boys! Because ‘they like it’ or ‘they had it coming’!”

To this day, Pamela Bozanich maintains her belief the McMartin children told the truth, and that Lyle and Erik made up their abuse.
Either way, the first Menendez trial is remembered for the strong female presence in the courtroom. Three of the four main lawyers were women. (Leslie Abramson represented Erik, and Jill Lansing, Lyle)

A Reporters Strange Obsession With Erik Menendez
Dominick Dunne was a True Crime writer who covered the Menendez Brothers trial for Vanity Fair. He wrote some of the most biased and scathing articles about the brothers. He accused them of lying about the abuse and even faking their tears.
One juror even said Dunne paid him to lie to the press about Lyle and Erik high-fiving in-between testimonies. A rumor that still persists (although, the court footage clearly shows it to be a lie.)
But behind the scenes, Dunne had a very different opinion. He privately told fellow reporter, Robert Rand, that he believed Lyle’s sexual abuse testimony.
Dunne and prosecutor Pamela Bozanich spent lunch breaks gossiping about Erik’s sexuality. Dominick and Pamela were both convinced Erik was gay. Pamela even suggested Erik liked “having sex” with his father, and her partner asked Erik multiple times if he and his brother had ever had sex with each other.
Dunne himself was gay, though his close friends say he was full of internalized homophobia.
Pamela told Dunne about a photoshoot Erik had done, which she described as “homoerotic”. Dunne made it his mission to find these photos, and he managed to track down the photographer. He had a shirtless photo of teenage Erik printed out for himself.
He kept it framed in his house, and would show it off to people.
The photographer later said in an interview that the photoshoot itself was “sad” and “off putting”. That Erik had no life behind his eyes.
Meanwhile, in the press, Dunne continued to slander the brothers. He called them liars, actors and spoiled brats. Even though in private he had admitted to believing them, and to feeling a kinship with Erik. But in the press, he had no problem discrediting and ridiculing a rape victim for defending himself.
