People of the Philippines vs. Ford Gutierrez y Dimaano G.R. No. 188602, February 4, 2010
FACTS:
On May 17, 2003, in Makati City, Ford Gutierrez (appellant) shot and killed Leo Salvador Regis and wounded Alexis Dalit, and also fired at but missed Jaypee Boneo, Randy Marcelo, and Jefferson Gallemit.
The victims were talking in front of Regis’ house when the appellant suddenly appeared and fired at them.
Regis died from the gunshot wound.
Dalit was hit in the arm and received medical treatment.
The other three victims were not hit.
The appellant claimed self-defense, stating that he was attacked by the victims, and that he only got hold of the gun during the fight.
The Regional Trial Court (RTC) found the appellant guilty of murder, frustrated murder and three counts of attempted murder.
The Court of Appeals (CA) affirmed the RTC decision with modifications, changing the frustrated murder conviction to attempted murder.
ISSUES:
Did the appellant act in valid self-defense?
Was treachery correctly appreciated as a qualifying circumstance to the crime of murder?
Was the appellant correctly found guilty of attempted murder for the injury sustained by Dalit?
Were the damages awarded by the lower courts proper?
RULING:
Answer: The Supreme Court affirmed the CA decision with modifications, finding the appellant guilty of murder and four counts of attempted murder and adjusting the damages awarded.
Legal Basis:
Self-Defense: Self-defense requires (a) unlawful aggression on the part of the victim; (b) reasonable necessity of the means employed by the accused to repel it; and (c) lack of sufficient provocation on his part. The burden of proof rests on the accused claiming self-defense.
Treachery: Treachery is present when the offender commits any of the crimes against persons, employing means, methods, or forms in the execution thereof which tend directly and specially to ensure its execution, without risk to the offender arising from the defense which the offended party might make.
Attempted Murder: If the wounds inflicted on the victim are not sufficient to cause death, the crime is only attempted murder.
Damages: When death occurs due to a crime, civil indemnity, actual or compensatory damages, moral damages, exemplary damages, attorney’s fees and expenses of litigation, and interest may be recovered. Civil indemnity for murder is fixed at P50,000. Temperate and actual damages are mutually exclusive. Exemplary damages may be awarded when the crime is attended by an aggravating circumstance.
Application:
Self-Defense: The appellant failed to prove unlawful aggression on the part of the victims. The victims were talking when they were suddenly fired upon by the appellant. The appellant's version of events was uncorroborated and deemed not credible.
Treachery: The attack was sudden and unexpected, with no provocation from the victims, which indicates treachery.
Attempted Murder: The wound sustained by Dalit was not fatal and therefore the crime is only attempted murder.
Damages: The Court affirmed the award of civil indemnity of P50,000 for the death of Regis. The award of temperate damages was deleted because actual damages were already granted. The court increased the exemplary damages for Regis' heirs to P30,000, and awarded moral damages of P50,000. The court also awarded actual damages of P22,596.50, moral damages of P40,000, and exemplary damages of P20,000 to Dalit.
Conclusion: The Supreme Court affirmed the appellant's conviction for murder and four counts of attempted murder. The Court ordered the appellant to pay the heirs of Regis P42,337.25 as actual damages, P50,000 as civil indemnity, P50,000 as moral damages, and P30,000 as exemplary damages. The appellant was also ordered to pay Dalit P22,596.50 as actual damages, P40,000 as moral damages, and P20,000 as exemplary damages.
DOCTRINE OF THE CASE:
Self-defense: The accused must prove the elements of self-defense: unlawful aggression, reasonable necessity of the means employed to repel it, and lack of sufficient provocation. The burden of proof lies with the accused.
Treachery: Treachery is present when the attack is sudden and unexpected, giving no chance to the victim to defend themselves.
Attempted Murder: If the wounds inflicted are not sufficient to cause death, the crime is only attempted murder.
Damages: In cases of murder, civil indemnity is awarded without the need for proof other than the fact of death and the accused’s responsibility. Temperate and actual damages are mutually exclusive. Exemplary damages may be awarded if the crime is attended by an aggravating circumstance.
