The countdown begins 
day 225:   Day 1 . Already begun to find ways to repair this busted heart.  Counting up to day 10 so I’m able to remind self “in life, wake up & do it all over again.”  There shouldn’t be so many days one must press in.  THEIR linear order I flip, and logic that destroyed all of it, by ALLOWING ME ONCE TO rearrange & redeposit all of it.  Just to see what happens?  
Colors fade to grey.  The only shade \ What rolls into folds of digital sheets \ The blinking light at 4AM is pretty neat \ Wondering where everyone’s attention’s been?  After we’ve made up ways to lose hope in a maze, calling it a failed “connection,” these subtle misdirections explain the necessity of experience in all its various reflections.  It’s felt.  So deal with the hand your dealt.  How to balance between the two?  Between something very bad & something you must trust so you don’t think, just do?  Impossible or wait, just hard to say | No boo-hoo, Somehow, Someday. No, someday, somehow & this is where I press in now...all my creative arts dispersed so just jump on every chance, never a need to rehearse, LIVE streaming is how ptsd memories WORK.

A new way to see old things 
a past picture to remind me while standing and waiting in line, all the problems with being in a market--where to start??  All the sensory & stimulus!!  So find a strategy:  trace the white lines.  Closing eyes, standing still, not having an outlet to move & head dizziness appears, oh shit, that feeling, gotta get out of here.  Hunched over & people look & you & react like, “What’s wrong with you!?”
Fell & no one helped, it was like that denial of safety thing--how many years doesn’t matter when PTSD places you right back in the feeling!  Of being left to die alone.  That connects to TRAUMA & the feeling of having to always roam...homelessness, mental illness, the things that EXIST but we can change all this!  Just because I QUESTION I’m treated like it’s okay to so easily dismiss...
Seeing visual lines & having control of what I’M LOOKING AT dampened the dizziness & allowed me to have MORE ABILITY TO MOVE head & “release”/increase ROM/move more & create TRUST of my body that this pain is going to be less.  Keep pushing... these were the private, quiet movements that made it SAFE to be on a mobile again, so no one is paying attention to you as you’re tracing lines to make the MOST SUBTLE HEAD MOVEMENTS you’ll never see

These lines while waiting in line reveal how my eyes track until I see something that’s going to diminish the dizziness, it makes sense you have to safely get to where you’re going (yes, I said this!) 
The secret to life is to stop talking & get to showing.
Decided today March 22, 2018 | ...trigger is the guide & why I know the difference between “hide & hide”... | what was happening in 2000, one, five | Now can say IT without triggering which was the hope in order to start truly living since I’ve been asked a specific line of questioning about violence to the body & what have I been doing?
Documenting these PTSD memories & now I’m going to put them in the places they belong
Literally, they will just pop up where I drop kick them to the sky & wherever they fall, they fall
I just get out of the way, which is what I’ve able to do.  That’s my level.  Don’t make fun & put me down.  It’s different after head trauma & repeated acts of stigma that seriously related to greed & ignorance & individuals who have zero empathy & use cruelty to “get what they want” : it’s not that hard : there’s really evil people  the world. 
Correction today, March 23, 2018 | time does not make sense | What I’m going do do is what I’m going to do tomorrow since that is the one-two punch combo that I’ve been practicing.  Jab & upper cut. That’s it, one-two, one-two over & over until my muscles memory takes.  My body doesn’t work the same way.  Until my fingertips stop being so sensitive so I can recall passwords from a pattern.  
How do I know things are different?  
MANY things that FEEL differently.  I can describe them all instead of using one word for anything.  It’s “good,” “fine” & “over” but it’s not so “fuck off” and let me realize that the words I’m learning now create IMPACT in my body so honesty & dishonesty are felt really strongly.  Is that being bi-polar or having a body that doesn’t lie.  What feels good feels really good.  What is the worst, having to relive being physically battered and mentally pummeled by being lied to about safety that has my nerve on fire.  So hose it down, but wait, every day, every thing triggers having been my profession, my education & my identity as an authority in behavior since I was telling the grown-ups to do smelting about self-harming children who were curious about violence.  It was reported, over 100 acts of violence & yet nothing happened.  So my nightmares are having to relive violence unto children & then I realize it’s not just children, the ones who require the most care becuase they are the least likely to achieve those independent self-regulation skills that means they will have control & that means less behavioral issues & less stigma & less judgement & cruelty.

The goal was achieved this month so it just took a while.  I’m not on anyone’s time schedule & that is the luxury of saving your pennies for a rainy 5-years.  What you build you get to keep.  I build a way to walls self-educate after tragedy since we’re learning every day.  HOW DID I FORGET THAT?
Just had to get stronger, physically & now that I am, my neck MOVES UP/DOWN & side-to-side, so I’ve regrouped in “safe spaces” with my family & even if they don’t realize their importance to someone who has been physically & mentally assaulted, it’s having nearness even though you don’t want to be touched in any way.  Once violence is done to you, it’s in the BODY & the only way to remove this nastiness is to get dirty with truth.

Please think about what your truth is?  Even what it means to be asked ‘what is your truth’ and with anything please share as little or as much as you’d like.  Every time you choose to put out something good back & if you use energy for hate, just be warned, I think there’s more good people than evil.

TODAY YOU STATE WHAT IS THE MOST FEARFUL THING FOR SOMEONE TO KNOW because the next question is WHY DO YOU HAVE THAT FEAR
To explain that is why your mind jumbles it off.  It’s helping you.  How do I know?  Been through this before, but didn’t know what it was.  See, it happened before & in adolescence, so that’s being IGNORANT
1st truth : I have nerve damage that affects sensations in my body that I manage through voice, movement, stretching & doing more rigorous activities like biking with strict rules for safety.  I will ride on the sidewalk, no ifs, ands or buts.  My body dictates my behavior much of the time but through help from my friends who remind me my body can’t always be in-control, I’ve learned to better manage nerve pain that makes you antsy since nerves like to glide.

2nd truth :  What to do what to do what to do what to do what to do what to do?!?!?
To explain how physical trauma FEELS means to go through it real time and reveal how I make no decisions because whatever I choose is going to have a consequence.  Demands for safety went unnoticed & then felt out ignored, the time wasted for the outcome, additional denial of safety and a physical disability that has literally changed my life, forcing me into a life of advocacy since as a former teacher IF YOU LEARN SOMETHING that can help others & a firm believer that charity is the only decent human-quality that clearly defines someone’s soul, since I learned something NEW I have to share & that has been what my time & energy has been spent on.  Trying to get strong to share...their shhhame...

trudging through snow, I just want to sweat not realizing that was what I needed but now, every time I hope for that & it happens 1/5.  It’s never known when I will sweat, the physical exertion not the indicator of effort since I could be sitting & typing & break into one, often my palms which makes me pretty happy since it’s reminding me my body is still trying to do what it used to without so much drama!  The sweat tells me to continue going to places.  Curiosity is the desire to want to see “new” things or be in “new” spaces, the problem with assault is it makes your world very small.  You don’t feel that subtle push&pull when stuck in the same space, just focusing on not triggering which is impossible so wasted a lot of time.  I should’ve been allowing the triggers out from the beginning but who thinks to do that?  It hurts so much & why you do CALL the people that have hurt you.  You do TEXT the person when it’s SAFE to contact since tech allows that filter & the survivor/victim gets the right to CALL THEM OUT 100% when the recognition of SHAME is PRESENT.  I spent so much time rejecting this amount of shame that I needed to sit with (years) just to be able to say, there is NO WAY I will be used as a punching bag in a space that MUST PROTECT ITS STUDENTS & EMPLOYEES.  That’s it.  It was not done & instead I witnessed how people effectively use emotion & denial to keep doing what they claim they’re not doing : adding to the problem.  This environment of fear that is stifling and mimics the life I was entering that was mostly imagery & jokes about a topic that I’ve grown to realize is often the motivator for anything in this world & how gross it is when people succumb to their greed & insecurities.  Fear wins when you stop GOING & DOING and these were the areas in life that I cherish most of all.  That’s freedom, to go & to do.  Everyone should have the opportunity to experience life in other times & places, transported through books, travel, culture, cuisine, we all have the potential to lead the lives we’re meant to if we’re able to innovate, imagine & create.  I’ve seen a sunrise over a different body of water my entire life, a tradition I’ve maintained when I travel & lately have incorporated in my hometown to make sure I always remember the significance of one’s birthday.  A special time that has to be felt post-tragedy since it will be different & this is what I’m trying to understand since this is what I lost--the ability to transition--so when I recall a rare view from a treehouse, the ability to return to that scene because every step to get there was felt in my body--the combination of self-awareness & nerve damage make me needy for sensation, but what I really want is one good sweat

3rd truth : every day is a reDO until I get sequencing, so one, two, three instead of “in the moment” the numbers represent a safe place to put a thought since everything is triggering after 12 years of education in a profession I took very seriously when violence was an every day thing & even before then as I found my students weren’t being taught : just accept there will be more DAY ONEs than any other number but once I get started & find that rhythm, it will be a flawless system as it was before.  Flawless because the thought & decision matches the outcomes since I make good choices that don’t hurt others needlessly
DAY 1 : Noting some changes in colors.  Eyes are fuzzy, blurry & not registering RED & GREEN.  Just read the word.  I see the D & A & I know that’s DECLINE & ACCEPT but why is not the same. TO DO  Make appointment with eye specialist & provide notes of what is happening.  Panic level : get information first & do everything that’s necessary to control symptoms.  Conclusion, could be side effect of Rx so get off Rx as soon as possible since responsible for lost 26 pounds & inability to sleep, concentrate, that buzzing in my brain, is seriously, the use of narcotics when the message has always been the same.  It’s the physical pain I’m trying to manage & in the meantime fight for my right to identify what is wrong in HEALTH CARE, since if when you lack KNOWLEDGE & SKILL, & EXPERTISE & EMPATHY, you simply can do real everlasting damage...

Business Visitor Visa UK
The UK business visitor visa is generally preferred by business travelling employees and their employers since the application process is typically less onerous than other work visa routes.
However, the rules on permissible activities under this visa are restrictive, and border officials have powers to question individuals travelling to the UK under the business visitor visa. If not satisfied that the visa conditions will be adhered to, they have powers to deny entry.
The end of EU free movement from 1 January 2021 also means more individuals will become subject to UK immigration control. EU nationals who are not UK residents will require appropriate permission to enter the UK before they travel.
We are regularly asked by HR teams to help where an employee, relying on a business visitor visa, has been detained at the border and refused entry into the country. This is an unwanted experience for the employee, and places considerable pressure on the HR team to resolve quickly.
But border issues can be avoided if the employee’s immigration options are considered before they travel and specifically, where it’s clarified whether the traveller will be deemed eligible for a business visitor visa UK.
  What is the business visitor visa?
The business visitor visa is now known as a ‘Standard Visitor Visa’.
You can apply if you want to visit the UK for business-related activities for a short period of time. Visitor visas are usually granted to allow business travellers to stay for up to six months.
  What activities are permitted for business visitors?
In particular, general business activities can include:
To attend meetings, conferences, seminars or interviews
Give a one-off or short series of talks provided these are not organised as commercial events and will not make a profit for the organiser
Negotiate and sign deals and contracts
Attend trade fairs, for promotional work only, provided the visitor is not directly selling
Carry out site visits and inspections
Gather information for their employment overseas
Be briefed on the requirements of a UK based customer, provided any work for the customer is done outside of the UK.
    Employees of an overseas-based company are also permitted to undertake the following corporate or intra-corporate activities:
Advise, consult, trouble-shoot or provide training
Share skills and knowledge on a specific internal project with UK employees of the same corporate group, provided no work is carried out directly with clients
Carry out regulatory or financial audits as an internal auditor at a UK branch of the same group of companies as your employer overseas.
    There are also additional sector specific activities that are permitted, including but not limited to the following:
To take part in a specific sports-related event
To perform in the UK as an artist, entertainer or musician
To undertake research as an academic or to accompany students on a study abroad programme
To undertake a clinical attachment or observer post as a doctor or dentist
To obtain funding to start, take over, join or run a business in the UK.
    What is not permitted on a Business Visitor Visa UK?
Under the Visitor Rules there are also various activities that are prohibited. In particular, unless expressly allowed by the permitted activities, you must not intend to work in the UK, which includes the following:
Taking employment in the UK
Doing work for an organisation or business in the UK
Establishing or running a business as a self-employed person
Doing a work placement or internship
Directly selling to the public
Providing goods and services
    When engaging in permitted activities, this must not amount to you taking employment, or doing work that amounts to you filling a role or providing short-term cover for a role within a UK based organisation.
In addition, where you are already paid and employed outside of the UK, you must remain so. Payment may only be allowed in specific circumstances, for example, billing a UK client for your time in the UK in circumstances where your overseas employer is contracted to provide services to a UK company and the majority of the contract work is carried out overseas.
Under a Business Visitor Visa UK, except as permitted under the Visitor Rules and where any additional requirements have been met, you must not intend to study in the UK, access medical treatment other than private medical treatment or to donate an organ, or to marry or form a civil partnership, or to give notice of this, in the UK.
  What are the eligibility criteria for a Business Visitor Visa UK?
To be eligible for a Business Visitor Visa UK you must satisfy the following eligibility criteria:
You will leave the UK at the end of your visit and within the permitted period
You have enough money without help from public funds to support and accommodate yourself
You can pay for your return or onward journey
You have proof of any business or other activities you want to do in the UK, as allowed by the Visitor Rules.
    It is inherent within these criteria that you are genuinely seeking entry for a purpose that is permitted by the visitor routes, namely business-related activities, and that you will not undertake any prohibited activities (see above).
If you are being paid by a UK company to visit as an expert in your profession, you should apply instead for a Permitted Paid Engagement visa.
  How do I apply for a Business Visitor Visa UK?
An application for a Business Visitor Visa must be made while you are outside the UK. You will need to complete an online application and pay a fee. You will also need to provide a valid travel document, supporting documentation and, where applicable, biometric information, ie; your fingerprints and a digital photo.
The earliest you can apply is three months before you travel, and you should get a decision within around three weeks – although you should check the guide processing times to find out how long getting a visa might take in the country you’re applying from.
If your application for a Business Visitor Visa is successful you can usually stay in the UK for up to six months. You might be able to stay for longer if you’re an academic on sabbatical and coming to the UK for research.
  Will a Business Visitor Visa UK guarantee entry?
The grant of a Business Visitor Visa UK will not guarantee entry to the country. It is still possible that you may be refused entry by border officials in the event that they are not satisfied that you fulfil all of the eligibility criteria, in particular where it is believed that the reason for your visit is not genuine or where the activities you plan to engage in amount to prohibited work.
You may also need to provide proof that you have access to sufficient resources to maintain and accommodate yourself adequately for the whole of your planned visit to the UK. There is no set level of funds required to show this, rather your income or savings, minus your financial commitments, must be sufficient to meet the likely costs you will incur in the UK and be reasonable expenditure in light of your financial situation.
Please note, in relation to having the necessary funds for travel, maintenance and accommodation, proof may be provided by a third party by way of a written undertaking where there is a genuine professional or personal relationship, and this support will be available for the intended duration of your stay.
  Visitor visa or paid engagement visa?
You can apply for a Permitted Paid Engagement Visa if have been invited by a UK-based organisation or client to come to the UK to do specific paid work without having to be sponsored under the points-based visa system.
To be eligible for this type of visa you must satisfy the following criteria:
You are 18 or over
You are visiting the UK for no more than 1 month
You will leave the UK at the end of your visit
You have enough money without help from public funds to support and accommodate yourself
You can pay for your return or onward journey
You are not in transit to a country outside the UK, Ireland, Isle of Man and the Channel Islands.
    Under a Permitted Paid Engagement visa you can undertake the following activities:
Be a student examiner or assessor
Take part in selection panels as a highly qualified academic if you’re invited by an education, arts or research organisation
Give lectures at a higher education institution, or arts or research organisation, as long as it’s not a part-time or full-time role
Examine UK-based pilots so they meet the standards of the country you come from if you’re invited by an approved UK training organisation regulated by the UK Civil Aviation Authority
Provide advocacy for a court or tribunal hearing, arbitration or other form of dispute resolution for legal proceedings within the UK as a qualified lawyer
Take part in arts, entertainment or sporting activities as a professional artist, entertainer, musician or sports person if you have been invited by a creative or sports organisation, agent or broadcaster based in the UK
Take part in fashion modelling assignments.
    You can also undertake minor activities related to your work or business overseas, such as attend meetings. You cannot, however, undertake specific paid work unrelated to your main job or area of expertise at home, or sell merchandise, other than what is permitted by your visa.

Making the Most of a Crisis: Agents Look to Tech to Improve
It is hard to find a silver lining in the COVID-19 tragedy, which has killed more than 100,000 Americans, impacted the economy and put the real estate sector in an anxious waiting pattern. It takes a special kind of optimism to persevere through a challenge as vast as a pandemic and national quarantine, but real estate professionals might be uniquely suited for this kind of opportunity.
After all, carrying the burden of people’s biggest transactions is all part of the job. So, when the industry slowed down for several months, all of that free time and energy more than likely was focused on a positive outcome. For many, the shutdown was a time to reset their real estate careers, assess what is working and what’s not, and get to work on getting better.
“Folks in this profession are thinking positively,” said Diane Hartley, president of The Institute for Luxury Home Marketing, an affiliate of Colibri Group which educates real estate agents working in the luxury residential market. “I was pleasantly surprised to see how many of them said, ‘I’m going to learn.'”
Hartley said her organization began offering virtual training in March shortly after the outbreak escalated, and the easy-to-access “Launch Into Learning” webinars were a big hit with agents of all experience levels. Typically offering one or two webinars per month pre-coronavirus, The Institute quickly scaled to sharing two to three per week.
Another Colibri partner, the Hondros Education Group, found an uptick in both students completing their professional and continuing education, as well as new agents completing education and entering the real estate business.
“There seems to be a pivot toward professional development. The top agents of today, who have opened up their minds to the new environment for real estate and how to successfully deliver virtual services, are launching into learning,” said Tina Lapp, president of Hondros Educational Group. “We are seeing a tremendous pull forward of progressive agents thinking ahead and utilizing this time to refine and build their skills and become proficient in areas such as commercial, luxury, property management, buyers representation and others in an effort to make themselves more marketable and build their business.”
The common denominator within this trend is technology. Teleconferencing on demand, coupled with the time and motivation to get to the next level has produced a surge in real estate training and networking during one of the scariest down markets in recent memory. Brokerages big and small have ramped up digital training programs—not just to teach the new regulations, remain compliant and close more no-contact deals, but to improve as complete real estate professionals.
Before the lockdowns went into place amidst the pandemic, National Association of REALTORS’® (NAR) CEO Bob Goldberg ordered a company-wide remote work test—its success was mirrored in the Association’s highly-attended, completely virtual mid-year conference.
“We have now become the model for success, and other organizations are reaching out to us for advice,” says Patrick Newton, director of Advocacy and PR Communications at NAR. “While we normally have around 9,000 members travel to Washington in May, more than triple that amount participated in the virtual conference.”
Newton says NAR may never go back to a solely in-person conference, ensuring a virtual component of some kind moving forward for all events.
Perhaps one of the best positioned outfits to lead this technology trend is the fast-growing, agent-owned publicly traded company, eXp World. With 29,000-plus agents, the brand uses its VirBELA Open Campus to hold virtual meetings with features such as spatialized voice chat, avatar customization and embedded web browsers. Recently, its first virtual shareholders meeting was attended by 9,500 and included 75 break-out sessions.

Regardless of how agents seek to better themselves, Mark Stark, CEO/owner at Berkshire Hathaway HomeServices Arizona/California/Nevada Properties, sees the shift in training and professional improvement as an evolution of the industry toward seeking the best of both worlds—merging the advantages of the pre- and post-pandemic eras.
“I see the world we’re in as an and environment, not an or environment,” Stark said. “People say there’s a ‘new normal.’ I don’t believe that. I think consumers will want everything they loved about the old and everything they love about the new.”
He said his team has been focusing on virtual training while still practicing in-person business—at a safe social distance, of course. The meetings are recorded for those who don’t feel safe attending, and agents concerned about on-site visits have co-workers on standby who don’t mind it to fill in at a minute’s notice. The result, Stark says, is a well-suited client experience and better-educated agents thanks to his increasingly popular Facebook Live training program.
“We are going to use all the virtual communications and we’re going to do everything we did live,” Stark said. “Consumers want to see face to face. They often say: ‘That’s great that you’re on my TV, but separate from that I can’t commit to you without seeing you and I want you to physically see my home.”
Katy Robinson, director of events, Learning and Development for RE/MAX INTEGRA, said the response to her company’s online training and engagement tools have been incredibly well received by agents and clients, alike, and she expects the platforms to continue in this distant direction.
“Prior to the pandemic, we were able to reach a fairly large swath of our network with the programs, but amid the current situation, it has become clear that virtual programs like these will be a focus moving forward as well,” Robinson said. “As of now, more than half of the RE/MAX INTEGRA agents within our U.S. footprint have opted in to complete this new training.”
According to the latest Online Learning Survey conducted by NAR, which looks at purchasing data from the Center for REALTOR® Development, most members who are interested in eLearning tend to be younger than 50 years old. Those who purchased online courses in the last year or so were largely 49 or younger (62 percent). In terms of online products, the most popular tend to be archived webinars, online videos and online courses.
But while many may assume this embracing of technology is skewing the industry toward younger agents, brokers are quick to point out that it really isn’t the case. The pivot, they say, is cutting across all generations—largely because it’s such a necessary part of today’s professional survival.
“Unsurprisingly, the early adopters of these programs have been the younger agents. They were some of the first to participate in these training techniques, but in a short period of time, more agents have tuned in and now it seems that the entire RE/MAX INTEGRA network has found the value in the easy-to-access tools and series that we have provided,” Robinson said. “Agents know that the ‘more you learn, the more you earn’ and are always focused on improving their business and themselves.”

OTTAWA, August 9, 2018 – The Royal Architectural Institute of Canada (RAIC) will hold a national forum in Vancouver on August 21 to explore challenges, opportunities, and new directions for architecture in British Columbia and Canada.

Payday lender lawyer Tim Muir faces reckoning – Kansas City Business Journal
Sitting in a prison cell that is his new home, Tim Muir potentially has years to contemplate everything that went wrong in his life and landed him in this position. But he’s not feeling guilty.
Muir thinks about being separated from his family. He still fumes about FBI agents storming into his Overland Park home wearing tactical gear, guns drawn, and arresting him in front of his children. It’s an emotional wound that remains raw years later.
But in a six-page letter he wrote in answer to questions from the Kansas City Business Journal, one sentiment not evident anywhere is regret. Muir believes he was wrongly convicted.
In October, a federal jury in New York convicted Muir for racketeering, wire fraud, money laundering and filing false Truth In Lending Act disclosures. The charges stemmed from his job as general counsel for a payday lending operation, which a jury determined used shell companies to give the appearance of Native American tribe ownership to circumvent state lending laws.
In reality, the operation — owned by Scott Tucker of Leawood — was run out of Overland Park. The operation generated $2 billion in profits and victimized 4.5 million consumers by charging interest rates ranging from 400 to 700 percent, according to prosecutors.
Muir and Tucker were tried and convicted together. Tucker was the flashy one, spending more than $100 million on luxury homes and cars, a Learjet, lavish travel and expenses for a professional racing team with six Ferraris.
By contrast, the low-key Muir played a relatively unknown character in the whole saga. He lived in a $300,000 house on a cul-de-sac not far from 119th Street and Roe Avenue in Overland Park. He coached his daughters’ sports teams. He helped raise money for charities ranging from a child abuse advocacy center to a scholarship fund for foster and adopted children to an organ donor program. A local lawyer who worked on fundraising with Muir said he was actively involved in the bar association and bar foundation, describing Muir as “a tremendous asset to the legal community and the local community in general.”
That’s a dramatically different picture of Muir than the one prosecutors painted: Muir filed false affidavits that claimed the tribes, not Tucker, were doing the lending. Muir orchestrated a sham merger to make it appear the tribes bought the business, and he even had two of Tucker’s corporate entities sue each other in an effort to confuse investigators and throw them off the trail. Prosecutors argued that Muir went too far in shielding the payday lending operations from law enforcement, making him culpable alongside Tucker.
Who is Tim Muir?
Muir, 46, moved to the Kansas City area with his parents at age 6, immigrating from Australia. He graduated from Shawnee Mission West High School in 1989.
Muir earned a biochemistry degree from the University of Kansas in 1998. He was intent on getting a law degree but couldn’t afford to go to law school right away. So he took a job as a manager at Godfather’s Pizza.
He later enrolled at Chicago Kent College of Law, with a focus on patent law. However, he had to leave Chicago Kent after only a year. His oldest brother, Patrick, suffered from a spinal disease that left him paralyzed, so Muir moved home to help care for him.
Muir eventually resumed law school at KU, commuting from Kansas City. He earned a law degree in 2004, at age 32.
He married Stephanie Tucker-Muir in 2007, and they have two daughters.
Seeing a payday
In 2006, two years out of law school and weighed down by student loans, Muir said an acquaintance recommended him to Tucker for a job as general counsel. Tucker already had several payday lending companies up and running. He drove exotic cars and flashed around cash, offering handsome wages for a new legal staff he was assembling.
“I was employed as general counsel for his company for about six months, and then subsequently started my own firm, becoming outside counsel,” Muir wrote to the Kansas City Business Journal. “There was no job description when I started. I joined a very large legal team that Scott had retained through the years.”
Muir estimated that more than 200 lawyers worked on Tucker’s legal matters through the years. Muir eventually took on the various tribal entities as clients, as well.
“The scope of my representation included business, litigation and regulatory matters,” he wrote. “I regularly interacted with tribal officers, attended board of director meetings and accompanied tribal leaders for government-to-government meetings, including with the New York Department of Financial Services, the Treasury Department and the chairman of the Federal Deposit Insurance Corp.”
The scheme
Tucker set up agreements with Native American tribes, which prosecutors said involved having the tribes establish corporations on reservation grounds for payday loan businesses.
Russell Bradley of St. Joseph was treasurer for the Kickapoo Tribe in Kansas when Tucker reached out offering a business opportunity. Tribal officials asked Tucker why he was approaching them.
“It was mainly because they wanted to get around the activity of the states establishing more regulations to deal with the payday-loan-type businesses,” Bradley testified at Tucker’s and Muir’s trial.
Bradley said Tucker’s pitch amounted to giving the tribes something for nothing.
“We’d be guaranteed $20,000 a month, plus a percentage over $2 million in lending per month,” Bradley testified. “We would be the owners, and they would be the managers of the company; they’d put up the money, and they would make us a regular check every month.”
Aside from on paper, Bradley said the tribe had little to do with the business. The documents signed by the tribe showed it had no obligation to invest money or pay the operation’s expenses, except for maintenance of a business office on the reservation. The business office — a computer set up in the tribal attorney’s office — was used to funnel financial reports. No one in the tribe was trained on how to use the system.
The loans started coming in as soon as the deal closed. Loan terms were confusing, helping generate excessive fees. Borrowers were told they would pay a $90 finance charge on a $300 loan. Then $75 would come out of each paycheck, leading victims to believe they were on track to pay off the loan. However, those $75 debits actually were renewal fees and not principal payments that would cover the debt in the alloted time. Prosecutors said the scheme’s multipart payment plan, if allowed to go to fruition, would result in a $300 loan costing $975.
In a Netflix documentary series titled “Dirty Money,” one victim, a truck driver named Walter Archer, talked about his experience borrowing $500 from one of Tucker’s companies. Archer said it was infuriating to find out those were renewal fees — and none of the principal had been paid.
“If I was in the same room with Scott Tucker, I would tell him there are millions of people you probably put into a position where, at least temporarily, they were homeless, or they did without electricity, or their water and sewer or garbage was turned off, or maybe they did without food for a little while so the kids could eat,” Archer said in the documentary. “Your greed put them in a very bad position, and you need to stand up and take accountability for what you’ve done and publicly apologize.”
The debate
Muir argues that borrowers knew the terms. He said the agreement was an industry standard used by more than 100 lenders. Customers received multiple emails describing the payment structure and how it worked, stating that if they took no action the loan would be renewed without the principal paid.
Muir also argued that the operation was up and running when he went to work for Tucker in 2006. He professes that he simply followed the lead of other attorneys before him and operated in good faith that his actions met the legal standard.
“All of my clients, and myself, believed whole heartedly in the legality of their business model,” Muir wrote to the Business Journal. “Whether through litigation, direct consultation with state and federal regulatory agencies or engaging congressional leaders in the legislative process, we never shied away from a debate regarding the lawfulness of tribal online lending.”
But prosecutors liken that argument to someone driving 80 miles an hour down a neighborhood street and, when stopped, arguing that others drove that fast, too. The prosecution convinced a jury that Muir was fully aware of the New York usury statute and that Muir’s job was to maintain the lie that these loans originated from Native American tribes and not Tucker.
“Lawyers paid by Tucker and supervised by Muir drafted bogus resolutions that they directed the tribes to pass to make it seem like the tribes owned part of Tucker’s business,” prosecutors said in the trial’s opening statements. “They filed false affidavits lying to the courts across the country, claiming that the tribes, not Tucker, were doing the lending.”
Employees in Overland Park were told to lie about where the company was located. The company went so far as to provide them with weather reports for the areas where the tribes were located, in case customers made small talk during phone calls.
“What the jury heard in a case like this is that (Muir) had an oath,” said Charlie Harris Jr., a partner at Seyferth Blumenthal & Harris and a disciplinary hearing officer for the Missouri Office of the Chief Disciplinary Counsel. “He knew he had an oath and responsibility to represent the truth to the court for each of the entities that he set up. The jury took a look at this case and said these are no more than sham corporations. The management of these companies were not strictly within the confines of the tribes. In fact, it’s pretty clear that the jury’s reaction was, not only did the tribes have little to no management powers, but he knew they’d have little to no management powers when he set up these corporations, and they were set up solely for the interest of making money.”
Tucker, who allegedly netted more than $1 billion, was sentenced to 16 years and eight months in prison.
Muir received about $10 million for his role in the payday operation, according to sentencing documents. He was sentenced to seven years in prison, starting his time on Feb. 27. Muir has filed an appeal.
Muir ended his letter to the Kansas City Business Journal with a simple statement: “Last, I have one thing to say: Prison sucks.”

The battle for Hillcrest
Tippi McCullough and Ross Noland square off to represent perhaps the House's most progressive district.
On May 22, voters will decide between Tippi McCullough, a longtime teacher and activist, and Ross Noland, an attorney and nonprofit director, in a race to represent downtown and midtown Little Rock in the state legislature. Actually, only Democratic voters will decide the race, but in House District 33, which stretches across Little Rock's midsection, from Reservoir Road to the River Market, south of Riverdale and mostly to the north of Interstate 630, there's not much distinction between Democratic voters and all voters. It's perhaps the state's most reliably liberal district.
After serving three terms, Democratic Rep. Warwick Sabin announced last year he would not seek re-election, but would instead explore running for Little Rock mayor. The winner of the Democratic primary will win the November election by default; no Republican or Libertarian candidate filed to run.
At a debate sponsored by the Pulaski County Democratic Party held Monday at Philander Smith College, McCullough and Noland substantively agreed on all policy questions: Both oppose Governor Hutchinson's proposal to reduce income tax rates on the state's highest earners, think charter schools should not be able to grow unchecked, believe that public schools are underfunded, argue that the University of Arkansas for Medical Sciences needs more state funding and support the preservation of War Memorial Park as green space.
McCullough and Noland live one street apart in Hillcrest, but their backgrounds and policy priorities separate them, each candidate said in an interview.
McCullough, 54, has taught English at Little Rock Central High School for the last four years. Before that, she spent 14 years at Mount St. Mary Academy, which fired her in 2013 for marrying her longtime partner, Pulaski County Deputy Prosecuting Attorney Barbara Mariani. The Catholic girls' school said McCullough had violated a morality clause in her contract, though according to McCullough, her relationship with Mariani was no secret at the school. The firing led to a public outcry; McCullough and Mariani traveled around the country sharing their story on behalf of the Human Rights Campaign's advocacy for LGBT rights.
The experience "opened my eyes a little bit" to politics, McCullough said. She became president of the Stonewall Democrats in 2014, which in turn got her more involved in state Democratic politics. It was a natural transition from LGBT advocate to political activist. "LGBT people are people — they have the same issues everyone else does" with housing, jobs and health care, she said. In January 2017, she became the chair of the Pulaski County Democratic Party. (She stepped back from active leadership during the campaign and plans to resume her duties after the election.)
On the campaign trail, McCullough likes to say, "I've lived in Little Rock for nearly 20 years, and I'm fortunate to live in Hillcrest, but I didn't grow up there." She was raised by a single mother in Hot Springs. She was the first in her family to get a college education, thanks, McCullough says, to her basketball skills, which landed her a scholarship at Ouachita Baptist University in Arkadelphia. After graduation, she got a job coaching basketball and teaching English in Kingston (Madison County) and later Mountain Pine (Garland County) and Newport. She was the first woman to be president of the Arkansas Basketball Coaches Association. (Asked in the debate Monday how she would govern in the minority party, she cited that leadership, saying the association looked a lot like the legislature, which drew laughs from the audience.)
Coaching and teaching all over the state makes it easy for her to relate to people, she said. She's witnessed the "struggles" of her students and their families, "whether it was because they were homeless or hungry or suffering abuse." That experience, along with her involvement in the Arkansas Education Association, which she said "strives to improve students' lives at school and also the teaching profession as a whole," gives her an edge in the campaign, she said. "Every door I knock on, when I ask them the most important issue to them, they say, 'Education.' "
McCullough is vice president of the Hillcrest Residents Association. When the Hillcrest Merchants Association considered shuttering the popular Hillcrest HarvestFest, she volunteered to step in to run the fest.
Noland, 37, is a lawyer who divides his time between his firm, specializing in environmental litigation, and serving as executive director of the Buffalo River Foundation, a nonprofit dedicated to cooperative conservation in the Buffalo River watershed. He cites his Arkansas bona fides on the campaign trail. He was born and raised in Little Rock and graduated from Central High School in 1999 as "Mr. Tiger Spirit." He received his undergraduate and law degrees from the University of Arkansas at Fayetteville, before completing a master's degree in environmental law at George Washington University in Washington, D.C. After working at a private firm in D.C., he returned to Little Rock to clerk for Pulaski County Circuit Judge Mary McGowan. Then he joined U.S. Sen. Blanche Lincoln's staff as legislative counsel to Senate Committee on Agriculture, Nutrition and Forestry, which Lincoln chaired. After she was defeated by John Boozman, Noland returned to Little Rock and worked primarily on environmental litigation for the McMath Woods law firm for five years before going into solo practice and taking on the leadership position with the Buffalo River Foundation.
Noland says his experience gives him the edge in the campaign. He's seen the inner workings of government, from his time at the U.S. Senate to working as an attorney in Little Rock and writing bills that have become law and rules that became regulations.
His knowledge of environmental issues also separates him from McCullough, he said. "There is no leader out on environmental issues down there. If there's one thing that affects us all — rich or poor, black or white, north or south of the interstate — it's the air that we breathe and the water we drink. To me, it's one of the most important issues facing the state and the nation right now, and I don't think we have enough emphasis on it. ... As far as what I can get done, I'm fully aware that I'm running to be a freshman in the lower house in the minority party."
But Noland said issues he's campaigning on have broad-based appeal. He wants to make renewable energy more accessible to the average person. "We need to make it easy for retail customers to deploy solar, whether it's through access to financing or making sure they get a fair price when they put energy back into the grid," he said. "There's a freedom association to producing your own energy" that Republicans should appreciate. He also said the playbook for state conservation could be used in passing other environmental measures in the legislature.
"We have a strong outdoor recreation movement in Arkansas. It's key for the environmental and conservation movement to tie what you like to do outdoors on the weekend to the fact that you need clean air and water to do it — whether it's duck hunting or floating or whatever." Outdoor activity is a "huge economic engine" throughout the state, he said.
Noland is married to Ali Noland; they have two children, the oldest of whom is in pre-K in the Little Rock School District. "The fundamental role of the legislature is to perform oversight of its executive agencies," he said. "We've got to get a plan to return to local control of the school board," he said. Expanding pre-K throughout the state is also one of his priorities.
Noland said he supports the Seventh Amendment right to a jury trial and strongly opposes Issue 1, the legislatively referred constitutional amendment that would limit the amount of compensation juries can provide for noneconomic damages, such as in injury or wrongful death cases.
After years of being a "policy person," Noland said he decided to get involved in politics because of the political climate. "The time to act is now. If you're not pissed off about what's going on out there now, you're not paying attention," he said.

Doctors who object to treatment on moral grounds must give referral

TORONTO — Ontario doctors who have a moral or religious objection to treatments such as assisted dying, contraception or abortions must refer patients to another doctor who can provide the service, after a court found it is necessary to guarantee that vulnerable patients can access the care they need.
A group of five doctors and three professional organizations had launched a legal challenge against a policy issued by the province’s medical regulator, arguing it infringed on their right to freedom of religion and conscience under the Charter of Rights and Freedoms.
The group — which includes the Christian Medical and Dental Society of Canada, the Canadian Federation of Catholic Physicians’ Societies and Canadian Physicians for Life — said the requirement for a referral amounted to being forced to take part in the treatment.
The College of Physicians and Surgeons of Ontario, meanwhile, said its policy aims to balance the moral beliefs of individual physicians while nonetheless ensuring access to care, particularly for vulnerable patients.
In a ruling released Wednesday, the divisional court said that though the policy does limit doctors’ religious freedom, the breach is justified. The benefits to the public outweigh the cost to doctors, who can choose to practise a specialty where such moral dilemmas will not arise, the court said.
“The goal of ensuring access to health care, in particular equitable access to health care, is pressing and substantial. The effective referral requirements of the policies are rationally connected to the goal,” Justice Herman J. Wilton-Siegel wrote on behalf of a three-member panel.
“The requirements impair the individual applicants’ right of religious freedom as little as reasonably possible in order to achieve the goal.”
What’s more, the court found, “the applicants do not have a common law right or a property right to practise medicine, much less a constitutionally protected right.”
“Those who enjoy the benefits of a licence to practise a regulated profession must expect to be subject to regulatory requirements that focus on the public interest, rather than the interests of the professionals themselves,” Wilton-Siegel wrote.
The groups said they were disappointed with the ruling and would review their options in regards to an appeal.

Clarke resigned as sheriff on Thursday. A regular presence on Fox News, Clarke has become a well-known figure in conservative circles in recent years. He is also an avowed supporter of President Donald Trump, and he spoke at the Republican National Convention in Cleveland last year. But he has come under fierce criticism amid a series of deaths in the Milwaukee County prison, including that of Terrill Thomas, who died of dehydration last year after guards turned off the water in his cell.
