Forgive me for sounding old, but when I was in the Army, this type of operation was called a "probe" where you test the security of an item/things/area you want to attack.
And the fact that these were illegals just gives even more credence to the cries that there are active terrorist cells training and/or running operations in this country!!

Quantico in Danger - pt. 1
Spellbound and worried to no end you all stood in front of the screen and watched the reports concerning the big fire because of the heat at the Marine corps base in Quantico. 
You observed that the wind was constantly changing so that the fire threatened to get out of control. 
“The fire must be prevented from spreading any further” you mumbled. 
Tim looked at you with a frown and spoke up “sure, but how should that be possible? They already do what they can.”
Staring at him you had an idea “there is a possibility” and you grinned. 
“That's it! Thanks, Tim!” you hugged him tightly and kissed him briefly on the cheek. 
Then you grabbed your mobile and called the fire fighters
“This is Y/N Y/L/N and I'm a pilot. We have two CL-215 Firefighting Aircrafts, do you need help?”
“Yeah, the wind changes constantly so the fire grows. There are tanks with gasoline and ammunition storages. We need to protect them from the fire or the whole camp will blow up.”
“Hang in there, we're coming.” You answered hurriedly and hung up. 
The whole team stood there stunned and observed what you were doing. 
You ignored them and called your colleagues on the airfield next. 
“Ray here” the other pilot of the second fire fighting airplane answered the phone. Exactly the man you wanted to speak to. 
“Hi, this is Y/N. You heard of the big fire in Quantico?” 
“Yes” 
“Good. We will fly there to help. So get the two CL-215s ready for take-off, refuel one manually, we don’t have time to take on water. I’ll fly ahead with the first plane. In the meantime, you can take on water with the second plane and come to help.”
“Okay, will do.”
With that you both hung up. 
Ray got to work and you turned around to meet the worried glances of the team. 
You felt with them and your heart flew out to them, but you had to go. 
“What are you up to?” Gibbs asked with a frown.
You sighed “the fire is spreading quickly and it needs to be stopped before it reaches the tanks with the gasoline.”
“Yes,” he said, but it sounded questioningly and absolutely worried. He was starting to get an uneasy feeling and he didn't like it one bit. 
“I called the chief of the fire fighters and he said the wind is constantly changing. So they are fighting a nearly lost cause. Aerial support can help stop the flames.” You continued. 
“Good” he stated, starting to suspect what you were getting at based on your phone call. His blood started to run cold out of fear for you. 
“I have to do it. I simply have to, Gibbs. I'm one of the few people who can fly these aircrafts.” you argumented. 
He huffed out, shaking his head. Walking towards you he grabbed your upper arms and spoke softly “you know what you are risking?”
You simply stood there, looked at him and nodded. 
He didn't give in and continued, intensifying his argumentation worriedly “you risk everything. You could be blown up by an explosion and crash because of it.”
“Yes, I know. We always have this risk” you stated, breaking free from his grasp. 
He shook his head, grabbed your hand and pulled you to the elevator, ordering “come with me.”
As soon as the elevator moved for two seconds with you both standing inside, he pulled the emergency switch and the cabin came to an abrupt stop. 
The stopping caused the metal box to shake and you landed in the arms of Gibbs, who held you tight to his chest wrapping his arms around you and pulling you to him, reveling in the feeling of your body against his. 
Your cheeks began to burn out of embarrassment, so you tried to get a little bit away from him. But he still held you close and didn't want to let you go. 
Beneath your palm on his chest, you felt his heart beating just as fast as yours. 
He couldn't help himself, but kissed you briefly right on your lips and then said 
“As a valuable member of the team, I cannot lose you.” 
Then he kissed you once again, but with more passion.
Breaking the kiss once more he whispered, winking at you “That's for encouragement to come back to us and most importantly to come back to me. And then we'll talk about both of us.” 
He paused and then continued “And if you can kiss Tim, then I can kiss you” he said grinning sneakily. 
“But I…” you began, but were stopped by his lips which were pressed on yours again. 
Breaking the kiss after a few moments he whispered “no buts.”
“So you kiss every agent of your team to encourage them to take care before a mission?” you mused smiling. 
He laughed “no. Only the ones I'm in love with.”
You were speechless. 
He leaned his forehead on yours and you both savored the feeling of the other. Both your hearts were racing and you were feeling lightheaded because of all those intense feelings you felt. 
Eventually he mumbled “I only ask you one thing: take care of yourself”. 
You tried to answer, but he softly laid his index finger on your lips. 
“Don't say anything. We’ll talk when you get back.”
You shared a sweet and tender kiss full of promises for the future, then you broke away from each other and Gibbs started the elevator again.

He gave a firm commitment to sustain the Games and expand it to many countries because it holds the promise of effectively lifting the spirits of veterans and soldiers still in active service. Personality:
Oscar is very straight forward and blunt to a point. He is also surprisingly empathetic considering his life and career path. He had a soft spot for women, as old fashioned and sexist as it may seem, is naturally extra protective of them. This extends to children as well. He is very much a man's man when it comes to societal roles. He is not however stuck in his ways and has modernized along with the growing independence of women. Along those lines, he is a very simple man. Give him a good burger and a beer and he'd be content. There isn't much he wants out of life except a family and to be remembered as a good person. He is resourceful, well trained from the military, and despite his perceived optimism, he is pessimistic. He always sees the worst in the world. It's the possible good in people that keeps a glimmer of hope for change alive. He is quick to blame himself when things fall apart, even if it had nothing to do with him. He does have PTSD from his time in the military and copes with his episodes by drinking. He learns quickly and adapts easily. He is a born leader, but prefers not to be in charge. He would much rather be the right hand man after being discharged from the service and gladly allows the right person to take the helm. However, he is capable of stepping back into the position when the need arises.
Biography:
The Lockmoores had about as normal a life as you could have - from the outside anyway. They put on the perfect family facade so well no ever questioned when they materialized in a new neighborhood or when they left it.  Behind closed doors however the patriarch of the familial unit was a black arms dealer working for both the US government and some of their underground partners. “It’s a living,” he would reply whenever asked about it from those in the know.
And it was.  A very good living, but it didn’t come without its costs. Neither of the children were ever to really form bonds with friends until adulthood when they were no longer being carted around the world for ‘dad’s work’. And their family outside of the four of them was nonexistent.  Their father had long before cut ties with his and their mother had been an only child whose parents had already passed by the time she met Frank.
Oscar was first, then Emily five years later.  The two of them became thick as thieves from day one.  Oscar is extremely protective of his sister - sometimes to the point of secluding her from the world.  He means well, but it can be a little much for Emily at times. Shortly after her birth, Millie was diagnosed with cancer and survived another year before perishing to the disease.  Frank did his best to keep things the way they’d always been, but Millie was a big part of keeping the children fed, clean, and happy when he was gone. 
For awhile it was just Oscar and Emily at home, but it wasn’t long until her big brother was expected to join in on the family business. He doesn’t talk about that time period of his life very often. Consider yourself lucky if he ever brings it up. Her father died a few years later during a deal gone bad, leaving Oscar and Em on their own.  It was at that point that Oscar joined the military using his last tie to the black market to get in and the two of them began their own nomadic lives.  Oscar was stationed all over the world - some places even a close call to those who recognized him from his days of working with his father. Even though he was technically part of the Army’s branch, he collaborated mostly with the Navy. 
The bases he was sent to include, but aren’t limited to  Marine Rotational Force in Darwin Australia (briefly), Greece Naval Support Activity Souda Bay, Naval Air Station in Sigonella Italy, the marine Corps garrison at the Værnes Air Station in Norway, the MCAS Yuma Arizona (briefly), Quantico in Virginia. His work always involved small to solo missions, never lasting very long with his efficiency. He resided in D.C. until being sent on his next case in New York.
It was while investigating a string of murders that the outbreak happened. He immediately went into survival mode, his military training kicking instinctively, fighting his way back to D.C. to reunite with Emily and his fiancee, Liz. He made two extremely short and to the point phone calls to each letting them know he was on his way. He found Emily hiding in the back of the tattoo shop she worked at. They made quick work of showing their relief the other was still alive and headed to Liz's work. 
By the time they arrived at her building however, it had been overrun by a decently sized horde. Oscar saw numerous co workers of Liz's as he scanned the now pale faces of all those once living. He fought his way through, hope of finding Liz dwindling by the second, until he caught sight of the dress she'd worn to work that morning. As if everything froze around them, he held out a hand and gently turned her by the shoulder. Her once vibrant, emerald eyes had become clouded and gray, though he could still see the faded green behind the dead look of confusion she gave him. Devastation gripped at his chest and the air had been sucked out of his lungs. She'd been infected. If it hadn't been for Emily yanking him from the nightmare he would have joined his love. 
The siblings headed to Oscar's apartment. The belief that being a few floors up would garner them more security from the infected than Emily's garden unit. They survived a few months before the complex was nearly overrun. The duo took off East. Oscar's theory that the cold would slow down the infected was partially right - some of the undead going in to a sort of hibernation as the temperature dropped. They found shelter from the winds in abandoned buildings and kept their selves warm with nightly fires as they travelled. Once they hit New York they made themselves even more invisible by travelling through subways - not an easy task by any means - eventually finding their way into the parking garage of The Wexley.

National Security Brief: Summary In VA, on May 3rd; two men who had entered the U.S. illegally (Jordanian foreign nationals who "recently crossed the southern border into the U.S.") approached a security gate at Marine Corps Base Quantico. The men claimed to be Amazon delivery persons. Security personnel advised the driver to move forward to a secondary security area for further inspection, the driver refused an order to "halt" and accelerated attempting to navigate into the interior of the "Town of Quantico". Security personnel activated barriers, which prevented further entry. One of the men has been reported to have been on the U.S. terrorist watch list.  Two days after the attempted Quantico breach, a person crashed into the White House gates and died (similar breach attempted on Jan 8th and in both cases, mainstream media and Gov. were silent). In late April, a vehicle tried to enter Joint Expeditionary Base Little Creek-Fort Story in Virginia Beach; the driver died in the crash. In late March, a Chinese national tried to access Twentynine Palms, was detained, and handed over to ICE. In early April a person attempted to breach an FBI field office by ramming a vehicle through the employee entrance gate. The vehicle was stopped by a security apparatus and the man was arrested. Separately, 3 Chinese nationals were captured after crossing over the Canadian border to the U.S. at Fort Fairfield, ME. Finally, in NC near Ft. Liberty (Ft. Frank’s Complicated Education
I had a mystery question related to the below statements and the fact that a Lieutenant is a commissioned officer that needs a bachelor’s degree.
Go ahead. Go ahead. I had to teach you how to hold a gun. Do you remember? Eighteen, and you'd never held a piece before. [x]
When Castle was just eighteen, he enlisted in the United States Marine Corps where he had eventually met and was then placed under the command of Major Ray Schoonover. [x]
It feels kinda weird—what would a Major on active duty be doing instructing newbie recruits at a boot camp? Aren’t there, like, drill sergeants or other special people for that?
And also, we all seem to agree that Frank is a lot smarter than people usually expect, but what exactly has gone into that Scout Sniper specialisation he’s so rightfully proud of?
So I, a non-American, fell into a research hole, and Frank’s academic / career path looks smth ridiculous like this.

STEP ONE - GETTING BACHELOR’S DEGREE AND APPARENTLY MEETING SCHOONOVER SOMEWHERE IN THE PROCESS

With a birthday in November [x], I’m assuming Frank finished highschool aged 17 [x]. After that, Frank may have enlisted straight away, because Schoonover remembers teaching an 18-year-old Frank to shoot, so that could be the 13-week recruit training program upon his initial enlisting. [1]. Btw, from there you graduate with these sort of dress uniforms (the red ‘blood stripes’, white belts):

However, a Lieutenant is a commissioned officer, and, in order to qualify for commission, Frank would still need a bachelor’s degree.
If Frank is enlisted already, he could obtain it a bit later through a MECEP program, but, in order to get on the path to commission faster, he could have gone to college + PLC course [2] right after the highschool, meaning he might have met Schoonover in the summer training course after his college freshman year (meaning Schoonover was an instructor at PLC?):

Or Frank could have gone to college + NROTC Marine Option [3] (meaning Schoonover was an instructor at NROTC or OCS?):
In addition to regular NROTC program requirements, NROTC (Marine Option) midshipmen must pass a 6-week OCS course known as "Bulldog" during summer between junior and senior year. "Bulldog" is modeled after the PLC Seniors Course.
In case of NROTC, I think it might have been the College Program route, as it doesn’t seem very likely that the trouble-maker Frank qualified for a scholarship lol [4]:

Also, with NROTC, you can apparently skip the officer school and, upon finishing college + the NROTC requirements, you get the 2nd Lt rank automatically. [5A][5B]
Theoretically, an Officer Candidates Course (OCC) would also work to get him into OCS, but that course is for college seniors and graduates, placing Frank’s first brush with Schoonover at ages 20-21. Although, it would offer Frank a different alternative to the 10-week Officer School later [also 4], letting Frank have his college summers free of PLC:
OCC is a 10-week commissioning program in Quantico, VA for college seniors and graduates interested in earning the title as a United States Marine Officer. Upon completion, newly commissioned Marine Officers will begin active duty at The Basic School (TBS) as Second Lieutenants.

STEP TWO - OFFICER CANDIDATES SCHOOL and LIEUTENANT RANK
With a college degree (aged 20-21), Frank finally qualifies for the OCS, which is based in Quantico and takes 10 weeks of full-time commitment [6]. If he went the NROTC or OCC route, this step can be skipped.
Considering the qualification, he must have pulled his shit together by then.
Officer Candidates must pass a series of tests before being admitted into the Officer Candidate School. An Officer Selection Officer (OSO), usually a Captain, meets with a prospective Officer Candidate. Upon completing a satisfactory interview, the OSO then makes the decision to move the prospective candidate onto the next step. The prospective candidate then must complete a short essay about why they want to be a Marine Officer, provide identification, pass a background check, provide five letters of recommendation, and complete a physical medical exam. [7]
Theoretically, Frank would qualify for the officer school already upon finishing PLC or NROTC or OCC during college, but college and officer school are not compatible in terms of time and effort required.
Either way, Frankie won’t become a scout sniper without that college degree:
Officer candidates who complete OCS (and have obtained their college degrees) are then commissioned as Second Lieutenants and sent to The Basic School (TBS) at Quantico for six months of further training with other newly commissioned Marine officers from all other commissioning programs. [7]

That’s a Second Lieutenant blue-white dress uniform, which is authorized for wearing in summer [8], with marksmanship annual qualification badges Rifle Expert (looks like it’s earned for the 2nd year in a row) and Pistol Expert [9], meaning he’s the bestest shot with these weapons (Marksman --> Sharpshooter --> Expert).
I can’t make out what’s pinned above the ribbons, but it’s something with wings, like this or this? The comics wiki says Frank Castle has received helicopter training, and can fly a plane too, but MCU version of the wiki doesn’t mention that.

STEP THREE - THE BASIC SCHOOL & SPECIALISATION
All newbie Marine Corps officers, fresh from OCS or NROTC, are further trained in The Basic School (which is also in Virginia).
After a Basic Officer Course (BOC) that lasts 28 weeks, Frank would have chosen his primary specialisation [10]. Because Scout Sniper military occupational specialty (MOS) falls under the Infantry category, after graduating BOC, he’d need to stay on that same Basic School campus and continue with an Infantry Officer Course (IOC) for another 15 weeks.
Also, Scout Sniper is a secondary MOS, which means that first Frank should have specialised in something else. Wikipedia in one instance says the prerequisite for Scout Sniper is becoming a Ground Intelligence Officer or some other kind of Infrantry MOS [11]. In another article [12], the prerequisite is either one of these primary MOS: 0311 Rifleman, 0321 Reconnaissance Marine, 0331 Machine Gunner, 0341 Mortarman, 0352 Antitank Missile Gunner, or 0369 Infantry Unit Leader.
I don’t understand how the rank requirements go together. How would a 2ndLt , after graduating from the Officer Candidates School, get a primary MOS that seems to be capped at a Sergeant rank or at Master Gunnery Sergeant? Unless PMOS can be assigned during earlier training? Or Frank took some time between highschool and college, or between college and OCS to get any of these primary specialties while in some lower-level marine boot camp? Or there is no upper rank limit? [gods I’m not gonna think about it, this is getting ridiculously long as is]

ANYWAY, he needed some on-field experience, an active contract, and a recommendation from his battalion with future plans to appoint him to a scout-sniper platoon, in order to get his ass sent to the Scout Sniper Course in Quantico. There are quotas and budget. See the list of requirements here.
The Scout Sniper Basic Course used to be 10 weeks before 2009 when Frank would have attended [13].

SINCE THEN, Frank Castle had earned the rank of 1st Lieutenant, was serving with US Marine Corps Force Recon, and 2 years before the events of DD s2 was awarded the Navy Cross [14].
The above sequence of training/education would explain how he’s wearing a 2nd Lt uniform at his wedding at... 21-22 years old (?), but doesn’t really explain this:
1) when would an 18yo Frank manage to get all the necessary hands-on field training with Schoonover? Because if he simply went to the boot camp and took his time moving through the enlisted and non-commissioned officer ranks without the college degree shortcut to 2nd Lt, then he can’t have been that young-looking in that wedding waltz flashback OR he can’t have worn that uniform OR he just remembers the whole thing wrong.
2) considering he DID need a bachelor’s degree to get that Lt rank, what did Frank study? Even if he went the route of a purely military themed college like this one, there’s still the choice of subjects.
3) Isn’t there some expectation of a certain speed of moving up the ranks? Why did Frank get only 1 levelup in ~14 years? He was reportedly excellent, trusted and respected in his job, his CO (officially) liked him well enough. Could be that, Navy Cross aside, the illegality and secrecy of the Cerberus project fucked up Frank’s military record even more than he realised, due to there not being sufficient amount and/or quality of performance info submitted for a promotion?

Former DeRidder Mayor Misty Roberts was charged with third-degree rape and contributing to the delinquency of juveniles, Louisiana State Police announced on Thursday. An investigation into the 42-year-old mayor, who was in her second term, was opened on July 26, after the Beauregard Parish Sheriff’s Office requested the state police look into a complaint against Roberts. “As the investigation progressed, LSP SVU conducted interviews with two juveniles, one of which was the victim. Both juveniles confirmed Roberts had sexual intercourse with one juvenile victim while employed as Mayor,” a statement read.***

Their break was when we didn't shoot them; why are they on bail?
The two illegal Jordanian migrants who are charged with trying to breach Marine Corps Base Quantico in May posted thousands of dollars in bail and were allowed to leave federal custody, The Post can exclusively reveal. Hasan Yousef Hamdan, 32, and Mohammad Khair Dabous, 28, were released from Immigration and Customs Enforcement (ICE) detention despite their immigration status — Hamdan had crossed into the country illegally in April and Dabous had overstayed his student visa and is subject to removal proceedings, law enforcement sources told The Post. They were arrested on May 3 for trespassing onto the military installation and handed over to ICE officers because of their immigration statuses.*** The two Jordanian nationals lied to guards at Quantico and claimed they worked for an Amazon subcontractor and were there to make a delivery, Capt. Michael Curtis, a spokesman for the base, previously told The Post. The officers quickly determined that the two had no business being there. The men, who were in a box truck, ignored instructions of military guards and tried to drive onto the base before they were stopped by anti-vehicle barriers.***
These two knuckleheads are part of a disturbing trend this year of illegal aliens attempting to enter military installations and surveil military personnel.

Pres Rutherford B. Hayes pardoned Bennett, certainly no later than 1881. Why don't we just ask Congress to repeal 18 U.S.C. §1461?

The security details for senior officials were changed, and electronic equipment such as mobile phones swapped. He said some senior officials had been moved to a different location.***
Look at how Secret Service directors Kimberly A. Cheatle and Ronald L. Rowe, Jr. responded to Crooks shooting Donald J. Trump. All they have done is stonewall Congress. It's not like some guy on the subway is asking them what they've been doing lately. Congress asks them how they failed, and they have no response. They just stonewall. Moreover, they seem to have no idea how to make things better.
I'm not suggesting that the U.S. arrest anyone.

A Bronx prosecutor abruptly resigned after he was caught on video allegedly attempting to meet a young boy he communicated with online, according to a clip produced by internet vigilantes who expose wannabe child predators. William C.C. Kemp-Neal, 30, quit his post in the Bronx District Attorney’s office four days after the group Dads Against Predators posted footage of him filmed in the parking lot of the Target on East Sandford Boulevard in Mount Vernon. In the clip taken July 8 at around 8:30 p.m., the video vigilantes approach a man identified as Kemp-Neal, asking if he’s Marcus. Almost immediately, Kemp-Neal — who graduated from Fordham Law in 2021 — runs. Kemp-Neal made $84,990 as an ADA, and handled mostly assault, harassment, and child endangerment cases.***

A fugitive rapist who was on the run for 30 years was finally busted in Iowa after police stopped him for riding a bicycle without a rear reflector, bodycam footage of the arrest shows. George Hartleroad, 71, was stopped by police in West Des Moines on June 26 and provided them with a fake name and social security number, WCCI reported. Video shows the bearded Hartleroad give his name as “Gregory Stallins,” and tell the officer that he is homeless and has been living in Iowa since 1991. He had no driver’s license on his person.*** “Alright brother, time to be honest with me, OK? So the info you give me comes back to a dead guy. Gregory Stallins is dead,” an officer is heard questioning Hartleroad in the video.*** At one point, police asked him to remove his hat so they could snap a photo to run through a facial recognition program.  Hartleroad eventually confessed his true identity. The officer then learned the real man he stopped has been wanted by authorities in Wisconsin since 1994 when he escaped from a halfway house, according to the station.*** He was convicted of rape in 1983 and served five years in prison, Wisconsin records show. Hartleroad said he would go back on the run the next chance he got. “I will jump again as soon as they turn me loose,” he tells the officers as they take him into custody. “They’ve been up in my ass for … 41 years now on a 9-year sentence,” he added. He is in now custody of the Wisconsin Department of Corrections after he was taken across state lines.

The Secret Service has denied a report that former Director Kimberly Cheatle and other agency leaders wanted to destroy cocaine found in the White House. “This is false. The US Secret Service takes its investigative and protective responsibilities very seriously,” agency spokesman Anthony Guglielmi said. *** A story in RealClearPolitics cited three anonymous sources within the Secret Service who claimed that Cheatle*** reassigned an officer who wanted to follow a specific crime scene investigative protocol after the discovery. Guglielmi’s statement did not address that aspect of the report.***
RealClearPolitics also reported that DNA testing on the bag returned a “partial hit,” meaning it may have matched a “blood relative of a finite pool of people.” However, additional searches for DNA matches were not conducted, according to the outlet.

Our country has always been a nation of laws, but something has changed dramatically in recent decades. Contrary to the narrative that Congress is racked by an inability to pass bills, the number of laws in our country has simply exploded. Less than 100 years ago, all of the federal government’s statutes fit into a single volume. By 2018, the U.S. Code encompassed 54 volumes and approximately 60,000 pages. Over the past decade, Congress has adopted an average of 344 new pieces of legislation each session. That amounts to 2 million to 3 million words of new federal law each year. Even the length of bills has grown—from an average of about two pages in the 1950s to 18 today. And that’s just the average. Nowadays, it’s not unusual for new laws to span hundreds of pages. The No Child Left Behind Act of 2001 ran more than 600 pages, the Patient Protection and Affordable Care Act of 2010 almost 1,000 pages, and the Consolidated Appropriations Act of 2021—which included a COVID-19 relief package—more than 5,000 pages. About the last one, the chair of the House Rules Committee quipped that “if we provide[d] everyone a paper copy we would have to destroy an entire forest.” Buried in the bill were provisions for horse racing, approvals for two new Smithsonian museums, and a section on foreign policy regarding Tibet. By comparison, the landmark protections afforded by the Civil Rights Act of 1964 took just 28 pages to describe. These figures from Congress only begin to tell the story. Federal agencies have been busy too. They write new rules and regulations implementing or interpreting Congress’s laws. Many bear the force of law. Thanks in part to Supreme Court Justice Louis Brandeis, agencies now publish their proposals and final rules in the Federal Register; their final regulations can also be found in the Code of Federal Regulations. When the Federal Register started in 1936, it was 16 pages long. Today, most of these decisions can be found in searchable electronic databases, but some come with high subscription fees. If you can’t afford those, you may have to consult a library. Good luck finding what you need there: Reported federal decisions now fill more than 5,000 volumes. Each volume clocks in at about 1,000 pages, for a total of more than 5 million pages.  *** You might think that federal criminal laws are reserved for the worst of the worst—individuals who have committed acts so egregious that they merit the attention not just of state authorities but of federal authorities, and not just civil fines but potential prison time. But if that’s your intuition, ask yourself this question: How many federal crimes do you think we have these days? It turns out no one knows. Yes, every few years some enterprising academic or government official sets out to count them. They devote considerable resources and time (often years) to the task. But in the end, they come up short.*** Numbers tell part of the story, but only a part. Today, the law touches our lives in very different ways than it once did. In the past, the rules that governed what happened in our homes, families, houses of worship, and schools were found less in law than in custom or were left to private agreement and individual judgment. Even in the areas of life where law has long played a larger role, its character has changed. Once, most of our law came from local and state authorities; now federal law often dominates.***
J. Gorsuch referred to Yates v. United States, 574 U. S. 528 (2015). The government had a weird theory that Yates had caught undersized red snappers, and then when he was caught by the feds, he had thrown out those fish and replaced them with other undersized red snappers. He was convicted. He appealed to the 11th Cir. which affirmed his conviction. He was lucky the Supreme Court reversed his conviction by 5-4.
Interestingly, the dissent in Yates largely agreed with J. Gorsuch that
That brings to the surface the real issue: overcriminalization and excessive punishment in the U. S. Code.*** Still and all, I tend to think, for the reasons the plurality gives, that § 1519 is a bad law—too broad and undifferentiated, with too-high maximum penalties, which give prosecutors too much leverage and sentencers too much discretion. And I'd go further: In those ways, § 1519 is unfortunately not an outlier, but an emblem of a deeper pathology in the federal criminal code. 574 U.S. 569 - 70.
