Gang preparing fake financial documents busted
Just two days after the arrest of three persons involved in a fake C-form sale racket, the district police busted a gang involved in preparing fake financial documents here today.
City Police Commissioner Gaurav Yadav claimed that the gangsters were involved in preparing fake documents like bank statements and loan statements and were “facilitating” students for procuring study visa in different countries.
The racket was being run from the premise of Education Boutique, Prime Tower. On a tip-off, the police laid a trap and nabbed three persons, Atul Vashisht, resident of Panchkula, Kamal Sehgal of the local Wariana, and Naresh Kumar, resident of the local Preet Nagar, Ladowali Road, from the Prime Tower.
Yadav revealed that Atul Vashisht runs Daffodils Study Abroad, Sector 22-C, Chandigarh, Kamal Sehgal runs Taff Educations, Green Park, near Narinder Cinema, Jalandhar, while Naresh Kumar runs Worldwide Career Consultants, Badwal Complex, near Narinder Cinema, Jalandhar.
Their fourth accomplice Pavit Brar, a Director of Education Boutique, is yet to be arrested. The police had recovered fabricated documents, supposed to be issued by different banks, from the arrested persons.
The racketeers used to advertise through media and were offering “readymade” documents to students desirous of going abroad for higher studies in different foreign countries.
A case under sections 419, 420, 465, 467, 471 and 120-B of the IPC was registered at Navi Baradari police station.

Fraudster Suryawanshi cheated people from different cities, promising gold at cheap rate, he collected lakhs of rupees from gullible victims
Mukesh Suryawanshi, the fraudster who duped several persons at various cities in the state by luring them with cheap gold, is currently behind the bars. Suryawanshi impressed people by his posh lifestyle and duped them of lakhs of rupees.
A 28-year-old woman from Baner, Pune, entrusted Rs 42.80 lakh to Mukesh Suryawanshi in January 2018. However, he only returned Rs 17.59 lakh to her, and after July 2018, stopped repaying. Fleeing to Dubai, he returned to Goa on March 6 of this year, where he was arrested upon arrival at the airport. He was later transferred to the Mumbai police for further investigation. A farmer from Dhule also fell victim to his deception. Suryawanshi convinced the farmer to invest in gold with the promise of doubling the returns. The farmer, trusting Suryawanshi and his family's lavish lifestyle, believed in the offer, especially as the initial repayments were assured. However, as time passed, Suryawanshi ceased payments, and he is said to have duped over 60 farmers from Dhule, Nashik, Jalgaon, and other districts in a similar manner. Suryawanshi also victimized two women from Thane. He promised one woman gold at a discounted price and told the other he would sell her gold at a higher price than market value. Both women were left devastated. Furthermore, he defrauded several married women under the pretense of marriage, promising to accept their children as well. He met these women on Facebook, gaining their trust before taking large sums of money. It was an alert investor, Satyanand Gaitonde, who tipped off the authorities. Suryawanshi duped him and his family out of about Rs 60-70 lakh. Gaitonde, who was based in Dahisar, Mumbai, met Suryawanshi in 2013 on a film set, and was later contacted on Facebook and WhatsApp. He put his trust in Suryawanshi, who persuaded him to invest in a gold business he claimed to have set up. Between 2018 and 2019, Gaitonde invested Rs 15.62 lakh, with his family members contributing as well. Upon realizing he had been scammed, Gaitonde unsuccessfully tried contacting Suryawanshi and eventually filed a police report. Gaitonde is calling for strict legal action against Suryawanshi and encourages other victims to come forward so that such frauds don't continue. for 10 seconds
A 28-year-old woman from Baner, Pune, handed over Rs 42.80 lakh to the fraudster in January 2018. However, he returned only Rs 17.59 lakh, and after July 2018, he stopped making any repayments. He later fled to Dubai and, after spending three years there, arrived in Goa on March 6 this year. Upon arrival at Goa Airport, the police arrested him and subsequently transferred him to the Mumbai police for further investigation.
A farmer from Dhule also fell prey to his deceit. The suspect duped the farmer of five tolas of gold by promising double profits on the investment. The farmer explained that Mukesh and his family had a high-profile image and lived an extravagant lifestyle, which easily won over the trust of many. Initially, the fraudster made assured repayments for three months, but then the payments ceased. In total, Suryawanshi is said to have duped around 60 farmers from Dhule, Nashik, Jalgaon, and other districts.
In addition, Suryawanshi cheated two women from Thane district. He told one woman that he could procure gold for them at a price lower than the market value. Similarly, in 2013, he convinced another woman that he would help her sell her gold at a price higher than the market rate. Both women ended up being left high and dry. Moreover, the conman also deceived several married women by falsely promising marriage and accepting them along with their children. He extracted lakhs of rupees from these women by targeting them on Facebook, particularly those from Pune and Ahmedabad.
Suryawanshi was eventually apprehended due to an alert complainant, Satyanand Gaitonde, who works as an agent with the National Security Service Canada. According to Gaitonde, Suryawanshi duped him and his family members of approximately Rs 60 lakh to Rs 70 lakh. Gaitonde, who owns a flat in the Dahisar area of Mumbai and visits the city occasionally, first met Suryawanshi in 2013 on a film set. Later, Suryawanshi contacted him through Facebook and WhatsApp, gained his confidence, and persuaded him to invest in gold by claiming he had started a company. During 2018-19, Gaitonde invested Rs 15.62 lakh, and his family also contributed. When Gaitonde realized that he had been duped, he tried to reach out to Suryawanshi, but received no response. Consequently, he lodged a complaint with the police. Gaitonde now calls for strict action against the fraudster and urges others to come forward with their complaints so that another conman like Suryawanshi does not emerge.

The Curious Case of the Honorable Travel Agents and the Migration Mirage: A Tragicomedy from Punjab
Once upon a time, in the land of five rivers, where dreams of foreign lands flourish like the crops in its fertile fields, the Punjab Government (Akali Dal Badal) decided to sprinkle a bit of regulatory magic dust over the profession of travel agents. With a wave of their legislative wand, they declared, “Let there be order!” And thus, the travel agents were ushered under the watchful eyes of the…

˖⁺. ﹙ the mastermind investigator grim reaper. ﹚: rishen herrera 9819.𖹭
. . . catch me if you can !! 🍒 : “ my - what is with that face? flustered? oh darling, whose fault might that be? ”
꒰ verse ꒱ 9819
꒰ species ꒱ grim reaper
꒰ ethnicity ꒱ mexican-indian
꒰ age ꒱ 34
꒰ gender ꒱ genderfluid, amab
꒰ mbti ꒱ estj
꒰ alias ꒱ scarlet stare, scarlet regard ( ?? alessio ), detective herrera, professor herrera, the scarlet reaper, reaper fraud ( mocking ), basic riddle ( muchen ), mother's boy ( muchen )
꒰ story ꒱ everyone knows him by that grin. that effortless charm and cocky attitude that sends most criminals into a spiral.
world renowned investigator and exceptional strategist. professor herrera - or as many know him by: the scarlet stare. a man of many talents and great intellect. one of the sharpest mind’s that the city has ever seen. what with his sharp eye and the frightening accuracy in each case he is put on. responsible for catching some of the most wanted.
yet despite this cunning, strategic mind. a bite for danger is most prevalent. looking. searching for a time in which he may be wrong. challenging himself and those around him to try and go against him. get him to make a mistake. quite the tie to his recklessness and need to solve a case by any means necessary. whether that be not playing by the law or tittering the lines of criminals.
although a human is what he would prefer to call himself - a grim reaper is what he actually is. something he’d rather hide away — despite being exceptional in that as well.
he would much rather spend his time solving cases than reaping souls in any case. it’s what he was born for.
꒰ appearance ꒱
rishen has a pair of maroon eyes, with pupils that constrict into slits during moments of intense emotions, along with this, he has slitted irises, that give him an even more ethereal look than he already had.
has medium-length, fluffy and curly dark brown hair that extend halfway down his neck and tickles at his face with small almost heart-shaped curls at times.
gorgeous bronze skin, littered with beauty spots on the left side of his face and along his forearms, sometimes, when you look long enough, the spots look like their own constellations
a very androgynous face that leans more towards feminine features, one genuienly cannot tell whether he is male or woman or something in between.
has rows of sharp, pearly white teeth that often do not get shown because he prefers to smile and not grin.
stands at a height of 5'8” with a a lean body type
long white talons that many reapers stare at in envy because he has an easier time actually painting them with brighter colours.
across his body, small ruby spots freckle his skin, specificaly his arms & around his pelvic area. while on his back, he has a small rose-quartz at the base of his spine, that shines beautifully when in sunlight.
right in the centre of his forehead, he sometimes dorns a small, tear-drop shaped ruby.
Sticking out his tongue, you can see the gold midline tongue piecing
he has a gold labret piercing ( it’s rather thin )
has standard lobe piercings in both ears, sharing space with some lovely gold helix piercings
often wears gold bangles, ones that shine beautifully and are vibrant in red and pink hues
rocks the red old money aesthetic
carries around pocket watches that he uses as his tracking devices. by an entire turn of one of the clock arms, he can turn the clock frame into a tracking device to see where his enemies are
꒰ personality ꒱
confident. quite confident. this can very quickly bleed into cockiness. he is very self-assured and well aware of his skillset. he also plays the cocky part because it gets the right people annoyed.
beyond charismatic. another skill that utilizes. this also ties in well with his charming antics. he knows when to use them and might sometimes be a bit of a flirt - he does so in a serene fashion.
incredibly intelligent. this ties in very well with his strategic mind.
brilliant. he is incredibly mentally keen and alert. you should be careful about what you say or do around him - he might be able to utilize it if may be.
a bit reckless. if there is something that needs to be done to solve a case - best believe he’ll look into it. even it means getting himself a bit hurt in the process.
loves entertaining the idea of him being potentially wrong. tittering the lines of danger and life-threatening. risking it all if it means putting his mind to the test and challenging himself. gets a rush for danger. ties in quite well with the point above
very provocative. perhaps a bit too much at times. a part of him enjoys ticking people off because he gets to see their true selves in the mix. which could aid some of his cases.
can be quite stubborn. if he sets his mind to something he is going to do it - which can be quite the fault
not one to get angry but does appreciate the audacity of those that try to do so. as stated, he absolutely loves a challenge.
ignores his grim reaper heritage for the most part. one of the only ways to actually anger him is bringing it up.
can be a bit impulsive. as calculated as he is - if he is in the heart of a situation and his mind tells him to do something. he’ll do it.
can be a bit deceitful too. secretive. it is something that he is working on.
very high perfectionism. this ties in with being very methodical and organised.
at the heart of everything. he is someone that is compassionate and wants to do good. he has a sense of justice that he wishes to fulfill.
꒰ with a lover ꒱
rishen can be quite playful and adores teasing you — however the bastard is so calm and serene about it! you couldn’t even fault him for doing it because he would convince you he isn’t teasing you at all! all to see you pout and flustered
very physically and verbally affectionate, they are two of his main love languages and he loves it just as much when it is reciprocated. through one or the other.
like most reapers, rishen shows his love through biting you. whether it be small nips of leaving marks, sometimes he draws a bit of blood too. . . he’s forgets how hard he sometimes can bite.
oh he knows he sometimes ends up being really busy. . . and he will always gets nervous that you might not understand. so if there has been a long time of no contact - he’ll always bring you flowers or treats, even if all is alright
a thing that comforts him a lot is to put his head on your chest or lap, listening to your heartbeat or simply resting on the plush of your thighs brings him at ease and makes him feel safe.
likes letting you sit in his lap or sitting himself in your lap whilst he’s doing work. it’s a way he can be near you while he’s busy
his scythe is constantly trying to talk to you. . . unfortunately he doesn’t pay it too much mind and often ignores the fact that it exists in the first place.
has given you one of his weiqi ( go ) pieces to summon him by. Sentimental pieces belonging to reapers given to the ones they love by them, can summon them if one should need ( only if you are in danger. )
really loves matching jewellery with you, wearing matching earrings and necklaces along with bracelets and rings
has a thing for putting his hands on your waist or between your thighs, both to feel the warmth ( or cold ) and to watch you squirm when he does.
rishen is very protective of you even if he doesn’t show it in the traditional sense - he knows many people are out for his head. and so this might also transcend into him being clingy to keep you safe.
he has a love for playing board games or card games with you, and sometimes, if you give him eyes enough, will let you have a bit of a lead. though expect him to win nontheless. bastard and his charming grin
has your name engraved into one of his pens and uses it when he is out writing on cases, interviewing people or investigating.
takes you out for cafe dates and art gallery dates and loves watching the way your eyes fill with life and happiness.
꒰ strengths ꒱
sharp intelligence: he is exceptionally intelligent and strategic. he is considered to be one of his city’s greatest minds.
deception: he is great at masking and keeping secrets. he is able to put on different personas to suit certain situations.
soul-reaping: rishen has the ability to reap more than 200 souls and carry them on his scythe until he can send them away to the afterlife. unfortunately he doesn’t really use the scythe much.
vapour teleportation: can shift his physical form into a dark vapour and can move at high speeds towards a different location.
dark vapor production: produces a dark vapour from his back and shoulders that can blind and disorientate enemies greatly.
hallucinative vapor production: similar to his dark vapour, however causes those that breathe it in to hallucinate; often multiple versions of him.
can see souls/ghosts: as a reaper rishen has the ability to see ghosts, spirits, wraiths, etc. along with the souls of both living and dead.
꒰ weaknesses ꒱
heart condition: he has a rare heart condition which results in him experiencing heart attacks when overwhelmed or panicked.
dislike of lineage: he does not like being a reaper. this can often be used against him
daylight: as a nocturnal reaper, daylight and other bright sources of light can weaken his senses of sight as he is used to the darkness of the night.
d’akar: an anti-magic material that can greatly weaken him if he comes into contact with it.
extreme emotional attachment: while reapers may remind one of humans, they are not. they are beings with very empathetic instincts and have souls bigger than the average mortal being — a thing that has been with them since their creation. they become extremely attached to things they love and it may cause them to become erratic if enough they love is taken away from them.
fading: occurs when a reaper goes through immense hurt and pain. their physical form quite literally begins to disappear, making them appear transparent. it can be a very painful process, both emotionally and physically. until their physical form eventually fades away and their soul moves on to the afterlife
꒰ relationships ꒱
zhào jìngyí: boyfriend, best friend, childhood friend
zhào mèng yáo: guardian figure, teacher, good terms
zhào mùchén: guardian figure, teacher, bad terms

he is both an investigator and profiler with experience in combative field
he is very good at strategy board games such as chess and weiqi ( go ), he often has individual games
he is allergic to cinnamon
he speaks hindi, spanish ( latin american ), chinese ( mandarin ) and knows asl
his scythe is named the scarlet strike ( or cherry, to jìngyí ), rishen however does not talk to it as much as it talks to him
he is a big appreciator of art and often likes analyzing art pieces. you can sometimes find him in art galleries during his days off
at times he wakes up early in the morning to bake. Often out of frustration at lack of sleep or because he finds himself stressed and restless due to upcoming or ongoing cases.

Air's End-of-Year Youtube Video Rec-List Round-Up
In light of recent events and also because I wanted to, I have put together a rec list of various (mostly longform) videos that I've enjoyed this year. Not all of these videos were released this year, however-- I just happened to see them for the first time in 2023. For readability and quality of life purposes, I have put this list under a readmore and divided the videos up by category, then creator, which means that some youtube channels might appear in multiple categories
I reserve the right to edit this later as I remember more videos, but I feel comfortable publishing it as is, considering it has almost 100 videos on it at this point

Rules of engagement:
Every once in awhile I will get an anonymous ask in my messages along the lines of: "Don't reblog from this person because of x, y, z problematic behavior, prejudice, they're a pretendian, etc."
Because of the limitations of Tumblr I understand that you are unable to post evidence/receipts in asks and the onus is on me to do the work to find out about it. And I will. This is all I ask of you if you wish to bring this to my attention:
Do not post it anonymously. I have no idea who is sending this information to me, who you are, if you're part of the community or outside of the community, if you're an ally or if your intentions are malicious, etc. Indian Country is small and we all kind of know each other to some extent. If I know who you are, what you post, what your intentions are, what your impact is, I am more willing to believe YOU and trust YOUR judgment than I am when it comes to a random anonymous message that could've been sent by anybody. I will not post your message. I will not front you off. I will not paint a target on your back.
If I reblog something from a problematic person but it's an on issue or a stance that I personally agree with separate from who they are? ESPECIALLY if they have a big platform? Chew the meat, spit out the bones. It's honestly the only way to interact with anybody with a big platform whether it's an activist or a celebrity. The American Indian Movement rose a lot of awareness on Native issues while simultaneously treating Native women and girls like garbage (and in one specific case, murdering one). Both should absolutely be discussed because both are relevant and both are important. I cannot talk about one and not the other. I am okay with my relationship to these topics and positions changing and shifting based on new information.
If I reblog a gifset from a problematic person honestly, just ask yourself why I'm reblogging it. Is it because I like that specific person or is it because I like the character in the gifset? Do I reblog this person frequently or do I reblog posts about the character or the show frequently? This is the only benefit of the doubt I want from you. I trust patterns of behavior and can hold myself accountable for them.
Know this first and foremost: I am here for Indigenous people before anybody else. I want to know who the abusers or the frauds or the predators are for the sake of everyone in our communities. Trust is earned and everyone should be careful and picky with who they decide to trust. I need to know who I can trust if you bring these allegations and information to me.
If you have any questions or need anything clarified please let me know.

Fake Indian art still a major problem despite federal responsibilities
Criminal pleas surface amid vague ‘Indigenous’ claims Tuesday, March 14, 2023 By Acee Agoyo, Indianz.Com
Efforts to strengthen the Indian Arts and Crafts Act are gaining new steam as government authorities try to enforce a law aimed at addressing fraud and exploitation of Native cultures and ways of life. On Monday, the Democratic chairman of the Senate Committee on Indian Affairs unveiled a discussion draft bill called the Amendments to Respect Traditional Indigenous Skill and Talent Act of 2023. Also known as the ARTIST Act [PDF], the proposed legislation seeks to protect the arts, crafts, goods and other creative works that American Indian, Alaska Native and Native Hawaiian people have produced since time immemorial.
“The ARTIST Act would update the Indian Arts and Crafts Act to support creative economies and strengthen enforcement of current law and protections against counterfeit competition for Native artists and their works,” the committee said in a news release on behalf of Sen. Brian Schatz (D-Hawaii), the chair of the legislative panel. “This discussion draft reflects direct stakeholder input as well as years of committee oversight and broad commitment to the protection of Native cultural patrimony and revitalization of Indigenous languages,” the release continued.
As enacted in 1990, the Indian Arts and Crafts Act makes it a crime to market, sell or promote an item as “Indian” unless it was created by a citizen of a state or federally recognized tribe or by an artisan certified by a tribe. The law was written to prevent the historical and ongoing misrepresentation of Native arts by non-Native entities. Yet Native artists and their advocates have long complained about the lack of enforcement as fakes and frauds have continued to flood the market and undermine an important source of income in Native communities across the United States.
It’s an issue that Secretary Deb Haaland, who is the first Native person to lead the Department of the Interior, has recognized as a major problem. “Native art is a critical part in telling the story of this country and can only be told by Native artists,” Haaland said in a video message after making history as the first Native person in a presidential cabinet. “Buying authentic pottery, jewelry, mixed-media creations, paintings and other art from Native American artists helps support tribal economies.” “Unfortunately forgery and copies hinder the positive economic opportunities available to Native artists and their families,” said Haaland, who is a citizen of the Pueblo of Laguna.
youtube
The law was updated in 2000 and in 2010 to strengthen enforcement. But as fraudulent works continue to be sold in some of the largest art markets in the U.S., the ARTIST Act builds on prior efforts by broadly expanding the ways in which federal officers can investigate suspected violations. Federal officers, for instance, would be authorized to make arrests, engage in searches and even conduct seizures for suspected violations of the Indian Arts and Crafts Act.
They would also be able to inspect shipments coming into the U.S. to ensure compliance with the law, according to provisions of the draft. And for the first time, Native Hawaiians would gain protections for their creative works. The ARTIST Act modifies existing definitions in federal law to ensure that the original inhabitants of Hawaii aren’t left out of enforcement efforts that are available to American Indian and Alaska Native artisans.
To help pay for these enforcement measures, the ARTIST Act authorizes ways in which people suspected of violating the law can have their property forfeited and be required to shoulder the costs of investigations through fines and penalties. A new Indian Arts and Crafts Forfeiture Fund would be established to assist the work of the Department of the Interior.
The draft discussion bill also requires visible and permanent labeling of items that come into the U.S. from Canada or Mexico. Anything that could “possibly be mistaken for, arts and crafts made by Native Americans” must be “indelibly marked with the country of origin,” according to provisions of the the ARTIST Act.
Finally, the ARTIST Act would require trainings of federal law enforcement officers, not only on the Indian Arts and Crafts Act but on the recently-enacted Safeguard Tribal Objects of Patrimony Act, also known as the STOP Act. The latter law makes it a crime to export tribal cultural property, another issue that has threatened Native cultures and ways of life. “For too long, the export and sale of sacred and culturally significant items from Native peoples in Hawaiʻi, Alaska, and across Indian Country has deprived these communities of their own history and heritage,” Schatz said after the measure was passed and signed into law during the prior session of Congress. “Our bill will help stop the black market trafficking of these items and bring them home.”
Just this month alone, federal authorities announced the resolution of three cases in which the Indian Arts and Crafts Act was violated. In all three instances, non-Natives created and sold fraudulent art by misrepresenting, falsifying and lying about their non-existent tribal backgrounds. In Washington, 52-year-old Lewis Anthony Rath and 67-year-old Jerry Chris Van Dyke, also known as Jerry Witten, pleaded guilty on March 1 to breaking the law.
Both men admitted that they sold fake “Indian” goods in the historic Pike Place Market in Seattle, one of the most heavily trafficked tourist areas in the city. “When non-Native artists falsely claim Indian heritage, they can take sales away from true Indian artists working to support themselves with skills and techniques handed down for generations,” Nick Brown, the U.S. Attorney for the Western District of Washington, said in a news release. “Stores and galleries need to partner with artists to ensure those artisans and craftsmen advertised as Indian Artists truly have tribal status,” Brown added, offering advice to businesses to ensure they comply with the law.
Rath falsely claimed to belong to the San Carlos Apache Tribe — while producing items that mimicked the Pacific Northwest tribal cultures that are hundreds of miles from his supposed Native homeland in Arizona. According to federal authorities, the goods were sold at the Raven’s Nest Treasure and the Ye Olde Curiosity Shop, both of which represented to customers that Rath was Native. And when agents from the U.S. Fish and Wildlife Service, which is part of the Department of the Interior, searched Rath’s home and studio, they found feathers from protected birds — including ones from golden eagles. He pleaded guilty to unlawful possession of these items in addition to violating the Indian Arts and Crafts Act.
Meanwhile, Van Dyke falsely claimed to be from the Nez Perce Tribe and was selling goods that he claimed were of Alaska Native origin — again far away from his supposed tribal background in Idaho. According to federal authorities, he produced the items using materials that were supplied to him by the non-Native owner of a gallery in Pike Place.
“Van Dyke had worked with the gallery for more than ten years, with the gallery owner providing him with woolly mammoth ivory, antlers, animal bones and fossilized walrus ivory to make the pendants that it sold,” the U.S. Attorney’s Office for the Western District of Washington said in the March 1 news release. A day later in Texas, the U.S. Attorney for the Western District announced the sentencing of Kevin Charles Kowalis, 60, for violating the law. According to federal authorities, he falsely marketed and sold jewelry online that he claimed were of “Zuni” and “Navajo” origin even though he does not belong to either tribal nation.
“Fraud can come in many forms but always carries the intent to deceive a victim,” U.S. Attorney Jaime Esparza of the Western District of Texas said in a news release. “Offenders like this defendant victimize both our cherished Native American community and consumers who believe they’re collecting authentic pieces of Native American culture. We will not stand idle while someone takes advantage of our citizens and our federal resources.” Kowalis will serve five years probation for his crime and was ordered to forfeit his inventory, pay a special assessment and pay restitution to a victimized artist from the Pueblo of Zuni.
The total amount appears to be relatively low — less than $1,500, according to court records. No fines were ordered due to his “inability to pay,” the criminal judgment reads. “This sentencing is important in the fight to end this type of fraud,” said Assistant Director Edward J. Grace of the U.S Fish and Wildlife Service’s Office of Law Enforcement. “Our dedicated team of special agents works on behalf of the Department of the Interior and the Indian Arts and Crafts Board to protect American Indian and Alaska Native artists and the consumers who purchase authentic Native American art and craftwork.”
Over in Washington, Rath and Van Dyke are due to be sentenced on May 17. As part of a plea agreement, federal prosecutors said they won’t seek prison time for Van Dyke. Rath did not obtain any promises regarding sentencing in his plea agreement. A federal judge, though, will make the final determination on punishments for both individuals.
“The Indian Arts and Crafts Board (IACB) is very pleased that Jerry Chris Van Dyke and Anthony Rath have been brought to justice for their roles in selling fake Indian artwork in violation of the Indian Arts and Crafts Act,” said Director Meridith Stanton, the leader of the IACB, which is part of the Department of the Interior. “Cases like these are critical to preserving the integrity and viability of authentic Native American art and craftwork in general, as well as preserving the rich cultural heritage of the Nez Perce Tribe and the San Carlos Apache Tribe and the economic livelihoods of their artists and craftspeople,” said Stanton.
The IACB helps look into potential violations of the Indian Arts and Crafts Act, offering examples of possible wrongdoing. But the board’s website notes that items that are marketed or portrayed as “Native American style” or “Native American inspired” can be sold without violating the law — so long as there is “qualified labeling” available to the consumer.
The draft discussion of the ARTIST Act maintains the legality of these categories of “Native American-style jewelry” and “Native American-style arts and crafts” but requires that such items be “indelibly marked” or labeled in a “permanent” fashion, to ensure the consumer is aware that they are not produced by an American Indian, Alaska Native or Native Hawaiian artist.
And while the title of the ARTIST Act contains the word “Indigenous,” the proposed bill does not contain any definitions of a term that has become increasingly used by people who are creating, marketing and selling art that they claim is Native in origin.
An example just emerged in New York, where a self-described activist opened an exhibit in February that appropriates numerous elements of Native culture even after admitting to Indianz.Com that they do not belong to any tribal community. The exhibition, located at a small gallery in the Upper East Side of New York City, notably incorporates the red imagery that Native women developed and brought to prominence to raise awareness to their missing and murdered sisters and relatives. It also includes a visual representation of a Native quilted blanket — albeit with the word “PRETENDIAN” stitched into it.
The Soul of Nations Foundation has prominently marketed the installation as “Indigenous” in origin, a designation that has prompted some Native people to consider reporting it to the Indian Arts and Crafts Board for possible violations of the Indian Artist and Crafts Act. In fact, the non-profit’s executive director and founding member, Ernest Hill, contacted Indianz.Com numerous times in advance of the opening on February 24, soliciting news coverage for an individual who removed all references to their supposed tribal affiliation over a year ago.
Yet Hill, whose parents served as religious missionaries to the Navajo Nation and to other reservations, has since refused to answer questions about the exhibition — including inquiries about the artist’s supposed tribal background.
Materials that Soul of Nations produced for the installation claim it is directed to “Indian Country” but the organization has repeatedly refused to respond to inquiries about the use of the designation in connection with someone who admitted they lack ties to any tribal community. Hill and Soul of Nations also have refused to clarify the source of funding for the project.
In press materials, they proudly assert that the installation has received “support” from the Department of State. On social media, Hill and Soul of Nations gave a different story. In response to a prominent Native environmental leader who has repeatedly attempted to hold the self-described activist accountable for the false claims of tribal belonging, they claimed that “no outside funding was provided for this exhibition.”
When asked to explain the discrepancy between the press materials and the social media post regarding their claim of receiving federal support, Hill and the Soul of Nations refused to respond. The organization started blocking Native users on social media and began restricting interactions on one of its accounts after questions were raised about the installation. The Soul of Nations website, incidentally, includes a prominent reference to the “Senate Committee on Indian Affairs” on a page that has been used to solicit monetary donations. The Department of State is also listed in the same section of the site.
Since the opening of the installation last month, the self-described “Indigenous” individual has posted on social media about being on “Day 371” of a “cancel” and a ‘call out” that has purportedly kept them “jobless.” The number of days is counted from the February 25, 2022, story on Indianz.Com that reported on their their non-existent tribal affiliations. The next post on the private account was about the installation, which opened to the public a year following publication of the story. The user has since deleted hundreds of posts about their supposed tribal background from the account, whose name is a variation of an anti-LGBTQ slur.
The Senate Committee on Indian Affairs is accepting comments about the Amendments to Respect Traditional Indigenous Skill and Talent (ARTIST) Act of 2023 until April 14. Comments can be sent to [email protected].

All Eyes Lead to the Truth | Biogenesis (6x22)
In the past, Chuck Burks always got the call from Agent Mulder. His partner, ever the skeptic, had never requested his services. Chuck’s methods were, after all, a bit freaky-deeky for her. So when he heard Agent Scully’s voice on the other end of the line, full of concern for Mulder, he knew something was different.
Before, it was always about solving the case; this time, it seemed personal.
“So, uh, what exactly are you experiencing?” he asked Mulder, who was a little caught off-guard seeing Chuck and Scully discussing the artifact they’d discovered, but happy to see him nonetheless.
“Noise, aural dissonance,” Mulder replied, indicating his head. “It comes and it goes.”
“Is it happening right now?” Scully asked.
“No, but it was a few minutes ago.”
“And it's only affecting you? Triggered by the rubbing?” Chuck asked. Mulder nodded. “Wow. That blows me away.”
“Why?”
“Because the rubbing is a fake,” Agent Scully piped up. “And I'm not the first one to say so.”
It was true; Chuck’s findings did, for once, support her down-to-earth read on the situation. But as usual, with the X-Files, there was always more to the story. Chuck explained to Mulder everything he and Scully had found, including the fact that their suspect, Dr. Barnes, had a particular interest in debunking artifacts exactly like the one that was affecting him.
“Barnes has made something of a career exposing science and religious fraud,” Chuck told them. “Name your wonder of the world. He's been there, debunked that.”
Mulder wasn’t convinced.“Yeah, but wouldn't it be in his great interest to hide something that he couldn't disprove?”
“Mulder, if it were real, why would an American Indian artifact be fused in rock on the west coast of Africa?” Scully interjected.
“In 1996, a rock from Mars was found in Antarctica. How did it get there?”
Scully gaped at him. “It was from outer space.”
Mulder threw up his hands. Exactly! He tossed a triumphant grin at Chuck, who put up the image of the artifact on the overhead projector one more time. As he did, however, Mulder doubled over in pain.
Chuck was absolutely stunned. He was witnessing its power in real time and he was fascinated.
Agent Scully gently ushered Mulder outside the room, her voice laden with concern. Chuck considered following to see if he could help, but decided against it; it seemed rather clear Scully had it under control, and even if she didn’t, it was even clearer she wanted to be alone with him.
Chuck had only met Agent Scully a couple of times, and despite her repeated blunt shutdowns of his and Mulder’s wild theories, he liked her. And he could see why Mulder liked her, too. She was a tough cookie, and just as passionate about science as he was. There was a reason she’d stuck by his side for so many years, though, and as he watched them conversing intimately in the hallway, he couldn’t help but wonder if that reason was a bit personal, as well.
After a minute or so, they came back into his office. Mulder got right to the point. “Hey Chuck, have you ever seen anything in your work regarding… well, mind-reading?”
Scully let out a loud, exasperated sigh, touching her hand to her forehead.
“I’ve never seen it demonstrated,” Chuck replied. Was Mulder suggesting….?
“Let’s just do this. Pick a number between one and a hundred.”
Scully appeared to have had enough. “Mulder, this is ridiculous. We need to get you to the hospital.”
“Just wait a minute,” Mulder said to her. He turned back to Chuck. “Pick one.”
Chuck was game. He thought hard. Nineteen. Nineteen.
“Nineteen,” Mulder responded immediately. “Was that it?”
Chuck could barely speak, he was so shocked. “Incredible!”
Scully furrowed her brow. “Enough,” she said. “Mulder, if you want to play fortune teller games later, I’ll be all ears. After you get examined.”
He turned to her. “Scully, I know Barnes killed Merkmallen, and he framed Dr. Sandoz. I can prove it to you because I heard it in his head, back at the lab. He hid the body at Sandoz’s place. Before I do anything else, we have to find it.”
Scully regarded her partner, and Chuck watched an entire story cross her face. Frustration at his stubbornness, but a similar desire to solve the case. Above all, he could see how worried she was about him. But if she knew Mulder the way he did —and he suspected that to be true— the resignation he now saw in her expression indicated that she knew arguing was futile. Mulder on a mission was as unstoppable as a freight train.
Mulder didn’t look away from her for a single second as they engaged in what Chuck could only describe as an entire conversation using only their eyes. It was almost more fascinating than the mind-reading, the way they operated.
“Okay,” she said finally. “We’ll check it out. Then home to bed, Mulder. I mean it.”
He gave her a smirk. “Understood, Doc.”
They looked at each other for another moment, and although Chuck’s forte was graphics analysis, he needed no expertise (or mind-reading abilities) to analyze the heat drifting between these two.
“Thanks, Chuck,” Mulder said, shaking his hand. “Until next time.”
Chuck observed their body language, the way Scully was watching him closely, the gentle hand Mulder laid at the small of her back as he led her towards the door. There was something different about them, and he dared not speculate how their relationship had evolved since he’d last seen them, but they’d come a long way, that was for sure.
Chuck took one last look at the garbled Navajo on the screen, then shut off the projector, following them out and closing the door behind him.
He wondered how much further they’d go before he saw them next.

Finding: Lackluster Oversight Resulted in Transnational Criminal Organizations and Fraudsters Stealing U.S. Taxpayer Money from Pandemic Relief Funds
International criminal organizations and foreign government-affiliated actors exploited the urgency of relief programs and orchestrated sophisticated fraud schemes that span multiple countries.
Chinese government-linked hackers stole at least $20 million in U.S. Government COVID-19 relief funds
An USSS investigation revealed that hackers affiliated with the Chinese government, specifically identified as APT41, were implicated in theft of $20 million of U.S. Government COVID-19 relief funds
APT41 has a history of fraudulent activity in the past, specifically traditional unemployment insurance fraud against SBA across dozens of states
APT41 also has a history of espionage activities on behalf of the Chinese government, including attacks on pro-democracy politicians in Hong Kong and data breaches affecting more than 100 organizations
A Nigerian fraud ring stole $10 million in pandemic relief funds
Mr. Abemdemi Rufai, a Nigerian government official, organized a large-scale cyberfraud scheme—named Scattered Canary—targeting COVID-19 relief funds
Scattered Canary, a business email compromise operation, filed at least 174 fraudulent unemployment claims in Washington state and 17 in Massachusetts that were all accepted, all with an expected payout of $5.4 million
An Indian national stole $8 million in a COVID-19 relief fraud scheme
A federal grand jury in Newark, New Jersey indicted an Indian national for submitting fraudulent PPP loan applications totaling more than $8.2 million
The defendant submitted at least 17 applications on behalf non-existent companies, using false information about employees and payroll
He also fabricated tax filings on behalf of a non-existent business to receive more relief payments
He reportedly received $3.3 million in loan proceeds which he then laundered
Domestic and International Fraudsters that Stole from Pandemic Relief Programs were also Connected to Other Organized Crimes
Fraudsters involved with stealing millions of dollars were also involved in other federal crimes including wire fraud and drug smuggling
DOL IG has continued to connect abuse of UI relief funds to organized criminal groups
The National UI Fraud Task Force was created to combat fraud of UI perpetrated by domestic and international criminal organizations, many of which include street-level criminal organizations with ties to illegal guns and drugs
The U.S. Attorney's Office charged six individuals, including two Maryland State Department of Labor subcontractors, with participating in a conspiracy to fraudulently obtain $3.5 million in UI benefits
The lead defendant now faces separate narcotics and firearms charges, including allegations that he unlawfully possessed a machine gun in furtherance of a drug trafficking crime
Another convicted felon charged with CARES Act fraud also committed firearm offenses and possession with the intent to distribute fentanyl
The U.S. Attorney's Office for the District of Maryland targeted cases with connections between COVID-19 fraud and individuals involved with violent crime, organized criminal networks, business email compromise schemes, and narcotics distribution
