Florida: Muslim mechanic - who had ISIS videos on phone - admits sabotaging American Airlines plane at Miami International
Iraqi immigrant Abdul-Majeed Marouf Ahmed Alani sabotaged flight with 150 passengers aboard but may only get 3 years jail.

An American Airlines mechanic accused of sabotaging a navigation system on a Miami flight with 150 passengers aboard pleaded guilty Wednesday to attempting to destroy the aircraft in a plea agreement designed to avoid a maximum sentence up to 20 years in prison.
“I do admit the guilt,” Abdul-Majeed Marouf Ahmed Alani, 60, said through an Arabic interpreter in Miami federal court.
Alani, a veteran AA employee who had lived in California and commuted to his job at Miami International Airport, now faces up to three years in prison under a joint recommendation by the U.S. Attorney’s Office and his defense lawyer. His sentencing is set for March 4.
At his detention hearing in September after his arrest, federal prosecutors suggested that Alani may have possible links to a Middle East terrorist group, but that allegation never came up at his plea hearing before U.S. District Judge Marcia Cooke.
His defense attorney, Jonathan Meltz, made that point outside the courtroom when asked by reporters about the allegation. “This case is only about what you heard in court,” said Meltz, who added that his client “has been leading a law-abiding life for 30 years.”
After his arrest, Alani told federal investigators that he disabled the aircraft’s navigation system on the morning of July 17 because he was upset over stalled union contract negotiations with the airline. He said he wanted to generate some overtime for maintenance on the plane.
Alani also said that he meant no harm to anyone.
The Miami-Nassau flight was aborted before takeoff at Miami International Airport after an error alert appeared on the navigation system.
At Wednesday’s hearing, prosecutor Randy Hummel summarized the evidence against Alani, stressing that the AA flight’s navigation system was “deliberately obstructed” with foam by Alani and that the “aircraft was deemed not airworthy.”
Alani was accused of tampering with the plane’s so-called air data module, a system that reports aircraft speed, pitch and other critical flight data to pilots.
Alani was not charged with a terrorism-related offense. However, prosecutors said at his detention hearing in September that FBI investigators learned Alani lied about taking a trip to Iraq in March to visit his brother. They also found out he told a fellow American Airlines employee in June that his brother had been kidnapped and was a member of the extremist Islamic group known as ISIS.
Prosecutors said Alani allowed the FBI to search his smartphone and agents found a “disturbing” ISIS video in which a person was being shot in the head, and that he sent the video to someone with an Arabic message asking “Allah” to take revenge against non-Muslims. In addition, they said Alani sent $700 to someone in Iraq, where he was born and has family.
At the detention hearing, prosecutor Maria Medetis told a magistrate judge that when federal investigators questioned Alani after his arrest on Sept. 5, he told them he had an “evil side” and that he “wanted to do something to delay” the plane “to get overtime” for maintenance repairs. After putting in a double shift on July 17, he actually did some overtime work on the disabled plane. On average, he made $9,400 a month as an American mechanic.
But the prosecutor also said Alani admitted to investigators that his tampering with the plane’s navigation system was dangerous. When they asked him whether he would allow himself or his own family to fly on the jet without the system, he said “no,” Medetis said.
Medetis said investigators also spoke with the American Airlines pilot of the targeted plane, and he said that without a functional navigation system “it could have resulted in a crash.”
None of the passengers and crew on the flight from Miami to Nassau were injured because his tampering with the air data module caused an error alert as the pilots powered up the plane’s engines on the runway July 17, according to a complaint affidavit.
As a result, flight No. 2834 was aborted and taken out of service for routine maintenance at American’s hangar at MIA, which is when the tampering with the air data module system was discovered during an inspection. An AA mechanic found a loosely connected tube in front of the nose gear underneath the cockpit that had been deliberately obstructed with some sort of hard foam material.
According to the complaint affidavit, Alani glued the foam in the tube leading from outside the American Airlines plane to its air data module. As a result, if the plane had taken off that day from MIA, the pilots would have had to operate the aircraft manually because the ADM system would not have received any computer data.
Federal Air Marshals zeroed in on Alani, who had worked as an American Airlines mechanic since September 1988, after reviewing video footage that captured him exiting a white truck on the morning of July 17 at concourse D and approaching the plane, which had just arrived from Orlando, the affidavit says.
The footage showed Alani, who walks with a limp, accessing the aircraft’s compartment where the navigation system was located in the plane, according to the affidavit, which was filed by the U.S. Attorney’s Office.
Alani, the federal charges said, spent about seven minutes doing the sabotage.
Air marshals, part of the Transportation Security Administration, conducted interviews with three other AA mechanics who were with Alani after he tampered with the plane. They helped investigators identify him from the video footage.
In response to the news of Alani’s guilty plea, his former employer, American Airlines, issued a statement: “We are grateful for the work of the FBI, the U.S. Attorney’s Office and other officials in resolving this matter.

THE STORY OF A BLACK HERO: COLIN FERGUSON
On 07th December 1993, on the Long Island Rail Road train this strong Black man rose and walked calmly down the aisle, shooting every white in sight as he passed with a 9mm handgun.
When he paused to reload his weapon, passengers wrestled him down. By then, six whites lay dead with nineteen more seriously wounded.
The strong Black man was Colin Ferguson, 36 years old, well-educated, unemployed immigrant from Jamaica.
His defense prompted debates over mental competency and criminal insanity like none ever heard in any courtroom.
LIRR police chief Joseph Flynn said, "this was the work of a deranged, maniacal person who for a variety of reasons decided to explode".
Ferguson insisted that he was perfectly sane.
In fact, Ferguson said that he was not the killer; he said that an "unidentified white man had done the shooting and then escaped".
A court-ordered psychiatric examination determined that Ferguson met both criteria by which defendants are deemed sane enough to stand trial in New York; meaning he understood the nature of the legal proceedings against him and he was able to assist in his own defense.
Through series of psychological evaluations Ferguson was also found to have been able to distinguish right from wrong at the time of the shootings.
One month after the shootings, on January 7, 1994, Ferguson was declared mentally competent by Nassau County District Judge, Ira Warshawsky.
Despite this ruling, Ferguson's court-appointed attorney, Anthony Falanga, said he would still attempt to defend Ferguson "on grounds of insanity".
Ferguson refused to cooperate with Falanga.
After two months, Falanga stepped aside when Ferguson agreed to be represented by controversial civil-rights attorneys, William Kunstler and Ronald Kuby.
Ferguson's new lawyers also agreed that "he was mentally unstable", but they announced that his defense would take a different approach.
When Ferguson was arrested, police found notes in his pockets expressing his hatred of Caucasians, Asians, and "Uncle Tom Negroes."
Kunstler and Kuby held that Ferguson's behavior could be "tied to a study entitled Black Rage".
In this 1968 study, psychologists Price Cobbs and William Grier observed that "in order to function in society, Afrikan-Americans suppress feelings of intense anger over racism".
Kunstler and Kuby wanted to expand this thesis into a "black rage" defense, arguing that continual racist mistreatment was the catalyst that caused Ferguson's "delusions and paranoia to explode into violence", they said.
Kunstler and Kuby vowed to press ahead with the "black rage" defense.
Their strategy, however, accepted that Ferguson "was the killer and that he was mentally unsound".
Collin Ferguson rejected both these assumptions.
Opening statements in the trial began on January 26, 1995, in Mineola, New York.
Wearing a bulletproof vest under a suit and speaking evenly, Ferguson said that as the commuter train made its way out of New York City, he had dozed off and someone (a white man) had stolen his gun and opened fire on the passengers.
"Mr. Ferguson was awakened by the gunfire and, amid the confusion, sought to protect himself," Ferguson said in court.
Ferguson told the jury that the charges against him were a racist conspiracy.
Police detectives found pieces of notebook paper in Ferguson's pockets with scribbled notes with the heading "reasons for this".
One of the notes referred to "racism by Caucasians and Uncle Tom Negroes."
They included a reference to "the false allegations against me by the filthy Caucasian racist female on the #1 line," a reference to his February 1992 arrest.
Ferguson's notes also expressed anger towards the New York State Workers' Compensation Board, Asians, Governor Mario Cuomo, and "so-called civil right leaders such as the Rev. Herbert Daughtry, C. Vernon Mason, and Calvin Butts".
They also included the names and telephone numbers of the Lt. Governor, the Attorney General, and the Manhattan law firm that Ferguson had previously threatened, whom he referred to as "those corrupt 'black' attorneys who not only refuse to help me but tried to steal my car."
Ferguson showed no remorse during hours of questioning from the Nassau County District Attorney's Office.
Officials there said, "he was lucid and clear and aware of what was going on".
Ferguson was arraigned on December 8, 1993. He never spoke during the arraignment and did not enter a plea.
He was ordered held without bail.
As the trial progressed, the eloquence of Ferguson's frequent objections proved that he was not a crazy man at all, he was perfectly sane and sound.
He accused the Jewish Defense League of conspiring to kill him and said that the prison murder of cannibal serial killer, Jeffrey Dahmer, was a rehearsal for his own death behind bars.
Ferguson made a request to subpoena U.S. President Bill Clinton, because the Clinton had personally commended the bravery of the three men who subdued Ferguson at the time of the shootings.
The request to subpoena Clinton was denied.
Ferguson also argued that the indictment against him contained 93 counts only because the shootings occurred in 1993.
"Had it been 1925," Ferguson said, "it would have been 25 counts."
Outside of court, a New York exorcist claimed that the CIA had kidnapped Ferguson and implanted a computer chip in his brain, activating it with an order to kill.
Ferguson considered calling the exorcist as a witness, but decided against it.
Although he was entitled to do so, Ferguson rested his case without calling himself to the stand.
Speaking in his own defense in court, Ferguson said:
"John the Baptist lived in the wilderness, a humble man, and he was put into prison," Ferguson said. "He was beheaded by a criminal justice system similar to this. After his death, we can look back and say with 20-20 hindsight, 'This was a great man.' And as much as I'm hated in Nassau County and America, I believe there are persons that are strengthened by me and my stand."
The white Judge presiding over the case sentenced Ferguson to six consecutive 25-years-to-life terms, one for each count of murder.
He also gave Ferguson 25-year sentences for each of 19 counts of attempted murder - for a total of 475 years.
But prison terms for multiple convictions of attempted murder are limited by New York law to a total of 50 years.
Thus, Ferguson's combined sentences added up to 200 years.
Ferguson appealed his conviction, asking for legal counsel this time.

The death toll from coronavirus in the United States rose to 12 on Thursday with the latest fatality recorded in King County, Washington, and 53 new cases broke out across the country, striking for the first time in Colorado, Tennessee, Texas and San Francisco. A helicopter flew testing kits to a cruise liner idled off the coast of California and barred from docking in San Francisco after at least 35 people developed flu-like symptoms aboard the ship, which has been linked to two other confirmed cases of COVID-19.Twenty new cases of the virus were confirmed in King County, Washington, local health officials said, bringing the total in the county to 51 with 11 deaths. Welcome to Word Vomit Wednesday! A series of blog posts about a specific topic from current events that I, and sometimes the rest of the Internet, ruminate obsessively about. All thoughts/opinions/experiences are my own; I don’t claim anything that I write to represent anyone other than myself.
  This time last year I parted ways with my girlfriends, bleary-eyed and in a fog. We didn’t even finish watching the coverage because we knew where it was heading. This time last year my numbness from shock slowly morphed into dread as I cocooned myself in a shield of blankets as the realization of how much more danger my life and the lives of many began to sink in. I was mortified, humiliated, and utterly heartbroken. The eerie silence of the street outside my window as the sky cried echoed my state of mind and the minds of many that day. This time last year I didn’t know how we were going to make it through the next 24 hours let alone the next two years. Last night, a year later, I finally feel relief. Our fear fueled into action made an enormous impact. Look at what we accomplished:

A majority of these positions that once were red now bleed blue. And a fuck ton of old, white, cis-het, republican men were rightfully fired from their positions. Exclusion and discrimination are disqualifiers. We don’t need public servants who only serve a portion of the public. This time last year everything changed. More people were inspired to take action, run for office, and fight for the America that we want to be and not the America we’ve historically been. Our resistance is strong and yesterday was just the tip of the iceberg. History was made and we wholly deserve to celebrate this moment. Then we get back to work.

U.S. real estate pain leaves foreign investors holding the bag
Foreign investors who backed real estate projects in return for U.S. visas are emerging as losers in the pandemic-driven commercial property crisis.
In Manhattan, Chinese investors who helped fund Related's Hudson Yards have called for arbitration to pressure the developer into returning their money. On Long Island, a separate group assumed the lease to the Nassau Coliseum, after billionaire Mikhail Prokhorov's Onexim Sports and Entertainment decided to walk away from the project.
The investors, who backed development deals through the U.S. Citizenship and Immigration Services' EB-5 program, aren't the only ones getting hammered by the Covid-19 pandemic, which has kept mall-goers, hotel guests and office workers home, pushing commercial-property owners into delinquency. But EB-5 investors, who cared more about coming to the U.S. than financial returns, have less leverage than most.
"Cash is king during Covid, and developers are reluctant to let go of any cash," said Mona Shah, a New York lawyer who works on EB-5 deals. "It doesn't help that there are some developers who show distinct lack of respect for EB-5 money. It's easy money."
Shah said she represents a hotel developer who is looking to reduce the principal owed on an EB-5 loan, because the property closed due to the pandemic and is unlikely to return to profitability quickly. In other cases, developers are seeking to extend loan terms or withhold payments entirely, Shah said.
At Hudson Yards, roughly 2,000 EB-5 investors poured $1 billion into the Manhattan project through a series of deals, according to a demand for arbitration filed recently by Chicago lawyer Doug Litowitz. The investors were unsophisticated about U.S. real estate, according to Litowitz, and were told by the Chinese firm that helped Related raise money that they would be repaid following...

The 2017 Elections Show Criminal Justice Reform Can Be a Winning Issue
Smearing candidates as "soft on crime" didn’t work this election cycle.
On Election Day 2017, candidates in Philadelphia, New Jersey, Virginia, and New York won on platforms that proactively embraced criminal justice reform or rejected fear-mongering attempts by opponents to label them as soft-on-crime.
Their victories send a strong signal to politicians running in 2018 elections that they do not need to hide from supporting issues like bail and sentencing reform, ending the death penalty, and restoring the rights of people living with a criminal record. They also represent the continuation of a shifting narrative that rejects the old tough-on-crime politics for a new approach that is rooted in civil rights and redefining community safety.
Philadelphia
By far the biggest criminal justice reform victory came with the election of Larry Krasner as Philadelphia’s next district attorney. Until 2010, Philadelphia had a district attorney known as America’s “Deadliest D.A.” for her robust support of the death penalty. Yet seven years later, Philadelphians elected a candidate likely to become America’s most progressive prosecutor.
Krasner, a civil rights lawyer who has never been a prosecutor and who wears as a badge of honor the fact that he has sued the police 75 times, won on a platform centered on criminal justice reform and ending mass incarceration. He has often spoken about the need for transformational changes in the city’s criminal justice system, and during his victory party, he spoke of the need to reform a system that has “systematically picked on black and brown people.” He has committed to ending the death penalty, ending cash bail, and fighting mass incarceration. The police unions in Philadelphia opposed Krasner’s election, mocking it as “hilarious.”
The issue of ending mass incarceration became a priority in the race because of the work of a coalition of local and national criminal justice and civil rights organizations including the Philadelphia Coalition for a Just District Attorney, Color of Change, Safety and Justice PAC, and the Working Families Party. The ACLU hired 51 canvassers who are formerly incarcerated to knock on 26,000 doors to ask our members, in a non-partisan way, to vote for a district attorney candidate committed to ending mass incarceration.
New Jersey
New Jersey’s race for governor was in many ways a referendum on marijuana legalization and on addressing racial disparities in the criminal justice system. Phil Murphy came out in support of marijuana legalization early on in his campaign, and he consistently framed the issue not just as a financial boost for the state but one of racial justice. New Jersey leads the nation in reducing its incarcerated population, seeing a 35 percent drop in its prison population in the past 18 years, but New Jersey also leads the nation when it comes to racial disparities in the criminal justice system. Black residents are 12 times more likely to be incarcerated as white residents.
Phil Murphy committed to addressing these disparities, and often cited the ACLU of New Jersey’s report finding widespread racial disparities in marijuana arrests in New Jersey. He spoke of the “structural racism in our criminal justice system” and of the need to fight against the for-profit prison industry. His platform included reforming mandatory minimum laws and fully implementing New Jersey’s historic bail reform law.
Murphy’s opponent, Kim Guadagno, on the other hand, ran on a platform that exploited people's concerns about public safety to pander to nativist anti-immigrant sentiment. She tried to label Murphy as soft-on-crime, using Willie Horton style attacks ads — a reference to the infamous 1988 presidential campaign commercial critical of a prison-furlough program supported by Democratic nominee Michael Dukakis. New Jersey voters rejected Guadagno's candidacy and elected Murphy instead.
Virginia
In Virginia, the race for governor turned into a referendum on President Trump’s supposedly tough-on-crime but destructive political playbook. Ed Gillespie defined his campaign by trying to paint his opponent as soft on gangs and criticized Gov. Terry McAuliffe for restoring the right to vote for thousands of state residents living with a criminal record. President Trump supported Gillespie and tweeted that his opponent, Ralph Northam, will “allow crime to be rampant in Virginia,” whereas under Gillespie, “MS-13 and crime will be gone.” Virginia voters didn't fall for it. Northam won.
In a lower profile race, Stephanie Morales won re-election as district attorney in Portsmouth City despite having convicted a white police officer in the killing of a Black teenager. She ran on a platform of police accountability and fighting mass incarceration and cash bail.
New York
In Nassau County, New York, Laura Curran won the race for county executive, despite racist attempts by her opponent to paint her as soft-on-crime. A mailer sent to Nassau voters in support of her opponent Jack Martins featured shirtless Latino men covered in tattoos with the text that Laura Curran is “MS-13’s choice for county executive.” The attempt flopped. Curran still won by 3 percentage points.
Despite not having any criminal justice ballot initiatives in 2017, this year will be remembered as one that saw a continuation of the push against mass incarceration and for criminal justice reform. The politics of mass incarceration are just as influential as the policies of mass incarceration. This is particularly true of district attorneys, who have extraordinary discretion in who gets incarcerated; the problem is that extraordinary power can be ripe for extraordinary abuse. This year suggests that the politics of mass incarceration may begin to change on a broader scale and bend towards justice.

On Thursday, June 22, AABANY’s Prosecutors’ Committee hosted its 9th Annual Reception at the New York County Lawyers Association. The Committee honored Deputy Chief Ellen Chang of the NYPD and Judge Danny Chun of Kings County Supreme Court for their exemplary record of public service.
Both honorees were among the first Asian Americans to hold such high offices in their respective fields. It was enlightening to hear about the challenges that both honorees faced as Asian Americans. Deputy Chief Chang began her career as a police officer at a time when only one percent of the force consisted of Asians. Likewise, as an immigrant, Judge Chun had to overcome racial stereotypes when he started as a District Attorney for New York County.
