Judd Legum at Popular Information:
Black women make up about 8% of the population in the United States. But, according to a report by Project Diane, firms founded by Black women received 0.0006% of total funding from venture capitalists between 2009 and 2017. In recent years, the amount of venture capital funding awarded to firms founded by Black women has remained far less than 1%. Further, a study by Palladium Impact Capital found that "Black women entrepreneurs in the United States suffer the largest gap between their total capital demand and the amount of investment capital they receive when compared to other demographic groups."   Nevertheless, some people believe that in the status quo, Black women are receiving too much venture capital. They argue that Black women are benefiting from illegal racial preferences. And they are suing to put an end to it. The focus of the litigation is the Fearless Fund, which runs the Strivers Grant Contest, a program that awards $20,000 to four small businesses that are majority-owned by Black women. A group called The American Alliance for Equal Rights (AAER) sued the Fearless Fund, arguing the grant contest constituted illegal racial discrimination. 
AAER bills itself as "a nonprofit membership organization dedicated to challenging distinctions made on the basis of race and ethnicity in federal and state courts." In practice, it files lawsuits on behalf of aggrieved white people who believe they are being harmed by programs designed to benefit racial minorities that face widespread discrimination. Edward Blum, the president of AAER, told the New York Times in 2023 that "systemic racism" does not exist. Blum also rejected the idea that "racism" was part of the country at its founding. AAER's most famous legal victory was a successful lawsuit arguing that "race-conscious student admissions policies used by Harvard University and the University of North Carolina" were unlawful. In the Fearless Fund lawsuit, AAER argued that the Fearless Fund's grant "violates section 1981 of the 1866 Civil Rights Act, which prohibits discrimination on the basis of race when enforcing contracts." That law was originally "intended to protect formerly enslaved people from economic exclusion," but is now being turned on its head by AAER. 
This week, a federal appeals court handed a victory to AAER. In a 2-1 decision, a panel found AAER was likely to succeed on the merits and issued an injunction suspending the Fearless Fund's grant program. The decision was written by two judges appointed by former President Trump.  Blum celebrated the decision while waiving away concerns about the systemic exclusion of Black women from venture capital funding. "Our nation’s civil rights laws do not permit racial distinctions because some groups are overrepresented in various endeavors, while others are under-represented," Blum said. 
The real meaning of civil rights law
Do civil rights laws really prohibit initiatives like the Fearless Fund's grants to businesses owned by Black women? Other courts have rejected challenges to similar programs. In November 2023, America First Legal (AFL) — an organization run by Trump advisor Stephen Miller — sued Progressive Insurance on behalf of a white business owner to stop a program that awarded $25,000 grants to black-owned small businesses. The money could be used toward the purchase of a commercial vehicle. The white business owner represented by AFL claimed he began filling out the application before realizing it was limited to Black-owned businesses.
The 3-judge panel on the 11th Circuit ruling against Fearless Fund is a victory for the right-wing White grievance industry and a loss for Black women.

The CEO and co-founder of the Fearless Fund, Arian Simone, said Monday the group wants President Biden to issue an executive order to protect “the right to fund specific marginalized groups” in light of a recent court ruling against the Atlanta-based venture firm. Simone also wants Congress to pass a law backing up the proposed order.
Her position follows a federal appeals court panel ruling last week that a grant for Black female businessowners run by the nonprofit arm of Fearless Fund likely violated the federal Civil Rights Act of 1866, throwing into question the future of diversity, equity and inclusion (DEI) programs.
In a 2-1 ruling, a three-judge panel from the 11th U.S. Circuit Court of Appeals also found Fearless was unlikely to enjoy First Amendment protection and that its program inflicts irreparable harm on the plaintiffs, an anonymous group of three white and Asian women.
Appeals judges halt Atlanta DEI grant fund for Black female-led businesses
The ruling is the latest in a string of court decisions against equity-focused business programs since the Supreme Court struck down affirmative action in college and university admissions.
Fearless Fund was founded in 2019 in Atlanta by three Black women to invest in women of color, a demographic that receives less than 1% of venture capital funding. It also has a nonprofit arm, the Fearless Foundation, that administered the grant at the heart of the lawsuit.
The Fearless Strivers grant contest gave $20,000 grants to Black female businessowners but the conservative group American Alliance for Equal Rights alleged the grant was racially discriminatory because only Black women were eligible. Last week, the appeals panel sided with the Alliance and issued a preliminary injunction against the grant.
Simone is now asking the federal government to intervene.
“Our ask is for an immediate Executive Order by the President of the United States to protect DEI & the right to fund specific marginalized groups if and when racial disparities exist. And for Congress to issue the Fearless Freedom Civil Rights Act, an Act that supports this executive order,” she wrote on Instagram.
The Atlanta Journal-Constitution spoke with Alphonso David, president and CEO of the Global Black Economic Forum and co-counsel to the Fearless Fund, about the potential implications of the recent ruling and Fearless’ next steps. This interview has been edited for length and clarity.
Q: What was your first thought when you heard the appeals panel had ruled against Fearless?
A: Disappointed and perplexed. We live in a country that professes to embody principles of fairness and equity. And we have a constitution that seeks to provide a level playing field, or at least promises to provide a level playing field for all citizens. We also live in a country that has not been able to effectively address the history of slavery and bias and discrimination, and the vestiges of slavery that we continue to live with today. So, reading that decision was incredibly disappointing because the practical reality remains the same … There is a significant disparity in funding for Black and brown entrepreneurs and businessowners in this country.
Q: What do you think the potential effects of the ruling could be?
A: What the plaintiffs in our case have been seeking to do is create a chilling effect across this country and maybe beyond that, where people are afraid to invest with Black businesses. They’re afraid to invest in programs that advance equity. And I think this 11th Circuit ruling could just exacerbate this problem where people feel a little skittish about supporting diversity and equity and inclusion programs, whether it be in the charitable space or in the private sector.
Q: What impact do you think this could have on philanthropy?
A: This decision for me amplifies what I see as a blatant hypocrisy within the world of philanthropy. Charitable organizations have been issuing grants to specific demographic groups for decades. And this is the first time that a federal court is stopping an organization from issuing grants to a specific demographic group, issuing grants consistent with their mission.
The implications for this decision, if it were to be applied within the philanthropic space broadly, are immense because it essentially redefines grantmaking. It essentially says you can’t issue grants to people of specific demographic groups, which we know is counter to what philanthropic groups have been doing for decades.
Q: So, while the scope of the ruling is limited in the corporate space, it can be applied pretty broadly in the philanthropic space?
A: Absolutely.
Charitable organizations are protected under the First Amendment to issue grants consistent with their missions and this has been a long-standing principle that had been applied and amplified and endorsed by advocates, lawyers and investors of all ideological stripes.
Q: Does the decision apply only to foundations that exist within this jurisdiction?
A: Correct.
Now, we understand that other courts may potentially use this decision in other cases … We have to wait to see the true application for this decision ... and we’ll be able to evaluate its impact in the future.
Q: What are Fearless’ next steps in this case now?
A: We are evaluating all options, and we will be making a decision and speaking publicly in the future about what steps we will end up taking.
As we look at this case, I want people to understand this is not about two women, it’s about all of us who are fighting to get to that place that we call equity. We’re so far from it and we have to continue fighting for it.

THOUGHTS ON GRUNKLE STAN GO
Probably the most compelling character in the whole show.
One thing I love about him is that he starts off as a comedic archetype that's pretty common, especially in cartoons being made at the time: he's the greedy, gruff, old conman (with a soft side).

But over time, the show gradually deepens his character. He's sensitive and appreciates art (that clown painting and "The Duchess Approves"), clever (can talk his way around just about anything), hard-working and a self-taught genius (rebuilt the portal with only 1/3 the schematics), worldly wise (he's not always right, yet the narrative usually backs ups his position), and a fearless badass.

AND THEN the show gives us his backstory to explain why he's both greedy and gruff. The world (especially his own father) has been extremely unkind to him, so he had to bee tough in order to survive. Meanwhile, he actually wants money so he can essentially buy his way back into his family (to make up for one impulsive, emotional act he made as teenager: smacking a table with something fragile on it). Also because he needs to keep the Mystery Shack property safe (paying Ford's mortgage) because that's where the portal is; furthermore, he needs to fund his repairs, engineering, and fuel for the portal, too.

Stan has spent 40 years of his life *only able to count on himself* while hard scrabbling through get-rich-quick schemes and cons (often with criminals and mobsters) just to win his family back. Of course he'd learn to act gruff and greedy. It's tragic, really. AND YET he stays silly. To the audience, at least. Always comedic, always entertaining, always heartwarming. Especially where Dipper and Mabel are concerned.

For those of you who don’t understand my righteous anger; I’m on 2 TV series, ELSBETH and RAISING KANAN. I’m filming SUPERMAN. Two years ago, I finished the fourth season of JACK RYAN. Last year I finished a run on Broadway in DEATH OF A SALESMAN. Even with my proof of employment, bank statements and real estate holdings, a white apartment owner DENIED my application to rent the apartment…..in Harlem, of all places. Racism and bigots are real. There are those who will do anything to destroy life’s journey for Black folks. When you deny our personal experiences, you are as vile and despicable.

Of course with Coraline aging up all her friends were now teens as well! Self assured and loyal Sienna was taking high school in stride, being part of the small team that created the school newspaper. She had already convinced both me and Art to give interviews on our chosen careers, it was hard to say no to someone so likeable.
Sierra, well, let’s just say I suspected my regular donations to R Triple C had all gone in to the fund for letting kids buy their own clothes and that he had used them all up. That was another thing, all the pronouns now belonged to zir apparently. The geeky goofball didn’t care about what people thought of her though so I hoped some of that fearlessness could rub off on Coraline.

He also co-owns Inazuma, where he provided funds to support talents when they first started streaming.
✩ ⋆ Rhinedottir: Albedo is a well-known artist with paintings displayed in museums and entries in history books. He also gained fame for his looks and knowledge in chemistry and science. Despite being an artist and streamer, he received a college scholarship for his exceptional intelligence. He joined Inazuma at Aether's invitation, where he gained even more popularity and began streaming.

As Florian grew up, he heard the regrets of people around him many times - for the accidental fire, for his parents who were willing to risk their lives to protect him from the fire, and for himself who had to live in an orphanage after losing his parents. When the director told these stories to the donors again and again, they would all sigh together, feeling this selfless love and praising the miracle of life.
Perhaps this is indeed a miracle that inherits love.
