Alec Baldwin once fired a blank round at a crew member on the set of “Rust,” prosecutors alleged in new court papers, as they accused the actor of being reckless with firearms while filming.
Prosecutors in the New Mexico involuntary manslaughter case against the “30 Rock” star said they plan to bring evidence at his trial — slated to begin on July 9 — showing that Baldwin had a history of flouting safety protocols on set, which led to Halyna Hutchins’ tragic shooting death in 2021.
One such reckless moment came when Baldwin, 66, pointed his gun and fired “a blank round at a crew member” while he held the person target in his line of sight, prosecutors alleged in the Monday filing.
Other examples of Baldwin ignoring safety procedures between Oct. 12, 2021 up until the day of the shooting included him using his gun as a pointer; firing the weapon after filming was over in violation of safety rules; holding his finger on the trigger in scenes that didn’t require it; rushing armorer Hannah Gutierrez-Reed to reload his gun faster; and being on FaceTime with his family and making videos for them during firearms training, the court papers claimed.
And before filming even started Baldwin — one of the producers and the leading actor in the movie — “asked to be assigned the ‘biggest’ gun available,” the filing alleged.
Prosecutors said they have photos and videos of Baldwin that they plan to show a jury acting cavalierly toward on-set safety rules.
In one clip, he “can be seen engaging in horseplay with his gun and pulling his gun when the scene did not call for the pulling of his gun,” the papers claimed. “When he pulls his gun the muzzle of the gun is pointed directly at another actor.”
Prosecutors said many clips show an angry and aggressive Baldwin, who can also be seen halting filming to yell and swear at the crew.
“Mr. Baldwin can be seen screaming intermittently throughout the attempts at filming the scene,” the filing claimed. “He exercises complete control over the set by stopping the acting sequence, cursing loudly and rushing the other cast and crew.”
Taken altogether this “intrinsic evidence” of Baldwin’s “other acts” leading up to Hutchins’ death shows that the incident wasn’t an “accident or mistake” — as Baldwin has maintained all along, prosecutors said.
During a rehearsal on the set of the Western film, Baldwin aimed his revolver in the direction of cinematographer Hutchins when it fired, killing her and wounding director Joel Souza.
Baldwin pleaded not guilty and faces up to 1 and 1/2 years if convicted.
Armorer Gutierrez-Reed, 26, was sentenced to 18 months behind bars in April after her conviction on the same charge Baldwin now faces.
A video hearing has been scheduled for Baldwin on Friday to go over a slew of motions for the upcoming trial.
Baldwin’s lawyers didn’t immediately return a request for comment Wednesday morning.

Souza talks about finishing the film and no longer having a relationship with Baldwin. He also talks about how the church scene was cut entirely. We know Jensen was supposed to be in that scene. Do you think it was Jensen's choice not to go back, or that in connection with that scene being cut, they rewrote some of the storylines so that his character no longer was needed?
Link. Neither, I think Jensen's manager didn't want him anywhere near Rust not just because of the tragedy and controversy, but also because he didn't want Jensen to add to the controversy ever since CNN picked up his story trolling the inexperienced armorer from the Denver convention. In later conventions Jensen said the media was wrong in calling the Rust set unsafe and a shit show and he really, really wanted to set the record straight. Then in his police interview he lashed out at the crew members for walking off the set over safety issues and implied that it’s expected in a low budget movie. If I was Jensen’s manager, I would want him far away from Rust because I don’t trust Jensen not to say something ….uncomfortable.
Jensen's character got recast, for the 3rd time so the character is still needed. Jensen replaced the original actor playing the sheriff and they had to do reshoots because of that, which included filming on full weekends because the recast/reshoots put them behind schedule. The role of sheriff is now played by Josh Hopkins (x).
They took out the church scene because they didn't want people to overly focus on the scene with macabre association. It's the same reason why Brandon Lee's last scene was cut from the final edit and his character's death was rewritten with a new scenario to try to put a distance to the real life tragedy in the audience's mind.

If you don't mind me asking what happened at the Rust shooting?
Phew. This is a big one. I'll do my best to answer, anon!
So.
Rust is a western movie that was being filmed a few years ago. Jensen was attached, as was Alec Baldwin, and a few other actors.
There were rumors of issues since the beginning of production. Alec Baldwin, for example, was late in arriving and missed a lot of gun training.
The armorer, Hannah Gutierrez-Reed, the person responsible for the weapons, was rather inexperienced and it was her--supposedly--first solo gig as opposed with her father. She was supposed to ensure all the bullets were blanks instead of real bullets. She prepared a gun for Alec to test for a scene.
Cinematographer Halyna Hutchins handed the gun to Alec and supposedly told him to test it first. Alec did not check the gun himself before test firing it. The shot killed Halyna and wounded a secondary person, Joel Souza, who was the director.
Hannah was eventually found guilty for her part of the death. She was charged and found guilty of involuntary manslaughter and sentenced to 18 months in prison on April 15, 2024.
Alec has also been charged. There were talks of the charges being dropped, but they have been reinstated.
Jensen was present and left his testimony to the police about what he had seen. He was deeply shaken and wanted Danneel there. The excuse as to why she couldn't was that she was "afraid to fly" (suspicious given her well-traveled life!) and couldn't talk to him about it (lack of emotional support).
Halyna leaves behind a husband and a 9 year old son.

Jensen Ackles being called as a witness in the trial against Alec Baldwin.
A plethora of cast and crew from the “Rust” production are being summoned as witnesses for Alec Baldwin‘s trial, including its helmer Joel Souza who was present on set during filming.
On February 24th, Baldwin will be making his initial appearance in court electronically after being charged with two counts of involuntary manslaughter for the demise of cinematographer Halyna Hutchins.
Court documents acquired by Fox News Digital name camera assistant Lane Luper and gaffer Serge Svetnoy as witnesses of the incident on the set of “Rust” – both have previously voiced their concerns about its lack of safety.
Luper resigned from his job on the production of “Rust” prior to the fatal shooting incident.
“What I put in my resignation letter was lax COVID policies, the housing situation driving to and from Albuquerque, and specifically, gun safety, a lack of rehearsals, a lack of preparing the crew for what we were doing that day,” Luper previously said during an appearance on “Good Morning America” in Nov. 2021.
Svetnoy also verified the danger that exists on set.
During a press conference months after the shooting, Svetnoy’s attorney told reporters that the movie’s producers “were cutting too many corners to save money” and that negligence on set led to Hutchins’ death.
Rounding out the list are Jensen Ackles, actor; Mamie Mitchell, script supervisor; Seth Kenney, owner of prop store; Gabrielle Pickle, line producer and Sarah Zachry, prop master.
In addition, a group of investigators from Santa Fe County led by Sheriff Adan Mendoza are listed, alongside FBI analysts and experts.
Astoundingly, assistant director David Halls was absent from the witness list. The first assistant director agreed to accept culpability for his actions and plead guilty to negligent use of a deadly weapon; now awaiting confirmation by a judge.
Halls allegedly handed Baldwin the gun before the fatal shooting of Hutchins and confirmed it was “cold,” meaning no live ammunition.
On January 31st, according to court documents, the formal charges against Baldwin and Gutierrez-Reed were two counts of involuntary manslaughter.
In the same documents, prosecutors provided a comprehensive overview of their probable cause against Baldwin.
“Baldwin’s deviation from known standards, practice and protocol directly caused the fatal death of Hutchins,” the documents state.
“By not receiving the required training on firearms, not checking the firearm with the armorer, letting the armorer leave the firearms in the church without being present, deviating from the practice of only accepting the firearm from the armorer, not dealing with the safety complaints on set and/or making sure safety meetings were held, putting his finger on the trigger of a real firearm when a replica or rubber gun should have been used, pointing the firearms at Hutchins and Souza, and the overall handling of the firearms in a negligent manner, Baldwin acted with willful disregard for the safety of others and in a manner which endangered other people, specifically Hutchins and Souza.”
On October 21, 2021, tragedy struck when a gun held by Baldwin discharged on the set of a church at Bonanza Creek Ranch in New Mexico. The incident resulted in the death of Hutchins.
Over the past year, the Santa Fe County Sheriff’s Department has been diligently looking into how live ammunition wound up on set. Gutierrez-Reed and Halls were supposedly two of only a few individuals that managed the firearm.
Before Halls is said to have provided Baldwin with the gun, Gutierrez-Reed spun the cylinder so that Halls could see it contained bullets, her lawyer reported.
In a primetime interview and again in a podcast episode, Baldwin strongly declared that he had not pulled the trigger of the gun. Initially indicating that he had only cocked it back as far as possible then let go, his story remains unaltered ever since.

Com o resultado, o Santos do técnico Emerson Leão chegou aos 37 pontos no Brasileiro, só três a menos do que o líder Cruzeiro.
Já a equipe carioca, apesar da estréia do técnico Joel Santana, continua a cair. A derrota de ontem foi a quarta consecutiva do clube, que permanece estacionado nos 22 pontos. A defesa do time continua sendo muito frágil -o clube sofreu 13 gols nas últimas quatro rodadas do Nacional.

O time paulista logo se impôs diante do Fluminense. Tocando melhor a bola, a equipe da Vila Belmiro pressionou o clube carioca e teve a primeira chance de gol aos 5min, com o meia Elano, que recebeu na entrada da área e bateu no canto direito, obrigando Kléber a saltar para fazer a defesa. Dois minutos depois, foi a vez de o atacante Ricardo Oliveira perder uma boa oportunidade. Nenê cruzou da esquerda e, aproveitando-se de falha da defesa do Fluminense, Oliveira cabeceou. Novamente, Kléber salvou.
A partir dos 11min, o Fluminense esboçou uma reação. Num erro da defesa santista, Romário roubou a bola, invadiu a área, mas não conseguiu driblar o zagueiro Pereira. Outra boa chance da equipe carioca ocorreu aos 17min, numa tabela de Romário com o zagueiro César. A bola foi cruzada rasteira na área e por pouco o atacante Josafá não a alcançou.
O jogo continuou equilibrado no primeiro tempo, embora o Santos mostrasse melhor qualidade técnica. Um dos destaques da partida, Ricardo Oliveira quase abriu o placar aos 30min, numa jogada em que driblou Marcão, limpou o lance e bateu no canto direito. Kléber foi obrigado a defender de mão trocada. De tanto insistir, o Santos conseguiu marcar aos 36min, num lançamento do lateral Léo para o volante Renato na direita. Renato lançou a bola para Elano, que estava livre e pegou de voleio.
Pouco depois, aos 39min, o Fluminense reagiu, graças a uma falha do voante santista Alexandre. Josafá tocou de calcanhar, Alexandre errou a bola e Romário, que voltava ao time, dominou livre para invadir a área, tocando na saída do goleiro Júlio Sérgio. O erro do jogador santista foi compensado aos 45min do primeiro tempo pelo zagueiro César, que entregou uma bola de presente para o atacante Nenê. Ele invadiu pela esquerda e bateu cruzado, desempatando o placar.
O segundo tempo foi ainda mais fácil para o Santos. Aos 18min, o volante Zada também falhou e Léo invadiu a área, sendo derrubado por Kléber. A bola chegou a entrar no gol, mas o árbitro marcou primeiro o pênalti, que foi convertido por Ricardo Oliveira. Com a saída do ex-palmeirense Lopes, o Fluminense até melhorou, mas desperdiçou chances com Romário e Joãozinho.
Foi o Santos, porém, que marcou mais um, já nos acréscimos. Jerri recebeu na entrada da área, percebeu que Kléber estava adiantado e tocou por cobertura, fechando o placar da partida.

Alec Baldwin’s high-profile trial is now under way in a courthouse in Santa Fe – almost three years after cinematographer Halyna Hutchin was killed in a tragic shooting while filming Western movie Rust.
During a rehearsal of a shooting scene in 2021, a prop gun Baldwin was holding went off, striking and killing Hutchins and injuring director Joel Souza.
Baldwin is charged with involuntary manslaughter and faces 18 months in prison.
Just before court began Thursday, Attorney Jason Bowles confirmed that the film’s armorer Hannah Gutierrez-Reed will testify on Friday. Gutierrez-Reed has already been convicted of involuntary manslaughter and sentenced to 18 months in prison.
On Wednesday, jurors heard opening statements with prosecutors saying that the Hollywood star skipped safety checks and recklessly handled a revolver prior to the fatal incident.
Baldwin “played make believe with a real gun and violated the cardinal rules of firearm safety,” special prosecutor Erlinda Ocampo Johnson said.
But defense attorney Alex Spiro said “these cardinal rules, they’re not cardinal rules on a movie set.”
As the first witnesses took the stand, prosecutors played the fraught 911 call in the aftermath of the shooting and graphic bodycam capturing the frantic efforts of first responders to save Hutchins. In the courtroom, Baldwin looked at the screen somberly as the video played.
